31. Inheritance (2/3)
٣١۔ كِتَابُ الْفَرَائِضِ ص ٢
The Prophet ﷺ said: A woman gets inheritance from the three following: one she has set free, a foundling, and her child about whom she has invoked a curse on herself if she was untrue in declaring he was not born out of wedlock. (Using translation from Abū Dāʾūd 2906)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «تُحْرِزُ الْمَرْأَةُ ثَلَاثَةَ مَوَارِيثَ عَتِيقَهَا وَلَقِيطَهَا وَوَلَدَهَا الَّذِي لَاعَنَتْ عَلَيْهِ»
[Machine] The Messenger ﷺ narrated that a man from the Ansar tribe of Bani Zurayq had accused his wife of adultery. So he came to the Messenger ﷺ and repeated this statement four times to him. Then Allah revealed the verse of cursing, so the Messenger ﷺ said, "Where is the questioner? Verily, Allah has revealed a great command." But the man insisted on cursing her and she insisted on seeking sanctuary from the punishment. So they both cursed each other. The Messenger ﷺ said, "If she gives birth to a child who is pale and keeled with thick bones, then he is for the one who has cursed her. But if she gives birth to a child who is black like the leaf of a date palm, then he is for someone else." So she gave birth to a child who was black like the leaf of a date palm, and the Messenger ﷺ called him to his mother's family and said, "Had it not been for the oaths that have passed, I would have done to him such and such."
عَنْ رَسُولِ اللهِ ﷺ أَنَّ رَجُلًا مِنَ الْأَنْصَارِ مِنْ بَنِي زُرَيْقٍ قَذَفَ امْرَأَتَهُ فَأَتَى رَسُولَ اللهِ ﷺ فَرَدَّدَ ذَلِكَ أَرْبَعَ مَرَّاتٍ عَلَى رَسُولِ اللهِ ﷺ فَأَنْزَلَ اللهُ آيَةَ الْمُلَاعَنَةِ فَقَالَ رَسُولُ اللهِ ﷺ أَيْنَ السَّائِلُ؟ إِنَّهُ قَدْ نَزَلَ مِنَ اللهِ أَمْرٌ عَظِيمٌ فَأَبَى الرَّجُلُ إِلَّا أَنْ يُلَاعِنَهَا وَأَبَتْ إِلَّا أَنْ تَدْرَأَ عَنْ نَفْسِهَا الْعَذَابَ فَتَلَاعَنَا فَقَالَ رَسُولُ اللهِ ﷺ «إِمَّا هِيَ تَجِيءُ بِهِ أُصَيْفِرَ أخَيْنِسَ مَنْشُولَ الْعِظَامِ فَهُوَ لِلْمُلَاعِنِ وَإِمَّا تَجِيءُ بِهِ أَسْوَدَ كَالْجَمَلِ الْأَوْرَقِ فَهُوَ لِغَيْرِهِ» فَجَاءَتْ بِهِ أَسْوَدَ كَالْجَمَلِ الْأَوْرَقِ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَجَعَلَهُ لِعَصَبَةِ أُمِّهِ وَقَالَ لَوْ مَا الْأَيْمَانُ الَّتِي مَضَتْ لَكَانَ لِي فِيهِ كَذَا وَكَذَا
31.20 [Machine] Inheritance of a woman from the blood money of her husband.
٣١۔٢٠ تَوْرِيثُ الْمَرْأَةِ مِنْ دِيَةِ زَوْجِهَا
that 'Umar would say: "The blood-money upon the tribe, and the wife does not inherit any of her husband's blood-money." Until Ad-Dahhak bin Sufyan Al-Kulabi informed him that the Messenger of Allah ﷺ wrote to me, that Ashaim Ad-Dibabi's wife inherited the blood-money of her husband. كَانَ عُمَرُ يَقُولُ الدِّيَةُ عَلَى الْعَاقِلَةِ وَلَا تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا فَقَالَ لَهُ الضَّحَّاكُ بْنُ سُفْيَانَ إِنَّ النَّبِيَّ ﷺ كَتَبَ إِلَيْهِ «أَنْ وَرِّثِ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا»
[Machine] The Prophet ﷺ wrote to him that he should give the woman, named Ashyam Al-Dibabi, her husband's blood money as inheritance. Umrah returned (after receiving the letter).
