البيهقي:١٤٤٤١ – وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ أَنَّهُ بَلَغَهُ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ سُئِلَ عَنِ الْمَرْأَةِ تَشْتَرِطُ عَلَى زَوْجِهَا أَنَّهُ لَا يَخْرُجُ بِهَا مِنْ بَلَدِهَا قَالَ فَقَالَ سَعِيدٌ يَخْرُجُ بِهَا إِنْ شَاءَ وَرُوِّينَا عَنِ الشَّعْبِيِّ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً وَشَرَطَ لَهَا دَارَهَا فَقَالَ زَوْجُهَا دَارُهَا وَرُوِّينَا عَنْ عَمْرِو بْنِ الْعَاصِ ؓ أَنَّهُ قَالَ أَرَى

أَنْ يُوفِيَ لَهَا بِشَرْطِهَا وَقَوْلُ الْجَمَاعَةِ أَوْلَى
