40. Chapter
٤٠۔ كِتَابُ الصَّدَاقِ
[Machine] He is the man who marries the woman and has not given her a dowry, then divorces her before consummating the marriage. So Allah has commanded to provide for her according to his means, whether he is wealthy or in difficulty. If he is wealthy, he should provide for her with a servant or something similar, and if he is in difficulty, then with three pieces of clothing or something similar.
هُوَ الرَّجُلُ يَتَزَوَّجُ الْمَرْأَةَ وَلَمْ يُسَمِّ لَهَا صَدَاقًا ثُمَّ طَلَّقَهَا مِنْ قَبْلِ أَنْ يَنْكِحَهَا فَأَمَرَ اللهُ تَعَالَى أَنْ يُمَتِّعْهَا عَلَى قَدْرِ يُسْرِهِ وَعُسْرِهِ فَإِنْ كَانَ مُوسِرًا مَتَّعَهَا بِخَادِمٍ أَوْ نَحْوِ ذَلِكَ وَإِنْ كَانَ مُعْسِرًا فَبِثَلَاثَةِ أَثْوَابٍ أَوْ نَحْوِ ذَلِكَ
[Machine] "Give her this and buy her that, and we considered that to be equivalent to about thirty dirhams. I said to Nafi', 'How was this man?' He said, 'He was generous and it was reported to us from another source that Nafi' narrated from Ibn 'Umar who said, 'The minimum amount of enjoyment would be thirty dirhams.'"
أَعْطِهَا كَذَا وَاكْسُهَا كَذَا فَحَسَبْنَا ذَلِكَ فَإِذَا هُوَ نَحْوٌ مِنْ ثَلَاثِينَ دِرْهَمًا قُلْتُ لِنَافِعٍ كَيْفَ كَانَ هَذَا الرَّجُلُ؟ قَالَ كَانَ مُتَسَدِّدًا وَرُوِّينَا مِنْ وَجْهٍ آخَرَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ أَدْنَى مَا يَكُونُ مِنَ الْمُتْعَةِ ثَلَاثُونَ دِرْهَمًا
[Machine] Abu Ubaid means to enjoy her sexually after divorce, and the Arabs used to call sexual enjoyment "al-tahmeem".
أَبُو عُبَيْدٍ يَعْنِي مَتَّعَهَا بِهَا بَعْدَ الطَّلَاقِ وَكَانَتِ الْعَرَبُ تُسَمِّي الْمُتْعَةَ التَّحْمِيمَ
فَبَلَغَهُ ذَلِكَ فَرَاجَعَهَا
[Machine] The woman is a rare possession of a separated lover.
الْمَرْأَةُ مَتَاعٌ قَلِيلٌ مِنْ حَبِيبٍ مَفَارِقٍ
