٢١۔ كِتَابُ الْفَرَائِضِ ص ٣
[Machine] "And it was given to a daughter or sister, so he gave her half and left what remained in the treasury." Yazid bin Harun narrated from Muhammad bin Salim, from Ash-Sha'bi, from Kharijah.
«أَنَّهُ أُتِيَ فِي ابْنَةٍ أَوْ أُخْتٍ فَأَعْطَاهَا النِّصْفَ وَجَعَلَ مَا بَقِيَ فِي بَيْتِ الْمَالِ» وقَالَ يَزِيدُ بْنُ هَارُونَ عَنْ مُحَمَّدِ بْنِ سَالِمٍ عَنْ الشَّعْبِيِّ عَنْ خَارِجَةَ
21.24 [Machine] In the inheritance of the cursed son.
٢١۔٢٤ بَابُ: فِي مِيرَاثِ ابْنِ الْمُلَاعَنَةِ
«مِيرَاثُهُ لِأُمِّهِ»
«لِأُمِّهِ وَأَهْلِهَا»
[Machine] Ibn Mas'ood said to his brother Al-Sudus, "Take what is left, and what remains is for the mother."
وقَالَ ابْنُ مَسْعُودٍ «لِأَخِيهِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُمِّ»
«الْمَالُ لِابْنِ الْأَخِ»
[Machine] About Zaid ibn Thabit regarding the inheritance of the accursed son, "One-third for his mother and two-thirds for the treasury."
عَنْ زَيْدِ بْنِ ثَابِتٍ فِي مِيرَاثِ ابْنِ الْمُلَاعَنَةِ «لِأُمِّهِ الثُّلُثُ وَالثُّلُثَانِ لِبَيْتِ الْمَالِ»
[Machine] From Al-Hasan: "One third (of the wealth) for his mother and the remainder for the clan of his mother."
عَنْ الْحَسَنِ «لِأُمِّهِ الثُّلُثُ وَبَقِيَّةُ الْمَالِ لِعَصَبَةِ أُمِّهِ»
[Machine] Ali and Ibn Mas'ood said about the cursed child, "He left his grandmother and brothers to his mother. The grandmother receives one third, while the brothers receive two thirds." Zaid ibn Thabit said, "The grandmother receives one sixth, and the brothers receive one third for the mother, and whatever remains goes to the treasury."
أَنَّ عَلِيًّا وَابْنَ مَسْعُودٍ قَالَا فِي وَلَدِ الْمُلَاعَنَةٍ تَرَكَ جَدَّتَهُ وَإِخْوَتَهُ لِأُمِّهِ قَالَ «لِلْجَدَّةِ الثُّلُثُ وَلِلْإِخْوَةِ الثُّلُثَانِ» وقَالَ زَيْدُ بْنُ ثَابِتٍ «لِلْجَدَّةِ السُّدُسُ وَلِلْإِخْوَةِ لِلْأُمِّ الثُّلُثُ وَمَا بَقِيَ فَلِبَيْتِ الْمَالِ»
[Machine] "His mother inherits it" means the son of the cursed.
«تَرِثُهُ أُمُّهُ» يَعْنِي ابْنَ الْمُلَاعَنَةِ
[Machine] "That Al-Nakha'i and Al-Sha'bi said, 'His mother inherits him.'"
أَنَّ النَّخَعِيَّ وَالشَّعْبِيَّ قَالَا «تَرِثُهُ أُمُّهُ»
[Machine] I wrote to a brother of mine from the Banu Zurayq tribe, asking him who decided the fate of the cursed son. He wrote back to me saying that the Prophet ﷺ decided that his mother should have the same status as his own mother and father. Sufyan said, "All the wealth belongs to the mother, she has the same status as his mother and father."
كَتَبْتُ إِلَى أَخٍ لِي مِنْ بَنِي زُرَيْقٍ أَسْأَلُهُ لِمَنْ قَضَى النَّبِيُّ ﷺ فِي ابْنِ الْمُلَاعَنَةِ؟ فَكَتَبَ إِلَيَّ أَنَّ النَّبِيَّ ﷺ «قَضَى بِهِ لِأُمِّهِ هِيَ بِمَنْزِلَةِ أُمِّهِ وَأَبِيهِ» وقَالَ سُفْيَانُ «الْمَالُ كُلُّهُ لِلْأُمِّ هِيَ بِمَنْزِلَةِ أَبِيهِ وَأُمِّهِ»
[Machine] "One third belongs to his mother and the rest is for his mother's family."
