42. Annulment and Divorce
٤٢۔ كِتَابُ الْخُلْعِ وَالطَّلَاقِ
[Machine] Rukana ibn Abd Yazid divorced his wife, Suhayma al-Muzaniyya al-Batta, and then went to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have divorced my wife, Suhayma al-Batta, and by Allah, I only intended to divorce her once." The Messenger of Allah ﷺ said to Rukana, "By Allah, did you not intend to divorce her only once?" Rukana said, "By Allah, I only intended to divorce her once." So the Messenger of Allah ﷺ returned her to him, and then he divorced her a second time during the time of Umar, and a third time during the time of Uthman. This hadith was narrated by Abdullah ibn Zubair from Muhammad ibn Idris, who was narrated by Muhammad ibn Ali, who was narrated by Ibn Sa'ib, who was narrated by Nafi' ibn Ujayr, who narrated from Rukana ibn Abd Yazid, who narrated from the Prophet ﷺ. And likewise.
أَنَّ رُكَانَةَ بْنَ عَبْدِ يَزِيدَ طَلَّقَ امْرَأَتَهُ سُهَيْمَةَ الْمُزَنِيَّةَ الْبَتَّةَ ثُمَّ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي طَلَّقْتُ امْرَأَتِي سُهَيْمَةَ الْبَتَّةَ وَاللهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً فَقَالَ رَسُولُ اللهِ ﷺ لِرُكَانَةَ وَاللهِ مَا أَرَدْتَ إِلَّا وَاحِدَةً؟ فَقَالَ رُكَانَةُ وَاللهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً فَرَدَّهَا إِلَيْهِ رَسُولُ اللهِ ﷺ فَطَلَّقَهَا الثَّانِيَةَ فِي زَمَنِ عُمَرَ ؓ وَالثَّالِثَةَ فِي زَمَنِ عُثْمَانَ ؓ 14999 أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ نا أَبُو دَاوُدَ نا مُحَمَّدُ بْنُ يُونُسَ النَّسَائِيُّ أَنَّ عَبْدَ اللهِ بْنَ الزُّبَيْرِ حَدَّثَهُمْ عَنْ مُحَمَّدِ بْنِ إِدْرِيسَ حَدَّثَنِي مُحَمَّدُ بْنُ عَلِيٍّ عَنِ ابْنِ السَّائِبِ عَنْ نَافِعِ بْنِ عُجَيْرٍ عَنْ رُكَانَةَ بْنِ عَبْدِ يَزِيدَ عَنِ النَّبِيِّ ﷺ بِهَذَا الْحَدِيثِ وَكَذَلِكَ
[Machine] It is called Suhaima, so I divorced her immediately. Then I came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I divorced my wife Suhaima Al-Batta'ah, and by Allah, I only wanted one divorce." He said, "By Allah, did you only want one divorce?" I said, "By Allah, I only wanted one divorce." So he returned her to me on the condition of one divorce. Abdullah ibn Ali ibn Al-Sa'ib, and Abdullah ibn Ali ibn Al-Awwal, who is the son of Rukana ibn Abdul Yazid.
يُقَالُ لَهَا سُهَيْمَةُ فَطَلَّقْتُهَا الْبَتَّةَ فَجِئْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي طَلَّقْتُ امْرَأَتِي سُهَيْمَةَ الْبَتَّةَ وَاللهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً فَقَالَ وَاللهِ مَا أَرَدْتَ إِلَّا وَاحِدَةً؟ قُلْتُ وَاللهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً فَرَدَّهَا عَلَيَّ عَلَى وَاحِدَةٍ عَبْدُ اللهِ بْنُ عَلِيٍّ الثَّانِي هُوَ عَبْدُ اللهِ بْنُ عَلِيِّ بْنِ السَّائِبِ وَعَبْدُ اللهِ بْنُ عَلِيٍّ الْأَوَّلُ هُوَ ابْنُ رُكَانَةَ بْنِ عَبْدِ يَزِيدَ
[Machine] He divorced his wife Talqah during the time of the Prophet ﷺ , then he came to the Prophet ﷺ and informed him. Then the Prophet ﷺ asked him, "Did you intend to divorce her only once?" He said, "By Allah, yes." The Prophet ﷺ said, "So it is as you intended." And it is like that.
أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ عَلَى عَهْدِ النَّبِيِّ ﷺ فَأَتَى النَّبِيَّ ﷺ فَأَخْبَرَهُ ثُمَّ قَالَ مَا نَوَيْتُ بِذَلِكَ إِلَّا وَاحِدَةً قَالَ آللَّهِ؟ قَالَ آللَّهِ قَالَ فَهُوَ عَلَى مَا أَرَدْتَ وَكَذَلِكَ
What did you intend? He said: A single utterance of divorce. He said: Do you swear by Allah? He replied: I swear by Allah. He said: It stands as you intended. Abu Dawud said: This tradition is sounder than that of Ibn Juraij that Rukanah divorced his wife by three pronouncements, for they are the members of his family and they are more aware for him. The tradition of Ibn Juraij has been narrated by some children of Abu Rafi' from 'Ikrimah on the authority of Ibn 'Abbas. (Using translation from Abū Dāʾūd 2208)
أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ فَأَتَى النَّبِيَّ ﷺ فَقَالَ مَا أَرَدْتَ بِهَا؟ قَالَ وَاحِدَةً قَالَ آللَّهِ؟ قَالَ آللَّهِ قَالَ هُوَ عَلَى مَا أَرَدْتَ
[Machine] Al-Zuhri, which of the Prophet's wives sought refuge from him? So he said, "Urwa informed me that when Ibn al-Jawn entered upon the Messenger of Allah, ﷺ , and approached her, she said, "I seek refuge in Allah from you." So the Messenger of Allah, ﷺ , said, "You sought refuge with the Great One, the Truth, against your people."
الزُّهْرِيَّ أِيُّ أَزْوَاجِ النَّبِيِّ ﷺ اسْتَعَاذَتْ مِنْهُ؟ فَقَالَ أَخْبَرَنِي عُرْوَةُ عَنْ عَائِشَةَ ؓ أَنَّ ابْنَةَ الْجَوْنِ لَمَّا دَخَلَتْ عَلَى رَسُولِ اللهِ ﷺ فَدَنَا مِنْهَا قَالَتْ أَعُوذُ بِاللهِ مِنْكَ فَقَالَ رَسُولُ اللهِ ﷺ عُذْتِ بِعَظِيمٍ الْحَقِي بِأَهْلِكِ
[Machine] About the Messenger of Allah in the Battle of Tabuk, and he mentioned the narration in its entirety. And the Messenger of Allah came to him and said, "Indeed, the Messenger of Allah orders you to separate from your wife." So I said, "Should I divorce her or what should I do with her?" So he said, "No, rather separate from her and do not approach her." And he sent to my two companions with the same command. So I said to my wife, "Go to your family and stay with them until Allah resolves this matter."
عَنْ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ فَذَكَرَ الْحَدِيثَ بِطُولِهِ وَأَنَّ رَسُولَ رَسُولِ اللهِ ﷺ أَتَاهُ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ يَأْمُرُكَ أَنْ تَعْتَزِلَ امْرَأَتَكَ فَقُلْتُ أُطَلِّقُهَا أَمْ مَاذَا أَفْعَلُ بِهَا؟ فَقَالَ لَا بَلِ اعْتَزِلْهَا فَلَا تَقْرَبَنَّهَا وَأَرْسَلَ إِلَى صَاحِبَيَّ بِمِثْلِ ذَلِكَ فَقُلْتُ لِامْرَأَتِي الْحَقِي بِأَهْلِكِ فَكُونِي عِنْدَهُمْ حَتَّى يَقْضِيَ اللهُ هَذَا الْأَمْرَ
[Machine] "Allah, ﷺ , said to Sawdah bint Zam'ah, 'Prepare yourself.' And he made her divorce once, and he had complete control over her."
اللهِ ﷺ قَالَ لِسَوْدَةَ بِنْتِ زَمْعَةَ ؓ اعْتَدِّي فَجَعَلَهَا تَطْلِيقَةً وَاحِدَةً وَهُوَ أَمْلَكُ بِهَا
[Machine] "He read, 'And if they had done what they were advised, it would have been better for them and stronger in faith.' [Quran 4:66] What led you to that? He said, 'I have indeed done it.' He said, 'Hold on to your wife, for indeed, one woman will cause you to lose 15,008.' And Abu Zakariya informed us, Abu Al-Abbas informed us, I am Ar-Rabi', I am Ash-Shafi'i, I am Sufyan. From Amr ibn Dinār, from Abdullah ibn Abi Salamah, from Sulayman ibn Yasār, that Umar ibn Al-Khattab said to the twin sisters something similar to what he said to Muttalib."
