42. Annulment and Divorce (2/6)
٤٢۔ كِتَابُ الْخُلْعِ وَالطَّلَاقِ ص ٢
[Machine] A man got married during the time of the Messenger of Allah ﷺ , and then divorced her. The Prophet ﷺ asked him, "Did you get married?" The man replied, "Yes." The Prophet ﷺ then asked, "And then what happened?" The man said, "Then I divorced her." The Prophet ﷺ asked, "Was any dowry given?" The man replied, "No." The Prophet ﷺ said, "Such a man can do that." The man then got married to another woman and divorced her. The Prophet ﷺ said to him, "Similar to that?" The man said, "I know (the ruling). I don't know if it was with this woman or the third one." The Messenger of Allah ﷺ said, "There is nothing more hated by Allah from the permissible acts than divorce." This hadith is narrated by 'Ubaidullah bin Al-Walid Al-Wasafi from Mu'harib from Ibn 'Umar in a brief, connected form.
تَزَوَّجَ رَجُلٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ امْرَأَةً فَطَلَّقَهَا فَقَالَ لَهُ النَّبِيُّ ﷺ أَتَزَوَّجْتَ؟ قَالَ نَعَمْ قَالَ ثُمَّ مَاذَا؟ قَالَ ثُمَّ طَلَّقْتُ قَالَ أَمِنْ رِيبَةٍ؟ قَالَ لَا قَالَ قَدْ يَفْعَلُ ذَلِكَ الرَّجُلُ قَالَ ثُمَّ تَزَوَّجَ امْرَأَةً أُخْرَى فَطَلَّقَهَا فَقَالَ لَهُ النَّبِيُّ ﷺ مِثْلَ ذَلِكَ قَالَ مُعَرَّفٌ فَمَا أَدْرِي أَعِنْدَ هَذَا أَوْ عِنْدَ الثَّالِثَةِ قَالَ رَسُولُ اللهِ ﷺ إِنَّهُ لَيْسَ شَيْءٌ مِنَ الْحَلَالِ أَبْغَضَ إِلَى اللهِ مِنَ الطَّلَاقِ وَرَوَاهُ عُبَيْدُ اللهِ بْنُ الْوَلِيدِ الْوَصَّافِيُّ عَنْ مُحَارِبٍ عَنِ ابْنِ عُمَرَ مَوْصُولًا مُخْتَصَرًا
[Machine] A man used to say, "I have divorced you, I have taken you back," but the news reached the Prophet ﷺ who said, "What is the matter with people who play with the limits set by Allah? This is an invalid marriage."
كَانَ رَجُلٌ يَقُولُ قَدْ طَلَّقْتُكِ قَدْ رَاجَعْتُكِ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ مَا بَالُ رِجَالٍ يَلْعَبُونَ بِحُدُودِ اللهِ؟ هَذَا مُرْسَلٌ
[Machine] The Messenger of Allah ﷺ said: "What is wrong with the people who play with the limits of Allah? I divorced you, I took you back, I divorced you, I took you back, until 14899." And Ali bin Muhammad al-Muqri'i informed us that I am al-Hasan bin Muhammad bin Ishaq, narrated to us Yusuf bin Ya'qub, narrated to us Muhammad bin Abi Bakr, narrated to us Mu'amal bin Ismail, narrated to us Sufyan, he mentioned it without a chain except that he said: "What is wrong with men? And he said: One of you says, 'I divorced you, I took you back,' as if he detests increasing from her or detests being intimate with her at any time without considering the prescribed time."
قَالَ رَسُولُ اللهِ ﷺ مَا بَالُ أَقْوَامٍ يَلْعَبُونَ بِحُدُودِ اللهِ طَلَّقْتُكِ رَاجَعْتُكِ طَلَّقْتُكِ رَاجَعْتُكِ 14899 وَأَخْبَرَنَا عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ نا يُوسُفُ بْنُ يَعْقُوبَ نا مُحَمَّدُ بْنُ أَبِي بَكْرٍ نا مُؤَمَّلُ بْنُ إِسْمَاعِيلَ نا سُفْيَانُ فَذَكَرَهُ مَوْصُولًا إِلَّا أَنَّهُ قَالَ مَا بَالُ رِجَالٍ؟ وَقَالَ يَقُولُ أَحَدُكُمْ قَدْ طَلَّقْتُكِ قَدْ رَاجَعْتُكِ وَكَأَنَّهُ كَرِهَ الِاسْتِكْثَارَ مِنْهُ أَوْ كَرِهَ إِيقَاعَهُ فِي كُلِّ وَقْتٍ مِنْ غَيْرِ مُرَاعَاةٍ لِوَقْتِهِ الْمَسْنُونِ
[Machine] Narrated by Prophet Muhammad ﷺ said, "Why does one of you say to his wife, 'I divorced you', when he has not, and then say, 'I have taken you back?' This is not a divorce according to the laws of Muslims. Divorce a woman during her period of purity."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لِمَ يَقُولُ أَحَدُكُمْ لِامْرَأَتِهِ قَدْ طَلَّقْتُكِ قَدْ رَاجَعْتُكِ لَيْسَ هَذَا بِطَلَاقِ الْمُسْلِمِينَ طَلِّقُوا الْمَرْأَةَ فِي قُبُلِ طُهْرِهَا
[Machine] Between Abu Talhah and Umm Salim, there was a disagreement. Abu Talhah intended to divorce Umm Salim. This matter reached the Prophet ﷺ , who said, "Indeed, divorcing Umm Salim is a severe sin."
بَيْنَ أَبِي طَلْحَةَ وَأُمِّ سُلَيْمٍ ؓ كَلَامٌ فَأَرَادَ أَبُو طَلْحَةَ أَنْ يُطَلِّقَ أُمَّ سُلَيْمٍ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ إِنَّ طَلَاقَ أُمِّ سُلَيْمٍ لَحَوْبٌ
42.11 [Machine] What is stated in the divorce according to the Sunnah and the innovation? Imam Shafi'i said: Allah, Exalted and Glorified be He, said: "When you divorce women, divorce them for their prescribed period" [Quran 65:1]. And it is also recited as "for their waiting period," and both meanings do not differ.
