42. Annulment and Divorce
٤٢۔ كِتَابُ الْخُلْعِ وَالطَّلَاقِ
[Machine] The messenger of Allah ﷺ said, "There is no divorce before marriage."
قَالَ رَسُولُ اللهِ ﷺ لَا طَلَاقَ قَبْلَ النِّكَاحِ
[Machine] On the authority of the Prophet ﷺ , he said: "There is no divorce in that which one does not possess, nor manumission except from what one possesses." This is the wording of the hadith narrated by Hisham. And in the narration of Ibn Abi Arooba, he said: "There is no divorce for a man in that which he does not possess, nor sale in that which he does not possess, nor manumission in that which he does not possess."
عَنِ النَّبِيِّ ﷺ قَالَ لَا طَلَاقَ فِيمَا لَا يَمْلِكُ وَلَا عِتْقَ إِلَّا فِيمَا يَمْلِكُ هَذَا لَفْظُ حَدِيثِ هِشَامٍ وَفِي رِوَايَةِ ابْنِ أَبِي عَرُوبَةَ قَالَ لَيْسَ عَلَى الرَّجُلِ طَلَاقٌ فِيمَا لَا يَمْلِكُ وَلَا بَيْعٌ فِيمَا لَا يَمْلِكُ وَلَا عِتْقٌ فِيمَا لَا يَمْلِكُ
[Machine] The Messenger of Allah ﷺ said, "There is no divorce except after marriage, and there is no emancipation except after ownership."
رَسُولَ اللهِ ﷺ قَالَ لَا طَلَاقَ إِلَّا بَعْدَ نِكَاحٍ وَلَا عِتْقَ إِلَّا بَعْدَ مِلْكٍ
"There is no divorce before marriage, and no manumission before taking possession." (Using translation from Ibn Mājah 2048)
لَا طَلَاقَ قَبْلَ النِّكَاحِ وَلَا عِتْقَ قَبْلَ مِلْكٍ
[Machine] I heard the Prophet ﷺ say, "There is no divorce for one who does not possess (wealth) and no emancipation for one who does not possess (wealth)." It was narrated to us by Abu Abdullah Al-Hafiz, from Abu Al-Abbas Muhammad Ibn Ya'qub, from Muhammad Ibn Sinan Al-Qazzaz, from Abu Bakr Al-Hanafi, from Ibn Abi Dhi'b, who mentioned it. Abu Dawood At-Tayalisi went against it and reported it differently.
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ لَا طَلَاقَ لِمَنْ لَمْ يَمْلِكُ وَلَا عِتْقَ لِمَنْ لَمْ يَمْلِكُ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا مُحَمَّدُ بْنُ سِنَانٍ الْقَزَّازُ نا أَبُو بَكْرٍ الْحَنَفِيُّ نا ابْنُ أَبِي ذِئْبٍ فَذَكَرَهُ وَخَالَفَهُ أَبُو دَاوُدَ الطَّيَالِسِيُّ فَرَوَاهُ
[Machine] The Messenger of Allah ﷺ said, "There is no divorce for the one who does not have ownership, and there is no emancipation for the one who does not have ownership." It was also narrated by someone other than him, from Muhammad ibn al-Munkadir, from Jabir.
قَالَ رَسُولُ اللهِ ﷺ لَا طَلَاقَ لِمَنْ لَمْ يَمْلِكُ وَلَا عِتَاقَ لِمَنْ لَمْ يَمْلِكُ وَرَوَاهُ غَيْرُهُ أَيْضًا عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ عَنْ جَابِرٍ
[Machine] I and indeed the Messenger of Allah ﷺ informed me that Jabir ibn Abdullah al-Ansari heard the Messenger of Allah ﷺ saying, "There is no divorce for those who do not possess wealth, nor is there manumission for those who do not possess wealth." And it was narrated from another source, apart from Jabir.
أَنَا وَلَكِنْ رَسُولُ اللهِ ﷺ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ ؓ أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لَا طَلَاقَ لِمَنْ لَا يَمْلِكُ وَلَا عِتْقَ لِمَنْ لَا يَمْلِكُ وَرُوِيَ ذَلِكَ مِنْ وَجْهٍ آخَرَ عَنْ جَابِرٍ ؓ
[Machine] The Messenger of Allah ﷺ said: There is no divorce before marriage, no manumission before possession, no breastfeeding after weaning, no association after separation, no fasting for a full day until the night.
