٦٣۔ كِتَابُ الْأَيْمَانِ ص ٤
[Machine] About Al-Hasan and Sa'id ibn al-Musayyib, they said about expiation, "It can be the measurement of wheat or the measurement of barley."
عَنِ الْحَسَنِ وَسَعِيدِ بْنِ الْمُسَيِّبِ أَنَّهُمَا قَالَا فِي الْكَفَّارَةِ مُدُّ حِنْطَةٍ أوْ مُدُّ شَعِيرٍ
[Machine] "That I give them, and when you see that I have done that, then feed on my behalf ten needy people, giving each of them a saa' of wheat or a saa' of dates. This is something that Umar used to see, and perhaps he preferred to increase and reward less than that, based on what we mentioned."
أَنْ أُعْطِيَهُمْ فَإِذَا رَأَيْتَنِي قَدْ فَعَلْتُ ذَلِكَ فَأَطْعِمْ عَنِّي عَشَرَةَ مَسَاكِينَ بَيْنَ كُلِّ مِسْكِينَيْنِ صَاعًا مِنْ بُرٍّ أَوْ صَاعًا مِنْ تَمْرٍ فَهَذَا شَيْءٌ كَانَ يَرَاهُ عُمَرُ ؓ وَلَعَلَّهُ كَانَ يَسْتَحِبُّ أَنْ يَزِيدَ وَيُجْزِئُ أَقَلُّ مِنْهُ بِدَلِيلِ مَا ذَكَرْنَا
63.27 [Machine] Who Swears an Oath in Something and Does Not Do It Repeatedly
٦٣۔٢٧ بَابُ مَنْ حَلَفَ فِي الشَّيْءِ لَا يَفْعَلُهُ مِرَارًا
[Machine] I will carry you until you take an oath of twenty rights. A man from the Ansar said to him, "What is the matter with you and the Amir of the Believers?" He said, "By Allah, he will have me carry him. I am a traveler and my mount has become tired with me." Umar said, "By Allah, I will carry you, by Allah, I will carry you." So he carried him and then he said, "Whoever takes an oath on a right, and sees another right better than it, let him fulfill the one that is better, and make amends for his oath." Ali bin Madini said, "This is a strange narration. The expiation is one." The scholar said, "This is not clear in the narration. It is mentioned from Mujahid from Ibn Umar that he swore multiple times, so he made expiation only once. It is also narrated from Ibn Umar regarding confirming the oath, which is the repeating of it in a single matter, and this is the view of another juristic school."
أَحْمِلُكَ حَتَّى حَلَفَ نَحْوًا مِنْ عِشْرِينَ يَمِينًا قَالَ فَقَالَ لَهُ رَجُلٌ مِنَ الْأَنْصَارِ مَا لَكَ وَلِأَمِيرِ الْمُؤْمِنِينَ قَالَ وَاللهِ لِيَحْمِلَنِّي إِنِّي ابْنُ سَبِيلٍ قَدْ أَدَّتْ بِي رَاحِلَتِي قَالَ فَقَالَ عُمَرُ وَاللهِ لَأَحْمِلَنَّكَ ثُمَّ وَاللهِ لَأَحْمِلَنَّكَ قَالَ فَحَمَلَهُ ثُمَّ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ هَذَا حَدِيثٌ غَرِيبٌ الْكَفَّارَةُ وَاحِدَةٌ قَالَ الشَّيْخُ لَيْسَ ذَلِكَ بِبَيِّنٍ فِي الْحَدِيثِ وَيُذْكَرُ عَنْ مُجَاهِدٍ عَنِ ابْنِ عُمَرَ ؓ أَنَّهُ أَقْسَمَ مِرَارًا فَكَفَّرَ كَفَّارَةً وَاحِدَةً وَرُوِيَ عَنِ ابْنِ عُمَرَ ؓ فِي تَوْكِيدِ الْيَمِينِ وَهُوَ تَكْرِيرُهَا فِي الشَّيْءِ الْوَاحِدِ مَذْهَبٌ آخَرُ
[Machine] The sheikh is the clear authority of the book, then the clear authority of the Sunnah, then what we have narrated in this chapter about Umar (may Allah be pleased with him). Even if he is messaged, it does not differentiate anything between affirming the right and not affirming it. And Allah knows best.
الشَّيْخُ ظَاهِرُ الْكِتَابِ ثُمَّ ظَاهِرُ السُّنَّةِ ثُمَّ مَا رَوَيْنَا فِي هَذَا الْبَابِ عَنْ عُمَرَ ؓ وَإِنْ كَانَ مُرْسَلًا لَا يُفَرِّقُ شَيْءٌ مِنْ ذَلِكَ بَيْنَ تَوْكِيدِ الْيَمِينِ وَغَيْرِ تَوْكِيدِهَا وَاللهُ أَعْلَمُ
63.28 [Machine] What is permissible in the atonement from clothing, and it includes everything that is called clothing, such as turbans, pants, wraps, and masks, and others. Allah Almighty said, "Or their clothing" [Al-Ma'idah: 89].
٦٣۔٢٨ بَابُ مَا يَجْزِئُ مِنَ الْكِسْوَةِ فِي الْكَفَّارَةِ وَهُوَ كُلُّ مَا وَقَعَ عَلَيْهِ اسْمُ كِسْوَةٍ, مِنْ عِمَامَةٍ, أَوْ سَرَاوِيلَ, أَوْ إِزَارٍ, أَوْ مُقَنَّعَةٍ, وَغَيْرِ ذَلِكَ قَالَ اللهُ تَعَالَى {أَوْ كِسْوَتُهُمْ} [المائدة: 89]
[Machine] Abu Musa al-Ash'ari swore an oath and gave wealth to the poor, who were then brought into the treasury. He then ordered a handful of wheat to be given to them, which they ate. After that, he clothed each person, either with a wrapped garment or an uncovered one. The sheikh said as if he had not seen the recompense of the wheat he had given them, and gave each of them a garment. It is also narrated from Zahdam al-Jarmi from Abu Musa al-Ash'ari that he swore an oath and gave ten poor people ten garments, giving each poor person a wrapped garment.
