37. Division of War Booty
٣٧۔ كِتَابُ قَسْمِ الْفَيْءِ وَالْغَنِيمَةِ
[Machine] The Messenger of Allah ﷺ contributed two arrows to the knights, and one arrow to his companion.
أَسْهَمَ رَسُولُ اللهِ ﷺ لِلْفَرَسِ سَهْمَيْنِ وَلِصَاحِبِهِ سَهْمًا
[Machine] That the Prophet ﷺ divided the voluntary offering between the horse by two shares, and for the man by one share.
أَنَّ النَّبِيَّ ﷺ قَسَمَ فِي النَّفْلِ لِلْفَرَسِ سَهْمَيْنِ وَلِلرَّجُلِ سَهْمًا
[Machine] That the Messenger of Allah ﷺ allocated three shares for a man: one share for the man and two shares for the horse, and likewise.
أَنَّ رَسُولَ اللهِ ﷺ أَسْهَمَ لِلرَّجُلِ ثَلَاثَةَ أَسْهُمٍ لِلرَّجُلِ سَهْمٌ وَلِلْفَرَسِ سَهْمَانِ وَكَذَلِكَ
[Machine] That the Messenger of Allah ﷺ assigned three arrows for a man and his horse, one arrow for himself and two arrows for his horse, and the same for another person.
أَنَّ رَسُولَ اللهِ ﷺ أَسْهَمَ لِلرَّجُلِ وَلِفَرَسِهِ ثَلَاثَةَ أَسْهُمٍ سَهْمًا لَهُ وَسَهْمَيْنِ لِفَرَسِهِ وَكَذَلِكَ
[Machine] That the Prophet ﷺ divided the spoils of the day of Khaibar; two arrows for the horseman and one arrow for the footman. Abdullah Al-Umari, who was often doubtful, narrated this from another angle, from Al-Qa'nybi, from Abdullah Al-Umari, with hesitation regarding the horseman or horses. Al-Shafi'i commented on this in the past, as if he had heard Nafi' saying to the horseman "two arrows" and to the footman "one arrow." So he said to the horseman "two arrows" and to the footman "one arrow." No one among the knowledgeable people doubts the superiority of Ubaidullah ibn Umar over his brother in memorization.
أَنَّ النَّبِيَّ ﷺ قَسَمَ يَوْمَ خَيْبَرَ لِلْفَارِسِ سَهْمَيْنِ وَلِلرَّاجِلِ سَهْمًا فَعَبْدُ اللهِ الْعُمَرِيُّ كَثِيرُ الْوَهْمِ وَقَدْ رُوِيَ ذَلِكَ مِنْ وَجْهٍ آخَرَ عَنِ الْقَعْنَبِيِّ عَنْ عَبْدِ اللهِ الْعُمَرِيِّ بِالشَّكِّ فِي الْفَارِسِ أَوِ الْفَرَسِ قَالَ الشَّافِعِيُّ فِي الْقَدِيمِ كَأَنَّهُ سَمِعَ نَافِعًا يَقُولُ لِلْفَرَسِ سَهْمَيْنِ وَلِلرَّجُلِ سَهْمًا فَقَالَ لِلْفَارِسِ سَهْمَيْنِ وَلِلرَّاجِلِ سَهْمًا وَلَيْسَ يَشُكُّ أَحَدٌ مِنْ أَهْلِ الْعِلْمِ فِي تَقْدِمَةِ عُبَيْدِ اللهِ بْنِ عُمَرَ عَلَى أَخِيهِ فِي الْحِفْظِ
[Machine] We witnessed the Battle of Hudaybiyah with the Messenger of Allah, ﷺ . When we left, we saw that people were shaking their camel humps. Some of them said to others, "What is this for people?" They said, "Allah has revealed to the Messenger of Allah, ﷺ ." So we went out trembling and found the Prophet, ﷺ , on his camel standing near the foot of the mountain. The people gathered around him, and he recited to them: "Indeed, We have given you a clear victory" [Quran 48:1]. A man said, "O Messenger of Allah, is this a victory?" He said, "Yes, by the One in Whose hand is my soul, it is indeed a victory." Then Khaibar was distributed among the people of Hudaybiyah, and no one entered it except those who witnessed the Battle of Hudaybiyah. The Prophet, ﷺ , divided it into eighteen equal parts, and the army was one thousand five hundred, three hundred of them were horsemen. So he gave two shares to the horsemen and one share to the foot soldier. Al-Shafi'i said in the Qadeem: Mujammal ibn Ya'qoub is an unknown scholar, so we relied on the narration of Ubaydullah, and we did not find any conflicting report like it, nor is it permissible to reject a report except with a report similar to it. The sheikh said, "The narrations about the distribution of Khaibar are conflicting, as it was divided among the people of Hudaybiyah, and the people of Hudaybiyah were, in most narrations, one thousand four hundred."
شَهِدْنَا الْحُدَيْبِيَةَ مَعَ رَسُولِ اللهِ ﷺ فَلَمَّا انْصَرَفْنَا عَنْهَا إِذَا النَّاسُ يَهُزُّونَ الْأَبَاعِرَ فَقَالَ بَعْضُهُمْ لِبَعْضٍ مَا لِلنَّاسِ؟ قَالُوا أَوْحَى اللهُ إِلَى رَسُولِ اللهِ ﷺ فَخَرَجْنَا نُوجِفُ فَوَجَدْنَا النَّبِيَّ ﷺ عَلَى رَاحِلَتِهِ وَاقِفًا عِنْدَ كُرَاعِ الْغَمِيمِ فَاجْتَمَعَ النَّاسُ إِلَيْهِ فَقْرَأَ عَلَيْهِمْ {إِنَّا فَتَحْنَا لَكَ فَتْحًا مُبِينًا} [الفتح 1] فَقَالَ رَجُلٌ يَا رَسُولَ اللهِ أَفَتْحٌ هُوَ؟ فَقَالَ إِي وَالَّذِي نَفْسِي بِيَدِهِ إِنَّهُ لَفَتْحٌ فَقُسِّمَتْ خَيْبَرُ عَلَى أَهْلِ الْحُدَيْبِيَةِ لَمْ يَدْخُلْ مَعَهُمْ فِيهَا أَحَدٌ إِلَّا مَنْ شَهِدَ الْحُدَيْبِيَةَ فَقَسَمَهَا النَّبِيُّ ﷺ عَلَى ثَمَانِيَةَ عَشَرَ سَهْمًا وَكَانَ الْجَيْشُ أَلْفًا وَخَمْسَمِائَةٍ مِنْهُمْ ثَلَاثُمِائَةِ فَارِسٍ فَأَعْطَى الْفَارِسَ سَهْمَيْنِ وَالرَّاجِلَ سَهْمًا قَالَ الشَّافِعِيُّ فِي الْقَدِيمِ مُجَمِّعُ بْنُ يَعْقُوبَ شَيْخٌ لَا يُعْرَفُ فَأَخَذْنَا فِي ذَلِكَ بِحَدِيثِ عُبَيْدِ اللهِ وَلَمْ نَرَ لَهُ خَبَرًا مِثْلَهُ يُعَارِضُهُ وَلَا يَجُوزُ رَدُّ خَبَرٍ إِلَّا بِخَبَرٍ مِثْلِهِ قَالَ الشَّيْخُ وَالرِّوَايَةُ فِي قَسْمِ خَيْبَرَ مُتَعَارِضَةٌ؛ فَإِنَّهَا قُسِّمَتْ عَلَى أَهْلِ الْحُدَيْبِيَةِ وَأَهْلُ الْحُدَيْبِيَةِ كَانُوا فِي أَكْثَرِ الرِّوَايَاتِ أَلْفًا وَأَرْبَعَمِائَةٍ
[Machine] "The Messenger of Allah ﷺ said, 'You are the best of people on Earth today.' Jabir said, 'If it was not for my sight, I would have shown you the location of the tree they brought out.' This narration is from Sahih (authentic) Hadith from Sufyan."
رَسُولُ اللهِ ﷺ أَنْتُمُ الْيَوْمَ خَيْرُ مَنْ عَلَى الْأَرْضِ فَقَالَ جَابِرٌ لَوْلَا بَصَرِي لَأَرَيْتُكُمْ مَوْضِعَ الشَّجَرَةِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ سُفْيَانَ وَكَذَلِكَ
[Machine] Ibn Muhammad ibn Muslimah told me about someone from his family who witnessed it, and Abdullah ibn Abi Bakr ibn Hazm also narrated it to me. They said: The shares were distributed among the people of Khaybar, which amounted to one thousand and eight hundred shares. This was the number of those who the shares of Khaybar were divided among; the companions of the Prophet ﷺ, their horses, and their men. The men were one thousand and four hundred, and the horses were two hundred. Each horse had two shares, and its owner had one share, and each man had one share. The Hadith mentioned the details of the distribution.
حَدَّثَنِي ابْنٌ لِمُحَمَّدِ بْنِ مَسْلَمَةَ عَمَّنْ أَدْرَكَهُ مِنْ أَهْلِهِ وَحَدَّثَنِيهِ عَبْدُ اللهِ بْنُ أَبِي بَكْرِ بْنِ حَزْمٍ قَالَا كَانَتِ الْمَقَاسِمُ عَلَى أَمْوَالِ خَيْبَرَ عَلَى أَلْفٍ وَثَمَانِمِائَةِ سَهْمٍ وَكَانَ ذَلِكَ عَدَدَ الَّذِينَ قُسِمَتْ خَيْبَرُ عَلَيْهِمْ مِنْ أَصْحَابِ النَّبِيِّ ﷺ خَيْلِهِمْ وَرِجَالِهِمْ الرِّجَالُ أَلْفٌ وَأَرْبَعُمِائَةِ رَجُلٍ وَالْخَيْلُ مِائَتَيْ فَرَسٍ فَكَانَ لِلْفَرَسِ سَهْمَانِ وَلِصَاحِبِهِ سَهْمٌ وَلِكُلِّ رَاجِلٍ سَهْمٌ وَذَكَرَ الْحَدِيثَ فِي كَيْفِيَّةِ الْقِسْمَةِ
[Machine] The Prophet ﷺ distributed two arrows to each of two hundred horses on the day of Khaybar. This has been narrated from Salih bin Kaysan, Bashir bin Yasir, and others, who all indicated the same. It has also been narrated with another chain of narration which is considered weak.
أَنَّ النَّبِيَّ ﷺ قَسَمَ لِمِائَتَيْ فَرَسٍ يَوْمَ خَيْبَرَ سَهْمَيْنِ سَهْمَيْنِ وَرُوِّينَا عَنْ صَالِحِ بْنِ كَيْسَانَ وَبَشِيرِ بْنِ يَسَارٍ وَغَيْرِهِمَا مَا دَلَّ عَلَى هَذَا وَرُوِيَ بِإِسْنَادٍ آخَرَ فِيهِ ضَعْفٌ
[Machine] On the Day of Hunayn, I doubt, and indeed they were given six arrows; four for their horses and two for themselves, so they sold the two arrows for two camels.
يَوْمَ حُنَيْنٍ أَنَا أَشُكُّ وَإِنَّهُمَا أُعْطِيَا سِتَّةَ أَسْهُمٍ؛ أَرْبَعَةً لِفَرَسَيْهِمَا وَسَهْمَيْنِ لَهُمَا فَبَاعَا السَّهْمَيْنِ بِبَكْرَيْنِ
[Machine] We came with the Messenger of Allah ﷺ - four men and with us is a horse. He gave each one of us an arrow and gave the horse two arrows. Umayyah bin Khalid narrated from Al-Mas'oodi that there were three arrows for the horse. Abu Ali Ar-Rudhbari informed us, I am Muhammad bin Bakr, narrated to us Abu Dawood, narrated to us Musaddad, narrated to us Umayyah bin Khalid, narrated to us Al-Mas'oodi from a man of the family of Abi 'Amrah, from Abi 'Amrah, and he mentioned its meaning with its addition.
أَتَيْنَا رَسُولَ اللهِ ﷺ أَرْبَعَةَ نَفَرٍ وَمَعَنَا فَرَسٌ فَأَعْطَى كُلَّ إِنْسَانٍ مِنَّا سَهْمًا وَأَعْطَى الْفَرَسَ سَهْمَيْنِ 12875 زَادَ فِيهِ أُمَيَّةُ بْنُ خَالِدٍ عَنِ الْمَسْعُودِيِّ فَكَانَ لِلْفَارِسِ ثَلَاثَةُ أَسْهُمٍ أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُسَدَّدٌ ثنا أُمَيَّةُ بْنُ خَالِدٍ ثنا الْمَسْعُودِيُّ عَنْ رَجُلٍ مِنْ آلِ أَبِي عَمْرَةَ عَنْ أَبِي عَمْرَةَ فَذَكَرَ مَعْنَاهُ بِزِيَادَتِهِ
[Machine] The Prophet ﷺ allocated four shares to Zubayr: one share for his mother among her relatives, one share for him, and two shares for his horse. Similarly, ...
