21. Book of Inheritance (4/7)
٢١۔ كِتَابُ الْفَرَائِضِ ص ٤
[Machine] "When a person dies, their rights are obligated to be given to their rightful heirs, and nothing should be given to anyone who converts to Islam or is freed from slavery before the inheritance is divided."
«إِذَا مَاتَ الْمَيِّتُ وَجَبَتِ الْحُقُوقُ لِأَهْلِهَا وَلَمْ يَجْعَلْ لِمَنْ أَسْلَمَ أَوْ أُعْتِقَ قَبْلَ أَنْ يُقْسَمَ الْمِيرَاثُ شَيْئًا»
the Prophet ﷺ said, "A Muslim cannot be the heir of a disbeliever, nor can a disbeliever be the heir of a Muslim." (Using translation from Bukhārī 6764)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ»
The Prophet ﷺ as saying: A Muslim may not inherit from an infidel nor an infidel from a Muslim. (Using translation from Abū Dāʾūd 2909)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ»
21.30 [Machine] The Offices
٢١۔٣٠ بَابُ: الْمُكَاتَبِ
[Machine] "The offices do not have any inheritance left from their correspondence."
«لَيْسَ لِلْمُكَاتَبِ مِيرَاثٌ مَا بَقِيَ عَلَيْهِ شَيْءٌ مِنْ مُكَاتَبَتِهِ»
[Machine] About a man named Ata who has sons, some of whom he has freed half of, some he has freed a third of, and some he has freed a fourth of. He said, "They do not inherit until they are freed."
عَنْ عَطَاءٍ فِي رَجُلٍ لَهُ بَنُونَ قَدْ أَعْتَقَ مِنْ بَعْضِهِمُ النِّصْفَ وَمِنْ بَعْضِهِمُ الثُّلُثَ وَمِنْ بَعْضٍ الرُّبُعَ قَالَ «لَا يَرِثُونَ حَتَّى يُعْتَقُوا»
[Machine] About Ibrahim, there was a man who bought his son when he was sick. He said, "If he recovers before one-third of his life has passed, he will inherit, but if death befalls him before that, he will not inherit."
عَنْ إِبْرَاهِيمَ فِي رَجُلٍ اشْتَرَى ابْنَهُ فِي مَرَضِهِ قَالَ «إِنْ خَرَجَ مِنَ الثُّلُثِ وَرِثَهُ وَإِنْ وَقَعَتْ عَلَيْهِ السِّعَايَةُ لَمْ يَرِثْ»
«حَدُّ الْمُكَاتَبِ حَدُّ الْمَمْلُوكِ حَتَّى يُعْتَقَ»
21.31 [Machine] Al-Walaa'
٢١۔٣١ بَابُ: الْوَلَاءِ
[Machine] The Prophet ﷺ said, "The master is a brother in faith, and a blessing, and the most deserving of people to inherit from him is the closest to him in freeing slaves."
قَالَ النَّبِيُّ ﷺ «الْمَوْلَى أَخٌ فِي الدِّينِ وَنِعْمَةٌ وَأَحَقُّ النَّاسِ بِمِيرَاثِهِ أَقْرَبُهُمْ مِنَ الْمُعْتِقِ»
[Machine] About Al-Sha'bi regarding a man who freed a slave, then the master and the slave died, and the emancipator left behind his father and son. They said, "The wealth belongs to the son."
عَنْ الشَّعْبِيِّ فِي رَجُلٍ أَعْتَقَ مَمْلُوكًا ثُمَّ مَاتَ الْمَوْلَى وَالْمَمْلُوكُ وَتَرَكَ الْمُعْتِقُ أَبَاهُ وَابْنَهُ قَالَا «الْمَالُ لِلِابْنِ»
«الْوَلَاءُ لِابْنِ الِابْنِ»
[Machine] That a woman freed a slave and then she passed away, leaving behind her son and brother. Then her master passed away as well. So the son of the woman and her brother came to the Prophet ﷺ regarding their inheritance. The Prophet ﷺ said, "His inheritance belongs to the son of the woman." The brother then asked, "O Messenger of Allah, what if she owed someone a debt?" The Prophet ﷺ replied, "You are responsible for it."