أَنَّ النَّبِيَّ ﷺ كَتَبَ إِلَيْهِ أَنْ يُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا فَرَجَعَ عُمَرُ
[Machine] The Messenger of Allah ﷺ heard something and said, "Al-Dhahhak ibn Sufyan al-Kilabi used to work for me to distribute charity for the Banu Kilab tribe. He has knowledge about it." Umar said, "He said a phrase that meant 'wait for me until I go out.' He entered the bathroom and stayed in it for an hour, then he came out and informed the people that the Prophet ﷺ had written to him to give a woman some money from her husband's blood money. Then he returned."
سَمِعَ رَسُولَ اللهِ ﷺ فِيهِ قَوْلًا فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ وَكَانَ النَّبِيُّ ﷺ اسْتَعْمَلَهُ عَلَى صَدَقَةِ بَنِي كِلَابٍ عِنْدِي مِنْهُ عِلْمٌ فَقَالَ عُمَرُ وَقَالَ كَلِمَةً مَعْنَاهَا انْتَظِرْنِي حَتَّى أَخْرُجَ فَدَخَلَ فُسَيْطِيطًا فَمَكَثَ فِيهِ سَاعَةً ثُمَّ خَرَجَ فَأَخْبَرَ النَّاسَ أَنَّ النَّبِيَّ ﷺ كَتَبَ إِلَيْهِ أَنْ يُوَرِّثَ امْرَأَةَ أَشْيَمَ مِنْ دِيَةِ زَوْجِهَا فَرَجَعَ
[Machine] That Umar asked the people in Mina about the woman's share of her husband's intellect, the Dahhak ibn Sufyan al-Kilabi wrote to me, the Messenger of Allah ﷺ , whether the woman should inherit from the blood money of her husband.
أَنَّ عُمَرَ سَأَلَ النَّاسَ بِمِنًى فِي مِيرَاثِ الْمَرْأَةِ مِنْ عَقْلِ زَوْجِهَا فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ كَتَبَ إِلَيَّ رَسُولُ اللهِ ﷺ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا
31.21 [Machine] The inheritance of the murderer.
٣١۔٢١ تَوْرِيثُ الْقَاتِلِ
[Machine] The Messenger of Allah, ﷺ , said, "The killer has no share of inheritance."
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ لِلْقَاتِلِ مِنَ الْمِيرَاثِ شَيْءٌ»
قَالَ رَسُولُ ﷺ لَيْسَ لِقَاتِلٍ شَيْءٌ
[Machine] "Indeed, the Messenger of Allah ﷺ said, 'The killer does not inherit.' Abu Abdullah Rahman, Ishaaq ibn Mataruk al-Hadith, said, 'I have reported this from the teachers of Layth so that it is not left out from among the middle (level scholars)."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْقَاتِلُ لَا يَرِثُ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ إِسْحَاقُ مَتْرُوكُ الْحَدِيثِ أَخْرَجْتُهُ فِي مَشَايِخِ اللَّيْثِ لِئَلَّا يُتْرَكَ مِنَ الْوَسَطِ
31.22 [Machine] Mawarithu Al-Majoos - This translates to "The inheritance of the Magi" in English.
٣١۔٢٢ مَوَارِيثُ الْمَجُوسِ
[Machine] Two verses of this Surah were abrogated, which are the verse of the ornaments and his saying, "So if they come to you, then judge between them or turn away from them." He returned them to their rulers until the verse was revealed, "And judge between them by what Allah has revealed." [Surah Al-Ma'idah 49] He said, "So the Messenger of Allah ﷺ was commanded to judge between them by what Allah has revealed."
نُسِخَ مِنْ هَذِهِ السُّورَةِ يَعْنِي آيَتَانِ آيَةُ الْقَلَائِدِ وَقَوْلُهُ {فَإِنْ جَاءُوكَ فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ} رَدَّهُمْ إِلَى حُكَّامِهِمْ حَتَّى نَزَلَتْ {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ} [المائدة 49] قَالَ فَأُمِرَ رَسُولُ اللهِ ﷺ أَنْ يَحْكُمَ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ
31.23 [Machine] In the inheritance between Muslims and polytheists.
