37. Division of War Booty
٣٧۔ كِتَابُ قَسْمِ الْفَيْءِ وَالْغَنِيمَةِ
[Machine] So we agreed with the Messenger of Allah ﷺ when he opened Khaibar and he gave us (some of its wealth). And he did not distribute anything from the spoils of Khaibar to anyone who was absent from its conquest except those who witnessed it with him, except for the companions of our ship with Ja'far and his companions, so he distributed with them.
فَوَافَقْنَا رَسُولَ اللهِ ﷺ حِينَ افْتَتَحَ خَيْبَرَ فَأَسْهَمَ لَنَا أَوْ قَالَ أَعْطَانَا مِنْهَا وَمَا قَسَمَ لِأَحَدٍ غَابَ عَنْ فَتْحِ خَيْبَرَ مِنْهَا شَيْئًا إِلَّا مَنْ شَهِدَ مَعَهُ إِلَّا أَصْحَابَ سَفِينَتِنَا مَعَ جَعْفَرٍ وَأَصْحَابِهِ فَقَسَمَ لَهُمْ مَعَهُمْ
[Machine] We arrived at the Messenger of Allah ﷺ after the conquest of Khaibar. He showed hospitality to us but did not show hospitality to anyone else, meaning he did not witness the conquest except along with us.
قَدِمْنَا عَلَى رَسُولِ اللهِ ﷺ بَعْدَ فَتْحِ خَيْبَرَ فَأَسْهَمَ لَنَا وَلَمْ يُسْهَمْ لِأَحَدٍ يَعْنِي لَمْ يَشْهَدِ الْفَتْحَ غَيْرَنَا
[Machine] I came to the Messenger of Allah ﷺ and his companions in Khaibar after they had conquered it. I asked the Messenger of Allah ﷺ to give me a share of the spoils, but some of the sons of Sa'id bin Al-'As said, "Do not give him anything, O Messenger of Allah." So I said, "O Messenger of Allah, this is the killer of Ibn Qa'qal." Ibn Sa'id said angrily, may he perish, "He tells a lie! Woe to him! By Allah, we have never seen anyone more hopeful than a wolf coming towards sheep than this man who is announcing the killing of a Muslim man whom Allah had honored through my hand, and he is not even congratulating me." Sufyan said, "I do not remember whether he gave him a share or not." Sufyan said, "I heard Isma'il bin 'Umayyah ask Al-Zuhri about it while I was present, and Abu 'Abdullah Al-Hafiz informed me that Abu Bakr bin Ishaq informed him from Bishr bin Musa from Al-Humaidi from Sufyan that he mentioned it through a similar chain, except that he did not mention the statement of Sufyan, and he added that Sufyan said, 'Al-Sa'idi also narrated it to me from his grandfather from Abu Hurairah from the Prophet ﷺ.'
قَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ وَأَصْحَابِهِ خَيْبَرَ بَعْدَمَا افْتَتَحُوهَا فَسَأَلْتُ رَسُولَ اللهِ ﷺ أَنْ يُسْهِمَ لِي مِنَ الْغَنِيمَةِ فَقَالَ بَعْضُ بَنِي سَعِيدِ بْنِ الْعَاصِ لَا تُسْهِمْ لَهُ يَا رَسُولَ اللهِ فَقُلْتُ يَا رَسُولَ اللهِ هَذَا قَاتِلُ ابْنِ قَوْقَلٍ فَقَالَ ابْنُ سَعِيدٍ وَاعَجَبًا لِوَبْرٍ تَدَلَّى عَلَيْنَا مِنْ قَدُومِ ضَانٍ يَنْعَى عَلَيَّ قَتْلَ رَجُلٍ مُسْلِمٍ أَكْرَمَهُ اللهُ عَلَى يَدِيَّ وَلَمْ يُهِنِّي عَلَى يَدَيْهِ قَالَ سُفْيَانُ فَلَا أَحْفَظُهُ أَنَّهُ قَالَ أَسْهَمَ لَهُ أَوْ لَمْ يُسْهِمْ قَالَ سُفْيَانُ سَمِعْتُ إِسْمَاعِيلَ بْنَ أُمَيَّةَ سَأَلَ الزُّهْرِيَّ عَنْهُ وَأَنَا حَاضِرٌ 12919 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو بَكْرِ بْنُ إِسْحَاقَ أنا بِشْرُ بْنُ مُوسَى ثنا الْحُمَيْدِيُّ ثنا سُفْيَانُ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ إِلَّا أَنَّهُ لَمْ يَذْكُرْ قَوْلَ سُفْيَانَ وَزَادَ قَالَ سُفْيَانُ حَدَّثَنِيهِ السَّعِيدِيُّ أَيْضًا عَنْ جَدِّهِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ
[Machine] That the Messenger of Allah ﷺ sent Aban ibn Sa'id ibn al-Aas on a mission from Medina towards Najd. Aban ibn Sa'id and his companions arrived to the Messenger of Allah ﷺ in Khaybar after he had conquered it, and their horses were tired. Aban ibn Sa'id and his companions said, "Swear to us, O Messenger of Allah." Abu Huraira said, "Do not swear to them, O Messenger of Allah." Aban said, "You swear, and we have a well from a sheep's head." The Prophet ﷺ said, "Sit down, O Aban," and the Messenger of Allah ﷺ did not swear to them. And likewise...
