42. Annulment and Divorce
٤٢۔ كِتَابُ الْخُلْعِ وَالطَّلَاقِ
She (Habibah) was the wife of Thabit ibn Qays ibn Shimmas. The Messenger of Allah ﷺ came out one morning and found Habibah by his door. The Messenger of Allah ﷺ said: Who is this? She replied: I am Habibah, daughter of Sahl. He asked: What is your case? She replied: I and Thabit ibn Qays, referring to her husband, cannot live together. When Thabit ibn Qays came, the Messenger of Allah ﷺ said to him: This is Habibah, daughter of Sahl, and she has mentioned (about you) what Allah wished to mention. Habibah said: Messenger of Allah, all that he gave me is with me. The Messenger of Allah ﷺ said to Thabit ibn Qays: Take it from her. So he took it from her, and she lived among her people (relatives). (Using translation from Abū Dāʾūd 2227)
وَأَنَّ رَسُولَ اللهِ ﷺ خَرَجَ إِلَى الصُّبْحِ فَوَجَدَ حَبِيبَةَ بِنْتَ سَهْلٍ عِنْدَ بَابِهِ فِي الْغَلَسِ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ هَذِهِ؟ فَقَالَتْ أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ فَقَالَ مَا شَأْنُكِ؟ فَقَالَتْ لَا أَنَا وَلَا ثَابِتٌ لِزَوْجِهَا فَلَمَّا جَاءَ ثَابِتُ بْنُ قَيْسٍ قَالَ لَهُ رَسُولُ اللهِ ﷺ هَذِهِ حَبِيبَةُ بِنْتُ سَهْلٍ قَدْ ذَكَرَتْ مَا شَاءَ اللهُ أَنْ تَذْكُرَ فَقَالَتْ حَبِيبَةُ يَا رَسُولَ اللهِ كُلُّ مَا أَعْطَانِي عِنْدِي فَقَالَ رَسُولُ اللهِ ﷺ لِثَابِتِ بْنِ قَيْسٍ خُذْ مِنْهَا فَأَخَذَ مِنْهَا وَجَلَسَتْ فِي أَهْلِهَا
[Machine] She came to the Prophet ﷺ in a state of weakness and complaining about something in her body. She said, "Neither I nor Thabit ibn Qais!" The Messenger of Allah ﷺ said, "O Thabit, take from her." So he took from her and she sat down.
أَنَّهَا أَتَتِ النَّبِيَّ ﷺ فِي الْغَلَسِ وَهِيَ تَشْكُو شَيْئًا بِبَدَنِهَا وَهِيَ تَقُولُ لَا أَنَا وَلَا ثَابِتُ بْنُ قَيْسٍ فَقَالَتْ قَالَ رَسُولُ اللهِ ﷺ يَا ثَابِتُ خُذْ مِنْهَا فَأَخَذَ مِنْهَا وَجَلَسَتْ
[Machine] A woman named Thabit ibn Qays came to the Prophet ﷺ and said, "O Messenger of Allah, by Allah, I have no complaint about Thabit in terms of his manners or religion, but I hate disbelief in Islam." The Prophet ﷺ asked, "Would you give back his garden to him?" She replied, "Yes." The Prophet ﷺ said, "O Thabit, accept the garden and divorce her with a single divorce."
امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ جَاءَتْ إِلَى النَّبِيِّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ وَاللهِ مَا أَعْتِبُ عَلَى ثَابِتٍ فِي خُلُقٍ وَلَا دِينٍ وَلَكِنْ أَكْرَهُ الْكُفْرَ فِي الْإِسْلَامِ فَقَالَ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ قَالَتْ نَعَمْ قَالَ يَا ثَابِتُ اقْبَلِ الْحَدِيقَةَ وَطَلِّقْهَا تَطْلِيقَةً
[Machine] A woman named Thabit ibn Qays ibn Shimas came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I do not find fault in Thabit's religion or character except that I fear disbelief in Islam." He asked her, "Do you return his garden to him?" She said, "Yes." So he commanded her to return it to him and they parted ways.
