56. Theft (2/4)
٥٦۔ كِتَابُ السَّرِقَةِ ص ٢
[Machine] I was presented to the Messenger of Allah ﷺ on the day of Uhud when I was fourteen years old, and he considered me too young. Then, I was presented to him on the day of Khandaq when I was fifteen years old, and he accepted me.
عُرِضْتُ عَلَى رَسُولِ اللهِ ﷺ يَوْمَ أُحُدٍ وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ سَنَةً فَاسْتَصْغَرَنِي وَعُرِضْتُ عَلَيْهِ يَوْمَ الْخَنْدَقِ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ فَقَبِلَنِي
[Machine] Indeed, this is the boundary between the young and the old.
إِنَّ هَذَا الْحَدَّ بَيْنَ الصَّغِيرِ وَالْكَبِيرِ
[Machine] Abdullah brought a slave girl who had been stolen and was not free (not married), so he did not cut her (the hand of the thief). Sufyan al-Thawri narrated it from Mis'ar, from Al-Qasim ibn Abdul Rahman, from his father, from Abdullah.
أُتِيَ عَبْدُ اللهِ بِجَارِيَةٍ قَدْ سَرَقَتْ وَلَمْ تُحْصَنْ فَلَمْ يَقْطَعْهَا وَرَوَاهُ سُفْيَانُ الثَّوْرِيُّ عَنْ مِسْعَرٍ عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِيهِ عَنْ عَبْدِ اللهِ
56.8 [Machine] The madman reaches a limit.
٥٦۔٨ بَابُ الْمَجْنُونِ يُصِيبُ حَدًّا
عَنِ الْأَعْمَشِ مَوْصُولًا مَرْفُوعًا
[Machine] Ali encountered a woman from the tribe of Fulan who had committed adultery and was about to be stoned. Ali asked Umar, "O Commander of the Believers, did you order the stoning of this woman?" Umar replied, "Yes." Ali then reminded Umar of the saying of the Prophet ﷺ, 'The pen is lifted from three: from the sleeper until he wakes up, from the child until he reaches puberty, and from the insane until he regains sanity.' Umar acknowledged this and revoked the order. This narration is transmitted by Ata bin Sa'ib from Abu Dhubiyan as a marfu' hadith.
مُرَّ عَلَى عَلِيٍّ بِمَجْنُونَةِ بَنِي فُلَانٍ قَدْ زَنَتْ وَهِيَ تُرْجَمُ فَقَالَ عَلِيٌّ لِعُمَرَ ؓ يَا أَمِيرَ الْمُؤْمِنِينَ أَمَرْتَ بِرَجْمِ فُلَانَةٍ؟ قَالَ نَعَمْ قَالَ أَمَا تَذْكُرُ قَوْلَ رَسُولِ اللهِ ﷺ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ وَعَنِ الْمَجْنُونِ حَتَّى يُفِيقَ ؟ قَالَ نَعَمْ فَأَمَرَ بِهَا فَخَلَّى عَنْهَا وَرَوَاهُ عَطَاءُ بْنُ السَّائِبِ عَنْ أَبِي ظَبْيَانَ مُرْسَلًا مَرْفُوعًا
AbuZubyan said: A woman who had committed adultery was brought to Umar. He gave orders that she should be stoned. Ali passed by just then. He seized her and let her go. Umar was informed of it. He said: Ask Ali to come to me. Ali came to him and said: Commander of the Faithful, you know that the Messenger of Allah ﷺ said: There are three (people) whose actions are not recorded: A boy till he reaches puberty, a sleeper till he awakes, a lunatic till he is restored to reason. This is an idiot (mad) woman belonging to the family of so and so. Someone might have done this action with her when she suffered the fit of lunacy. Umar said: I do not know. Ali said: I do not know. أُتِيَ عُمَرُ ؓ بِامْرَأَةٍ قَدْ فَجَرَتْ فَأَمَرَ بِرَجْمِهَا فَمُرَّ بِهَا عَلَى عَلِيٍّ ؓ وَقَدِ انْطُلِقَ بِهَا لِتُرْجَمَ فَأَخَذَهَا مِنْهُمْ فَخَلَّى سَبِيلَهَا فَأَتَى عُمَرُ ؓ فَأُخْبِرَ أَنَّ عَلِيًّا ؓ خَلَّى سَبِيلَهَا فَقَالَ ادْعُوهُ لِي فَجَاءَ عَلِيٌّ ؓ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ وَاللهِ لَقَدْ عَلِمْتَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ الْغُلَامِ حَتَّى يَبْلُغَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمَعْتُوهِ حَتَّى يَبْرَأَ وَإِنَّ هَذِهِ مَعْتُوهَةُ بَنِي فُلَانٍ لَعَلَّ الَّذِي أَتَاهَا أَتَاهَا وَهِيَ فِي بَلَائِهَا فَقَالَ عُمَرُ لَا أَدْرِي فَقَالَ عَلِيٌّ وَأَنَا لَا أَدْرِي
[Machine] I heard the Prophet ﷺ say, "The pen has been lifted from three: from the child until he reaches puberty, from the sleeper until he wakes up, and from the insane until he regains sanity." He (the narrator) said: And Abu al-Rabi' narrated to us, Hushaym informed us, Khalid al-Hadda narrated from Abu al-Dhuhah from Ali (may Allah be pleased with him), with the same narration.
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ الصَّبِيِّ حَتَّى يَعْقِلَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمَجْنُونِ حَتَّى يُكْشَفَ عَنْهُ 17214 قَالَ وَحَدَّثَنَا أَبُو الرَّبِيعِ ثنا هُشَيْمٌ أنبأ خَالِدٌ الْحَذَّاءُ عَنْ أَبِي الضُّحَى عَنْ عَلِيٍّ ؓ بِمِثْلِ ذَلِكَ
56.9 [Machine] What is a talisman and what is not
٥٦۔٩ بَابُ مَا يَكُونُ حِرْزًا ومَا لَا يَكُونُ
[Machine] It was said to Safwan ibn Umayyah that whoever does not migrate will perish. So Safwan advanced to Medina and slept in the mosque, using his cloak as a pillow. A thief came and took his cloak from under his head. Safwan caught the thief and brought him to the Prophet ﷺ . The Messenger of Allah ﷺ ordered that his hand be cut off. Safwan said, "I did not intend for this to happen, it was charity on his part." The Messenger of Allah ﷺ said, "Why didn't he ask you for it before bringing him to me?" Abu Zakariya narrated to us, Abu Al-Abbas informed us, Rabee'ah informed Ash-Shafi'i, who informed Sufyan ibn 'Uyaynah, from 'Amr, from Tawus, from the Prophet ﷺ , a narration similar to the hadith of Malik. This hadith has been narrated from another chain as well, and it has been narrated by Ibn Kasib, from Sufyan ibn 'Uyaynah, with a connected chain of narration that includes mentioning Ibn 'Abbas, but it is not authentic.
أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ قِيلَ لَهُ مَنْ لَمْ يُهَاجِرْ هَلَكَ فَقَدِمَ صَفْوَانُ الْمَدِينَةَ فَنَامَ فِي الْمَسْجِدِ مُتَوَسِّدًا رِدَاءَهُ فَجَاءَ سَارِقٌ فَأَخَذَ رِدَاءَهُ مِنْ تَحْتِ رَأْسِهِ فَأَخَذَ صَفْوَانُ السَّارِقَ فَجَاءَ بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ تُقْطَعُ يَدُهُ فَقَالَ صَفْوَانُ إِنِّي لَمْ أُرِدْ هَذَا هُوَ عَلَيْهِ صَدَقَةٌ فَقَالَ رَسُولُ اللهِ ﷺ فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ 17216 وَأَخْبَرَنَا أَبُو زَكَرِيَّا ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ أَنْبَأَ الشَّافِعِيُّ أَنْبَأَ سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَمْرٍو عَنْ طَاوُسٍ عَنِ النَّبِيِّ ﷺ مِثْلَ حَدِيثِ مَالِكٍ هَذَا الْمُرْسَلُ يُقَوِّي الْأَوَّلَ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ وَرُوِيَ عَنِ ابْنِ كَاسِبٍ عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ بِإِسْنَادِهِ مَوْصُولًا بِذِكْرِ ابْنِ عَبَّاسٍ فِيهِ وَلَيْسَ بِصَحِيحٍ
[Machine] While Safwan bin Umayyah was lying on the ground in the area of Al-Bat'ha, a man came and took his fur from under his head. The Prophet Mohammed ﷺ was brought to him and ordered that the thief's hand be cut off. The thief said, "I request your forgiveness. Will you accept the intercession of Abu Wahb before you decide?"
