21. Book of Inheritance (1/7)
٢١۔ كِتَابُ الْفَرَائِضِ ص ١
[Machine] "Omar Ibn Al Khattab said, 'Learn the obligations, melodies, and traditions just as you learn the Quran.'"
عُمَرُ بْنُ الْخَطَّابِ «تَعَلَّمُوا الْفَرَائِضَ وَاللَّحْنَ وَالسُّنَنَ كَمَا تَعَلَّمُونَ الْقُرْآنَ»
[Machine] The translation of the Arabic phrase "عُمَرُ «تَعَلَّمُوا الْفَرَائِضَ فَإِنَّهَا مِنْ دِينِكُمْ»" into English is: "Omar said, 'Learn the obligations, for they are part of your religion.'"
عُمَرُ «تَعَلَّمُوا الْفَرَائِضَ فَإِنَّهَا مِنْ دِينِكُمْ»
[Machine] Ibn Shihab said, "If Uthman and Zaid were to perish in some time, the knowledge of inheritance would also perish. Indeed, a time has come upon people and no one knows it except for these two."
ابْنُ شِهَابٍ «لَوْ هَلَكَ عُثْمَانُ وَزَيْدٌ فِي بَعْضِ الزَّمَانِ لَهَلَكَ عِلْمُ الْفَرَائِضِ لَقَدْ أَتَى عَلَى النَّاسِ زَمَانٌ وَمَا يَعْلَمُهَا غَيْرُهُمَا»
[Machine] "Abdullah said, 'Learn the Quran and the religious obligations, for soon a person may become in need of knowledge that he once knew or be surrounded by a people who are ignorant.'"
عَبْدُ اللَّهِ «تَعَلَّمُوا الْقُرْآنَ وَالْفَرَائِضَ فَإِنَّهُ يُوشِكُ أَنْ يَفْتَقِرَ الرَّجُلُ إِلَى عِلْمٍ كَانَ يَعْلَمُهُ أَوْ يَبْقَى فِي قَوْمٍ لَا يَعْلَمُونَ»
[Machine] "Abu Musa: Whoever knows the Quran but does not know the obligatory duties, his example is like a lighthouse without a light or without any essence."
أَبُو مُوسَى «مَنْ عَلِمَ الْقُرْآنَ وَلَمْ يَعْلَمِ الْفَرَائِضَ فَإِنَّ مَثَلَهُ مَثَلُ الْبُرْنُسِ لَا وَجْهَ لَهُ أَوْ لَيْسَ لَهُ وَجْهٌ»
[Machine] I said to Alqamah, "I don't know what to ask you about." He said, "Have your neighbors died?"
قُلْتُ لِعَلْقَمَةَ مَا أَدْرِي مَا أَسْأَلُكَ عَنْهُ قَالَ «أَمِتْ جِيرَانَكَ»
[Machine] Learn the obligations, divorce, and pilgrimage, for they are part of your religion.
«تَعَلَّمُوا الْفَرَائِضَ وَالطَّلَاقَ وَالْحَجَّ فَإِنَّهُ مِنْ دِينِكُمْ»
[Machine] "They used to have a desire to teach the Quran, religious obligations, and rituals."
«كَانُوا يُرَغِّبُونَ فِي تَعْلِيمِ الْقُرْآنِ وَالْفَرَائِضِ وَالْمَنَاسِكِ»
[Machine] "Whoever reads the Quran, let him learn the obligations, for if he meets an Arab, and the Arab asks, 'Do you read the Quran?' If he says 'Yes,' then he asks, 'Do you fulfill the obligations?' If he says 'Yes,' then it is something additional and good. But if he says 'No,' then the Arab asks, 'What is your superiority over me, O emigrant?'"
مَنْ قَرَأَ الْقُرْآنَ فَلْيَتَعَلَّمِ الْفَرَائِضَ فَإِنْ لَقِيَهُ أَعْرَابِيٌّ قَالَ يَا مُهَاجِرُ أَتَقْرَأُ الْقُرْآنَ؟ فَإِنْ قَالَ نَعَمْ قَالَ تَفْرِضُ؟ فَإِنْ قَالَ نَعَمْ فَهُوَ زِيَادَةٌ وَخَيْرٌ وَإِنْ قَالَ لَا قَالَ فَمَا فَضْلُكَ عَلَيَّ يَا مُهَاجِرُ
[Machine] We asked Masruq, "Did Aisha used to perform the obligatory duties well?" He replied, "By the One besides whom there is no God, I have seen the senior companions of Muhammad asking her about the obligatory duties."