أَنَّ امْرَأَةً أَعْتَقَتْ عَبْدًا لَهَا ثُمَّ تُوُفِّيَتْ وَتَرَكَتِ ابْنَهَا وَأَخَاهَا ثُمَّ تُوُفِّيَ مَوْلَاهَا فَأَتَى النَّبِيَّ ﷺ ابْنُ الْمَرْأَةِ وَأَخُوهَا فِي ميراثه فَقَالَ النَّبِيُّ ﷺ «مِيرَاثُهُ لِابْنِ الْمَرْأَةِ» فَقَالَ أَخُوهَا يَا رَسُولَ اللَّهِ لَوْ أَنَّهُ جَرَّ جَرِيرَةً عَلَى مَنْ كَانَتْ؟ قَالَ «عَلَيْكَ»
[Machine] About a man who freed a slave and then the man died and the master died, leaving the freed slave with his father and son. The freed slave said, "To his father belongs such and such, and what remains belongs to his son."
عَنْ رَجُلٍ أَعْتَقَ مَمْلُوكًا لَهُ فَمَاتَ وَمَاتَ الْمَوْلَى وَتَرَكَ الْمُعْتِقُ أَبَاهُ وَابْنَهُ فَقَالَ «لِأَبِيهِ كَذَا وَمَا بَقِيَ فَلِابْنِهِ»
[Machine] I heard the judge and Hammad saying, "He is for the son."
سَمِعْتُ الْحَكَمَ وَحَمَّادًا يَقُولَانِ «هُوَ لِلِابْنِ»
[Machine] It is narrated that the Prophet ﷺ went to Al-Baqi' and saw a man being sold. He approached him and bargained for him, then left him. Another man saw him and bought him, then set him free. He brought him to the Prophet ﷺ and said, "I have bought this man and set him free. What do you see in him?" The Prophet ﷺ said, "He is your brother and your freed slave." He asked, "What do you see in his companionship?" The Prophet ﷺ said, "If you show him gratitude, it is better for him and worse for you, and if you show him ingratitude, it is better for you and worse for him." He asked, "What do you see in his wealth?" The Prophet ﷺ said, "If he dies and leaves no heirs, then you are his inheritor."
أَنَّ النَّبِيَّ ﷺ خَرَجَ إِلَى الْبَقِيعِ فَرَأَى رَجُلًا يُبَاعُ فَأَتَاهُ فَسَاوَمَ بِهِ ثُمَّ تَرَكَهُ فَرَآهُ رَجُلٌ فَاشْتَرَاهُ فَأَعْتَقَهُ ثُمَّ جَاءَ بِهِ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنِّي اشْتَرَيْتُ هَذَا فَأَعْتَقْتُهُ فَمَا تَرَى فِيهِ؟ فَقَالَ «هُوَ أَخُوكَ وَمَوْلَاكَ» قَالَ مَا تَرَى فِي صُحْبَتِهِ؟ فَقَالَ «إِنْ شَكَرَكَ فَهُوَ خَيْرٌ لَهُ وَشَرٌّ لَكَ وَإِنْ كَفَرَكَ فَهُوَ خَيْرٌ لَكَ وَشَرٌّ لَهُ» قَالَ مَا تَرَى فِي مَالِهِ؟ قَالَ «إِنْ مَاتَ وَلَمْ يَتْرُكْ عَصَبَةً فَأَنْتَ وَارِثُهُ»
[Machine] That the daughter of Hamza freed a slave owned by her, but he died and left behind his daughter and his slave woman, the daughter of Hamza. The Messenger of Allah ﷺ then divided his inheritance between his daughter and the daughter of Hamza equally into two parts.
أَنَّ ابْنَةَ حَمْزَةَ أَعْتَقَتْ عَبْدًا لَهَا فَمَاتَ وَتَرَكَ ابْنَتَهُ وَمَوْلَاتَهُ بِنْتَ حَمْزَةَ «فَقَسَمَ رَسُولُ اللَّهِ ﷺ مِيرَاثَهُ بَيْنَ ابْنَتِهِ وَمَوْلَاتِهِ بِنْتِ حَمْزَةَ نِصْفَيْنِ»
[Machine] "I presented my case to Ali regarding a father who passed away without leaving anyone but me and his master. So, Ali gave me half, and he gave his master half."
«قَاضَيْتُ إِلَى عَلِيٍّ فِي أَبٍ مَاتَ لَمْ يَدَعْ أَحَدًا غَيْرِي وَمَوْلَاهُ فَأَعْطَانِي النِّصْفَ وَأَعْطَى مَوْلَاهُ النِّصْفَ»
[Machine] "It was brought to him a daughter and a slave, so he gave half to the daughter and half to the slave." The judge said, "This is the share of the slave that he inherited from his master."
