٢١۔ كِتَابُ الْفَرَائِضِ ص ٢
«إِنِّي لَأَحْفَظُ فِي الْجَدِّ ثَمَانِينَ قَضِيَّةً مُخْتَلِفَةً»
[Machine] "If there is no seriousness in it, then give it to me."
«إِنْ لَمْ يَكُنْ فِيهَا جَدٌّ فَهَاتِهَا»
[Machine] "If he wants to leap into the flames of Hell, let him settle matters between the grandfather and the brothers."
أَنْ يَتَقَحَّمَ جَرَاثِيمَ جَهَنَّمَ فَلْيَقْضِ بَيْنَ الْجَدِّ وَالْإِخْوَةِ»
21.11 [Machine] The statement of Abu Bakr regarding the grandfather
٢١۔١١ بَابُ: قَوْلِ أَبِي بَكْرٍ فِي الْجَدِّ
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ
[Machine] "That Abu Bakr Al-Siddiq made determination his father."
«أَنَّ أَبَا بَكْرٍ الصِّدِّيقَ جَعَلَ الْجَدَّ أَبًا»
[Machine] Abu Bakr Al-Siddiq was known for his fatherly seriousness.
أَنَّ أَبا بَكْرٍ الصِّدِّيقِ «جَعَلَ الْجَدَّ أَبًا»
«أَنَّ أَبَا بَكْرٍ جَعَلَ الْجَدَّ أَبًا»
[Machine] Abu Bakr used to consider his grandfather as a father.
أَنَّ أَبَا بَكْرٍ «كَانَ يَجْعَلُ الْجَدَّ أَبًا»
[Machine] Abu Bakr used to consider his grandfather as (his own) father.
أَنَّ أَبَا بَكْرٍ كَانَ يَجْعَلُ الْجَدَّ أَبًا
[Machine] "Indeed, a grandfather does not hold the same position as a father in your eyes, and you do not deny." He (the interrogator) said, "I said, even if you were (the father), you would not deny." Marwan said, "I bear witness regarding Uthman bin Affan that he testified regarding Abu Bakr that he made the grandfather (as) a father when there is no father."
أَنَّ الْجَدَّ لَا يُنَزَّلُ فِيكُمْ مَنْزِلَةَ الْأَبِ وَأَنْتَ لَا تُنْكِرُ؟ قَالَ قُلْتُ وَلَوْ كُنْتَ أَنْتَ لَمْ تُنْكِرْ قَالَ مَرْوَانُ فَأَنَا أَشْهَدُ عَلَى عُثْمَانَ بْنِ عَفَّانَ أَنَّهُ شَهِدَ عَلَى أَبِي بَكْرٍ «أَنَّهُ جَعَلَ الْجَدَّ أَبًا إِذَا لَمْ يَكُنْ دُونَهُ أَبٌ»
[Machine] That Abu Bakr "used to consider his grandfather as a father."
أَنَّ أَبَا بَكْرٍ «كَانَ يَجْعَلُ الْجَدَّ أَبًا»
[Machine] The Messenger of Allah ﷺ said, "If I were to take anyone as my intimate friend, I would have taken Abu Bakr as my intimate friend. However, the brotherhood of Islam is superior." This means that Abu Bakr was made a father, which means a grandfather.
قَالَ رَسُولُ اللَّهِ ﷺ «لَوْ كُنْتُ مُتَّخِذًا أَحَدًا خَلِيلًا لَاتَّخَذْتُهُ خَلِيلًا وَلَكِنْ أُخُوَّةُ الْإِسْلَامِ أَفْضَلُ» يَعْنِي «أَبَا بَكْرٍ جَعَلَهُ أَبًا» يَعْنِي الْجَدَّ
«أَنَّ أَبَا بَكْرٍ جَعَلَ الْجَدَّ أَبًا»
[Machine] "Indeed, the grandfather's tradition has passed and indeed Abu Bakr made the grandfather a father, but people have chosen."
«إِنَّ الْجَدَّ قَدْ مَضَتْ سُنَّتُهُ وَإِنَّ أَبَا بَكْرٍ جَعَلَ الْجَدَّ أَبًا وَلَكِنَّ النَّاسَ تَخَيَّرُوا»
21.12 [Machine] In Omar's statement about al-Jadd.
