31. Inheritance (1/3)
٣١۔ كِتَابُ الْفَرَائِضِ ص ١
[Machine] The Messenger of Allah ﷺ said, "Learn the Quran and teach it to others, learn knowledge and teach it to others, and learn the religious obligations (Fara'id) and teach them to others. Verily, I am a person who will be taken, and knowledge will decrease until there will be disputes between two individuals regarding a religious obligation, and there will be no judge to settle their dispute."
قَالَ رَسُولُ اللهِ ﷺ «تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ فَإِنِّي امْرُؤٌ مَقْبُوضٌ وَإِنَّ الْعِلْمَ سَيَنْقُصُ حَتَّى يَخْتَلِفَ الِاثْنَانِ فِي الْفَرِيضَةِ فَلَا يَجِدَانِ مَنْ يَفْصِلُ بَيْنَهُمَا»
[Machine] Abdullah bin Mas'ood said: "Indeed, the Messenger of Allah ﷺ said, 'Learn the Quran and teach it to the people, learn and teach the obligations (i.e. religious duties), and learn knowledge and teach it to the people. For indeed, I am taking hold of you, and indeed, knowledge will decrease. And trials will appear until two people will differ in a matter of obligation, and they will not find anyone to judge between them.'"
قَالَ عَبْدُ اللهِ بْنُ مَسْعُودٍ إِنَّ رَسُولَ اللهِ ﷺ قَالَ «تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ فَإِنِّي مَقْبُوضٌ وَإِنَّ الْعِلْمَ سَيَنْقُصُ وَتَظْهَرُ الْفِتَنُ حَتَّى يَخْتَلِفَ الِاثْنَانِ فِي فَرِيضَةٍ لَا يَجِدَانِ إِنْسَانًا يَفْصِلُ بَيْنَهُمَا»
31.2 [Machine] The Inheritance of Prophets' Mentions
٣١۔٢ ذِكْرُ مَوَارِيثِ الْأَنْبِيَاءِ
[Machine] The Messenger of Allah ﷺ said, "We do not inherit what we leave behind, it is a charity." He said to Abdullah bin Rahman, Talha, Saad, and Ali, "I swear by Allah, you know that the Messenger of Allah ﷺ said, 'We do not inherit what we leave behind, it is a charity?' They said, 'Yes.'"
قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» قَالَ وَقَالَ لِعَبْدِ الرَّحْمَنِ وَطَلْحَةَ وَسَعْدٍ وَعَلِيٍّ نَشَدْتُكُمْ بِاللهِ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ؟ قَالُوا نَعَمْ
" We do not have any heirs; what we leave behind is a charitable endowment." (Using translation from Muslim 1761)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» يَعْنِي بِذَلِكَ نَفْسَهُ
[Machine] Umar said to Abdur Rahman, Saad, Uthman, Talha, and Zubair, "I implore you by Allah, before whom the heavens and the earth stand, have you heard the Prophet ﷺ saying, 'We, the prophets, do not leave behind any inheritance. Whatever we leave behind is considered charity'?" They replied, "O Allah, yes."
قَالَ عُمَرُ لِعَبْدِ الرَّحْمَنِ وَسَعْدٍ وَعُثْمَانَ وَطَلْحَةَ وَالزُّبَيْرِ أَنْشُدُكُمْ بِاللهِ الَّذِي قَامَتْ لَهُ السَّمَوَاتُ وَالْأَرْضُ سَمِعْتُمُ النَّبِيَّ ﷺ يَقُولُ «إِنَّا مَعْشَرَ الْأَنْبِيَاءِ لَا نُورَثُ مَا تَرَكْنَا فَهُوَ صَدَقَةٌ»؟ قَالُوا اللهُمَّ نَعَمْ
'Umar sent for me when the day rose high. I found him sitting on a couch without cover. When I entered upon him, he said: Malik, some people of you tribe gradually came here, and I have ordered to give them something, so distribute it among them. I said: If you assigned this (work) to some other person, (it would be better). He said: Take it. Then Yarfa' came to him and said: Commander of the Faithful, will you permit 'Uthman b. 'Affan, 'Abd al-Rahman b. 'Awf, al-Zubair b. al-'Awwam, and Sa'd b, Abi Waqqas (to enter) ? He said: Yes. So he permitted them and they entered. Yarfa' again came to him and said: Commander of the Faithful, would you permit al-'Abbas and 'Ali ? He said: Yes. He then permitted them and they entered. Al-'Abbas said: Commander of Faithful, decide between me and this, referring to 'Ali. Some of them said: Yes, Commander of the Faithful, decide between them and give them comfort. Malik b. Aws said: It occurred to me that both of them brought the other people for this. 'Umar said: Show patience (do not make haste). He then turned towards those people and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that Messenger of Allah ﷺ said: We are not inherited whatever we leave is sadaqah (alms). They said: Yes. He then turned towards 'Ali and al-'Abbas and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that Messenger of Allah ﷺ said: We are not inherited whatever we leave is sadaqah (alms). They said: Yes. He then said: Allah has appointed for the Messenger of Allah ﷺ a special portion (in the booty) which he did not do for anyone. Allah, Most High, said: What Allah has bestowed on His Apostle (and taken away) from them - for this ye made no expedition with either cavalry or camelry. But Allah gives power to His apostles over any He pleases ; and Allah has power over all things". Allah bestowed (the property of) Banu al-Nadir on His Apostle. I swear by Allah, he did not reserve it for himself, nor did he take it over and above you. The Messenger of Allah ﷺ used to his share for his maintenance annually, or used to take his contribution and give his family their annual contribution (from this property), then take what remained and deal with it as he did with Allah's property. He then turned towards those people and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that ? They said: Yes. He then turned towards 'Ali and al-'Abbas and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that ? They said: Yes. When the Messenger of Allah ﷺ died, Abu Bakr said: I am the protector of the Messenger of Allah ﷺ. Then you and this ('Ali) came to Abu Bakr, demanding a share from the inheritance of your cousin, and this ('Ali) demanding the share of his wife from (the property of her) father. Abu Bakr then said: The Messenger of Allah ﷺ said: We are not inherited. Whatever we leave is sadaqah. Allah knows that he (Abu Bakr) was true, faithful, rightly-guided, and the follower of Triuth. Abu Bakr then administered it (property of the Prophet). When Abu Bakr died, I said: I am the protector of the Messenger of Allah ﷺ and Abu Bakr. So I administered whatever Allah wished. Then you and this ('Ali) came. Both of you are at one, and your matter is the same. So they asked me for it (property), and I said: If you wish I give it to you on condition that you are bound by the covenant of Allah, meaning that you will administer it as the Messenger of Allah ﷺ used to administer. So you took it from me on that condition. Then again you have come to me so that I decide between you other than that. I swear by Allah, I shall not decide between you other than that till the Last Hour comes. If you helpless, return it to me. Abu Dawud said: They asked him for making it half between them, and not that they were ignorant of the fact the Prophet ﷺ said: We are not inherited. Whatever we leave is sadaqah (alms). They were also seeking the truth. 'Umar then said: I do not apply the name of division to it ; It leave it on its former condition. (Using translation from Abū Dāʾūd 2963)
حِينَ دَخَلْتُ عَلَيْهِ يَا مَالِكُ إِنَّهُ قَدْ دَقَّ أَهْلُ أَبْيَاتٍ وَقَدْ أَمَرْتُ فِيهِمْ بِرَضْخٍ فَخُذْهُ فَاقْسِمْ بَيْنَهُمْ قُلْتُ لَوْ أَمَرْتَ بِهِ غَيْرِي؟ قَالَ خُذْهُ فَجَاءَ يَرْفَأُ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي عُثْمَانَ وَعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ وَالزُّبَيْرِ بْنِ الْعَوَّامِ وَسَعْدِ بْنِ أَبِي وَقَّاصٍ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمْ فَدَخَلُوا ثُمَّ جَاءَ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي الْعَبَّاسِ وَعَلِيٍّ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمَا فَدَخَلَا فَقَالَ الْعَبَّاسُ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنِي وَبَيْنَ هَذَا يَعْنِي عَلِيًّا فَقَالَ بَعْضُهُمْ أَجَلْ يَا أَمِيرَ الْمُؤْمِنِينَ فَاقْضِ بَيْنَهُمَا وَارْحَمْهُمَا فَقَالَ عُمَرُ أَنْشُدُكُمْ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ؟» قَالُوا نَعَمْ ثُمَّ أَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ فَقَالَ أَنْشُدُكُمَا بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ؟ قَالَا نَعَمْ قَالَ فَإِنَّ اللهَ خَصَّ نَبِيَّهُ ﷺ بِخَاصَّةٍ لَمْ يَخُصَّ بِهَا أَحَدًا مِنَ النَّاسِ فَقَالَ {وَمَا أَفَاءَ اللهُ عَلَى رَسُولِهِ مِنْهُمْ فَمَا أَوْجَفْتُمْ عَلَيْهِ مِنْ خَيْلٍ وَلَا رِكَابٍ وَلَكِنَّ اللهَ يُسَلَّطُ رُسُلَهُ عَلَى مَنْ يَشَاءُ وَاللهُ عَلَى كُلِّ شَيْءٍ قَدِيرٌ} [الحشر 6] فَكَانَ اللهُ أَفَاءَ عَلَى رَسُولِهِ ﷺ بَنِي النَّضِيرِ فَوَاللهِ مَا اسْتَأْثَرَ بِهَا عَلَيْكُمْ وَلَا أَخَذَهَا دُونَكُمْ فَكَانَ رَسُولُ اللهِ ﷺ يَأْخُذُ مِنْهَا نَفَقَةَ سَنَةٍ وَيَجْعَلُ مَا بَقِيَ أُسْوَةَ الْمَالِ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ ذَلِكَ؟ قَالُوا نَعَمْ وَأَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ فَقَالَ أَنْشُدُكُمَا بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمَانِ ذَلِكَ؟ قَالَا نَعَمْ فَلَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ قَالَ أَبُو بَكْرٍ أَنَا وَلِيُّ رَسُولِ اللهِ ﷺ فَجِئْتَ أَنْتَ وَهَذَا إِلَى أَبِي بَكْرٍ فَجِئْتَ أَنْتَ تَطْلُبُ مِيرَاثَكَ مِنِ ابْنِ أَخِيكَ وَيَطْلُبُ هَذَا مِيرَاثَ امْرَأَتِهِ مِنْ أَبِيهَا فَقَالَ أَبُو بَكْرٍ قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» فَوَلِيَهَا أَبُو بَكْرٍ فَلَمَّا تُوُفِّيَ قُلْتُ أَنَا وَلِيُّ رَسُولِ اللهِ ﷺ وَوَلِيُّ أَبِي بَكْرٍ فَوَلِيتُهَا مَا شَاءَ اللهُ أَنْ أَلِيَهَا ثُمَّ جِئْتَ أَنْتَ وَهَذَا وَأَنْتُمَا جَمِيعًا وَأَمْرُكُمَا وَاحِدٌ فَسَأَلْتُمَانِيهَا فَقُلْتُ إِنْ شِئْتُمَا أَدْفَعَهَا إِلَيْكُمَا عَلَى أَنَّ عَلَيْكُمَا عَهْدَ اللهِ لِتَلِيَانَهَا بِالَّذِي كَانَ رَسُولُ اللهِ ﷺ يَلِيهَا بِهِ فَأَخَذْتُمَاهَا مِنِّي عَلَى ذَلِكَ ثُمَّ جِئْتُمَانِي لِأَقْضِيَ بَيْنَكُمَا بِغَيْرِ ذَلِكَ وَاللهِ لَا أَقْضِي بَيْنَكُمَا بِغَيْرِ ذَلِكَ حَتَّى تَقُومَ السَّاعَةُ فَإِنْ عَجَزْتُمَا عَنْهَا فَرُدَّاهَا إِلَيَّ
When the Messenger of Allah ﷺ died, the wives of the Prophet ﷺ intended to send 'Uthman b. 'Affan to Abu Bakr to ask him their cost of living from (the inheritance of) the Prophet ﷺ. Thereupon 'Aishah said: Did not the Messenger of Allah ﷺ say: We are not inherited. Whatever we leave is sadaqah. (Using translation from Abū Dāʾūd 2976)
أَنَّ أَزْوَاجَ النَّبِيِّ ﷺ حِينَ تُوُفِّيَ رَسُولُ اللهِ ﷺ أَرَدْنَ أَنْ يَبْعَثْنَ عُثْمَانَ بْنَ عَفَّانَ إِلَى أَبِي بَكْرٍ؛ يَسْأَلْنَ مِيرَاثَهُنَّ مِنْ رَسُولِ اللهِ ﷺ فَقَالَتْ لَهُنَّ عَائِشَةُ أَلَيْسَ قَدْ قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا فَهُوَ صَدَقَةٌ»
31.3 [Machine] The inheritance of the lone, only child
٣١۔٣ مِيرَاثُ الْوَلَدِ الْوَاحِدِ الْمُنْفَرِدِ
[Machine] A man from the immigrants donated a large piece of land to his mother, but she passed away and he had no other heir except himself. He came to the Prophet ﷺ and said, "My mother was one of the dearest people to me and I honored her. I donated a large piece of land to her, but she passed away and I am her only heir. How should I deal with it?" The Prophet ﷺ said, "Allah has made your reward obligatory and has returned your land to you. So, do with it as you please."