«الثُّلُثُ لِأُمِّهِ وَمَا بَقِيَ فَلِعَصَبَةِ أُمِّهِ»
[Machine] About Ali and Abdullah regarding the son of Al-Mula'anah, they said, "His lineage traces back to his mother."
عَنْ عَلِيٍّ وَعَبْدِ اللَّهِ فِي ابْنِ الْمُلَاعَنَةِ قَالَا «عَصَبَتُهُ عَصَبَةُ أُمِّهِ»
[Machine] He used to say, "The inheritance of the cursed child belongs to his mother." I asked, "What if he has a sibling from his mother?" He replied, "He will have one-sixth."
أَنَّهُ كَانَ يَقُولُ «مِيرَاثُ وَلَدِ الْمُلَاعَنَةِ لِأُمِّهِ» قُلْتُ فَإِنْ كَانَ لَهُ أَخٌ مِنْ أُمِّهِ؟ قَالَ «لَهُ السُّدُسُ»
[Machine] "The cursed son inherits his mother's share from him, and all of that is in the treasury."
«وَلَدُ الْمُلَاعَنَةِ لِأُمِّهِ تَرِثُ فَرِيضَتَهَا مِنْهُ وَسَائِرُ ذَلِكَ فِي بَيْتِ الْمَالِ»
[Machine] "If they curse each other, they will be separated and not come together, and the child's mother is called the son of so-and-so, his lineage is attributed to her and she inherits him, and whoever calls him for adultery is punished."
إِذَا تَلَاعَنَا فُرِّقَ بَيْنَهُمَا وَلَمْ يَجْتَمِعَا وَدُعِيَ الْوَلَدُ لِأُمِّهِ يُقَالُ ابْنُ فُلَانَةَ هِيَ عَصَبَتُهُ يَرِثُهَا وَتَرِثُهُ وَمَنْ دَعَاهُ لِزِنْيَةٍ جُلِدَ
[Machine] "In the cursed boy, it is said that his mother's tribe will inherit from him while they remain unaware of him."
فِي وَلَدِ الْمُتَلَاعِنَيْنِ «أَنَّهُ تَرِثُهُ عَصَبَةُ أُمِّهِ وَهُمْ يَعْقِلُونَ عَنْهُ»
[Machine] About Ibn Abbas, regarding the child of a cursed woman, he is the one who has no father. "His mother and his brothers from his mother shall inherit him, and his mother's clan shall inherit him. But If someone throws him, his thrower shall be punished by being thrown himself."
عَنْ ابْنِ عَبَّاسٍ فِي وَلَدِ الْمُلَاعَنَةِ هُوَ الَّذِي لَا أَبَ لَهُ «تَرِثُهُ أُمُّهُ وَإِخْوَتُهُ مِنْ أُمِّهِ وَعَصَبَةُ أُمِّهِ فَإِنْ قَذَفَهُ قَاذِفٌ جُلِدَ قَاذِفُهُ»
[Machine] "He made him the Messenger of Allah ﷺ as a means for his mother to protect her from the hardships she encountered, and for his brothers from his mother. Mak'houl said, 'If the mother dies and leaves behind her son, and then her son also passes away, the inheritance of her son will go entirely to his brothers from his mother because it belonged to their mother and their grandfather. And the father's share will be one-sixth of his son's son, and the grandfather only inherits in this specific case because he is the father of the mother. And the brothers from the mother inherit their mother's inheritance, while the grandfather inherits his daughter's son because he was designated for her. Therefore, the wealth that belongs to the child is inherited by the heirs of the mother, and it is safeguarded by the grandfather alone if there is no one else."
«جَعَلَهُ رَسُولُ اللَّهِ ﷺ لِأُمِّهِ فِي سَبَبِهِ لِمَا لَقِيَتْ مِنَ الْبَلَاءِ وَلِإِخْوَتِهِ مِنْ أُمِّهِ» وقَالَ مَكْحُولٌ «فَإِنْ مَاتَتِ الْأُمُّ وَتَرَكَتِ ابْنَهَا ثُمَّ تُوُفِّيَ ابْنُهَا الَّذِي جُعِلَ لَهَا كَانَ مِيرَاثُهُ لِإِخْوَتِهِ مِنْ أُمِّهِ كُلُّهُ لِأَنَّهُ كَانَ لِأُمِّهِمْ وَجَدِّهِمْ وَكَانَ لِأَبِيهَا السُّدُسُ مِنَ ابْنِ ابْنَتِهِ وَلَيْسَ يَرِثُ الْجَدُّ إِلَّا فِي هَذِهِ الْمَنْزِلَةِ لِأَنَّهُ إِنَّمَا هُوَ أَبُ الْأُمِّ وَإِنَّمَا وَرِثَ الْإِخْوَةُ مِنَ الْأُمِّ أُمَّهُمْ وَوَرِثَ الْجَدُّ ابْنَتَهُ لِأَنَّهُ جُعِلَ لَهَا فَالْمَالُ الَّذِي لِلْوَلَدِ لِوَرَثَةِ الْأُمِّ وَهُوَ يُحْرِزُهُ الْجَدُّ وَحْدَهُ إِذَا لَمْ يَكُنْ غَيْرُهُ»
[Machine] A group of people disputed over the son of the accursed, Ali, so his tribe came seeking his inheritance. He said, "Indeed, his father disowned him, so you have no share in his inheritance." Thus, he decreed his inheritance to his mother and made her tribe his heirs.
