56. Theft (1/4)
٥٦۔ كِتَابُ السَّرِقَةِ ص ١
[Machine] The Messenger of Allah ﷺ said, "May Allah curse the thief who steals an egg and his hand is cut off, and who steals a rope and his hand is cut off." This is the wording of the hadith reported by Az-Za'farani.
قَالَ رَسُولُ اللهِ ﷺ لَعَنَ اللهُ السَّارِقَ يَسْرِقُ الْبَيْضَةَ فَتُقْطَعُ يَدُهُ وَيَسْرِقُ الْحَبْلَ فَتُقْطَعُ يَدُهُ لَفْظُ حَدِيثِ الزَّعْفَرَانِيِّ
The Quraish were anxious about the Makhzumi woman who had committed theft, They said : Who will speak to the Messenger of Allah ﷺ about her ? Then they said: Who will be bold enough for it but Uasmah bin Zaid, the prophet’s ﷺ friend! So Usamah spoke to him, and the Messenger of Allah ﷺ said : Are you interceding regarding one of the punishments prescribed by Allah ? He then got up and gave an address, saying : What destroyed your predecessors was just that when a person of rank among them committed a theft, They left him alone , and when a weak one of them committed a theft, they inflicted the prescribed punishment on him . I swear by Allah that if Fatimah daughter of Muhammad should steal, I would have her hand cut off. (Using translation from Abū Dāʾūd 4373)
شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللهِ ﷺ؟ فَقَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللهِ ﷺ؟ فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللهِ ﷺ أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللهِ؟ ثُمَّ قَامَ فَاخْتَطَبَ فَقَالَ أَيُّهَا النَّاسُ إِنَّمَا هَلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهُمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهُمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا
56.2 [Machine] What is required to be cut?
٥٦۔٢ بَابُ مَا يَجِبُ فِيهِ الْقَطْعُ
[Machine] The Messenger of Allah ﷺ said, "The hand is cut off for a quarter of a dinar and upward."
قَالَ رَسُولُ اللهِ ﷺ تُقْطَعُ الْيَدُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا
[Machine] On the authority of the Prophet ﷺ , he said, "Cutting (a specific amount) is valued at a quarter of a Dinar or more." And Abu Abdullah Al-Hafiz and Abu Zakariah Ibn Abi Ishaq informed us, they both said, "Abu Al-Abbas Muhammad Ibn Ya'qub narrated to us, who narrated from Al-Hasan Ibn Mukram, who mentioned it similarly."
عَنِ النَّبِيِّ ﷺ قَالَ الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا 17158 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْحَسَنُ بْنُ مُكْرَمٍ فَذَكَرَهُ بِمِثْلِهِ
The Prophet ﷺ said, "The hand should be cut off for stealing something that is worth a quarter of a Dinar or more." (Using translation from Bukhārī 6789)
أَنَّ النَّبِيَّ ﷺ قَالَ تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا
[Machine] "The Messenger of Allah ﷺ said, 'Cutting is allowed for quarter of a dinar and upwards.' This narration is from Imam Ash-Shafi'i, and in another narration from Imam Ar-Ramli, it is mentioned that he used to cut in quarter of a dinar and upwards."
رَسُولَ اللهِ ﷺ قَالَ الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا لَفْظُ حَدِيثِ الشَّافِعِيِّ وَفِي رِوَايَةِ الرَّمْلِيِّ كَانَ يَقْطَعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا
[Machine] The Prophet ﷺ said, "The hand of the thief should be cut off for a quarter of a dinar or more." This is the wording of the hadith narrated by Ibn al-Sarh, and in another narration by Harmala it is stated that Aisha, the wife of the Prophet ﷺ , narrated from the Messenger of Allah ﷺ that he said, "The hand of the thief should not be cut off except for a quarter of a dinar or more."
النَّبِيَّ ﷺ قَالَ تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا لَفْظُ حَدِيثِ ابْنِ السَّرْحِ وَفِي رِوَايَةِ حَرْمَلَةَ قَالَ عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ عَنْ رَسُولِ اللهِ ﷺ قَالَ لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي رُبِعِ دِينَارٍ فَصَاعِدًا
The hand of the thief may not be cut off but for a quarter of a dinar and upwards. (Using translation from Muslim 1684e)
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ لَا تُقْطَعُ يَدُ سَارِقٍ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا
[Machine] A man named Bina Bayy stole, so I sent Amrah bint Abdul Rahman to him. I said to her, "My son, if he does not have at least a quarter of a dinar, do not cut off his hand. For Aisha informed me that she heard the Messenger of Allah ﷺ say, 'Do not cut off (the hand) for less than a quarter of a dinar.'" So I looked and found that he had stolen two dirhams. I then struck him, imposed a fine on him, and released him.
بِنَبَطِيٍّ قَدْ سَرَقَ فَبَعَثَتْ إِلِيَّ عَمْرَةُ بِنْتُ عَبْدِ الرَّحْمَنِ أَيْ بُنِيَّ إِنْ لَمْ يَكُنْ بَلَغَ رُبْعَ دِينَارٍ فَلَا تَقْطَعْهُ فَإِنَّ عَائِشَةَ ؓ حَدَّثَتْنِي أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ لَا يُقْطَعُ فِي دُونِ رُبْعِ دِينَارٍ قَالَ فَنَظَرَ فَإِذَا سَرِقَتُهُ بَلَغَتْ دِرْهَمَيْنِ قَالَ فَضَرَبْتُهُ وَغَرَّمْتُهُ وَخَلَّيْتُ سَبِيلَهُ
[Machine] From the people of your country is a man named Hawrani who has committed a small theft. My aunt, Ummrah bint Abdulrahman, sent a message to me, saying not to rush in dealing with this man until I come to you and inform you of what I have heard from Aisha regarding the matter of the thief. So she came to me and informed me that she heard Aisha saying that the Messenger of Allah ﷺ said, "Cut off the thief's hand for a quarter of a Dinar, and do not cut off for anything less than that." And a quarter of a Dinar is three Dirhams, and a Dinar is equal to twelve Dirhams. She said, "The value of the stolen item is less than a quarter of a Dinar, so I did not cut his hand." This narration was also reported by Sulayman ibn Yasār and Muhammad ibn Abdulrahman ibn Zurārah al-Ansāri, from Ummrah, from Aisha, from the Prophet ﷺ , similar to the narration of the group, attributed to Az-Zuhri, from Ummrah.