٢١۔١٢ بَابُ: فِي قَوْلِ عُمَرَ فِي الْجَدِّ
«إِنَّ أَوَّلَ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَرُ»
[Machine] The first instance of inheritance in Islam was when Umar inherited his wealth. Ali and Zaid came to him and said, "That is not for you. You are just like one of the two brothers."
إِنَّ أَوَّلَ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَرُ فَأَخَذَ مَالَهُ فَأَتَاهُ عَلِيٌّ وَزَيْدٌ فَقَالَا «لَيْسَ لَكَ ذَاكَ إِنَّمَا أَنْتَ كَأَحَدِ الْأَخَوَيْنِ»
[Machine] Umar used to share with his brother and two siblings, and when they increased, he gave him one-third, and he gave him one-sixth with the child.
«كَانَ عُمَرُ يُقَاسِمُ بِالْجَدِّ مَعَ الْأَخِ وَالْأَخَوَيْنِ فَإِذَا زَادُوا أَعْطَاهُ الثُّلُثَ وَكَانَ يُعْطِيهِ مَعَ الْوَلَدِ السُّدُسَ»
[Machine] "I had seen an opinion in my grandfather, so if you see that you should follow it, then follow it." Uthman said to him, "If we follow your opinion, it is indeed guidance, and if we follow the opinion of the sheikh, then he is truly knowledgeable."
«إِنِّي كُنْتُ رَأَيْتُ فِي الْجَدِّ رَأْيًا فَإِنْ رَأَيْتُمْ أَنْ تَتَّبِعُوهُ فَاتَّبِعُوهُ» فَقَالَ لَهُ عُثْمَانُ إِنْ نَتَّبِعْ رَأْيَكَ فَإِنَّهُ رَشَدٌ وَإِنْ نَتَّبِعْ رَأْيَ الشَّيْخِ فَلَنِعْمَ ذُو الرَّأْيِ كَانَ
21.13 [Machine] The saying of Ali about seriousness
٢١۔١٣ بَابُ: قَوْلِ عَلِيٍّ فِي الْجَدِّ
[Machine] "To give importance to seriousness and not to give it to anyone afterwards."
«أَنْ أَعْطِ الْجَدَّ سُدُسًا وَلَا تُعْطِهِ أَحَدًا بَعْدَهُ»
[Machine] It seems that Al-Sha'bi means Ali, may Allah be pleased with him, narrated it from Ali, may Allah be pleased with him.
كَأَنَّهُ يَعْنِي عَلِيًّا رِضْوَانُ اللَّهِ عَلَيْهِ الشَّعْبِيُّ يَرْوِيهِ عَنْ عَلِيٍّ رِضْوَانُ اللَّهِ عَلَيْهِ
[Machine] Ali used to consider seriousness as a sixth sense.
أَنَّ عَلِيًّا «كَانَ يَجْعَلُ الْجَدَّ أَخًا مَتََى يَكُونَ سَادِسًا»
[Machine] "Ali used to distribute the share of the grandfather among the brothers equally."
أَنَّ عَلِيًّا «كَانَ يُشَرِّكُ الْجَدَّ مَعَ الْإِخْوَةِ إِلَى السُّدُسِ»
[Machine] "Ali used to mediate between the grandparents and siblings until he becomes the sixth."
«كَانَ عَلِيٌّ يُشَرِّكُ بَيْنَ الْجَدِّ وَالْإِخْوَةِ حَتَّى يَكُونَ سَادِسًا»
[Machine] "Ali used to share the inheritance equally among his six siblings. He would give each person their rightful share, and he would not grant an inheritance to a brother from the mother's side along with a paternal grandfather, nor to a sister from the mother's side. The grandfather's share would not exceed one-sixth even if there were other heirs. He would not divide the inheritance with a paternal brother along with a brother from the mother's side and mother. If there was a sister from the father's side, a sister from the mother's side, and a brother from the father's side, he would give the sister half and divide the other half equally between the grandfather and the brother. If they were brothers and sisters, he would share with them equally up to one-sixth."