بَيْنَمَا صَفْوَانُ بْنُ أُمَيَّةَ مُضْطَجِعٌ بِالْبَطْحَاءِ إِذْ جَاءَ إِنْسَانٌ فَأَخَذَ بُرْدَهُ مِنْ تَحْتِ رَأْسِهِ فَأُتِيَ بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِقَطْعِهِ فَقَالَ إِنِّي أَعْفُو عَنْهُ أَوْ أَتَجَاوَزُ قَالَ فَهَلْ قَبْلَ أَنْ تَأْتِيَنَا بِهِ أَبَا وَهْبٍ؟
I was sleeping in the mosque on a cloak mine whose price was thirty dirhams. A man came and pinched it away from me. The man was seized and brought to the Messenger of Allah ﷺ. He ordered that his hand should be cut off. I came to him and said: Do you cut off only for thirty dirhams ? I sell it to him and make the payment of its price a loan ? He said: Why did you not do so before bringing him to me ? Abu Dawud said: Za'idah has also transmitted it from Simak from Ju'ayd ibn Hujayr. He said: Safwan slept. Mujahid and Tawus said: While he was sleeping a thief came and stole the cloak from beneath his head. The version of AbuSalamah ibn AbdurRahman has: He snatched it away from beneath his head and he awoke. He cried and he (the thief) was seized. Az-Zuhri narrated from Safwan ibn Abdullah. His version has: He slept in the mosque and used his cloak as pillow. A thief came and took his cloak. The thief was seized and brought to the Prophet ﷺ. (Using translation from Abū Dāʾūd 4394)
كُنْتُ نَائِمًا فِي الْمَسْجِدِ عَلَى خَمِيصَةٍ لِي ثَمَنُ ثَلَاثِينَ دِرْهَمًا فَجَاءَ رَجُلٌ فَاخْتَلَسَهَا مِنِّي فَأَخَذَ الرَّجُلَ فَأَتَى بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِهِ لِيُقْطَعَ قَالَ فَأَتَيْتُهُ فَقُلْتُ أَتَقْطَعُهُ مِنْ أَجْلِ ثَلَاثِينَ دِرْهَمًا أَنَا أَبِيعُهُ وَأُنْسِئُهُ ثَمَنَهَا قَالَ أَلَا كَانَ هَذَا قَبْلَ أَنْ تَأْتِيَنِي بِهِ هَكَذَا
[Machine] Al-Shafi'i was wearing a garment of Safwan, which he had acquired by sleeping on it. The Prophet ﷺ cut the thief of his garment.
الشَّافِعِيُّ وَرِدَاءُ صَفْوَانَ كَانَ مُحْرَزًا بِاضْطِجَاعِهِ عَلَيْهِ فَقَطَعَ النَّبِيُّ ﷺ سَارِقَ رِدَائِهِ
[Machine] Uthman ibn Affan used to say, "There is no punishment for a thief until he has taken the stolen goods out of the house."
كَانَ عُثْمَانُ بْنُ عَفَّانَ ؓ يَقُولُ لَيْسَ عَلَى سَارِقٍ قَطْعٌ حَتَّى يُخْرِجَ الْمَتَاعَ مِنَ الْبَيْتِ
[Machine] Do not cut off his hand until he has committed theft.
لَا تَقْطَعْ يَدَهُ حَتَّى يُخْرِجَ السَّرِقَةَ
[Machine] Ali said, "The thief should not be cut off until he takes out the stolen goods from the house." This was also narrated from a different perspective about Ali's intention. Sulayman bin Musa also narrated it from Uthman.
قَالَ عَلِيٌّ ؓ لَا يُقْطَعُ السَّارِقُ حَتَّى يُخْرِجَ الْمَتَاعَ مِنَ الْبَيْتِ وَرُوِي ذَلِكَ مِنْ وَجْهٍ آخَرَ عَنْ عَلِيٍّ ؓ فِي مَعْنَاهُ وَرَوَاهُ أَيْضًا سُلَيْمَانُ بْنُ مُوسَى عَنْ عُثْمَانَ ؓ
Muhammad ibn Yahya ibn Hibban said: A slave stole a plant of a palm-tree from the orchard of a man and planted it in the orchard of his master. The owner of the plant went out in search of the plant and he found it. He solicited help against the slave from Marwan ibn al-Hakam who was the Governor of Medina at that time. Marwan confined the slave and intended to cut off his hand. The slave's master went to Rafi' ibn Khadij and asked him about it. He told him that he had heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. The man then said: Marwan has seized my slave and wants to cut off his hand. I wish you to go with me to him and tell him that which you have heard from the Messenger of Allah ﷺ. So Rafi' ibn Khadij went with him and came to Marwan ibn al-Hakam. Rafi' said to him: I heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. So Marwan gave orders to release the slave and then he was released. Abu Dawud said: Kathar means pith of the palm-tree. (Using translation from Abū Dāʾūd 4388)
فَأَخْبَرَهُ أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ وَالْكَثَرُ الْجُمَّارُ فَقَالَ الرَّجُلُ فَإِنَّ مَرْوَانَ بْنَ الْحَكَمِ أَخَذَ غُلَامًا لِي وَيُرِيدُ قَطْعَ يَدِهِ وَأَنَا أُحِبُّ أَنْ تَمْشِيَ مَعِي إِلَيْهِ فَتُخْبِرَهُ بِالَّذِي سَمِعْتَ مِنْ رَسُولِ اللهِ ﷺ فَمَشَى مَعَهُ رَافِعُ بْنُ خَدِيجٍ حَتَّى أَتَى مَرْوَانَ فَقَالَ أَخَذْتَ غُلَامًا لِهَذَا؟ فَقَالَ نَعَمْ قَالَ مَا أَنْتَ صَانِعٌ بِهِ؟ قَالَ أَرَدْتُ قَطْعَ يَدِهِ قَالَ لَهُ رَافِعُ بْنُ خَدِيجٍ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ فَأَمَرَ مَرْوَانُ بِالْعَبْدِ فَأُرْسِلَ
[Machine] The Messenger of Allah ﷺ said, "There should be no cutting in a hanging fruit or in the harrisah of a mountain. If a thief comes and the spoils have reached the amount of nisab, then cuts should be made. We have narrated this as a connected hadith from 'Amr ibn Shu'aib from his father from his grandfather. Ash-Shafi'i (may Allah have mercy on him) said, "The walls are not a protection for the date palm or its fruits because most of them are permissible, and they enter from its sides. So whoever steals something from a wall of hanging dates, it is not cut unless it enters the grain." Ash-Shafi'i said, "The totality of the boundaries is considered in relation to the stolen property. If the place that was stolen is attributed by the public to being a boundary in a similar place, then it is cut if it enters it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا قَطْعَ فِي ثَمَرٍ مُعَلَّقٍ وَلَا فِي حَرِيسَةِ جَبَلٍ فَإِذَا آوَاهُ الْمُرَاحُ أَوِ الْجَرِينُ فَالْقَطْعُ فِيمَا بَلَغَ ثَمَنَ الْمِجَنِّ وَقَدْ رُوِّينَا هَذَا مَوْصُولًا مِنْ حَدِيثِ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَالْحَوَائِطُ لَيْسَتْ بِحِرْزٍ لِلنَّخْلِ وَلَا لِلثَّمَرِ؛ لِأَنَّ أَكْثَرَهَا مُبَاحٌ يُدْخَلُ مِنْ جَوَانِبِهِ فَمَنْ سَرَقَ مِنْ حَائِطٍ شَيْئًا مِنْ تَمْرٍ مُعَلَّقٍ لَمْ يُقْطَعْ فَإِذَا آوَاهُ الْجَرِينُ قُطِعَ فِيهِ قَالَ الشَّافِعِيُّ وَجُمْلَةُ الْحِرْزَانِ يُنْظَرُ إِلَى الْمَسْرُوقِ فَإِنْ كَانَ الْمَوْضِعَ الَّذِي سُرِقَ فِيهِ تَنْسِبُهُ الْعَامَّةُ إِلَى أَنَّهُ حِرْزٌ فِي مِثْلِ ذَلِكَ الْمَوْضِعِ قُطِعَ إِذَا
56.10 [Machine] The thief is gifted with the theft.