٣١۔٢٣ فِي الْمُوَارَثَةِ بَيْنَ الْمُسْلِمِينَ وَالْمُشْرِكِينَ
[Machine] The Messenger of Allah ﷺ said, "A Muslim does not inherit from a disbeliever."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَرِثُ مُسْلِمٌ كَافِرًا»
The Prophet ﷺ as saying: A Muslim may not inherit from an infidel nor an infidel from a Muslim. (Using translation from Abū Dāʾūd 2909)
قَالَ رَسُولُ اللهِ ﷺ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ»
31.24 [Machine] The mention of differences regarding Malik in the hadith of Usamah ibn Zaid.
٣١۔٢٤ ذِكْرُ الِاخْتِلَافِ عَلَى مَالِكٍ فِي حَدِيثِ أُسَامَةَ بْنِ زَيْدٍ فِيهِ
[Machine] "That the Messenger of Allah, ﷺ , said: 'A Muslim does not inherit from a disbeliever.'"
أَنَّ رَسُولَ اللهِ صَلَّى اللهُ ﷺ قَالَ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ»
[Machine] The Messenger of Allah ﷺ said: "A Muslim does not inherit from a disbeliever."
قَالَ رَسُولُ اللهِ ﷺ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ»
[Machine] The Messenger of Allah ﷺ said, "A Muslim does not inherit from a disbeliever." 6342 Ahmad bin Suleiman ar-Ruhawi informed us, he said: Mu'awiya bin Hisham informed us, he said: Malik narrated to us from az-Zuhri from Ali bin Husayn from Amr bin Uthman from Usama bin Zaid from the Prophet ﷺ with a similar statement. Abu 'Abd ar-Rahman said, "The correct view is from the hadith of Malik ibn 'Amr bin 'Uthman, and we do not know of any of the companions of az-Zuhri who followed him in this, and it was said to him, so he affirmed it. He said, "This is his house."
قَالَ رَسُولُ اللهِ ﷺ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ» 6342 أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ الرُّهَاوِيُّ قَالَ حَدَّثَنَا مُعَاوِيَةُ بْنُ هِشَامٍ قَالَ حَدَّثَنَا مَالِكٌ عَنِ الزُّهْرِيِّ عَنْ عَلِيِّ بْنِ حُسَيْنٍ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ أُسَامَةَ بْنِ زَيْدٍ عَنِ النَّبِيِّ ﷺ مِثْلَهُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَالصَّوَابُ مِنْ حَدِيثِ مَالِكٍ عَمْرِو بْنِ عُثْمَانَ وَلَا نَعْلَمُ أَنَّ أَحَدًا مِنْ أَصْحَابِ الزُّهْرِيِّ تَابَعَهُ عَلَى ذَلِكَ وَقَدْ قِيلَ لَهُ فَثَبَتَ عَلَيْهِ؟ وَقَالَ هَذِهِ دَارُهُ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ»
A Muslim is not entitled to inherit from a non-Muslim, and a non-Muslim is not entitled to inherit from a Muslim. (Using translation from Muslim 1614)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا يَرِثُ الْكَافِرُ الْمُسْلِمَ وَلَا يَرِثُ الْمُسْلِمُ الْكَافِرَ»

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا يَرِثُ الْكَافِرُ الْمُسْلِمَ»
31.25 [Machine] The Fall of the Moors between the Two Nations.
٣١۔٢٥ سُقُوطُ الْمُوَارَثَةِ بَيْنَ الْمِلَّتَيْنِ
The Prophet ﷺ said: people of two different religions would not inherit from one another. (Using translation from Abū Dāʾūd 2911)

31.26 [Machine] The boy greets one of his parents.