أَنَّ أَبَا مُوسَى الْأَشْعَرِيَّ ؓ حَلَفَ عَلَى يَمِينٍ فَكَفَّرَ وَأَمَرَ بِالْمَسَاكِينِ فَأُدْخِلُوا بَيْتَ الْمَالِ فَأَمَرَ بِجَفْنَةٍ مِنْ ثَرِيدٍ فَقُدِّمَتْ إِلَيْهِمْ فَأَكَلُوا ثُمَّ كَسَا كُلَّ إِنْسَانٍ مِنْهُمْ ثَوْبًا إِمَّا مُعَقَّدًا وَإِمَّا ظَهْرَانِيًا قَالَ الشَّيْخُ وَكَأَنَّهُ لَمْ يَرَ الْكَفَّارَةَ بِمَا أَعْطَاهُمْ مِنَ الثَّرِيدِ مُجْزِيَةً فَأَعْطَى كُلَّ وَاحِدٍ مِنْهُمْ ثَوْبًا وَرُوِيَ عَنْ زَهْدَمٍ الْجَرْمِيِّ عَنْ أَبِي مُوسَى الْأَشْعَرِيِّ ؓ أَنَّهُ حَلَفَ فَأَعْطَى عَشَرَةَ مَسَاكِينَ عَشَرَةَ أَثْوَابٍ لِكُلِّ مِسْكِينٍ ثَوْبًا مِنْ مُعَقَّدِ هَجَرَ
[Machine] About Ata, Mujahid, and Ikrimah, they said: "To every poor person, give a garment, such as a shirt, trousers, or cloak." So I said to Khusaif, "What if he is able to?" He replied, "Whoever does good, it is good for him. But if he cannot find these qualities, then fasting for three days, while mentioning it in consecutive recitation of Surah Al-Baqarah, is the expiation." It is also narrated by Ibn Jurayj from Ata that he said regarding the expiation for breaking an oath, "Stretch, stretch," and the covering is a garment, a garment.
عَنْ عَطَاءٍ وَمُجَاهِدٍ وَعِكْرِمَةَ قَالُوا لِكُلِّ مِسْكِينٍ ثَوْبٌ قَمِيصٌ أَوْ إِزَارٌ أَوْ رِدَاءٌ فَقُلْتُ لِخُصَيفٍ أَرَأَيْتَ إِنْ كَانَ مُوسِرًا؟ قَالَ أِيَّ ذَا فَعَلَ فَحَسَنٌ فَمَنْ لَمْ يَجِدْ هَذِهِ الْخِصَالَ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ وَذَكَرَ أَنَّهَا فِي قِرَاءَةِ أُبَيٍّ مُتَتَابِعَةٍ وَفِي رِوَايَةِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ أَنَّهُ قَالَ فِي كَفَّارَةِ الْيَمِينِ مُدٌّ مُدٌّ وَالْكُسْوَةُ ثَوْبٌ ثَوْبٌ
[Machine] I heard the Messenger of Allah ﷺ say, "There is no vow in disobedience to Allah, and its expiation is the expiation of an oath." So I said, "O Abu Nujaid, our companion is not wealthy, so how can he expiate?" He said, "If a group of people came to a leader from the leaders, and he clothed each person among them in a Qalansuwa (a type of robe), the people would say that he has clothed them. And it is mentioned about Salman that he said, 'What a beautiful gown the Tabban is.'"
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا نَذْرَ فِي مَعْصِيَةِ اللهِ وَكَفَّارَتُهُ كَفَّارَةُ يَمِينٍ فَقُلْتُ يَا أَبَا نُجَيْدٍ إِنَّ صَاحِبَنَا لَيْسَ بِالْمُوسِرِ فَبِمَ يُكَفِّرُ؟ قَالَ لَوْ أَنَّ قَوْمًا قَامُوا إِلَى أَمِيرٍ مِنَ الْأُمَرَاءِ وَكَسَا كُلَّ إِنْسَانٍ مِنْهُمْ قَلَنْسُوَةً لَقَالَ النَّاسُ قَدْ كَسَاهُمْ وَيُذْكَرُ عَنْ سَلْمَانَ ؓ أَنَّهُ قَالَ نِعْمَ الثَّوْبُ التُّبَّانُ
63.29 [Machine] What is permissible regarding the emancipation of slaves?
٦٣۔٢٩ بَابُ مَا يَجُوزُ فِي عِتْقِ الْكَفَّارَاتِ
[Machine] He said, "I went to the Messenger of Allah ﷺ and said, 'O Messenger of Allah, I had a maid who used to tend my sheep. One of the sheep went missing, so I asked her about it and she said, "A wolf ate it." I felt sorry and being from the children of Adam, I slapped her in the face and asked her, 'Should I set you free?' The Messenger of Allah ﷺ said to her, 'Where is Allah?' She replied, 'He is in the sky.' He asked her, 'Who am I?' She said, 'You are the Messenger of Allah.' He then said, 'Set her free.' This narration was reported by Malik bin Anas and narrated by Yahya bin Abi Kathir from Hilal bin Abi Ma'munah from 'Ata bin Yasar from Mu'awiya bin Al-Hakam As-Sulami."