مِنْ أَهْلِ بِلَادِكُمْ حَوْرَانِيٍّ قَدْ سَرَقَ سَرِقَةً يَسِيرَةً قَالَ فَأَرْسَلَتْ إِلِيَّ خَالَتِي عَمْرَةُ بِنْتُ عَبْدِ الرَّحْمَنِ أَنْ لَا تَعْجَلْ فِي أَمْرِ هَذَا الرَّجُلِ حَتَّى آتِيَكَ فَأُخْبِرَكَ مَا سَمِعْتُ مِنْ عَائِشَةَ ؓ فِي أَمْرِ السَّارِقِ قَالَ فَأَتَتْنِي فَأَخْبَرَتْنِي أَنَّهَا سَمِعَتْ عَائِشَةَ ؓ تَقُولُ قَالَ رَسُولُ اللهِ ﷺ اقْطَعُوا فِي رُبْعِ دِينَارٍ لَا تَقْطَعُوا فِيمَا هُوَ أَدْنَى مِنْ ذَلِكَ وَكَانَ رُبْعُ دِينَارٍ ثَلَاثَةَ دَرَاهِمَ وَالدِّينَارُ اثْنَا عَشَرَ دِرْهَمًا قَالَ وَكَانَتْ سَرِقَتُهُ دُونَ الرُّبْعِ دِينَارٍ فَلَمْ أَقْطَعْهُ وَرَوَاهُ سُلَيْمَانُ بْنُ يَسَارٍ وَمُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ زُرَارَةَ الْأَنْصَارِيُّ عَنْ عَمْرَةَ عَنْ عَائِشَةَ عَنِ النَّبِيِّ ﷺ مِنْ قَوْلِهِ نَحْوَ رِوَايَةِ الْجَمَاعَةِ عَنِ الزُّهْرِيِّ عَنْ عَمْرَةَ
[Machine] A thief was not punished during the time of the Prophet ﷺ for stealing an item worth less than the weight of a hanjafa or a turs, and both of them have a value. This is the narration of Ibn Numayr.
لَمْ يُقْطَعْ سَارِقٌ فِي عَهْدِ النَّبِيِّ ﷺ فِي أَقَلِّ مِنْ ثَمَنِ الْمِجَنِّ حَجَفَةٍ أَوْ تُرْسٍ وَكِلَاهُمَا ذُو ثَمَنٍ لَفْظُ حَدِيثِ ابْنِ نُمَيْرٍ
[Machine] Translation: The thief's hand was not cut off during the time of the Messenger of Allah ﷺ for a value less than a handful of dates or a piece of cloth, and each of them has a value. And it is known to me that the amount that
السَّارِقِ لَمْ تُقْطَعْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي أَدْنَى مِنْ ثَمَنِ حَجَفَةٍ أَوْ تُرْسٍ وَكُلُّ وَاحِدٍ مِنْهُمَا ذُو ثَمَنٍ وَأَنَّ يَدَ السَّارِقِ لَمْ تُقْطَعْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي الشَّيْءِ التَّافِهِ وَالَّذِي عِنْدِي أَنَّ الْقَدْرَ الَّذِي
[Machine] There was never a hand cut off during the time of the Messenger of Allah ﷺ for less than the worth of a handful of dates or barley.
لَمْ تَكُنْ يَدٌ تُقْطَعُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فِي أَدْنَى مِنْ ثَمَنِ مِجَنٍّ حَجَفَةٍ أَوْ تُرْسٍ
56.3 [Machine] Differences among carriers in the price of maize, and what is valid and what is not valid.
٥٦۔٣ بَابُ اخْتِلَافِ النَّاقِلِينَ فِي ثَمَنِ الْمِجَنِّ، وَمَا يَصِحُّ مِنْهُ وَمَا لَا يَصِحُّ
[Machine] The Messenger of Allah ﷺ cut off the hand of a thief for stealing something worth three dirhams.
أَنَّ رَسُولَ اللهِ ﷺ قَطَعَ سَارِقًا فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ
[Machine] The Prophet ﷺ cut off the hand of a man who stole a shield made for women, worth three dirhams.
أَنَّ النَّبِيَّ ﷺ قَطَعَ يَدَ رَجُلٍ سَرَقَ تُرْسًا مِنْ صُفَّةِ النِّسَاءِ ثَمَنُهُ ثَلَاثَةُ دَرَاهِمَ
[Machine] The Prophet ﷺ received a goat as a gift, its value was three dirhams.
أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي مِجَنٍّ ثَمَنُهُ ثَلَاثَةُ دَرَاهِمَ
The Messenger of Allah said: 'The hand of the thief is not to be cut off for anything less than a shield."' It was said to 'Aishah: 'What is the price of a shield?" She said: "One-quarter of a Dinar." (Using translation from Nasāʾī 4935)
اللهِ ﷺ لَا يُقْطَعُ السَّارِقُ فِيمَا دُونَ ثَمَنِ الْمِجَنِّ فَقِيلَ لِعَائِشَةَ ؓ مَا ثَمَنُ الْمِجَنِّ؟ قَالَتْ رُبْعُ دِينَارٍ
[Machine] Allah ﷺ said: "Do not cut off the hand of the thief except for the value of the stolen goods. 'Umrah bint Abd al-Rahman asked Aisha, 'What was the value of the stolen goods at that time?' Aisha said, 'One quarter of a dinar.' The hadith of Aisha regarding the Prophet ﷺ cutting off the hand for a quarter of a dinar, and the hadith of Ibn 'Umar regarding the Prophet ﷺ cutting off a hand for an item worth three dirhams, are both agreed upon. Al-Shafi'i said: 'These two hadiths are in agreement, because three dirhams at the time of the Prophet ﷺ were worth a quarter of a dinar. This is because the exchange rate during the time of the Messenger of Allah ﷺ was twelve dirhams to a dinar, and it remained the same afterwards. Umar mandated the payment of twelve thousand dirhams as blood money for the people of paper money, and one thousand dinars for the people of gold. Aisha, Abu Huraira, and Ibn Abbas all agreed that the blood money is twelve thousand dirhams. The hadith of Uthman regarding the Uturjah is also cited as evidence, and the hadith of Abu Bakr ibn Hazm from 'Umrah, who heard it from Aisha, is also evidence. And Allah knows best."
