40. Chapter
٤٠۔ كِتَابُ الصَّدَاقِ
A woman came to the Messenger of Allah ﷺ and said: Messenger of Allah, I have offered myself to you. When she stood for a long time, a man got up and said: Messenger of Allah, marry her to me if you have no need for her. The Messenger of Allah ﷺ asked: Have you anything to give her as dower ? He replied: I have nothing by this lower garment of mine. The Messenger of Allah ﷺ said: If you give your lower garment, you will sit while you have no lower garment. So look for something else. He said: I do not find anything. He said: Look for something, even though it should be an iron ring. The man sought it but found nothing. The Messenger of Allah ﷺ said: Do you know anything from the Qur'an ? He said: Yes, I know surah so and so, which he named. The Messenger of Allah ﷺ said: I have given you her in marriage for the part of the Qur'an which you know. (Using translation from Abū Dāʾūd 2111)
أَنَّ رَسُولَ اللهِ ﷺ جَاءَتْهُ امْرَأَةٌ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي وَهَبْتُ نَفْسِي لَكَ فَقَامَتْ قِيَامًا طَوِيلًا فَقَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ زَوِّجْنِيهَا إِنْ لَمْ تَكُنْ لَكَ بِهَا حَاجَةٌ فَقَالَ رَسُولُ اللهِ ﷺ هَلْ عِنْدَكَ مِنْ شَيْءٍ تُصْدِقُهَا إِيَّاهُ؟ قَالَ مَا عِنْدِي إِلَّا إِزَارِي هَذَا قَالَ رَسُولُ اللهِ ﷺ إِنْ أَعْطَيْتَهَا إِيَّاهُ جَلَسْتَ لَا إِزَارَ لَكَ فَالْتَمِسْ شَيْئًا قَالَ وَاللهِ مَا أَجِدُ شَيْئًا قَالَ الْتَمِسْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ فَالْتَمَسَ فَلَمْ يَجِدْ شَيْئًا فَقَالَ رَسُولُ اللهِ ﷺ هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ؟ قَالَ نَعَمْ سُورَةُ كَذَا وَسُورَةُ كَذَا فَقَالَ رَسُولُ اللهِ ﷺ قَدْ زَوَّجْتُكَهَا عَلَى مَا مَعَكَ مِنَ الْقُرْآنِ
[Machine] He heard Sahl bin Saad Al-Saadi saying: I was among the people in the presence of the Prophet ﷺ when a woman stood up and said, "I have offered myself to you, so what is your opinion?" A man from the people stood up and said, "O Messenger of Allah, marry her to me." He did not respond to him. Then another woman stood up and said, "O Messenger of Allah, she has offered herself to you, so what is your opinion?" The man stood up again and said, "O Messenger of Allah, marry her to me." Then a third woman stood up and the Prophet ﷺ asked him, "Do you have anything?" He replied, "No." He said, "Go and search, even if it is a ring made of iron." He went and searched but did not find anything. He said, "Go and search, even if it is for a verse from the Quran." He said, "Yes, Surah so and so, and Surah so and so." He said, "Go, for I have married her to you based on what you have from the Quran, as the words of both of them are equal."