أَنَّهُ قَالَ أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ جَارِيَةً لِي كَانَتْ تَرْعَى غَنَمًا لِي فَفَقَدَتْ شَاةً مِنَ الْغَنَمِ فَسَأَلْتُهَا عَنْهَا فَقَالَتْ أَكَلَهَا الذِّئْبُ فَأَسِفْتُ وَكُنْتُ مِنْ بَنِي آدَمَ فَلَطَمْتُ وَجْهَهَا وَعَلَيَّ رَقَبَةٌ أَأُعْتِقُهَا؟ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ أَيْنَ اللهُ؟ فَقَالَتْ هُوَ فِي السَّمَاءِ فَقَالَ مَنْ أَنَا ؟ فَقَالَتْ أَنْتَ رَسُولُ اللهِ قَالَ أَعْتِقْهَا كَذَا قَالَهُ مَالِكُ بْنُ أَنَسٍ وَرَوَاهُ يَحْيَى بْنُ أَبِي كَثِيرِ عَنْ هِلَالِ بْنِ أَبِي مَيْمُونَةَ عَنْ عَطَاءِ بْنِ يَسَارٍ عَنْ مُعَاوِيَةَ بْنِ الْحَكَمِ السُّلَمِيِّ
[Machine] Then I found a captured sheep that a young girl was tending near Uhud and Al-Jawwaniyyah. I saw that a wolf had attacked it. I felt sorry for it, as a human being from the children of Adam feels sorry. So, I killed the sheep by striking it once, then I went to the Messenger of Allah ﷺ and informed him about it. He disapproved of what I did, so I said, "O Messenger of Allah, should I not set it free?" He replied, "Yes, bring it to me." So, I brought it to the Messenger of Allah ﷺ , and he asked it, "Where is Allah?" It replied, "He is in the sky." He then asked, "Who am I?" It replied, "You are the Messenger of Allah." He said, "Indeed, it is a believer, so set it free."
ثُمَّ أَطَلَعْتُ غُنَيْمَةً لِي تَرْعَاهَا جَارِيَةٌ لِي قِبَلَ أُحُدٍ وَالْجَوَّانِيَّةِ فَوَجَدْتُ الذِّئْبَ قَدْ أَصَابَ مِنْهَا شَاةً وَأَنَا رَجُلٌ مِنْ بَنِي آدَمَ آسَفُ كَمَا يَأْسَفُونَ فَصَكَكْتُهَا صَكَّةً ثُمَّ انْصَرَفْتُ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرْتُهُ فَعَظَّمَ ذَلِكَ عَلَيَّ قَالَ فَقُلْتُ يَا رَسُولَ اللهِ أَفَلَا أُعْتِقُهَا؟ قَالَ بَلَى ائْتِنِي بِهَا قَالَ فَجِئْتُ بِهَا رَسُولَ اللهِ ﷺ فَقَالَ لَهَا أَيْنَ اللهُ؟ قَالَتْ فِي السَّمَاءِ قَالَ فَمَنْ أَنَا ؟ قَالَتْ أَنْتَ رَسُولُ اللهِ قَالَ إِنَّهَا مُؤْمِنَةٌ فَأَعْتِقْهَا
[Machine] A man from the Ansar came to the Prophet ﷺ with a black slave woman and said, "O Messenger of Allah, I have a believing slave woman. If you consider her to be a believer, I will set her free." The Messenger of Allah ﷺ asked her, "Do you testify that there is no god but Allah?" She said, "Yes." He asked her, "Do you testify that Muhammad is the Messenger of Allah?" She said, "Yes." He asked her, "Do you believe in the resurrection after death?" She said, "Yes." He said, "Set her free, for she is a believer." This narration has been mentioned regarding Awf ibn Abdullah ibn Utbah from Ubaidullah ibn Utbah from Abu Hurairah, and it has also been narrated regarding Awf from his father, from his grandfather, and it has been cited in the book of Az-Zuhar.
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَتَى النَّبِيَّ ﷺ بِوَلِيدَةٍ سَوْدَاءَ فَقَالَ يَا رَسُولَ اللهِ إِنِّي عَلَيَّ رَقَبَةٌ مُؤْمِنَةٌ فَإِنْ كُنْتَ تَرَى هَذِهِ مُؤْمِنَةً أُعْتِقْهَا فَقَالَ لَهَا رَسُولُ اللهِ ﷺ أَتَشْهَدِينَ أَنْ لَا إِلَهَ إِلَّا اللهُ؟ قَالَتْ نَعَمْ قَالَ أَتَشْهَدِينَ أَنَّ مُحَمَّدًا رَسُولُ اللهِ؟ قَالَتْ نَعَمْ قَالَ أَفَتُؤْمِنِينَ بِالْبَعْثِ بَعْدَ الْمَوْتِ؟ قَالَتْ نَعَمْ قَالَ أَعْتِقْهَا هَذَا مُرْسَلٌ وَقَدْ قِيلَ عَنْ عَوْنِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ عَنْ عُبَيْدِ اللهِ بْنِ عُتْبَةَ عَنْ أَبِي هُرَيْرَةَ ؓ وَقَدْ قِيلَ عَنْ عَوْنٍ عَنْ أَبِيهِ عَنْ جَدِّهِ وَقَدْ مَضَى فِي كِتَابِ الظِّهَارِ
63.30 [Machine] What is mentioned about the son of adultery?
٦٣۔٣٠ بَابُ مَا جَاءَ فِي وَلَدِ الزِّنَا
[Machine] The Messenger of Allah ﷺ said, "The child of adultery is the worst of three." Abu Abdullah Al-Hafiz informed us that Abu Nasr Ahmad ibn Sahl Al-Faqih from Bokhara narrated to us, that Saleh ibn Muhammad Al-Hafiz informed us, that Abu Ar-Rabi'i Az-Zahrani, Uthman ibn Abi Shaybah, and Zuhair ibn Harb said, "Jareer narrated from Suhail ibn Abi Salih, who mentioned something similar to it." He added, "Abu Huraira said, 'Being given a whip in the cause of Allah is dearer to me than emancipating a child of adultery.'"
