59. Jizyah
٥٩۔ كِتَابُ الْجِزْيَةِ
وَأَنْ لَا يَغْمِسُوا أَوْلَادَهُمْ
[Machine] "That they should not be compelled in a religion other than their own, as Dawud used to say, 'There is no obligation except for those who have submitted willingly'."
أَنْ لَا يُكْرَهُوا عَلَى دِينٍ غَيْرِ دِينِهِمْ فَكَانَ دَاوُدُ يَقُولُ مَا لِبَنِي تَغْلِبَ ذِمَّةٌ؛ قَدْ صَبَغُوا
[Machine] That they do not immerse any of their children in Christianity and that the charity is doubled for them. He said, and Ubada said, "They have done so, and it is not their covenant." 18797 Abu Sa'eed ibn Abi 'Amr informed us that Abu Al-'Abbas narrated that Ar-Rabi' said that Ash-Shafi'i said after this hadith, and this is how the people of Maghazi have memorized it and transmitted it better than this context, so they said, "It was aimed at them in terms of jizyah." They said, "We are Arabs; we do not pay what the non-Arabs pay. But take from us as some of you take from others, meaning charity." So 'Umar said, "No, this is an obligation on the Muslims." So they said, "Increase as much as you want with this name, not with the name of jizyah." So he did, and they agreed that the charity be weakened for them.
أَنْ لَا يَغْمِسُوا أَحَدًا مِنْ أَوْلَادِهِمْ فِي النَّصْرَانِيَّةِ وَتُضَاعَفَ عَلَيْهِمُ الصَّدَقَةُ قَالَ وَكَانَ عُبَادَةُ يَقُولُ قَدْ فَعَلُوا وَلَا عَهْدَ لَهُمْ 18797 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ عُقَيْبَ هَذَا الْحَدِيثِ وَهَكَذَا حَفِظَ أَهْلُ الْمَغَازِي وَسَاقُوهُ أَحْسَنَ مِنْ هَذَا السِّيَاقِ فَقَالُوا رَامَهُمْ عَلَى الْجِزْيَةِ فَقَالُوا نَحْنُ عَرَبٌ لَا نُؤَدِّي مَا يُؤَدِّي الْعَجَمُ وَلَكِنْ خُذْ مِنَّا كَمَا يَأْخُذُ بَعْضُكُمْ مِنْ بَعْضٍ يَعْنُونَ الصَّدَقَةَ فَقَالَ عُمَرُ ؓ لَا هَذَا فَرْضٌ عَلَى الْمُسْلِمِينَ فَقَالُوا فَزِدْ مَا شِئْتَ بِهَذَا الِاسْمِ لَا بِاسْمِ الْجِزْيَةِ فَفَعَلَ فَتَرَاضَى هُوَ وَهُمْ عَلَى أَنْ ضَعَّفَ عَلَيْهِمُ الصَّدَقَةَ