فَقَرَأَ {وَلَوْ أَنَّهُمْ فَعَلُوا مَا يُوعَظُونَ بِهِ لَكَانَ خَيْرًا لَهُمْ وَأَشَدَّ تَثْبِيتًا} [النساء 66] مَا حَمَلَكَ عَلَى ذَلِكَ؟ قَالَ قَدْ فَعَلْتُ قَالَ أَمْسِكْ عَلَيْكَ امْرَأَتَكَ فَإِنَّ الْوَاحِدَةَ تُبِتُّ 15008 وَأَخْبَرَنَا أَبُو زَكَرِيَّا نا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا سُفْيَانُ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ عَبْدِ اللهِ بْنِ أَبِي سَلَمَةَ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَالَ لِلتَّوْأَمَةِ مِثْلَ قَوْلِهِ لِلْمُطَّلِبِ
[Machine] He used to say that in the cell, the wilderness, the rocks, and the desert there is only one and he is the most deserving of it.
أَنَّهُ كَانَ يَقُولُ فِي الْخَلِيَّةِ وَالْبَرِيَّةِ وَالْبَتَّةِ وَالْبَائِنَةِ وَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا
[Machine] To his wife: "Tell your guardian to bring you to me during the season." While Umar was circumambulating the Kaaba, he met a man who greeted him and said, "Who are you?" Umar replied, "I am the one you ordered to be brought to you." The man said, "I swear by the Lord of this structure, did you mean divorce by saying, 'Your rope is on your camel?'" The man added, "If you had sworn to me in a different place, I would not have believed you, for I intended to separate." Umar said, "That is what you intended."
لِامْرَأَتِهِ حَبْلُكِ عَلَى غَارِبِكِ فَكَتَبَ عُمَرُ ؓ إِلَى عَامِلِهِ أَنْ مُرْهُ أَنْ يُوَافِيَنِي فِي الْمَوْسِمِ فَبَيْنَمَا عُمَرُ ؓ يَطُوفُ بِالْبَيْتِ إِذْ لَقِيَهُ الرَّجُلُ فَسَلَّمَ عَلَيْهِ فَقَالَ مَنْ أَنْتَ؟ قَالَ أَنَا الَّذِي أَمَرْتَ أَنْ يُجْلَبَ عَلَيْكَ فَقَالَ أَنْشُدُكَ بِرَبِّ هَذِهِ الْبَنِيَّةِ هَلْ أَرَدْتَ بِقَوْلِكَ حَبْلُكِ عَلَى غَارِبِكِ الطَّلَاقَ؟ فَقَالَ الرَّجُلُ لَوِ اسْتَحْلَفْتَنِي فِي غَيْرِ هَذَا الْمَكَانِ مَا صَدَقْتُكَ أَرَدْتُ الْفِرَاقَ فَقَالَ عُمَرُ ؓ هُوَ مَا أَرَدْتَ
[Machine] He has a long white beard and has been with us for the season. The man came to him in the sacred mosque and told him the story. He said, "Do you see that bald man circumambulating the house? Go to him, ask him, then come back and tell me what he said to you." So he went to him and found that it was Ali. He said to him, "Who sent you to me?" He replied, "The commander of the faithful." He said, "He told his wife, 'Your fate lies in your hands.' She said, 'Face the house and swear by Allah that you have no intention of divorcing me.' So he said, 'I swear by Allah, I only wanted divorce.'" So the man said, "Your wife is divorced from you."