«كَانَ عَلِيٌّ يُشَرِّكُ الْجَدَّ إِلَى سِتَّةٍ مَعَ الْإِخْوَةِ يُعْطِي كُلَّ صَاحِبِ فَرِيضَةٍ فَرِيضَتَهُ وَلَا يُوَرِّثُ أَخًا لِأُمٍّ مَعَ جَدٍّ وَلَا أُخْتًا لِأُمٍّ وَلَا يَزِيدُ الْجَدَّ مَعَ الْوَلَدِ عَلَى السُّدُسِ إِلَّا أَنْ يَكُونَ غَيْرُهُ وَلَا يُقَاسِمُ بِأَخٍ لِأَبٍ مَعَ أَخٍ لِأَبٍ وَأُمٍّ وَإِذَا كَانَتْ أُخْتٌ لِأَبٍ وَأُمٍّ وَأَخٌ لِأَبٍ أَعْطَى الْأُخْتَ النِّصْفَ وَالنِّصْفَ الْآخَرَ بَيْنَ الْجَدِّ وَالْأَخِ نِصْفَيْنِ وَإِذَا كَانُوا إِخْوَةً وَأَخَوَاتٍ شَرَّكَهُمْ مَعَ الْجَدِّ إِلَى السُّدُسِ»
21.14 [Machine] The saying of Ibn Abbas regarding Al-Jad.
٢١۔١٤ بَابُ: قَوْلِ ابْنِ عَبَّاسٍ فِي الْجَدِّ
[Machine] "Who is your oldest father?" So I said, "I am Adam." He said, "Have you not heard the saying of Allah the Almighty, 'O Children of Adam' (Surah Al-A'raf 26)."
«أَيُّ أَبٍ لَكَ أَكْبَرُ؟» فَقُلْتُ أَنَا آدَمُ قَالَ أَلَمْ تَسْمَعْ إِلَى قَوْلِ اللَّهِ تَعَالَى {يَا بَنِي آدَمَ} [الأعراف 26]
[Machine] "I wish that both I and those who disagree with me in seriousness would curse each other, so which of us is worse in speech."
«لَوَدِدْتُ أَنِّي وَالَّذِينَ يُخَالِفُونَنِي فِي الْجَدِّ تَلَاعَنَّا أَيُّنَا أَسْوَأُ قَوْلًا»
«أَنَّهُ جَعَلَ الْجَدَّ أَبًا»
21.15 [Machine] The saying of Ibn Mas'ood about Al-Jadd.
٢١۔١٥ بَابُ: قَوْلِ ابْنِ مَسْعُودٍ فِي الْجَدِّ
[Machine] Do I have any sisters? I said no. He said that the husband's share is a half and the mother's share is a third. He said, "So I tried my best to answer me and he did not answer me except by that." Ibrahim and 'Amir and 'Abdul-Rahman ibn 'Abdullah said, "No one has ever come with a obligation more confusing than the obligation you came with." He said, "So I came to 'Ubaidah As-Salmani and it was said that no one in Kufa knows more about a obligation than 'Ubaidah and Al-Harith Al-A'war. 'Ubaidah used to sit in the mosque, and when Shurayh came with an obligation that had a difficulty, he would refer it to 'Ubaidah, and he would give a ruling. So I asked him and he said, "If you want, I can tell you about the obligation of Abdullah ibn Mas'ood in this matter. He said, "For the husband, there are three shares, half for the wife, a third for the mother, and a sixth of the remaining capital for the father-in-law." Abu Ishaq said, "The father-in-law is the grandfather."
لِي هَلْ مِنْ أُخْتٍ؟ قُلْتُ لَا قَالَ لِلْبَعْلِ الشَّطْرُ وَلِلْأُمِّ الثُّلُثُ قَالَ فَجَهِدْتُ عَلَى أَنْ يُجِيبَنِي فَلَمْ يُجِبْنِي إِلَّا بِذَلِكَ فَقَالَ إِبْرَاهِيمُ وَعَامِرٌ وَعَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ مَا جَاءَ أَحَدٌ بِفَرِيضَةٍ أَعْضَلَ مِنْ فَرِيضَةٍ جِئْتَ بِهَا قَالَ فَأَتَيْتُ عَبِيدَةَ السَّلْمَانِيَّ وَكَانَ يُقَالُ لَيْسَ بِالْكُوفَةِ أَحَدٌ أَعْلَمَ بِفَرِيضَةٍ مِنْ عَبِيدَةَ وَالْحَارِثِ الْأَعْوَرِ وَكَانَ عَبِيدَةُ يَجْلِسُ فِي الْمَسْجِدِ فَإِذَا وَرَدَتْ عَلَى شُرَيْحٍ فَرِيضَةٌ فِيهَا جَدٌّ رَفَعَهُمْ إِلَى عَبِيدَةَ فَفَرَضَ فَسَأَلْتُهُ فَقَالَ إِنْ شِئْتُمْ نَبَّأْتُكُمْ بِفَرِيضَةِ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ فِي هَذَا «جَعَلَ لِلزَّوْجِ ثَلَاثَةَ أَسْهُمٍ النِّصْفَ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ السُّدُسُ مِنْ رَأْسِ الْمَالِ وَلِلْأَخِ سَهْمٌ وَلِلْجَدِّ سَهْمٌ» قَالَ أَبُو إِسْحَاقَ «الْجَدُّ أَبُو الْأَبِ»
21.16 [Machine] The statement of Zaid about the grandfather.