قَالَ رَسُولُ اللهِ ﷺ وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ 19988 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو نَصْرٍ أَحْمَدُ بْنُ سَهْلٍ الْفَقِيهُ بِبُخَارَى ثنا صَالِحُ بْنُ مُحَمَّدٍ الْحَافِظُ ثنا أَبُو الرَّبِيعِ الزَّهْرَانِيُّ وَعُثْمَانُ بْنُ أَبِي شَيْبَةَ وَزُهَيْرُ بْنُ حَرْبٍ قَالُوا ثنا جَرِيرٌ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ فَذَكَرَهُ بِمِثْلِهِ زَادَ قَالَ قَالَ أَبُو هُرَيْرَةَ ؓ لَأَنْ أُمَتِّعَ بِسَوْطٍ فِي سَبِيلِ اللهِ أَحَبُّ إِلِيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ زِنْيَةٍ
[Machine] The Messenger of Allah ﷺ said, "The offspring of illegal sexual intercourse is the worst of the three."
قَالَ رَسُولُ اللهِ ﷺ وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ
[Machine] The Prophet ﷺ said, "No child born out of wedlock shall enter Paradise." This is also narrated by Mujahid from Abu Huraira in the elevated form.
النَّبِيَّ ﷺ قَالَ لَا يَدْخُلُ الْجَنَّةَ وَلَدُ زِنْيَةٍ وَرُوِيَ ذَلِكَ أَيْضًا عَنْ مُجَاهِدٍ عَنْ أَبِي هُرَيْرَةَ ؓ مَرْفُوعًا
[Machine] "It is narrated that the Messenger of Allah, ﷺ , said: 'Verily, for me to be equipped with a whip in the cause of Allah is more beloved to me than to free the offspring of adultery.' And the Messenger of Allah, ﷺ , said: 'The offspring of adultery are the worst of the three.' And truly, the deceased is punished by the weeping of the living.' Aisha said: 'May Allah have mercy on Abu Hurairah, he misunderstood in hearing and gave a misguided answer. For me to be equipped with a whip in the cause of Allah is more beloved to me than to command adultery and then free the child. As for his statement 'The offspring of adultery are the worst of the three,' this hadith was not in reference to this incident. Rather, it was a man from the hypocrites who hurt the Messenger of Allah, ﷺ , so he said: 'Who will protect me from so-and-so?' It was said: 'O Messenger of Allah, he has the offspring of adultery with him.' So the Messenger of Allah, ﷺ , said: 'He is the worst of the three.' And Allah says: 'No soul shall bear the burden of another.' As for his statement 'Verily, the deceased is punished by the weeping of the living,' this hadith was not in reference to this incident. Rather, the Messenger of Allah, ﷺ , passed by the house of a Jew who had died and his family was weeping over him. So he said: 'They weep over him, and indeed, he is being punished.' And Allah says: 'Allah does not burden a soul beyond its capacity.' Salamah bin Al-Fadl Al-Abrash narrated this hadith, and it has also been narrated from Abu Sulayman Ash-Shami, who is Burd bin Sinan, from Az-Zuhri, from Aisha. And Allah knows best."
َؓ يَقُولُ إِنَّ رَسُولَ اللهِ ﷺ قَالَ لَأَنْ أُمَتِّعَ بِسَوْطٍ فِي سَبِيلِ اللهِ أَحَبُّ إِلِيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ الزِّنَا وَإِنَّ رَسُولَ اللهِ ﷺ قَالَ وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ وَ إِنَّ الْمَيِّتَ يُعَذَّبُ بِبُكَاءِ الْحِيِّ فَقَالَتْ عَائِشَةُ ؓ رَحِمَ اللهُ أَبَا هُرَيْرَةَ أَسَاءَ سَمْعًا فَأَسَاءَ إِجَابَةً لَأَنْ أُمَتِّعَ بِسَوْطٍ فِي سَبِيلِ اللهِ أَحَبُّ إِلِيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ الزِّنَا إنَّهَا لَمَّا نَزَلَتْ {فَلَا اقْتَحَمَ الْعَقَبَةَ وَمَا أَدْرَاكَ مَا الْعَقَبَةُ فَكُّ رَقَبَةٍ} [البلد 12] قِيلَ يَا رَسُولَ اللهِ مَا عِنْدَنَا مَا نُعْتِقُ إِلَّا أَنَّ أَحَدَنَا لَهُ الْجَارِيَةُ السَّوْدَاءُ تَخْدُمُهُ وَتَسْعَى عَلَيْهِ فَلَوْ أَمَرْنَاهُنَّ فَزَنَيْنَ فَجِئْنَ بِأَولَادٍ فَأَعْتَقْنَاهُمْ فَقَالَ رَسُولُ اللهِ ﷺ لَأَنْ أُمَتِّعَ بِسَوْطٍ فِي سَبِيلِ اللهِ أَحَبُّ إِلِيَّ مِنْ أَنْ آمُرَ بِالزِّنَا ثُمَّ أُعْتِقَ الْوَلَدَ وَأَمَّا قَوْلُهُ وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ فَلَمْ يَكُنِ الْحَدِيثُ عَلَى هَذَا إِنَّمَا كَانَ رَجُلٌ مِنَ الْمُنَافِقِينَ يُؤْذِي رَسُولَ اللهِ ﷺ فَقَالَ مَنْ يَعْذِرُنِي مِنْ فُلَانٍ؟ قِيلَ يَا رَسُولَ اللهِ إِنَّهُ مَعَ مَا بِهِ وَلَدُ الزِّنَا فَقَالَ رَسُولُ اللهِ ﷺ هُوَ شَرُّ الثَّلَاثَةِ وَاللهُ تَعَالَى يَقُولُ {وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى} [الأنعام 164] وَأَمَّا قَوْلُهُ إِنَّ الْمَيِّتَ لَيُعَذَّبُ بِبُكَاءِ الْحِيِّ فَلَمْ يَكُنِ الْحَدِيثُ عَلَى هَذَا وَلَكِنَّ رَسُولَ اللهِ ﷺ مَرَّ بِدَارِ رَجُلٍ مِنَ الْيَهُودِ قَدْ مَاتَ وَأَهْلُهُ يَبْكُونَ عَلَيْهِ فَقَالَ إِنَّهُمْ لَيَبْكُونَ عَلَيْهِ وَإِنَّهُ لَيُعَذَّبُ وَاللهُ ﷻ يَقُولُ {لَا يُكَلِّفُ اللهُ نَفْسًا إِلَّا وُسْعَهَا} [البقرة 286] سَلَمَةُ بْنُ الْفَضْلِ الْأَبْرَشُ يَرْوِي مَنَاكِيرَ وَقَدْ رُوِيَ عَنْ أَبِي سُلَيْمَانَ الشَّامِيِّ وَهُوَ بُرْدُ بْنُ سِنَانٍ عَنِ الزُّهْرِيِّ عَنْ عَائِشَةَ ؓ مُرْسَلًا فِي إِعْتَاقِ وَلَدِ الزِّنَا وَاللهُ أَعْلَمُ
[Machine] In the child born out of wedlock, there is no blame on his parents whatsoever. "No bearer of burdens can bear the burden of another" [Surah Al-An'am verse 164]. There is a separate burden that some of the weak and authentic scholars have placed upon him.