اللهِ ﷺ قَالَ لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي ثَمَنِ الْمِجَنِّ فَمَا فَوْقَهُ قَالَتْ عَمْرَةُ بِنْتُ عَبْدِ الرَّحْمَنِ فَقُلْتُ لِعَائِشَةَ ؓ مَا ثَمَنُ الْمِجَنِّ يَوْمَئِذٍ؟ قَالَتْ رُبْعُ دِينَارٍ وَحَدِيثُ عَائِشَةَ عَنِ النَّبِيِّ ﷺ الْقَطْعُ فِي رُبْعِ دِينَارٍ وَحَدِيثُ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ قَطَعَ فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ قَالَ الشَّافِعِيُّ هَذَانِ مُتَّفِقَانِ؛ لِأَنَّ ثَلَاثَةَ دَرَاهِمَ فِي زَمَانِ النَّبِيِّ ﷺ رُبْعُ دِينَارٍ وَذَلِكَ أَنَّ الصَّرْفَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ اثْنَا عَشَرَ دِرْهَمًا بِدِينَارٍ وَكَانَ كَذَلِكَ بَعْدَهُ وَفَرَضَ عُمَرُ الدِّيَةَ اثْنَيْ عَشَرَ أَلْفَ دِرْهَمٍ عَلَى أَهْلِ الْوَرِقِ وَعَلَى أَهْلِ الذَّهَبِ أَلْفَ دِينَارٍ وَقَالَتْ عَائِشَةُ وَأَبُو هُرَيْرَةَ وَابْنُ عَبَّاسٍ فِي الدِّيَةِ اثْنَا عَشَرَ أَلْفَ دِرْهَمٍ وَاحْتُجَّ فِي ذَلِكَ أَيْضًا بِحَدِيثِ عُثْمَانَ فِي الْأُتْرُجَّةِ وَذَلِكَ يَرِدُ وَحَدِيثُ أَبِي بَكْرِ بْنِ حَزْمٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ دَلِيلٌ عَلَى ذَلِكَ وَاللهُ أَعْلَمُ
[Machine] The price of the camel during the time of the Messenger of Allah ﷺ was set at ten dirhams, and so on.
كَانَ ثَمَنُ الْمِجَنِّ فِي عَهْدِ رَسُولِ اللهِ ﷺ يُقَوَّمُ عَشَرَةَ دَرَاهِمَ فَكَذَا
[Machine] The hand was not cut off during the time of the Messenger of Allah ﷺ, except in the case of theft, and its value at that time was a dinar. Al-Bukhari said: Ayman al-Habashi, from the people of Mecca, the freed slave of Ibn Abu Amrah al-Makki, heard Aisha narrate from him. His son, Abdul Wahid ibn Ayman, narrated from him. The Sheikh (Imam Bukhari) said: Ahmad said that his narration from the Prophet ﷺ is cut off. Sharik ibn Abdullah al-Qadi narrated it from Mansour, who mixed up his chain of narration and narrated from him from Mansour from Mujahid and Ata from Ayman ibn Um Ayman. He (Ahmad) raised him (Sharik ibn Abdullah) and narrated from him from Mansour from both of them from Um Ayman. He also narrated from him from Mansour from Ata from Ayman ibn Um Ayman from Um Ayman. And this is an error from Sharik or from the one who narrated from him. And Imam Shafi'i responded to him with what
لَمْ تُقْطَعِ الْيَدُ فِي زَمَانِ رَسُولِ اللهِ ﷺ إِلَّا فِي مِجَنٍّ وَقِيمَتُهُ يَوْمَئِذٍ دِينَارٌ قَالَ الْبُخَارِيُّ أَيْمَنُ الْحَبَشِيُّ مِنْ أَهْلِ مَكَّةَ مَوْلَى ابْنِ أَبِي عَمْرَةَ الْمَكِّيِّ سَمِعَ عَائِشَةَ رَوَى عَنْهُ ابْنُهُ عَبْدُ الْوَاحِدِ بْنُ أَيْمَنَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَرِوَايَتُهُ عَنِ النَّبِيِّ ﷺ مُنْقَطِعَةٌ وَرَوَاهُ شَرِيكُ بْنُ عَبْدِ اللهِ الْقَاضِي عَنْ مَنْصُورٍ فَخَلَطَ فِي إِسْنَادِهِ فَرَوَى عَنْهُ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ وَعَطَاءٍ عَنْ أَيْمَنَ ابْنِ أُمِّ أَيْمَنَ رَفَعَه وَرَوَى عَنْهُ عَنْ مَنْصُورٍ عَنْهُمَا عَنْ أُمِّ أَيْمَنَ وَرَوَى عَنْهُ عَنْ مَنْصُورٍ عَنْ عَطَاءٍ عَنْ أَيْمَنَ ابْنِ أُمِّ أَيْمَنَ عَنْ أُمِّ أَيْمَنَ وَهَذَا مِنْ خَطَأِ شَرِيكٍ أَوْ مَنْ رَوَى عَنْهُ وَقَدْ أَجَابَ عَنْهُ الشَّافِعِيُّ بِمَا
[Machine] Al-Shafi'i said: I said to some people, "This is the Sunnah of the Messenger of Allah ﷺ , that it is permissible to cut (a hand) if the value reaches a quarter of a dinar and above. So how can you say that it is only permissible to cut the hand if the value reaches ten dirhams and above? What is your evidence for that?" He replied, "We have narrated from Shurayk from Mansur from Mujahid from Ayman from the Prophet ﷺ something similar to our statement." I said, "Do you know Ayman?" He replied, "Ayman is the one who narrated from him, Ata' bin Abi Rabah, and he is a person whose narration may be lesser than that of Ata', and Ata' narrated from him, the hadith of Ta'ba ibn Amra ibn Ka'b ibn Malik, and this hadith is disconnected. Disconnected narration is not considered as evidence." He said, "Indeed, Shurayk bin Abdullah narrated from Mujahid from Ayman bin Um Ayman, the brother of Usama, from his mother. I said, "You have no knowledge of our companions. Ayman, the brother of Usama, was killed with the Messenger of Allah ﷺ on the Day of Hunayn before Mujahid was born, and there was no one left after the Prophet ﷺ to narrate from him." The sheikh, may Allah have mercy on him, who was referred to by al-Shafi'i, said: "This narration from Ata' from Ayman, other than this hadith, is not considered valid."
