42. Annulment and Divorce
٤٢۔ كِتَابُ الْخُلْعِ وَالطَّلَاقِ
[Machine] Her hand was broken, so the Messenger of Allah ﷺ came to her at dawn and stood there for her until he came out. She said: "O Messenger of Allah, this is the place of refuge of Thabit bin Qais bin Shammas." He asked: "And who are you?" She said: "Habiba bint Sahl." He asked: "What happened to your hands?" She said: "He hit me." So the Prophet ﷺ called Thabit bin Qais and mentioned what had happened between them. The Prophet ﷺ asked him: "What did you give her?" He said: "Two pieces of date palm or two gardens." The Prophet ﷺ asked: "Would it be possible for you to take some of your property and leave some for her?" He asked: "Would that be acceptable, O Messenger of Allah?" The Prophet ﷺ replied: "Yes." So he took one of the portions and divorced her. Thereafter, Ubayy bin Ka'b married her and took her with him to the Levant, where she passed away.
كَسَرَ يَدَهَا فَجَاءَتْ رَسُولَ اللهِ ﷺ فِي الْفَجْرِ فَوَقَفَتْ لَهُ حَتَّى خَرَجَ عَلَيْهَا فَقَالَتْ يَا رَسُولَ اللهِ هَذَا مَقَامُ الْعَائِذِ مِنْ ثَابِتِ بْنِ قَيْسِ بْنِ شِمَاسٍ قَالَ وَمَنْ أَنْتِ؟ قَالَتْ حَبِيبَةُ بِنْتُ سَهْلٍ قَالَ مَا شَأْنُكِ تَرِبَتْ يَدَاكِ؟ قَالَتْ ضَرَبَنِي فَدَعَا النَّبِيُّ ﷺ ثَابِتَ بْنَ قَيْسٍ فَذَكَرَ ثَابِتُ مَا بَيْنَهُمَا فَقَالَ لَهُ النَّبِيُّ ﷺ مَاذَا أَعْطَيْتَهَا؟ قَالَ قِطْعَتَيْنِ مِنْ نَخْلٍ أَوْ حَدِيقَتَيْنِ قَالَ فَهَلْ لَكَ أَنْ تَأْخُذَ بَعْضَ مَالِكَ وَتَتْرُكَ لَهَا بَعْضَهُ؟ قَالَ هَلْ يَصْلُحُ ذَلِكَ يَا رَسُولَ اللهِ؟ قَالَ نَعَمْ فَأَخَذَ إِحْدَاهُمَا فَفَارَقَهَا ثُمَّ تَزَوَّجَهَا أُبَيُّ بْنُ كَعْبٍ ؓ بَعْدَ ذَلِكَ فَخَرَجَ بِهَا إِلَى الشَّامِ فَتُوُفِّيَتْ هُنَالِكَ