أَنَّ رَسُولَ اللهِ ﷺ بَعَثَ أَبَانَ بْنَ سَعِيدِ بْنِ الْعَاصِ عَلَى سَرِيَّةٍ مِنَ الْمَدِينَةِ قِبَلَ نَجْدٍ فَقَدِمَ أَبَانُ بْنُ سَعِيدٍ وَأَصْحَابُهُ عَلَى رَسُولِ اللهِ ﷺ بِخَيْبَرَ بَعْدَ أَنْ فَتَحَهَا وَإِنَّ حِزَمَ خَيْلِهِمْ لِيفٌ فَقَالَ أَبَانُ بْنُ سَعِيدٍ وَأَصْحَابُهُ اقْسِمْ لَنَا يَا رَسُولَ اللهِ قَالَ أَبُو هُرَيْرَةَ فَقُلْتُ لَا تَقْسِمْ لَهُمْ يَا رَسُولَ اللهِ فَقَالَ أَبَانُ أَنْتَ بِهَا وَبَرٌ تَحَدَّرَ عَلَيْنَا مِنْ رَأْسِ ضَانٍ فَقَالَ النَّبِيُّ ﷺ اجْلِسْ يَا أَبَانُ وَلَمْ يَقْسِمْ لَهُمْ رَسُولُ اللهِ ﷺ وَكَذَلِكَ
[Machine] That Allah opened Khaibar for the Messenger of Allah and Aban ibn Sa'id ibn al-Aas came to him with his horses and asked him to give him and his companions some provisions, but the Messenger of Allah did not do that. Abu Hurairah said: The saddles of their horses were made of soft skin. This agrees with the narration of al-Zubaydi in his text, but it contradicts it in its chain of narrators. Allah knows best. Muhammad ibn Yahya al-Dhuhli said: These two hadiths are reliable; the hadith of Anbasah from the hadith of al-Zubaydi, and the hadith of Sa'id ibn al-Musayyib from the hadith of Sa'id ibn Abdul Aziz.
أَنَّ اللهَ ﷻ فَتَحَ عَلَى رَسُولِ اللهِ ﷺ خَيْبَرَ ثُمَّ جَاءَهُ أَبَانُ بْنُ سَعِيدِ بْنِ الْعَاصِ فِي خَيْلٍ لَهُ فَسَأَلَهُ أَنْ يُسْهِمَ لَهُ وَلِأَصْحَابِهِ فَلَمْ يَفْعَلْ ذَلِكَ رَسُولُ اللهِ ﷺ قَالَ أَبُو هُرَيْرَةَ وَكَانَتْ حِزَمَ خَيْلِهِمُ اللِّيفُ فَهَذَا يُوَافِقُ رِوَايَةَ الزُّبَيْدِيِّ فِي مَتْنِهِ وَيُخَالِفُهُ فِي إِسْنَادِهِ وَاللهُ أَعْلَمُ قَالَ مُحَمَّدُ بْنُ يَحْيَى الذُّهْلِيُّ الْحَدِيثَانِ مَحْفُوظَانِ؛ حَدِيثُ عَنْبَسَةَ مِنْ حَدِيثِ الزُّبَيْدِيِّ وَحَدِيثُ سَعِيدِ بْنِ الْمُسَيِّبِ مِنْ حَدِيثِ سَعِيدِ بْنِ عَبْدِ الْعَزِيزِ
[Machine] I did not witness any spoils of war with the Messenger of Allah ﷺ except for the distribution in Khaibar, as it was specifically for the people of Hudaibiyah. Abu Musa and Abu Hurairah came between Hudaibiyah and Khaibar.