٢١۔١٦ بَابُ: قَوْلِ زَيْدٍ فِي الْجَدِّ
[Machine] Zaid used to divide the grandfather's inheritance equally among the siblings, according to one-third.
أَنَّ زَيْدًا «كَانَ يُشَرِّكُ الْجَدَّ مَعَ الْإِخْوَةِ إِلَى الثُّلُثِ»
[Machine] "It was the case that he would share with his brothers the work with great effort, up to one-third, and then he would not diminish it."
«أَنَّهُ كَانَ يُقَاسِمُ بِالْجَدِّ مَعَ الْإِخْوَةِ إِلَى الثُّلُثِ ثُمَّ لَا يُنْقِصُهُ»
[Machine] "Amir said, 'Take from the matter of the ancestors what the people have agreed upon.'" Abu Muhammad said, meaning the statement of Zaid.
عَامِرٌ «خُذْ مِنْ أَمْرِ الْجَدِّ مَا اجْتَمَعَ النَّاسُ عَلَيْهِ» قَالَ أَبُو مُحَمَّدٍ يَعْنِي قَوْلَ زَيْدٍ
21.17 [Machine] Alexandria: Husband, sister to a father and mother, grandfather, and mother
٢١۔١٧ بَابُ: الْأَكْدَرِيَّةِ: زَوْجٌ، وَأُخْتٌ لِأَبٍ وَأُمٍّ، وَجَدٌّ، وَأُمٌّ
[Machine] He made them twenty-seven for the mother, six for the wife, nine for the husband, eight for the grandfather, and four for the sister.
جَعَلَهَا مِنْ سَبْعٍ وَعِشْرِينَ لِلْأُمِّ سِتَّةٌ وَلِلزَّوْجِ تِسْعَةٌ وَلِلْجَدِّ ثَمَانِيَةٌ وَلِلْأُخْتِ أَرْبَعَةٌ
21.18 [Machine] In the neighborhoods
٢١۔١٨ بَابُ: فِي الْجَدَّاتِ
[Machine] "The first grandmother who was fed in Islam is either a mother or her living son."
«إِنَّ أَوَّلَ جَدَّةٍ أُطْعِمَتْ فِي الْإِسْلَامِ سَهْمًا أَمُّ أَبٍ وَابْنُهَا حَيٌّ»
[Machine] The translation of the Arabic phrase أَنَّ النَّبِيَّ ﷺ «أَطْعَمَ جَدَّةً سُدُسًا» into English is "Indeed, the Prophet peace be upon him fed a group with one-sixth of the amount."
أَنَّ النَّبِيَّ ﷺ «أَطْعَمَ جَدَّةً سُدُسًا»
[Machine] It means: "Umar inherited a grandmother with her son."
أَنَّ عُمَرَ «وَرَّثَ جَدَّةً مَعَ ابْنِهَا»
[Machine] "The Prophet Muhammad ﷺ fed three granaries with one-sixth of their crops." I asked Ibrahim, "Who are they?" He said, "Your paternal grandmother is one of them, and your maternal grandmother is the other."
«أَطْعَمَ رَسُولُ اللَّهِ ﷺ ثَلَاثَ جَدَّاتٍ سُدُسًا» قَالَ قُلْتُ لِإِبْرَاهِيمَ مَنْ هُنَّهْ؟ قَالَ جَدَّتَاكَ مِنْ قِبَلِ أَبِيكَ وَجَدَّتُكَ مِنْ قِبَلِ أُمِّكَ
«تَرِثُ الْجَدَّةُ وَابْنُهَا حَيٌّ»
[Machine] "Do not inherit the son of his mother's mother, whom she does not give birth to, so how will she inherit?"