أَنَّ رَجُلًا مِنَ الْمُهَاجِرِينَ تَصَدَّقَ بِأَرْضٍ لَهُ عَظِيمَةٍ عَلَى أُمِّهِ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرُهُ فَأَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ أُمِّي كَانَتْ مِنْ أَحَبِّ النَّاسِ إِلَيَّ وَأَعَزَّهَمْ عَلَيَّ وَإِنِّي تَصَدَّقْتُ عَلَيْهَا بِأَرْضٍ لِي عَظِيمَةٍ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرِي فَكَيْفَ تَأْمُرُنِي أَنْ أَصْنَعَ بِهَا؟ قَالَ قَدْ أَوْجَبَ اللهُ لَكَ أَجْرَكَ وَرَدَّ عَلَيْكَ أَرْضَكَ فَاصْنَعْ بِهَا كَيْفَ شِئْتَ
[Machine] "That he gave charity to his parents, then both of them passed away, so the Messenger of Allah ﷺ returned his share of inheritance to him."
«أَنَّهُ تَصَدَّقَ عَلَى أَبَوَيْهِ ثُمَّ تُوُفِّيَا فَرَدَّهُ رَسُولُ اللهِ ﷺ إِلَيْهِ مِيرَاثًا»
31.4 [Machine] The inheritance of the only daughter alone.
٣١۔٤ مِيرَاثُ الِابْنَةِ الْوَاحِدَةِ الْمُنْفَرِدَةِ
[Machine] "A woman came to the Prophet ﷺ and said, 'I have given charity on behalf of my mother with a young slave girl, but she has passed away. So, she has come to me as an inheritance.' He (the Prophet) said, 'Allah has rewarded you and honored you with inheritance.' Abu Abdullah Al-Rahman said, 'This is incorrect, and the correct wording is Abdullah ibn Buraida.'"
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ فَمَاتَتْ فَرَجَعَتْ إِلَيَّ فِي الْمِيرَاثِ فَقَالَ «قَدْ آجَرَكِ اللهُ وَرَدَّ عَلَيْكِ فِي الْمِيرَاثِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ وَالصَّوَابُ عَبْدُ اللهِ بْنُ بُرَيْدَةَ
“A woman came to-the Prophet ﷺ and said: 'O Messenger of Allah ﷺ, I gave my mother a slave girl of mine, and she has died.' The Messenger of Allah ﷺ said: 'Allah (SWT) has rewarded you, and returned to you your inheritance (without your seeking that.' ” (Using translation from Ibn Mājah 2394)
جَاءَتِ امْرَأَةٌ إِلَى النَّبِيِّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ وَإِنَّهَا مَاتَتْ فَقَالَ رَسُولُ اللهِ ﷺ «آجَرَكِ اللهُ وَرَدَّ عَلَيْكِ الْمِيرَاثَ»
“A woman came to-the Prophet ﷺ and said: 'O Messenger of Allah ﷺ, I gave my mother a slave girl of mine, and she has died.' The Messenger of Allah ﷺ said: 'Allah (SWT) has rewarded you, and returned to you your inheritance (without your seeking that.' ” (Using translation from Ibn Mājah 2394)
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ فَمَاتَتْ فَقَالَ «قَدْ أجَزاَكِ اللهُ وَرَدَّ عَلَيْكِ الْمِيرَاثَ»
Buraidah said A woman came to the Messenger of Allah ﷺ and said I gave a slave girl as sadaqah to my mother who has now died and has left that slave girl. He said your reward is sure and the inheritance has given her back to you. (Using translation from Abū Dāʾūd 1656)
أَنَّ امْرَأَةً أَتَتْ رَسُولَ اللهِ ﷺ فَقَالَتْ إِنِّي كُنْتُ تَصَدَّقْتُ عَلَى أُمِّي بِوَلِيدَةٍ وَإِنَّهَا مَاتَتْ وَتَرَكَتْ تِلْكَ الْوَلِيدَةَ فَقَالَ «وَجَبَ أَجْرُكِ وَرَجَعَتْ إِلَيْكِ فِي الْمِيرَاثِ»
I became seriously ill at Mecca and the Prophet ﷺ came to visit me. I said, "O Messenger of Allah ﷺ! I shall leave behind me a good fortune, but my heir is my only daughter; shall I bequeath two third of my property to be spent in charity and leave one third (for my heir)?" He said, "No." I said, "Shall I bequeath half and leave half?" He said, "No." I said, "Shall I bequeath one third and leave two thirds?" He said, "One third is alright, though even one third is too much." Then he placed his hand on his forehead and passed it over my face and ʿAbdomen and said, "O Allah! Cure Saʿd and complete his emigration." I feel as if I have been feeling the coldness of his hand on my liver ever since. (Using translation from Bukhārī 5659)
قَالَ سَعْدٌ اشْتَكَيْتُ شَكْوَى بِمَكَّةَ فَدَخَلَ عَلَى رَسُولِ اللهِ ﷺ يَعُودُنِي قُلْتُ يَا رَسُولَ اللهِ إِنِّي تَرَكْتُ مَالًا وَلَيْسَ عِنْدِي إِلَّا ابْنَةٌ وَاحِدَةٌ أَفَأَوْصِي بِثُلُثَيْ مَالِي فَأَتْرُكُ لَهَا الثُّلُثَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالنِّصْفِ فَأَتْرُكُ لَهَا النِّصْفَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالثُّلُثِ وَأَتْرُكُ لَهَا الثُّلُثَيْنِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ» ثَلَاثَ مَرَّاتٍ وَوَضَعَ يَدَهُ عَلَى جَبْهَتِي فَمَسَحَ وَجْهِي وَصَدْرِي وَبَطْنِي قَالَ اللهُمَّ اشْفِ سَعْدًا وَأَتِمَّ لَهُ هِجْرَتَهُ فَمَا زِلْتُ أَجِدُ بَرْدَ يَدِهِ عَلَى كَبِدِي حَتَّى السَّاعَةِ
"The Prophet came to visit me when I was in Makkah. I said: 'O Messenger of Allah, shall I bequeath all my money?' He said: 'No.' I said: 'One-half?' He said: 'No.' I said: 'One-third?' He said: '(Bequeath) one-third, and one-third is a lot. If you leave your heirs independent of means, that is better than if you leave them poor and holding out their hands to people.'" (Using translation from Nasāʾī 3627)
كَانَ النَّبِيُّ ﷺ يَعُودُهُ وَهُوَ بِمَكَّةَ وَلَمْ تَكُنْ لَهُ إِلَّا ابْنَةٌ وَاحِدَةٌ قَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» قَالَ النِّصْفُ؟ قَالَ «لَا» قَالَ فَالثُّلُثُ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ
31.5 [Machine] The inheritance of the parent from their child.