٤٢۔١١ بَابُ مَا جَاءَ فِي طَلَاقِ السُّنَّةِ وَطَلَاقِ الْبِدْعَةِ قَالَ الشَّافِعِيُّ: قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} [الطلاق: 1] , وَقُرِئَتْ لِقُبُلِ عِدَّتِهِنَّ وَهُمَا لَا يَخْتَلِفَانِ فِي مَعْنًى
What do you think if a man divorces his wife while she is menstruating? He said: Abdullah ibn Umar divorced his wife while she was menstruating during the time of the Messenger of Allah ﷺ.So Umar asked the Messenger of Allah ﷺ saying: Abdullah ibn Umar divorced his wife while she was menstruating. Abdullah said: He returned her to me and did not count it (the pronouncement) anything. He said: When she is purified, he may divorce her or keep her with him. Ibn Umar said: The Prophet ﷺ recited the Qur'anic verse: O Prophet, when you divorce women, divorce them in the beginning of their waiting period." Abu Dawud said: This tradition has been narrated by Yunus b. Jubair, Anas b. Sirin b. Jubair, Zaid b. Aslam, Abu al-Zubair and Mansur from Abu Wa'il on the authority of Ibn 'Umar. They all agreed on the theme that the Prophet ﷺ commanded him to take her back (and keep her) till she was purified. Then if he desired, he might divorce her or keep her with him if he wanted to do so. The version narrated by al-Zuhri from Salim from Nafi' on the authority of Ibn 'Umar has: The Prophet ﷺ commanded him to take her back (and keep her) till she is purified, and then has menstrual discharge, and then she is purified. Then if he desires, he may divorce her and if he desires he may keep her. Abu Dawud said: A version like that of Nafi' and al-Zuhri has also been transmitted by 'Ata al-Khurasani from al-Hasan on the authority of Ibn 'Umar. All the versions of this tradition contradict the one narrated by Abu al-Zubair. (Using translation from Abū Dāʾūd 2185)
طَلَّقَ عَبْدُ اللهِ بْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ عَبْدَ اللهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ النَّبِيُّ ﷺ لِيُرَاجِعْهَا فَرَدَّهَا عَلَيَّ وَقَالَ إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ قَالَ ابْنُ عُمَرَ وَقَرَأَ النَّبِيُّ ﷺ {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ} [الطلاق 1] فِي قُبُلِ عِدَّتِهِنَّ
[Machine] I heard Abdullah, son of Umar ibn al-Khattab, read (O Prophet, when you divorce women, divorce them for their waiting period).
سَمِعْتُ عَبْدَ اللهِ بْنَ عُمَرَ بْنِ الْخَطَّابِ ؓ قَرَأَ (يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِقُبُلِ عِدَّتِهِنَّ)
[Machine] That Ibn Abbas used to recite this verse, so divorce them before their waiting period or keep them in marriage until their waiting period.
أَنَّ ابْنَ عَبَّاسٍ كَانَ يَقْرَأُ هَذَا الْحَرْفَ فَطَلِّقُوهُنَّ قُبُلَ عِدَّتِهِنَّ أَوْ لِقُبُلِ عِدَّتِهِنَّ
[Machine] Abu Tahir al-Faqih informed us, from Abu Bakr al-Qattan, from Ali ibn al-Hasan al-Hilali, from Abu Asim al-Nabil, from Ibn Jurayj, who said: "Mujahid used to recite it like this, meaning, the pronunciation of their names."
أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ نا أَبُو بَكْرٍ الْقَطَّانُ نا عَلِيُّ بْنُ الْحَسَنِ الْهِلَالِيُّ أنا أَبُو عَاصِمٍ النَّبِيلُ نا ابْنُ جُرَيْجٍ قَالَ كَانَ مُجَاهِدٌ يَقْرَؤُهَا هَكَذَا يَعْنِي لَقُبُلِ عِدَّتِهِنَّ
Command him ('Abdullah b. 'Umar) to take her back (and keep her) and pronounce divorce when she is purified and she again enters the period of menstruation and she is again purified (after passing the period of menses), and then if he so desires he may keep her and if he desires divorce her (finally) before touching her (without having an intercourse with her), for that is the period of waiting ('ldda) which God, the Exalted and Glorious, has commanded for the divorce of women. أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ ؓ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيَتْرُكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ ﷻ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ وَفِي رِوَايَةِ الشَّافِعِيِّ ثُمَّ لِيُمْسِكْهَا بَدَلَ قَوْلِهِ ثُمَّ لِيَتْرُكْ وَلَمْ يَقُلْ بَعْدُ
I divorced my wife during the lifetime of Messenger of Allah ﷺ when she was in the state of menses. 'Umar (Allah be pleased with him) made a mention of it to Messenger of Allah ﷺ, whereupon he said: Command him to take her back and leave her (in that state) until she is purified. Then (let her) enter the period of second menses, and when she is purified, then divorce her (finally) before having a sexual intercourse with her, or retain her (finally). That is the 'Idda (the prescribed period) which Allah commanded (to be kept in view) while divorcing the women. 'Ubaidullah reported: I said to Nafi': What became of that divorce (pronounced within 'Idda)? He said: It was as one which she counted. (Using translation from Muslim 1471c)
طَلَّقْتُ امْرَأَتِي عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ ؓ لِرَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ مُرْهُ فَلْيُرَاجِعْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ حَيْضَةً أُخْرَى فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا إِنْ شَاءَ قَبْلَ أَنْ يُجَامِعَهَا أَوْ يُمْسِكْهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللهُ تَعَالَى أَنْ تُطَلَّقَ لَهَا النِّسَاءُ فَقُلْتُ لِنَافِعٍ مَا صَنَعَتِ التَّطْلِيقَةُ؟ قَالَ وَاحِدَةً اعْتَدَّتْ بِهَا
[Machine] He divorced his wife while she was menstruating, pronouncing one divorce. The Messenger of Allah ﷺ ordered him to take her back, then to hold her until she becomes pure, then to wait until she goes through another menstrual cycle. Then, if he wishes to divorce her, he should divorce her before having sexual intercourse with her. That is the waiting period that Allah has commanded women to observe. This is the narration of Yahya.
طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً وَاحِدَةً فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُرَاجِعَهَا ثُمَّ يُمْسِكَهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ عِنْدَهُ حَيْضَةً أُخْرَى ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا فَإِنْ أَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا حِينَ تَطْهُرَ مِنْ قَبْلِ أَنْ يُجَامِعَهَا فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ لَفْظُ حَدِيثِ يَحْيَى
‘Abd Allah (bin Umar) said that he divorced his wife while she was menstruating. ‘Umar mentioned the matter to the Messenger of Allah ﷺ. The Messenger of Allah ﷺ became angry and said “Command him, he must take her back and keep her back till she is purified, then has another menstrual period and is purified. Then if he desires he may divorce her during the period of purity before he has intercourse with her. This is the divorce for waiting period as commanded by Allaah, the Exalted. أَخْبَرَهُ أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِرَسُولِ اللهِ ﷺ فَتَغَيَّظَ فِيهِ رَسُولُ اللهِ ﷺ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ لِيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا طَاهِرًا قَبْلَ أَنْ يَمَسَّهَا فَتِلْكَ الْعِدَّةُ كَمَا أَمَرَ اللهُ ﷻ
[Machine] I divorced my wife during the lifetime of the Messenger of Allah ﷺ while she was in her menstrual period. 'Umar mentioned that to the Messenger of Allah ﷺ, and he became angry with me because of that. He said to me, "Take her back and keep her until she becomes pure from her menses and then becomes pure from any bleeding, then if you wish, divorce her before having any sexual relation with her, that will be the divorce done to her at her waiting period." As Allah commanded. Abdullah said: "So I took her back, and I considered that as one divorce that I had divorced her with." And Abu 'Abdullah al-Hafiz informed us, and Abu al-Walid informed me, from Muhammad bin Ahmad bin Zuhair, from Ishaq bin Mansur, from Yazid bin 'Abdul-Rabbi, from Muhammad bin Harb, whose chain of narration matches Abu Dawud's.
طَلَّقْتُ امْرَأَتِي فِي حَيَاةِ رَسُولِ اللهِ ﷺ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِرَسُولِ اللهِ ﷺ فَتَغَيَّظَ عَلَيَّ فِي ذَلِكَ وَقَالَ لِيُرَاجِعْهَا ثُمَّ يُمْسِكْهَا حَتَّى تَحِيضَ حَيْضَةً وَتَطْهُرَ فَإِنْ شَاءَ أَنْ يُطَلِّقَهَا طَاهِرًا قَبْلَ أَنْ يَمَسَّهَا فَذَلِكَ الطَّلَاقُ لِلْعِدَّةِ كَمَا أَمَرَ اللهُ تَعَالَى قَالَ عَبْدُ اللهِ فَرَاجَعْتُهَا وَحَسِبْتُ لَهَا التَّطْلِيقَةَ الَّتِي طَلَّقْتُهَا 14911 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو الْوَلِيدِ أنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زُهَيْرٍ نا إِسْحَاقُ بْنُ مَنْصُورٍ نا يَزِيدُ بْنُ عَبْدِ رَبِّهِ نا مُحَمَّدُ بْنُ حَرْبٍ بِإِسْنَادِهِ نَحْوَهُ
I divorced my wife while she was in the state of menses. 'Umar (Allah be pleased with him) made mention of it to Allah's Apostle ﷺ and he was enraged and he said: Command him to take her back until she enters the second ensuing menses other than the one in which he divorced her and in case he deems proper to divorce her, he should pronounce divorce (finally) before touching her (in the period) when she is purified of her menses, and that is the prescribed period in regard to divorce as Allah has commanded. 'Abdullah made a pronouncement of one divorce and it was counted in case of divorce. 'Abdullah took her back as Messenger of Allah ﷺ had commanded him. (Using translation from Muslim 1471f)
طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَذَكَرَ عُمَرُ لِرَسُولِ اللهِ ﷺ فَتَغَيَّظَ رَسُولُ اللهِ ﷺ فَقَالَ لِيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَحِيضَ حَيْضَةً مُسْتَقْبِلَةً سِوَى حَيْضَتِهَا الَّتِي طَلَّقَهَا فِيهَا فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا طَاهِرًا مِنْ حَيْضَتِهَا قَبْلَ أَنْ يَمَسَّهَا فَذَلِكَ الطَّلَاقُ الْعِدَّةُ كَمَا أَمَرَ اللهُ ﷻ وَكَانَ عَبْدُ اللهِ طَلَّقَهَا تَطْلِيقَةً فَحُسِبَتْ مِنْ طَلَاقِهَا وَرَاجَعَهَا عَبْدُ اللهِ كَمَا أَمَرَهُ رَسُولُ اللهِ ﷺ
he divorced his wife when she was menstruating, and 'Umar mentioned that to the Prophet ﷺ. He said: "Tell him to take her back then divorce her when she is pure (not menstruating) or pregnant." (Using translation from Ibn Mājah 2023)
أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلًا
Command him to take her back until she is pure and then she enters the second menses and then becomes pure. Then either divorce her (finally) or retain her. (Using translation from Muslim 1471i)
طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ ؓ عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ حَيْضَةً أُخْرَى ثُمَّ تَطْهُرَ ثُمَّ يُطَلِّقَ بَعْدُ أَوْ يُمْسِكَ
[Machine] In saying "so divorce them during their waiting period," [Quran 65:1] Tahir said, without intimacy, some narrators have added to it "or through an evident indication," and I have not found it in reliable narrations.
فِي قَوْلِهِ {فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} [الطلاق 1] قَالَ طَاهِرًا مِنْ غَيْرِ جِمَاعٍ زَادَ فِيهِ بَعْضُ الرُّوَاةِ أَوْ عِنْدَ حَبَلٍ قَدْ تَبَيَّنَ وَلَمْ أَجِدْهُ فِي الرِّوَايَاتِ الْمَحْفُوظَةِ
[Machine] To divorce (a woman) while she is in a state of purity without having had intercourse with her, or to divorce her while she is pregnant with a clearly visible pregnancy. As for what is forbidden, it is to divorce her while she is menstruating or to divorce her at the time of having intercourse with her without knowing whether the womb contains a child or not.