أَنَّهُ سَمِعَ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ ؓ يَقُولُ كُنْتُ فِي الْقَوْمِ عِنْدَ النَّبِيِّ ﷺ فَقَامَتِ امْرَأَةٌ فَقَالَتْ إِنَّهَا وَهَبَتْ نَفْسَهَا لَكَ فَرَ فِيهَا رَأْيَكَ فَقَامَ رَجُلٌ مِنَ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ زَوِّجْنِيهَا فَلَمْ يَرُدَّ عَلَيْهِ شَيْئًا ثُمَّ قَامَتْ فَقَالَتْ يَا رَسُولَ اللهِ إِنَّهَا قَدْ وَهَبَتْ نَفْسَهَا لَكَ فَرَ فِيهَا رَأْيَكَ فَقَامَ الرَّجُلُ فَقَالَ يَا رَسُولَ اللهِ زَوِّجْنِيهَا ثُمَّ قَامَتِ الثَّالِثَةُ فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ عِنْدَكَ مِنْ شَيْءٍ؟ قَالَ لَا قَالَ فَاذْهَبْ فَاطْلُبْ فَذَهَبَ فَطَلَبَ فَلَمْ يَجِدْ شَيْئًا قَالَ اذْهَبْ فَاطْلُبْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ قَالَ فَذَهَبَ فَطَلَبَ فَقَالَ لَمْ أَجِدْ شَيْئًا قَالَ هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ؟ قَالَ نَعَمْ سُورَةُ كَذَا وَسُورَةُ كَذَا قَالَ اذْهَبْ فَقَدْ زَوَّجْتُكَهَا عَلَى مَا مَعَكَ مِنَ الْقُرْآنِ لَفْظُ حَدِيثِهِمَا سَوَاءٌ
The Prophet ﷺ seeing a yellow mark (of perfume) on the clothes of ʿAbdur-Rahman bin ʿAuf, said, "What about you?" ʿAbdur-Rahman replied, "I have married a woman with a Mahr of gold equal to a date-stone." The Prophet ﷺ said, "May Allah bestow His Blessing on you (in your marriage). Give a wedding banquet, (Walima) even with one sheep." (Using translation from Bukhārī 6386)
أَنَّ رَسُولَ اللهِ ﷺ رَأَى عَلَى عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ أَثَرَ صُفْرَةٍ فَقَالَ مَهْيَمْ أَوْ مَهْ؟ فَقَالَ تَزَوَّجْتُ امْرَأَةً قَالَ عَلَى كَمْ؟ قَالَ عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ قَالَ بَارَكَ اللهُ لَكَ أَوْلِمْ وَلَوْ بِشَاةٍ
[Machine] Abdul Rahman ibn Awf married a woman from the Ansar (the helpers) on the weight of a nawa (a measure) of gold. He saw the Prophet ﷺ with the joy of the wedding, so he asked him, and he said, "Indeed, I married a woman on the weight of a nawa of gold."
أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ ؓ تَزَوَّجَ امْرَأَةً مِنَ الْأَنْصَارِ عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ فَرَأَى النَّبِيُّ ﷺ بَشَاشَةَ الْعُرْسِ وَسَأَلَهُ فَقَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ
[Machine] Abdulrahman arrived as an immigrant and the Prophet ﷺ formed a brotherhood between him and Saad ibn Rabee’. Saad said to him, "I have two wives, so look which one you like until I divorce her, and when her waiting period ends, you can marry her. I also have wealth, so I will give you half of it." Abdulrahman said, "May Allah bless you in your family and wealth. Show me the way to the marketplace." They showed him the way and he did not return that day until he came back with goods. The Prophet ﷺ then lost him and when he came to him, he had shabby clothes on. The Prophet ﷺ asked him, "What happened?" Abdulrahman replied, "I married a woman from the Ansar." The Prophet ﷺ asked, "How much did you give as dowry?" Abdulrahman said, "A date stone of gold weight, or he might have said, the weight of a date stone of gold." The Prophet ﷺ said, "Give me the bone if you have, even if it is from a sheep." Az-Zuhri said, "And he informed us that Yazid ibn Harun narrated to us from Humeid from Anas in a similar manner, except that Anas said, 'He received some fat and meat as profit.'"