قَالَ الشَّافِعِيُّ ؓ قُلْتُ لِبَعْضِ النَّاسِ هَذِهِ سُنَّةُ رَسُولِ اللهِ ﷺ أَنْ يُقْطَعَ فِي رُبْعِ دِينَارٍ فَصَاعِدًا فَكَيْفَ قُلْتَ لَا تُقْطَعُ الْيَدُ إِلَّا فِي عَشَرَةِ دَرَاهِمَ فَصَاعِدًا؟ وَمَا حُجَّتُكَ فِي ذَلِكَ؟ قَالَ قَدْ رُوِّينَا عَنْ شَرِيكٍ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ عَنْ أَيْمَنَ عَنِ النَّبِيِّ ﷺ شَبِيهًا بِقَوْلِنَا قُلْتُ أَتَعْرِفُ أَيْمَنَ؟ إِنَّمَا أَيْمَنُ الَّذِي رَوَى عَنْهُ عَطَاءٌ فَرَجُلٌ حَدَثٌ لَعَلَّهُ أَصْغَرُ مِنْ عَطَاءٍ وَرَوَى عَنْهُ عَطَاءٌ حَدِيثًا عَنْ تَبِيعٍ ابْنِ امْرَأَةِ كَعْبٍ عَنْ كَعْبٍ فَهَذَا مُنْقَطِعٌ وَالْحَدِيثُ الْمُنْقَطِعُ لَا يَكُونُ حُجَّةً قَالَ فَقَدْ رَوَى شَرِيكُ بْنُ عَبْدِ اللهِ عَنْ مُجَاهِدٍ عَنْ أَيْمَنَ ابْنِ أُمِّ أَيْمَنَ أَخِي أُسَامَةَ لِأُمِّهِ قُلْتُ لَا عِلْمَ لَكَ بِأَصْحَابِنَا أَيْمَنُ أَخُو أُسَامَةَ قُتِلَ مَعَ رَسُولِ اللهِ ﷺ يَوْمَ حُنَيْنٍ قَبْلَ أَنْ يُولَدَ مُجَاهِدٌ وَلَمْ يَبْقَ بَعْدَ النَّبِيِّ ﷺ فَيُحَدِّثَ عَنْهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَالَّذِي أَشَارَ إِلَيْهِ الشَّافِعِيُّ ؓ مِنْ رِوَايَةِ عَطَاءٍ عَنْ أَيْمَنَ غَيْرُ هَذَا الْحَدِيثِ
[Machine] Whoever performs ablution and perfects their ablution, then prays the evening prayer, followed by four units of prayer, completes the bowing and prostration in them, and learns what is recited in them, will be rewarded as if they have observed the Night of Decree. Al-Bukhari indicated this in his Tarikh (history) and he and others used it as evidence that his hadith about the reward of observing the Night of Decree is disconnected in relation to the eight-unit prayer.
مَنْ تَوَضَّأَ فَأَحْسَنَ الْوُضُوءَ ثُمَّ صَلَّى الْعِشَاءَ الْآخِرَةَ وَصَلَّى بَعْدَهَا أَرْبَعَ رَكَعَاتٍ فَأَتَمَّ رُكُوعَهُنَّ وَسُجُودَهُنَّ وَتَعَلَّمَ مَا يَقْتَرِئُ فِيهِنَّ كُنَّ لَهُ بِمَنْزِلَةِ لَيْلَةِ الْقَدْرِ وَقَدْ أَشَارَ إِلَيْهِ الْبُخَارِيُّ فِي التَّارِيخِ وَاسْتَدَلَّ هُوَ وَغَيْرُهُ بِذَلِكَ عَلَى أَنَّ حَدِيثَهُ فِي ثَمَنِ الْمِجَنِّ مُنْقَطِعٌ
[Machine] The price of a slave during the time of the Prophet Muhammad ﷺ was ten dirhams. Abu Abdullah Al-Hafiz informed us that Abu al-Abbas reported that Al-Rabi' said that Al-Shafi'i said: "This is the opinion of Abdullah ibn Amr in narrating from Amr ibn Shu'aib and the slaves have always been and are currently a commodity that is priced at one hundred and twenty dirhams. So when the Messenger of Allah ﷺ cut in a quarter of a dinar, he cut in more than that. And you claim that Amr ibn Shu'aib is not one whose narration is accepted, while he has transmitted sunan that agree with our statements, and you say he is mistaken. So how can you reject his narration once and then use it as evidence against the people of memorization and truthfulness, even though he has not reported anything that contradicts our statements?"