٥٦۔١٠ بَابُ السَّارِقِ تُوهَبُ لَهُ السَّرِقَةُ
[Machine] Sufwan ibn Umayyah was a man from the liberated ones. He came to the Prophet ﷺ and tied his camel and put his cloak on it. Then, he moved aside to relieve himself. A man came and stole his cloak, and brought it to the Messenger of Allah ﷺ . He ordered that it be cut, so Sufwan said, "O Messenger of Allah, shall it be cut while it is my cloak that I will give as a gift?" The Prophet ﷺ said, "Why didn't you come to me before bringing it to me?"
كَانَ صَفْوَانُ بْنُ أُمَيَّةَ رَجُلًا مِنَ الطُّلَقَاءِ فَأَتَى النَّبِيَّ ﷺ فَأَنَاخَ رَاحِلَتَهُ وَوَضَعَ رِدَاءَهُ عَلَيْهَا ثُمَّ تَنَحَّى يَقْضِي الْحَاجَةَ فَجَاءَ رَجُلٌ فَسَرَقَ رِدَاءَهُ فَأَخَذَهُ فَأَتَى بِهِ رَسُولَ اللهِ ﷺ فَأَمَرَ بِهِ أَنْ يُقْطَعَ فَقَالَ يَا رَسُولَ اللهِ تَقْطَعُهُ فِي رِدَائِي أَنَا أَهَبُهُ لَهُ فَقَالَ فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ
[Machine] And by Allah, I will not go to my house until I go to the city and come to Al-Madina. So I came to Al-Madina and was directed to Al-Abbas. While he was sleeping in the mosque with a turban on his head, a thief came and stole it from him. So he took it from him and brought it to the Prophet ﷺ . The Prophet ﷺ ordered it to be cut, so he said, "O Messenger of Allah, it is his." He said, "Then, why didn't you kiss it before bringing it?"
وَاللهِ لَا أَصِلُ إِلَى بَيْتِي حَتَّى أَذْهَبَ إِلَى الْمَدِينَةِ فَأَتَى الْمَدِينَةَ فَدُلَّ عَلَى الْعَبَّاسِ ؓ فَبَيْنَا هُوَ نَائِمٌ فِي الْمَسْجِدِ وَعَلَى رَأْسِهِ قُصَّةٌ فَجَاءَ سَارِقٌ فَسَرَقَهَا فَأَخَذَهَا مِنْهُ فَجَاءَ بِهِ إِلَى النَّبِيِّ ﷺ فَأَمَرَ النَّبِيُّ ﷺ بِقَطْعِهِ فَقَالَ يَا رَسُولَ اللهِ هِيَ لَهُ فَقَالَ فَهَلَّا قَبْلَ أَنْ تَأْتِيَ بِهِ
[Machine] They were concerned about the matter of the woman with the deviated hand who had stolen, so they asked, "Who will speak to the Messenger of Allah ﷺ about her?" They said, "No one would dare except Usama bin Zaid, the beloved of the Messenger of Allah ﷺ ." So Usama spoke to him, and the Messenger of Allah ﷺ asked, "Will you intercede in one of the limits set by Allah?" Then he got up and delivered a sermon, saying, "The people who came before you were destroyed because when the honorable among them stole, they would leave him, but when the weak among them stole, they would establish the prescribed punishment upon him. By Allah! If Fatima, the daughter of Muhammad, were to steal, I would cut off her hand." It is reported in the authentic Hadith of Al-Laith bin Saad, number 17228: Abu Abdullah Al-Hafiz informed us, who was informed by Abu Amr Al-Hiri, who was informed by Abdullah bin Muhammad bin Yunus, who was informed by Abu At-Tahir, who was informed by Ibn Wahb, who was informed by Yunus, from Ibn Shihab, who said: 'Urwa bin Az-Zubair informed me, from Aisha, the wife of the Prophet ﷺ , that the people of Quraysh were most concerned about the matter of the woman who had stolen during the time of the Prophet ﷺ in the Battle of Fath. Then he mentioned the meaning of the Hadith of Al-Laith and added that the woman who had stolen was brought and her hand was cut off. Yunus said that Ibn Shihab said that 'Urwa said that Aisha said, "She repented afterwards and got married, and she used to come to the Messenger of Allah ﷺ and ask for his help."
هَمَّهُمْ أَمْرُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللهِ ﷺ؟ فَقَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللهِ ﷺ؟ فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللهِ ﷺ تَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللهِ؟ ثُمَّ قَامَ فَخَطَبَ فَقَالَ إِنَّمَا هَلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهُمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهُمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ اللَّيْثِ بْنِ سَعْدٍ 17228 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرٍو الْحِيرِيُّ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ يُونُسَ ثنا أَبُو الطَّاهِرِ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الَّتِي سَرَقَتْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ الْفَتْحِ فَذَكَرَ مَعْنَى حَدِيثِ اللَّيْثِ زَادَ ثُمَّ أُتِيَ بِتِلْكَ الْمَرْأَةِ الَّتِي سَرَقَتْ فَقُطِعَتْ يَدُهَا قَالَ يُونُسُ قَالَ ابْنُ شِهَابٍ قَالَ عُرْوَةُ قَالَتْ عَائِشَةُ ؓ فَحَسُنَتْ تَوْبَتُهَا بَعْدُ وَتَزَوَّجَتْ فَكَانَتْ تَأْتِي بَعْدُ رَسُولَ اللهِ ﷺ فَأَرْفَعُ حَاجَتَهَا إِلَى رَسُولِ اللهِ ﷺ
The Messenger of Allah ﷺ Said: Forgive the people of good qualities their slips, but not faults to which prescribed penalties apply. (Using translation from Abū Dāʾūd 4375)
قَالَ رَسُولُ اللهِ ﷺ أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ إِلَّا حَدًّا مِنْ حُدُودِ اللهِ
56.11 [Machine] What is the ruling on the one who steals a young slave from his enclosure?