«لَا تَرِثُ أُمُّ أَبِ الْأُمِّ ابْنُهَا الَّذِي تُدْلِي بِهِ لَا يَرِثُ فَكَيْفَ تَرِثُ هِيَ؟»
«تَرِثُ الْجَدَّةُ وَابْنُهَا حَيٌّ»
21.19 [Machine] The statement of Abu Bakr As-Siddiq about genealogy
٢١۔١٩ بَابُ: قَوْلِ أَبِي بَكْرٍ الصِّدِّيقِ فِي الْجَدَّاتِ
[Machine] Abu Bakr's grandmother, the mother of his father or the mother of his mother, came to him and said, "My son's son or my daughter's son has passed away and I was informed that I have a share. What is it for me?" Abu Bakr replied, "I did not hear the Messenger of Allah ﷺ saying anything about this, but I will ask the people." After performing the Dhuhr prayer, Abu Bakr asked, "Which one of you heard the Messenger of Allah ﷺ saying something about the grandmother?" Al-Mughirah bin Shu'bah replied, "I heard him saying, 'He gave her one-sixth.'" Abu Bakr asked, "Does anyone else know this except you?" Muhammad bin Muslimah said, "Yes, he is truthful." So Abu Bakr gave her one-sixth. Then another woman with a similar case came to Umar and said, "I do not know what I have heard from the Messenger of Allah ﷺ about this, but I will ask the people." They informed her with the narration of Al-Mughirah bin Shu'bah and Muhammad bin Muslimah. Umar said, "If any one of you had a share by herself, she should have one-sixth, but if both of you share together, then it is between you."
جَاءَتْ إِلَى أَبِي بَكْرٍ جَدَّةٌ أُمُّ أَبٍ أَوْ أُمُّ أُمٍّ فَقَالَتْ إِنَّ ابْنَ ابْنِي أَوِ ابْنَ ابْنَتِي تُوُفِّيَ وَبَلَغَنِي أَنَّ لِي نَصِيبًا فَمَا لِي؟ فَقَالَ أَبُو بَكْرٍ مَا سَمِعْتُ رَسُولَ اللَّهِ ﷺ قَالَ فِيهَا شَيْئًا وَسَأَسْأَلُ النَّاسَ فَلَمَّا صَلَّى الظُّهْرَ فقَالَ أَيُّكُمْ سَمِعَ رَسُولَ اللَّهِ ﷺ قَالَ فِي الْجَدَّةِ شَيْئًا؟ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ أَنَا قَالَ مَاذَا؟ قَالَ «أَعْطَاهَا رَسُولُ اللَّهِ ﷺ سُدُسًا» قَالَ أَيَعْلَمُ ذَاكَ أَحَدٌ غَيْرُكَ؟ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ صَدَقَ فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ فَجَاءَتْ إِلَى عُمَرَ مِثْلُهَا فَقَالَ مَا أَدْرِي مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ فِيهَا شَيْئًا وَسَأَسْأَلُ النَّاسَ فَحَدَّثُوهُ بِحَدِيثِ الْمُغِيرَةِ بْنِ شُعْبَةَ وَمُحَمَّدِ بْنِ مَسْلَمَةَ فَقَالَ عُمَرُ «أَيُّكُمَا خَلَتْ بِهِ فَلَهَا السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فَهُوَ بَيْنَكُمَا»
21.20 [Machine] The saying of Ali and Zaid about the grandmothers
٢١۔٢٠ بَابُ: قَوْلِ عَلِيٍّ وَزَيْدٍ فِي الْجَدَّاتِ
[Machine] Ali and Zaid said, "When the grandmothers are equal, the inheritance is distributed among three grandmothers: the grandmother of his father, the grandmother of his mother, and the grandmother of his father's mother. If one of them is closer, then the relatives of the deceased have the right to inherit.”
عَنْ عَلِيٍّ وَزَيْدٍ قَالَا «إِذَا كَانَتِ الْجَدَّاتُ سَوَاءً وَرِثَ ثَلَاثُ جَدَّاتٍ جَدَّتَا أَبِيهِ أُمُّ أُمِّهِ وَأُمُّ أَبِيهِ وَجَدَّةُ أُمِّهِ فَإِنْ كَانَتْ إِحَدَاهُنَّ أَقْرَبَ فَالسَّهْمُ لِذَوِي الْقُرْبَى»
[Machine] About Ali and Zaid, "They used to not inherit the grandmother, mother of the father, along with the father."