قَدِمَ عَبْدُ الرَّحْمَنِ مُهَاجِرًا فَآخَى النَّبِيُّ ﷺ بَيْنَهُ وَبَيْنَ سَعْدِ بْنِ الرَّبِيعِ ؓ فَقَالَ لَهُ سَعْدٌ لِي امْرَأَتَانِ فَانْظُرْ أَيَّتَهُمَا أَحَبُّ إِلَيْكَ حَتَّى أُطَلِّقَهَا فَإِذَا انْقَضَتْ عِدَّتُهَا تَزَوَّجْهَا وَلِي مَالٌ فَنِصْفُهُ لَكَ فَقَالَ بَارَكَ اللهُ لَكَ فِي أَهْلِكَ وَمَالِكَ دُلُّونِي عَلَى السُّوقِ فَدَلُّوهُ قَالَ فَلَمْ يَرْجِعْ يَوْمَئِذٍ حَتَّى جَاءَ بِأَشْيَاءَ ثُمَّ فَقَدَهُ النَّبِيُّ ﷺ فَأَتَاهُ وَعَلَيْهِ وَضَرُ صُفْرَةٍ فَقَالَ لَهُ مَهْيَمْ؟ فَقَالَ تَزَوَّجْتُ امْرَأَةً مِنَ الْأَنْصَارِ قَالَ عَلَى كَمْ؟ قَالَ عَلَى نَوَاةٍ مِنْ ذَهَبٍ أَوْ قَالَ وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ قَالَ أَوْلِمْ وَلَوْ بِشَاةٍ قَالَ وَحَدَّثَنَا الزَّعْفَرَانِيُّ ثنا يَزِيدُ بْنُ هَارُونَ أنبأ حُمَيْدٌ عَنْ أَنَسٍ نَحْوَهُ إِلَّا أَنَّهُ قَالَ أَصَابَ شَيْئًا مِنْ سَمْنٍ وَأَقِطٍ رَبِحَهُ
[Machine] The Messenger of Allah, ﷺ , used to be gentle even with a sheep.
رَسُولُ اللهِ ﷺ أَوْلِمْ وَلَوْ بِشَاةٍ
عَنْ شُعْبَةَ دُونَ قَوْلِهِ فَجَازَ ذَلِكَ
[Machine] The passage translates to: "Yani al-nawata thalathata darahim wa thuluthan."
قُوِّمَتْ يَعْنِي النَّوَاةَ ثَلَاثَةَ دَرَاهِمَ وَثُلُثًا
[Machine] That Abdul Rahman Ibn Awf married a woman from the Ansar on the condition that her dowry be equivalent to a weight of gold, which was five dirhams. And this is similar to...
أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ تَزَوَّجَ امْرَأَةً مِنَ الْأَنْصَارِ عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ قُوِّمَتْ خَمْسَ دَرَاهِمَ وَهَذَا أَشْبَهُ
[Machine] And five dirhams are called a nugget of gold, just as forty ounces are called a uqiyyah, and just as twenty are called a nash. 14367 Abu Ubaid said, Yahya ibn Saeed narrated to me from Sufyan, who narrated from Mansur, who narrated from Mujahid, who said, "An uqiyyah is forty, a nash is twenty, and a nugget is five."
وَخَمْسَةُ دَرَاهِمَ تُسَمَّى نَوَاةَ ذَهَبٍ كَمَا تُسَمَّى الْأَرْبَعُونَ أُوقِيَّةً وَكَمَا تُسَمَّى الْعِشْرُونَ نَشًّا 14367 قَالَ أَبُو عُبَيْدٍ حَدَّثَنِيهِ يَحْيَى بْنُ سَعِيدٍ عَنْ سُفْيَانَ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ قَالَ الْأُوقِيَّةُ أَرْبَعُونَ وَالنَّشُّ عِشْرُونَ وَالنَّوَاةُ خَمْسَةٌ
[Machine] I heard Jabir ibn Abdullah say, "We used to enjoy eating dates and flour in the days of the Prophet Muhammad ﷺ and Abu Bakr, until Umar advised us against it due to an incident involving Amr ibn Huraith."
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ ؓ يَقُولُ كُنَّا نَسْتَمْتِعُ بِالْقَبْضَةِ مِنَ التَّمْرِ وَالدَّقِيقِ الْأَيَّامَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَأَبِي بَكْرٍ حَتَّى نَهَانَا عُمَرُ فِي شَأْنِ عَمْرِو بْنِ حُرَيْثٍ
[Machine] From Jabir, we used to have sexual intercourse during the time of the Messenger of Allah ﷺ with just a morsel of food. This is the first narration, except that he came with it and added this phrase, and Ya'qub bin 'Ata' is not relying on it.
عَنْ جَابِرٍ كُنَّا نَنْكِحَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ بِالْقَبْضَةِ مِنَ الطَّعَامِ هَذَا هُوَ الْحَدِيثُ الْأَوَّلُ إِلَّا أَنَّهُ أَتَى بِهِ بِهَذَا اللَّفْظِ وَيَعْقُوبُ بْنُ عَطَاءٍ غَيْرُ مُحْتَجٍّ بِهِ
[Machine] "That the Prophet ﷺ said: If a man marries a woman in exchange for a handful of food, it would be considered as a dowry."