٥٦۔١١ بَابُ مَا جَاءَ فِي مَنْ سَرَقَ عَبْدًا صَغِيرًا مِنْ حِرْزٍ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: يُقْطَعُ، وَرَوَاهُ الثَّوْرِيُّ، عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ، عَنِ الْحَسَنِ الْبَصْرِيِّ، إِلَّا أَنَّهُ قَالَ: حُرًّا كَانَ أَوْ عَبْدًا، وَخَالَفَهُ الثَّوْرِيُّ فِي الْحُرِّ
[Machine] The scholars from the people of Madinah used to say that whoever steals a young or non-Arab slave has no retribution. It was narrated that Umar ibn Al-Khattab did not order the punishment for them. He said, "These are human traffickers." Our companions interpreted this to mean that if the slave is intelligent, then it has been narrated that Umar cut off the hand of a man who stole a slave boy.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ سَرَقَ عَبْدًا صَغِيرًا أَوْ أَعْجَمِيًّا لَا حِيلَةَ لَهُ قُطِعَ وَرُوِي عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ أَنَّهُ لَمْ يَرَ عَلَيْهِمُ الْقَطْعَ قَالَ هَؤُلَاءِ خَلَّابُونَ قَالَ أَصْحَابُنَا مَعْنَاهُ فِي الْعَبْدِ إِذَا كَانَ عَاقِلًا فَقَدْ رُوِيَ عَنْ عُمَرَ ؓ أَنَّهُ قَطَعَ رَجُلًا فِي غُلَامٍ سُرِقَ
[Machine] A man who used to steal children was brought and he ordered to have his hand cut off. Abu Saad al-Malini reported to us that Abu Ahmad bin Adi al-Hafiz narrated to us from al-Husayn bin Abdullah al-Qattan from Ishaq bin Musa from Abdullah bin Muhammad bin Yahya from Hisham bin Urwah from Urwah bin Zubair that Marwan bin al-Hakam was the governor of Madinah. He had a man who used to steal children and then take them to another land to sell them. Marwan consulted him about this matter so Urwah narrated this Hadith from Aisha from the Prophet ﷺ that he cut off a man's hand for this. Abu Ahmad said: This is not narrated from Hisham except from the narration of Abdullah bin Muhammad bin Yahya from him. Abu Bakr bin al-Harith al-Asbahani reported to us that Abu al-Hasan al-Daraqutni al-Hafiz said: Abdullah bin Muhammad bin Yahya bin Urwah specifically narrated from Hisham bin Urwah, and he made many mistakes in narrating from Hisham and his Hadith is weak.
ﷺ أُتِيَ بِرَجُلٍ كَانَ يَسْرِقُ الصِّبْيَانَ فَأَمَرَ بِقَطْعِهِ 17232 وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ ثنا الْحُسَيْنُ بْنُ عَبْدِ اللهِ الْقَطَّانُ ثنا إِسْحَاقُ بْنُ مُوسَى ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ عُرْوَةَ حَدَّثَنِي هِشَامُ بْنُ عُرْوَةَ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ أَنَّ مَرْوَانَ بْنَ الْحَكَمِ كَانَ عَامِلًا عَلَى الْمَدِينَةِ أُتِيَ بِرَجُلٍ يَسْرِقُ الصِّبْيَانَ ثُمَّ يَخْرُجُ بِهِمْ يَبِيعُهُمْ فِي أَرْضٍ أُخْرَى فَاسْتَشَارَ مَرْوَانُ فِي أَمْرِهِ فَحَدَّثَهُ عُرْوَةُ هَذَا الْحَدِيثَ عَنْ عَائِشَةَ ؓ عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَطَعَ رَجُلًا فِي ذَلِكَ قَالَ فَأَمَرَ مَرْوَانُ بِالَّذِي يَسْرِقُ الصِّبْيَانَ فَقُطِعَتْ يَدُهُ قَالَ أَبُو أَحْمَدَ هَذَا غَيْرُ مَحْفُوظٍ عَنْ هِشَامٍ إِلَّا مِنْ رِوَايَةِ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ يَحْيَى عَنْهُ 17233 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ قَالَ قَالَ أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ تَفَرَّدَ بِهِ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ عُرْوَةَ عَنْ هِشَامِ بْنِ عُرْوَةَ وَهُوَ كَثِيرُ الْخَطَأِ عَلَى هِشَامٍ ضَعِيفُ الْحَدِيثِ
56.12 [Machine] What happens to the servant who steals
٥٦۔١٢ بَابُ مَا جَاءَ فِي الْعَبْدِ الْآبِقِ إِذَا سَرَقَ
[Machine] Does Ibn Umar have this in any book of Allah, so he commanded for his hand to be cut off.
لَهُ ابْنُ عُمَرَ فِي أِيِّ كِتَابِ اللهِ وَجَدْتَ هَذَا؟ فَأَمَرَ بِهِ ابْنُ عُمَرَ فَقُطِعَتْ يَدُهُ
فَقَطَعَهُ
[Machine] Abu Al-Abbas Al-Asamm narrated from Al-Rabi' that Al-Shafi'i narrated from Malik, who narrated from Ruzaiq bin Hakim that he took hold of a slave who had committed theft. He wrote a letter to Umar bin Abdul Aziz, saying, "I have heard that when a slave committed theft, he was not to be punished by amputation." Umar replied, "Indeed, Allah says, 'As for the thief, man or woman, cut off their hands as a recompense for what they have earned. An exemplary punishment from Allah. And Allah is Exalted in Might and Wise.' (Surah Al-Ma'idah, 38) So, if the theft reaches a quarter of a Dinar or more, then amputate." The sheikh (Malik) said that this statement was also the opinion of Qasim bin Muhammad, Salim bin Abdullah, Urwah bin Zubayr, and others. Ibn Abbas used to believe that the enslaved thief was not to be punished by amputation, and we will follow his opinion instead of the opinion of other companions, because his opinion is closer to the Book of Allah. Al-Shafi'i said, "Committing the crime of theft does not increase the disobedience to Allah by amputation." The sheikh (Malik) mentioned that this view was refuted by some weak narrations from Ibn Abbas and it is not a valid argument.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ مَالِكٌ عَنْ رُزَيْقِ بْنِ حَكِيمٍ أَنَّهُ أَخَذَ عَبْدًا آبِقًا قَدْ سَرَقَ فَكَتَبَ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ إِنِّي كُنْتُ أَسْمَعُ أَنَّ الْعَبْدَ الْآبِقَ إِذَا سَرَقَ لَمْ يُقْطَعْ فَكَتَبَ عُمَرُ إِنَّ اللهَ يَقُولُ {وَالسَّارِقُ وَالسَّارِقَةُ فَاقْطَعُوا أَيْدِيَهُمَا جَزَاءً بِمَا كَسَبَا نَكَالًا مِنَ اللهِ وَاللهُ عَزِيزٌ حَكِيمٌ} [المائدة 38] فَإِنْ بَلَغَتْ سَرِقَتُهُ رُبْعَ دِينَارٍ أَوْ أَكْثَرَ فَاقْطَعْهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَهَذَا قَوْلُ قَاسِمِ بْنِ مُحَمَّدٍ وَسَالِمِ بْنِ عَبْدِ اللهِ وَعُرْوَةَ بْنِ الزُّبَيْرِ وَغَيْرِهِمْ وَكَانَ ابْنُ عَبَّاسٍ يَذْهَبُ إِلَى أَنْ لَيْسَ عَلَى الْآبِقِ الْمَمْلُوكِ قَطْعٌ إِذَا سَرَقَ وَقَدْ تَرَكْنَا عَلَيْهِ قَوْلَهُ إِلَى قَوْلِ غَيْرِهِ مِنَ الصَّحَابَةِ؛ لِأَنَّهُ أَشْبَهُ بِكِتَابِ اللهِ ﷻ قَالَ الشَّافِعِيُّ وَلَا تَزِيدُهُ مَعْصِيَةُ اللهِ بِالْإِبَاقِ خَيْرًا قَالَ الشَّيْخُ وَقَدْ رَفَعَهُ بَعْضُ الضُّعَفَاءِ عَنِ ابْنِ عَبَّاسٍ وَلَيْسَ بِشَيْءٍ
56.13 [Machine] The drone is being cut.
٥٦۔١٣ بَابُ الطَّرَّارُ يُقْطَعُ
[Machine] About the scholars from the people of Madinah, they used to say that Tarrar (a specific type of monetary transaction) is a form of Qat', and they used to say that there should be no Qat' except for something that has reached the value of a quarter of a Dinar or more.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ أَنَّهُمْ كَانُوا يَقُولُونَ عَلَى الطَّرَّارِ الْقَطْعُ وَكَانُوا يَقُولُونَ لَا قَطْعَ إِلَّا فِيمَا بَلَغَتْ قِيمَتُهُ رُبْعَ دِينَارٍ فَصَاعِدًا
56.14 [Machine] The beard is cut when the shroud is removed from the entire grave. Al-Shafi'i said: Because this is a form of protection similar to it.