يُطَلِّقَهَا طَاهِرًا مِنْ غَيْرِ جِمَاعٍ أَوْ يُطَلِّقَهَا حَامِلًا مُسْتَبِينًا حَمْلَهَا وَأَمَّا الْحَرَامُ فَأَنْ يُطَلِّقَهَا حَائِضًا أَوْ يُطَلِّقَهَا حِينَ يُجَامِعُهَا لَا يَدْرِي اشْتَمَلَ الرَّحِمُ عَلَى وَلَدٍ أَمْ لَا
[Machine] A man who divorces according to the Sunnah will never regret it.
مَا طَلَّقَ رَجُلٌ طَلَاقَ السُّنَّةِ فَيَنْدَمُ أَبَدًا
42.12 [Machine] Divorce occurs during menstruation, even if it is an innovation. Imam Shafi'i (may Allah have mercy on him) said: It is clear, meaning in the hadith of Ibn 'Umar, that divorce occurs during menstruation, because he is only commanded to divorce those who are bound by divorce. As for those who are not bound by divorce, they remain in their previous state before divorce. The sheikh said: We have mentioned the hadith of Salim, Nafi' and Abdullah ibn Dinar from Ibn 'Umar.
٤٢۔١٢ بَابُ الطَّلَاقِ يَقَعُ عَلَى الْحَائِضِ وَإِنْ كَانَ بِدْعِيًّا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: بَيِّنٌ يَعْنِي فِي حَدِيثِ ابْنِ عُمَرَ أَنَّ الطَّلَاقَ يَقَعُ عَلَى الْحَائِضِ؛ لِأَنَّهُ إِنَّمَا يُؤْمَرُ بِالْمُرَاجَعَةِ مَنْ لَزِمَهُ الطَّلَاقُ , فَأَمَّا مَنْ لَمْ يَلْزَمْهُ الطَّلَاقُ فَهُوَ بِحَالِهِ قَبْلَ الطَّلَاقِ. قَالَ الشَّيْخُ: قَدْ ذَكَرْنَا حَدِيثَ سَالِمٍ وَنَافِعٍ وَعَبْدِ اللهِ بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ
[Machine] "Indeed, Abdullah bin Umar divorced his wife while she was menstruating. He went to Umar and asked him about it, so Umar instructed him to reconcile with her and then divorce her during her waiting period. Abdullah bin Umar said, 'What if he is unable and loses control (of his desires)?' Umar said, 'Yes.' Abdullah bin Umar asked, 'What if he ejaculates?'"
فَإِنَّ عَبْدَ اللهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ ؓ النَّبِيَّ ﷺ فَسَأَلَهُ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يُطَلِّقَهَا فِي قُبُلِ عِدَّتِهَا قَالَ قُلْتُ فَيَعْتَدُّ بِهَا قَالَ نَعَمْ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ
"I asked Ibn 'Umar about a man who divorced his wife while she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar?' He divorced his wife while she was menstruating, and 'Umar asked the Prophet about that, and he told him to take her back, then wait for the right time. I said to him: 'Was that divorce counted?' He said: 'Be quiet! What do you think if some becomes helpless and behaves foolishly?'" (Using translation from Nasāʾī 3399)
تَعْرِفُ ابْنَ عُمَرَ؟ إِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا قُلْتُ فَيُعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ؟ قَالَ فَمَهْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ
[Machine] I divorced my wife while she was menstruating. Umar ibn al-Khattab came to the Prophet ﷺ and mentioned this to him. The Prophet ﷺ advised him to wait until she becomes clean (from menstruation), then divorce her. I then asked Ibn Umar about it, and he said, "What prevents you? What if he becomes impotent or confused by the wording of the Hadith of Ghandar?"
طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَأَتَى عُمَرُ بْنُ الْخَطَّابِ ؓ النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ ﷺ لِيُرَاجِعْهَا فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا قَالَ فَقُلْتُ لِابْنِ عُمَرَ فَاحْتَسَبْتَ بِهَا قَالَ فَمَا يَمْنَعُهُ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ لَفْظُ حَدِيثِ غُنْدَرٍ
[Machine] "O Messenger of Allah, do you consider that divorce?" He replied, "Yes"
عُمَرُ ؓ يَا رَسُولَ اللهِ أَفَتَحْتَسِبُ بِتِلْكَ التَّطْلِيقَةِ؟ قَالَ نَعَمْ
I asked Ibn 'Umar (Allah be pleased with them) about the woman whom he had divorced. He said: I divorced her while she was in the state of menses. It was mentioned to 'Umar (Allah be pleased with him) and he then made a mention of that to Allah's Apostle ﷺ, whereupon he said: Command him to take her back and when the period of menses is over, then (he may divorce her in the state of her purity. He (Ibn Umar) said: So I took her back, then divorced her in her purity. I (the narrator) said: Did you count that divorce which you pronounced in the state of menses? He said: Why should I not have counted that? Was I helpless or foolish? (Using translation from Muslim 1471o)
طَلَّقْتُهَا وَهِيَ حَائِضٌ فَذُكِرَ ذَلِكَ لِعُمَرَ ؓ فَذَكَرَهُ لِلنَّبِيِّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا لِطُهْرِهَا قَالَ فَرَاجَعْتُهَا ثُمَّ طَلَّقْتُهَا لِطُهْرِهَا قُلْتُ فَاعْتَدَّتْ بِتِلْكَ التَّطْلِيقَةِ الَّتِي طُلِّقَتْ وَهِيَ حَائِضٌ قَالَ مَالِي لَا أَعْتَدُّ بِهَا وَإِنْ كُنْتَ عَجَزْتَ وَاسْتَحْمَقْتَ
Do you know 'Abdullah b. Umar? He said: Yes. He said: It was he who divorced his wife jn the state of menses and 'Umar went to Allah's Apostle ﷺ and gave him this information. and he commanded him that he should take her back; and he (Abu Tawus) said: I did not hear any addition to this (hadith) from my father. (Using translation from Muslim 1471r)
فَإِنَّهُ طَلَّقَ امْرَأَتَهُ حَائِضًا فَذَهَبَ عُمَرُ ؓ إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ الْخَبَرَ فَأَمَرَهُ أَنْ يَرْتَجِعَهَا قَالَ لَمْ أَسْمَعْهُ يَزِيدُ عَلَى ذَلِكَ لِأَبِيهِ
[Machine] It was reported that Ibn Umar divorced his wife while she was menstruating. The Prophet ﷺ commanded him to reconcile with her until she becomes pure (finishes her menstruation). Then, when she becomes pure, he can divorce her.