«أَنَّهُ أُتِيَ بِابْنَةٍ وَمَوْلًى فَأَعْطَى الِابْنَةَ النِّصْفَ وَالْمَوْلَى النِّصْفَ» قَالَ الْحَكَمُ «فَمَنْزِلِي هَذَا نَصِيبُ الْمَوْلَى الَّذِي وَرِثَهُ عَنْ مَوْلَاهُ»
[Machine] "He died and left behind his daughter and his followers, so Ali gave his daughter half and his followers half."
«أَنَّهُ مَاتَ وَتَرَكَ ابْنَتَهُ وَمَوَالِيَهُ فَأَعْطَى عَلِيٌّ ابْنَتَهُ النِّصْفَ وَمَوَالِيَهُ النِّصْفَ»
[Machine] "That her father died, so Ali became half for her and half for his followers."
«أَنَّ أَبَاهَا مَاتَ فَجَعَلَ عَلِيٌّ لَهَا النِّصْفَ وَلِمَوَالِيهِ النِّصْفَ»
[Machine] About two sisters, one of them bought their father and then set him free. After he died, he said, "Both of them have two-thirds of their inheritance specified in the Book of Allah, and whatever is left belongs to the one who set him free."
عَنْ أُخْتَيْنِ اشْتَرَتْ إِحْدَاهُمَا أَبَاهَا فَأَعْتَقَتْهُ ثُمَّ مَاتَ قَالَ «لَهُمَا الثُّلُثَانِ فَرِيضَتُهُمَا فِي كِتَابِ اللَّهِ وَمَا بَقِيَ فَلِلْمُعْتِقَةِ دُونَ الْأُخْرَى»
[Machine] Regarding Sha'bi's opinion about a woman who freed her father, and the father died, leaving behind four daughters. One of them said, "They are not entitled to anything but two-thirds, while she is included among them."
عَنْ الشَّعْبِيِّ فِي امْرَأَةٍ أَعْتَقَتْ أَبَاهَا فَمَاتَ الْأَبُ وَتَرَكَ أَرْبَعَ بَنَاتٍ هِيَ إِحْدَاهُنَّ قَالَ «لَيْسَ عَلَيْهِ مِنَّةٌ لَهُنَّ الثُّلُثَانِ وَهِيَ مَعَهُنَّ»
21.32 [Machine] In whom have the relatives not given except the guardians?
٢١۔٣٢ بَابُ: فِيمَنْ أَعْطَى ذَوِي الْأَرْحَامِ دُونَ الْمَوَالِي
[Machine] "Ali spent a quarter on his wife and half on his daughter, then he gave the rest to his daughter."
«قَضَى عَلِيٌّ لِامْرَأَتِهِ الثُّمُنَ وَلِابْنَتِهِ النِّصْفَ ثُمَّ رَدَّ الْبَقِيَّةَ عَلَى ابْنَتِهِ»
[Machine] The translation of the given Arabic phrase into English is: "Indeed, a close relative of Ibrahim passed away and left behind wealth, so I said to Ibrahim. He said, 'Indeed, she has a relative.'"
أَنَّ مَوْلَاةً لِإِبْرَاهِيمَ تُوُفِّيَتْ وَتَرَكَتْ مَالًا فَقُلْتُ لِإِبْرَاهِيمَ فَقَالَ «إِنَّ لَهَا ذَا قَرَابَةٍ»
21.33 [Machine] Loyalty to the elders.
٢١۔٣٣ بَابُ: الْوَلَاءُ لِلْكُبْرِ
[Machine] "And I think he mentioned that Abdullah also said that they said, 'Loyalty belongs to the elders,' meaning that loyalty is closer to a father or mother."
وَأَحْسَبُهُ قَدْ ذَكَرَ عَبْدَ اللَّهِ أَيْضًا أَنَّهُمْ قَالُوا «الْوَلَاءُ لِلْكُبْرِ» يَعْنُونَ بِالْكُبْرِ مَا كَانَ أَقْرَبَ بِأَبٍ أَوْ أُمٍّ
[Machine] "It died and left her nephew to his father and mother, and her nephew to his father. Omar wrote, 'Indeed, loyalty is to the elder.'"
أَنَّهَا مَاتَتْ وَتَرَكَتِ ابْنَ أَخِيهَا لِأَبِيهَا وَأُمِّهَا وَابْنَ أَخِيهَا لِأَبِيهَا فَكَتَبَ عُمَرُ «إِنَّ الْوَلَاءَ لِلْكُبْرِ»
وقَالَ عَبْدُ اللَّهِ وَشُرَيْحٌ «لِلْوَرَثَةِ»
[Machine] "Umar, Abdullah, Ali, and Zaid have spent their lives in loyalty to the elderly."
