The Prophet ﷺ said: I am nearer to every believer than himself, so if anyone leaves a debt or a helpless family, I shall be responsible, but if anyone leaves property, it goes to his heirs. I am patron of him who has none, inheriting his property and freeing him from his liabilities. A maternal uncle is patron of him who has none, inheriting his property and freeing him from his liabilities. Abu Dawud said: da'iah means dependants or helpless family. Abu Dawud said: This tradition has been transmitted by al-Zubaidi from Rashid b. Sa'd from Ibn 'A'idh on the authority of al-Miqdam. It has also been transmitted by Mu'awiyah b. Salih from Rashid who said: I heard al-Miqdam (say).

قَالَ رَسُولُ اللَّهِ ﷺ أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَىَّ وَمَنْ تَرَكَ مَالاً فَلِوَرَثَتِهِ وَأَنَا مَوْلَى مَنْ لاَ مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ وَالْخَالُ مَوْلَى مَنْ لاَ مَوْلَى لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ

I heard the Messenger of Allah ﷺ say: I am the heirs of Him who has none, freeing him from his liabilities, and inheriting what he possesses. A maternal uncle is the heir of Him who has none, freeing him from his liabilities, and inheriting his property.

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ أَنَا وَارِثُ مَنْ لاَ وَارِثَ لَهُ أَفُكُّ عَانِيَهُ وَأَرِثُ مَالَهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ يَفُكُّ عَانِيَهُ وَيَرِثُ مَالَهُ

"'Umar bin Al-Khattab sent me with a letter to Abu'Ubaidah (saying) that The Messenger of Allah ﷺ said : 'Allah and His Messenger are responsible for the one who has no patron. And the maternal uncle inherits from the one who has no heirs.'"

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لاَ مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ

“I am the heir of the one who has no heir, and I will pay blood money on his behalf and inherit from him, and the maternal uncle is the heir of the one who has no heir; he pays the blood money on his behalf and inherits from him.'”

قَالَ رَسُولُ اللَّهِ ﷺ أَنَا وَارِثُ مَنْ لاَ وَارِثَ لَهُ أَعْقِلُ عَنْهُ وَأَرِثُهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ

“Allah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of one who has no other heir.”

أَنَّ النَّبِيَّ ﷺ قَالَ اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لاَ مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ

ʿAllah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir.”

أَنَّ النَّبِيَّ ﷺ قَالَ اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ

The Prophet ﷺ said: If anyone leaves a debt or a helpless family I shall be responsible-and sometimes the narrator said: Allah and His Apostle will be responsible-but if anyone leaves property, it goes to his heirs. I am the heirs of him who has none, paying blood-wit for him and inheriting from him; and a maternal uncle is the heir of him who has none, paying blood-wit for him and inheriting from him. عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ مَنْ تَرَكَ كَلًّا فَإِلَى اللهِ وَرَسُولِهِ وَرُبَّمَا قَالَ فَإِلَيْنَا وَمَنْ تَرَكَ مَالًا فَلِوَارِثِهِ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ وَأَنَا وَارِثُ مَنْ لَاوَارِثَ لَهُ أَرِثُهُ وَأَعْقِلُ عَنْهُ

[Machine] On the authority of the Prophet ﷺ , he said: "Whoever leaves behind wealth, it belongs to his heirs. And whoever leaves behind a debt or loss, it comes to me (to settle), and I am the guardian for the one who has no guardian. Should I overlook him (the debt or loss) and inherit his wealth, if there is a close relative (kinship), they (the relative) are the guardian for the one who has no guardian. They should overlook him (the debt or loss) and inherit his wealth."

عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَيَّ وَأَنَا وَلِيُّ مَنْ لَا وَلِيَّ لَهُ أَفُكُّ عَنْهُ وَأَرِثُ مَالَهُ وَالْخَالُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ يَفُكُّ عَنْهُ وَيَرِثُ مَالَهُ

[Machine] The Messenger of Allah ﷺ said: "Whoever leaves behind a debt or an orphan, it is upon me to take care of them. And whoever leaves behind wealth, it is for his heirs. And I am the guardian of those who have no guardian. I will inherit their wealth and fulfill their responsibilities. And the paternal uncle is the guardian of those who have no guardian. He will inherit their wealth and fulfill their responsibilities."

قَالَ رَسُولُ اللهِ ﷺ مَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَيَّ وَمَنْ تَرَكَ مَالًا فَلِوَارِثِهِ وَأَنَا مَوْلَى مَنْ لَا مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ وَالْخَالُ مَوْلَى مَنْ لَا مَوْلَى لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ

ʿAllah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir.” (Using translation from Aḥmad 189)

«اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ»