فِي وَلَدِ الزِّنَا لَيْسَ عَلَيْهِ مِنْ وِزْرِ أَبَوَيْهِ شَيْءٌ {لَا تَزِرُ} [الأنعام 164] وَازِرَةٌ وِزْرَ أُخْرَى رَفَعَهُ بَعْضُ الضُّعَفَاءِ وَالصَّحِيحُ مَوْقُوفٌ
[Machine] The Messenger of Allah ﷺ said: "The child of adultery is the worst of the three when he does the actions of his parents."
قَالَ رَسُولُ اللهِ ﷺ وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ إِذَا عَمِلَ بِعَمَلِ أَبَوَيْهِ
[Machine] The Messenger of Allah ﷺ said, "The child of fornication is the worst of the three when he commits the same acts as his parents. This chain of narration is weak, and what precedes it is not strong. This statement is only narrated based on the report from Sufyan Ath-Thawri."
قَالَ رَسُولُ اللهِ ﷺ وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ إِذَا عَمِلَ بِعَمَلِ أَبَوَيْهِ هَذَا إِسْنَادٌ ضَعِيفٌ وَمَا قَبْلَهُ لَيْسَ بِالْقَوِيِّ وَإِنَّمَا يُرْوَى هَذَا الْكَلَامُ عَلَى الْخَبَرِ مِنْ قَوْلِ سُفْيَانَ الثَّوْرِيِّ
[Machine] The Messenger of Allah ﷺ was asked about the child of fornication, and he said, "He is among the worst three." Sufyan (may Allah be pleased with him) explained, meaning when he follows the actions of his parents.
سُئِلَ رَسُولُ اللهِ ﷺ عَنْ وَلَدِ الزِّنَا فَقَالَ هُوَ شَرُّ الثَّلَاثَةِ قَالَ سُفْيَانُ يَعْنِي إِذَا عَمِلَ بِعَمَلِ وَالِدَيْهِ
أَبَوَيْهِ يَتُوبَانِ
[Machine] "To him, you are not your father, whom he is known by, so he killed her and named the worst of the three."
لَهُ لَسْتَ لِأَبِيكَ الَّذِي تُدْعَى بِهِ فَقَتَلَهَا فَسُمِّيَ شَرَّ الثَّلَاثَةِ
63.31 [Machine] What is mentioned regarding the emancipation of the child of adultery.
٦٣۔٣١ بَابُ مَا جَاءَ فِي إِعْتَاقِ وَلَدِ الزِّنَا
أَبُو هُرَيْرَةَ نَعَمْ
[Machine] That Abdullah ibn Umar freed the son of Zina and his mother.
أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ أَعْتَقَ ابْنَ زِنًا وَأُمَّهُ
[Machine] In the children of fornication, set them free and treat them kindly.
فِي أَوْلَادِ الزِّنَا أَعْتِقُوهُمْ وَأَحْسِنُوا إِلَيْهِمْ
[Machine] Look at both of them more closely, and they found the price of both of them to be a dinar for the child of adultery. So he commanded them with it.
انْظُرْ أَكْثَرَهُمَا ثَمَنًا فَوَجَدُوا وَلَدَ الزِّنَا أَكْثَرَهُمَا ثَمَنًا بِدِينَارٍ فَأَمَرَهُمْ بِهِ
[Machine] Look at both of them and then determine their value.
انْظُرْ أَكْثَرَهُمَا ثَمَنًا
[Machine] Ibn Umar bought a slave who was born out of wedlock.
أَعْتَقَ ابْنُ عُمَرَ غُلَامًا لَهُ وَلَدَ زِنًا
[Machine] "And he said: Allah and His Messenger have commanded us to be kind to those who mistreat us. Allah, the Exalted, has said, 'So either you grant a favor afterwards or take ransom.' [Muhammad 4]. It is also narrated from Umar that he disliked it."
وَقَالَ قَدْ أَمَرَنَا اللهُ وَرَسُولُهُ ﷺ أَنْ نَمُنَّ عَلَى مَنْ هُوَ شَرٌّ مِنْهُ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {فَإِمَّا مَنًّا بَعْدُ وَإِمَّا فِدَاءً} [محمد 4] وَرُوِيَ عَنْ عُمَرَ ؓ أَنَّهُ كَرِهَهُ
[Machine] I would rather carry two sandals in the way of Allah than to have someone born out of wedlock be freed.