«قَضَى عُمَرُ وَعَبْدُ اللَّهِ وَعَلِيٌّ وَزَيْدٌ لِلْكُبْرِ بِالْوَلَاءِ»
[Machine] Fukayhah, the daughter of Samaan, passed away and left her nephew to his father and her nephew's children to their father and mother. So Umar inherited the children of her brother to their father.
تُوُفِّيَتْ فُكَيْهَةُ بِنْتُ سَمْعَانَ وَتَرَكَتِ ابْنَ أَخِيهَا لِأَبِيهَا وَبَنِي بَنِي أَخِيهَا لِأَبِيهَا وَأُمِّهَا «فَوَرَّثَ عُمَرُ بَنِي أَخِيهَا لِأَبِيهَا»
[Machine] From Umar, Ali, and Zaid, they said, "Loyalty belongs to the older ones."
عَنْ عُمَرَ وَعَلِيٍّ وَزَيْدٍ أَنَّهُمْ قَالُوا «الْوَلَاءُ لِلْكُبْرِ»
[Machine] About Ibrahim, he had two brothers who were slaves, and their father had freed them. One of them died and left behind a child named Ali, while the other one was named Zaid and Abdullah. They used to say, "Loyalty belongs to the eldest."
عَنْ إِبْرَاهِيمَ فِي أَخَوَيْنِ وَرِثَا مَوْلًى كَانَ أَعْتَقَهُ أَبُوهُمَا فَمَاتَ أَحَدُهُمَا وَتَرَكَ وَلَدًا قَالَ كَانَ عَلِيٌّ وَزَيْدٌ وَعَبْدُ اللَّهِ يَقُولُونَ «الْوَلَاءُ لِلْكُبْرِ»
عُمَرُ وَعَلِيٌّ «الْوَلَاءُ لِلْكُبْرِ»
«الْوَلَاءُ لِلْكُبْرِ»
«الْوَلَاءُ لِلْكُبْرِ»
21.34 [Machine] In the man who supports the man
٢١۔٣٤ بَابُ: فِي الرَّجُلِ يُوَالِي الرَّجُلَ
[Machine] Regarding the man who supports another man, they said: "He is among the Muslims." Sufyan said: "And that's what we say as well."
عَنْ الْحَسَنِ فِي الرَّجُلِ يُوَالِي الرَّجُلَ قَالَا «هُوَ بَيْنَ الْمُسْلِمِينَ» قَالَ سُفْيَانُ وَكَذَلِكَ نَقُولُ
“I heard Tamim Ad- Dari say: ‘I said: O Messenger of Allah, what is the Sunnah concerning a man from among the People of the Book who becomes a Muslim at the hands of another man?’ He said: ‘He is the closest of all people to him in life and in death.’” (Using translation from Ibn Mājah 2752)
سَمِعْتُ تَمِيمًا الدَّارِيَّ يَقُولُ سَأَلْتُ رَسُولَ اللَّهِ ﷺ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا السُّنَّةُ فِي الرَّجُلِ مِنْ أَهْلِ الْكُفْرِ يُسْلِمُ عَلَى يَدَيْ رَجُلٍ مِنَ الْمُسْلِمِينَ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «هُوَ أَوْلَى النَّاسِ بِمَحْيَاهُ وَمَمَاتِهِ»
[Machine] About a man from the people of As-Sawad, whenever he converted to Islam under the guidance of a man, he said, "He understands him and inherits from him."
عَنْ رَجُلٍ مِنْ أَهْلِ السَّوَادِ إِذَا أَسْلَمَ عَلَى يَدَيْ رَجُلٍ قَالَ «يَعْقِلُ عَنْهُ وَيَرِثُهُ»
21.35 [Machine] Who said: 'Indeed, a woman inherits from the blood money of her husband'
٢١۔٣٥ بَابُ: مَنْ قَالَ: إِنَّ الْمَرْأَةَ تَرِثُ مِنْ دِيَةِ زَوْجِهَا
[Machine] "The woman inherits from the blood money of her husband in intentional and accidental homicides."
«تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا فِي الْعَمْدِ وَالْخَطَإِ»
[Machine] "The compensation for obligations set by Allah Almighty."
«الدِّيَةُ عَلَى فَرَائِضِ اللَّهِ ﷻ»
«الدِّيَةُ سَبِيلُهَا سَبِيلُ الْمِيرَاثِ»
[Machine] "That the brothers inherit from the mother from the estate."
