37. Division of War Booty

٣٧۔ كِتَابُ قَسْمِ الْفَيْءِ وَالْغَنِيمَةِ

37.39 [Machine] The secret mission emerges from an enemy military camp. Al-Shafi'i said: Muslim armies have already marched and seized abundant spoils, and the majority of the soldiers were at the battle of Hunayn. They shared the spoils while being with the Messenger of Allah ﷺ .

٣٧۔٣٩ بَابُ السَّرِيَّةِ تَخْرُجُ مِنْ عَسْكَرٍ فِي بِلَادِ الْعَدُوِّ قَالَ الشَّافِعِيُّ: قَدْ مَضَتْ خَيْلٌ لِلْمُسْلِمِينَ فَغَنِمَتْ بِأَوْطَاسَ غَنَائِمَ كَثِيرَةً، وَأَكْثَرُ الْعَسْكَرِ بِحُنَيْنٍ، فَشَرَكُوهُمْ وَهُمْ مَعَ رَسُولِ اللهِ ﷺ

[Machine] When the Prophet ﷺ finished from Hunayn, he sent Abu 'Amir to the army of Autas. He met Dura'id ibn Asimah, who got killed, and Allah granted victory to his companions. This hadith was mentioned in Sahih from Abu Kurayb.  

البيهقي:١٢٩٢٨أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ حَدَّثَنِي أَبِي وَعَبْدُ اللهِ بْنُ مُحَمَّدٍ قَالَ أَبِي أَخْبَرَنَا وَقَالَ عَبْدُ اللهِ حَدَّثَنَا أَبُو كُرَيْبٍ ثنا أَبُو أُسَامَةَ عَنْ بُرَيْدٍ عَنْ أَبِي بُرْدَةَ عَنْ أَبِي مُوسَى قَالَ

لَمَّا فَرَغَ النَّبِيُّ ﷺ مِنْ حُنَيْنٍ بَعَثَ أَبَا عَامِرٍ عَلَى جَيْشِ أَوْطَاسَ فَلَقِيَ دُرَيْدَ بْنَ الصِّمَّةِ فَقُتِلَ دُرَيْدٌ وَهَزَمَ اللهُ أَصْحَابَهُ وَذَكَرَ الْحَدِيثَ أَخْرَجَاهُ فِي الصَّحِيحِ عَنْ أَبِي كُرَيْبٍ

[Machine] The Messenger of Allah ﷺ delivered a sermon during the Year of the Conquest and said, "O people, indeed there were oaths taken in the times of ignorance (pre-Islamic era), and the strength of Islam has only increased them. There are no oaths in Islam. The Muslims have a hand over those who are not among them, their lowest rank is their responsibility, and their highest rank is their defense. Their armies will retaliate against them, while they stay in their forts. The rest of the hadith was mentioned."  

البيهقي:١٢٩٢٩أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ ثنا يُونُسُ بْنُ بُكَيْرٍ عَنِ ابْنِ إِسْحَاقَ قَالَ حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

خَطَبَ رَسُولُ اللهِ ﷺ عَامَ الْفَتْحِ فَقَالَ أَيُّهَا النَّاسُ إِنَّهُ مَا كَانَ مِنْ حِلْفٍ فِي الْجَاهِلِيَّةِ فَإِنَّ الْإِسْلَامَ لَمْ يَزِدْهُ إِلَّا شِدَّةً وَلَا حِلْفَ فِي الْإِسْلَامِ وَالْمُسْلِمُونَ يَدٌ عَلَى مَنْ سِوَاهُمْ يَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ يَرُدُّ عَلَيْهِمْ أَقْصَاهُمْ تُرَدُّ سَرَايَاهُمْ عَلَى قَعَدَتِهِمْ وَذَكَرَ بَاقِيَ الْحَدِيثِ

[Machine] "To go back to your group and not advance upon them; for we have no power over them." So he said, "As for me, I will make a covenant with God not to harm them and I will associate with them." When daylight came, they found that they had filled the earth. So he and his associates attacked and defeated the enemy, gaining much spoils. The people who did not participate in the fight joined them and said, "We are partners with you in the spoils." Those who witnessed the battle said, "You have no share, for you did not participate in the fight." Abdullah bin Zubair, who was among those who fought alongside Habib, wrote to Muawiya saying, "You have no share in this." Muawiya wrote to Umar ibn Al-Khattab about it, and Umar wrote back. And the poet Al-Bahr Al-Rajz said, "Indeed, Habib is a bad companion and the son of Zubair is a trouble-maker. They are not reliable nor trustworthy in people's affairs."  

