٢١۔٥٥ بَابُ: جَرِّ الْوَلَاءِ

[Machine] Regarding Ali, Umar, and Zaid, they said, "A parent carries the responsibility of their child."  

الدارمي:٣٢٠٨حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ أَشْعَثَ عَنْ الشَّعْبِيِّ

عَنْ عَلِيٍّ وَعُمَرَ وَزَيْدٍ قَالُوا «الْوَالِدُ يَجُرُّ وَلَاءَ وَلَدِهِ»

[Machine] "Aljad du yajurru alwala’a" translates to "Generosity leads to loyalty" in English.  

الدارمي:٣٢٠٩حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ أَشْعَثَ عَنْ الشَّعْبِيِّ قَالَ

«الْجَدُّ يَجُرُّ الْوَلَاءَ»

[Machine] "The parent cherishes the loyalty of his child."  

الدارمي:٣٢١٠حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ أَشْعَثَ عَنْ ابْنِ سِيرِينَ عَنْ شُرَيْحٍ قَالَ

«الْوَالِدُ يَجُرُّ وَلَاءَ وَلَدِهِ»

[Machine] About Amr, who was a slave, he died while having a free father and children from a free woman. To whom does the custody of his child belong? He said, "To the allies of the grandfather."  

الدارمي:٣٢١١حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زَكَرِيَّا

عَنْ عَامِرٍ فِي مَمْلُوكٍ تُوُفِّيَ وَلَهُ أَبٌ حُرٌّ وَلَهُ بَنُونَ مِنَ امْرَأَةٍ حُرَّةٍ لِمَنْ وَلَاءُ وَلَدِهِ؟ قَالَ «لِمَوَالِي الْجَدِّ»

[Machine] About Ibrahim, in offices, he died, and he completed half of his work, and he has a son from a free woman. He said, "I can only see his child's obligations dragging him."  

الدارمي:٣٢١٢حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا إِسْرَائِيلُ عَنْ مُغِيرَةَ

عَنْ إِبْرَاهِيمَ فِي مُكَاتَبٍ مَاتَ وَقَدْ أَدَّى نِصْفَ مُكَاتَبَتِهِ وَلَهُ وَلَدٌ مِنَ امْرَأَةٍ حُرَّةٍ قَالَ «مَا أُرَاهُ إِلَّا قَدْ جَرَّ وَلَاءَ وَلَدِهِ»  

darimi:3213Sulaymān b. Ḥarb > Shuʿbah > al-Ḥakam > Ibrāhīm

[Machine] "When a slave married a free woman and then she gave birth to free children, and then he was freed after that, the loyalty returned to the family of their father." So, Shurayh took hold of it.  

الدارمي:٣٢١٣حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ حَدَّثَنَا شُعْبَةُ عَنْ الْحَكَمِ عَنْ إِبْرَاهِيمَ قَالَ كَانَ شُرَيْحٌ لَا يَرْجِعُ عَنْ قَضَاءٍ يَقْضِي بِهِ فَحَدَّثَهُ الْأَسْوَدُ أَنَّ عُمَرَ قَالَ

«إِذَا تَزَوَّجَ الْمَمْلُوكُ الْحُرَّةَ فَوَلَدَتْ أَوْلَادًا أَحْرَارًا ثُمَّ عُتِقَ بَعْدَ ذَلِكَ رَجَعَ الْوَلَاءُ لِمَوَالِي أَبِيهِمْ» فَأَخَذَ بِهِ شُرَيْحٌ

[Machine] During the Mamluk era, a free person (usually a slave) would be under the authority of their master. "If a child is freed, they are considered to be free because their mother is freed. When the father is freed, the child follows their status."  

الدارمي:٣٢١٤حَدَّثَنَا يَعْلَى عَنْ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ قَالَ قَالَ

عُمَرُ فِي الْمَمْلُوكِ يَكُونُ تَحْتَهُ الْحُرَّةُ «يُعْتَقُ الْوَلَدُ بِعِتْقِ أُمِّهِ فَإِذَا عُتِقَ الْأَبُ جَرَّ الْوَلَاءَ»  

darimi:3215Muslim > ʿAbd al-Wārith > Kathīr b. Shinẓīr

[Machine] "As for what she gave birth to while he was a slave, their allegiance is to her family members who were the recipients of her grace. And as for what she gave birth to while he was a free man, their allegiance is to his family members who were the recipients of his grace."  

الدارمي:٣٢١٥حَدَّثَنَا مُسْلِمٌ حَدَّثَنَا عَبْدُ الْوَارِثِ عَنْ كَثِيرِ بْنِ شِنْظِيرٍ عَنْ عَطَاءٍ فِي الْحُرَّةِ تَحْتَ الْعَبْدِ قَالَ

«أَمَّا مَا وَلَدَتْ مِنْهُ وَهُوَ عَبْدٌ فَوَلَاؤُهُمْ لِأَهْلِ نِعْمَتِهَا وَمَا وَلَدَتْ مِنْهُ وَهُوَ حُرٌّ فَوَلَاؤُهُمْ لِأَهْلِ نِعْمَتِهِ»  

darimi:3216Jaʿfar b. ʿAwn > al-Aʿmash > Ibrāhīm

[Machine] "If a free woman serves under a slave and bears a child for him, then the child is to be freed along with its mother, and their loyalty and guardianship belongs to the mother's freedmen. But if the father is freed, the loyalty is transferred to the freedmen of his father."  

الدارمي:٣٢١٦حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ عَنْ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ قَالَ قَالَ

عُمَرُ «إِذَا كَانَتِ الْحُرَّةُ تَحْتَ الْمَمْلُوكِ فَوَلَدَتْ لَهُ غُلَامًا فَإِنَّهُ يُعْتَقُ بِعِتْقِ أُمِّهِ وَوَلَاؤُهُ لِمَوَالِي أُمِّهِ فَإِذَا أُعْتِقَ الْأَبُ جَرَّ الْوَلَاءَ إِلَى مَوَالِي أَبِيهِ»  

darimi:3217al-Ḥakam b. al-Mubārak > Muḥammad b. Salamah > Ibn Isḥāq > al-ʿAlāʾ b. ʿAbd al-Raḥman from his father

[Machine] "That is my lord, so they both went to Uthman and he ruled in favor of al-Hurqi."  

الدارمي:٣٢١٧حَدَّثَنَا الْحَكَمُ بْنُ الْمُبَارَكِ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ عَنْ ابْنِ إِسْحَاقَ عَنْ الْعَلَاءِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِيهِ قَالَ كَانَتْ أُمِّي مَوْلَاةً لِلْحُرَقَةِ وَكَانَ أَبِي يَعْقُوبُ مُكَاتَبًا لِمَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ النَّصْرِيِّ ثُمَّ إِنَّ أَبِي أَدَّى كِتَابَتَهُ فَدَخَلَ الْحُرَقِيُّ عَلَى عُثْمَانَ فسَأَلَ لي الْحَقَّ يَعْنِي الْعَطَاءَ وَعِنْدَهُ مَالِكُ بْنُ أَوْسٍ فَقَالَ

ذَاكَ مَوْلَايَ فَاخْتَصَمَا إِلَى عُثْمَانَ فَقَضَى بِهِ لِلْحُرَقِيِّ
