56.9 [Machine] What is a talisman and what is not

٥٦۔٩ بَابُ مَا يَكُونُ حِرْزًا ومَا لَا يَكُونُ

[Machine] It was said to Safwan ibn Umayyah that whoever does not migrate will perish. So Safwan advanced to Medina and slept in the mosque, using his cloak as a pillow. A thief came and took his cloak from under his head. Safwan caught the thief and brought him to the Prophet ﷺ . The Messenger of Allah ﷺ ordered that his hand be cut off. Safwan said, "I did not intend for this to happen, it was charity on his part." The Messenger of Allah ﷺ said, "Why didn't he ask you for it before bringing him to me?" Abu Zakariya narrated to us, Abu Al-Abbas informed us, Rabee'ah informed Ash-Shafi'i, who informed Sufyan ibn 'Uyaynah, from 'Amr, from Tawus, from the Prophet ﷺ , a narration similar to the hadith of Malik. This hadith has been narrated from another chain as well, and it has been narrated by Ibn Kasib, from Sufyan ibn 'Uyaynah, with a connected chain of narration that includes mentioning Ibn 'Abbas, but it is not authentic.  

البيهقي:١٧٢١٥أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ صَفْوَانَ بْنِ عَبْدِ اللهِ

أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ قِيلَ لَهُ مَنْ لَمْ يُهَاجِرْ هَلَكَ فَقَدِمَ صَفْوَانُ الْمَدِينَةَ فَنَامَ فِي الْمَسْجِدِ مُتَوَسِّدًا رِدَاءَهُ فَجَاءَ سَارِقٌ فَأَخَذَ رِدَاءَهُ مِنْ تَحْتِ رَأْسِهِ فَأَخَذَ صَفْوَانُ السَّارِقَ فَجَاءَ بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ تُقْطَعُ يَدُهُ فَقَالَ صَفْوَانُ إِنِّي لَمْ أُرِدْ هَذَا هُوَ عَلَيْهِ صَدَقَةٌ فَقَالَ رَسُولُ اللهِ ﷺ فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ 17216 وَأَخْبَرَنَا أَبُو زَكَرِيَّا ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ أَنْبَأَ الشَّافِعِيُّ أَنْبَأَ سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَمْرٍو عَنْ طَاوُسٍ عَنِ النَّبِيِّ ﷺ مِثْلَ حَدِيثِ مَالِكٍ هَذَا الْمُرْسَلُ يُقَوِّي الْأَوَّلَ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ وَرُوِيَ عَنِ ابْنِ كَاسِبٍ عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ بِإِسْنَادِهِ مَوْصُولًا بِذِكْرِ ابْنِ عَبَّاسٍ فِيهِ وَلَيْسَ بِصَحِيحٍ

[Machine] While Safwan bin Umayyah was lying on the ground in the area of Al-Bat'ha, a man came and took his fur from under his head. The Prophet Mohammed ﷺ was brought to him and ordered that the thief's hand be cut off. The thief said, "I request your forgiveness. Will you accept the intercession of Abu Wahb before you decide?"  

البيهقي:١٧٢١٧وَأَخْبَرَنَا أَبُو الْحَسَنِ مُحَمَّدُ بْنُ الْحُسَيْنِ بْنِ دَاوُدَ الْعَلَوِيُّ أنبأ أَبُو الْفَضْلِ الْعَبَّاسُ بْنُ مُحَمَّدِ بْنِ قُوهْيَارٍ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ السَّعْدِيُّ أنبأ بَكَّارُ بْنُ الْخَصِيبِ ثنا حَبِيبٌ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ قَالَ

بَيْنَمَا صَفْوَانُ بْنُ أُمَيَّةَ مُضْطَجِعٌ بِالْبَطْحَاءِ إِذْ جَاءَ إِنْسَانٌ فَأَخَذَ بُرْدَهُ مِنْ تَحْتِ رَأْسِهِ فَأُتِيَ بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِقَطْعِهِ فَقَالَ إِنِّي أَعْفُو عَنْهُ أَوْ أَتَجَاوَزُ قَالَ فَهَلْ قَبْلَ أَنْ تَأْتِيَنَا بِهِ أَبَا وَهْبٍ؟