أَنَّ قَوْمًا اخْتَصَمُوا إِلَى عَلِيٍّ ؓ فِي وَلَدِ الْمُتَلَاعِنَيْنِ فَجَاءَ عَصَبَةُ أَبِيهِ يَطْلُبُونَ مِيرَاثَهُ فَقَالَ «إِنَّ أَبَاهُ كَانَ تَبَرَّأَ مِنْهُ فَلَيْسَ لَكُمْ مِنْ مِيرَاثِهِ شَيْءٌ» فَقَضَى بِمِيرَاثِهِ لِأُمِّهِ وَجَعَلَهَا عَصَبَتَهُ
21.25 [Machine] In the legacy of the hijra
٢١۔٢٥ بَابُ: فِي مِيرَاثِ الْخُنْثَى
[Machine] About Ali, regarding a man, he will have what a man has and what a woman has. Which of the two will inherit? He replied, "He will inherit from both."
عَنْ عَلِيٍّ فِي الرَّجُلِ يَكُونُ لَهُ مَا لِلرَّجُلِ وَمَا لِلْمَرْأَةِ مِنْ أَيِّهِمَا يُوَرَّثُ؟ فَقَالَ «مِنْ أَيِّهِمَا بَالَ»
«يُوَرَّثُ مِنْ قِبَلِ مَبَالِهِ»
[Machine] About a newborn who was born without being male or female, he does not have what belongs to the male nor does he have what belongs to the female. He excretes from his genital area similar to the appearance of urine and feces. When asked about his inheritance, he responded, "Half of the share of the male and half of the share of the female."
عَنْ مَوْلُودٍ وُلِدَ وَلَيْسَ بِذَكَرٍ وَلَا أُنْثَى لَيْسَ لَهُ مَا لِلذَّكَرِ وَلَيْسَ لَهُ مَا لِلْأُنْثَى يُخْرِجُ مِنْ سُرَّتِهِ كَهَيْئَةِ الْبَوْلِ وَالْغَائِطِ سُئِلَ عَنْ مِيرَاثِهِ فَقَالَ «نِصْفُ حَظِّ الذَّكَرِ وَنِصْفُ حَظِّ الْأُنْثَى»
21.26 [Machine] Al-kalalati
٢١۔٢٦ بَابُ: الْكَلَالَةِ
[Machine] "I will give my opinion on it, and if it is correct, then it is from Allah, and if it is incorrect, then it is from me and from Satan. I do not see anything left for the parent and child. When Umar was appointed, he said, 'I am too shy to contradict something that Abu Bakr said.'"
إِنِّي سَأَقُولُ فِيهَا بِرَأْيِي فَإِنْ كَانَ صَوَابًا فَمِنَ اللَّهِ وَإِنْ كَانَ خَطَأً فَمِنِّي وَمِنَ الشَّيْطَانِ أُرَاهُ مَا خَلَا الْوَالِدَ وَالْوَلَدَ فَلَمَّا اسْتُخْلِفَ عُمَرُ قَالَ «إِنِّي لَأَسْتَحْيِي اللَّهَ أَنْ أَرُدَّ شَيْئًا قَالَهُ أَبُو بَكْرٍ»
[Machine] He said, "Nothing troubled the companions of the Messenger of Allah ﷺ as much as poverty troubled them."
أَنَّهُ قَالَ «مَا أَعْضَلَ بِأَصْحَابِ رَسُولِ اللَّهِ ﷺ شَيْءٌ مَا أَعْضَلَتْ بِهِمُ الْكَلَالَةُ»
الْكَلَالَةُ مَا خَلَا الْوَالِدَ وَالْوَلَدَ
[Machine] "He used to recite this verse: 'And if a man dies and leaves behind him a female relative, his wife shall have the right of inheritance.' [Quran 4:12] or a woman who has a brother or a sister, Saad said to his mother..."