لَأَنْ أُحْمَلَ عَلَى نَعْلَيْنِ فِي سَبِيلِ اللهِ أَحَبُّ إِلِيَّ مِنْ أَنْ أُعْتِقَ ابْنَ زِنْيَةٍ
63.32 [Machine] The choice between food, clothing, and emancipation, {so whoever does not find [enough] food - then fasting for three days} [Surah Al-Baqarah: 196]
٦٣۔٣٢ بَابُ التَّخْيِيرِ بَيْنَ الْإِطْعَامِ وَالْكُسْوَةِ وَالْعِتْقِ , {فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ} [البقرة: 196]
[Machine] Everything in the Quran is either "or" or "or" and it is chosen. So, if it is not found, it is the first of the first.
كُلُّ شَيْءٍ فِي الْقُرْآنِ أَوْ أَوْ فَهُوَ مُخَيَّرٌ فَإِذَا كَانَ لَمْ يَجِدْ فَهُوَ الْأَوَّلُ الْأَوَّلُ
[Machine] Abu Al-Walid and others besides Hashim say they did not see any harm in that.
أَبُو الْوَلِيدِ وَغَيْرُ هُشَيْمٍ يَقُولُ كَانُوا لَا يَرَوْنَ بِذَلِكَ بَأْسًا
63.33 [Machine] The succession in the fasting of expiation
٦٣۔٣٣ بَابُ التَّتَابُعِ فِي صَوْمِ الْكَفَّارَةِ
أَنَّهُ كَانَ يَقْرَأُ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ مُتَتَابِعَاتٍ
فَهِيَ مُتَتَابِعَةٌ
[Machine] If he wants, he can separate. I said, "Then it is in the continuous recitation of Abdullah." He said, "In that case, we follow the Book of Allah."
إِنْ شَاءَ فَرَّقَ قُلْتُ فَإِنَّهَا فِي قِرَاءَةِ عَبْدِ اللهِ مُتَتَابِعَةٍ قَالَ إِذًا نَنْقَادُ لِكِتَابِ اللهِ ﷻ
عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ ؓ وَاللهُ أَعْلَمُ
63.34 [Machine] The Mosque of Al-Ayman for those who break their covenant willingly or under compulsion
٦٣۔٣٤ بَابُ جَامِعِ الْأَيْمَانِ مَنْ حَنِثَ نَاسِيًا لِيَمِينِهِ أَوْ مُكْرَهًا عَلَيْهِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ {إِلَّا مَنْ أُكْرِهَ وَقَلْبُهُ مُطْمَئِنٌّ بِالْإِيمَانِ} [النحل: 106]
the Messenger of Allah ﷺ said, "Allah has forgiven for me my nation their mistakes and forgetfulness, and what they are forced to do."
قَالَ رَسُولُ اللهِ ﷺ: «تَجَاوَزَ اللهُ عَنْ أُمَّتِي الْخَطَأَ وَالنِّسْيَانَ وَمَا اسْتُكْرِهُوا عَلَيْهِ۔»
[Machine] The Messenger of Allah ﷺ said: "Indeed, Allah has overlooked for my Ummah what they do to themselves and what is forced upon them, except for what they say or do. " So said Abu Hurairah, and it appears that 'Ata heard it from both parties, and both hadiths convey the intended meaning, and in both, the concept of coercion is discussed, and it is emphasized.
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ تَجَاوَزَ عَنْ أُمَّتِي مَا حَدَّثَتْ بِهِ أَنْفُسَهَا وَمَا أُكْرِهُوا عَلَيْهِ إِلَّا أَنْ يَتَكَلَّمُوا بِهِ أَوْ يَعْمَلُوا بِهِ كَذَا قَالَ عَنْ أَبِي هُرَيْرَةَ وَالظَّاهِرُ أَنَّ عَطَاءً سَمِعَهُ مِنَ الْوَجْهَيْنِ جَمِيعًا وَهُمَا حَدِيثَانِ يُؤَدِّي كُلُّ وَاحِدٍ مِنْهُمَا مَا قُصِدَ بِهِ مِنَ الْمَعْنَى وَفِيهِمَا جَمِيعًا طَرْحُ الْإِكْرَاهِ وَقَدْ
[Machine] The Prophet ﷺ said, "There is no divorce or freeing a slave during a state of confinement."
النَّبِيَّ ﷺ قَالَ لَا طَلَاقَ وَلَا عِتَاقَ فِي إِغْلَاقٍ
63.35 [Machine] What is mentioned about someone who swears: "He will fulfill his right until a certain time, or until a specific duration, and what is used as evidence that he does not have a specific time.
٦٣۔٣٥ بَابُ مَا جَاءَ فِيمَنْ حَلَفَ: لَيَقْضِيَنَّ حَقَّهُ إِلَى حِينٍ , أَوْ إِلَى زَمَانٍ , وَمَا يُسْتَدَلُّ بِهِ عَلَى أَنَّهُ لَيْسَ لَهُ وَقْتٌ مَعْلُومٌ
الْحِينُ سِتَّةُ أَشْهُرٍ
الْحِينُ قَدْ يَكُونُ غُدْوَةً وَعَشِيَّةً
[Machine] The date palm tree takes one to two months for its fruit to ripen, so we see the two months.
هِيَ النَّخْلَةُ يَكُونُ فِيهَا حِمْلُهَا شَهْرًا وَشَهْرَينِ فَنَرَى الْحِينَ شَهْرَيْنِ
الْحِينُ سِتَّةُ أَشْهُرٍ
[Machine] "That I not do such and such a thing at any time, so what is the time that is not reached? He recited: 'Has there not come upon man a period of time when he was not a thing [even] mentioned?' [Surah Al-Insan, verse 1] He does not know how much time has passed since Allah created him. As for the time that is reached, the saying of Allah the Exalted: 'She gives her fruit every time by permission of its Lord.' [Surah Ibrahim, verse 25] From the clusters of dates to their ripening."