I was sleeping in the mosque on a cloak mine whose price was thirty dirhams. A man came and pinched it away from me. The man was seized and brought to the Messenger of Allah ﷺ. He ordered that his hand should be cut off. I came to him and said: Do you cut off only for thirty dirhams ? I sell it to him and make the payment of its price a loan ? He said: Why did you not do so before bringing him to me ? Abu Dawud said: Za'idah has also transmitted it from Simak from Ju'ayd ibn Hujayr. He said: Safwan slept. Mujahid and Tawus said: While he was sleeping a thief came and stole the cloak from beneath his head. The version of AbuSalamah ibn AbdurRahman has: He snatched it away from beneath his head and he awoke. He cried and he (the thief) was seized. Az-Zuhri narrated from Safwan ibn Abdullah. His version has: He slept in the mosque and used his cloak as pillow. A thief came and took his cloak. The thief was seized and brought to the Prophet ﷺ. (Using translation from Abū Dāʾūd 4394)   

البيهقي:١٧٢١٨أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ عَبْدِ اللهِ بْنِ إِبْرَاهِيمَ الْهَاشِمِيُّ بِبَغْدَادَ ثنا عُثْمَانُ بْنُ أَحْمَدَ بْنِ السَّمَّاكِ ثنا مُحَمَّدُ بْنُ الْحُسَيْنِ الْحُنَيْنِيُّ ثنا عَمْرُو بْنُ حَمَّادِ بْنِ طَلْحَةَ ثنا أَسْبَاطٌ عَنْ سِمَاكٍ عَنْ حُمَيْدِ ابْنِ أُخْتِ صَفْوَانَ عَنْ صَفْوَانَ بْنِ أُمَيَّةَ قَالَ

كُنْتُ نَائِمًا فِي الْمَسْجِدِ عَلَى خَمِيصَةٍ لِي ثَمَنُ ثَلَاثِينَ دِرْهَمًا فَجَاءَ رَجُلٌ فَاخْتَلَسَهَا مِنِّي فَأَخَذَ الرَّجُلَ فَأَتَى بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِهِ لِيُقْطَعَ قَالَ فَأَتَيْتُهُ فَقُلْتُ أَتَقْطَعُهُ مِنْ أَجْلِ ثَلَاثِينَ دِرْهَمًا أَنَا أَبِيعُهُ وَأُنْسِئُهُ ثَمَنَهَا قَالَ أَلَا كَانَ هَذَا قَبْلَ أَنْ تَأْتِيَنِي بِهِ هَكَذَا  

رَوَاهُ جَمَاعَةٌ عَنْ عَمْرِو بْنِ حَمَّادٍ

[Machine] Al-Shafi'i was wearing a garment of Safwan, which he had acquired by sleeping on it. The Prophet ﷺ cut the thief of his garment.  

البيهقي:١٧٢١٩وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ قَالَ قَالَ أَبُو دَاوُدَ وَرَوَاهُ زَائِدَةُ عَنْ سِمَاكٍ عَنْ جُعَيْدِ بْنِ حُجَيْرٍ قَالَ نَامَ صَفْوَانُ قَالَ

الشَّافِعِيُّ وَرِدَاءُ صَفْوَانَ كَانَ مُحْرَزًا بِاضْطِجَاعِهِ عَلَيْهِ فَقَطَعَ النَّبِيُّ ﷺ سَارِقَ رِدَائِهِ

[Machine] Uthman ibn Affan used to say, "There is no punishment for a thief until he has taken the stolen goods out of the house."  

البيهقي:١٧٢٢٠أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ ثنا سَعْدَانُ بْنُ نَصْرٍ ثنا مُعَاذُ بْنُ مُعَاذٍ عَنِ ابْنِ جُرَيْجٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى قَالَ

كَانَ عُثْمَانُ بْنُ عَفَّانَ ؓ يَقُولُ لَيْسَ عَلَى سَارِقٍ قَطْعٌ حَتَّى يُخْرِجَ الْمَتَاعَ مِنَ الْبَيْتِ

[Machine] Do not cut off his hand until he has committed theft.  