أَنَّ النَّبِيَّ ﷺ قَالَ لَوْ أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً عَلَى مِلْءِ كَفٍّ مِنْ طَعَامٍ لَكَانَ ذَلِكَ صَدَاقًا
[Machine] The Messenger of Allah ﷺ said, "Whoever gives a handful of dates, or a handful of wheat, or a handful of barley in charity, he will indeed be permissible."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْطَى فِي صَدَاقٍ مِلْءَ كَفَّيْهِ بُرًّا أَوْ تَمْرًا أَوْ سَوِيقًا أَوْ دَقِيقًا فَقَدِ اسْتَحَلَّ
[Machine] The Prophet ﷺ said: "Whoever permits something with a dirham, it means he has permitted marriage." This was narrated by Abu Bakr ibn Abi Shaybah from Wakee' from Ibn Abi Labeebah from his grandfather from the Prophet ﷺ.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اسْتَحَلَّ بِدِرْهَمٍ فَقَدِ اسْتَحَلَّ يَعْنِي النِّكَاحَ وَرَوَاهُ أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ عَنْ وَكِيعٍ عَنِ ابْنِ أَبِي لَبِيبَةَ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ
[Machine] A man from the Banu Fazara came to the Prophet ﷺ and said, "I have married a woman on the condition that she wears two sandals." The Prophet ﷺ approved of that, meaning he approved of their marriage.
جَاءَ رَجُلٌ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ قَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً عَلَى نَعْلَيْنِ فَأَجَازَ النَّبِيُّ ﷺ ذَلِكَ أَيْ نِكَاحَهُ
[Machine] An woman from Fazara was brought to the Prophet ﷺ. She had married wearing a pair of sandals. The Messenger of Allah ﷺ asked her, "Are you satisfied with yourself and your wealth with a pair of sandals?" She replied, "Yes." Then Asim ibn Ubayd Allah ibn Asim ibn Umar ibn Al-Khattab approved it, and the Imams narrated from him despite his weakness.
أَنَّ امْرَأَةً مِنْ فَزَارَةَ جِيءَ بِهَا إِلَى النَّبِيِّ ﷺ قَدْ تَزَوَّجْتُ عَلَى نَعْلَيْنِ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ أَرَضِيتِ مِنْ نَفْسِكِ وَمَالِكِ بِنَعْلَيْنِ؟ قَالَتْ نَعَمْ فَأَجَازَهُ عَاصِمُ بْنُ عُبَيْدِ اللهِ بْنِ عَاصِمِ بْنِ عُمَرَ بْنِ الْخَطَّابِ تَكَلَّمُوا فِيهِ وَمَعَ ضَعْفِهِ رَوَى عَنْهُ الْأَئِمَّةُ
[Machine] The Messenger of Allah ﷺ said, "Marry those who are single among you." They (the people) said, "O Messenger of Allah, what are the criteria between them?" He said, "Whatever their families agree upon." And Abu Abdullah and Abu Bakr narrated to us, they said: Abu al-Abbas narrated to us, narrated by Al-Hasan ibn Ali ibn Abi Talib, narrated by Yahya, from Hafs ibn Ghayyath and Abi Muawiyah, from Hajjaj ibn Artat, from Abdul Malik ibn Al-Mughira Al-Taifi, from Abdul Rahman ibn Al-Baylamani, from the Prophet ﷺ , with a similar narration. And it has been said about Hajjaj ibn Artat, from Abdul Malik, from Abdul Rahman ibn Al-Baylamani, from Umar ibn Al-Khattab, from the Prophet ﷺ , but it is not considered preserved. Abu Bakr ibn Al-Harith narrated to us, he said: Abu Muhammad ibn Hayyan informed us, narrated by Muhammad ibn Abdullah ibn Rustah, narrated by Muhammad ibn Amr Zunayj, narrated by Harun ibn Al-Mughira, from Hajjaj, and he mentioned it in its meaning.