أَنْ لَا أَصْنَعَ حِينًا كَذَا وَكَذَا فَمَا الْحِينُ الَّذِي لَا يُدْرَكُ؟ قَالَ فَقَرَأَ {هَلْ أَتَى عَلَى الْإِنْسَانِ حِينٌ مِنَ الدَّهْرِ} [الإنسان 1] مَا يَدْرِي كَمْ أَتَى مُنْذُ خَلَقَهُ اللهُ وَأَمَّا الْحِينُ الَّذِي يُدْرَكُ قَوْلُ اللهِ تَعَالَى {تُؤْتِي أُكُلَهَا كُلَّ حِينٍ} [إبراهيم 25] مَا بَيْنَ صِرَامِ النَّخْلِ إِلَى ثَمَرِهَا
[Machine] Narrated from Qatadah regarding His saying exalted,"And you will surely know its news after a while" (Quran 88:1), he said, "After death." And in His saying, "And in Thamud when it was said to them, 'Enjoy yourselves for a time'" (Quran 51:43), he said, "Three days." And in His saying, "She provides her food every time" (Quran 14:25), he said, "Every seven months." And it has been mentioned from Rabi'ah ibn Abi Abdur Rahman that he said, "Al-Heen" is a year.
عَنْ قَتَادَةَ فِي قَوْلِهِ تَعَالَى {وَلَتَعْلَمُنَّ نَبَأَهُ بَعْدَ حِينٍ} [ص 88] قَالَ بَعْدَ الْمَوْتِ {وَفِي ثَمُودَ إِذْ قِيلَ لَهُمْ تَمَتَّعُوا حَتَّى حِينٍ} [الذاريات 43] قَالَ ثَلَاثَةُ أَيَّامٍ وَفِي قَوْلِهِ {تُؤْتِي أَكُلَهَا كُلَّ حِينٍ} [إبراهيم 25] قَالَ كُلَّ سَبْعَةِ أَشْهُرٍ وَذُكِرَ عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ أَنَّهُ قَالَ الْحِينُ سَنَةٌ
[Machine] The time is either two or three months unless their respective durations are specified differently, and the difference in meaning of "the time" in its different contexts is evidence that "the time" does not have a specific definition in its absolute sense, and likewise, time, and Allah knows best.
الزَّمَانُ شَهْرَانِ أَوْ ثَلَاثَةٌ مَا لَمْ يُوَقِّتْ أَجَلًا اخْتِلَافُهُمْ فِي الْحِينِ وَاخْتِلَافُ مَعْنَى الْحِينِ فِي مَوَاضِعِهِ دَلِيلٌ عَلَى أَنْ لَيْسَ لَلْحِينِ غَايَةٌ عِنْدَ الْإِطْلَاقِ وَكَذَلِكَ الزَّمَانُ وَاللهُ أَعْلَمُ
63.36 [Machine] What is close to sin is not sin. Some of our companions argue about that based on what.
٦٣۔٣٦ بَابُ مَا يَقْرُبُ مِنَ الْحِنْثِ , لَا يَكُونُ حِنْثًا احْتَجَّ بَعْضُ أَصْحَابِنَا فِي ذَلِكَ بِمَا
[Machine] The Messenger of Allah ﷺ said: "I do not leave the mosque until I inform you of a verse or a chapter that has not been revealed to any prophet after Sulaiman except me." He then walked and I followed him until he reached the door of the mosque. He pulled out one of his legs from the carpet of the mosque, while the other remained inside the mosque. I said to myself, "He has forgotten." He then turned towards me with his face and said, "With what do you begin the recitation of the Quran when you start the prayer?" I said, "In the name of Allah, the Most Merciful, the Most Gracious." He said, "It is, it is." Then its chain of narration is weak.
قَالَ رَسُولُ اللهِ ﷺ لَا أَخْرُجُ مِنَ الْمَسْجِدِ حَتَّى أُخْبِرَكَ بِآيَةٍ أَوْ سُورَةٍ لَمْ تَنْزِلْ عَلَى نَبِيٍّ بَعْدَ سُلَيْمَانَ غَيْرِي قَالَ فَمَشَى فَتَبِعْتُهُ حَتَّى انْتَهَى إِلَى بَابِ الْمَسْجِدِ قَالَ فَأَخْرَجَ إِحْدَى رِجْلَيْهِ مِنْ أُسْكُفَّةِ الْمَسْجِدِ وَبَقِيَتِ الْأُخْرَى فِي الْمَسْجِدِ فَقُلْتُ بَيْنِي وَبَيْنَ نَفْسِي نَسِيَ قَالَ فَأَقْبَلَ عَلَيَّ بِوَجْهِهِ قَالَ بِأِيِّ شَيْءٍ تَفْتَتِحُ الْقُرْآنَ إِذَا افْتَتَحْتَ الصَّلَاةَ؟ قَالَ قُلْتُ بِبِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ قَالَ هِيَ هِيَ ثُمَّ خَرَجَ إِسْنَادُهُ ضَعِيفٌ
63.37 [Machine] Who swore not to eat bread with Adam. Afterward, he ate it with something that is commonly considered to be Adam in appearance or something that can be dyed with it, or something that cannot be dyed.
٦٣۔٣٧ بَابُ مَنْ حَلَفَ: لَا يَأْكُلُ خُبْزًا بِأَدِمٍ , فَأَكَلَهُ بِمَا يُعَدَّ أَدَمًا فِي الْعَادَةِ , بِمَا يَصْطَبِغُ بِهِ , أَوْ لَا يَصْطَبِغُ
[Machine] The Messenger of Allah ﷺ said, "What a good companion a good character is."
قَالَ رَسُولُ اللهِ ﷺ نِعْمَ الْإِدَامُ الْخَلُّ
[Machine] The passage translates to: "He ﷺ asked his family about food, and they said, 'We only have vinegar.' So, he called for it and began eating it while saying, 'Vinegar is a good food, vinegar is a good food.'"