٥٦۔١٤ بَابُ النَّبَّاشِ يُقْطَعُ إِذَا أَخْرَجَ الْكَفَنَ مِنْ جَمِيعِ الْقَبْرِ قَالَ الشَّافِعِيُّ : لِأَنَّ هَذَا حِرْزٌ مِثْلُهُ
The Messenger of Allah ﷺ said to me: O AbuDharr: I replied: At your service and at your pleasure, Messenger of Allah! He said: how will you do when death smites people, and a house, meaning a grave, will cost as much as a slave. I said: Allah and His Apostle know best, or he said: What Allah and His Apostle choose for me. He said: Show endurance, or he said: You may show endurance. Abu Dawud said: Hammad b. Abi Sulaiman said: The hand of one who rifles a grave should be cut off because he had entered the deceased's house. (Using translation from Abū Dāʾūd 4409)
قَالَ رَسُولُ اللهِ ﷺ يَا أَبَا ذَرٍّ قُلْتُ لَبَّيْكَ وَسَعْدَيْكَ قَالَ كَيْفَ أَنْتَ إِذَا أَصَابَ النَّاسَ مَوْتٌ يَكُونُ الْبَيْتُ فِيهِ بِالْوَصِيفِ؟ يَعْنِي الْقَبْرَ قَالَ قُلْتُ اللهُ وَرَسُولُهُ أَعْلَمُ أَوْ مَا خَارَ اللهُ وَرَسُولُهُ قَالَ عَلَيْكَ بِالصَّبْرِ
عَنِ الْحَسَنِ مِثْلَهُ
[Machine] He said, "It is cut in our dead as it is cut in our living."
أَنَّهُ قَالَ يُقْطَعُ فِي أَمْوَاتِنَا كَمَا يُقْطَعُ فِي أَحْيَائِنَا
[Machine] From the grave digger's news, Umar wrote to him, "By my life, it is thought that the thief of the dead will be punished as the thief of the living is punished."
عَنْ نَبَّاشِي الْقُبُورِ فَكَتَبَ إِلَيْهِ عُمَرُ لَعَمْرِي لَيُحْسَبُ سَارِقُ الْأَمْوَاتِ أَنْ يُعَاقَبَ بِمَا يُعَاقَبُ بِهِ سَارِقُ الْأَحْيَاءِ
[Machine] "And 'Abbad ibn Al-Awwam said: We used to accuse him of lying, referring to Suhail ibn Dhakwan, the father of Al-Sindi, from Mecca."
وَقَالَ عَبَّادُ بْنُ الْعَوَّامِ كُنَّا نَتَّهِمُهُ بِالْكَذِبِ يَعْنِي سُهَيْلًا وَهُوَ سُهَيْلُ بْنُ ذَكْوَانَ أَبُو السِّنْدِيِّ الْمَكِّيُّ
[Machine] "That the Prophet ﷺ cursed the one who conceals and the one who is concealed. This is a hadith."
أَنَّ النَّبِيَّ ﷺ لَعَنَ الْمُخْتَفِيَ وَالْمُخْتَفِيَةَ هَذَا مُرْسَلٌ
[Machine] The Messenger of Allah ﷺ cursed the one who conceals (the truth) and the one who is concealed, and likewise.
رَسُولَ اللهِ ﷺ لُعِنَ الْمُخْتَفِي وَالْمُخْتَفِيَةُ وَكَذَلِكَ
56.15 [Machine] Group of Hand and Leg Amputation Cases in Robbery.
٥٦۔١٥ جُمَّاعُ أَبْوَابِ قَطْعِ الْيَدِ وَالرِّجْلِ فِي السَّرِقَةِ
56.16 [Machine] The thief steals first, then his right hand is cut off from the wrist joint, and then he is burned.
٥٦۔١٦ بَابُ السَّارِقِ يَسْرِقُ أَوَّلًا فَتُقْطَعُ يَدُهُ الْيُمْنَى مِنْ مَفْصِلِ الْكَفِّ، ثُمَّ يُحْسَمُ بِالنَّارِ
[Machine] "He said in our recitation, 'The hands of male and female thieves should be cut off.'"
أَنَّهُ قَالَ فِي قِرَاءَتِنَا وَالسَّارِقُونَ وَالسَّارِقَاتُ تُقْطَعُ أَيْمَانُهُمْ
[Machine] "That the Prophet ﷺ cut off the hand of a thief from the wrist."
أَنَّ النَّبِيَّ ﷺ قَطَعَ يَدَ سَارِقٍ مِنَ الْمَفْصِلِ 17249 قَالَ وَحَدَّثَنَا وَكِيعٌ ثنا سُفْيَانُ عَنِ ابْنِ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ مِثْلَهُ
[Machine] The Prophet ﷺ cut off the hand of a thief from the wrist. Abu Ahmad said, "And this hadith is narrated from Malik ibn Mighwal, and I only know it through the narration of Khalid from him."
قَطَعَ النَّبِيُّ ﷺ سَارِقًا مِنَ الْمَفْصِلِ قَالَ أَبُو أَحْمَدَ وَهَذَا الْحَدِيثُ عَنْ مَالِكِ بْنِ مِغْوَلٍ لَا أَعْرِفُهُ إِلَّا مِنْ رِوَايَةِ خَالِدٍ عَنْهُ
[Machine] Umar ibn Al-Khattab used to amputate the thief at the joint.
كَانَ عُمَرُ بْنُ الْخَطَّابِ ؓ يَقْطَعُ السَّارِقَ مِنَ الْمَفْصِلِ
56.17 [Machine] And Ali used to cut it from the bottom of the foot
٥٦۔١٧ وَكَانَ عَلِيٌّ يَقْطَعُهَا مِنْ شَطْرِ الْقَدَمِ "
[Machine] Ali severing their hands from the joint and sealed them as if I am looking at their hands as ruby bunches
أَنَّ عَلِيًّا ؓ قَطَعَ أَيْدِيَهُمْ مِنَ الْمَفْصِلِ وَحَسَمَهَا فَكَأَنِّي أَنْظُرُ إِلَى أَيْدِيهِمْ كَأَنَّهَا أُيُورُ الْحُمُرِ
[Machine] That Ali used to cut off the hand and leave the foot as a support, so it was as if Ali used to separate between the hand and the foot, cutting off the hand from the joint and cutting off the foot from the ankle bone. And we say with the saying of others among the companions in equality between them, and this is the saying of the majority. And with Allah is the success.
أَنَّ عَلِيًّا ؓ كَانَ يَقْطَعُ الرِّجْلَ وَيَدَعُ الْعَقِبَ يَعْتَمِدُ عَلَيْهَا فَكَأَنَّ عَلِيًّا ؓ كَانَ يُفَرِّقُ بَيْنَ الْيَدِ وَالرِّجْلِ فَيَقْطَعُ الْيَدَ مِنَ الْمَفْصِلِ وَيَقْطَعُ الرِّجْلَ مِنْ شَطْرِ الْقَدَمِ وَنَحْنُ نَقُولُ بِقَوْلِ غَيْرِهِ مِنَ الصَّحَابَةِ فِي التَّسْوِيَةِ بَيْنَهُمَا وَهُوَ قَوْلُ الْكَافَّةِ وَبِاللهِ التَّوْفِيقُ
[Machine] That the Messenger of Allah ﷺ was brought a thief who had stolen a shield, so they said, "O Messenger of Allah, this person has indeed stolen." The Messenger of Allah ﷺ said, "What do you say, O thief?" The thief admitted, "Yes, O Messenger of Allah." The Messenger of Allah ﷺ said, "Take him and cut off his hand, then settle your disputes among yourselves, and then bring him to me." So his hand was cut off, and he was brought to the Messenger of Allah ﷺ who said, "Repent to Allah." The thief said, "I repent to Allah." Allah accepted his repentance, and Ya'qub narrated on the authority of Abdul Aziz, and others narrated from him, and Ali bin Al-Madeeni (or Madini) reported from him. Abu Al-Hasan Muhammad bin Abi Al-Ma'roof Al-Faqeeh narrated to us that Bishr bin Ahmad narrated to him, that Ahmad bin Al-Husain bin Nasr Al-Hazaa narrated to him, and he mentioned it in meaning as a Mursal (Hadith missing one or more narrators in the chain of narration) without mentioning Abu Huraira except that he said, "So they cut off his hand and settled their disputes, then they brought him to him." And Ali narrated to us, and he said, Abdul Aziz bin Abi Hazim informed me, and he informed me that Yazid bin Khusaifah narrated to him, on the authority of Ibn Thawban, who narrated it from Ali, who narrated from Sufyan, who narrated from Ibn Khusaifah, who narrated it from Muhammad bin Abdur Rahman bin Thawban, and he mentioned it as a Mursal. Ali said, "None of them deemed it authentic except Ibn Thawban, to anyone." And it reached me that Muhammad bin Ishaq reported it.