لَهُ عُمَرُ ؓ وَافِ مَعَنَا الْمَوْسِمَ فَأَتَاهُ الرَّجُلُ فِي الْمَسْجِدِ الْحَرَامِ فَقَصَّ عَلَيْهِ الْقِصَّةَ فَقَالَ تَرَى ذَلِكَ الْأَصْلَعَ يَطُوفُ بِالْبَيْتِ اذْهَبْ إِلَيْهِ فَسَلْهُ ثُمَّ ارْجِعْ فَأَخْبِرْنِي بِمَا رَجَعَ إِلَيْكَ قَالَ فَذَهَبَ إِلَيْهِ فَإِذَا هُوَ عَلِيٌّ ؓ فَقَالَ مَنْ بَعَثَكَ إِلِيَّ؟ فَقَالَ أَمِيرُ الْمُؤْمِنِينَ قَالَ إِنَّهُ قَالَ لِامْرَأَتِهِ حَبْلُكِ عَلَى غَارِبِكِ فَقَالَ اسْتَقْبِلِ الْبَيْتَ وَاحْلِفْ بِاللهِ مَا أَرَدْتَ طَلَاقًا فَقَالَ الرَّجُلُ وَأَنَا أَحْلِفُ بِاللهِ مَا أَرَدْتُ إِلَّا الطَّلَاقَ فَقَالَ بَانَتْ مِنْكَ امْرَأَتُكَ
[Machine] I wanted to initiate divorce every time, so he separated between them and Allah knows best. Al-Shafi'i, may Allah have mercy on him, said in his book Al-Qadim, and Ibn Jurayj mentioned from Ata that Umar ibn al-Khattab lifted a man to him who said to his wife, "Your rope is on your camel." Ali said to him, "Look between them," and he mentioned the meaning of what we have narrated, except that he said, "Ali completed it three times," and it was mentioned by Sa'eed from Qatadah from Al-Hasan from Ali, and the sheikh, may Allah have mercy on him, said, "This does not contradict the narration of Malik, and it is as if Umar made it one, as he said in al-Batta, and Ali made it three, and Allah knows best. It is possible that both of them made it three to repeat the wording in the entry of three divorces, and his intention each time was to initiate divorce, as we said in the narration of Mansur from Ata, and Allah knows best.
أَرَدْتُ بِكُلِّ مَرَّةٍ إِحْدَاثَ طَلَاقٍ فَفَرَّقَ بَيْنَهُمَا وَاللهُ أَعْلَمُ 15013 قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي كِتَابِ الْقَدِيمِ وَذَكَرَ ابْنُ جُرَيْجٍ عَنْ عَطَاءٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ رُفِعَ إِلَيْهِ رَجُلٌ قَالَ لِامْرَأَتِهِ حَبْلُكِ عَلَى غَارِبِكِ فَقَالَ لِعَلِيٍّ ؓ انْظُرْ بَيْنَهُمَا فَذَكَرَ مَعْنَى مَا رَوَيْنَا إِلَّا أَنَّهُ قَالَ فَأَمْضَاهُ عَلِيٌّ ؓ ثَلَاثًا قَالَ وَذُكِرَ عَنْ سَعِيدٍ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ عَلِيٍّ ؓ مِثْلُهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَهَذَا لَا يُخَالِفُ رِوَايَةَ مَالِكٍ وَكَأَنَّ عُمَرَ ؓ جَعَلَهَا وَاحِدَةً كَمَا قَالَ فِي الْبَتَّةِ وَعَلِيٌّ ؓ جَعَلَهَا ثَلَاثًا وَاللهُ أَعْلَمُ وَيُحْتَمَلُ أَنَّهُمَا جَمِيعًا جَعَلَاهَا ثَلَاثًا لِتَكْرِيرِهِ اللَّفْظَ فِي الْمَدْخُولِ بِهَا ثَلَاثًا وَإِرَادَتِهِ بِكُلِّ مَرَّةٍ إِحْدَاثَ طَلَاقٍ كَمَا قُلْنَا فِي رِوَايَةِ مَنْصُورٍ عَنْ عَطَاءٍ وَاللهُ أَعْلَمُ
[Machine] "And regarding Ata's statement, 'a cell and you are free from me, a pure woman and you are innocent from me, apparent and you are a daughter of mine,' it means that he acknowledges his responsibility for her. Likewise, Amr ibn Dinar has mentioned the same."
وَعَنْ عَطَاءٍ فِي قَوْلِهِ خَلِيَّةٌ وَخَلَوْتِ مِنِّي وَبَرِيَّةٌ وَبَرِئْتِ مِنِّي وَبَائِنَةٌ وَبِنْتِ مِنِّي أَنَّهُ يَدِينُ فِيهَا وَكَذَلِكَ عَنْ عَمْرِو بْنِ دِينَارٍ
[Machine] About Masrooq, Ibrahim, and others, they only meant that if one speaks about something resembling divorce.
عَنْ مَسْرُوقٍ وَإِبْرَاهِيمَ وَغَيْرِهِمَا وَإِنَّمَا أَرَادُوا بِذَلِكَ إِذَا تَكَلَّمَ بِمَا يُشْبِهُ الطَّلَاقَ
