[Machine] The scholars from the people of Madinah used to say that whoever steals a young or non-Arab slave has no retribution. It was narrated that Umar ibn Al-Khattab did not order the punishment for them. He said, "These are human traffickers." Our companions interpreted this to mean that if the slave is intelligent, then it has been narrated that Umar cut off the hand of a man who stole a slave boy.  

البيهقي:١٧٢٣٠أَخْبَرَنَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ يُوسُفَ أنبأ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ ثنا إِسْمَاعِيلُ الْقَاضِي ثنا ابْنُ أَبِي أُوَيْسٍ ثنا ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ

عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ سَرَقَ عَبْدًا صَغِيرًا أَوْ أَعْجَمِيًّا لَا حِيلَةَ لَهُ قُطِعَ وَرُوِي عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ أَنَّهُ لَمْ يَرَ عَلَيْهِمُ الْقَطْعَ قَالَ هَؤُلَاءِ خَلَّابُونَ قَالَ أَصْحَابُنَا مَعْنَاهُ فِي الْعَبْدِ إِذَا كَانَ عَاقِلًا فَقَدْ رُوِيَ عَنْ عُمَرَ ؓ أَنَّهُ قَطَعَ رَجُلًا فِي غُلَامٍ سُرِقَ