سَأَلْنَا مَسْرُوقًا كَانَتْ عَائِشَةُ تُحْسِنُ الْفَرَائِضَ؟ قَالَ «وَالَّذِي لَا إِلَهَ غَيْرُهُ لَقَدْ رَأَيْتُ الْأَكَابِرَ مِنْ أَصْحَابِ مُحَمَّدٍ يَسْأَلُونَهَا عَنِ الْفَرَائِضِ»
21.2 [Machine] Who Claims Paternity Other Than His Father?
٢١۔٢ بَابُ: مَنِ ادَّعَى إِلَى غَيْرِ أَبِيهِ
[Machine] "This is the branch of the first person who threw an arrow in the way of Allah, and this is the rope of the fortress of Taif to the Messenger of Allah ﷺ. Indeed, they both mentioned that the Messenger of Allah ﷺ said, 'Whoever claims to belong to someone other than his father, knowing that he is not his father, Paradise is forbidden for him.'"
شُعْبَةُ هَذَا أَوَّلُ مَنْ رَمَى بِسَهْمٍ فِي سَبِيلِ اللَّهِ وَهَذَا تَدَلَّى حِصْنِ الطَّائِفِ إِلَى رَسُولِ اللَّهِ ﷺ إِنَّهُمَا حَدَّثَا أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنِ ادَّعَى إِلَى غَيْرِ أَبِيهِ وَهُوَ يَعْلَمُ أَنَّهُ غَيْرُ أَبِيهِ فَالْجَنَّةُ عَلَيْهِ حَرَامٌ»
[Machine] "Claiming lineage that is not recognized is disbelief in Allah, and disavowing lineage is disbelief in Allah even if it is true."
«كُفْرٌ بِاللَّهِ ادِّعَاءٌ إِلَى نَسَبٍ لَا يُعْرَفُ وَكُفْرٌ بِاللَّهِ تَبَرُّؤٌ مِنْ نَسَبٍ وَإِنْ دَقَّ»
عَنْ ابْنِ مَسْعُودٍ نَحْوًا مِنْهُ
[Machine] I came to the Prophet ﷺ to pledge allegiance to him, but when I arrived, he had passed away, and Abu Bakr was standing in his place. He praised and cried for a long time, then he said, "I heard the Messenger of Allah ﷺ saying, 'Disbelief is to deny one's lineage, even if it is known, and to claim a lineage that is unknown.'"
أَتَيْتُ النَّبِيَّ ﷺ لِأُبَايِعَهُ فَجِئْتُ وَقَدْ قُبِضَ وَأَبُو بَكْرٍ قَائِمٌ فِي مَقَامِهِ فَأَطَالَ الثَّنَاءَ وَأَكْثَرَ الْبُكَاءَ فَقَالَ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «كُفْرٌ بِاللَّهِ انْتِفَاءٌ مِنْ نَسَبٍ وَإِنْ دَقَّ وَادِّعَاءُ نَسَبٍ لَا يُعْرَفُ»
[Machine] The Messenger of Allah ﷺ said: "Whoever claims to have a relationship with someone other than his biological father, or supports those who are not his legal guardians, those who have freed him from slavery, then upon him is the curse of Allah, the angels, and all people, until the Day of Judgment. His expenditures and testimonies will not be accepted."
قَالَ رَسُولُ اللَّهِ ﷺ «أَيُّمَا رَجُلٍ ادَّعَى إِلَى غَيْرِ وَالِدِهِ أَوْ تَوَلَّى غَيْرَ مَوَالِيهِ الَّذِينَ أَعْتَقُوهُ فَإِنَّ عَلَيْهِ لَعْنَةَ اللَّهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ إِلَى يَوْمِ الْقِيَامَةِ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ»
21.3 [Machine] In a husband, two parents, a woman, and two parents
٢١۔٣ بَابُ: فِي زَوْجٍ وَأَبَوَيْنِ وَامْرَأَةٍ وَأَبَوَيْنِ
[Machine] Abdullah used to say that when he traveled with us on a path, we found it easy. He also said about a husband and parents that "the husband gets half and the mother gets one-third of what is remaining."