مَا شَهِدْتُ مَعَ رَسُولِ اللهِ ﷺ مَغْنَمًا إِلَّا قَسَمَ لِي إِلَا خَيْبَرَ؛ فَإِنَّهَا كَانَتْ لِأَهْلِ الْحُدَيْبِيَةِ خَاصَّةً وَكَانَ أَبُو مُوسَى وَأَبُو هُرَيْرَةَ جَاءَا بَيْنَ الْحُدَيْبِيَةِ وَبَيْنَ خَيْبَرَ
[Machine] From a group of the Banu Ghifar, they said: Verily, Abu Hurayrah arrived in Al-Madinah while the Prophet ﷺ had already left for Khaybar. He appointed a man from the Banu Ghifar to govern Al-Madinah, whose name was Siba' bin 'Urfutah. Abu Hurayrah said: We found him in the Fajr prayer. And when we finished our prayers, we went to Siba' bin 'Urfutah, who provided us with dates until we reached the Messenger of Allah ﷺ , who had already conquered Khaybar. He addressed the Muslims and included us in their share of the spoils. This narration was reported by Ruwah bin Al-Qasim, through his chain of narrators and its meaning. He said: He sought permission from the people to allocate a portion of the spoils to us, and they granted him permission. He divided 12,924 (spoils) among us. Abu Al-Hasan bin Abi Al-Ma'roof Al-Isfaraayini and Abu 'Amr Isma'il bin Nujayd As-Sulami both narrated from Abu 'Abdullah Al-Bushanjee, who narrated from 'Umayah bin Bistam, who narrated from Yazid bin Zurai', who narrated from Ruwah bin Al-Qasim, who mentioned this narration after the conquest of Khaybar, and the most authentic narration is from the one who narrated that he did not participate in the battle, yet he intended to distribute (the spoils) among those who witnessed it, and it is possible that he included them in the distribution with their consent, as mentioned in this narration. عَنْ نَفَرٍ مِنْ بَنِي غِفَارٍ قَالُوا إِنَّ أَبَا هُرَيْرَةَ قَدِمَ الْمَدِينَةَ وَقَدْ خَرَجَ النَّبِيُّ ﷺ إِلَى خَيْبَرَ وَاسْتَخْلَفَ عَلَى الْمَدِينَةِ رَجُلًا مِنْ بَنِي غِفَارٍ يُقَالُ لَهُ سِبَاعُ بْنُ عُرْفُطَةَ قَالَ أَبُو هُرَيْرَةَ فَوَجَدْنَاهُ فِي صَلَاةِ الصُّبْحِ فَلَمَّا فَرَغْنَا مِنْ صَلَاتِنَا أَتَيْنَا سِبَاعَ بْنَ عُرْفُطَةَ فَزَوَّدَنَا تَمْرًا حَتَّى قَدِمْنَا عَلَى رَسُولِ اللهِ ﷺ وَقَدْ فَتَحَ خَيْبَرَ وَكَلَّمَ الْمُسْلِمِينَ فَأَشْرَكونَا فِي سُهْمَانِهِمْ وَرَوَاهُ رَوْحُ بْنُ الْقَاسِمِ عَنْ خُثَيْمِ بْنِ عِرَاكٍ بِإِسْنَادِهِ وَمَعْنَاهُ وَقَالَ فَاسْتَأْذَنَ النَّاسَ أَنْ يَقْسِمَ لَنَا مِنَ الْغَنَائِمِ فَأَذِنُوا لَهُ فَقَسَمَ لَنَا 12924 أَخْبَرَنَا أَبُو الْحَسَنِ بْنُ أَبِي الْمَعْرُوفِ الْإِسْفِرَايِينِيُّ أنا أَبُو عَمْرٍو إِسْمَاعِيلُ بْنُ نُجَيْدٍ السُّلَمِيُّ ثنا أَبُو عَبْدِ اللهِ الْبُوشَنْجِيُّ ثنا أُمَيَّةُ بْنُ بِسْطَامٍ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا رَوْحُ بْنُ الْقَاسِمِ فَذَكَرَهُ الرِّوَايَاتُ فِي قُدُومِهِ بَعْدَ فَتْحِ خَيْبَرَ أَصَحُّ ثُمَّ رِوَايَةُ مَنْ رَوَى أَنَّهُ لَمْ يُسْهِمْ لَهُ أَرَادَ قِسْمَةَ مَنْ شَهِدَهَا وَيُحْتَمَلُ أَنَّهُ أَشْرَكَهُمْ فِي سُهْمَانِهِمْ بِرِضَاهُمْ كَمَا فِي هَذِهِ الرِّوَايَةِ وَاللهُ أَعْلَمُ
[Machine] That the Messenger of Allah ﷺ did not distribute the spoils of war to those absent who did not witness it except for the day of Khaybar. He distributed the spoils of war to those absent from the people of Hudaybiyyah because Allah, Blessed and Exalted, had promised them the spoils of Khaybar. He said, "And Allah has promised you much booty that you will take, and He has hastened for you this [victory]..." [Surah Al-Fath 20]. It was for the people of Hudaybiyyah, both those who witnessed it