كَانَ ثَمَنُ الْمِجَنِّ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ عَشَرَةَ دَرَاهِمَ 17178 فَقَدْ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ ؓ هَذَا رَأْيٌ مِنْ عَبْدِ اللهِ بْنِ عَمْرٍو فِي رِوَايَةِ عَمْرِو بْنِ شُعَيْبٍ وَالْمِجَانُّ قَدِيمًا وَحَدِيثًا سَلْعٌ يَكُونُ ثَمَنَ عَشَرَةٍ وَمِائَةٍ وَدِرْهَمَيْنِ فَإِذَا قَطَعَ رَسُولُ اللهِ ﷺ فِي رُبْعِ دِينَارٍ قَطَعَ فِي أَكْثَرَ مِنْهُ وَأَنْتَ تَزْعُمُ أَنَّ عَمْرَو بْنَ شُعَيْبٍ لَيْسَ مِمَّنْ تُقْبَلُ رِوَايَتُهُ وَتَتْرُكُ عَلَيْنَا سُنَنًا رَوَاهَا تُوَافِقُ أَقَاوِيلَنَا وَتَقُولُ غَلِطَ فَكَيْفَ تَرُدُّ رِوَايَتَهُ مَرَّةً ثُمَّ تَحْتَجُّ بِهِ عَلَى أَهْلِ الْحِفْظِ وَالصِّدْقِ مَعَ أَنَّهُ لَمْ يَرْوِ شَيْئًا يُخَالِفُ قَوْلَنَا؟
The Messenger of Allah ﷺ had thief’s hand cut off for a shield worth three dirhams. (Using translation from Abū Dāʾūd 4385)
أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي مِجَنٍّ ثَمَنُهُ خَمْسَةُ دَرَاهِمَ
56.4 [Machine] What the companions have reported on matters that necessitate certainty
٥٦۔٤ بَابُ مَا جَاءَ عَنِ الصَّحَابَةِ مْ فِيمَا يَجِبُ بِهِ الْقَطْعُ
[Machine] "O Abu Hamzah, does the thief get less than a dinar cut off? He said: Abu Bakr did cut off someone in something that does not please me, for it was three dirhams for me."
يَا أَبَا حَمْزَةَ أَيُقْطَعُ السَّارِقُ فِي أَقَلَّ مِنْ دِينَارٍ؟ قَالَ قَدْ قَطَعَ أَبُو بَكْرٍ ؓ فِي شَيْءٍ لَا يَسُرُّنِي أَنَّهُ لِي بِثَلَاثَةِ دَرَاهِمَ
[Machine] I attended Abu Bakr Al-Siddiq and he caught a thief stealing something worth three dirhams. It pleases me that I own three dirhams.
حَضَرْتُ أَبَا بَكْرٍ الصِّدِّيقَ ؓ قَطَعَ سَارِقًا فِي شَيْءٍ مَا يَسْوَى ثَلَاثَةَ دَرَاهِمَ وَمَا يَسُرُّنِي أَنَّهُ لِي بِثَلَاثَةِ دَرَاهِمَ
[Machine] "And Abu Abdullah Al-Hafiz informed us that Abu Abdullah Al-Saffar narrated to us, that Abdullah ibn Ahmad ibn Hanbal narrated to me, that Amr ibn Muhammad narrated to me, that Abu Ahmad Al-Zubairi narrated to me, from Sufyan, from Shu'bah, from Qatadah, from Anas, who said: Abu Bakr cut five dirhams."
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُ ثنا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ حَدَّثَنِي عَمْرُو بْنُ مُحَمَّدٍ ثنا أَبُو أَحْمَدَ الزُّبَيْرِيُّ عَنْ سُفْيَانَ عَنْ شُعْبَةَ عَنْ قَتَادَةَ عَنْ أَنَسٍ قَالَ قَطَعَ أَبُو بَكْرٍ ؓ فِي خَمْسَةِ دَرَاهِمَ
"I heard Anas say: 'A man stole a shield during the time of Abu Bakr, the value of which was five Dirhams, and he cut off his hand."' (Using translation from Nasāʾī 4913)
أَنَّ رَجُلًا سَرَقَ مِجَنًّا عَلَى عَهْدِ النَّبِيِّ ﷺ أَوْ أَبِي بَكْرٍ أَوْ عُمَرَ فَقُوِّمَ خَمْسَةَ دَرَاهِمَ فَقَطَعَهُ
[Machine] That the Prophet ﷺ cut a shirt into pieces, the price of one piece being five dirhams, and Abu Bakr (may Allah be pleased with him) also cut a shirt into pieces, the price of one piece being five dirhams. This is what was reported in the preserved narration of Sa'id ibn Abi 'Arubah.
أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي مِجَنٍّ ثَمَنُهُ خَمْسَةُ دَرَاهِمَ وَأَنَّ أَبَا بَكْرٍ ؓ قَطَعَ فِي مِجَنٍّ ثَمَنُ خَمْسَةِ دَرَاهِمَ كَذَا قَالَ وَالْمَحْفُوظُ مِنْ حَدِيثِ سَعِيدِ بْنِ أَبِي عَرُوبَةَ
[Machine] That Abu Bakr cut in a sheep, its price was five dirhams or four dirhams, Sa'id is doubtful.
أَنَّ أَبَا بَكْرٍ ؓ قَطَعَ فِي مِجَنٍّ ثَمَنُهُ خَمْسَةُ دَرَاهِمَ أَوْ أَرْبَعَةُ دَرَاهِمَ شَكَّ سَعِيدٌ
[Machine] The Messenger of Allah and Abu Bakr and Umar were in Mijann. I asked, "How much did it equal?" He said, "Five dirhams" in the narration of Shayban, and in the narration of Musa, Abu Hilal said, "It is my understanding that the Messenger of Allah cut off the hand of a thief in Mijann." We said, "O Abu Hamza, how much did that Mijann equal?" He said, "Five dirhams."