قَالَ رَسُولُ اللهِ ﷺ انْكِحُوا الْأَيَامَى مِنْكُمْ قَالُوا يَا رَسُولَ اللهِ فَمَا الْعَلَائِقُ بَيْنَهُمْ؟ قَالَ مَا تَرَاضَى عَلَيْهِ أَهْلُوهُمْ 14376 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ وَأَبُو بَكْرٍ قَالَا ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ ثنا يَحْيَى عَنْ حَفْصِ بْنِ غِيَاثٍ وَأَبِي مُعَاوِيَةَ عَنْ حَجَّاجِ بْنِ أَرْطَاةَ عَنْ عَبْدِ الْمَلِكِ بْنِ الْمُغِيرَةِ الطَّائِفِيِّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ عَنِ النَّبِيِّ ﷺ مِثْلَهُ هَذَا مُنْقَطِعٌ وَقَدْ قِيلَ عَنْ حَجَّاجِ بْنِ أَرْطَاةَ عَنْ عَبْدِ الْمَلِكِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ عَنِ النَّبِيِّ ﷺ وَلَيْسَ بِمَحْفُوظٍ 14377 أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ الْحَارِثِ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ رُسْتَةَ ثنا مُحَمَّدُ بْنُ عَمْرٍو زُنَيْجٌ ثنا هَارُونُ بْنُ الْمُغِيرَةِ عَنْ حَجَّاجٍ فَذَكَرَهُ بِمَعْنَاهُ
[Machine] The Messenger of Allah ( peace and blessings be upon him) said, "Marry the single people." They said, "O Messenger of Allah, who are the single people?" He said, "Those who agree to the marriage." And it was said about Muhammad ibn Abdurrahman ibn Baylamani, from his father, from Ibn Abbas, from the Prophet ﷺ , with a similar meaning, except that he said, "Those who the family agrees upon, even if it is the length of a spear from Arak." Abu Saad Al-Malini informed us that Abu Ahmad ibn Adi narrated to us, Muhammad ibn Munir Al-Mutairi narrated to us, Al-Ramadi narrated to us, Amru ibn Khalid al-Harrani narrated to us, Salih ibn Abd al-Jabbar narrated to us, and he is Abu Abd al-Rahman al-Hadrami, from Muhammad ibn Abdurrahman ibn Baylamani, so he mentioned him. Abu Ahmad said, "May Allah have mercy on him, Muhammad ibn Abdurrahman ibn Baylamani is weak, and Muhammad ibn Al-Harith is weak, and their weakness is evident in their hadith." The Sheikh said, "And Yahya ibn Ma'in and others from the verifiers of the narrations said the same, and the evidence for the hadith is supported by another chain."
قَالَ رَسُولُ اللهِ ﷺ انْكِحُوا الْأَيَامَى قَالُوا يَا رَسُولَ اللهِ مَا الْعَلَائِقُ؟ قَالَ مَا تَرَاضَى عَلَيْهِ أَهْلُوهُمْ 14379 وَقَدْ قِيلَ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ عَنْ أَبِيهِ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ ﷺ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ مَا تَرَاضَى عَلَيْهِ الْأَهْلُونَ وَلَوْ قَضِيبًا مِنْ أَرَاكٍ أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ ثنا مُحَمَّدُ بْنُ مُنِيرٍ الْمَطِيرِيُّ ثنا الرَّمَادِيُّ ثنا عَمْرُو بْنُ خَالِدٍ الْحَرَّانِيُّ ثنا صَالِحُ بْنُ عَبْدِ الْجَبَّارِ وَهُوَ أَبُو عَبْدِ الرَّحْمَنِ الْحَضْرَمِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ فَذَكَرَهُ قَالَ أَبُو أَحْمَدَ رَحِمَهُ اللهُ مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ ضَعِيفٌ وَمُحَمَّدُ بْنُ الْحَارِثِ ضَعِيفٌ وَالضَّعْفُ عَلَى حَدِيثِهِمَا بَيِّنٌ قَالَ الشَّيْخُ وَكَذَلِكَ قَالَهُ يَحْيَى بْنُ مَعِينٍ وَغَيْرُهُ مِنْ مُزَكِّي الْأَخْبَارِ وَلِلْحَدِيثِ شَاهِدٌ بِإِسْنَادٍ آخَرَ
[Machine] We asked the Messenger of Allah ﷺ about the rights of women. He replied, "It is what their husbands agree upon."