٣١۔٢٦ الصَّبِيُّ يُسْلِمُ أَحَدُ أَبَوَيْهِ
My daughter; she is weaned or about to wean. Rafi' said: My daughter. The Prophet ﷺ said to him: Be seated on a side. And he said to her: Be seated on a side. He then seated the girl between them, and said to them: Call her. The girl inclined to her mother. The Prophet ﷺ said: O Allah! guide her. The daughter then inclined to her father, and he took her. (Using translation from Abū Dāʾūd 2244)
أَنَّهُ أَسْلَمَ وَأَبَتِ امْرَأَتُهُ الْإِسْلَامَ فَأَتَتِ النَّبِيَّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ ابْنَتِي قَالَ «هَذِهِ فَطِيمٌ أَوْ شَبَهُ الْفَطِيمِ» فَقَالَ أَبُو الْحَكَمِ يَا رَسُولَ اللهِ ابْنَتِي فَقَالَ لَهُ النَّبِيُّ ﷺ اقْعُدْ نَاحِيَةً وَقَالَ لَهَا «اقْعُدِي نَاحِيَةً» وَأَقْعَدَ الصَّبِيَّةَ بَيْنَهُمَا ثُمَّ قَالَ «ادْعُوَاهَا» فَمَالَتِ الصَّبِيَّةُ إِلَى أُمِّهَا فَقَالَ رَسُولُ اللهِ ﷺ «اللهُمَّ اهْدِهَا» فَمَالَتْ إِلَى أَبِيهَا
"O Allah, guide him," and (the child) went to his father. (Using translation from Nasāʾī 3495)
أَنْ تُسْلِمَ فَجَاءَ ابْنٌ لَهُمَا صَغِيرٌ لَمْ يَبْلُغْ فَأَجْلَسَ النَّبِيُّ ﷺ الْأَبَ هَاهُنَا وَالْأُمَّ هَاهُنَا ثُمَّ خَيَّرَهُ فَقَالَ اللهُمَّ اهْدِهِ فَذَهَبَ إِلَى أَبِيهِ
[Machine] That his parents had a dispute about him, one of them being a Muslim and the other being a disbeliever, so he went to the disbeliever and the Prophet ﷺ said, "O Allah, guide him," so he turned to the Muslim and ruled in his favor. 6355 Abu Bakr ibn Ali informed me, he said: Abdel Alaa ibn Hammad Al-Nursi informed us: Hammad ibn Salamah informed us: from Uthman Al-Batti: from Abdul Hamid ibn Salamah: from his father: that a man embraced Islam and his wife did not, so he was sent.
أَنَّ أَبَوَيْهِ اخْتَصَمَا فِيهِ إِلَى النَّبِيِّ ﷺ أَحَدُهُمَا مُسْلِمٌ وَالْآخَرُ كَافِرٌ فَتَوَجَّهَ إِلَى الْكَافِرِ فَقَالَ النَّبِيُّ ﷺ اللهُمَّ اهْدِهِ فَتَوَجَّهَ إِلَى الْمُسْلِمِ فَقَضَى بِهِ لَهُ 6355 أَخْبَرَنِي أَبُو بَكْرِ بْنُ عَلِيٍّ قَالَ حَدَّثَنَا عَبْدُ الْأَعْلَى يَعْنِي ابْنَ حَمَّادٍ النَّرْسِيَّ قَالَ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ عُثْمَانَ الْبَتِّيِّ عَنْ عَبْدِ الْحَمِيدِ بْنِ سَلَمَةَ عَنْ أَبِيهِ أَنَّ رَجُلًا أَسْلَمَ وَلَمْ تُسْلِمِ امْرَأَتُهُ مُرْسَلٌ
[Machine] "The Messenger of Allah ﷺ said, 'A Muslim does not inherit from a Christian unless he is his slave or servant.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَرِثُ الْمُسْلِمُ النَّصْرَانِيَّ إِلَّا أَنْ يَكُونَ عَبْدَهُ أَوْ أَمَتَهُ»
31.27 [Machine] Inheritance of offices according to the amount that has been performed
٣١۔٢٧ تَوْرِيثُ الْمُكَاتَبِ بِقَدْرِ مَا أَدَّى مِنْهُ
[Machine] The Prophet ﷺ said, "If a slave has been given a specific limit or inheritance, it should be calculated based on the amount he has been freed from, and the punishment should be imposed on him based on the amount he has been freed from."
عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا أَصَابَ الْمُكَاتَبُ حَدًّا أَوْ مِيرَاثًا وَرِثَ بِحِسَابِ مَا عَتَقَ مِنْهُ وَأُقِيمَ عَلَيْهِ الْحَدُّ بِحِسَابِ مَا عَتَقَ مِنْهُ»
31.28 [Machine] Inheritance of Relatives Other than Legal Guardians
٣١۔٢٨ تَوْرِيثُ ذَوِي الْأَرْحَامِ دُونَ الْمَوَالِي
[Machine] That the freed slave of the Messenger of Allah ﷺ passed away, so they mentioned his inheritance to him (the Messenger). He said, "Is there anyone among his people here?" They said, "Yes." He said, "Then give it to him." 6359 Abdullah ibn Muhammad ibn Tamim al-Mississi reported to me that Hajjaj, meaning the son of Muhammad al-Awar, told me that Shu'bah narrated to me from Abdur Rahman ibn al-Asbahani, from Mujahid ibn Wardan, a man from the people of Madinah who praised him (the freed slave) and spoke well of him, from Urwah, from Aisha, similar to that.
أَنَّ مَوْلًى لِرَسُولِ اللهِ ﷺ تُوُفِّيَ فَذَكَرُوا لَهُ مِيرَاثَهُ فَقَالَ «هَلْ هَاهُنَا أَحَدٌ مِنْ أَهْلِ أَرْضِهِ؟» قَالُوا نَعَمْ قَالَ «فَادْفَعُوهُ إِلَيْهِ» 6359 أَخْبَرَنِي عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ تَمِيمٍ الْمِصِّيصِيُّ قَالَ حَدَّثَنَا حَجَّاجٌ يَعْنِي ابْنَ مُحَمَّدٍ الْأَعْوَرَ قَالَ حَدَّثَنِي شُعْبَةُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْأَصْبَهَانِيِّ عَنْ مُجَاهِدِ بْنِ وَرْدَانَ رَجُلٍ مِنْ أَهْلِ الْمَدِينَةِ وَأَثْنَى عَلَيْهِ خَيْرًا عَنْ عُرْوَةَ عَنْ عَائِشَةَ نَحْوَهُ
[Machine] A companion of the Prophet ﷺ fell from a date palm and died. The Prophet ﷺ was then given his inheritance and asked if he had any relatives or family. They replied no, so the Prophet ﷺ said, "Look for some of his family members" and Ibn Bashshar said, "Give it to the people of his tribe."
أَنَّ مَوْلًى لِلنَّبِيِّ ﷺ خَرَّ مِنْ عِذْقِ نَخْلَةٍ فَمَاتَ فَأَتَى النَّبِيُّ ﷺ بِمِيرَاثِهِ فَقَالَ «هَلْ لَهُ مِنْ رَحِمٍ أَوْ نَسَبٍ؟» قَالُوا لَا قَالَ «انْظُرُوا بَعْضَ أَهْلِهِ» وَقَالَ ابْنُ بَشَّارٍ أَهْلَ قَوْمِهِ فَأَعْطُوهُ إِيَّاهُ
[Machine] The Prophet ﷺ said, "Look for someone who could be his support," but they couldn't find anyone, so the Prophet ﷺ said, "Give him the biggest portion of meat."
النَّبِيُّ ﷺ «اطْلُبُوا لَهُ عُصْبَةً» فَلَمْ يَجِدُوا فَقَالَ النَّبِيُّ ﷺ «أَعْطُوهُ أَكْبَرَ خُزَاعَةَ»
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, I have the inheritance of a man from the Azd tribe, but I cannot find any Azd to give it to." The Prophet said, "Go and look for any Azd for a year" or he said, "for a while." So the man went and came back after the first year and said, "O Messenger of Allah, I did not find any Azd." The Prophet said, "Go and give it to the first Khuzai person you meet." When the man turned away, the Prophet said, "Bring him back." So he returned and the Prophet said, "Go and give it to the biggest Khuzai person."