قَالَ رَسُولُ اللهِ ﷺ لَا طَلَاقَ قَبْلَ النِّكَاحِ وَلَا عِتْقَ قَبْلَ مِلْكٍ وَلَا رَضَاعَ بَعْدَ فِصَالٍ وَلَا وِصَالَ وَلَا صَمْتَ يَوْمٍ إِلَى اللَّيْلِ
[Machine] The Messenger of Allah ﷺ said that there is no breastfeeding after weaning, no completion after ejaculation, no emancipation except after ownership, no divorce except after marriage, and the narration mentions.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا رَضَاعَ بَعْدَ فِصَالٍ وَلَا يُتْمَ بَعْدَ احْتِلَامٍ وَلَا عِتْقَ إِلَّا بَعْدَ مِلْكٍ وَلَا طَلَاقَ إِلَّا بَعْدَ نِكَاحٍ وَذَكَرَ الْحَدِيثَ
[Machine] "There is no divorce except after marriage, and there is no freeing of a slave except after possession, and likewise."
ﷺ لَا طَلَاقَ إِلَّا بَعْدَ نِكَاحٍ وَلَا عِتْقَ إِلَّا بَعْدَ مِلْكٍ وَكَذَلِكَ
[Machine] Ali said, "Marry her, and there is nothing upon you."
قَالَ عَلِيٌّ ؓ تَزَوَّجْهَا فَلَا شَيْءَ عَلَيْكَ
لَا طَلَاقَ إِلَّا بَعْدَ نِكَاحٍ
[Machine] There is no divorce except after marriage, and there is no emancipation except after ownership.
لَا طَلَاقَ إِلَّا مِنْ بَعْدِ نِكَاحٍ وَلَا عَتَاقَ إِلَّا مِنْ بَعْدِ مِلْكٍ
إِنَّمَا الطَّلَاقُ مِنْ بَعْدِ النِّكَاحِ
[Machine] "O you who have believed, when you marry believing women and then divorce them before you have touched them..." [Al-Ahzab 49]. And He did not say when you divorce the believing women then marry them again.
اللهُ تَبَارَكَ وَتَعَالَى {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ} [الأحزاب 49] وَلَمْ يَقُلْ إِذَا طَلَّقْتُمُ الْمُؤْمِنَاتِ ثُمَّ نَكَحْتُمُوهُنَّ
[Machine] There is no divorce except after marriage, as mentioned in this narration, which is reported with this chain of narrators as being elevated (meaning authentic and trustworthy). It is also reported from Bashar ibn al-Sarayy from Hisham ibn Saad from Az-Zuhri from Urwah from the Prophet ﷺ as being directly transmitted.
لَا طَلَاقَ إِلَّا بَعْدَ نِكَاحٍ كَذَا أُتِيَ بِهِ مَوْقُوفًا وَقَدْ رُوِيَ بِهَذَا الْإِسْنَادِ مَرْفُوعًا وَرُوِيَ عَنْ بِشْرِ بْنِ السَّرِيِّ عَنْ هِشَامِ بْنِ سَعْدٍ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنِ النَّبِيِّ ﷺ مُرْسَلًا
[Machine] The boy is divorced if I were to marry her until I eat the entire date pit, and the date pit is the male date palm fruit. Then they regretted what had happened, so Al-Mundhir said, "I will come to you with an explanation of that." So I went to Sa'id ibn al-Musayyib and said to him: "A man from my family proposed to his cousin, and they disagreed about some matter." He said: "She is divorced if he marries her until he eats the entire date pit." Ibn al-Musayyib said: "He has no obligation if he divorces what he does not possess." Then I asked 'Urwah ibn Zubayr about that, and he said: "He has no obligation if he divorces what he does not possess." Then I asked Abu Salamah ibn 'Abd al-Rahman, and he said: "He has no obligation if he divorces what he does not possess." Then I asked Abu Bakr ibn 'Abd al-Rahman ibn al-Harith ibn Hisham about it, and he said: "He has no obligation if he divorces what he does not possess." Then I asked 'Ubaydullah ibn 'Abdullah ibn 'Utbah ibn Mas'ud about it, and he said: "He has no obligation if he divorces what he does not possess." Then I asked 'Umar ibn 'Abd al-'Aziz, and he said: "Did you ask anyone else?" I said: "Yes." So he named them and said: "Then I returned to the people and told them what I had asked about."