٣١۔٥ مِيرَاثُ الْوَالِدِ مِنْ وَلَدِهِ
[Machine] A man gave a piece of land to his son as a charity, but then it was returned to him as inheritance. He mentioned this to the Messenger of Allah ﷺ , who said to him, "You have earned a reward, and your property has returned to you."
أَنَّ رَجُلًا تَصَدَّقَ عَلَى وَلَدِهِ بِأَرْضٍ فَرَدَّهَا إِلَيْهِ الْمِيرَاثُ فَذَكَرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَهُ «وَجَبَ أَجْرُكَ وَرَجَعَ إِلَيْكَ مَالُكَ»
31.6 [Machine] The Mention of Joy
٣١۔٦ ذِكْرُ الْكَلَالَةِ
[Machine] The Messenger of Allah ﷺ used to frequently perform ablution without any clear reason, so he poured water from his ablution onto me. Then he became conscious and I asked him if it meant that he was bequeathing me some inheritance. So, the verse of obligatory bequest was revealed.
أَنَّ رَسُولَ اللهِ ﷺ عَادَهُ وَهُوَ لَا يَعْقِلُ فَتَوَضَّأَ فَصَبَّ عَلَيْهِ مِنْ وَضُوئِهِ فَعَقَلَ قُلْتُ يَرِثُنِي كَلَالَةٌ فَكَيْفَ الْمِيرَاثُ؟ فَأُنْزِلَ آيَةُ الْفَرْضِ
I became sick so Messenger of Allah ﷺ and Abu Bakr came on foot to pay me a visit. When they came, I was unconscious. Messenger of Allah ﷺ performed ablution and he poured over me the water (of his ablution) and I came to my senses and said, "O Messenger of Allah ﷺ! What shall I do regarding my property? How shall I distribute it?" The Prophet ﷺ did not reply till the Divine Verses of inheritance were revealed . (Using translation from Bukhārī 6723)
سَمِعْتُ جَابِرًا يَقُولُ مَرِضْتُ فَأَتَانِي رَسُولُ اللهِ ﷺ وَأَبُو بَكْرٍ يَعُودَانِي وَهُمَا يَمْشِيَانِ فَوَجَدَانِي قَدْ أُغْمِيَ عَلَيَّ فَتَوَضَّأَ رَسُولُ اللهِ ﷺ فَصَبَّ وَضُوءَهُ عَلَيَّ فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ كَيْفَ أَقْضِي فِي مَالِي؟ كَيْفَ أَصْنَعُ فِي مَالِي؟ فَلَمْ يُجِبْنِي بِشَيْءٍ حَتَّى أُنْزِلَتْ آيَةُ الْمِيرَاثِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ ابْنُ جُرَيْجٍ
Allah's Apostle ﷺ and Abi Bakr (Allah be pleased with him) visited me on foot in Banu Salama, and found me unconscious. He (the Holy Prophet) called for water and performed ablution and sprinkled out of it (the water) over me. I felt relieved. I said: Messenger of Allah, what should I do with my property? And this verse was revealed:" Allah enjoins you concerning your children: for the male is equal of the portion of two females." (Using translation from Muslim 1616b)
عَادَنِي النَّبِيُّ ﷺ وَأَبُو بَكْرٍ فِي بَنِي سَلَمَةَ فَوَجَدَانِي لَا أَعْقِلُ فَدَعَا بِمَاءٍ فَتَوَضَّأَ ثُمَّ رَشَّ عَلَيَّ مِنْهُ فَأَفَقْتُ فَقُلْتُ لَهُ كَيْفَ أَصْنَعُ فِي مَالِي يَا رَسُولَ اللهِ؟ فَأَنْزَلَ اللهُ {يُوصِيكُمُ اللهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11]
31.7 [Machine] The exclusive mention of inheritance for sisters
٣١۔٧ ذِكْرُ مِيرَاثِ الْأَخَوَاتِ عَلَى انْفِرَادِهِنَّ
I fell ill, and I had seven sisters. The Messenger of Allah ﷺ came to me and blew on my face. So I became conscious. I said: Messenger of Allah, may I not bequeath one-third of my property to my sisters? He replied: Do good. I asked: Half? He replied: Do good. He then went out and left me, and said: I do not think, Jabir, you will die of this disease. Allah has revealed (verses) and described the share of your sisters. He appointed two-thirds for them. Jabir used to say: This verse was revealed about me: "They ask thee for a legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs. اشْتَكَيْتُ وَعِنْدِي سَبْعُ أَخَوَاتٍ لِي فَدَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ فَنَفَخَ فِي وَجْهِي فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ أَلَا أُوصِي لِأَخَوَاتِي بِالثُّلُثَيْنِ؟ ثُمَّ خَرَجَ وَتَرَكَنِي ثُمَّ رَجَعَ إِلَيَّ فَقَالَ إِنِّي لَا أَرَاكَ مَيِّتًا مِنْ وَجَعِكَ هَذَا وَإِنَّ اللهَ قَدْ أَنْزَلَ فَبَيَّنَ الَّذِي لِأَخَوَاتِكَ فَجَعَلَ لَهُنَّ الثُّلُثَيْنِ فَكَانَ جَابِرٌ يَقُولُ أُنْزِلَتْ هَذِهِ الْآيَةُ فِيَّ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]

The last verse revealed about the decease who left no descendants or ascendants: "They ask thee for the legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs." (Using translation from Abū Dāʾūd 2888)
آخِرُ آيَةٍ نَزَلَتْ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]
[Machine] The last verse revealed in the Quran is Surah An-Nisa.