عَبْدُ اللَّهِ كَانَ عُمَرُ إِذَا سَلَكَ بِنَا طَرِيقًا وَجَدْنَاهُ سَهْلًا وَإِنَّهُ قَالَ فِي زَوْجٍ وَأَبَوَيْنِ «لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ»
«قَسَّمَهَا زَيْدُ بْنُ ثَابِتٍ مِنْ أَرْبَعَةٍ»
[Machine] "In a woman and two parents, the woman receives one-fourth and the mother receives one-third of what remains."
فِي امْرَأَةٍ وَأَبَوَيْنِ «لِلْمَرْأَةِ الرُّبُعُ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ»
[Machine] He said to the woman: a quarter is one out of four, and for the mother is one-third of what remains as a share, and for the father are two shares.
أَنَّهُ قَالَ لِلْمَرْأَةِ الرُّبُعُ سَهْمٌ مِنْ أَرْبَعَةٍ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ سَهْمٌ وَلِلْأَبِ سَهْمَانِ
مِثْلَ قَوْلِ عُثْمَانَ
[Machine] "He said about a woman who left her husband and parents, 'The husband gets half, and the mother gets one-third of what remains.'"
أَنَّهُ قَالَ فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا وَأَبَوَيْهَا «لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ»
[Machine] From four parts for the woman, there remains a quarter, and for the mother, there remains a third of what is left, and what is left, belongs to the father.
مِنْ أَرْبَعَةٍ لِلْمَرْأَةِ الرُّبُعُ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَمَا بَقِيَ فَلِلْأَبِ
[Machine] "Umar would say, 'When we would travel on a path, we followed it and found it easy. Indeed, he passed a ruling regarding a woman and both parents from four. So he gave the woman a quarter and the mother a third of what remained, and the father received two shares.'"
كَانَ عُمَرُ «إِذَا سَلَكَ بِنَا طَرِيقًا اتَّبَعْنَاهُ فِيهِ وَجَدْنَاهُ سَهْلًا وَإِنَّهُ قَضَى فِي امْرَأَةٍ وَأَبَوَيْنِ مِنْ أَرْبَعَةٍ فَأَعْطَى الْمَرْأَةَ الرُّبُعَ وَالْأُمَّ ثُلُثَ مَا بَقِيَ وَالْأَبَ سَهْمَيْنِ»
عَنْ زَيْدِ بْنِ ثَابِتٍ مِثْلَ ذَلِكَ
[Machine] He used to say, "Allah would not have shown me to prefer a mother over a father."
كَانَ يَقُولُ مَا كَانَ اللَّهُ لِيَرَانِي أَنْ أُفَضِّلَ أُمًّا عَلَى أَبٍ
[Machine] Zaid said, "You are a man who speaks his opinion, and I am a man who speaks my opinion."
زَيْدٌ «إِنَّمَا أَنْتَ رَجُلٌ تَقُولُ بِرَأْيِكَ وَأَنَا رَجُلٌ أَقُولُ بِرَأْيِي»
[Machine] "From Ibn Abbas, they said about a husband and parents: 'The husband is entitled to half of the wealth, while the mother is entitled to one-third of the total wealth, and whatever is left belongs to the father.'"
عَنْ ابْنِ عَبَّاسٍ أَنَّهُمَا قَالَا فِي زَوْجٍ وَأَبَوَيْنِ «لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ ثُلُثُ جَمِيعِ الْمَالِ وَمَا بَقِيَ فَلِلْأَبِ»
[Machine] "Two-thirds of all the wealth goes to a mother in the form of a woman and two parents, and to a wife and two parents."
«لِلْأُمِّ ثُلُثُ جَمِيعِ الْمَالِ فِي امْرَأَةٍ وَأَبَوَيْنِ وَفِي زَوْجٍ وَأَبَوَيْنِ»
[Machine] Ibn Abbas disobeyed the people of the Qibla regarding a woman and her two parents, and he allocated one-third of all the wealth to the mother.
خَالَفَ ابْنُ عَبَّاسٍ أَهْلَ الْقِبْلَةِ فِي امْرَأَةٍ وَأَبَوَيْنِ جَعَلَ لِلْأُمِّ الثُّلُثَ مِنْ جَمِيعِ الْمَالِ
21.4 [Machine] In a daughter and sister
٢١۔٤ بَابٌ: فِي ابْنَةٍ وَأُخْتٍ
[Machine] Mu'adh ibn Jabal decided in Yemen in favor of a girl and a sister, so he gave half to the girl and half to the sister.