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ عِنْدِي مِيرَاثَ رَجُلٍ مِنَ الْأَزْدِ وَإِنِّي لَمْ أَجِدْ أَزْدِيًّا أَدْفَعُهُ إِلَيْهِ قَالَ «انْطَلِقْ فَالْتَمِسْ أَزْدِيًّا عَامًا» أَوْ قَالَ «حَوْلًا» فَانْطَلَقَ ثُمَّ أَتَاهُ فَجْرَ الْعَامِ الثَّانِي فَقَالَ يَا رَسُولَ اللهِ لَمْ أَجِدْ أَزْدِيًّا قَالَ انْطَلِقْ فَادْفَعْهُ إِلَى أَوَّلِ خُزَاعِيٍّ تَلْقَاهُ فَلَمَّا أَدْبَرَ قَالَ عَلَيَّ بِالرَّجُلِ فَرَجَعَ فَقَالَ انْطَلِقْ فَادْفَعْهُ إِلَى أَكْبَرِ خُزَاعَةَ
[Machine] The Prophet ﷺ was approached by a man who said, "I have inherited property from a man of Azd, but I cannot find any Azdis to give it to." The Prophet ﷺ said, "Go and seek out any Azdis nearby." After some time, the man returned and said, "I still cannot find any Azdis to give the property to." The Prophet ﷺ advised him, "Then go and look for a trustworthy person and give it to him." Muhammad ibn Isma'il said, "The trustworthy person mentioned by the Prophet ﷺ was Kabir bin Khuzay'ah, so give it to him." In the year 6364, Muhammad ibn al-'Ala narrated from Ibn Idris, who said, "I heard Jabriel bin Ahmar narrate from Ibn Buraydah, who said, 'A man came to the Messenger of Allah ﷺ and said, 'O Messenger of Allah, I have inherited property from a man of Azd.' The rest of the narration is mursal."
أَتَى النَّبِيَّ ﷺ رَجُلٌ فَقَالَ إِنَّ عِنْدِي مِيرَاثَ رَجُلٍ مِنِ الْأَزْدِ وَلَسْتُ أَجِدُ أَزْدِيًّا أَدْفَعُهُ إِلَيْهِ قَالَ «فَاذْهَبْ فَالْتَمِسْ أَزْدِيًّا حَوْلًا» فَأَتَاهُ بَعْدَ الْحَوْلِ فَقَالَ لَهُ لَمْ أَجِدْ أَزْدِيًّا أَدْفَعُهُ إِلَيْهِ قَالَ فَاذْهَبْ فَانْظُرْ خَيْرَ خُزَاعَةَ وَقَالَ مُحَمَّدُ بْنُ إِسْمَاعِيلَ «كَبِيرَ خُزَاعَةَ فَادْفَعْهُ إِلَيْهِ» 6364 أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَاءِ قَالَ حَدَّثَنَا ابْنُ إِدْرِيسَ قَالَ سَمِعْتُ جِبْرِيلَ بْنَ أَحْمَرَ عَنِ ابْنِ بُرَيْدَةَ قَالَ جَاءَ رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ فِي يَدِي مِيرَاثَ رَجُلٍ مِنَ الْأَزْدِ وَسَاقَ الْحَدِيثَ مُرْسَلٌ
31.29 [Machine] Inheritance of Property among Relatives
٣١۔٢٩ تَوْرِيثُ الْمَوَالِي مَعَ ذَوِي الرَّحِمِ
[Machine] "The servant of mine died, leaving behind his daughter. The Messenger of Allah ﷺ divided his wealth between me and his daughter, giving me half and giving her half. Muhammad, meaning the son of Abdullah, said this while referring to his son's sister, Shaddad, from his mother."
مَاتَ مَوْلًى لِي وَتَرَكَ ابْنَتَهُ فَقَسَّمَ رَسُولُ اللهَ ﷺ مَالَهُ بَيْنِي وَبَيْنَ ابْنَتِهِ فَجَعَلَ لِي النِّصْفَ وَلَهَا النِّصْفَ قَالَ مُحَمَّدٌ يَعْنِي ابْنَ عَبْدِ الرَّحْمَنِ وَهِيَ أُخْتُ ابْنِهِ شَدَّادٍ لِأُمِّهِ
[Machine] "Abu Abdullah and this is closer to the correct answer than the one before it."
أَبُو عَبْدِ الرَّحْمَنِ وَهَذَا أَوْلَى بِالصَّوَابِ مِنَ الَّذِي قَبْلَهُ
31.30 [Machine] The mention of allegiance
٣١۔٣٠ ذِكْرُ الْوَلَاءِ
[Machine] "They stipulated her loyalty, so she mentioned that to the Messenger of Allah ﷺ , and he said, 'Buy her and set her free, for loyalty belongs to the one who emancipates.'"