«آخِرُ آيَةٍ أُنْزِلَتْ فِي الْقُرْآنِ سُورَةُ النِّسَاءِ»
31.8 [Machine] The mention of sisters with girls and their dwellings from the inheritance
٣١۔٨ ذِكْرُ الْأَخَوَاتِ مَعَ الْبَنَاتِ وَمَنَازِلِهِنَّ مِنَ التَّرِكَاتِ
“A man came to Abu Musa Al-Ash’ari and Salman bin Rabi’ah Al-Bahili and asked them about (the shares of) a daughter, a son’s daughter, a sister through one’s father and mother. They said: ‘The daughter gets one half, and what is left goes to the sister. Go to Ibn Mas’ud, for he will concur with what we say.’ So the man went to Ibn Mas’ud, and told him what they had said. ‘Abdullah said: ‘I will go astray and will not be guided (if I say that I agree); but I will judge as the Messenger of Allah ﷺ judged. The daughter gets one half, and the son’s daughter gets one- sixth. That makes two thirds. And what is left goes to the sister.’” (Using translation from Ibn Mājah 2721)
ابْنُ مَسْعُودٍ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنِّي سَأَقْضِي بِمَا قَضَى بِهِ رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ
31.9 [Machine] Interpretation of Allah's saying: "Indeed, a man's death causes him to have no offspring, but he does have sisters." [An-Nisa: 176]
٣١۔٩ تَأْوِيلُ قَوْلِ اللهِ ﷻ {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ} [النساء: 176]
[Machine] "For the daughter, it is half, and for the sister, it is half. Come to Abdullah and he will follow me. So Abdullah came and mentioned that to him. He said, 'I found in the book that I have gone astray, and I am not one of the guided ones. I will judge in it according to what the Messenger of Allah ﷺ has decreed: for the daughter, it is half, for the daughter of the son, it is one-sixth, and what remains is for the sister.' So he came to Abu Musa and mentioned that to him. He said, 'Do not ask me about anything as long as this ink is between your faces.'"
لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَائْتِ عَبْدَ اللهِ فَسَيُتَابِعُنِي فَأَتَى عَبْدَ اللهِ فَذَكَرَ ذَلِكَ لَهُ قَالَ فَوَجَدْتُ فِي الْكِتَابِ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَى أَبَا مُوسَى فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ
31.10 [Machine] The inheritance of the daughter of the son with the daughter
٣١۔١٠ تَوْرِيثُ ابْنَةِ الِابْنِ مَعَ الِابْنَةِ
Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you." قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَوْا أَبَا مُوسَى فَأَخْبَرُوهُ فَقَالَ لَا تَسْأَلُونِي وَهَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ
31.11 [Machine] Daughter and Son of a Father, along with a Sister of a Father and a Mother
٣١۔١١ ابْنَةٌ وَأَخٌ لِأَبٍ مَعَ أُخْتٍ لِأَبٍ وَأُمٍّ
The Prophet ﷺ said, "Give the Fara'id (the shares of the inheritance that are prescribed in the Qur'an) to those who are entitled to receive it. Then whatever remains, should be given to the closest male relative of the deceased ." (Using translation from Bukhārī 6732)
أَنَّ النَّبِيَّ ﷺ قَالَ «أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ»
[Machine] The Messenger of Allah ﷺ said, "Attach the wealth to the obligations, for whatever is left of the obligations is the rightful possession of the person who remembers." Abu Abdur-Rahman Sufyan Ath-Thawri said, "I have memorized more from Wahib, and Wahib is trustworthy and reliable. It is as if the narration of Ath-Thawri is more accurate."
قَالَ رَسُولُ اللهِ ﷺ «أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ فَمَا تَرَكَتِ الْفَرَائِضُ فَأَوْلَى رَجُلٍ ذَكَرٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ سُفْيَانُ الثَّوْرِيُّ أَحْفَظُ مِنْ وُهَيْبٍ وَوُهَيْبٌ ثِقَةٌ مَأْمُونٌ وَكَأَنَّ حَدِيثَ الثَّوْرِيِّ أَشْبَهُ بِالصَّوَابِ
31.12 [Machine] Mentioning of grandparents and great-grandparents, as well as their allotted shares.
٣١۔١٢ ذِكْرُ الْجَدَّاتِ وَالْأَجْدَادِ، وَمَقَادِيرِ نَصِيبِهِمْ
[Machine] That Umar gathered the companions of the Messenger of Allah, ﷺ , to discuss a matter pertaining to inheritance. He asked them if anyone had heard the Messenger of Allah, ﷺ , mention anything about inheritance. Maqil ibn Yasar Al-Muzani stood up and said, "I heard the Messenger of Allah, ﷺ , mention a duty that includes inheritance and he gave two-thirds or one-half of it." Umar asked him, "What is the duty?" He replied, "I do not know." Umar kicked him with his foot and said, "You don't know!"
أَنَّ عُمَرَ جَمَعَ أَصْحَابَ رَسُولِ اللهِ ﷺ فِي شَأْنِ الْجَدِّ فَنَشَدَهُمْ مَنْ سَمِعَ رَسُولَ اللهِ ﷺ ذَكَرَ مِنَ الْجَدِّ شَيْئًا فَقَامَ مَعْقِلُ بْنُ يَسَارٍ الْمُزَنِيُّ فَقَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ أُتِيَ بِفَرِيضَةٍ فِيهَا جَدٌّ فَأَعْطَاهُ ثُلُثَا أَوْ سُدُسًا فَقَالَ لَهُ عُمَرُ مَا الْفَرِيضَةُ؟ قَالَ لَا أَدْرِي فَرَكَلَهُ عُمَرُ بِقَدَمِهِ ثُمَّ قَالَ لَا دَرَيْتَ
“The Messenger of Allah ﷺ ruled concerning a grandfather who was among us, that he should receive one sixth.” (Using translation from Ibn Mājah 2723)
قَضَى رَسُولُ اللهِ ﷺ فِي جَدٍّ كَانَ فِينَا بِالسُّدُسِ
[Machine] The Messenger of Allah ﷺ gave the sixth share to the grandfather and Umar said to him, "Woe to you, who are you with?" He replied, "I don't know."
أَعْطَى رَسُولُ اللهِ ﷺ الْجَدَّ السُّدُسَ فَقَالَ لَهُ عُمَرُ وَيْلَكَ مَعَ مَنْ؟ قَالَ لَا أَدْرِي
[Machine] The Prophet ﷺ heard something exciting in conversation, so a man stood up and said, "I witnessed it, he gave him a third." The Prophet asked, "With whom?" The man replied, "I don't know." The Prophet said, "You should have known."
سَمِعَ النَّبِيَّ ﷺ فِي الْجَدِّ شَيْئًا فَقَامَ رَجُلٌ فَقَالَ أَنَا شَهِدْتُهُ أَعْطَاهُ الثُّلُثَ قَالَ مَعَ مَنْ؟ قَالَ لَا أَدْرِي قَالَ لَا دَرَيْتَ
[Machine] A man came to the Prophet ﷺ and said, "Indeed, my son's son has passed away. What do I have of his inheritance?" The Prophet ﷺ said, "You have one-sixth." When he turned away, the man called him back and said, "You have another one-sixth." When he turned away again, the man called him back and said, "Indeed, the other one-sixth is a gift." Muhammad said in his narration, "When he turned away, he said, 'You have another one-sixth, and the other one-sixth is a gift for you.'"
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ ابْنَ ابْنِي مَاتَ فَمَا لِي مِنْ مِيرَاثِهِ؟ فَقَالَ «لَكَ السُّدُسُ» فَلَمَّا وَلَّى دَعَاهُ فَقَالَ «لَكَ سُدُسٌ آخَرُ» فَلَمَّا وَلَّى دَعَاهُ فَقَالَ «إِنَّ السُّدُسَ الْآخَرَ طُعْمَةٌ» وَقَالَ مُحَمَّدٌ فِي حَدِيثِهِ فَلَمَّا أَدْبَرَ قَالَ لَكَ سُدُسٌ آخَرُ وَالْآخَرُ طُعْمَةٌ لَكَ
[Machine] The Messenger of Allah ﷺ used to give the grandmother a sixth (portion) if she was not the mother.
أَطْعَمَ رَسُولُ اللهِ ﷺ الْجَدَّةَ السُّدُسَ إِذَا لَمْ تَكُنْ أُمٌّ
[Machine] "What do I know for you? I will ask the people. So when the people prayed the morning prayer, he asked them. Al-Mughirah ibn Shu'bah said, 'I heard the Messenger of Allah ﷺ giving her a sixth.' Abu Bakr asked, 'Do you have anyone else?' Muhammad ibn Muslimah said, 'I heard the Messenger of Allah ﷺ giving her that.' So Abu Bakr gave her that. Ibn Shihab said, 'I do not know which two grandmothers they are.'"
مَا أَعْلَمُ لَكِ شَيْئًا؟ وَسَأَسْأَلُ النَّاسَ فَلَمَّا صَلَّى النَّاسُ الصُّبْحَ سَأَلَهُمْ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ أَنَا سَمِعْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا السُّدُسَ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ أَنَا سَمِعْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا ذَلِكَ فَأَعْطَاهَا ذَلِكَ أَبُو بَكْرٍ قَالَ ابْنُ شِهَابٍ لَا أَدْرِي أَيُّ الْجَدَّتَيْنِ هِيَ؟
[Machine] Abu Bakr, I do not find anything for you in the Book of Allah and I do not know that the Messenger of Allah ﷺ mentioned anything. I will ask the people in the evening. So, when he prayed the Dhuhr prayer, he stood among the people and asked them. Al-Mughirah bin Shu'bah said, "I heard the Messenger of Allah ﷺ giving her one-sixth." He asked, "Did anyone hear that with you?" Muhammad bin Muslimah called him and said, "I heard the Messenger of Allah ﷺ giving her one-sixth." Upon hearing this, Abu Bakr implemented it. Nasru bin Ali bin Nasr al-Jahdhami narrated to us, he said, "Abdul A'la (meaning Ibn Abdul A'la) told us, Ma'mar narrated to us from Az-Zuhri, from Qabeesah bin Dhu'ayb, that the grandmother of the mother came to Abu Bakr and narrated the Hadith." Muhammad bin Jabalah ar-Raafiqi informed us, he said, "Abdullah bin Sulaim informed us, he said, "Ubaydullah (meaning Ibn Amr) ar-Raqqi informed us, he said, "Ishaq (meaning Ibn Rashid) informed us from Az-Zuhri, from Qabeesah bin Dhu'ayb, that the grandmother of the mother came to Abu Bakr and narrated the Hadith." Abu Abdur Rahman az-Zuhri did not hear it from Qabeesah. Imran bin Bakkar al-Barrad narrated to us, he said, "Abu al-Yaman (meaning Al-Hakam bin Nafi') told us, Shu'aib narrated to us from Az-Zuhri, he said, "Qabeesah came and the grandmother told the Hadith." Harun bin Sa'id bin Al-Haytham al-Ayli narrated to us, he said, "Khalid bin Nazar informed us, he said, "Al-Qasim bin Mabrur narrated to us from Yunus, he said, "Ibn Shihab claimed that Qabeesah bin Dhu'ayb said that the grandmother came to Abu Bakr and narrated the Hadith." Muhammad bin Abdullah bin Yazid al-Muqri' narrated to us, he said, "Sufyan informed us, he said, I heard Az-Zuhri narrating from a man from Qabeesah bin Dhu'ayb that the grandmother came to Abu Bakr and narrated the Hadith."