ﷺ سَأَلَ أَهْلَهُ الْأَدَمَ فَقَالُوا مَا عِنْدَنَا إِلَّا خَلٌّ فَدَعَا بِهِ فَجَعَلَ يَأْكُلُ مِنْهُ وَيَقُولُ نِعْمَ الْأَدَمُ الْخَلُّ نِعْمَ الْأَدَمُ الْخَلُّ
I saw that the Prophet ﷺ took a piece of bread of barley and put a date on it and said: This is the condiment of this. (Using translation from Abū Dāʾūd 3830)
رَأَيْتُ النَّبِيَّ ﷺ أَخَذَ كِسْرَةً مِنْ خُبْزِ شَعِيرٍ فَوَضَعَ عَلَيْهَا تَمْرَةً وَقَالَ هَذِهِ إِدَامُ هَذِهِ فَأَكَلَهَا
63.38 [Machine] Whoever takes an oath: "He shall not speak to a man," so he sends him a messenger or writes him a letter. Allah, may He be glorified, said {And it is not for any human being that Allah should speak to him except by revelation or from behind a partition or that He sends a messenger to reveal, by His permission, what He wills.}[Surah Ash-Shura: 51] And He said to the believers about the hypocrites {Say, "Do not offer an excuse. We have informed you of the news.}[Surah At-Tawbah: 94] And He informed them about their news through the revelation that Jibril (Gabriel) revealed to him, and the Prophet ﷺ informed them through the revelation that was sent to him. Imam Ash-Shafi'i, may Allah have mercy on him, said: "Whoever says, 'He does not lie,' he says: Indeed, the speech of human beings is not like the speech of Allah. The speech of human beings can be contradicted, don't you see that if a man abandons another man, migration becomes forbidden for him for more than three nights? So if he writes to him or sends him a messenger, and he is able to communicate with him, does this not remove him from the sin of his migration?
٦٣۔٣٨ بَابُ مَنْ حَلَفَ: لَا يُكَلِّمُ رَجُلًا , فَأَرْسَلَ إِلَيْهِ رَسُولًا , أَوْ كَتَبَ إِلَيْهِ كِتَابًا قَالَ اللهُ جَلَّ ثَنَاؤُهُ {وَمَا كَانَ لِبَشَرٍ أَنْ يُكَلِّمَهُ اللهُ إِلَّا وَحْيًا أَوْ مِنْ وَرَاءِ حِجَابٍ أَوْ يُرْسِلَ رَسُولًا فَيُوحِيَ بِإِذْنِهِ مَا يَشَاءُ} [الشورى: 51] وَقَالَ لِلْمُؤْمِنِينَ فِي الْمُنَافِقِينَ {قُلْ لَا تَعْتَذِرُوا لَنْ نُؤْمِنَ لَكُمْ قَدْ نَبَّأَنَا اللهُ مِنْ أَخْبَارِكُمْ} [التوبة: 94] وَإِنَّمَا نَبَّأَهُمْ مِنْ أَخْبَارِهِمْ بِالْوَحْيِ الَّذِي يَنْزِلُ بِهِ جِبْرَائِيلُ عَلَيْهِ السَّلَامُ عَلَى النَّبِيِّ ﷺ , وَيُخْبِرُهُمُ النَّبِيُّ ﷺ بِوَحْيٍ إِلَيْهِ , قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " مَنْ قَالَ لَا يَحْنَثُ , قَالَ: إِنَّ كَلَامَ الْآدَمِيِّينَ لَا يُشْبِهُ كَلَامَ اللهِ , كَلَامُ الْآدَمِيَّينَ بِالْمُوَاجَهَةِ , أَلَا تَرَى أَنَّهُ لَوْ هَجَرَ رَجُلٌ رَجُلًا , كَانَتِ الْهِجْرَةُ مُحَرَّمَةً عَلَيْهِ فَوْقَ ثَلَاثِ لَيَالٍ , فَكَتَبَ إِلَيْهِ , أَوْ أَرْسَلَ إِلَيْهِ رَسُولًا , وَهُوَ يَقْدِرُ عَلَى كَلَامِهِ , لَمْ يُخْرِجْهُ هَذَا مِنْ هِجْرَتِهِ الَّتِي يَأْثَمُ بِهَا؟ "
[Machine] Narrated by Abu Ayyub al-Ansari: It is not permissible for a Muslim to abandon his brother for more than three days. When they meet, one of them turns away from the other, and both of them are in the wrong. The better of the two is the one who initiates peace.
عَنْ أَبِي أَيُّوبَ الْأَنْصَارِيِّ ؓ يَرْوِيهِ لَا يَحِلُّ لِمُسْلِمٍ أَنْ يَهْجُرَ أَخَاهُ فَوْقَ ثَلَاثَةٍ يَلْتَقِيَانِ فَيَصُدُّ هَذَا وَيَصُدُّ هَذَا وَخَيْرُهُمَا الَّذِي يَبْدَأُ بِالسَّلَامِ
[Machine] The Messenger of Allah ﷺ said: "It is not permissible for a believer to forsake another believer for more than three days. And if they meet after three days, one should greet the other. However, if one does not respond, the Muslim who initiated the greeting will be free from the sin of abandoning, and the responsibility will fall upon the one who did not respond."
قَالَ رَسُولُ اللهِ ﷺ لَا يَحِلُّ لِمُؤْمِنٍ أَنْ يَهْجُرَ مُؤْمِنًا فَوْقَ ثَلَاثَةِ أَيَّامٍ فَإِذَا مَرَّ ثَلَاثٌ لَقِيَهُ فَسَلَّمَ عَلَيْهِ فَإِنْ رَدَّهُ فَقَدِ اشْتَرَكَا فِي الْأَجْرِ وَإِنْ لَمْ يَرُدَّ عَلَيْهِ فَقَدْ بَرِأَ الْمُسْلِمُ مِنَ الْهِجْرَةِ وَصَارَتْ عَلَى صَاحِبِهِ