سَأَلْنَا رَسُولَ اللهِ ﷺ عَنْ صَدَاقِ النِّسَاءِ فَقَالَ هُوَ مَا اصْطَلَحَ عَلَيْهِ أَهْلُوهُمْ
[Machine] "Partner raised him to the Prophet, ﷺ , and said: It is not forbidden for a man to marry with a little or a lot of his wealth, if they agree and bear witness. Abu Haroon Al-Abdi is not a proof by himself, and it has been narrated from weak sources, from another aspect, from Abu Sa'id, raised. Al-Shafi'i, may Allah have mercy on him, said: It has reached us that Umar Ibn Al-Khattab said: In three handfuls of raisins is the dowry."
شَرِيكٌ رَفَعَهُ إِلَى النَّبِيِّ ﷺ قَالَ لَيْسَ عَلَى الرَّجُلِ جُنَاحٌ أَنْ يَتَزَوَّجَ بِقَلِيلٍ أَوْ كَثِيرٍ مِنْ مَالِهِ إِذَا تَرَاضَوْا وَأَشْهِدُوا أَبُو هَارُونَ الْعَبْدِيُّ غَيْرُ مُحْتَجٍّ بِهِ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ ضَعِيفٍ عَنْ أَبِي سَعِيدٍ مَرْفُوعًا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبَلَغَنَا أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَالَ فِي ثَلَاثِ قَبَضَاتِ زَبِيبٍ مَهْرٌ
[Machine] If she accepts you as her husband, then she will have a dowry.
إِنْ رَضِيَتْ بِسِوَاكِ أَرَاكٍ فَهُوَ لَهَا مَهْرٌ
[Machine] The Messenger of Allah ﷺ said: "Women should not be married except with their consent, and they should not be married except with the permission of their guardians, and the dowry should not be less than ten dirhams." Ahmad ibn Muhammad ibn Ahmad ibn al-Harith al-Asbahani narrated to us, Abu Muhammad ibn Hibban narrated to us, Ahmad ibn Isa ibn Sikkin al-Baladi narrated to us, Zakariya ibn al-Hakam al-Ras'ani narrated to us, Abu al-Mughira 'Abd al-Qudus ibn al-Hajjaj narrated to us, Mubashir ibn 'Ubayd mentioned him.
قَالَ رَسُولُ اللهِ ﷺ لَا يَنْكِحُ النِّسَاءَ إِلَّا كُفُؤٌ وَلَا يُزَوِّجُهُنَّ إِلَّا الْأَوْلِيَاءُ وَلَا مَهْرَ دُونَ عَشَرَةِ دَرَاهِمَ أَخْبَرَنَاه أَحْمَدُ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ الْحَارِثِ الْأَصْبَهَانِيُّ أنبأ أَبُو مُحَمَّدِ بْنُ حِبَّانَ أنبأ أَحْمَدُ بْنِ عِيسَى بْنِ سِكِّينٍ الْبَلَدِيُّ ثنا زَكَرِيَّا بْنُ الْحَكَمِ الرَّسْعَنِيُّ ثنا أَبُو الْمُغِيرَةِ عَبْدُ الْقُدُّوسِ بْنُ الْحَجَّاجِ ثنا مُبَشِّرُ بْنُ عُبَيْدٍ فَذَكَرَهُ
[Machine] The Prophet Muhammad ﷺ said: "There is no friendship without giving at least ten dirhams in charity." Abu Ali al-Hafiz, Mubashir ibn Ubayd, is known to transmit weak hadiths, and this narration is criticized and not accepted. Ali ibn Mubashir ibn Ubayd's hadiths are not supported. The scholar (may Allah have mercy on him) and al-Hajjaj ibn Arta'ah are not to be relied upon or used as evidence, and he did not receive this hadith from al-Hajjaj except through Mubashir ibn Ubayd al-Halabi. They have all unanimously agreed to abandon it, and Ahmad ibn Hanbal (may Allah have mercy on him) criticized him for fabricating hadiths.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا صَدَاقَ دُونَ عَشَرَةِ دَرَاهِمَ قَالَ أَبُو عَلِيٍّ الْحَافِظُ مُبَشِّرُ بْنُ عُبَيْدٍ مَتْرُوكُ الْحَدِيثِ وَهَذَا مُنْكَرٌ لَمْ يُتَابَعْ عَلَيْهِ قَالَ عَلِيُّ بْنُ مُبَشِّرِ بْنِ عُبَيْدٍ مَتْرُوكُ الْحَدِيثِ أَحَادِيثُهُ لَا يُتَابَعُ عَلَيْهَا قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَالْحَجَّاجُ بْنُ أَرْطَأَةَ لَا يُحْتَجُّ بِهِ وَلَمْ يَأْتِ بِهِ عَنِ الْحَجَّاجِ غَيْرُ مُبَشِّرِ بْنِ عُبَيْدٍ الْحَلَبِيِّ وَقَدْ أَجْمَعُوا عَلَى تَرْكِهِ وَكَانَ أَحْمَدُ بْنُ حَنْبَلٍ رَحِمَهُ اللهُ يَرْمِيهِ بِوَضْعِ الْحَدِيثِ
