21.46 [Machine] The Inheritance of the Wanderer

٢١۔٤٦ بَابُ: مِيرَاثِ السَّائِبَةِ

[Machine] Abdullah said: "The generous person puts his money wherever he wants." Abdullah bin Yazid said: Shu'ba said: "I have not heard this from Salamah except from me."  

الدارمي:٣١٥٩أَخْبَرَنَا أَبُو نُعَيْمٍ وَعَبْدُ اللَّهِ بْنُ يَزِيدَ قَالَا حَدَّثَنَا شُعْبَةُ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنْ أَبِي عَمْرٍو الشَّيْبَانِيِّ قَالَ قَالَ

عَبْدُ اللَّهِ «السَّائِبَةُ يَضَعُ مَالَهُ حَيْثُ شَاءَ» قَالَ عَبْدُ اللَّهِ بْنُ يَزِيدَ قَالَ شُعْبَةُ «لَمْ يَسْمَعْ هَذَا مِنْ سَلَمَةَ أَحَدٌ غَيْرِي»

الدارمي:٣١٦٠أَخْبَرَنَا الْحَكَمُ بْنُ الْمُبَارَكِ حَدَّثَنَا حَاتِمُ بْنُ وَرْدَانَ عَنْ يُونُسَ عَنْ الْحَسَنِ سُئِلَ عَنْ مِيرَاثِ السَّائِبَةِ فَقَالَ

«كُلُّ عَتِيقٍ سَائِبَةٌ»

[Machine] The translation of the phrase "عُمَرُ «الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا أَوْ لِوَقْتِهِمَا»" from Arabic to English is: "The age/an entire lifetime of 'sadaqah' (charity) and 'sā'ibah' (letting loose animals for grazing) is for their day or their time."  

الدارمي:٣١٦١أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَنْبَأَنَا سُلَيْمَانُ عَنْ أَبِي عُثْمَانَ قَالَ قَالَ

عُمَرُ «الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا أَوْ لِوَقْتِهِمَا»

الدارمي:٣١٦٢حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زَكَرِيَّا قَالَ سُئِلَ عَامِرٌ عَنْ الْمَمْلُوكِ يُعْتَقُ سَائِبَةً لِمَنْ وَلَاؤُهُ؟ قَالَ

«لِلَّذِي أَعْتَقَهُ»

[Machine] "Mawlā died during the time of Uthman without having a heir, so he commanded for his wealth to be entered into the treasury."  

الدارمي:٣١٦٣حَدَّثَنَا أَبُو حَاتِمٍ الْبَصْرِيُّ هُوَ رَوْحُ بْنُ أَسْلَمَ حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ عَنْ أَبِيهِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَمْرٍو قَالَ

«مَاتَ مَوْلًى عَلَى عَهْدِ عُثْمَانَ َلَيْسَ لَهُ وَالٍ فَأَمَرَ بِمَالِهِ فَأُدْخِلَ بَيْتَ الْمَالِ»

[Machine] About stolen property in a man who died and had no inheritor, he said, "His wealth is where he directed it. If he did not direct it, then it is in the treasury."  

الدارمي:٣١٦٤حَدَّثَنَا يَعْلَى حَدَّثَنَا إِسْمَاعِيلُ عَنْ عَامِرٍ

عَنْ مَسْرُوقٍ فِي رَجُلٍ مَاتَ وَلَمْ يَكُنْ لَهُ مَوْلَى عَتَاقَةٍ قَالَ «مَالُهُ حَيْثُ أَوْصَى بِهِ فَإِنْ لَمْ يَكُنْ أَوْصَى فَهُوَ فِي بَيْتِ الْمَالِ»

[Machine] Regarding the statement of Damarah and Rashid ibn Saad and others about the freed slave, they said, "Certainly, his loyalty belongs to the one who freed him. His separation is only from slavery, not from loyalty."  

الدارمي:٣١٦٥حَدَّثَنَا أَبُو سَعِيدِ بْنُ عَمْرٍو عَنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ

عَنْ ضَمْرَةَ وَرَاشِدِ بْنِ سَعْدٍ وَغَيْرِهِمَا قَالُوا فِيمَنْ أُعْتِقَ سَائِبَةً «إِنَّ وَلَاءَهُ لِمَنْ أَعْتَقَهُ إِنَّمَا سَيَّبَهُ مِنَ الرِّقِّ وَلَمْ يُسَيِّبْهُ مِنَ الْوَلَاءِ»

[Machine] Ibrahim and al-Sha'bi said, "There is no harm in selling abandoned goods and gifts."  

الدارمي:٣١٦٦حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ حَدَّثَنَا أَبُو دَاوُدَ عَنْ شُعْبَةَ قَالَ أَخْبَرَنِي مَنْصُورٌ

عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ قَالَا «لَا بَأْسَ بِبَيْعِ وَلَاءِ السَّائِبَةِ وَهِبَتِهِ»

[Machine] "A man emancipated a runaway boy and then came to Abdullah and said, 'I have emancipated a runaway boy for myself, and this is his belonging.' He said, 'It is yours.' He said, 'I have no need for it.' He said, 'Put it, as there are many inheritors here.'"  

الدارمي:٣١٦٧حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا الْمَسْعُودِيُّ عَنْ الْقَاسِمِ قَالَ

أَعْتَقَ رَجُلٌ غُلَامًا سَائِبَةً فَأَتَى عَبْدَ اللَّهِ وَقَالَ إِنِّي أَعْتَقْتُ غُلَامًا لِي سَائِبَةً وَهَذِهِ تَرِكَتُهُ قَالَ «هِيَ لَكَ» قَالَ لَا حَاجَةَ لِي فِيهَا قَالَ «فَضَعْهَا فَإِنَّ هَاهُنَا وَارِثًا كَثِيرًا»
