63. Faith
٦٣۔ كِتَابُ الْأَيْمَانِ
[Machine] Abu Musa al-Ash'ari swore an oath and gave wealth to the poor, who were then brought into the treasury. He then ordered a handful of wheat to be given to them, which they ate. After that, he clothed each person, either with a wrapped garment or an uncovered one. The sheikh said as if he had not seen the recompense of the wheat he had given them, and gave each of them a garment. It is also narrated from Zahdam al-Jarmi from Abu Musa al-Ash'ari that he swore an oath and gave ten poor people ten garments, giving each poor person a wrapped garment.
أَنَّ أَبَا مُوسَى الْأَشْعَرِيَّ ؓ حَلَفَ عَلَى يَمِينٍ فَكَفَّرَ وَأَمَرَ بِالْمَسَاكِينِ فَأُدْخِلُوا بَيْتَ الْمَالِ فَأَمَرَ بِجَفْنَةٍ مِنْ ثَرِيدٍ فَقُدِّمَتْ إِلَيْهِمْ فَأَكَلُوا ثُمَّ كَسَا كُلَّ إِنْسَانٍ مِنْهُمْ ثَوْبًا إِمَّا مُعَقَّدًا وَإِمَّا ظَهْرَانِيًا قَالَ الشَّيْخُ وَكَأَنَّهُ لَمْ يَرَ الْكَفَّارَةَ بِمَا أَعْطَاهُمْ مِنَ الثَّرِيدِ مُجْزِيَةً فَأَعْطَى كُلَّ وَاحِدٍ مِنْهُمْ ثَوْبًا وَرُوِيَ عَنْ زَهْدَمٍ الْجَرْمِيِّ عَنْ أَبِي مُوسَى الْأَشْعَرِيِّ ؓ أَنَّهُ حَلَفَ فَأَعْطَى عَشَرَةَ مَسَاكِينَ عَشَرَةَ أَثْوَابٍ لِكُلِّ مِسْكِينٍ ثَوْبًا مِنْ مُعَقَّدِ هَجَرَ
[Machine] About Ata, Mujahid, and Ikrimah, they said: "To every poor person, give a garment, such as a shirt, trousers, or cloak." So I said to Khusaif, "What if he is able to?" He replied, "Whoever does good, it is good for him. But if he cannot find these qualities, then fasting for three days, while mentioning it in consecutive recitation of Surah Al-Baqarah, is the expiation." It is also narrated by Ibn Jurayj from Ata that he said regarding the expiation for breaking an oath, "Stretch, stretch," and the covering is a garment, a garment.
عَنْ عَطَاءٍ وَمُجَاهِدٍ وَعِكْرِمَةَ قَالُوا لِكُلِّ مِسْكِينٍ ثَوْبٌ قَمِيصٌ أَوْ إِزَارٌ أَوْ رِدَاءٌ فَقُلْتُ لِخُصَيفٍ أَرَأَيْتَ إِنْ كَانَ مُوسِرًا؟ قَالَ أِيَّ ذَا فَعَلَ فَحَسَنٌ فَمَنْ لَمْ يَجِدْ هَذِهِ الْخِصَالَ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ وَذَكَرَ أَنَّهَا فِي قِرَاءَةِ أُبَيٍّ مُتَتَابِعَةٍ وَفِي رِوَايَةِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ أَنَّهُ قَالَ فِي كَفَّارَةِ الْيَمِينِ مُدٌّ مُدٌّ وَالْكُسْوَةُ ثَوْبٌ ثَوْبٌ
[Machine] I heard the Messenger of Allah ﷺ say, "There is no vow in disobedience to Allah, and its expiation is the expiation of an oath." So I said, "O Abu Nujaid, our companion is not wealthy, so how can he expiate?" He said, "If a group of people came to a leader from the leaders, and he clothed each person among them in a Qalansuwa (a type of robe), the people would say that he has clothed them. And it is mentioned about Salman that he said, 'What a beautiful gown the Tabban is.'"
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا نَذْرَ فِي مَعْصِيَةِ اللهِ وَكَفَّارَتُهُ كَفَّارَةُ يَمِينٍ فَقُلْتُ يَا أَبَا نُجَيْدٍ إِنَّ صَاحِبَنَا لَيْسَ بِالْمُوسِرِ فَبِمَ يُكَفِّرُ؟ قَالَ لَوْ أَنَّ قَوْمًا قَامُوا إِلَى أَمِيرٍ مِنَ الْأُمَرَاءِ وَكَسَا كُلَّ إِنْسَانٍ مِنْهُمْ قَلَنْسُوَةً لَقَالَ النَّاسُ قَدْ كَسَاهُمْ وَيُذْكَرُ عَنْ سَلْمَانَ ؓ أَنَّهُ قَالَ نِعْمَ الثَّوْبُ التُّبَّانُ