رَسُولُ اللهِ ﷺ وَأَبُو بَكْرٍ وَعُمَرُ ؓ فِي مِجَنٍّ قُلْتُ كَمْ كَانَ يُسَاوِي؟ قَالَ خَمْسَةَ دَرَاهِمَ لَفْظُ حَدِيثِ شَيْبَانَ وَفِي رِوَايَةِ مُوسَى قَالَ أَبُو هِلَالٍ حِفْظِي أَنَّ رَسُولَ اللهِ ﷺ قَطَعَ يَدَ سَارِقٍ فِي مِجَنٍّ قَالَ قُلْنَا يَا أَبَا حَمْزَةَ كَمْ كَانَ يَسْوَى ذَاكَ الْمِجَنُّ؟ قَالَ خَمْسَةَ دَرَاهِمَ
[Machine] It is narrated that the Prophet ﷺ cut a camel in five or four dirhams. Then I met Sa'id ibn Abi 'Arubah and he said it was from Abu Bakr As-Siddiq. Then I met Hisham ibn Abi Abdullah and he said it was from the Prophet ﷺ , otherwise it was from Abu Bakr. It seemed that he was doubtful about it, but the correct narration is that it was from Abu Bakr.
أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي مِجَنٍّ خَمْسَةِ دَرَاهِمَ أَوْ أَرْبَعَةِ دَرَاهِمَ فَلَقِيتُ سَعِيدَ بْنَ أَبِي عَرُوبَةَ فَقَالَ هُوَ عَنْ أَبِي بَكْرٍ الصِّدِّيقِ ؓ فَلَقِيتُ هِشَامَ بْنَ أَبِي عَبْدِ اللهِ فَقَالَ هُوَ عَنِ النَّبِيِّ ﷺ وَإِلَّا فَهُوَ عَنْ أَبِي بَكْرٍ فَكَأَنَّهُ شَكَّ فِيهِ وَالصَّحِيحُ أَنَّهُ عَنْ أَبِي بَكْرٍ ؓ
[Machine] That a thief stole a purse during the time of Uthman, so Uthman ordered it to be brought to him. It contained three dirhams from the exchange of twelve dirhams in a dinar. He cut off the thief's hand. Malik said, "And it is the purse that people eat from."
أَنَّ سَارِقًا سَرَقَ أُتْرُجَّةً فِي عَهْدِ عُثْمَانَ ؓ فَأَمَرَ بِهَا عُثْمَانُ فَقُوِّمَتْ ثَلَاثَةَ دَرَاهِمَ مِنْ صَرْفِ اثْنَيْ عَشَرَ دِرْهَمًا بِدِينَارٍ فَقَطَعَ يَدَهُ قَالَ مَالِكٌ وَهِيَ الْأُتْرُنْجَةُ الَّتِي يَأْكُلُهَا النَّاسُ
The prophet ﷺ used to cut off a thief’s hand for a quarter of a dinar and upwards. (Using translation from Abū Dāʾūd 4383)
الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا
[Machine] That Ali cut off the hand of a thief with an iron egg costing a quarter of a dinar.
أَنَّ عَلِيًّا ؓ قَطَعَ يَدَ سَارِقٍ فِي بَيْضَةٍ مِنْ حَدِيدٍ ثَمَنُ رُبْعِ دِينَارٍ
[Machine] Uthman owes Qawwam eight dirhams, but he did not pay him back.
لِعُثْمَانَ ؓ قَوِّمْهُ فَقَوَّمَهُ ثَمَانِيَةَ دَرَاهِمَ فَلَمْ يَقْطَعْهُ
[Machine] Abdullah bin Masoud said, "The hand is not to be severed except for a dinar or ten dirhams, and both of them are cut off."
قَالَ عَبْدُ اللهِ بْنُ مَسْعُودٍ لَا تُقْطَعُ الْيَدُ إِلَّا فِي الدِّينَارِ أَوِ الْعَشَرَةِ دَرَاهِمَ فَكِلَاهُمَا مُنْقَطِعٌ
[Machine] He said, "The hand is not cut off except for ten dirhams." We said, "However, At-Thuwri narrated from 'Isa bin Abi Az-Zahhak, from Ash-Sha'bi, from Ibn Mas'ud, that the Messenger of Allah ﷺ cut off the hand of a thief for five dirhams. This is closer to being authentic from 'Abdullah than the Hadith of Al-Mas'udi from Al-Qasim, from 'Abdullah." He (Ibn Mas'ud) said: "Then how come you did not take it?" We said: "This is a Hadith that does not contradict our Hadith. If he cut (the hand off) for three, he cut it for five or more." He (Ibn Mas'ud) said: "We have narrated from 'Umar bin Al-Khattab that he did not cut off for eight dirhams." Ash-Shafi'i said: "The narration of 'Umar is not correct." Ma'mar narrated from 'Ata Al-Khurasani from 'Umar (saying): "The punishment for theft is one-quarter of a Dinar or more." We did not see the need to rely on it, because it is not proven and no one can use the Messenger of Allah ﷺ as evidence, and the Muslims must follow his command." Ash-Shafi'i said: "So we do not rely on a Hadith that differs from us, nor do we rely on what those who have abandoned Hadith and rely solely on the apparent meaning of the Qur'an have relied upon." The Shaykh (Ash-Shafi'i) may Allah have mercy upon him) said: "As for the narration of Dawud Al-Awdi Az-Za'afiri from 'Amir Ash-Sha'bi from 'Ali, regarding cutting off (the hand), I have not come across it yet, and his narration is only in relation to the lowest amount of goods, which the scholars of his time criticized him for. If he also narrated concerning cutting (the hand) off, then it is Munkar (denounced) and Dawud cannot be relied upon with similar narrations. It has also been narrated from another obscure route from 'Ali which is weak and cannot be relied upon with similar narrations."