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِسَارِقٍ سَرَقَ شَمْلَةً فَقَالُوا يَا رَسُولَ اللهِ إِنَّ هَذَا قَدْ سَرَقَ فَقَالَ رَسُولُ اللهِ ﷺ مَا إِخَالُهُ سَرَقَ قَالَ السَّارِقُ بَلَى يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ اذْهَبُوا بِهِ فَاقْطَعُوهُ ثُمَّ احْسِمُوهُ ثُمَّ ائْتُونِي بِهِ فَقُطِعَ فَأُتِيَ بِهِ فَقَالَ تُبْ إِلَى اللهِ ﷻ قَالَ تُبْتُ إِلَى اللهِ قَالَ تَابَ اللهُ عَلَيْكَ وَصَلَهُ يَعْقُوبُ عَنْ عَبْدِ الْعَزِيزِ وَتَابَعَهُ عَلَيْهِ غَيْرُهُ وَأَرْسَلَهُ عَنْهُ عَلِيُّ بْنُ الْمَدِينِيِّ 17255 أَخْبَرَنَاهُ أَبُو الْحَسَنِ مُحَمَّدُ بْنُ أَبِي الْمَعْرُوفِ الْفَقِيهُ أنبأ بِشْرُ بْنُ أَحْمَدَ أنبأ أَحْمَدُ بْنُ الْحُسَيْنِ بْنِ نَصْرٍ الْحَذَّاءُ ثنا عَلِيُّ بْنُ عَبْدِ اللهِ ثنا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ الدَّرَاوَرْدِيُّ فَذَكَرَهُ بِمَعْنَاهُ مُرْسَلًا دُونَ ذِكْرِ أَبِي هُرَيْرَةَ فِيهِ إِلَّا أَنَّهُ قَالَ فَقَطَعُوهُ ثُمَّ حَسَمُوهُ ثُمَّ أَتَوْهُ بِهِ 17256 قَالَ وَحَدَّثَنَا عَلِيٌّ قَالَ حَدَّثَنِيهِ عَبْدُ الْعَزِيزِ بْنُ أَبِي حَازِمٍ أَخْبَرَنِي يَزِيدُ بْنُ خُصَيْفَةَ عَنِ ابْنِ ثَوْبَانَ ح قَالَ وَثَنَا عَلِيُّ ثنا سُفْيَانُ ثنا ابْنُ خُصَيْفَةَ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ فَذَكَرَهُ مُرْسَلًا قَالَ عَلِيٌّ لَمْ يُسْنِدْهُ وَاحِدٌ مِنْهُمْ فَوْقَ ابْنِ ثَوْبَانَ إِلَى أَحَدٍ قَالَ وَبَلَغَنِي أَنَّ مُحَمَّدَ بْنَ إِسْحَاقَ
[Machine] Ali used to cut, enforce, and imprison. When they were acquitted, he would send for them and release them. Then, he would say, "Raise your hands to Allah," and they would raise their hands. He would say, "Who cut you?" They would say, "Ali." He would ask, "Why?" They would say, "We stole." He would say, "O Allah, bear witness. O Allah, bear witness to the statement of the shoe incident." The narration in which Ali bin Madini mentioned was also narrated by Ammar bin Ruzayq Ad-Dabbi from Salamah bin Kuhail. Ibn Abjar disagreed regarding its chain of narration.
كَانَ عَلِيٌّ ؓ يَقْطَعُ وَيَحْسِمُ وَيَحْبِسُ فَإِذَا بَرِئُوا أَرْسَلَ إِلَيْهِمْ فَأَخْرَجَهُمْ ثُمَّ قَالَ ارْفَعُوا أَيْدِيَكُمْ إِلَى اللهِ قَالَ فَيَرْفَعُونَهَا فَيَقُولُ مَنْ قَطَعَكَ؟ فَيَقُولُونَ عَلِيٌّ فَيَقُولُ وَلِمَ؟ فَيَقُولُونَ سَرَقْنَا قَالَ فَيَقُولُ اللهُمَّ اشْهَدْ اللهُمَّ اشْهَدْ لَفْظُ حَدِيثِ الْحَذَّاءِ زَادَ فِي رِوَايَتِهِ قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ وَقَدْ رَوَى هَذَا الْحَدِيثَ عَمَّارُ بْنُ رُزَيْقٍ الضَّبِّيُّ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ فَخَالَفَ ابْنَ أَبْجَرَ فِي إِسْنَادِهِ
[Machine] It was that when the thief was caught, his hand would be cut off, then he would be punished, then he would be thrown into prison. When they were acquitted and he wanted to release them, he would say, "Raise your hands to Allah as if I see them like red camels." He would ask, "Who cut you?" They would say, "Ali." He would say, "O Allah, they have spoken the truth about You. I cut them in Your name and sent them for Your sake." Ali ibn al-Madini narrated this in the first chain, and the hadith is with me from Ibn Abjar. The sheikh, may Allah have mercy on him, said, "It is as if he was commanding them to confess until they are acquitted. It is not that he was imprisoning them as a punishment." Sufyan al-Thawri narrated from Muhammad ibn Ishaq from Abu Ja'far that Ali said, "Imprisoning the Imam after the establishment of punishment is an injustice."
أَنَّهُ كَانَ إِذَا أَخَذَ اللِّصَّ قَطَعَهُ ثُمَّ حَسَمَهُ ثُمَّ أَلْقَاهُ فِي السِّجْنِ فَإِذَا بَرِئُوا وَأَرَادَ أَنْ يُخْرِجَهُمْ فَقَالَ ارْفَعُوا أَيْدِيَكُمْ إِلَى اللهِ كَأَنِّي أَنْظُرُ إِلَيْهَا كَأَنَّهَا أُيُورُ الْحُمُرِ فَيَقُولُ مَنْ قَطَعَكُمْ؟ فَيَقُولُونَ عَلِيٌّ فَيَقُولُ اللهُمَّ صَدَقُوا فِيكَ قَطَعْتُهُمْ وَفِيكَ أَرْسَلْتُهُمْ قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ فِي الْإِسْنَادِ الْأَوَّلِ وَالْحَدِيثُ عِنْدِي حَدِيثُ ابْنِ أَبْجَرَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَكَأَنَّهُ كَانَ يَأْمُرُ بِتَعَهُّدِهِمْ حَتَّى يَبْرَءُوا لَا أَنَّهُ كَانَ يَحْبِسُهُمْ تَعْزِيرَا فَقَدْ رَوَى سُفْيَانُ الثَّوْرِيُّ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ أَبِي جَعْفَرٍ أَنَّ عَلِيًّا ؓ قَالَ حَبْسُ الْإِمَامِ بَعْدَ إِقَامَةِ الْحَدِّ ظُلْمٌ
56.18 [Machine] The Thief Returns and Steals Again, Twice, Thrice, and Fourth
٥٦۔١٨ بَابُ السَّارِقِ يَعُودُ فَيَسْرِقُ ثَانِيًا وَثَالِثًا وَرَابِعًا
[Machine] A thief was brought to the Prophet ﷺ and he said, "Kill him." They said, "O Messenger of Allah, he only stole." He said, "Cut off his hand." So his hand was cut off. Then the thief was brought a second time and the Prophet ﷺ said, "Kill him." They said, "O Messenger of Allah, he only stole." He said, "Cut off his hand." So his hand was cut off. Then the thief was brought a third time and the Prophet ﷺ said, "Kill him." They said, "O Messenger of Allah, he only stole." He said, "Cut off his hand." So his hand was cut off. Then the thief was brought a fourth time and the Prophet ﷺ said, "Kill him." They said, "O Messenger of Allah, he only stole." He said, "Cut off his hand." So his hand was cut off. Then the thief was brought a fifth time and the Prophet ﷺ said, "Kill him." Jaber said, "So we took him and killed him, then we dragged him and threw him into a well and threw stones on him." This is the wording of Abu Dawood's narration. In the narration of Abu Ma'shar, he said in the first instance, "Indeed, he stole, O Messenger of Allah." He said, "Cut off his hand." And in the second instance, after this statement, he said, "Cut off his leg." And in the third instance, he said, "Cut off his hand." And in the fourth instance, he said, "Cut off his leg." And in the fifth instance, he said, "Didn't I tell you to kill him? Kill him." He said, "So we passed him by the pastures of the camels, and we made the camels trample him with their legs until they ran away from him." He said, "So we did to him with stones until we killed him."
