31.4 [Machine] The inheritance of the only daughter alone.

٣١۔٤ مِيرَاثُ الِابْنَةِ الْوَاحِدَةِ الْمُنْفَرِدَةِ

[Machine] "A woman came to the Prophet ﷺ and said, 'I have given charity on behalf of my mother with a young slave girl, but she has passed away. So, she has come to me as an inheritance.' He (the Prophet) said, 'Allah has rewarded you and honored you with inheritance.' Abu Abdullah Al-Rahman said, 'This is incorrect, and the correct wording is Abdullah ibn Buraida.'"

أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ فَمَاتَتْ فَرَجَعَتْ إِلَيَّ فِي الْمِيرَاثِ فَقَالَ «قَدْ آجَرَكِ اللهُ وَرَدَّ عَلَيْكِ فِي الْمِيرَاثِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ وَالصَّوَابُ عَبْدُ اللهِ بْنُ بُرَيْدَةَ

“A woman came to-the Prophet ﷺ and said: 'O Messenger of Allah ﷺ, I gave my mother a slave girl of mine, and she has died.' The Messenger of Allah ﷺ said: 'Allah (SWT) has rewarded you, and returned to you your inheritance (without your seeking that.' ” (Using translation from Ibn Mājah 2394)

جَاءَتِ امْرَأَةٌ إِلَى النَّبِيِّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ وَإِنَّهَا مَاتَتْ فَقَالَ رَسُولُ اللهِ ﷺ «آجَرَكِ اللهُ وَرَدَّ عَلَيْكِ الْمِيرَاثَ»

أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ فَمَاتَتْ فَقَالَ «قَدْ أجَزاَكِ اللهُ وَرَدَّ عَلَيْكِ الْمِيرَاثَ»

Buraidah said A woman came to the Messenger of Allah ﷺ and said I gave a slave girl as sadaqah to my mother who has now died and has left that slave girl. He said your reward is sure and the inheritance has given her back to you. (Using translation from Abū Dāʾūd 1656)

أَنَّ امْرَأَةً أَتَتْ رَسُولَ اللهِ ﷺ فَقَالَتْ إِنِّي كُنْتُ تَصَدَّقْتُ عَلَى أُمِّي بِوَلِيدَةٍ وَإِنَّهَا مَاتَتْ وَتَرَكَتْ تِلْكَ الْوَلِيدَةَ فَقَالَ «وَجَبَ أَجْرُكِ وَرَجَعَتْ إِلَيْكِ فِي الْمِيرَاثِ»

I became seriously ill at Mecca and the Prophet ﷺ came to visit me. I said, "O Messenger of Allah ﷺ! I shall leave behind me a good fortune, but my heir is my only daughter; shall I bequeath two third of my property to be spent in charity and leave one third (for my heir)?" He said, "No." I said, "Shall I bequeath half and leave half?" He said, "No." I said, "Shall I bequeath one third and leave two thirds?" He said, "One third is alright, though even one third is too much." Then he placed his hand on his forehead and passed it over my face and ʿAbdomen and said, "O Allah! Cure Saʿd and complete his emigration." I feel as if I have been feeling the coldness of his hand on my liver ever since. (Using translation from Bukhārī 5659)   

الكبرى للنسائي:٦٢٨٤أَخْبَرَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ قَالَ حَدَّثَنَا يَحْيَى يَعْنِي ابْنَ سَعِيدٍ الْقَطَّانَ عَنِ الْجَعْدِ يَعْنِي ابْنَ أَوْسٍ قَالَ حَدَّثَتْنِي عَائِشَةُ بِنْتُ سَعْدٍ قَالَتْ

قَالَ سَعْدٌ اشْتَكَيْتُ شَكْوَى بِمَكَّةَ فَدَخَلَ عَلَى رَسُولِ اللهِ ﷺ يَعُودُنِي قُلْتُ يَا رَسُولَ اللهِ إِنِّي تَرَكْتُ مَالًا وَلَيْسَ عِنْدِي إِلَّا ابْنَةٌ وَاحِدَةٌ أَفَأَوْصِي بِثُلُثَيْ مَالِي فَأَتْرُكُ لَهَا الثُّلُثَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالنِّصْفِ فَأَتْرُكُ لَهَا النِّصْفَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالثُّلُثِ وَأَتْرُكُ لَهَا الثُّلُثَيْنِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ» ثَلَاثَ مَرَّاتٍ وَوَضَعَ يَدَهُ عَلَى جَبْهَتِي فَمَسَحَ وَجْهِي وَصَدْرِي وَبَطْنِي قَالَ اللهُمَّ اشْفِ سَعْدًا وَأَتِمَّ لَهُ هِجْرَتَهُ فَمَا زِلْتُ أَجِدُ بَرْدَ يَدِهِ عَلَى كَبِدِي حَتَّى السَّاعَةِ

"The Prophet came to visit me when I was in Makkah. I said: 'O Messenger of Allah, shall I bequeath all my money?' He said: 'No.' I said: 'One-half?' He said: 'No.' I said: 'One-third?' He said: '(Bequeath) one-third, and one-third is a lot. If you leave your heirs independent of means, that is better than if you leave them poor and holding out their hands to people.'" (Using translation from Nasāʾī 3627)

كَانَ النَّبِيُّ ﷺ يَعُودُهُ وَهُوَ بِمَكَّةَ وَلَمْ تَكُنْ لَهُ إِلَّا ابْنَةٌ وَاحِدَةٌ قَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» قَالَ النِّصْفُ؟ قَالَ «لَا» قَالَ فَالثُّلُثُ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ
