40. Chapter
٤٠۔ كِتَابُ الصَّدَاقِ
[Machine] The Messenger of Allah ﷺ said, "Indeed, the most rightful of conditions to be fulfilled are those by which you have made lawful the private parts."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ أَحَقَّ الشُّرُوطِ أَنْ تُوَفَّى بِهَا مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ
[Machine] The Messenger of Allah ﷺ said, "The most deserving conditions to be fulfilled are those through which you permitted yourselves to engage in sexual relations."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ أَحَقَّ الشُّرُوطِ أَنْ يُوَفَّى بِهَا مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ
"Barirah came to me and said: 'O 'Sishah, I have drawn up a contract of manumission with my master, (to buy my freedom) in return for nine Uwqiyah, one Uwqiyah to be paid each year; help me,' she had not yet paid anything toward her contract of manumission.' 'Aishah, who liked her and wanted to help her, said: 'Go back to your masters and if they agree to let me pay the whole sum and that your loyalty will be to me, I will do it.' So Barirah went to her masters and suggested that to them, but they refused and said: 'if she wants to seek reward (with Allah) by freeing you, let her do so, but (you loyalty) will be to us, 'Aishah told the Messenger of Allah about that and he said: 'Do not let that stop you. Buy her and set her free, and loyalty belongs to the one who sets the slave free.; so she did that, then the Messenger of Allah stood up before the people, praised and glorified Allah, then said: 'What is the matter with people who stipulate conditions that are not in the Book of Allah? Whoever stipulates conditions that are not in even if there are a hundred conditions? The decree of Allah takes priority, and the conditions of Allah binding. And loyalty belongs to the one who sets the slaves free.' (Using translation from Nasāʾī 4656)
زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ جَاءَتْ بَرِيرَةُ إِلِيَّ فَقَالَتْ يَا عَائِشَةُ إِنِّي كَاتَبْتُ أَهْلِي عَلَى سَبْعَةِ أَوَاقٍ فِي كُلِّ عَامٍ أُوقِيَّةٌ فَأَعِينِينِي وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا فَقَالَتْ لَهَا عَائِشَةُ ؓ وَنَفِسَتْ فِيهَا ارْجِعِي إِلَى أَهْلِكِ فَإِنْ أَحَبُّوا أَنْ أُعْطِيَهُمْ ذَلِكَ جَمِيعًا وَيَكُونُ وَلَاؤُكِ لِي فَعَلْتُ فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا فَعَرَضَتْ ذَلِكَ عَلَيْهِمْ فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ فَلْتَفْعَلْ وَيَكُونُ وَلَاؤُكِ لَنَا فَذَكَرَتْ ذَلِكَ عَائِشَةُ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا يَمْنَعُكِ ذَلِكَ مِنْهَا ابْتَاعِي وَأَعْتِقِي فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ فَفَعَلَتْ وَقَامَ رَسُولُ اللهِ ﷺ فِي النَّاسِ فَحَمِدَ اللهَ ثُمَّ قَالَ أَمَّا بَعْدُ فَمَا بَالُ أُنَاسٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ تَعَالَى وَلَا سُنَّةِ نَبِيِّهِ مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ قَضَاءُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ
[Machine] The Prophet ﷺ said: Muslims are bound by their conditions, except for a condition that forbids what is permissible or allows what is forbidden, and this applies likewise.
قَالَ رَسُولُ اللهِ ﷺ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ إِلَّا شَرْطًا حَرَّمَ حَلَالًا أَوْ شَرْطًا أَحَلَّ حَرَامًا وَكَذَلِكَ
[Machine] Muslims, according to their conditions, adhere to what is in accordance with the truth. Sufyan ibn Hamza's wording has been narrated in this matter, and this is also narrated weakly from a third party, from Aisha, and from Anas ibn Malik, in a raised manner.
اللهِ ﷺ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ فِيمَا وَافَقَ الْحَقَّ لَفْظُ سُفْيَانَ بْنِ حَمْزَةَ وَرُوِيَ ذَلِكَ مِنْ وَجْهٍ ثَالِثٍ ضَعِيفٍ عَنْ عَائِشَةَ ؓ وَعَنْ أَنَسِ بْنِ مَالِكٍ مَرْفُوعًا
[Machine] Abdullah Al-Hafiz informed that Abu Abdullah As-Saffar narrated from Ibn Abi Dunya who narrated from Ismail bin Abdullah bin Zurara who narrated from Abdul Aziz bin Abdul Rahman Al-Jazari who narrated from Khuthaif who narrated from Urwa who narrated from Aisha that the Messenger of Allah ﷺ said, "Muslims are bound by the condition of their agreements as long as it does not contradict the truth." 14435 Khuthaif said, "And Atha bin Abi Rabah narrated to me from Anas bin Malik who said, 'The Messenger of Allah ﷺ said, "Muslims are bound by the conditions of their agreements as long as it does not contradict the truth."'"
عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُ ثنا ابْنُ أَبِي الدُّنْيَا أنبأ إِسْمَاعِيلُ بْنُ عَبْدِ اللهِ بْنِ زُرَارَةَ ثنا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الرَّحْمَنِ الْجَزَرِيُّ عَنْ خُصَيْفٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ ؓ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ مَا وَافَقَ الْحَقَّ 14435 قَالَ خُصَيْفٌ وَحَدَّثَنِي عَطَاءُ بْنُ أَبِي رَبَاحٍ عَنْ أَنَسِ بْنِ مَالِكٍ قَالَ قَالَ رَسُولُ اللهِ ﷺ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ مَا وَافَقَ الْحَقَّ مِنْ ذَلِكَ
عَنِ النَّبِيِّ ﷺ قَالَ لَا يَنْبَغِي لِامْرَأَةٍ أَنْ تَشْتَرِطَ طَلَاقَ أُخْتِهَا لِتَكْفَأَ إِنَاءَهَا
[Machine] "Regarding Umar, may Allah be pleased with him, during his caliphate."
عَنْ عُمَرَ ؓ بِخِلَافِهِ
[Machine] The divisions of rights in the conditions of the first narration are similar to the book, the Sunnah, and the statements of other companions.
مَقَاطِعَ الْحُقُوقِ عِنْدَ الشُّرُوطِ الرِّوَايَةُ الْأُولَى أَشْبَهُ بِالْكِتَابِ وَالسُّنَّةِ وَقَوْلِ غَيْرِهِ مِنَ الصَّحَابَةِ ؓ
شَرْطُ اللهِ قَبْلَ شَرْطِهَا
[Machine] The Messenger of Allah ﷺ said, "Whoever stipulates a condition that is not in the Book of Allah, then it is not binding upon him, even if it is a hundred conditions."
قَالَ رَسُولُ اللهِ ﷺ مَنْ شَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَلَيْسَ لَهُ ذَاكَ وَإِنْ كَانَ مِائَةَ شَرْطٍ
[Machine] To fulfill its condition and the words of the majority would be more appropriate.
أَنْ يُوفِيَ لَهَا بِشَرْطِهَا وَقَوْلُ الْجَمَاعَةِ أَوْلَى
[Machine] "You have disobeyed the sunnah and entrusted the matter to those who are not suitable. So, the agreement, separation, and sexual relations are in your hands." He said, and then a man came to him and said, "I married a woman and stipulated that if I do not bring such and such to her, I am not entitled to marriage." Ibn Abbas said, "Marriage is permissible and conditions are not invalid."
خَالَفْتَ السُّنَّةَ وَوَلَّيْتَ الْأَمْرَ غَيْرَ أَهْلِهِ فَالصَّدَاقُ وَالْفِرَاقُ وَالْجِمَاعُ بِيَدِكَ قَالَ وَجَاءَهُ رَجُلٌ فَقَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً وَشَرَطْتُ لَهَا إِنْ لَمْ أَجِيءْ بِكَذَا وَكَذَا إِلَى كَذَا وَكَذَا فَلَيْسَ لِي نِكَاحٌ فَقَالَ ابْنُ عَبَّاسٍ النِّكَاحُ جَائِزٌ وَالشَّرْطُ لَيْسَ بِشَيْءٍ
[Machine] Regarding the practice (sunnah), and when you have appointed someone not qualified for governance over you, then the truth is your companion and separation is in your hand. Al-Jimaah informed us through Abu Hazim al-Hafiz, who reported from Abu Al-Fadl ibn Khumayrawayh, who reported from Ahmad ibn Najdah, who reported from Sa'id ibn Mansur, who reported from Isma'il ibn 'Ayyash, who mentioned it. And in this there is a correspondence between Ata' al-Khurasani and his superior.
عَنِ السُّنَّةِ وَوَلَّيْتَ الْأَمْرَ غَيْرَ أَهْلِهِ عَلَيْكَ الصَّدَاقُ وَبِيَدِكَ الْفِرَاقُ وَالْجِمَاعُ أَخْبَرَنَاهُ أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ خُمَيْرَوَيْهِ ثنا أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا إِسْمَاعِيلُ بْنُ عَيَّاشٍ فَذَكَرَهُ وَفِي هَذَا إِرْسَالٌ بَيْنَ عَطَاءٍ الْخُرَاسَانِيِّ وَمَنْ فَوْقَهُ
[Machine] That the Messenger of Allah ﷺ said: "The women are with their husbands, wherever they may be, except for the women of the Ansar. They do not leave their homes, and they do not leave, meaning they do not leave the city. Ja'far ibn Zubayr is very weak."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ النِّسَاءُ مَعَ أَزْوَاجِهِنَّ حَيْثُ مَا كَانُوا إِلَّا نِسَاءَ الْأَنْصَارِ لَا يَخْرُجْنَ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ يَعْنِي مِنَ الْمَدِينَةِ جَعْفَرُ بْنُ الزُّبَيْرِ هَذَا ضَعِيفٌ جِدًّا