أَنَّ النَّبِيَّ ﷺ قَسَمَ لِلزُّبَيْرِ أَرْبَعَةَ أَسْهُمٍ؛ سَهْمًا لِأُمِّهِ فِي الْقُرْبَى وَسَهْمًا لَهُ وَسَهْمَيْنِ لِفَرَسِهِ وَكَذَلِكَ
[Machine] The Prophet ﷺ gave Zubair four arrows on the day of Hunayn: two for the horse, one for himself, and one for the relative. This is one of the oddities of the Zanbari from the narration of Malik, and it is only known through the first chain of narration, and it is sufficient.
أَعْطَى النَّبِيُّ ﷺ الزُّبَيْرَ يَوْمَ حُنَيْنٍ أَرْبَعَةَ أَسْهُمٍ؛ سَهْمَيْنِ لِلْفَرَسِ وَسَهْمًا لَهُ وَسَهْمًا لِلْقَرَابَةِ هَذَا مِنْ غَرَائِبِ الزَّنْبَرِيِّ عَنْ مَالِكٍ وَإِنَّمَا يُعْرَفُ بِالِإسْنَادِ الْأَوَّلِ وَفِيهِ كِفَايَةٌ
[Machine] When the Messenger of Allah ﷺ conquered Mecca, Zubayr was on the left side of the cavalry and Mikdad ibn Aswad was on his right side. He said, "When the Messenger of Allah ﷺ entered, he wiped the dust off their faces with his garment and said, 'I have allocated two arrows for the horse and one arrow for the rider. Whoever falls short of it, Allah will fall short with him.' In this matter, besides what we mentioned about Umar, Talha, Zubayr, Mikdad, Abu Hurairah, and Sahl ibn Abi Hathmah, there is sufficient evidence."
لَمَّا فَتَحَ رَسُولُ اللهِ ﷺ مَكَّةَ كَانَ الزُّبَيْرُ عَلَى الْمَجْنَبَةِ الْيُسْرَى وَكَانَ الْمِقْدَادُ بْنُ الْأَسْوَدِ عَلَى مَجْنَبَتِهِ الْيُمْنَى قَالَ فَلَمَّا دَخَلَ رَسُولُ اللهِ ﷺ فَمَسَحَ الْغُبَارَ عَنْ وُجُوهِهِمَا بِثَوْبِهِ وَقَالَ إِنِّي جَعَلْتُ لِلْفَرَسِ سَهْمَيْنِ وَلِلْفَارِسِ سَهْمًا فَمَنْ نَقَصَهُ نَقَصَهُ اللهُ وَفِي الْبَابِ سِوَى مَا ذَكَرْنَا عَنْ عُمَرَ وَطَلْحَةَ وَالزُّبَيْرِ وَالْمِقْدَادِ وَأَبِي هُرَيْرَةَ وَسَهْلِ بْنِ أَبِي حَثْمَةَ عَنِ النَّبِيِّ ﷺ وَفِي بَعْضِ مَا ذَكَرْنَا كِفَايَةٌ
[Machine] The division and distribution of spoils only took place in the battle of Banu Qurayza, and at that time there were thirty-six horses, which the Messenger of Allah ﷺ was most knowledgeable about their worth. According to his custom, the division took place. On that day, the Messenger of Allah ﷺ allotted three arrows to each horseman: one arrow for himself, two arrows for his horse, and one arrow for the foot soldier. As for the day of Badr, the two arrows were not used and no spoils were distributed among the Muslims until what Allah willed for them came, so He permitted it for them after they were on the verge of destruction, saying, "If there had not been before a decree from Allah forbidding the division of the spoils of war, it would have been distributed among them." [Quran 8:68] until the end of the two verses. Then came the day of Uhud, which was a year of calamity, followed by the year of the ditch, which was a year of siege. Then came the time of the Banu Qurayza, and the division took place according to his custom up until this day.