أَنَّهُ قَالَ لَا تُقْطَعُ الْيَدُ إِلَّا فِي عَشَرَةِ دَرَاهِمَ قُلْنَا فَقَدْ رَوَى الثَّوْرِيُّ عَنْ عِيسَى بْنِ أَبِي عَزَّةَ عَنِ الشَّعْبِيِّ عَنِ ابْنِ مَسْعُودٍ أَنَّ رَسُولَ اللهِ ﷺ قَطَعَ سَارِقًا فِي خَمْسَةِ دَرَاهِمَ وَهَذَا أَقْرَبُ أَنْ يَكُونَ صَحِيحًا عَنْ عَبْدِ اللهِ مِنْ حَدِيثِ الْمَسْعُودِيِّ عَنِ الْقَاسِمِ عَنْ عَبْدِ اللهِ قَالَ فَكَيْفَ لَمْ تَأْخُذُوا بِهَذَا؟ قُلْنَا هَذَا حَدِيثٌ لَا يُخَالِفُ حَدِيثَنَا إِذَا قَطَعَ فِي ثَلَاثَةِ دَرَاهِمَ قَطَعَ فِي خَمْسَةٍ أَوْ أَكْثَرَ قَالَ فَقَدْ رُوِّينَا عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ أَنَّهُ لَمْ يَقْطَعْ فِي ثَمَانِيَةِ دَرَاهِمَ قَالَ الشَّافِعِيُّ رِوَايَتُهُ عَنْ عُمَرَ ؓ غَيْرُ صَحِيحَةٍ وَقَدْ رَوَى مَعْمَرٌ عَنْ عَطَاءٍ الْخُرَاسَانِيِّ عَنْ عُمَرَ ؓ الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا فَلَمْ نَرَ أَنْ نَحْتَجَّ بِهِ؛ لِأَنَّهُ لَيْسَ بِثَابِتٍ وَلَيْسَ لِأَحَدٍ مَعَ رَسُولِ اللهِ ﷺ حُجَّةٌ وَعَلَى الْمُسْلِمِينَ اتِّبَاعُ أَمْرِهِ قَالَ الشَّافِعِيُّ ؓ فَلَا إِلَى حَدِيثٍ صَحِيحٍ ذَهَبَ مَنْ خَالَفَنَا وَلَا إِلَى مَا ذَهَبَ إِلَيْهِ مَنْ تَرَكَ الْحَدِيثَ وَاسْتَعْمَلَ ظَاهِرَ الْقُرْآنَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ أَمَّا رِوَايَةُ دَاوُدَ الْأَوْدِيِّ الزَّعَافِرِيِّ عَنْ عَامِرٍ الشَّعْبِيِّ عَنْ عَلِيٍّ ؓ فِي الْقَطْعِ فَلَمْ أَقِفْ عَلَيْهَا بَعْدُ وَإِنَّمَا رِوَايَتُهُ فِي أَقَلِّ الصَّدَاقِ وَقَدْ أَنْكَرَهَا عَلَيْهِ عُلَمَاءُ عَصْرِهِ فَإِنْ كَانَ قَدْ رَوَى أَيْضًا فِي الْقَطْعِ فَهُوَ مُنْكَرٌ وَدَاوُدُ لَا يُحْتَجُّ بِمِثْلِهِ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ مُظْلِمٍ عَنْ عَلِيٍّ ؓ وَهُوَ ضَعِيفٌ لَا يُحْتَجُّ بِمِثْلِهِ
[Machine] Narrated by Ibn Mas'ud, and he was contradicted by Al-Mas'udi who transmitted it as he heard it, and the one who transmitted it in opposition to him is not weaker than him.
عَنِ ابْنِ مَسْعُودٍ وَخَالَفَهُ الْمَسْعُودِيُّ فَرَوَاهُ مُرْسَلًا كَمَا مَضَى وَالَّذِي رَوَى فِي مُعَارَضَتِهِ لَيْسَ بِأَضْعَفَ مِنْهُ
[Machine] "Peace be upon him, he cut a vein that was worth five dirhams. As for the narration of Umar, we have mentioned that it was severed from the perspective that it was only."
ﷺ قَطَعَ فِي مِجَنٍّ قِيمَتُهُ خَمْسَةُ دَرَاهِمَ وَأَمَّا حَدِيثُ عُمَرَ ؓ فَقَدْ ذَكَرْنَا انْقِطَاعَهُ مِنْ جِهَةِ أَنَّهُ إِنَّمَا
عَنْ عُمَرَ ؓ وَهُوَ مُنْقَطِعٌ
[Machine] He heard Abu Hurairah and Abu Sa'id Al-Khudri saying: cutting (money) into four dirhams and above. The Sheikh, may Allah have mercy on him, said: It is possible that they said it when the exchange of a quarter dinar for four dirhams occurred, and this is what we have narrated from Umar, and from others regarding five dirhams. It is possible that this occurred when the exchange rate changed. The original amount is a quarter dinar according to what has been established from the Sunnah.
أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ وَأَبَا سَعِيدٍ الْخُدْرِيَّ يَقُولَانِ الْقَطْعُ فِي أَرْبَعَةِ دَرَاهِمَ فَصَاعِدًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ يُحْتَمَلُ أَنْ يَكُونَا إِنَّمَا قَالَاهُ حِينَ صَارَ صَرْفُ رُبْعِ دِينَارٍ بِأَرْبَعَةِ دَرَاهِمَ وَكَذَلِكَ مَا رُوِّينَا عَنْ عُمَرَ ؓ وَعَنْ غَيْرِهِ فِي الْخَمْسِ يُحْتَمَلُ أَنْ يَكُونَ ذَلِكَ عِنْدَ تَغَيُّرِ الصَّرْفِ وَالْأَصْلُ فِي النِّصَابِ هُوَ رُبْعُ دِينَارٍ بِدَلَالَةِ مَا مَضَى مِنَ السُّنَّةِ الثَّابِتَةِ
"It has not been too long and I have not forgotten yet. Cutting off (the hand of the thief) is for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4927)
أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ قَالَتْ مَا طَالَ عَلَيَّ وَمَا نَسِيتُ الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا

٥٦۔٥ بَابُ الْقَطْعِ فِي الطَّعَامِ الرُّطَبِ
مَالِكٌ وَهِيَ الْأُتْرُجَّةُ الَّتِي يَأْكُلُهَا النَّاسُ
56.6 [Machine] The translation of the given heading into English would be: "Compensation for Everything that has a Price if Stolen from a Protected Place and its Value Reaches a Quarter Dinar.