جِيءَ بِسَارِقٍ إِلَى النَّبِيِّ ﷺ فَقَالَ اقْتُلُوهُ فَقَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ؟ فَقَالَ اقْطَعُوهُ فَقُطِعَ ثُمَّ جِيءَ بِهِ الثَّانِيَةَ فَقَالَ اقْتُلُوهُ فَقَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ اقْطَعُوهُ قَالَ فَقُطِعَ ثُمَّ جِيءَ بِهِ الثَّالِثَةَ فَقَالَ اقْتُلُوهُ فَقَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ اقْطَعُوهُ ثُمَّ أُتِيَ بِهِ الرَّابِعَةَ فَقَالَ اقْتُلُوهُ فَقَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ اقْطَعُوهُ فَأُتِيَ بِهِ الْخَامِسَةَ فَقَالَ اقْتُلُوهُ قَالَ جَابِرٌ فَانْطَلَقْنَا بِهِ فَقَتَلْنَاهُ ثُمَّ اجْتَرَرْنَاهُ فَأَلْقَيْنَاهُ فِي بِئْرٍ وَرَمَيْنَا عَلَيْهِ الْحِجَارَةَ لَفْظُ حَدِيثِ أَبِي دَاوُدَ وَفِي رِوَايَةِ أَبِي مَعْشَرٍ فِي الْمَرَّةِ الْأُولَى قَالَ إِنَّهُ سَرَقَ يَا رَسُولَ اللهِ قَالَ اقْطَعُوا يَدَهُ وَقَالَ فِي الْمَرَّةِ الثَّانِيَةِ بَعْدَ هَذَا الْقَوْلِ اقْطَعُوا رِجْلَهُ وَفِي الْمَرَّةِ الثَّالِثَةِ اقْطَعُوا يَدَهُ وَفِي الْمَرَّةِ الرَّابِعَةِ اقْطَعُوا رِجْلَهُ وَفِي الْمَرَّةِ الْخَامِسَةِ قَالَ أَلَمْ أَقُلْ لَكُمُ اقْتُلُوهُ اقْتُلُوهُ قَالَ فَمَرَرْنَا بِهِ إِلَى مِرْبَدِ النَّعَمِ فَحَمَلْنَا عَلَيْهِ النَّعَمَ فَشَالَ بِيَدَيْهِ وَرِجْلَيْهِ حَتَّى نَفَرَتْ مِنْهُ الْإِبِلُ قَالَ فَعَلَوْنَاهُ بِالْحِجَارَةِ حَتَّى قَتَلْنَاهُ
[Machine] The Prophet ﷺ ordered for a thief to have his hand cut off. Then the thief was brought to him again after stealing, and the Prophet ﷺ ordered for his leg to be cut off. Then the thief was brought to him again after stealing, and the Prophet ﷺ ordered for his left hand to be cut off. Then the thief was brought to him again after stealing, and the Prophet ﷺ ordered for his right leg to be cut off. Then the thief was brought to him again after stealing, and the Prophet ﷺ ordered for his execution. This hadith is narrated by Hisham ibn Urwah and Muhammad ibn Abi Humaid from Ibn al-Munkadir.
أُتِيَ النَّبِيُّ ﷺ بِسَارِقٍ فَأَمَرَ بِقَطْعِ يَدِهِ ثُمَّ أُتِيَ بِهِ قَدْ سَرَقَ فَأَمَرَ بِهِ فَقَطَعَ رِجْلَهُ ثُمَّ أُتِيَ بِهِ بَعْدُ وَقَدْ سَرَقَ فَأَمَرَ بِقَطْعِ يَدِهِ الْيُسْرَى ثُمَّ أُتِيَ بِهِ قَدْ سَرَقَ فَأَمَرَ بِقَطْعِ رِجْلِهِ الْيُمْنَى ثُمَّ أُتِيَ بِهِ قَدْ سَرَقَ فَأَمَرَ بِقَتْلِهِ وَقَدْ رُوِيَ هَذَا الْحَدِيثُ عَنْ هِشَامِ بْنِ عُرْوَةَ وَمُحَمَّدِ بْنِ أَبِي حُمَيْدٍ عَنِ ابْنِ الْمُنْكَدِرِ
[Machine] Abu Abdullah Al-Hafiz informed me of a license in what has not been completed from the book Al-Mustadrak. Abu Bakr Muhammad ibn Ahmad ibn Balawiyyah narrated to me, who narrated from Ishaq ibn Al-Hassan Al-Harbi, who narrated from Affan ibn Muslim, who narrated from Hammad ibn Salamah, who narrated from Yahya ibn Saad, who narrated from Al-Harith ibn Hattab, that a man stole during the time of the Messenger of Allah ﷺ . He was brought to the Prophet ﷺ and he said, "Kill him." The people said, "He only stole once." The Prophet ﷺ then said, "Cut his hand." The man stole again, so his hand was cut off. He stole again during the time of Abu Bakr, so his hand was cut off again. He continued stealing and his hands were cut off until both of his hands were amputated. Then, he stole for the fifth time, and Abu Bakr (may Allah be pleased with him) said, "The Messenger of Allah ﷺ knew about this when he commanded for him to be killed. Take him, and kill him." He was then handed over to the youth of Quraysh, and among them was Abdullah ibn Zubayr. Abdullah ibn Zubayr said, "Order me to kill him." So they gave him the order, and whenever he struck him, they followed suit until they killed him. Is'haq Al-Hanzali narrated it from Nadr ibn Shumail, who narrated from Hammad ibn Salamah, who narrated from Yahya ibn Saad.