أَنَّ ابْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَمَرَهُ النَّبِيُّ ﷺ أَنْ يُرَاجِعَهَا حَتَّى تَطْهُرَ فَإِذَا طَهُرَتْ طَلَّقَهَا
[Machine] Ibn Umar divorced his wife while she was in her menstrual period. Umar went to the Messenger of Allah ﷺ and informed him about it. The Messenger of Allah ﷺ ordered him to wait until she becomes pure again, then to reconcile with her, and then to count the divorce as the first time it happened.
طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ وَاحِدَةً فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ فَأَمَرَهُ إِذَا طَهُرَتْ أَنْ يُرَاجِعَهَا ثُمَّ يَسْتَقْبِلَ الطَّلَاقَ فِي عِدَّتِهَا ثُمَّ تَحْتَسِبُ بِالتَّطْلِيقَةِ الَّتِي طَلَّقَ أَوَّلَ مَرَّةٍ
[Machine] The Prophet Muhammad ﷺ ordered him to wait until she purifies herself. If she purifies herself, then he can either divorce her if he wishes, or he can keep her before having sexual intercourse.
فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَرْتَجِعَهَا حَتَّى تَطْهُرَ فَإِذَا طَهُرَتْ فَإِنْ شَاءَ طَلَّقَ وَإِنْ شَاءَ أَمْسَكَ قَبْلَ أَنْ يُجَامِعَ
[Machine] He divorced his wife while she was menstruating, so Umar went to the Prophet ﷺ and informed him about that. The Prophet ﷺ made it count as a single divorce. Al-Bukhari said, and Abu Ma'mar narrated to us from Ayyub, from Sa'eed ibn Jubair, from Ibn Umar, who said: "I was considered to have divorced her with one divorce."
أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ ؓ النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَجَعَلَهَا وَاحِدَةً قَالَ الْبُخَارِيُّ وَقَالَ أَبُو مَعْمَرٍ نا عَبْدُ الْوَارِثِ أَخْبَرَنَاهُ أَيُّوبُ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عُمَرَ ؓ قَالَ حُسِبَتْ عَلَيَّ بِتَطْلِيقَةٍ
[Machine] Abdullah bin Umar's wife was menstruating during the time of the Messenger of Allah ﷺ , so Umar asked the Messenger of Allah ﷺ about it. Abdullah bin Umar divorced his wife while she was menstruating, so Abdullah said to the Prophet ﷺ , "Should I take her back when she becomes clean or should I keep her?" Ibn Umar recited the verse to the Prophet ﷺ , "O Prophet, when you divorce women, divorce them for their waiting period" [Surah At-Talaq 1], meaning during their waiting period.
عَبْدُ اللهِ بْنُ عُمَرَ ؓ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ ؓ رَسُولَ اللهِ ﷺ فَقَالَ لَهُ عَبْدُ اللهِ بْنُ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ قَالَ عَبْدُ اللهِ فَرَدَّهَا عَلَيَّ وَلَمْ يَرَهَا شَيْئًا وَقَالَ إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ قَالَ ابْنُ عُمَرَ وَقَرَأَ النَّبِيُّ ﷺ {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} [الطلاق 1] أَيْ فِي قُبُلِ عِدَّتِهِنَّ
[Machine] The Messenger of Allah, ﷺ , said, "Whoever divorces for the sake of innovation, we will hold him accountable for his innovation." Abu Abdul Rahman As-Sulami informed us that I am Abu Al-Hasan Ad-Darqutni, the guardian (preserver). Isma'il bin Abi Umayyah Al-Misri, the abandoned one in hadith, said.
قَالَ رَسُولُ اللهِ ﷺ مَنْ طَلَّقَ لِلْبِدْعَةِ أَلْزَمْنَاهُ بِدْعَتَهُ 14933 أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أَنَا أَبُو الْحَسَنِ الدَّارَقُطْنِيِّ الْحَافِظُ قَالَ إِسْمَاعِيلُ بْنُ أَبِي أُمَيَّةَ الْمِصْرِيُّ مَتْرُوكُ الْحَدِيثِ
42.13 [Machine] The choice of the husband not to divorce more than one
٤٢۔١٣ بَابُ الِاخْتِيَارِ لِلزَّوْجِ أَنْ لَا يُطَلِّقَ إِلَّا وَاحِدَةً قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِتَكُونَ لَهُ الرَّجْعَةُ فِي الْمَدْخُولِ بِهَا وَيَكُونَ خَاطِبًا فِي غَيْرِ الْمَدْخُولِ بِهَا وَمَتَى نُكِحَتْ بَقِيَتْ لَهُ عَلَيْهَا اثْنَتَانِ مِنَ الطَّلَاقِ، وَلَا يَحْرُمُ عَلَيْهِ أَنْ يُطَلِّقَ اثْنَتَيْنِ وَلَا ثَلَاثًا لِأَنَّ اللهَ تَعَالَى جَلَّ ثَنَاؤُهُ أَبَاحَ الطَّلَاقَ عَلَى أَهْلِهِ وَمَا أَبَاحَ فَلَيْسَ بِمَحْظُورٍ عَلَى أَهْلِهِ وَأَنَّ رَسُولَ اللهِ ﷺ عَلَّمَ عَبْدَ اللهِ بْنَ عُمَرَ مَوْضِعَ الطَّلَاقِ، وَلَوْ كَانَ فِي عَدَدِ الطَّلَاقِ مُبَاحٌ وَمَحْظُورٌ عَلَّمَهُ إِنْ شَاءَ اللهُ إِيَّاهُ
[Machine] So let him review it, then let him divorce her when she has purified herself or while she is pregnant.
فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا إِذَا طَهُرَتْ أَوْ وَهِيَ حَامِلٌ
[Machine] She said, "My husband divorced me three times." This was brought to the Messenger of Allah ﷺ and he did not give her a place to live or provide for her. He ordered her to go and stay with Ibn Umm Maktum. In another narration from Umm Waraqa bint Qays, she said, "I said, 'O Messenger of Allah, my husband divorced me three times and I fear that he will forcibly enter (my house).' So he ordered her and she migrated."