[Machine] The minimum amount for which intercourse is permissible is ten dirhams.
أَدْنَى مَا يُسْتَحَلُّ بِهِ الْفَرْجُ عَشَرَةُ دَرَاهِمَ
[Machine] Ali said, "There is no friendship without ten dirhams."
قَالَ عَلِيٌّ ؓ لَا صَدَاقَ دُونَ عَشَرَةِ دَرَاهِمَ
[Machine] "From Ali, there is something that cannot be proven like it, unless it is contradicted by another, that it is not allowed for a dowry to be less than ten dirhams. 14388 Abu Bakr ibn Al-Harith reported to us that Ali ibn Umar Al-Hafiz informed us that Ahmad ibn Muhammad ibn Said narrated to us from Abdullah ibn Ibrahim ibn Qutaybah, from Ibn Numayr, who told me that Abu Al-Basir Ibrahim ibn Ismail narrated from Ubaidullah Al-Ashja'i that he said: I asked Sufyan, meaning Al-Thawri, about the hadith of Dawud Al-Awdi from Sha'bi from Ali, that there is no dowry less than ten dirhams. Sufyan said: Dawud's narration is still rejected. I said: Shu'bah narrated from him, so he struck his forehead and said, 'Dawud, Dawud'."
عَنْ عَلِيٍّ ؓ فيه شَيْئًا لَا يَثْبُتُ مِثْلُهُ لَوْ لَمْ يُخَالِفْهُ غَيْرُهُ أَنَّهُ لَا يَكُونُ مَهْرٌ أَقَلَّ مِنْ عَشَرَةِ دَرَاهِمَ 14388 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ أَنْبَأَ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ سَعِيدٍ ثنا عَبْدُ اللهِ بْنُ إِبْرَاهِيمَ بْنِ قُتَيْبَةَ ثنا ابن نُمَيْرٍ حَدَّثَنِي أَبُو الْبَصِيرِ إِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ عَنْ عُبَيْدِ اللهِ الْأَشْجَعِيِّ قَالَ قُلْتُ لِسُفْيَانَ يَعْنِي الثَّوْرِيَّ حَدِيثُ دَاوُدَ الْأَوْدِيِّ عَنِ الشَّعْبِيِّ عَنْ عَلِيٍّ ؓ لَا مَهْرَ أَقَلَّ مِنْ عَشَرَةِ دَرَاهِمَ فَقَالَ سُفْيَانُ دَاوُدُ مَا زَالَ هَذَا يُنْكَرُ عَلَيْهِ قُلْتُ إِنَّ شُعْبَةَ رَوَى عَنْهُ فَضَرَبَ جَبْهَتَهُ وَقَالَ دَاوُدُ دَاوُدُ
[Machine] The dowry should not be less than ten dirhams, so it became a new tradition. 14390 Abu Abdullah Al-Hafiz informed us, Abu Al-Abbas Muhammad ibn Ya'qub narrated that he heard Al-Abbas ibn Muhammad say that he heard Yahya ibn Ma'in say that Ghiyath is a liar, not trustworthy or reliable. Abu Al-Fadl said he is Ghiyath ibn Ibrahim Al-Basri. He said, "And I heard Yahya say that Dawud Al-Awdi is nothing." 14391 Abu Saad Al-Malini informed us, Abu Ahmad ibn Adi informed us, Al-Saghi narrated that he heard Ibn Al-Muthanna say that he never heard Yahya ibn Sa'id Al-Qattan or Abdul Rahman ibn Mahdi narrate anything from Sufyan, or from Dawud ibn Yazid, even a small thing. And it was narrated from Ali ibn Abi Talib, in contradiction to that.