أَنْبَأَنِي أَبُو عَبْدِ اللهِ الْحَافِظُ إِجَازَةً فِيمَا لَمْ يُمْلِ مِنْ كِتَابِ الْمُسْتَدْرَكِ حَدَّثَنِي أَبُو بَكْرٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ بَالَوَيْهِ ثنا إِسْحَاقُ بْنُ الْحَسَنِ الْحَرْبِيُّ ثنا عَفَّانُ بْنُ مُسْلِمٍ ثنا حَمَّادُ بْنُ سَلَمَةَ ثنا يُوسُفُ بْنُ سَعْدٍ عَنِ الْحَارِثِ بْنِ حَاطِبٍ أَنَّ رَجُلًا سَرَقَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَأُتِيَ بِهِ النَّبِيَّ ﷺ فَقَالَ اقْتُلُوهُ فَقَالُوا إِنَّمَا سَرَقَ قَالَ فَاقْطَعُوهُ ثُمَّ سَرَقَ أَيْضًا فَقُطِعَ ثُمَّ سَرَقَ عَلَى عَهْدِ أَبِي بَكْرٍ ؓ فَقُطِعَ ثُمَّ سَرَقَ فَقُطِعَ حَتَّى قُطِعَتْ قَوَائِمُهُ ثُمَّ سَرَقَ الْخَامِسَةَ فَقَالَ أَبُو بَكْرٍ ؓ كَانَ رَسُولُ اللهِ ﷺ أَعْلَمَ بِهَذَا حِينَ أَمَرَ بِقَتْلِهِ اذْهَبُوا بِهِ فَاقْتُلُوهُ فَدُفِعَ إِلَى فِتْيَةٍ مِنْ قُرَيْشٍ فِيهِمْ عَبْدُ اللهِ بْنُ الزُّبَيْرِ فَقَالَ عَبْدُ اللهِ بْنُ الزُّبَيْرِ أَمِّرُونِي عَلَيْكُمْ فَأَمَّرُوهُ فَكَانَ إِذَا ضَرَبَهُ ضَرَبُوهُ حَتَّى قَتَلُوهُ تَابَعَهُ إِسْحَاقُ الْحَنْظَلِيُّ عَنِ النَّضْرِ بْنِ شُمَيْلٍ عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ يُوسُفَ بْنِ سَعْدٍ
[Machine] The passage translates into English as follows:
"With regards to the thief, they said, 'O Messenger of Allah, this is a young boy, an orphan from the Ansar (helpers), and by Allah, we do not know of any possessions they have besides this (stolen item).' So he left him. Then he was brought to him a second time, and he left him. Then he was brought to him a third time, and he left him. Then he was brought to him a fourth time, and he left him. Then he was brought to him a fifth time, and he cut off his hand. Then he was brought to him a sixth time, and he cut off his foot. Then he was brought to him a seventh time, and he cut off his hand. Then he was brought to him an eighth time, and he cut off his foot. This is how I found it in my book.' Hammadd bin Mas'adah narrated from Ibn Juraij, from Abdullah bin Abi Umayyah, from Al-Harith bin Abdullah bin Abi Rabi'ah, and he is the most authentic and reliable, in a sound chain of narration."
بِالسَّارِقِ فَقَالُوا يَا رَسُولَ اللهِ هَذَا غُلَامٌ لِأَيْتَامٍ مِنَ الْأَنْصَارِ وَاللهِ مَا نَعْلَمُ لَهُمْ مَالًا غَيْرَهُ فَتَرَكَهُ ثُمَّ أُتِيَ بِهِ الثَّانِيَةَ فَتَرَكَهُ ثُمَّ أُتِيَ بِهِ الثَّالِثَةَ فَتَرَكَهُ ثُمَّ أُتِيَ بِهِ الرَّابِعَةَ فَتَرَكَهُ ثُمَّ أُتِيَ بِهِ الْخَامِسَةَ فَقَطَعَ يَدَهُ ثُمَّ أُتِيَ بِهِ السَّادِسَةَ فَقَطَعَ رِجْلَهُ ثُمَّ أُتِيَ بِهِ السَّابِعَةَ فَقَطَعَ يَدَهُ ثُمَّ أُتِيَ بِهِ الثَّامِنَةَ فَقَطَعَ رِجْلَهُ كَذَا وَجَدْتُهُ فِي كِتَابِي وَقَالَ حَمَّادُ بْنُ مَسْعَدَةَ عَنِ ابْنِ جُرَيْجٍ عَنْ عَبْدِ اللهِ بْنِ أَبِي أُمَيَّةَ عَنِ الْحَارِثِ بْنِ عَبْدِ اللهِ بْنِ أَبِي رَبِيعَةَ وَهُوَ أَصَحُّ وَهُوَ مُرْسَلٌ حَسَنٌ بِإِسْنَادٍ صَحِيحٍ
[Machine] From the people of Yemen, a man who had his hand and foot cut off came to Abu Bakr as-Siddiq and complained to him that the governor of Yemen had treated him unjustly. He used to pray at night and Abu Bakr would say to him, "And your father, does he not have a night like yours, you thief?" Then they noticed that some jewelry belonging to Asma bint Umays, the wife of Abu Bakr, was missing. The man started accompanying them and saying, "O Allah, curse the person who has hidden this righteous family's jewelry." They found the jewelry with a goldsmith, and it was discovered that the man with the cut-off hand was the thief. The man admitted to his crime, or witnesses testified against him, so Abu Bakr ordered that his left hand be cut off. Abu Bakr said, "I swear by Allah, his invocation against himself is more severe to me than his theft."
مِنْ أَهْلِ الْيَمَنِ أَقْطَعَ الْيَدِ وَالرِّجْلِ قَدِمَ عَلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ فَشَكَا إِلَيْهِ أَنَّ عَامَلَ الْيَمَنِ ظَلَمَهُ وَكَانَ يُصَلِّي مِنَ اللَّيْلِ فَيَقُولُ أَبُو بَكْرٍ ؓ وَأَبِيكَ مَا لَيْلُكَ بِلَيْلِ سَارِقٍ ثُمَّ إِنَّهُمُ افْتَقَدُوا حُلِيًّا لِأَسْمَاءَ بِنْتِ عُمَيْسٍ ؓ امْرَأَةِ أَبِي بَكْرٍ ؓ فَجَعَلَ الرَّجُلُ يَطُوفُ مَعَهُمْ وَيَقُولُ اللهُمَّ عَلَيْكَ بِمَنْ بَيَّتَ أَهْلَ هَذَا الْبَيْتِ الصَّالِحِ فَوَجَدُوا الْحُلِيَّ عِنْدَ صَائِغً وَإِنَّ الْأَقْطَعَ جَاءَ بِهِ فَاعْتَرَفَ الْأَقْطَعُ أَوْ شُهِدَ عَلَيْهِ فَأَمَرَ بِهِ أَبُو بَكْرٍ ؓ فَقُطِعَتْ يَدُهُ الْيُسْرَى وَقَالَ أَبُو بَكْرٍ ؓ وَاللهِ لَدُعَاؤُهُ عَلَى نَفْسِهِ أَشَدُّ عِنْدِي مِنْ سَرِقَتِهِ
[Machine] The passage translates to: "The age of Sunnah is the saying of Omar, the age of Sunnah is the saying of Omar, resembling to be aware of the Sunnah of the Messenger of Allah ﷺ."
عُمَرُ ؓ السُّنَّةُ الْيَدُ قَوْلُ عُمَرَ ؓ السُّنَّةُ الْيَدُ يُشْبِهُ أَنْ يَكُونَ عَرَفَ فِيهِ سُنَّةَ رَسُولِ اللهِ ﷺ
[Machine] A man had his hand and foot cut off during the time of Abu Bakr. Abu Bakr intended to cut off his other hand and let him live with it, purify himself with it, and benefit from it. Umar said, "By the One in whose hand is my soul, his other hand should also be cut off." Abu Bakr ordered for it to be done and his hand was cut off.
أَنَّ رَجُلًا سَرَقَ عَلَى عَهْدِ أَبِي بَكْرٍ ؓ مَقْطُوعَةٌ يَدُهُ وَرِجْلُهُ فَأَرَادَ أَبُو بَكْرٍ ؓ يَقْطَعُ رِجْلَهُ وَيَدَعُ يَدَهُ يَسْتَطْيبُ بِهَا وَيَتَطَهَّرُ بِهَا وَيَنْتَفِعُ بِهَا فَقَالَ عُمَرُ لَا وَالَّذِي نَفْسِي بِيَدِهِ لَتَقْطَعَنَّ يَدَهُ الْأُخْرَى فَأَمَرَ بِهِ أَبُو بَكْرٍ ؓ فَقُطِعَتْ يَدُهُ
[Machine] I witnessed Umar ibn al-Khattab cutting off hand after hand and leg.
شَهِدْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ قَطَعَ يَدًا بَعْدَ يَدٍ وَرِجْلٍ
