40. Chapter
٤٠۔ كِتَابُ الصَّدَاقِ
[Machine] "From the Messenger of Allah ﷺ , he said: Announce the marriage. Abdullah bin Al-Aswad proposed to Aamir."
عَنْ رَسُولِ اللهِ ﷺ قَالَ أَعْلِنُوا النِّكَاحَ تَفَرَّدَ بِهِ عَبْدُ اللهِ بْنُ الْأَسْوَدِ عَنْ عَامِرٍ
[Machine] The Messenger of Allah ﷺ , "Did you have amusement with you, for the Ansar love amusement?"
رَسُولُ اللهِ ﷺ هَلْ كَانَ مَعَكُمْ لَهْوٌ فَإِنَّ الْأَنْصَارَ يُحِبُّونَ اللهْوَ
The Messenger of Allah (May peace be upon him) came and visited me in the morning when I had been conducted to my husband, and sat on my bedding as you are sitting beside me. Some little girls of ours began to play the tambourine and eulogise those of my ancestors who were killed in the battle of Badr, and then one of them said: And among us is a Prophet who knows what will happen tomorrow. He said : Stop this and say what you were saying. (Using translation from Abū Dāʾūd 4922)
جَاءَ رَسُولُ اللهِ ﷺ فَدَخَلَ عَلَيَّ صَبِيحَةَ بُنِيَ بِي فَجَلَسَ عَلَى فِرَاشِي كَمَجْلِسِكَ مِنِّي فَجَعَلَتْ جُوَيْرِيَاتٌ يَضْرِبْنَ الدُّفَّ لَهُنَّ وَيَنْدُبْنَ مَنْ قُتِلَ مِنْ آبَائِي يَوْمَ بَدْرٍ إِلَى أَنْ قَالَتْ إِحْدَاهُنَّ وَفِينَا نَبِيٌّ يَعْلَمُ مَا فِي غَدٍ فَقَالَ دَعِي هَذَا وَقُولِي الَّذِي كُنْتِ تَقُولِينَ
[Machine] When a woman or a man got married, the female slaves of the Ansar would come out, singing and playing. They said, "Pass by a gathering where the Messenger of Allah ﷺ is present and we are singing and playing, and she would urge her husband to give her a ram to slaughter while they are in the Mihrab and her husband is in the mosque, knowing what will happen tomorrow." Indeed, the Prophet ﷺ came to them and said, "Glory be to Allah, no one knows what will happen tomorrow except Allah. Do not say such things, but say 'we have come to you, we have come to you.' Greet us and we will greet you. This is a good Messenger."
كَانَ النِّسَاءُ إِذَا تَزَوَّجَتِ الْمَرْأَةُ أَوِ الرَّجُلُ خَرَجَ جَوَارِي مِنْ جَوَارِي الْأَنْصَارِ وَيُغَنِّينَ وَيَلْعَبْنَ قَالَتْ فَمَرُّوا فِي مَجْلِسٍ فِيهِ رَسُولُ اللهِ ﷺ وَهُنَّ يُغَنِّينَ وَهُنَّ يَقُلْنَ أَهْدَى لَهَا زَوْجُهَا كَبْشًا يُبَحْبِحْنَ فِي الْمِرْبَدِ وَزَوْجُهَا فِي النَّادِي يَعْلَمُ مَا فِي غَدِ وَإِنَّ النَّبِيَّ ﷺ قَامَ إِلَيْهِنَّ فَقَالَ سُبْحَانَ اللهِ لَا يَعْلَمُ مَا فِي غَدٍ إِلَّا اللهُ لَا تَقُولُوا هَكَذَا وَقُولُوا أَتَيْنَاكُمْ أَتَيْنَاكُمْ فَحَيَّانَا وَحَيَّاكُمْ هَذَا مُرْسَلٌ جَيِّدٌ
[Machine] The wife of the Prophet ﷺ narrated that the Prophet ﷺ heard people singing at a wedding, and they were saying, "And her husband gifted her a slaughtered ram to be cooked, and your love is in the gathering, and he knows what will happen tomorrow." Or he ﷺ said, "Yahya said, 'And your husband is in the gathering, and he knows what will happen tomorrow.'" She said to him, so the Messenger of Allah ﷺ said, "No one knows what will happen tomorrow except Allah, the Exalted." And this is not found in the narration of Abu Abdullah. Or he ﷺ said, "Yahya said, 'And your husband is in the gathering.'"