لَمْ يَقَعِ الْقَسْمُ وَلَا السَّهْمُ إِلَّا فِي غَزَاةِ بَنِي قُرَيْظَةَ وَكَانَتِ الْخَيْلُ يَوْمَئِذٍ سِتَّةً وَثَلَاثِينَ فَرَسًا فَفِيهَا أَعْلَمَ رَسُولُ اللهِ ﷺ سُهْمَانَ الْخَيْلِ وَسُهْمَانَ الرِّجَالِ فَعَلَى سُنَّتِهَا جَرَتِ الْمَقَاسِمُ فَجَعَلَ رَسُولُ اللهِ ﷺ يَوْمَئِذٍ لِلْفَارِسِ وَفَرَسِهِ ثَلَاثَةَ أَسْهُمٍ؛ لَهُ سَهْمٌ وَلِفَرَسِهِ سَهْمَانِ وَلِلرَّاجِلِ سَهْمًا فَأَمَّا يَوْمُ بَدْرٍ فَلَمْ يَقَعْ فِيهِ السُّهْمَانُ وَلَمْ تَحْلِلْ لَهُمْ فِيهِ الْمَغَانِمُ حَتَّى كَانَ فِيهِ مِنَ اللهِ مَا كَانَ فَأَحَلَّهَا لَهُمْ بَعْدَ أَنْ كَادَ النَّاسُ يَهْلِكُوا فَقَالَ {لَوْلَا كِتَابٌ مِنَ اللهِ سَبَقَ} [الأنفال 68] إِلَى آخِرِ الْآيَتَيْنِ ثُمَّ كَانَ يَوْمُ أُحُدٍ فَكَانَ عَامَ مُصِيبَةٍ ثُمَّ كَانَ عَامُ الْخَنْدَقِ فَكَانَ عَامَ حِصَارٍ ثُمَّ كَانَتْ بَنُو قُرَيْظَةَ فَعَلَى سُنَّتِهَا جَرَتِ الْمَقَاسِمُ إِلَى يَوْمِكَ هَذَا
[Machine] About the Prophet ﷺ , he said to the horseman, "Three arrows for you, and one arrow for the man."
عَنِ النَّبِيِّ ﷺ قَالَ لِلْفَارِسِ ثَلَاثَةُ أَسْهُمٍ وَلِلرَّاجِلِ سَهْمٌ
[Machine] Abu Amro Al-Adibi informed us, I am Abu Bakr Al-Isma'ili, I am Al-Hadrami. Ahmad bin Abdullah bin Yunus narrated to us, who narrated from Israel, from Al-Aswad bin Qais, from Kulthum Al-Wadi'i, from Mundhir bin Amr Al-Wadi'i. Omar appointed him on horseback to go to Sham, and there were Barazin (slave soldiers) with him. He said, "The horses were faster and the companions of the Barazin came." Then Mundhir bin Amr divided two arrows for the horses and one arrow for his companion, and then he wrote to Umar bin Al-Khattab saying, "You have followed the Sunnah, and in the old book, there is a narration from Abu Abdur-Rahman, from Ash-Shafi'i, the Hadith of Shadhan, from Zuheir, from Abu Ishaq who said, "I went on a military expedition with Sa'id bin Uthman, and he gave two arrows to my horse and one arrow to me." Abu Ishaq said, "Hane ibn Hane narrated to me about Ali." Harithah bin Muzarrab also narrated to me about Umar.
أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أنا الْحَضْرَمِيُّ ثنا أَحْمَدُ بْنُ عَبْدِ اللهِ بْنِ يُونُسَ ثنا إِسْرَائِيلُ عَنِ الْأَسْوَدِ بْنِ قَيْسٍ عَنْ كُلْثُومٍ الْوَادِعِيِّ عَنْ مُنْذِرِ بْنِ عَمْرٍو الْوَادِعِيِّ وَكَانَ عُمَرُ ؓ بَعَثَهُ عَلَى خَيْلٍ بِالشَّامِ وَكَانَ فِي الْخَيْلِ بَرَاذِينُ قَالَ فَسَبَقَتِ الْخَيْلُ وَجَاءَ أَصْحَابُ الْبَرَاذِينِ قَالَ ثُمَّ إِنَّ الْمُنْذِرَ بْنَ عَمْرٍو قَسَمَ لِلْفَرَسِ سَهْمَيْنِ وَلِصَاحِبِهِ سَهْمًا ثُمَّ كَتَبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ فَقَالَ قَدْ أَصَبْتَ السُّنَّةَ وَفِي كِتَابِ الْقَدِيمِ رِوَايَةَ أَبِي عَبْدِ الرَّحْمَنِ عَنِ الشَّافِعِيِّ حَدِيثُ شَاذَانَ عَنْ زُهَيْرٍ عَنْ أَبِي إِسْحَاقَ قَالَ غَزَوْتُ مَعَ سَعِيدِ بْنِ عُثْمَانَ فَأَسْهَمَ لِفَرَسِي سَهْمَيْنِ وَلِي سَهْمًا قَالَ أَبُو إِسْحَاقَ وَبِذَلِكَ حَدَّثَنِي هَانِئُ بْنُ هَانِئٍ عَنْ عَلِيٍّ ؓ وَكَذَلِكَ حَدَّثَنِي حَارِثَةُ بْنُ مُضَرِّبٍ عَنْ عُمَرَ ؓ