امْرَأَةُ ثَابِتِ بْنِ قَيْسِ بْنِ شِمَاسٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ مَا أَنْقِمُ عَلَى ثَابِتٍ فِي دِينٍ وَلَا خُلُقٍ غَيْرَ أَنِّي أَخَافُ الْكُفْرَ فِي الْإِسْلَامِ فَقَالَ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ؟ قَالَتْ نَعَمْ فَأَمَرَهَا أَنْ تَرُدَّ عَلَيْهِ فَفَرَّقَ بَيْنَهُمَا
[Machine] Jameelat, the daughter of Al-Salul, came to the Prophet ﷺ seeking a divorce. He asked her, "What is your reason?" She replied, "A garden." He then told her to give him back his garden.
جَمِيلَةَ بِنْتَ السَّلُولِ أَتَتِ النَّبِيَّ ﷺ تُرِيدُ الْخُلْعَ فَقَالَ لَهَا مَا أَصْدَقَكِ؟ قَالَتْ حَدِيقَةً قَالَ فَرُدِّي عَلَيْهِ حَدِيقَتَهُ
[Machine] Jameela bint As-Salul came to the Prophet ﷺ and said, "By my father, are you and my mother to blame Thabit ibn Qays ibn Shimas for his character and religion? However, I cannot stand his dislike and I hate disbelief in Islam." The Prophet ﷺ said, "Do you reject his wealth? She replied, "Yes." So the Messenger of Allah ﷺ ordered him to take what was brought to her and not to increase it."
أَنَّ جَمِيلَةَ بِنْتَ السَّلُولِ أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ بِأَبِي أَنْتَ وَأُمِّي مَا أَعْتِبُ عَلَى ثَابِتِ بْنِ قَيْسِ بْنِ شِمَاسٍ فِي خُلُقٍ وَلَا دِينٍ وَلَكِنِّي لَا أُطِيقُهُ بُغْضًا وَأَكْرَهُ الْكُفْرَ فِي الْإِسْلَامِ فَقَالَ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ؟ قَالَتْ نَعَمْ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَأْخُذَ مِنْهَا مَا سَاقَ إِلَيْهَا وَلَا يَزْدَادُ كَذَا
[Machine] "That a woman came to the Prophet ﷺ complaining about her husband. He said, 'Would you return his garden?' She said yes, and more. He said, 'As for the surplus, no.'"
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ تَشْكُو زَوْجَهَا فَقَالَ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ؟ قَالَتْ نَعَمْ وَزِيَادَةً قَالَ أَمَّا الزِّيَادَةُ فَلَا
[Machine] A woman came to the Prophet ﷺ and said, "O Messenger of Allah, I dislike my husband and I desire to separate from him." He asked her, "Do you return the garden that he granted you as a dowry?" She replied, "Yes, and in addition to that." The Prophet ﷺ said, "Regarding the additional part, I cannot grant it. As for the garden, do you return it?" She replied, "Yes." The Prophet ﷺ then issued a judgment in favor of the man. News of the Prophet's ﷺ judgment reached the man, and he said, "I accept the judgment of the Messenger of Allah ﷺ ." And so it was.
أَتَتِ امْرَأَةٌ النَّبِيَّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي أُبْغِضُ زَوْجِي وَأُحِبُّ فِرَاقَهُ فَقَالَ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ الَّتِي أَصْدَقَكِ؟ قَالَ وَكَانَ أَصْدَقَهَا حَدِيقَةً قَالَتْ نَعَمْ وَزِيَادَةً قَالَ النَّبِيُّ ﷺ أَمَّا الزِّيَادَةُ مِنْ مَالِكِ فَلَا وَلَكِنِ الْحَدِيقَةُ قَالَتْ نَعَمْ فَقَضَى بِذَلِكَ النَّبِيُّ ﷺ عَلَى الرَّجُلِ فَأُخْبِرَ بِقَضَاءِ النَّبِيِّ ﷺ فَقَالَ قَدْ قَبِلْتُ قَضَاءَ رَسُولِ اللهِ ﷺ وَكَذَلِكَ
[Machine] He ﷺ said: "The one who divorces his wife should not take back from her more than what he had given her, and likewise."
ﷺ قَالَ لَا يَأْخُذُ مِنَ الْمُخْتَلِعَةِ أَكْثَرَ مِمَّا أَعْطَاهَا وَكَذَلِكَ
[Machine] The Prophet ﷺ asked her, "Do you return his garden that he gave you?" She replied, "Yes, and with an increase." So the Prophet ﷺ said, "As for the increase, no, but his garden?" She replied, "Yes." He took it from her and left her path. When Thabit ibn Qays ibn Shimas heard of this, he said, "I have accepted the decree of the Messenger of Allah ﷺ ." Abu Zubayr heard it from more than one person, and this is also relayed.
النَّبِيُّ ﷺ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ الَّتِي أَعْطَاكِ؟ قَالَتْ نَعَمْ وَزِيَادَةً فَقَالَ النَّبِيُّ ﷺ أَمَّا الزِّيَادَةُ فَلَا وَلَكِنْ حَدِيقَتَهُ فَقَالَتْ نَعَمْ فَأَخَذَهَا لَهُ وَخَلَّى سَبِيلَهَا فَلَمَّا بَلَغَ ذَلِكَ ثَابِتَ بْنَ قَيْسِ بْنِ شِمَاسٍ ؓ قَالَ قَدْ قَبِلْتُ قَضَاءَ رَسُولِ اللهِ ﷺ سَمِعَهُ أَبُو الزُّبَيْرِ مِنْ غَيْرِ وَاحِدٍ وَهَذَا أَيْضًا مُرْسَلٌ
[Machine] She asked for divorce from her husband, so she went to the Prophet ﷺ with her husband and mentioned it to him. The Messenger of Allah ﷺ asked her, "Do you want him to give you back your garden and divorce you?" She replied, "Yes, and I want more." He asked her again, "Do you want him to give you back your garden and divorce you?" She replied, "Yes, and I want more." He asked her for the third time, and she replied, "Yes, and I want more." So he granted her the divorce and she returned his garden to him, adding even more to it. And that was the case.
أَنْ تَخْتَلِعَ مِنْ زَوْجِهَا فَأَتَتِ النَّبِيَّ ﷺ مَعَ زَوْجِهَا فَذَكَرَتْ لَهُ ذَلِكَ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ تَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ وَيُطَلِّقُكِ؟ قَالَتْ نَعَمْ وَأَزِيدُهُ فَقَالَ لَهَا الثَّانِيَةَ تَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ وَيُطَلِّقُكِ؟ قَالَتْ نَعَمْ وَأَزِيدُهُ فَقَالَ لَهَا الثَّالِثَةَ قَالَتْ نَعَمْ وَأَزِيدُهُ فَخَلَعَهَا فَرَدَّتْ عَلَيْهِ حَدِيقَتَهُ وَزَادَتْهُ وَكَذَلِكَ
[Machine] In the dressing room, she takes off what is below her head.
فِي الْمُخْتَلِعَةِ تَخْتَلِعُ بِمَا دُونَ عِقَاصِ رَأْسِهَا
[Machine] "Take off her veil, even if it is just from her ears."
عُمَرُ ؓ أَخْلَعُهَا وَلَوْ مِنْ قُرْطِهَا
[Machine] Your husband divorced you by selling you and 'Umar approved it.
بَاعَكِ زَوْجُكِ طَلَاقًا بَيْعًا وَأَجَازَهُ عُمَرُ
[Machine] Umar ibn al-Khattab said, "When women seek divorce (khul'), do not hold it against them."
قَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ إِذَا أَرَادَ النِّسَاءُ الْخُلْعَ فَلَا تُكَفِّرُوهُنَّ
[Machine] "Abdullah bin Umar did not deny her anything from his wealth."
مِنْ زَوْجِهَا بِكُلِّ شَيْءٍ لَهَا فَلَمْ يُنْكِرْ ذَلِكَ عَبْدُ اللهِ بْنُ عُمَرَ ؓ
[Machine] "And he borrowed from me on behalf of Uthman. When we approached him, he said: 'O Amir al-Muminin, do you have the conditions?' I said: 'Yes.' So take all of its belongings, even its handles.' She said: 'So I set off and gave him everything until there was only the door left between me and him.'"
وَأَنَّهُ اسْتَأْدَانِي عَلَى عُثْمَانَ ؓ فَلَمَّا دَنَوْنَا مِنْهُ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ الشَّرْطُ أَمْلَكُ قَالَ أَجَلْ فَخُذْ مِنْهَا مَتَاعَهَا كُلَّهُ حَتَّى عِقَاصَهَا قَالَتْ فَانْطَلَقْتُ فَدَفَعْتُ إِلَيْهِ كُلَّ شَيْءٍ حَتَّى أَجَفْتُ بَيْنِي وَبَيْنَهُ الْبَابَ