أَنَّهُ كَانَ يَقْرَأُ هَذِهِ الْآيَةَ {وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً} [النساء 12] أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ قَالَ سَعْدٌ لِأُمٍّ
21.27 [Machine] Inheritance of Close Relatives
٢١۔٢٧ بَابُ: فِي مِيرَاثِ ذَوِي الْأَرْحَامِ
[Machine] He informed him that Umar ibn Al-Khattab sought someone to inherit the son of Ad-Dahdah but did not find an heir, so he transferred the wealth of Ad-Dahdah's son to the uncles of Ad-Dahdah's son.
أَخْبَرَهُ «أَنَّ عُمَرَ بْنَ الْخَطَّابِ الْتَمَسَ مَنْ يَرِثُ ابْنَ الدَّحْدَاحَةِ فَلَمْ يَجِدْ وَارِثًا فَدَفَعَ مَالَ ابْنِ الدَّحْدَاحَةِ إِلَى أَخْوَالِ ابْنِ الدَّحْدَاحَةِ»
ʿAllah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir.” (Using translation from Aḥmad 189)
«اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ»
[Machine] "Umar came to an aunt and an uncle, so he gave two-thirds to his aunt and one-third to his uncle."
«أُتِيَ عُمَرُ فِي عَمٍّ لِأُمٍّ وَخَالَةٍ فَأَعْطَى الْعَمَّ لِلْأُمِّ الثُّلُثَيْنِ وَأَعْطَى الْخَالَةَ الثُّلُثَ»
[Machine] "Omar ibn Al-Khattab gave one third to his paternal aunt and two thirds to his maternal aunt."
«أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَعْطَى الْخَالَةَ الثُّلُثَ وَالْعَمَّةَ الثُّلُثَيْنِ»
عَنْ هَذَا
[Machine] "The aunt is in the position of the mother, and the uncle is in the position of the father, and the niece is in the position of the sibling, and every relative is in the position of the womb, by which he asserts his rights if he is not an inheritor with close kinship."
«الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَالْعَمَّةُ بِمَنْزِلَةِ الْأَبِ وَبِنْتُ الْأَخِ بِمَنْزِلَةِ الْأَخِ وَكُلُّ ذي رَحِمٍ بِمَنْزِلَةِ رَحِمِهِ الَّتِي يُدْلِي بِهَا إِذَا لَمْ يَكُنْ وَارِثٌ ذُو قَرَابَةٍ»
21.28 [Machine] Al-'Asabati
٢١۔٢٨ بَابُ: الْعَصَبَةِ
[Machine] "That Umar spent in the people of Ta'oon Amawas, that when they were equal before the father, the children of the mother were more entitled, and when some of them were closer to each other through a father, they were more entitled to the wealth."
«أَنَّ عُمَرَ قَضَى فِي أَهْلِ طَاعُونِ عَمَوَاسَ أَنَّهُمْ كَانُوا إِذَا كَانُوا مِنْ قِبَلِ الْأَبِ سَوَاءً فَبَنُو الْأُمِّ أَحَقُّ وَإِذَا كَانَ بَعْضُهُمْ أَقْرَبَ مِنْ بَعْضٍ بِأَبٍ فَهُمْ أَحَقُّ بِالْمَالِ»
[Machine] Salim, a slave of Abu Hudhayfah, was injured on the day of Yamamah and his inheritance reached two hundred dirhams. Umar said, "Hold it for his mother until she reaches her last days."
أُصِيبَ سَالِمٌ مَوْلَى أَبِي حُذَيْفَةَ يَوْمَ الْيَمَامَةِ فَبَلَغَ مِيرَاثُهُ مِائَتَيْ دِرْهَمٍ فَقَالَ عُمَرُ «احْبِسُوهَا عَلَى أُمِّهِ حَتَّى تَأْتِيَ عَلَى آخِرِهَا»
“The Messenger of Allah ﷺ ruled that the sons from the same mother inherit from one another, but not sons from different mothers. A man inherits from his full brother from the same father and mother, but not his brothers from his father.” (Using translation from Ibn Mājah 2739)
عَنِ النَّبِيِّ ﷺ قَالَ «الْإِخْوَةُ مِنَ الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُونَ أَخِيهِ لِأَبِيهِ»
Muhammad bin Ja'far narrated to us, from Shu'bah, from Amr bin Murrah who said: "I asked Abu Ubaidah bin Abdullah: 'Did you remember anything from Abdullah?' He said, 'No'" (Using translation from Tirmidhī 624)
«لَا»
[Machine] Abdullah said, "A mother is a family for those who have no family, and a sister is a family for those who have no family."