and those who were absent, as well as those who witnessed it from among other people. And regarding Yunus, he said that Ibn Shihab told us, "By Allah, the most knowledgeable, it has been reported to us that he distributed to 'Uthman ibn 'Affan on the day of Badr, and 'Uthman was delayed with his wife Ruqayyah, the daughter of the Messenger of Allah ﷺ, and she was afflicted with smallpox. Then Zayd ibn Harithah came with the good news of the victory of Badr, and 'Uthman ﷺ was burying Ruqayyah, daughter of the Messenger of Allah ﷺ, in her grave." Ibn Shihab said, "And it has been reported to us that the Messenger of Allah ﷺ distributed to Talhah ibn 'Ubaidullah and Sa'id ibn Zaid, both of whom were absent in Sham." The sheikh said, "We have been narrated from Ibn Ishaq that no one from the people of Hudaybiyyah other than Jabir ibn 'Abdullah al-Ansari was absent from Khaybar. As for his distribution to 'Uthman ibn 'Affan and others of the spoils of Badr, the evidence for this in this book has passed, that it was the Messenger of Allah ﷺ who distributed it as he saw fit, and indeed the spoils became for those who witnessed the battle after the distribution of Badr. أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَقْسِمْ لِغَائِبٍ فِي مَغْنَمٍ لَمْ يَشْهَدْهُ إِلَّا يَوْمَ خَيْبَرَ قَسَمَ لِغَائِبِ أَهْلِ الْحُدَيْبِيَةِ مِنْ أَجْلِ أَنَّ اللهَ تَبَارَكَ وَتَعَالَى كَانَ أَعْطَى خَيْبَرَ الْمُسْلِمِينَ مِنْ أَهْلِ الْحُدَيْبِيَةِ فَقَالَ {وَعَدَكُمُ اللهُ مَغَانِمَ كَثِيرَةً تَأْخُذُونَهَا فَعَجَّلَ لَكُمْ هَذِهِ} [الفتح 20] وَكَانَتْ لِأَهْلِ الْحُدَيْبِيَةِ مَنْ شَهِدَ مِنْهُمْ وَمَنْ غَابَ وَلِمَنْ شَهِدَ مِنَ النَّاسِ غَيْرِهِمْ وَعَنْ يُونُسَ قَالَ قَالَ ابْنُ شِهَابٍ بَلَغَنَا وَاللهُ أَعْلَمُ أَنَّهُ قَسَمَ لِعُثْمَانَ بْنِ عَفَّانَ ؓ يَوْمَ بَدْرٍ وَكَانَ عُثْمَانُ ؓ تَخَلَّفَ عَلَى امْرَأَتِهِ رُقَيَّةَ بِنْتِ رَسُولِ اللهِ ﷺ وَأَصَابَتْهَا الْحَصْبَةُ فَجَاءَ زَيْدُ بْنُ حَارِثَةَ بَشِيرًا بِوَقْعَةِ بَدْرٍ وَعُثْمَانُ ؓ عَلَى قَبْرِ رُقَيَّةَ بِنْتِ رَسُولِ اللهِ ﷺ يَدْفِنُهَا قَالَ ابْنُ شِهَابٍ وَبَلَغَنَا أَنَّ رَسُولَ اللهِ ﷺ قَسَمَ لِطَلْحَةَ بْنِ عُبَيْدِ اللهِ وَسَعِيدِ بْنِ زَيْدٍ وَكَانَا غَائِبَيْنِ بِالشَّامِ قَالَ الشَّيْخُ قَدْ رُوِّينَا عَنِ ابْنِ إِسْحَاقَ أَنَّهُ لَمْ يَغِبْ عَنْ خَيْبَرَ مِنْ أَهْلِ الْحُدَيْبِيَةِ إِلَّا جَابِرَ بْنَ عَبْدِ اللهِ الْأَنْصَارِيَّ وَأَمَّا قِسْمَتُهُ لِعُثْمَانَ بْنِ عَفَّانَ وَغَيْرِهِ مِنْ غَنَائِمَ بَدْرٍ فَقَدْ مَضَتِ الدَّلَالَةُ فِي هَذَا الْكِتَابِ عَلَى أَنَّهَا كَانَتْ لِرَسُولِ اللهِ ﷺ يَضَعُهَا حَيْثُ أَرَاهُ اللهُ ﷻ وَإِنَّمَا صَارَتِ الْغَنِيمَةُ لِمَنْ شَهِدَ الْوَقْعَةَ بَعْدَ قِسْمَةِ بَدْرٍ وَاللهُ أَعْلَمُ
[Machine] The people of 'Utârid took control of the water of Basrah and were supplied with 'Amâr from Kufah. He went out before the event and arrived after it. He said, "We are partners with them in the spoils." Then a man from Banî 'Utârid stood up and said, "O servant adorned with honor, do you want us to divide our spoils for you?" His ear had been injured in the way of Allah. (The Prophet) said, "Do you insult me over the loss of my dearest ear or my better ear?" Then he wrote to 'Umar. He wrote that the spoils are for those who witnessed the event, and it has been narrated to us from Abu Bakr as-Siddiq in another narration that he wrote, "The spoils are only for those who witnessed the event."
