[Machine] They were concerned about the matter of the woman with the deviated hand who had stolen, so they asked, "Who will speak to the Messenger of Allah ﷺ about her?" They said, "No one would dare except Usama bin Zaid, the beloved of the Messenger of Allah ﷺ ." So Usama spoke to him, and the Messenger of Allah ﷺ asked, "Will you intercede in one of the limits set by Allah?" Then he got up and delivered a sermon, saying, "The people who came before you were destroyed because when the honorable among them stole, they would leave him, but when the weak among them stole, they would establish the prescribed punishment upon him. By Allah! If Fatima, the daughter of Muhammad, were to steal, I would cut off her hand." It is reported in the authentic Hadith of Al-Laith bin Saad, number 17228: Abu Abdullah Al-Hafiz informed us, who was informed by Abu Amr Al-Hiri, who was informed by Abdullah bin Muhammad bin Yunus, who was informed by Abu At-Tahir, who was informed by Ibn Wahb, who was informed by Yunus, from Ibn Shihab, who said: 'Urwa bin Az-Zubair informed me, from Aisha, the wife of the Prophet ﷺ , that the people of Quraysh were most concerned about the matter of the woman who had stolen during the time of the Prophet ﷺ in the Battle of Fath. Then he mentioned the meaning of the Hadith of Al-Laith and added that the woman who had stolen was brought and her hand was cut off. Yunus said that Ibn Shihab said that 'Urwa said that Aisha said, "She repented afterwards and got married, and she used to come to the Messenger of Allah ﷺ and ask for his help."

A lady committed theft during the lifetime of Messenger of Allah ﷺ in the Ghazwa of Al-Fath, ((i.e. Conquest of Mecca). Her folk went to Usama bin Zaid to intercede for her (with the Prophet). When Usama interceded for her with Messenger of Allah ﷺ, the color of the face of Messenger of Allah ﷺ changed and he said, "Do you intercede with me in a matter involving one of the legal punishments prescribed by Allah?" Usama said, "O Messenger of Allah ﷺ! Ask Allah's Forgiveness for me." So in the afternoon, Allah's Apostle got up and addressed the people. He praised Allah as He deserved and then said, "Amma ba'du ! The nations prior to you were destroyed because if a noble amongst them stole, they used to excuse him, and if a poor person amongst them stole, they would apply (Allah's) Legal Punishment to him. By Him in Whose Hand Muhammad's soul is, if Fatima, the daughter of Muhammad stole, I would cut her hand." Then Messenger of Allah ﷺ gave his order in the case of that woman and her hand was cut off. Afterwards her repentance proved sincere and she got married. ʿAisha said, "That lady used to visit me and I used to convey her demands to Messenger of Allah ﷺ."

Who would speak to Messenger of Allah ﷺ about her? They (again) said: Who can dare do this but Usama b. Zaid, the loved one of Messenger of Allah ﷺ? She was brought to Messenger of Allah ﷺ and Usama b. Zaid spoke about her to him (interceded on her behalf). The color of the face of Messenger of Allah ﷺ changed, and he said: Do you intercede in one of the prescribed punishments of Allah? He (Usama) said: 'Messenger of Allah, seek forgiveness for me.' When it was dusk. Messenger of Allah ﷺ stood up and gave an address. He (first) glorified Allah as He deserves, and then said: Now to our topic. This (injustice) destroyed those before you that when any one of (high) rank committed theft among them, they spared him, and when any weak one among them committed theft, they inflicted the prescribed punishment upon him. By Him in Whose Hand is my life, even if Fatima daughter of Muhammad were to commit theft, I would have cut off her hand. He (the Holy Prophet) then commanded about that woman who had committed theft, and her hand was cut off. ʿA'isha (further) said: Hers was a good repentance, and she later on married and used to come to me after that, and I conveyed her needs (and problems) to Messenger of Allah ﷺ.

"Urwah bin Az-Zubair told me that a woman stole at the time of the Messenger of Allah, during the Conquest. Her people went to Uswamah bin Zaid, to ask him to intercede." 'Urwah said: "When Usamah spoke to him concerning her, the face of the Messenger of Allah changed color and he said: 'Are you speaking to me concerning one of the Hadd punishments of Allah?" Usamah said: 'Pray to Allah for forgiveness for me, O Messenger of Allah.' When evening came, the Messenger of Allah stood up to deliver a speech. He praised Allah as He deserves, then he said: 'The people who came before you were destroyed because, whenever a noble person among them stole, they would carry out the Hadd punishment on him. By the One in whose hand is my soul, if Fatimah bint Muhammad were to steal, I would cut off her hand.' Then the Messenger of Allah ordered that the hand of that woman be cut off. After that she repented sincerely, and 'Aishah said: 'She used to come to me after that, and I would convey her needs to the Messenger of Allah."'