«قَضَى مُعَاذُ بْنُ جَبَلٍ بِالْيَمَنِ فِي بِنْتٍ وَأُخْتٍ فَأَعْطَى الْبِنْتَ النِّصْفَ وَالْأُخْتَ النِّصْفَ»
[Machine] "You are my messenger to Abdullah ibn Uthbata, so inform him of that." And he was his judge in Kufa.
«أَنْتَ رَسُولِي إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ فَأَخْبِرْهُ بِذَاكَ» وَكَانَ قَاضِيَهُ بِالْكُوفَةِ
[Machine] "Half for his daughter and what is left for his sister."
«لِابْنَتِهِ النِّصْفُ وَلِأُخْتِهِ مَا بَقِيَ»
21.5 [Machine] In the partnership
٢١۔٥ بَابُ: فِي الْمُشَرِّكَةِ
[Machine] About Ibrahim, in terms of a wife, a mother, and siblings from the father and mother, and siblings from the mother? He said, "Umar, Abdullah, and Zaid used to share things." Umar said, "Their father only increased their closeness."
عَنْ إِبْرَاهِيمَ فِي زَوْجٍ وَأُمٍّ وَإِخْوَةٍ لِأَبٍ وَأُمٍّ وَإِخْوَةٍ لِأُمٍّ؟ قَالَ كَانَ عُمَرُ وَعَبْدُ اللَّهِ وَزَيْدٌ يُشَرِّكُونَ وَقَالَ عُمَرُ «لَمْ يَزِدْهُمُ الْأَبُ إِلَّا قُرْبًا»
«أَنَّهُ كَانَ لَا يُشَرِّكُ»
[Machine] That Uthman used to associate partners with Allah, and Ali did not associate partners with Allah.
«أَنَّ عُثْمَانَ كَانَ يُشَرِّكُ وَعَلِيٌّ كَانَ لَا يُشَرِّكُ»
«أَنَّ زَيْدًا كَانَ يُشَرِّكُ»
«أَنَّهُ كَانَ يُشَرِّكُ»
[Machine] "In idolatry, the father did not bring them closer."
فِي الْمُشَرَّكَةِ «لَمْ يَزِدْهُمُ الْأَبُ إِلَّا قُرْبًا»
21.6 [Machine] In my paternal cousin's sons: one of them is a husband and the other is a maternal uncle.
٢١۔٦ بَابُ: فِي ابْنَيْ عَمٍّ: أَحَدُهُمَا زَوْجٌ وَالْآخَرُ أَخٌ لِأُمٍّ
[Machine] Abdullah came concerning the obligation of the half-brothers from the mother's side. He said that all the property belongs to his brother, his mother's son, so he distributed it to him according to the share of a full brother from the father's side and the mother's side. When Ali arrived, I asked him about it and informed him of Abdullah's statement. He said, "May Allah have mercy on him. If he was a jurist, then perhaps I would have increased his share beyond what Allah had prescribed for him, which is one-sixth. Then he would have divided it among them like a man from among them."
أُتِيَ عَبْدُ اللَّهِ فِي فَرِيضَةِ بَنِي عَمٍّ أَحَدُهُمْ أَخٌ لِأُمٍّ فَقَالَ الْمَالُ أَجْمَعُ لِأَخِيهِ لِأُمِّهِ فَأَنْزَلَهُ بِحِسَابِ أَوْ بِمَنْزِلَةِ الْأَخِ مِنَ الْأَبِ وَالْأُمِّ فَلَمَّا قَدِمَ عَلِيٌّ سَأَلْتُهُ عَنْهَا وَأَخْبَرْتُهُ بِقَوْلِ عَبْدِ اللَّهِ فَقَالَ يَرْحَمُهُ اللَّهُ إِنْ كَانَ لَفَقِيهًا أَمَّا أَنَا فَلَمْ أَكُنْ لِأَزِيدَهُ عَلَى مَا فَرَضَ اللَّهُ لَهُ سَهْمٌ السُّدُسُ ثُمَّ يُقَاسِمُهُمْ كَرَجُلٍ مِنْهُمْ
[Machine] Ali said, "If he was a scholar, even if it were me, I would have given him one-sixth and what is left would be between them."