أَنْ يَشْتَرِطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ «اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»
Messenger of Allah ﷺ said, "The wala is for the one who gives the silver (pays the price) and does the favor (of manumission after paying the price). (Using translation from Bukhārī 6760)
قَالَ رَسُولُ اللهِ ﷺ «الْوَلَاءُ لِمَنْ أَعْطَى الْوَرِقَ وَوَلِيَ النِّعْمَةَ»
"I bought Barirah and her masters stipulated that her loyalty (Wala) should be to them, I mentioned that to the Prophet and he said: 'Set her free, and loyalty belongs to the one who pays the silver.''' She said: "so I set her free. The Messenger of Allah called her and gave her the choice regarding her husband, and she chose herself. Her husband was a free man." (Using translation from Nasāʾī 4642)
اشْتَرَيْتُ بَرِيرَةَ فَاشْتَرَطَ أَهْلُهَا وَلَاءَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «أَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْطَى الْوَرِقَ» قَالَتْ فَعَتَقْتُهَا
The Prophet ﷺ said, "The Wala' is for the manumitted (of the slave). (Using translation from Bukhārī 6752)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»
The Prophet ﷺ said, "The Wala' is for the manumitted (of the slave). (Using translation from Bukhārī 6752)
قَالَ رَسُولُ اللهِ ﷺ «إِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ»
[Machine] To buy a female slave for the purpose of setting her free, and they stipulated her loyalty. So she mentioned that to the Messenger of Allah ﷺ , and the Messenger of Allah ﷺ said, "Buy her and set her free, for loyalty belongs to the one who sets free."
أَنْ تَشْتَرِيَ بَرِيرَةَ لِلْعِتْقِ وَأَنَّهُمُ اشْتَرَطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ»
[Machine] "The Messenger of Allah ﷺ said: 'Loyalty belongs to those who show gratitude.'"
رَسُولُ اللهِ ﷺ «الْوَلَاءُ لِمَنْ وَلِيَ النِّعْمَةَ»
[Machine] Barirah came seeking my help in her correspondence, so I said to her, "If you wish, I will write to them once and pay your dowry. Then, I will set you free." Barirah mentioned this to her guardians, and they said, "We agree, as long as you stipulate that the loyalty remains with us." She narrated the incident to the Messenger of Allah, ﷺ , and he said, "Buy her, for indeed loyalty belongs to the one who sets them free." This wording is reported by Ahmad in his Musnad from Al-Harith bin Maskeen, recited upon him. I've also heard it from Ibn Al-Qasim who said: Malik narrated to me from Yahya bin Sa'eed, who narrated from 'Amrah, that Barirah came seeking Aisha's help, and this narration is mursal.
جَاءَتْ بَرِيرَةُ تَسْتَعِينُنِي فِي مُكَاتَبَتِهَا فَقُلْتُ لَهَا إِنْ شَاءَ مَوَالِيكِ صَبَبْتُ لَهُمْ ثَمَنَكِ صَبَّةً وَاحِدَةً وَأَعْتَقْتُكِ فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِمَوَالِيهَا فَقَالُوا لَا إِلَّا أَنْ تَشْتَرِطَ أَنَّ الْوَلَاءَ لَنَا قَالَتْ فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ «اشْتَرِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» وَاللَّفْظُ لِأَحْمَدَ 6375 الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ عَنِ ابْنِ الْقَاسِمِ قَالَ حَدَّثَنِي مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَمْرَةَ أَنَّ بَرِيرَةَ جَاءَتْ تَسْتَعِينُ عَائِشَةَ مُرْسَلٌ
31.31 [Machine] If the emancipator dies and the enslaved remains
٣١۔٣١ إِذَا مَاتَ الْمعَتِقُ وَبَقِيَ الْمُعْتَقُ
[Machine] A man died during the time of the Prophet ﷺ and he did not leave behind any relatives except for a slave whom he had freed. So the Prophet ﷺ gave him his inheritance. Abu Abdur Rahman Awsajah said, "He is not well-known and we do not know anyone who narrates from him except Amr ibn Dinar. We only found this hadith with Awsajah."