أَبُو بَكْرٍ مَا أَجِدُ لَكِ فِي كِتَابِ اللهِ شَيْئًا وَمَا عَلِمْتُ أَنَّ رَسُولَ اللهِ ﷺ ذَكَرَ شَيْئًا وَسَأَسْأَلُ النَّاسَ الْعَشِيَّةَ فَلَمَّا صَلَّى الظُّهْرَ قَامَ فِي النَّاسِ فَسَأَلَهُمْ قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ قَدْ سَمِعْتُ رَسُولَ اللهِ ﷺ يُعْطِيهَا السُّدُسَ قَالَ هَلْ سَمِعَ ذَلِكَ مَعَكَ أَحَدٌ؟ فَنَادَاهُ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ قَدْ سَمِعْتُ رَسُولَ اللهِ ﷺ يُعْطِيهَا السُّدُسَ فَأَنْفَذَ ذَلِكَ أَبُو بَكْرٍ أَخْبَرَنَا نَصْرُ بْنُ عَلِيِّ بْنِ نَصْرٍ الْجَهْضَمِيُّ قَالَ أَخْبَرَنَا عَبْدُ الْأَعْلَى يَعْنِي ابْنَ عَبْدِ الْأَعْلَى قَالَ حَدَّثَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ أَنَّ جَدَّةً أَتَتْ أَبَا بَكْرٍ وَسَاقَ الْحَدِيثَ [112] 6307 أَخْبَرَنِي مُحَمَّدُ بْنُ جَبَلَةَ الرَّافِقِيُّ قَالَ حَدَّثَنَا عَبْدُ اللهِ بْنُ سُلَيْمٍ قَالَ حَدَّثَنَا عُبَيْدُ اللهِ يَعْنِي ابْنَ عَمْرٍو الرَّقِّيَّ عَنْ إِسْحَاقَ يَعْنِي ابْنَ رَاشِدٍ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ أَنَّ الْجَدَّةَ أُمَّ الأُمِّ أَتَتْ أَبَا بَكْرٍ وَسَاقَ الْحَدِيثَ 6308 أَخْبَرَنِي مُحَمَّدُ بْنُ جَبَلَةَ الرَّافِقِيُّ قَالَ حَدَّثَنَا عَبْدُ اللهِ بْنُ سُلَيْمٍ قَالَ حَدَّثَنَا عُبَيْدُ اللهِ يَعْنِي ابْنَ عَمْرٍو الرَّقِّيَّ عَنْ إِسْحَاقَ يَعْنِي ابْنَ رَاشِدٍ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ أَنَّ الْجَدَّةَ أُمَّ الْأُمِّ أَتَتْ أَبَا بَكْرٍ وَسَاقَ الْحَدِيثَ قَالَ أَبُو عَبْدِ الرَّحْمَنِ الزُّهْرِيُّ لَمْ يَسْمَعْهُ مِنْ قَبِيصَةَ 6309 أَخْبَرَنِي عِمْرَانُ بْنُ بَكَّارٍ الْبَرَّادُ قَالَ حَدَّثَنَا أَبُو الْيَمَانِ يَعْنِي الْحَكَمَ بْنَ نَافِعٍ قَالَ أَخْبَرَنَا شُعَيْبٌ عَنِ الزُّهْرِيِّ قَالَ قَالَ قَبِيصَةُ جَاءَتِ الْجَدَّةُ وَسَاقَ الْحَدِيثَ 6310 أَخْبَرَنَا هَارُونُ بْنُ سَعِيدِ بْنِ الْهَيْثَمِ الْأَيْلِيُّ قَالَ حَدَّثَنَا خَالِدُ بْنُ نَزَارٍ قَالَ أَخْبَرَنَا الْقَاسِمُ بْنُ مَبْرُورٍ عَنْ يُونُسَ قَالَ ابْنُ شِهَابٍ زَعَمَ قَبِيصَةُ بْنُ ذُؤَيْبٍ أَنَّ الْجَدَّةَ أَتَتْ أَبَا بَكْرٍ وَسَاقَ الْحَدِيثَ 6311 أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ يَزِيدَ الْمُقْرِئُ قَالَ حَدَّثَنَا سُفْيَانُ قَالَ سَمِعْتُ الزُّهْرِيَّ يُحَدِّثُ عَنْ رَجُلٍ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ أَنَّ الْجَدَّةَ أَتَتْ إِلَى أَبِي بَكْرٍ وَسَاقَ الْحَدِيثَ
31.13 [Machine] Mention the name of this man who brought al-Zuhri between him and Qabisa ibn Dhu'ayb.
٣١۔١٣ ذِكْرُ اسْمِ هَذَا الرَّجُلِ الَّذِي أَدْخَلَ الزُّهْرِيُّ بَيْنَهُ وَبَيْنَ قَبِيصَةَ بْنِ ذُؤَيْبٍ
[Machine] "What do you have in the Book of Allah, and what do I know for you in the Sunnah of the Messenger of Allah ﷺ ? So, return until I ask the people." So, he asked the people, and Al-Mughirah bin Shu'bah said, 'I attended the Messenger of Allah ﷺ when he gave her one-sixth.' Abu Bakr (may Allah be pleased with him) asked, 'Do you have anyone else with you?' So, Muhammad bin Maslamah stood up and said, 'As Al-Mughirah said.' So, Abu Bakr fulfilled her request."