عَنْ عَلِيٍّ وَزَيْدٍ «أَنَّهُمَا كَانَا لَا يُوَرِّثَانِ الْجَدَّةَ أُمَّ الْأَبِ مَعَ الْأَبِ»
[Machine] That Uthman used to not inherit the grandmother and her son while they are alive.
أَنَّ عُثْمَانَ «كَانَ لَا يُوَرِّثُ الْجَدَّةَ وَابْنُهَا حَيٌّ»
21.21 [Machine] The statement of Ibn Mas'ud about grandparents
٢١۔٢١ بَابُ: قَوْلِ ابْنِ مَسْعُودٍ فِي الْجَدَّاتِ
[Machine] "Indeed, grandmothers do not have inheritance, they are merely a provision that we provide. And grandmothers are the closest and farthest among them are equal."
«إِنَّ الْجَدَّاتِ لَيْسَ لَهُنَّ مِيرَاثٌ إِنَّمَا هِيَ طُعْمَةٌ أُطْعِمْنَهَا وَالْجَدَّاتُ أَقْرَبُهُنَّ وَأَبْعَدُهُنَّ سَوَاءٌ»
[Machine] "Abdullah inherits the grandmother and her son is alive."
عَبْدُ اللَّهِ «تَرِثُ الْجَدَّةُ وَابْنُهَا حَيٌّ»
21.22 [Machine] A stolen saying in traditions
٢١۔٢٢ بَابُ: قَوْلِ مَسْرُوقٍ فِي الْجَدَّاتِ
[Machine] Four grandmothers arrived, competing for the position of stolen. He canceled either the mother or the father of the mother, and inherited three: his paternal grandmother, his maternal grandmother, and his paternal grandfather's mother.
جِئْنَ أَرْبَعُ جَدَّاتٍ يَتَسَاوَقْنَ إِلَى مَسْرُوقٍ فَأَلْغَى أَمَّ أَبِي الْأُمِّ وَوَرَّثَ ثَلَاثًا جَدَّتَيْ أَبِيهِ أُمَّ أُمِّهِ وَأُمَّ أَبِيهِ وَجَدَّةَ أُمِّهِ

٢١۔٢٣ بَابُ: قَوْلِ عَلِيٍّ وَعَبْدِ اللَّهِ وَزَيْدٍ فِي الرَّدِّ
[Machine] "The half and the sixth and what remains is an odd number on the girl."
«النِّصْفُ وَالسُّدُسُ وَمَا بَقِيَ فَرَدٌّ عَلَى الْبِنْتِ»
[Machine] "It came to pass that there were two brothers from one mother and father. He gave one-third of the wealth to the brothers from the mother, and the rest of the wealth to the mother. And he said, 'The mother is a tie for those who have no family tie.'"
أَنَّهُ أُتِيَ فِي إِخْوَةٍ لِأُمٍّ وَأُمٍّ فَأَعْطَى الْإِخْوَةَ مِنَ الْأُمِّ الثُّلُثَ وَالْأُمَّ سَائِرَ الْمَالِ وَقَالَ «الْأُمُّ عَصَبَةُ مَنْ لَا عَصَبَةَ لَهُ»
[Machine] About a man who died and left his daughter with no known heir; he said, "She inherits all his wealth."
عَنْ رَجُلٍ مَاتَ وَتَرَكَ ابْنَتَهُ لَا يُعْلَمُ وَارِثٌ غَيْرُهَا قَالَ «لَهَا الْمَالُ كُلُّهُ»
[Machine] That Ibn Mas'ood used to not respond to a brother of his mother when his mother was present, nor to a grandmother when she was accompanied by someone other than her, nor to the daughter of a son with the daughter of a step-son, nor to a woman and her husband. And Ali used to respond to everyone with a question, except for a woman and her husband.
أَنَّ ابْنَ مَسْعُودٍ «كَانَ لَا يَرُدُّ عَلَى أَخٍ لِأُمٍّ مَعَ أُمٍّ وَلَا عَلَى جَدَّةٍ إِذَا كَانَ مَعَهَا غَيْرُهَا مِمَّنْ لَهُ فَرِيضَةٌ وَلَا عَلَى ابْنَةِ ابْنٍ مَعَ ابْنَةِ الصُّلْبِ وَلَا عَلَى امْرَأَةٍ وَزَوْجٍ» وَكَانَ عَلِيٌّ يَرُدُّ عَلَى كُلِّ ذِي سَهْمٍ إِلَّا الْمَرْأَةَ وَالزَّوْجَ