البيهقي:١٢٩٣٠أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ أنا أَبُو الْفَضْلِ بْنُ خَمِيرَوَيْهِ ثنا أَحْمَدُ بْنُ نَجْدَةَ ثنا الْحَسَنُ بْنُ الرَّبِيعِ ثنا عَبْدُ اللهِ بْنُ الْمُبَارَكِ عَنِ ابْنِ أَبِي ذِئْبٍ قَالَ بَلَغَنَا أَنَّ حَبِيبَ بْنَ مَسْلَمَةَ غَزَا الرُّومَ فَأَخَذُوا رَجُلًا فَاتَّهَمُوهُ فَأَخْبَرَهُمْ أَنَّهُ عَيْنٌ فَقَالَ هَذَا مَلِكُ الرُّومِ فِي النَّاسِ وَرَاءَ هَذَا الْجَبَلِ فَقَالَ لِأَصْحَابِهِ أَشِيرُوا عَلَيَّ فَقَالَ بَعْضُهُمْ نَرَى أَنْ تُقِيمَ حَتَّى يَلْحَقَ بِكَ النَّاسُ وَكَانُوا مُنْقَطِعِينَ وَقَالَ بَعْضُهُمْ نَرَى

أَنْ تَرْجِعَ إِلَى فِئَتِكَ وَلَا تَقْدُمْ عَلَى هَؤُلَاءِ؛ فَإِنَّهُ لَا طَاقَةَ لَنَا بِهِمْ فَقَالَ أَمَّا أَنَا فَأُعْطِي اللهَ عَهْدًا لَا أَخِيسُ بِهِ لَأُخَالِطَنَّهُمْ فَلَمَّا ارْتَفَعَ النَّهَارُ إِذَا هُوَ بِهِمْ قَدْ مَلَئُوا الْأَرْضَ فَحَمَلَ وَحَمَلَ أَصْحَابُهُ فَانْهَزَمَ الْعَدُوُّ وَأَصَابُوا غَنَائِمَ كَثِيرَةً فَلَحِقَ النَّاسُ الَّذِينَ لَمْ يَحْضُرُوا الْقِتَالَ وَقَالُوا نَحْنُ شُرَكَاؤُكُمْ فِي الْغَنِيمَةِ وَقَالَ الَّذِينَ شَهِدُوا الْقِتَالَ لَيْسَ لَكُمْ نَصِيبٌ؛ لَمْ تَحْضُرُوا الْقِتَالَ وَقَالَ عَبْدُ اللهِ بْنُ الزُّبَيْرِ وَكَانَ مِمَّنْ حَضَرَ مَعَ حَبِيبٍ لَيْسَ لَكُمْ نَصِيبٌ فَكَتَبَ بِذَلِكَ إِلَى مُعَاوِيَةَ فَكَتَبَ أَنِ اقْسِمْ بَيْنَهُمْ كُلِّهِمْ قَالَ وَأَظُنُّ مُعَاوِيَةَ كَانَ كَتَبَ بِذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ فَكَتَبَ بِذَلِكَ عُمَرُ ؓ وَقَالَ الشَّاعِرُ [البحر الرجز] إِنَّ حَبِيبًا بِئْسَ مَا يُوَاسِي وَابْنُ الزُّبَيْرِ ذَاهِبُ الْأَقْسَاسِ لَيْسُوا بِأَنْجَادٍ وَلَا أكيَاسِ وَلَا رَفِيقًا بِأُمُورِ النَّاسِ
