البيهقي:١٤٩٣٨ – أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ أنا أَبُو عُبَيْدٍ الْقَاسِمُ بْنُ إِسْمَاعِيلَ نا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ زَنْجُوَيْهِ نا نُعَيْمُ بْنُ حَمَّادٍ عَنِ ابْنِ الْمُبَارَكِ عَنْ مُحَمَّدِ بْنِ رَاشِدٍ نا سَلَمَةُ بْنُ أَبِي سَلَمَةَ عَنْ أَبِيهِ أَنَّهُ ذُكِرَ عِنْدَهُ أَنَّ الطَّلَاقَ الثَّلَاثَ بِمَرَّةٍ مَكْرُوهٌ فَقَالَ طَلَّقَ حَفْصُ بْنُ عَمْرِو بْنِ الْمُغِيرَةِ فَاطِمَةَ بِنْتَ قَيْسٍ بِكَلِمَةٍ وَاحِدَةٍ ثَلَاثًا فَلَمْ يَبْلُغْنَا أَنَّ النَّبِيَّ

ﷺ عَابَ ذَلِكَ عَلَيْهِ وَطَلَّقَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ امْرَأَتَهُ ثَلَاثًا فَلَمْ يَعِبْ ذَلِكَ عَلَيْهِ أَحَدٌ وَكَذَلِكَ  

رَوَاهُ شَيْبَانُ بْنُ فَرُّوخَ عَنْ مُحَمَّدِ بْنِ رَاشِدٍ وَاحْتَجَّ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي ذَلِكَ أَيْضًا بِمَا رَوَاهُ بِإِسْنَادِهِ عَنِ ابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ وَعَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ ؓ فِيمَنْ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا لَا يَنْكِحُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ قَالَ وَمَا عَابَ ابْنُ عَبَّاسٍ وَلَا أَبُو هُرَيْرَةَ عَلَيْهِ أَنْ يُطَلِّقَ ثَلَاثًا وَلَمْ يَقُلْ لَهُ عَبْدُ اللهِ بْنُ عَمْرٍو بِئْسَ مَا صَنَعْتَ حِينَ طَلَّقْتَ ثَلَاثًا قَالَ الشَّيْخُ وَتِلْكَ الْآثَارُ تَرِدُ بَعْدَ هَذَا إِنْ شَاءَ اللهُ