«أَنْ يُوَرَّثَ الْإِخْوَةُ مِنَ الْأُمِّ مِنَ الدِّيَةِ»
[Machine] "The intellect is an inheritance among the heirs of the deceased according to the book of God and His obligations."
«الْعَقْلُ مِيرَاثٌ بَيْنَ وَرَثَةِ الْقَتِيلِ عَلَى كِتَابِ اللَّهِ وَفَرَائِضِهِ»
[Machine] "He has indeed wronged the one who did not leave an inheritance for his siblings from the mother's wealth."
«لَقَدْ ظَلَمَ مَنْ لَمْ يُوَرِّثِ الْإِخْوَةَ مِنَ الْأُمِّ مِنَ الدِّيَةِ»
[Machine] Umar, Ali, and Zaid said, "Diyyah (blood money) is inherited just as wealth, its mistakes and intentional acts are inherited."
عَنْ عُمَرَ وَعَلِيٍّ وَزَيْدٍ قَالُوا «الدِّيَةُ تُورَثُ كَمَا يُورَثُ الْمَالُ خَطَؤُهُ وَعَمْدُهُ»
21.36 [Machine] Who said: "He does not inherit"?
٢١۔٣٦ بَابُ: مَنْ قَالَ: لَا يُوَرَّثُ
[Machine] "Ali did not inherit brothers from his mother, nor his wife, nor did any woman inherit anything from the compensation. Abdullah said, 'Some people insert a man between Ismail and 'Amir.'"
«كَانَ عَلِيٌّ لَا يُوَرِّثُ الْإِخْوَةَ مِنَ الْأُمِّ وَلَا الزَّوْجَ وَلَا الْمَرْأَةَ مِنَ الدِّيَةِ شَيْئًا» قَالَ عَبْد اللَّهِ «بَعْضُهُمْ يُدْخِلُ بَيْنَ إِسْمَاعِيلَ وَعَامِرٍ رَجُلًا»
[Machine] "Brothers do not inherit from their mother from the dowry."
«لَا تُوَرَّثُ الْإِخْوَةُ مِنَ الْأُمِّ مِنَ الدِّيَةِ»
21.37 [Machine] The legacy of the victims
٢١۔٣٧ بَابُ: مِيرَاثِ الْغَرْقَى
[Machine] "All people inherit the death of their blind in destruction or drowning, as they do not inherit it from their living relatives."
«كُلُّ قَوْمٍ مُتَوَارِثِينَ عَمِيَ مَوْتُهُمْ فِي هَدْمٍ أَوْ غَرَقٍ فَإِنَّهُمْ لَا يَتَوَارَثُونَ يَرِثُهُمُ الْأَحْيَاءُ»
[Machine] The following translation is as follows: "The dead do not inherit from each other, but the living inherit from the dead."
«لَا يُوَرَّثُ الْأَمْوَاتُ بَعْضُهُمْ مِنْ بَعْضٍ وَيُوَرَّثُ الْأَحْيَاءُ مِنَ الْأَمْوَاتِ»
[Machine] "That Umm Kulthum and her son Zaid died on the same day, and their mourning processions met on the road, yet neither one of them inherited from the other. And that the people of Harrah did not inherit from each other, and the people of Siffin did not inherit from each other."
«أَنَّ أُمَّ كُلْثُومٍ وَابْنَهَا زَيْدًا مَاتَا فِي يَوْمٍ وَاحِدٍ فَالْتَقَتِ الصَّائِحَتَانِ فِي الطَّرِيقِ فَلَمْ يَرِثْ كُلُّ وَاحِدٍ مِنْهُمَا مِنْ صَاحِبِهِ وَأَنَّ أَهْلَ الْحَرَّةِ لَمْ يَتَوَارَثُوا وَأَنَّ أَهْلَ صِفِّينَ لَمْ يَتَوَارَثُوا»
[Machine] "A house in Sham fell upon a group, and Umar distributed some of it among them."
«أَنَّ بَيْتًا فِي الشَّامِ وَقَعَ عَلَى قَوْمٍ فَوَرَّثَ عُمَرُ بَعْضَهُمْ مِنْ بَعْضٍ»
[Machine] "He inherited two brothers who were killed in the Battle of Siffin, one of them by the other."
أَنَّهُ وَرَّثَ أَخَوَيْنِ قُتِلَا بِصِفِّينَ أَحَدَهُمَا مِنَ الْآخَرِ