البيهقي:١٧٢٢١أَخْبَرَنَا أَبُو سَعِيدٍ شَرِيكُ بْنُ عَبْدِ الْمَلِكِ الْإِسْفِرَايِينِيُّ بِهَا ثنا بِشْرُ بْنُ أَحْمَدَ الْإِسْفِرَايِينِيُّ ثنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ يَحْيَى بْنِ سُلَيْمَانَ ثنا عَاصِمُ بْنُ عَلِيٍّ ثنا ابْنُ أَبِي ذِئْبٍ عَنِ الزُّهْرِيِّ عَنْ ثَعْلَبَةَ الشَّامِيِّ وَكَانَ طَارِقٌ اسْتَخْلَفَهُ عَلَى الْمَدِينَةِ فَأُتِيَ بِسَارِقٍ فَعَاقَبَهُ فَاعْتَرَفَ بِالسَّرِقَةِ فَبَعَثَ إِلَى ابْنِ عُمَرَ يَسْأَلُ عَنْ ذَلِكَ فَقَالَ

لَا تَقْطَعْ يَدَهُ حَتَّى يُخْرِجَ السَّرِقَةَ

[Machine] Ali said, "The thief should not be cut off until he takes out the stolen goods from the house." This was also narrated from a different perspective about Ali's intention. Sulayman bin Musa also narrated it from Uthman.  

البيهقي:١٧٢٢٢أَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو أَحْمَدَ الْحَافِظُ أنبأ أَبُو الْعَبَّاسِ أَحْمَدُ بْنُ عَبْدِ اللهِ بْنِ سَابُورَ الدَّقِيقِيُّ بِبَغْدَادَ ثنا أَبُو نُعَيْمٍ يَعْنِي الْحَلَبِيَّ عُبَيْدَ بْنَ هِشَامٍ ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ الْمَدَنِيُّ عَنْ حُسَيْنِ بْنِ عَبْدِ اللهِ بْنِ ضُمَيْرَةَ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

قَالَ عَلِيٌّ ؓ لَا يُقْطَعُ السَّارِقُ حَتَّى يُخْرِجَ الْمَتَاعَ مِنَ الْبَيْتِ وَرُوِي ذَلِكَ مِنْ وَجْهٍ آخَرَ عَنْ عَلِيٍّ ؓ فِي مَعْنَاهُ وَرَوَاهُ أَيْضًا سُلَيْمَانُ بْنُ مُوسَى عَنْ عُثْمَانَ ؓ

Muhammad ibn Yahya ibn Hibban said: A slave stole a plant of a palm-tree from the orchard of a man and planted it in the orchard of his master. The owner of the plant went out in search of the plant and he found it. He solicited help against the slave from Marwan ibn al-Hakam who was the Governor of Medina at that time. Marwan confined the slave and intended to cut off his hand. The slave's master went to Rafi' ibn Khadij and asked him about it. He told him that he had heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. The man then said: Marwan has seized my slave and wants to cut off his hand. I wish you to go with me to him and tell him that which you have heard from the Messenger of Allah ﷺ. So Rafi' ibn Khadij went with him and came to Marwan ibn al-Hakam. Rafi' said to him: I heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. So Marwan gave orders to release the slave and then he was released. Abu Dawud said: Kathar means pith of the palm-tree. (Using translation from Abū Dāʾūd 4388)   

البيهقي:١٧٢٢٣أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْبُوشَنْجِيُّ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حِبَّانَ أَنَّ عَبْدًا سَرَقَ وَدِيًّا مِنْ حَائِطِ رَجُلٍ فَغَرَسَهُ فِي حَائِطِ سَيِّدِهِ فَخَرَجَ صَاحِبُ الْوَدِيِّ يَلْتَمِسُ وَدِيَّهُ فَوَجَدَهُ فَاسْتَعْدَى عَلَى الْعَبْدِ مَرْوَانَ بْنَ الْحَكَمِ فَسَجَنَ الْعَبْدَ وَأَرَادَ قَطْعَ يَدِهِ فَانْطَلَقَ سَيِّدُ الْعَبْدِ إِلَى رَافِعِ بْنِ خَدِيجٍ فَسَأَلَهُ عَنْ ذَلِكَ

