59.8 [Machine] The difference between marriage of women from whom jizyah and their sacrificial animals are taken.

٥٩۔٨ بَابُ الْفَرْقِ بَيْنَ نِكَاحِ نِسَاءِ مَنْ يُؤْخَذُ مِنْهُ الْجِزْيَةِ وَذَبَائِحِهِمْ

[Machine] The Messenger of Allah ﷺ sent to the Magians of Hajar, offering them Islam. Whoever accepted Islam, it was accepted from them, and whoever refused, they were required to pay the jizyah tax. They were not allowed to consume sacrificial animals or marry Muslim women. This is an authentic narration confirmed by the consensus of the majority of Muslims. However, what has been narrated from Hudhayfah regarding the marriage of Magian women is not valid, and the narration regarding the marriage of Christian women contradicts the narrations of Umar and Ali. This statement is to be discussed in its appropriate context, God willing.  

البيهقي:١٨٦٦٣أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ عَلِيٍّ الْحَافِظُ الْأَصْبَهَانِيُّ أنبأ أَبُو عَمْرِو بْنُ حَمْدَانَ أنبأ الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا وَكِيعٌ ثنا سُفْيَانُ عَنْ قَيْسِ بْنِ مُسْلِمٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ عَلِيٍّ قَالَ كَتَبَ

رَسُولُ اللهِ ﷺ إِلَى مَجُوسِ هَجَرَ يَعْرِضُ عَلَيْهِمُ الْإِسْلَامَ فَمَنْ أَسْلَمَ قَبِلَ مِنْهُ وَمَنْ أَبَى ضُرِبَتْ عَلَيْهِ الْجِزْيَةُ عَلَى أَنْ لَا تُؤْكَلَ لَهُمْ ذَبِيحَةٌ وَلَا تُنْكَحَ لَهُمُ امْرَأَةٌ هَذَا مُرْسَلٌ وَإِجْمَاعُ أَكْثَرِ الْمُسْلِمِينَ عَلَيْهِ يُؤَكِّدُهُ وَلَا يَصِحُّ مَا رُوِيَ عَنْ حُذَيْفَةَ فِي نِكَاحِ مَجُوسِيَّةٍ وَالرِّوَايَةُ فِي نَصَارَى بَنِي تَغْلِبَ عَنْ عُمَرَ وَعَلِيٍّ ؓ تَرِدُ فِي مَوْضِعِهَا إِنْ شَاءَ اللهُ تَعَالَى