ؓ زَوْجِ النَّبِيِّ ﷺ أَنَّ النَّبِيَّ ﷺ سَمِعَ نَاسًا يُغَنُّونَ فِي عُرْسٍ وَهُمْ يَقُولُونَ وَأَهْدَى لَهَا زَوْجُهَا أَكْبُشَ يُبَحْبِحْنَ فِي الْمِرْبَدِ وَحِبُّكِ فِي النَّادِي وَيَعْلَمُ مَا فِي غَدِ أَوْ قَالَ يَحْيَى وَزَوْجُكِ فِي النَّادِي وَيَعْلَمُ مَا فِي غَدِ قَالَتْ فَقَالَ رَسُولُ اللهِ ﷺ لَا يَعْلَمُ مَا فِي غَدٍ إِلَّا اللهُ سُبْحَانَهُ وَلَيْسَ فِي حَدِيثِ أَبِي عَبْدِ اللهِ أَوْ قَالَ يَحْيَى وَزَوْجُكِ فِي النَّادِي
'Aisha arranged a marriage for a female relative of hers among the Ansar. The Messenger of Allah came and said: Have you taken the girl (to her husbands house)?” They said: “Yes.” He said: “Have you sent someone with her to sing?” She said: “No.” The Messenger of Allah said: “The Ansar are People with romantic feelings. Why don't you send someone with her to say: 'We have come to you, we have come to you, may Allah bless you and us?'” (Using translation from Ibn Mājah 1900)
أَنْكَحَتْ ذَا قَرَابَةٍ لَهَا مِنَ الْأَنْصَارِ فَجَاءَ النَّبِيُّ ﷺ فَقَالَ أَهْدَيْتُمُ الْفَتَاةَ؟ قَالَتْ نَعَمْ قَالَ فَأَرْسَلْتُمْ مَنْ تُغَنِّي؟ قَالَتْ لَا قَالَ النَّبِيُّ ﷺ إِنَّ الْأَنْصَارَ قَوْمٌ فِيهِمْ غَزَلٌ فَلَوْ أَرْسَلْتُمْ مَنْ يَقُولُ أَتَيْنَاكُمْ أَتَيْنَاكُمْ فَحَيَّانَا وَحَيَّاكُمْ
عَنْ أَبِي إِسْحَاقَ
[Machine] Abdul Malik came to me with his slave girls, hitting the tambourine and singing. So I said, "Do you allow such things while you are the companions of Muhammad ﷺ ?" They said, "He has permitted us to perform at weddings and mourn at the time of calamities." Shirik reported it with the same meaning and mentioned Qarzah and Abu Mas'ood. However, he said, "Except for weeping at the time of calamities." Shirik said, "I saw him saying this statement." He said, "Except for weeping, not wailing."
عَبْدُ الْمَلِكِ ذَهَبَ عَلَيَّ وَجَوَارِي يَضْرِبْنَ بِالدُّفِّ وَيُغَنِّينَ فَقُلْتُ تُقِرُّونَ عَلَى هَذَا وَأَنْتُمْ أَصْحَابُ مُحَمَّدٍ ﷺ؟ قَالُوا إِنَّهُ قَدْ رَخَّصَ لَنَا فِي الْعُرُسَاتِ وَالنِّيَاحَةِ عِنْدَ الْمُصِيبَةِ وَرَوَاهُ شَرِيكٌ بِمَعْنَاهُ وَذَكَرَ قَرَظَةَ وَأَبَا مَسْعُودٍ إِلَّا أَنَّهُ قَالَ وَفِي الْبُكَاءِ عِنْدَ الْمُصِيبَةِ قَالَ شَرِيكٌ أُرَاهُ قَالَ فِي غَيْرِ نَوْحٍ
[Machine] Narrated by the Prophet ﷺ : "There is a separation between what is permissible and what is forbidden, which is the sound and beating of the drums during marriage." And Abu Abdul Rahman As-Sulami informed us, narrating from Abu Al-Hasan Al-Karizi, narrating from Ali Ibn Abdul Aziz, from Abu Ubaid, from Hushaym, that this was mentioned to him, except that he (the Prophet) said: "And the beating of drums during marriage." Abu Ubaid said: "Some people have claimed that the drum is a language, and the narration is with a fatha (vowel marking of "a" sound), and as for the saying 'the sound,' some people interpret it as referring to listening, and this is incorrect. As for its meaning according to us, it is the announcement of marriage and the disturbance caused by the sound and mentioning among the people. And for this reason, Umar said..."
عَنِ النَّبِيِّ ﷺ قَالَ فَصْلٌ بَيْنَ الْحَلَالِ وَالْحَرَامِ الصَّوْتُ وَضَرْبُ الدُّفِّ فِي النِّكَاحِ 14695 وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنا أَبُو الْحَسَنِ الْكَارِزِيُّ نا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ عَنْ أَبِي عُبَيْدٍ نا هُشَيْمٌ عَنْعَنَ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ وَالدُّفُّ فِي النِّكَاحِ قَالَ أَبُو عُبَيْدٍ قَدْ زَعَمَ بَعْضُ النَّاسِ أَنَّ الدُّفَّ لُغَةً وَالْخَبَرُ بِالْفَتْحِ وَأَمَّا قَوْلُهُ الصَّوْتُ فَبَعْضُ النَّاسِ يَذْهَبُ بِهِ إِلَى السَّمَاعِ وَهَذَا خَطَأٌ وَفِيمَا مَعْنَاهُ عِنْدَنَا إِعْلَانُ النِّكَاحِ وَاضْطِرَابُ الصَّوْتِ بِهِ وَالذِّكْرُ فِي النَّاسِ وَلِذَلِكَ قَالَ عُمَرُ
[Machine] "O Amir al-Mu'minin, there was a matter that was less significant and I testified against him regarding it. Then Umar pushed the punishment away from the person who threw it and said, 'Protect the chastity of these women and announce this marriage, and he forbade mut'a (temporary marriage)."
يَا أَمِيرَ الْمُؤْمِنِينَ كَانَ أَمْرٌ دُونَ فَأَشْهَدْتُ عَلَيْهِ أَهْلَهَا فَدَرَأَ عُمَرُ ؓ الْحَدَّ عَنْ قَاذِفِهِ وَقَالَ حَصِّنُوا فَرُوجَ هَذِهِ النِّسَاءِ وَأَعْلِنُوا هَذَا النِّكَاحَ وَنَهَى عَنِ الْمُتْعَةِ
[Machine] What is this? If they say a wedding or circumcision, he remained silent.
مَا هَذَا؟ فَإِنْ قَالُوا عُرْسٌ أَوْ خِتَانٌ صَمَتَ
[Machine] The Messenger of Allah ﷺ said: "Make marriage public and announce it openly. Celebrate it with the beating of drums." He said this, and it is said that he was Khalid ibn Elias, a weak narrator.
قَالَ رَسُولُ اللهِ ﷺ أَظْهِرُوا النِّكَاحَ وَاضْرِبُوا عَلَيْهِ بِالْغِرْبَالِ كَذَا قَالَ وَإِنَّمَا هُوَ خَالِدُ بْنُ إِلْيَاسَ ضَعِيفٌ
[Machine] The Messenger of Allah ﷺ said, "Announce this marriage and hold it in the mosques, and strike it with drums. Let one of you must offer something, even if it is a sheep. And when one of you intends to propose to a woman who has adorned herself with black, let him inform her and not deceive her, for Isa bin Maymun is weak."
قَالَ رَسُولُ اللهِ ﷺ أَعْلِنُوا هَذَا النِّكَاحَ وَاجْعَلُوهُ فِي الْمَسَاجِدِ وَاضْرِبُوا عَلَيْهِ بِالدُّفُوفِ وَلْيُولِمْ أَحَدُكُمْ وَلَوْ بِشَاةٍ فَإِذَا خَطَبَ أَحَدُكُمُ امْرَأَةً وَقَدْ خَضَبَ بِالسَّوَادِ فَلْيُعْلِمْهَا وَلَا يَغُرَّنَّهَا عِيسَى بْنُ مَيْمُونٍ ضَعِيفٌ
[Machine] The Messenger of Allah ﷺ passed by Bani Zuraiq and heard singing and playing. He asked, "What is this?" They replied, "It is the wedding of so-and-so, O Messenger of Allah." He said, "This wedding is complete, not adulterous nor secretive, until a drum is heard or smoke is seen." Husayn narrated that 'Amr ibn Yahya al-Mazini said, "The Messenger of Allah ﷺ disliked secret marriages until they are announced with a drum." Husayn ibn 'Abdullah is weak in hadith narration.
أَنَّ رَسُولَ اللهِ ﷺ مَرَّ هُوَ وَأَصْحَابُهُ بِبَنِي زُرَيْقٍ فَسَمِعُوا غِنَاءً وَلَعِبًا فَقَالَ مَا هَذَا؟ قَالُوا نِكَاحُ فُلَانٍ يَا رَسُولَ اللهِ قَالَ كَمَّلَ دِينَهُ هَذَا النِّكَاحُ لَا السِّفَاحُ وَلَا نِكَاحُ السِّرِّ حَتَّى يُسْمَعَ دُفٌّ أَوْ يُرَى دُخَانٌ قَالَ حُسَيْنٌ وَحَدَّثَنِي عَمْرُو بْنُ يَحْيَى الْمَازِنِيُّ أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَكْرَهُ نِكَاحَ السِّرِّ حَتَّى يُضْرَبَ بِالدُّفِّ حُسَيْنُ بْنُ عَبْدِ اللهِ ضَعِيفٌ