فَأَخْبَرَهُ أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ وَالْكَثَرُ الْجُمَّارُ فَقَالَ الرَّجُلُ فَإِنَّ مَرْوَانَ بْنَ الْحَكَمِ أَخَذَ غُلَامًا لِي وَيُرِيدُ قَطْعَ يَدِهِ وَأَنَا أُحِبُّ أَنْ تَمْشِيَ مَعِي إِلَيْهِ فَتُخْبِرَهُ بِالَّذِي سَمِعْتَ مِنْ رَسُولِ اللهِ ﷺ فَمَشَى مَعَهُ رَافِعُ بْنُ خَدِيجٍ حَتَّى أَتَى مَرْوَانَ فَقَالَ أَخَذْتَ غُلَامًا لِهَذَا؟ فَقَالَ نَعَمْ قَالَ مَا أَنْتَ صَانِعٌ بِهِ؟ قَالَ أَرَدْتُ قَطْعَ يَدِهِ قَالَ لَهُ رَافِعُ بْنُ خَدِيجٍ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ فَأَمَرَ مَرْوَانُ بِالْعَبْدِ فَأُرْسِلَ

[Machine] The Messenger of Allah ﷺ said, "There should be no cutting in a hanging fruit or in the harrisah of a mountain. If a thief comes and the spoils have reached the amount of nisab, then cuts should be made. We have narrated this as a connected hadith from 'Amr ibn Shu'aib from his father from his grandfather. Ash-Shafi'i (may Allah have mercy on him) said, "The walls are not a protection for the date palm or its fruits because most of them are permissible, and they enter from its sides. So whoever steals something from a wall of hanging dates, it is not cut unless it enters the grain." Ash-Shafi'i said, "The totality of the boundaries is considered in relation to the stolen property. If the place that was stolen is attributed by the public to being a boundary in a similar place, then it is cut if it enters it."  

البيهقي:١٧٢٢٤وَأَخْبَرَنَا أَبُو أَحْمَدَ أنبأ أَبُو بَكْرٍ ثنا مُحَمَّدٌ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنِ ابْنِ أَبِي حُسَيْنٍ الْمَكِّيِّ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا قَطْعَ فِي ثَمَرٍ مُعَلَّقٍ وَلَا فِي حَرِيسَةِ جَبَلٍ فَإِذَا آوَاهُ الْمُرَاحُ أَوِ الْجَرِينُ فَالْقَطْعُ فِيمَا بَلَغَ ثَمَنَ الْمِجَنِّ وَقَدْ رُوِّينَا هَذَا مَوْصُولًا مِنْ حَدِيثِ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَالْحَوَائِطُ لَيْسَتْ بِحِرْزٍ لِلنَّخْلِ وَلَا لِلثَّمَرِ؛ لِأَنَّ أَكْثَرَهَا مُبَاحٌ يُدْخَلُ مِنْ جَوَانِبِهِ فَمَنْ سَرَقَ مِنْ حَائِطٍ شَيْئًا مِنْ تَمْرٍ مُعَلَّقٍ لَمْ يُقْطَعْ فَإِذَا آوَاهُ الْجَرِينُ قُطِعَ فِيهِ قَالَ الشَّافِعِيُّ وَجُمْلَةُ الْحِرْزَانِ يُنْظَرُ إِلَى الْمَسْرُوقِ فَإِنْ كَانَ الْمَوْضِعَ الَّذِي سُرِقَ فِيهِ تَنْسِبُهُ الْعَامَّةُ إِلَى أَنَّهُ حِرْزٌ فِي مِثْلِ ذَلِكَ الْمَوْضِعِ قُطِعَ إِذَا  

أَخْرَجَهُ مِنَ الْحِرْزِ وَإِنْ لَمْ تَنْسِبْهُ الْعَامَّةُ إِلَى أَنَّهُ حِرْزٌ لَمْ يُقْطَعْ