٥٦۔٦ بَابُ الْقَطْعِ فِي كُلِّ مَا لَهُ ثَمَنٌ إِذَا سُرِقَ مِنْ حِرْزٍ وَبَلَغَتْ قِيمَتُهُ رُبْعَ دِينَارٍ
[Machine] "He (the Prophet Muhammad ﷺ ) narrated that there should be no cutting or increasing in the quantity of fruits. Abu Ali Al-Roudhbary informed us that Abu Bakr ibn Dasa narrated to us that Abu Dawood narrated to us that Muhammad ibn Ubaid narrated to us that Hammad narrated to us from Yahya, from Muhammad ibn Yahya ibn Habban, with this hadith. He (Marwan) then whipped him (the person) with lashes and set him free."
فَحَدَّثَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ 17201 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ عُبَيْدٍ ثنا حَمَّادٌ ثنا يَحْيَى عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ بِهَذَا الْحَدِيثِ قَالَ فَجَلَدَهُ مَرْوَانُ جَلَدَاتٍ وَخَلَّى سَبِيلَهُ
[Machine] The Messenger of Allah ﷺ said: "No fruit should be cut in half nor should it be left in abundance." Yahya said: "The 'thamar' (fruit) refers to what is at the top of the palm tree, while 'al-kathar' (abundance) refers to the fruit that is still young and green."
قَالَ رَسُولُ اللهِ ﷺ لَا يُقْطَعُ فِي ثَمَرٍ وَلَا كَثَرٍ قَالَ يَحْيَى الثَّمَرُ مَا كَانَ فِي رُءُوسِ النَّخْلِ وَالْكَثَرُ الْوَدِيُّ وَالْجُمَّارُ
[Machine] "That the Prophet ﷺ said, 'There is neither shortage nor abundance in fruit.' The wording of the hadith is a narration of Abu Sa'eed, and Abu Sa'eed added in his narration: Al-Shafi'i said, 'With this, we say there is neither shortage in suspended fruit, because it is not yet fully grown, nor abundance in hanging fruit, because it is not yet fully grown. And this is similar to the narration of Amr ibn Shuayb.'"
أَنَّ النَّبِيَّ ﷺ قَالَ لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ لَفْظُ حَدِيثِ أَبِي سَعِيدٍ زَادَ أَبُو سَعِيدٍ فِي رِوَايَتِهِ قَالَ الشَّافِعِيُّ وَبِهَذَا نَقُولُ لَا قَطْعَ فِي ثَمَرٍ مُعَلَّقٍ؛ لِأَنَّهُ غَيْرُ مُحْرَزٍ وَلَا جُمَّارٍ لِأَنَّهُ غَيْرُ مُحْرَزٍ وَهُوَ يُشْبِهُ حَدِيثَ عَمْرِو بْنِ شُعَيْبٍ
[Machine] From the Prophet ﷺ that he said, "There should be no cutting in hanging fruits. But if the crows peck at it, then cutting it is permissible."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لَا قَطْعَ فِي ثَمَرٍ مُعَلَّقٍ فَإِذَا آوَاهُ الْجَرِينُ فَفِيهِ الْقَطْعُ
[Machine] The Messenger of Allah ﷺ was asked, "In what situations is the hand cut off?" He replied, "It is not cut off for a hanging fruit. If a crow pecks at it, then it is cut off for the worth of a mudd [a unit of measurement]. It is also not cut off for grazing on a mountain, but if a sheep grazes on it, then it is cut off for the worth of a mudd." Abu Hazim Al-Hafiz and Abu Nasr Ibn Qatadah narrated to us, reporting from Abu Al-Fadl Ibn Khumayrawayh, who reported from Ahmad Ibn Najdah, who narrated from Sa'id Ibn Mansur, who narrated from Abu Mu'awiyah, who narrated from a man from Thaqif, who reported from Abu Salamah Ibn 'Abdul Rahman, who said, "Uthman Ibn 'Affan said, 'There is no cutting off for birds.'"
سُئِلَ رَسُولُ اللهِ ﷺ فِي كَمْ تُقْطَعُ الْيَدُ؟ قَالَ لَا تُقْطَعُ فِي ثَمَرٍ مُعَلَّقٍ فَإِذَا آوَاهُ الْجَرِينُ قُطِعَتْ فِي ثَمَنِ الْمِجَنِّ وَلَا تُقْطَعُ فِي حَرِيسَةِ الْجَبَلِ وَإِذَا آوَاهُ الْمُرَاحُ قُطِعَتْ فِي ثَمَنِ الْمِجَنِّ أَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ وَأَبُو نَصْرِ بْنُ قَتَادَةَ قَالَا أنبأ أَبُو الْفَضْلِ بْنُ خَمِيرَوَيْهِ أنبأ أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا أَبُو مُعَاوِيَةَ ثنا رَجُلٌ مِنْ ثَقِيفٍ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ قَالَ قَالَ عُثْمَانُ بْنُ عَفَّانَ ؓ لَا قَطْعَ فِي طَيْرٍ
[Machine] "And Abu Hazim and Abu Nasr narrated that Abu Al-Fadl narrated that Ahmad narrated that Saeed narrated that Faraj ibn Fadalah narrated from Luqman ibn Aamir from Abu Ad-Dardaa who said, 'There is no cutting for the thief of a pigeon, and this is only intended for birds and pigeons that are sent without a guardian.'"
وَأَخْبَرَنَا أَبُو حَازِمٍ وَأَبُو نَصْرٍ قَالَا أنبأ أَبُو الْفَضْلِ أنبأ أَحْمَدُ ثنا سَعِيدٌ ثنا فَرَجُ بْنُ فَضَالَةَ عَنْ لُقْمَانَ بْنِ عَامِرٍ عَنْ أَبِي الدَّرْدَاءِ قَالَ لَيْسَ عَلَى سَارِقِ الْحَمَامِ قَطْعٌ وَهَذَا إِنَّمَا أَرَادَ فِي الطَّيْرِ وَالْحَمَامِ الْمُرْسَلَةِ فِي غَيْرِ حِرْزٍ