On the tongues of known people and unknown ones, it was being said that a woman had stolen. So she was sold, and the Prophet ﷺ ordered her hand to be cut off, even though Usamah ibn Zayd had interceded for her. The Messenger of Allah ﷺ said about her, "What did she say?" Abdullah ibn Wahb differed from Yunus and narrated from Al-Zuhri, from Urwah, from Aisha that "Quraysh was concerned about the matter of the woman who stole during the time of the Prophet ﷺ in the Fath expedition." Then he mentioned the hadith, and it was mentioned before, and in the same manner Ibn Al-Mubarak reported it from Yunus, from Al-Zuhri, who said: Urwah ibn Zubayr informed me that a woman stole during the time of the Messenger of Allah ﷺ . Then he mentioned the hadith until his statement, "So the Messenger of Allah ﷺ ordered that woman to be cut off, and she repented after that and got married." Aisha said, "She used to come to me after that, and I would convey her need to the Messenger of Allah ﷺ ." Abu Amr Al-Adib informed us that Abu Bakr Al-Isma'ili informed me that Hassan ibn Sufyan informed us that Hibban narrated to us from Ibn Al-Mubarak about it, and its meaning, Shabeeb said, from Yunus, except that he also documented the last part from Al-Zuhri, from Al-Qasim ibn Muhammad, from Aisha regarding repentance. And Al-Laith ibn Sa'd narrated it from Al-Zuhri, from Urwah, from Aisha that Quraysh was concerned about the matter of the Makhozumi woman who stole. Then he mentioned the hadith until his statement, "By Allah, if Fatimah bint Muhammad had stolen, I would cut off her hand," and the mention of it has passed.  

البيهقي:١٧٢٩٨وَكَذَلِكَ أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ يَحْيَى بْنِ فَارِسٍ ثنا أَبُو صَالِحٍ عَنِ اللَّيْثِ حَدَّثَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ قَالَ كَانَ عُرْوَةُ يُحَدِّثُ أَنَّ عَائِشَةَ ؓ قَالَتْ اسْتَعَارَتِ امْرَأَةٌ يَعْنِي

حُلِيًّا عَلَى أَلْسِنَةِ أُنَاسٍ يُعْرَفُونَ وَلَا تُعْرَفُ هِيَ فَبَاعَتْهُ وَأَخَذَتْ فَأُتِيَ بِهَا النَّبِيُّ ﷺ فَأَمَرَ بِقَطْعِ يَدِهَا وَهِيَ الَّتِي تَشَفَّعَ فِيهَا أُسَامَةُ بْنُ زَيْدٍ وَقَالَ فِيهَا رَسُولُ اللهِ ﷺ مَا قَالَ وَخَالَفَهُ عَبْدُ اللهِ بْنُ وَهْبٍ عَنْ يُونُسَ فَقَالَ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ ؓ أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الَّتِي سَرَقَتْ فِي عَهْدِ النَّبِيِّ ﷺ فِي غَزْوَةِ الْفَتْحِ ثُمَّ ذَكَرَ الْحَدِيثَ وَقَدْ مَضَى ذِكْرُهُ 17299 وَكَذَلِكَ قَالَهُ عَبْدُ اللهِ بْنُ الْمُبَارَكِ عَنْ يُونُسَ عَنِ الزُّهْرِيِّ قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّ امْرَأَةً سَرَقَتْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَذَكَرَ الْحَدِيثَ إِلَى قَوْلِهِ ثُمَّ أَمَرَ رَسُولُ اللهِ ﷺ بِتِلْكَ الْمَرْأَةِ فَقُطِعَتْ يَدُهَا فَحَسُنَتْ تَوْبَتُهَا بَعْدَ ذَلِكَ وَتَزَوَّجَتْ قَالَتْ عَائِشَةُ فَكَانَتْ تَأْتِينِي بَعْدَ ذَلِكَ فَأَرْفَعُ حَاجَتَهَا إِلَى رَسُولِ اللهِ ﷺ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْأَدِيبُ أَنْبَأَ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي الْحَسَنُ بْنُ سُفْيَانَ ثنا حِبَّانُ عَنِ ابْنِ الْمُبَارَكِ بِذَلِكَ وَبِمَعْنَاهُ قَالَهُ شَبِيبٌ عَنْ يُونُسَ إِلَّا أَنَّهُ أَسْنَدَ آخِرَهُ عَنِ الزُّهْرِيِّ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنْ عَائِشَةَ ؓ فِي التَّوْبَةِ وَرَوَاهُ اللَّيْثُ بْنُ سَعْدٍ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ ؓ أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ ثُمَّ ذَكَرَ الْحَدِيثَ إِلَى قَوْلِهِ وَايْمُ اللهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا وَقَدْ مَضَى ذِكْرُهُ