أَنَّهَا قَالَتْ طَلَّقَنِي زَوْجِي ثَلَاثًا فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَلَمْ يَجْعَلْ لَهَا سُكْنَى وَلَا نَفَقَةً وَأَمَرَهَا أَنْ تَعْتَدَّ عِنْدَ ابْنِ أُمِّ مَكْتُومٍ وَفِي رِوَايَةِ عُرْوَةَ بْنِ الزُّبَيْرِ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ قُلْتُ يَا رَسُولَ اللهِ زَوْجِي طَلَّقَنِي ثَلَاثًا فَأَخَافُ أَنْ يَقْتَحِمَ فَأَمَرَهَا فَتَحَوَّلَتْ
[Machine] A man divorced his wife three times, and then another man married her, but he divorced her before touching her. The Messenger of Allah ﷺ was asked if the first man could remarry her. He said, "No, until he tastes her sweetness like the first (husband) tasted it."
رَجُلًا طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَهَا رَجُلٌ آخَرُ فَطَلَّقَهَا قَبْلَ أَنْ يَمَسَّهَا فَسُئِلَ رَسُولُ اللهِ ﷺ أَتَحِلُّ لِلْأَوَّلِ؟ قَالَ لَا حَتَّى يَذُوقَ عُسَيْلَتَهَا كَمَا ذَاقَ الْأَوَّلُ
[Machine] "What did he do to deserve that? Abdurrahman ibn Auf divorced his wife three times and no one blamed him for it. And likewise..."
ﷺ عَابَ ذَلِكَ عَلَيْهِ وَطَلَّقَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ امْرَأَتَهُ ثَلَاثًا فَلَمْ يَعِبْ ذَلِكَ عَلَيْهِ أَحَدٌ وَكَذَلِكَ
[Machine] "To be followed by two divorces among the remaining Qur'an reciters. When the Messenger of Allah ﷺ heard this, he said, 'O Ibn Umar, this is not how Allah commanded you. Indeed, you have made a mistake in the Sunnah. The Sunnah is to anticipate purity and divorce for every reciter.' He ﷺ then instructed me, so I reviewed it, and he said, 'When she becomes pure, divorce her at that time or hold on.' I said, 'O Messenger of Allah, what if I divorced her three times? Would it be permissible for me to reconcile with her?' He said, 'That would be apparent from you and these additions that were brought by Ata al-Khurasani are an act of disobedience. These additions are not mentioned in any other narration. And they have spoken about this, and his statement resembles the occurrence of what he used to do with the three divorces during the state of menstruation.' And Allah knows best."
أَنْ يُتْبِعَهَا تَطْلِيقَتَيْنِ أُخْرَاوَيْنِ عِنْدَ الْقُرْئَيْنِ الْبَاقِيَيْنِ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ يَا ابْنَ عُمَرَ مَا هَكَذَا أَمَرَكَ اللهُ إِنَّكَ قَدْ أَخْطَأْتَ السُّنَّةَ وَالسُّنَّةُ أَنْ تَسْتَقْبِلَ الطُّهْرَ فَتُطَلِّقَ لِكُلِّ قُرْءٍ قَالَ فَأَمَرَنِي رَسُولُ اللهِ ﷺ فَرَاجَعْتُهَا ثُمَّ قَالَ إِذَا طَهُرَتْ فَطَلِّقْ عِنْدَ ذَلِكَ أَوْ أَمْسِكْ فَقُلْتُ يَا رَسُولَ اللهِ أَفَرَأَيْتَ لَوْ أَنِّي طَلَّقْتُهَا ثَلَاثًا كَانَ يَحِلُّ لِي أَنْ أُرَاجِعَهَا؟ قَالَ كَانَتْ تَبِينُ مِنْكَ وَتَكُونُ مَعْصِيَةً هَذِهِ الزِّيَادَاتُ الَّتِي أُتِيَ بِهَا عَنْ عَطَاءٍ الْخُرَاسَانِيِّ لَيْسَتْ فِي رِوَايَةِ غَيْرِهِ وَقَدْ تَكَلَّمُوا فِيهِ وَيُشْبِهُ أَنْ يَكُونَ قَوْلُهُ وَتَكُونُ مَعْصِيَةً رَاجِعًا إِلَى إِيقَاعِ مَا كَانَ يُوقِعُهُ مِنَ الطَّلَاقِ الثَّلَاثِ فِي حَالِ الْحَيْضِ وَاللهُ أَعْلَمُ
[Machine] He divorced his wife while she was on her period, with one divorce. The Messenger of Allah ﷺ commanded him to take her back, then hold her until she becomes pure, and then she has another menstrual period with him. Then he should wait until she becomes pure from her period before having sexual intercourse with her. If he wants to divorce her, let him divorce her when she becomes pure before having sexual intercourse with her. That is the waiting period which Allah commanded for women. Ibn Umar, when asked about this, said to one of them: If you have divorced her three times, she is prohibited for you until she marries someone else and disobeys Allah in what He has commanded you regarding divorcing your wife.
أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً وَاحِدَةً فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُرَاجِعَهَا ثُمَّ يُمْسِكَهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ عِنْدَهُ حَيْضَةً أُخْرَى ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا فَإِنْ أَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا حِينَ تَطْهُرُ مِنْ قَبْلِ أَنْ يُجَامِعَهَا فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ ﷻ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ وَكَانَ ابْنُ عُمَرَ إِذَا سُئِلَ عَنْ ذَلِكَ قَالَ لِأَحَدِهِمْ إِنْ كُنْتَ طَلَّقْتَهَا ثَلَاثًا فَقَدْ حُرِّمَتْ عَلَيْكَ حَتَّى تَنْكِحَ زَوْجًا غَيْرَكَ وَعَصَيْتَ اللهَ ﷻ فِيمَا أَمَرَكَ مِنْ طَلَاقِ امْرَأَتِكَ
Mujahid said “I was with Ibn ‘Abbas”. A man came to him and said that he divorced his wife by three pronouncements. I kept silence and thought that he was going to restore het to him. He then said “A man goes and commits a foolish act and then says “O, Ibn ‘Abbas! Alaah has said “And for those who fear Allaah, He (ever) prepares a way out.” Since you did not keep duty to Allaah I do not find a way out for you. You disobeyed your Lord and your wife was separated from you. Allaah has said “O Prophet! When you divorce women divorce them in the beginning of their waiting period.” Abu Dawud said “This tradition has been transmitted by Humaid Al A’raj and by others from Mujahid on the authority of Ibn ‘Abbas. Shu’bjh narrated it from ‘Amr bin Murrah from Sa’id bin Jubair on the authority of Ibn ‘Abbas. Ayyub and Ibn ‘Jubair both narrated it from “’Ikrimah bin Khalid from Sa’id bin Jubair on the authority of Ibn ‘Abbas. Ibn Juraij narrated it from ‘Abd Al Hamid bin Rafi’ from ‘Ata from Ibn ‘Abbas. Al A’mash narrated it from Malik bin Al Harith on the authority of Ibn ‘Abbas. They all said about the divorce by three pronouncements. He allowed it and said” (Your wife) has been separated from you similar to the tradition narrated by Isma’il from Ayub from ‘Abd Allaah bin Kathir.” Abu Dawud said “Hammad bin Zaid narrated it from Ayyub from ‘Ikrimah on the authority of Ibn ‘Abbas. This version adds If he said “You are divorced three times saying in one pronouncement, it constitutes a single (divorce). Isma’il bin Ibrahim narrated it from Ayyub from ‘Ikrimah. This is his (‘Ikrimah’s) statement. He did not mention the name of Ibn ‘Abbas. He narrated it as a statement of ‘Ikrimah.” (Using translation from Abū Dāʾūd 2197)
{وَمَنْ يَتَّقِ اللهَ يَجْعَلْ لَهُ مَخْرَجًا} [الطلاق 2] وَإِنَّكَ لَمْ تَتَّقِ اللهَ فَلَا أَجِدُ لَكَ مَخْرَجًا عَصَيْتَ رَبَّكَ وَبَانَتْ مِنْكَ امْرَأَتُكَ وَإِنَّ اللهَ قَالَ {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ} [الطلاق 1] فِي قُبُلِ عِدَّتِهِنَّ هَكَذَا فِي هَذِهِ الرِّوَايَةِ ثَلَاثًا
[Machine] "You disobeyed your Lord, and your wife has confessed to not fearing Allah, so He will make a way out for you. Then He recited, 'O Prophet, when you [Muslims] divorce women, divorce them for [the commencement of] their waiting period." [Surah At-Talaq, verse 1] in the acceptance of their waiting period."
عَصَيْتَ رَبَّكَ وَبَانَتْ مِنْكَ امْرَأَتُكَ لَمْ تَتَّقِ اللهَ فَيَجْعَلْ لَكَ مَخْرَجًا ثُمَّ قَرَأَ {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ} [الطلاق 1] فِي قُبُلِ عِدَّتِهِنَّ
[Machine] "Three divorces make it impermissible for you to take back your wife, and their remaining on you is a sin. Have you taken the verses of Allah in mockery? In this, there is evidence that He has made the sin in regards to the three divorces, and Allah knows best. Al-Shafi'i narrated from Al-Zanj and Ibn Jurayj from 'Ata' from Ibn Abbas in a hundred (divorces). He said: 'And ninety-seven (divorces) in which you have taken the verses of Allah in mockery.' Al-Shafi'i said: Ibn Abbas disagreed with him, saying: 'Any addition to the count of divorces that Allah has not made, and he did not object to what Allah has made of the three divorces.'"
ثَلَاثٌ فَتَحْرُمُ عَلَيْكَ امْرَأَتُكَ وَبَقِيَّتُهُنَّ عَلَيْكَ وِزْرٌ أَتَّخَذْتَ آيَاتِ اللهِ هُزُوًا؟ فَفِي هَذَا دَلَالَةٌ عَلَى أَنَّهُ جَعَلَ الْوِزْرَ فِيمَا فَوْقَ الثَّلَاثِ وَاللهُ أَعْلَمُ وَرَوَاهُ الشَّافِعِيُّ عَنِ الزَّنْجِيِّ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ ؓ فِي مِائَةٍ قَالَ وَسَبْعٌ وَتِسْعُونَ اتَّخَذْتَ آيَاتِ اللهِ هُزُوًا قَالَ الشَّافِعِيُّ فَعَابَ عَلَيْهِ ابْنُ عَبَّاسٍ كُلَّ مَا زَادَ مِنْ عَدَدِ الطَّلَاقِ الَّذِي لَمْ يَجْعَلِ اللهُ إِلَيْهِ وَلَمْ يَعِبْ عَلَيْهِ مَا جَعَلَ اللهُ إِلَيْهِ مِنَ الثَّلَاثِ
[Machine] If a husband wants to divorce his wife in accordance with what Allah has commanded, then he should wait for her to have her menstruation cycle and become pure again. Then he can divorce her while she is in a state of purity, without having sexual intercourse. Two witnesses should be present. After the waiting period of her menstruation cycle and purification has passed, if he wishes, he can take her back. If he wishes, he can divorce her.
أَنْ يُطَلِّقَ لِلسُّنَّةِ كَمَا أَمَرَ اللهُ ﷻ فَلْيُنْظِرْهَا حَتَّى تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ لِيُطَلِّقْهَا طَاهِرًا فِي غَيْرِ جِمَاعٍ وَيُشْهِدُ رَجُلَيْنِ ثُمَّ لِيُنْظِرْهَا حَتَّى تَحِيضَ ثُمَّ تَطْهُرَ فَإِنْ شَاءَ رَاجَعَ وَإِنْ شَاءَ طَلَّقَ
[Machine] "To divorce her in every purity is to divorce. So if that is the last, then that is the waiting period that Allah has commanded. Abu Abdullah As-Sulami informed us: I, Ali bin Umar Al-Hafiz, narrated from Al-Hussein and Al-Qasim, who narrated from Ismail Al-Mahamili, who said: Abu As-Saib Salam bin Junadah informed us, who narrated from Hafs bin Ghias from Al-A'mash, who mentioned it, and we prefer to do it in this way. We have also been narrated from Abdullah bin Mas'ud that he made the transgression on the addition to the three. Allah knows best, and He is most knowledgeable in His affairs."