أَنَّ رَجُلًا مَاتَ عَلَى عَهْدِ النَّبِيِّ ﷺ وَلَمْ يَتْرُكْ قَرَابَةً إِلَّا عَبْدًا هُوَ أَعْتَقَهُ فَأَعْطَاهُ النَّبِيُّ ﷺ مِيرَاثَهُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ عَوْسَجَةُ لَيْسَ بِالْمَشْهُورِ وَلَا نَعْلَمُ أَنَّ أَحَدًا يَرْوِي عَنْهُ غَيْرَ عَمْرِو بْنِ دِينَارٍ وَلَمْ نَجِدْ هَذَا الْحَدِيثَ إِلَّا عِنْدَ عَوْسَجَةَ
[Machine] The Prophet ﷺ said, "Seek an inheritor for him," but they found no inheritor, so he gave his inheritance to the one he had freed from his descendants. I asked, "Who told you this?" He said, "Awisah narrated it from Ibn Abbas."
النَّبِيُّ ﷺ «ابْتَغُوا لَهُ وَارِثًا» فَلَمْ يَجِدُوا وَارِثًا فَدَفَعَ مِيرَاثَهُ إِلَى الَّذِي أَعْتَقَهُ مِنْ نَسْلِهِ قُلْتُ مَنْ حَدَّثَكَ؟ قَالَ عَوْسَجَةُ عَنِ ابْنِ عَبَّاسٍ
31.32 [Machine] Inheritance of the Followers of Al-Muwalaah
٣١۔٣٢ بَابُ مِيرَاثِ مَوَالِي الْمُوَالَاةِ
'I asked the Messenger of Allah ﷺ: What is the Sunnah regarding a man among the people of the Shirk who accepts Islam at the hand of a man among the Muslims?' So the Messenger of Allah ﷺ said: "He is the closet of the people to him in his life and in his death.'" (Using translation from Tirmidhī 2112)
سَأَلْتُ النَّبِيَّ ﷺ عَنِ الرَّجُلِ مِنَ الْمُشْرِكِينَ يُسْلِمُ عَلَى يَدَيْ رَجُلٍ مِنَ الْمُسْلِمِينَ قَالَ «هُوَ أَوْلَى النَّاسِ بِمَحْيَاهُ وَبِمَمَاتِهِ»
[Machine] Tameem Ad-Dari said, "I asked the Messenger of Allah ﷺ , 'What is the ruling regarding a disbeliever who gives Salaam to a Muslim?' He replied, 'He has more right over his life and his death.' Abu Abdur-Rahman said, 'And this statement is more correct than the one before it.'"
قَالَ تَمِيمٌ الدَّارِيُّ سَأَلْتُ رَسُولَ اللهِ ﷺ قُلْتُ أَرَأَيْتَ الرَّجُلَ مِنْ أَهْلِ الْكُفْرِ يُسْلِمُ عَلَى يَدَيْ رَجُلٍ مِنْ أَهْلِ الْإِسْلَامِ كَيْفَ الْقَضَاءُ فِيهِ؟ قَالَ «هُوَ أَوْلَى النَّاسِ بِمَحْيَاهُ وَبِمَمَاتِهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَهَذَا أَوْلَى بِالصَّوَابِ مِنَ الَّذِي قَبْلَهُ
[Machine] I asked the Messenger of Allah ﷺ about a polytheist man who converts to Islam under the protection of a Muslim man. He said, "He is the closest of people to him in terms of his life and death."
سَأَلْتُ رَسُولَ اللهِ ﷺ عَنِ الرَّجُلِ مِنَ الْمُشْرِكِينَ يُسْلِمُ عَلَى يَدَيِ الرَّجُلِ مِنَ الْمُسْلِمِينَ قَالَ «هُوَ أَوْلَى النَّاسِ بِهِ حَيَاتِهِ وَمَوْتِهِ»
31.33 [Machine] Sale of loyalty
٣١۔٣٣ بَيْعُ الْوَلَاءِ
Messenger of Allah ﷺ forbade the selling or donating the Wala' of a freed slave. (Using translation from Bukhārī 2535)
سَمِعْتُ ابْنَ عُمَرَ يَقُولُ «نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ»