مَا لَكِ فِي كِتَابِ اللهِ مِنْ شَيْءٍ وَمَا أَعْلَمُ لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ «حَضَرْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا السُّدُسَ» فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ كَمَا قَالَ الْمُغِيرَةُ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ
The Prophet ﷺ said: I am nearer to the believers than themselves, so if anyone leaves property, it goes to his heirs, and if anyone leaves debt and dependants, let the matter come to me and I shall be responsible. (Using translation from Abū Dāʾūd 2954)
قَالَ رَسُولُ اللهِ ﷺ «أَنَا أَوْلَى بِالْمُؤْمِنِينَ مِنْ أَنْفُسِهِمْ فَمَنْ تَرَكَ مَالًا فَهُوَ إِلَى الْعَصَبَةِ وَمَنْ تَرَكَ كَلًّا أَوْ ضَيَاعًا فَأَنَا وَلِيُّهُ»
[Machine] I heard the Messenger of Allah say, "Whatever the child or the parent acquires is considered part of their lineage."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَا أَحْرَزَ الْوَلَدُ أَوِ الْوَالِدُ فَهُوَ لِعَصَبَتِهِ مَنْ كَانَ [114] 6315 أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ قَالَ حَدَّثَنَا الْمُعْتَمِرُ يَعْنِي ابْنَ سُلَيْمَانَ قَالَ سَمِعْتُ الْحُسَيْنَ الْمُعَلِّمِ قَالَ حَدَّثَنَا عَمْرُو بْنُ شُعَيْبٍ قَالَ قَالَ عُمَرُ مُرْسَلٌ

٣١۔١٤ ذُو السَّهْمِ
[Machine] On the authority of the Prophet ﷺ who said: "Allah does not make a person who has a share in Islam equal to someone who has no share in it."
عَنِ النَّبِيِّ ﷺ قَالَ لَا يَجْعَلُ اللهُ مَنْ لَهُ سَهْمٌ فِي الْإِسْلَامِ كَمَنْ لَا سَهْمَ لَهُ
31.15 [Machine] Inheritance of the paternal uncle
٣١۔١٥ تَوْرِيثُ الْخَالِ
ʿAllah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir.” (Using translation from Aḥmad 189)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ»

٣١۔١٧ ذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ الْمِقْدَامِ بْنِ مَعْدِيكَرِبَ فِي تَوْرِيثِ الْخَالِ
The Prophet ﷺ said: I am nearer to every believer than himself, so if anyone leaves a debt or a helpless family, I shall be responsible, but if anyone leaves property, it goes to his heirs. I am patron of him who has none, inheriting his property and freeing him from his liabilities. A maternal uncle is patron of him who has none, inheriting his property and freeing him from his liabilities. Abu Dawud said: da'iah means dependants or helpless family. Abu Dawud said: This tradition has been transmitted by al-Zubaidi from Rashid b. Sa'd from Ibn 'A'idh on the authority of al-Miqdam. It has also been transmitted by Mu'awiyah b. Salih from Rashid who said: I heard al-Miqdam (say). (Using translation from Abū Dāʾūd 2900)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَيَّ وَمَنْ تَرَكَ مَالًا فَلِوَارِثِهِ وَأَنَا وَلِيُّ مَنْ لَا وَلِيَّ لَهُ أَفُكُّ عَنْوَهُ وَأَرِثُ مَالَهُ وَالْخَالُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ يَفُكُّ عَنْوَهُ وَيَرِثُ مَالَهُ»
[Machine] The Messenger of Allah ﷺ said, "I am a guardian of those who have no guardian. I inherit his wealth and manage his affairs. And the uncle is a guardian of those who have no guardian. He inherits his wealth and manages his affairs."
قَالَ رَسُولُ اللهِ ﷺ أَنَا مَوْلَى مَنْ لَا مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ وَالْخَالُ مَوْلَى مَنْ لَا مَوْلَى لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ
[Machine] On the authority of the Messenger of Allah ﷺ who said, "Whoever leaves behind wealth, it is for his family, and whoever leaves behind debt, it is for Allah and His Messenger." And perhaps he said, "It is for us." He said, "I am a member of a tribe who has no inheritance, and I leave it and disassociate myself from it. And the paternal uncle is a member of a tribe who has no inheritance, and he disassociates himself from it and inherits it."
عَنْ رَسُولِ اللهِ ﷺ قَالَ «مَنْ تَرَكَ مَالًا فَلِأَهْلِهِ وَمَنْ تَرَكَ كَلًّا فَإِلَى اللهِ وَرَسُولِهِ» وَرُبَّمَا قَالَ فَإِلَيْنَا قَالَ وَأنا عُصْبَةُ مَنْ لَا عُصْبَةَ لَهُ أَرِثُهُ وَأَعْقِلُ عَنْهُ وَالْخَالُ عُصْبَةُ مَنْ لَا عُصْبَةَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ
[Machine] The Messenger of Allah ﷺ said: "I am the guardian of one who has no guardian. I will inherit from him and absolve him. And the paternal uncle is the guardian of one who has no guardian. He will inherit from him and absolve him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَنَا وَلِيُّ مَنْ لَا وَلِيَّ لَهُ أَرِثُهُ وَأَفُكُّ عَنْهُ وَالْخَالُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ يَرِثُهُ وَيَفُكُّ عَنْهُ
31.18 [Machine] Inheritance of a newborn if they have reached puberty.
٣١۔١٨ تَوْرِيثُ الْمَوْلُودِ إِذَا اسْتَهَلَّ
“If a child utters a sound (after being born), the funeral prayer should be offered for him and (his relatives) may inherit from him.” (Using translation from Ibn Mājah 1508)
عَنِ النَّبِيِّ ﷺ قَالَ «الصَّبِيُّ إِذَا اسْتَهَلَّ وَرِثَ وَصُلِّيَ عَلَيْهِ»
[Machine] According to Abu Al-Zubayr, (this is) not an unreliable hadith, and Ibn Jurayj has confirmed it from Al-Mughirah. And Allah knows best.
عَنْ أَبِي الزُّبَيْرِ غَيْرُ حَدِيثٍ مُنْكَرٍ وَابْنُ جُرَيْجٍ أَثْبَتُ مِنَ الْمُغِيرَةِ وَاللهُ أَعْلَمُ

٣١۔١٩ مِيرَاثُ وَلَدِ الْمُلَاعَنَةِ
The Prophet ﷺ said: A woman gets inheritance from the three following: one she has set free, a foundling, and her child about whom she has invoked a curse on herself if she was untrue in declaring he was not born out of wedlock. (Using translation from Abū Dāʾūd 2906)