عَلِيٌّ «إِنْ كَانَ لَفَقِيهًا وَلَوْ كُنْتُ أَنَا أَعْطَيْتُهُ السُّدُسَ وَمَا بَقِيَ كَانَ بَيْنَهُمْ»
21.7 [Machine] In a daughter and a son of a son, and a sister of a father and a mother
٢١۔٧ بَابُ: فِي بِنْتٍ وَابْنَةِ ابْنٍ، وَأُخْتٍ لِأَبٍ وَأُمٍّ
“A man came to Abu Musa Al-Ash’ari and Salman bin Rabi’ah Al-Bahili and asked them about (the shares of) a daughter, a son’s daughter, a sister through one’s father and mother. They said: ‘The daughter gets one half, and what is left goes to the sister. Go to Ibn Mas’ud, for he will concur with what we say.’ So the man went to Ibn Mas’ud, and told him what they had said. ‘Abdullah said: ‘I will go astray and will not be guided (if I say that I agree); but I will judge as the Messenger of Allah ﷺ judged. The daughter gets one half, and the son’s daughter gets one- sixth. That makes two thirds. And what is left goes to the sister.’” (Using translation from Ibn Mājah 2721)
لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَإِنِّي أَقْضِي بِمَا قَضَى بِهِ رَسُولُ اللَّهِ ﷺ «لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُخْتِ»
21.8 [Machine] In brothers, sisters and children, and descendants of descendants.
٢١۔٨ بَابُ: فِي الْإِخْوَةِ وَالْأَخَوَاتِ وَالْوَلَدِ، وَوَلَدِ الْوَلَدِ
[Machine] He used to say about sisters from the same father and mother, brothers, and sisters from the same father, that two-thirds of the inheritance should be given to them. As for the remaining portion, it belongs to the males and not the females. A thief came to the city and heard Zaid's statement in it, and he admired it. Some of his companions said to him, "Would you abandon the statement of Abdullah?" He replied, "I came to the city and found Zaid ibn Thabit from the knowledgeable people. Ahmad said, so I asked Abu Shihab, "And how did Zaid say about it?" He said, "He divided it among them."
أَنَّهُ كَانَ يَقُولُ فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ لِلْأَخَوَاتِ لِلْأَبِ وَالْأُمِّ الثُّلُثَانِ وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ فَقَدِمَ مَسْرُوقٌ الْمَدِينَةَ فَسَمِعَ قَوْلَ زَيْدٍ فِيهَا فَأَعْجَبَهُ فَقَالَ لَهُ بَعْضُ أَصْحَابِهِ أَتَتْرُكُ قَوْلَ عَبْدِ اللَّهِ؟ قَالَ إِنِّي أَتَيْتُ الْمَدِينَةَ فَوَجَدْتُ زَيْدَ بْنَ ثَابِتٍ مِنَ الرَّاسِخِينَ فِي الْعِلْمِ قَالَ أَحْمَدُ فَقُلْتُ لِأَبِي شِهَابٍ وَكَيْفَ قَالَ زَيْدٌ فِيهَا؟ قَالَ «شَرَّكَ بَيْنَهُمْ»
[Machine] "In a family of a father and mother, and brothers and sisters of the father, he used to give the sisters from the father and mother two-thirds, and the remaining portion was for the males and not the females." So a wise person said, Zayd ibn Thabit said, "This is a practice from the time of ignorance, that men would inherit more than women, even though their sisters are the ones taking care of them."
فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ «أَنَّهُ كَانَ يُعْطِي الْأَخَوَاتِ مِنَ الْأَبِ وَالْأُمِّ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ» فَقَالَ حَكِيمٌ قَالَ زَيْدُ بْنُ ثَابِتٍ «هَذَا مِنْ عَمَلِ الْجَاهِلِيَّةِ أَنْ يَرِثَ الرِّجَالُ دُونَ النِّسَاءِ إِنَّ إِخْوَتَهُنَّ قَدْ رُدُّوا عَلَيْهِنَّ»
[Machine] She used to divide between two daughters, a granddaughter, and a great-grandson, giving the two daughters two-thirds and keeping the remaining portion for herself.
أَنَّهَا كَانَتْ تُشَرِّكُ بَيْنَ ابْنَتَيْنِ وَابْنَةِ ابْنٍ وَابْنِ ابْنٍ تُعْطِي الِابْنَتَيْنِ الثُّلُثَيْنِ وَمَا بَقِيَ فَشَرِكتُهُمْ
[Machine] Ibn Mas'ud used to say about a daughter, the daughters of a son, and the sons of a son, "If the division between them is less than one sixth, he gave them one sixth, and if it is more than one sixth, he gave them one sixth."