الْفَتَى هِيَ طَالِقٌ إِنْ نَكَحْتُهَا حَتَّى آكُلَ الْغَضِيضَ وَالْغَضِيضُ طَلْعُ النَّخْلِ الذَّكَرِ ثُمَّ نَدِمُوا عَلَى مَا كَانَ مِنَ الْأَمْرِ فَقَالَ الْمُنْذِرُ أَنَا آتِيكُمْ مِنْ ذَلِكَ بِالْبَيَانِ قَالَ فَانْطَلَقْتُ إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ فَقُلْتُ لَهُ إِنَّ رَجُلًا مِنْ أَهْلِي خَطَبَ ابْنَةَ عَمٍّ لَهُ فَشَجَرَ بَيْنَهُمْ بَعْضُ الْأَمْرِ فَقَالَ هِيَ طَالِقٌ إِنْ نَكَحْتُهَا حَتَّى آكُلَ الْغَضِيضَ قَالَ ابْنُ الْمُسَيِّبِ لَيْسَ عَلَيْهِ شَيْءٌ طَلَّقَ مَا لَا يَمْلِكُ ثُمَّ إِنِّي سَأَلْتُ عُرْوَةَ بْنَ الزُّبَيْرِ عَنْ ذَلِكَ فَقَالَ لَيْسَ عَلَيْهِ شَيْءٌ طَلَّقَ مَا لَا يَمْلِكُ ثُمَّ سَأَلْتُ أَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ فَقَالَ لَيْسَ عَلَيْهِ شَيْءٌ طَلَّقَ مَا لَا يَمْلِكُ ثُمَّ سَأَلْتُ أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ عَنْ ذَلِكَ فَقَالَ لَيْسَ عَلَيْهِ شَيْءٌ طَلَّقَ مَا لَمْ يَمْلِكُ ثُمَّ سَأَلْتُ عُبَيْدَ اللهِ بْنَ عَبْدِ اللهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ عَنْ ذَلِكَ فَقَالَ لَيْسَ عَلَيْهِ شَيْءٌ طَلَّقَ مَا لَا يَمْلِكُ ثُمَّ سَأَلْتُ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ فَقَالَ هَلْ سَأَلْتَ أَحَدًا قَالَ قُلْتُ نَعَمْ فَسَمَّاهُمْ قَالَ ثُمَّ رَجَعْتُ إِلَى الْقَوْمِ فَأَخْبَرْتُهُمْ بِمَا سَأَلْتُ عَنْهُ
[Machine] A fisherman came forward, saying, "Indeed, marriage is a contract that is made, and divorce is what dissolves it. But how can an unresolved contract be settled before it is made?" So Al-Walid was amazed by what he said, accepted it, and wrote to his employee in Yemen to use it in resolving disputes.
سِمَاكٌ مِنْ عِنْدِهِ إِنَّمَا النِّكَاحُ عُقْدَةٌ تُعْقَدُ وَالطَّلَاقُ يَحُلُّهَا وَكَيْفَ تُحَلُّ عُقْدَةٌ قَبْلَ أَنْ تُعْقَدُ؟ فَأُعْجِبَ الْوَلِيدُ مِنْ قَوْلِهِ وَأَخَذَ بِهِ وَكَتَبَ إِلَى عَامِلِهِ بِالْيَمَنِ أَنْ يَسْتَعْمِلَهُ عَلَى الْقَضَاءِ
[Machine] And Sa'id ibn al-Musayyib said, "Oh, son of my brother, can there be a flood before rain?"
وَقَالَ سَعِيدُ بْنُ الْمُسَيِّبِ يَا ابْنَ أَخِي أَيَكُونُ سَيْلٌ قَبْلَ مَطَرٍ