عَبْدُ اللَّهِ «الْأُمُّ عَصَبَةُ مَنْ لَا عَصَبَةَ لَهُ وَالْأُخْتُ عَصَبَةُ مَنْ لَا عَصَبَةَ لَهُ»
The Prophet ﷺ said, "Give the Fara'id (the shares of the inheritance that are prescribed in the Qur'an) to those who are entitled to receive it. Then whatever remains, should be given to the closest male relative of the deceased ." (Using translation from Bukhārī 6732)
عَنِ النَّبِيِّ ﷺ قَالَ «أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ»
21.29 [Machine] In the inheritance of polytheists and Muslims
٢١۔٢٩ بَابُ: فِي مِيرَاثِ أَهْلِ الشِّرْكِ وَأَهْلِ الْإِسْلَامِ
[Machine] "The closest people to inherit it are from her own religion."
«يَرِثُهَا أَقْرَبُ النَّاسِ إِلَيْهَا مِنْ أَهْلِ دِينِهَا»
«أَهْلُ دِينِهَا يَرِثُونَهَا»
Umar ibn Al-Khattab said, "Those who associate partners with God, we do not inherit from them nor do they inherit from us."
عُمَرُ بْنُ الْخَطَّابِ «أَهْلُ الشِّرْكِ لَا نَرِثُهُمْ وَلَا يَرِثُونَا»
[Machine] The Messenger of Allah ﷺ , as well as Abu Bakr and Umar, said, "People of two different religions cannot inherit from each other."
أَنَّ رَسُولَ اللَّهِ ﷺ وَأَبَا بَكْرٍ وَعُمَرَ قَالُوا «لَا يَتَوَارَثُ أَهْلُ دِينَيْنِ»
"The people of two religions do not inherit from each other." (Using translation from Tirmidhī 2108)
«لَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ»
[Machine] "We do not inherit from the people of the Book, and they do not inherit from us, except when a man's servant or his slave dies."
«لَا نَرِثُ أَهْلَ الْكِتَابِ وَلَا يَرِثُونَا إِلَّا أَنْ يَمُوتَ لِلرَّجُلِ عَبْدُهُ أَوْ أَمَتُهُ»
[Machine] The Messenger of Allah ﷺ said, "The people of the Book do not inherit from us, and we do not inherit from them. Only a man can inherit from his slave or his servant."
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نَرِثُ أَهْلَ الْكِتَابِ وَلَا يَرِثُونَا إِلَّا الرَّجُلُ يَرِثُ عَبْدَهُ أَوْ أَمَتَهُ»
[Machine] "Muaawiyah used to inherit from Muslim but does not inherit the disbeliever from the Muslim," Masrooq said. "And whatever happened in Islam, the decree is dearer to me than it." Abu Muhammad was asked, "Do you say this?" He said, "No."
«كَانَ مُعَاوِيَةُ يُوَرِّثُ الْمُسْلِمَ مِنَ الْكَافِرِ وَلَا يُوَرِّثُ الْكَافِرَ مِنَ الْمُسْلِمِ» قَالَ قَالَ مَسْرُوقٌ «وَمَا حَدَثَ فِي الْإِسْلَامِ قَضَاءٌ أَحَبُّ إِلَيَّ مِنْهُ» قِيلَ لِأَبِي مُحَمَّدٍ «تَقُولُ بِهَذَا؟» قَالَ «لَا»
[Machine] "The age that nobody inherits is closer to the people than the followers of its religion; two religions do not inherit each other."
عُمَرُ «لَيْسَ ذَاكَ لَكَ يَرِثُهَا أَقْرَبُ النَّاسِ مِنْهَا مِنْ أَهْلِ دِينِهَا لَا يَتَوَارَثُ مِلَّتَانِ»
[Machine] "Umar ibn Al-Khattab said: 'Two different religions cannot be inherited, and one cannot be hidden from those who do not inherit.'"
عُمَرُ بْنُ الْخَطَّابِ «لَا يَتَوَارَثُ مِلَّتَانِ شَتَّى وَلَا يَحْجُبُ مَنْ لَا يَرِثُ»
the Prophet ﷺ said, "A Muslim cannot be the heir of a disbeliever, nor can a disbeliever be the heir of a Muslim." (Using translation from Bukhārī 6764)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ»