أَنْ يُطَلِّقَهَا فِي كُلِّ طُهْرٍ تَطْلِيقَةً فَإِذَا كَانَ آخِرُ ذَلِكَ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ بِهَا أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ السُّلَمِيُّ أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا الْحُسَيْنُ وَالْقَاسِمُ أنبأ إِسْمَاعِيلُ الْمَحَامِلِيُّ قَالَا نا أَبُو السَّائِبِ سَلَمُ بْنُ جُنَادَةَ نا حَفْصُ بْنُ غِيَاثٍ عَنِ الْأَعْمَشِ فَذَكَرَهُ وَنَحْنُ هَكَذَا نَسْتَحِبُّ أَنْ يَفْعَلَ وَقَدْ رُوِّينَا أَيْضًا عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ أَنَّهُ جَعَلَ الْعُدْوَانَ فِي الزِّيَادَةِ عَلَى الثَّلَاثِ وَاللهُ أَعْلَمُ وَهُوَ فِيمَا
[Machine] She showed you three and the rest of them are disobedience.
بَانَتْ مِنْكَ بِثَلَاثٍ وَسَائِرُهُنَّ مَعْصِيَةٌ
[Machine] The man then mentioned that to Abu Musa, intending to criticize him, so Abu Musa said, "Do you not see that Imran ibn Husein has said this and that?" Abu Musa then said, "May Allah bless us abundantly, just as He has blessed Abu Nu'ayd."
فَانْطَلَقَ الرَّجُلُ فَذَكَرَ ذَلِكَ لِأَبِي مُوسَى ؓ يُرِيدُ بِذَلِكَ عَيْبَهُ فَقَالَ أَلَا تَرَى أَنَّ عِمْرَانَ بْنَ حُصَيْنٍ قَالَ كَذَا وَكَذَا؟ فَقَالَ أَبُو مُوسَى أَكْثَرَ اللهُ فِينَا مِثْلَ أَبِي نُجَيْدٍ
42.14 [Machine] What is mentioned in the divorce declaration three times and even if they are accumulated.
٤٢۔١٤ بَابُ مَا جَاءَ فِي إِمْضَاءِ الطَّلَاقِ الثَّلَاثِ وَإِنْ كُنَّ مَجْمُوعَاتٍ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة: 229] وَقَالَ: {فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ} [البقرة: 230]-[545]- قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَالْقُرْآنُ وَاللهُ أَعْلَمُ يَدُلُّ عَلَى أَنَّ مَنْ طَلَّقَ زَوْجَةً لَهُ دَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا ثَلَاثًا لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ
[Machine] When her waiting period is over, it is permissible for him to take her back even if he divorced her a thousand times. A man came to his wife and divorced her, then he waited until she completed her waiting period. When she was near the end of her waiting period, he took her back and then divorced her again. He said, "By Allah, I will never shelter you (i.e., take you back) or leave you forever." At that point, Allah revealed the verse, "Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment" (Quran 2:229). From that moment, people started regarding divorce differently. If a person divorced or did not divorce his wife, this information could be verified. This is stated by Al-Bukhari and others.
أَنْ تَنْقَضِيَ عِدَّتُهَا كَانَ ذَلِكَ لَهُ وَإِنْ طَلَّقَهَا أَلْفَ مَرَّةٍ فَعَمَدَ رَجُلٌ إِلَى امْرَأَةٍ لَهُ فَطَلَّقَهَا ثُمَّ أَمْهَلَهَا حَتَّى إِذَا شَارَفَتِ انْقِضَاءَ عِدَّتِهَا ارْتَجَعَهَا ثُمَّ طَلَّقَهَا وَقَالَ وَاللهِ لَا أُؤْوِيكِ إِلِيَّ وَلَا تَخْلِينَ أَبَدًا فَأَنْزَلَ اللهُ تَبَارَكَ وَتَعَالَى {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة 229] فَاسْتَقْبَلَ النَّاسُ الطَّلَاقَ جَدِيدًا مِنْ يَوْمِئِذٍ مَنْ كَانَ مِنْهُمْ طَلَّقَ أَوْ لَمْ يُطَلِّقْ هَذَا مُرْسَلٌ وَهُوَ الصَّحِيحُ قَالَهُ الْبُخَارِيُّ وَغَيْرُهُ
The wife of Rifaʿa Al-Qurazi came to the Prophet ﷺ and said, "I was Rifaʿa's wife, but he divorced me and it was a final irrevocable divorce. Then I married ʿAbdur-Rahman bin Az-Zubair but he is impotent." The Prophet ﷺ asked her 'Do you want to remarry Rifaʿa? You cannot unless you had a complete sexual relation with your present husband." Abu Bakr was sitting with Messenger of Allah ﷺ and Khalid bin Saʿid bin Al-ʿAs was at the door waiting to be admitted. He said, "O Abu Bakr! Do you hear what this (woman) is revealing frankly before the Prophet ﷺ ?" (Using translation from Bukhārī 2639)
سَمِعَهَا تَقُولُ جَاءَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ الْقُرَظِيِّ فَطَلَّقَنِي فَبَتَّ طَلَاقِي فَتَزَوَّجْتُ بَعْدَهُ عَبْدَ الرَّحْمَنِ بْنَ الزُّبَيْرِ وَإِنَّمَا مَعَهُ مِثْلُ هُدْبَةِ الثَّوْبِ فَتَبَسَّمَ رَسُولُ اللهِ ﷺ وَقَالَ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى تَذُوقِي عُسَيْلَتَهُ وَيَذُوقَ عُسَيْلَتَكِ وَأَبُو بَكْرٍ ؓ عِنْدَ النَّبِيِّ ﷺ وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ بِالْبَابِ يَنْتَظِرُ أَنْ يُؤْذَنَ لَهُ فَنَادَى فَقَالَ يَا أَبَا بَكْرٍ أَلَا تَسْمَعُ إِلَى مَا تَهْجُرُ بِهِ هَذِهِ عِنْدَ رَسُولِ اللهِ ﷺ؟ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ عُيَيْنَةَ وَغَيْرِهِ
[Machine] A man divorced his wife three times and she got married again and then got divorced. The Prophet ﷺ was asked if the first man could remarry her. He replied, "No, until she marries another man and tastes his marriage as she tasted her first marriage."
رَجُلًا طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَتْ فَطَلَّقَ فَسُئِلَ النَّبِيُّ ﷺ أَتَحِلُّ لِلْأَوَّلِ؟ قَالَ لَا حَتَّى تَذُوقَ عُسَيْلَتَهُ كَمَا ذَاقَ الْأَوَّلُ