لَا يَكُونُ مَهْرٌ أَقَلَّ مِنْ عَشَرَةِ دَرَاهِمَ فَصَارَ حَدِيثًا 14390 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ قَالَ سَمِعْتُ الْعَبَّاسَ بْنَ مُحَمَّدٍ يَقُولُ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ يَقُولُ غِيَاثٌ كَذَّابٌ لَيْسَ بِثِقَةٍ وَلَا مَأْمُونٍ قَالَ أَبُو الْفَضْلِ هُوَ غِيَاثُ بْنُ إِبْرَاهِيمَ الْبَصْرِيُّ قَالَ وَسَمِعْتُ يَحْيَى يَقُولُ دَاوُدُ الْأَوْدِيُّ لَيْسَ بِشَيْءٍ 14391 أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أَنْبَأَ أَبُو أَحْمَدَ بْنُ عَدِيٌّ أَنْبَأَ السَّاجِيُّ قَالَ سَمِعْتُ ابْنَ الْمُثَنَّى يَقُولُ مَا سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ الْقَطَّانَ وَلَا عَبْدَ الرَّحْمَنِ يَعْنِي ابْنَ مَهْدِيٍّ حَدَّثَنَا عَنْ سُفْيَانَ عَنْ دَاوُدَ بْنِ يَزِيدَ شَيْئًا قَطُّ وَبِمَعْنَاهُ قَالَ عَمْرُو بْنُ عَلِيٍّ وَقَدْ رُوِيَ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ بِخِلَافِ ذَلِكَ
الصَّدَاقُ مَا تَرَاضَى بِهِ الزَّوْجَانِ
[Machine] Abu al-Abbas al-Asamm narrated that Rabee' reported from Shafi'i who reported from Sufyan who reported from Ayoub bin Musa who reported from Yazid bin Abdullah bin Qusayt that a man was informed of good news about a slave girl, so a man said, "Give her to me." This was mentioned to Saeed bin Musayyib, who said, "No one is allowed to have a gifted slave girl after the Prophet ﷺ, even if he were to whip her with a lash that is beyond measure." He also said in another place, "Even if he were to whip her with a lash, she is permissible for him."
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ عَنْ أَيُّوبَ بْنِ مُوسَى عَنْ يَزِيدَ بْنِ عَبْدِ اللهِ بْنِ قُسَيْطٍ قَالَ بُشِّرَ رَجُلٌ بِجَارِيَةٍ فَقَالَ رَجُلٌ هَبْهَا لِي فَذُكِرَ ذَلِكَ لِسَعِيدِ بْنِ الْمُسَيِّبِ فَقَالَ لَمْ تَحِلَّ الْمَوْهُوبَةُ لِأَحَدٍ بَعْدَ النَّبِيِّ ﷺ وَلَوْ أَصْدَقَهَا سَوْطًا فَمَا فَوْقَهُ جَازَ وَقَالَ فِي مَوْضِعٍ آخَرَ وَلَوْ أَصْدَقَهَا سَوْطًا أُحِلَّتْ لَهُ
[Machine] "And if it were a handful of corn or a grain of corn, and Allah knows best."
وَلَوْ كَانَ قَبْضَةً مِنْ حِنْطَةٍ أَوْ حَبَّةَ حِنْطَةٍ وَاللهُ أَعْلَمُ