غَزَتْ بَنُو عُطَارِدٍ مَاءَ الْبَصْرَةِ وَأُمِدُّوا بِعَمَّارٍ مِنَ الْكُوفَةِ فَخَرَجَ قَبْلَ الْوَقْعَةِ وَقَدِمَ بَعْدَ الْوَقْعَةِ فَقَالَ نَحْنُ شُرَكَاؤُهُمْ فِي الْغَنِيمَةِ فَقَامَ رَجُلٌ مِنْ بَنِي عُطَارِدٍ فَقَالَ أَيُّهَا الْعَبْدُ الْمُجَدَّعُ تُرِيدُ أَنْ نَقْسِمَ لَكَ غَنَائِمَنَا؟ وَكَانَتْ أُذُنُهُ أُصِيبَتْ فِي سَبِيلِ اللهِ فَقَالَ عَيَّرْتُمُونِي بِأَحَبِّ أُذُنِيَّ أَوْ خَيْرِ أُذُنِيَّ قَالَ فَكَتَبَ فِي ذَلِكَ إِلَى عُمَرَ ؓ فَكَتَبَ أَنَّ الْغَنِيمَةَ لِمَنْ شَهِدَ الْوَقْعَةَ وَرُوِّينَا عَنْ أَبِي بَكْرٍ الصِّدِّيقِ ؓ فِي قِصَّةٍ أُخْرَى أَنَّهُ كَتَبَ إِنَّمَا الْغَنِيمَةُ لِمَنْ شَهِدَ الْوَقْعَةَ
[Machine] And the people of Sham said, "Why have you not witnessed the battles? You have no share with us." Habib refused to join them, and his companions gathered their spoils. The people of Sham and the people of Iraq argued about that, to the point that it almost caused a conflict between them. Some of the people of Iraq said, "If you kill Salman, we will kill your beloved companion. If you go towards Ibn 'Affan, we will follow suit." Abu Bakr al-Ghassani said, "I heard that this was the first enmity that occurred between the people of Sham and the people of Iraq."
وَقَالَ أَهْلُ الشَّامِ لَمْ تَشْهَدُوا الْقِتَالَ لَيْسَ لَكُمْ مَعَنَا شَيْءٌ وَأَبَى حَبِيبٌ أَنْ يُشْرِكَهُمْ وَحَوَى وَأَصْحَابُهُ عَلَى غَنِيمَتِهِمْ فَتَنَازَعَ أَهْلُ الشَّامِ وَأَهْلُ الْعِرَاقِ فِي ذَلِكَ حَتَّى كَادَ يَكُونُ بَيْنَهُمْ فِي ذَلِكَ كَوْنٌ فَقَالَ بَعْضُ أَهْلِ الْعِرَاقِ إِنْ تَقْتُلُوا سَلْمَانَ نَقْتُلْ حَبِيبَكُمْ وَإِنْ تَرْحَلُوا نَحْوَ ابْنِ عَفَّانَ نَرْحَلْ قَالَ أَبُو بَكْرٍ الْغَسَّانِيُّ فَسَمِعْتُ أَنَّهَا أَوَّلُ عَدَاوَةٍ وَقَعَتْ بَيْنَ أَهْلِ الشَّامِ وَأَهْلِ الْعِرَاقِ