أَنَّ ابْنَ مَسْعُودٍ كَانَ يَقُولُ فِي بِنْتٍ وَبَنَاتِ ابْنٍ وَابْنِ ابْنٍ «إِنْ كَانَتِ الْمُقَاسَمَةُ بَيْنَهُمْ أَقَلَّ مِنَ السُّدُسِ أَعْطَاهُمُ السُّدُسَ وَإِنْ كَانَ أَكْثَرَ مِنَ السُّدُسِ أَعْطَاهُمُ السُّدُسَ»
[Machine] Does anyone of them have a stronger proof than Abdullah? He said, "No, but I have seen Zaid ibn Thabit and the people of Madinah associating in marriage with two daughters, a granddaughter, a grandson, and two sisters."
لَهُ عَلْقَمَةُ هَلْ أَحَدٌ مِنْهُمْ أَثْبَتُ مِنْ عَبْدِ اللَّهِ؟ فَقَالَ لَا وَلَكِنِّي «رَأَيْتُ زَيْدَ بْنَ ثَابِتٍ وَأَهْلَ الْمَدِينَةِ يُشَرِّكُونَ فِي ابْنَتَيْنِ وَبِنْتِ ابْنٍ وَابْنِ ابْنٍ وَأُخْتَيْنِ»
[Machine] About Shurayh, he said: "Regarding a woman who left her husband, mother, and sister to live with her father, mother, and sister from her father's side, and her brothers from her mother's side, he divided her inheritance into six shares. Then he increased it until it reached ten shares. The husband receives half of the inheritance (three shares), the sister from the father and mother each receive half of the inheritance (three shares), the mother receives one-sixth of the inheritance, the brothers from the mother receive two-thirds of the inheritance, and the sister from the father receives one share, to complete the two thirds."
عَنْ شُرَيْحٍ «فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا وَأُمَّهَا وَأُخْتَهَا لِأَبِيهَا وَأُمِّهَا وَأُخْتَهَا لِأَبِيهَا وَإِخْوَتَهَا لِأُمِّهَا جَعَلَهَا مِنْ سِتَّةٍ ثُمَّ رَفَعَهَا فَبَلَغَتْ عَشَرَةً لِلزَّوْجِ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ وَلِلْأُخْتِ مِنَ الْأَبِ وَالْأُمِّ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ وَلِلْأُمِّ السُّدُسُ سَهْمٌ وَلِلْإِخْوَةِ مِنَ الْأُمِّ الثُّلُثُ سَهْمَانِ وَلِلْأُخْتِ مِنَ الْأَبِ سَهْمٌ تَكْمِلَةُ الثُّلُثَيْنِ»
21.9 [Machine] In the Mamluks and the People of the Book
٢١۔٩ بَابُ: فِي الْمَمْلُوكِينَ وَأَهْلِ الْكِتَابِ
[Machine] Ali and Zaid used to not be hindered by the disbelievers or the slaves, and they would not inherit anything from them. Abdullah, on the other hand, would be hindered by the disbelievers and the slaves, and he would not inherit anything from them.
أَنَّ عَلِيًّا وَزَيْدًا «كَانَا لَا يَحْجُبَانِ بِالْكُفَّارِ وَلَا بِالْمَمْلُوكِينَ وَلَا يُوَرِّثَانِهِمْ شَيْئًا» وَكَانَ عَبْدُ اللَّهِ «يَحْجُبُ بِالْكُفَّارِ وَبِالْمَمْلُوكِينَ وَلَا يُوَرِّثُهُمْ»
[Machine] Ali and Zaid said, "The slaves and the people of the Book do not wear the hijab or inherit." And Abdullah said, "They wear the hijab and do not inherit."
أَنَّ عَلِيًّا وَزَيْدًا قَالَا «الْمَمْلُوكُونَ وَأَهْلُ الْكِتَابِ لَا يَحْجُبُونَ وَلَا يَرِثُونَ» وَقَالَ عَبْدُ اللَّهِ «يَحْجُبُونَ وَلَا يَرِثُونَ»
21.10 [Machine] Translation: "Al-Jaddi
٢١۔١٠ بَابُ: الْجَدِّ
[Machine] That Omar wrote the inheritance of his grandfather until, when it was criticized, he called for it and erased it, then he said, "You will see your opinion about it."
أَنَّ عُمَرَ كَانَ كَتَبَ مِيرَاثَ الْجَدِّ حَتَّى إِذَا طُعِنَ دَعَا بِهِ فَمَحَاهُ ثُمَّ قَالَ «سَتَرَوْنَ رَأْيَكُمْ فِيهِ»
