٢١۔ كِتَابُ النِّكَاحِ ص ٢

"None of you should propose marriage to a woman when someone else has already proposed to her, unless he marries (and he gives up the idea), or gives him permission." (Using translation from Nasāʾī 3241)   

الكبرى للنسائي:٥٣٣٧أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي يُونُسُ بْنُ يَزِيدَ عَنِ ابْنِ شِهَابٍ قَالَ حَدَّثَنِي سَعِيدُ بْنُ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَنْكِحَ أَوْ يَتْرُكَ» وَقَفَهُ مُحَمَّدُ بْنُ سِيرِينَ

[Machine] A man should not compete with his brother's bid, nor propose to his brother's betrothed. Hisham raised it.

«لَا يَسُمِ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَلَا يَخْطُبُ عَلَى خِطْبَةِ أَخِيهِ» رَفَعَهُ هِشَامٌ

It was narrated from Abu Hurairah that the Prophet said: "None of you should propose marriage to a woman when someone else has already proposed to her." (Using translation from Nasāʾī 3240)

"The Messenger of Allah forbade offering more for something that has already been bought by his brother, or for a man to propose marriage to a woman when someone else has already proposed to her, unless the previous suitor gave up the idea or gave him permission." أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ كَانَ يَقُولُ «نَهَى رَسُولُ اللهِ ﷺ أَنْ يَبِيعَ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ وَلَا يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ الرَّجُلِ حَتَّى يَتْرُكَ الْخَاطِبُ قَبْلَهُ أَوْ يَأْذَنَ لَهُ الْخَاطِبُ»

"I was with Anas bin Malik and a daughter of his was with him. He said: 'A woman came to the Messenger of Allah and offered herself in marriage to him. She said: O Messenger of Allah, do you want to marry me?'" (Using translation from Nasāʾī 3249)  

الكبرى للنسائي:٥٣٤١أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّى قَالَ حَدَّثَنِي مَرْحُومُ بْنُ عَبْدِ الْعَزِيزِ الْعَطَّارُ أَبُو عَبْدِ اللهِ قَالَ سَمِعْتُ ثَابِتًا الْبُنَانِيَّ يَقُولُ كُنْتُ عِنْدَ أَنَسِ بْنِ مَالِكٍ وَعِنْدَهُ ابْنَةٌ لَهُ فَقَالَ

جَاءَتِ امْرَأَةٌ إِلَى رَسُولِ اللهِ ﷺ فَعَرَضَتْ عَلَيْهِ نَفْسَهَا فَقَالَتْ يَا رَسُولَ اللهِ أَلَكَ فِيَّ حَاجَةٌ؟

"How little was her modesty." Anas said: "She was better than you; she offered herself in marriage to the Prophet." (Using translation from Nasāʾī 3250)  

الكبرى للنسائي:٥٣٤٢أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا مَرْحُومٌ قَالَ حَدَّثَنَا ثَابِتٌ عَنْ أَنَسٍ

أَنَّ امْرَأَةً عَرَضَتْ نَفْسَهَا عَلَى النَّبِيِّ ﷺ فَضَحِكَتِ ابْنَةٌ لِأَنَسٍ فَقَالَتْ مَا كَانَ أَقَلَّ حَيَاءَهَا فَقَالَ أَنَسٌ «هِيَ خَيْرٌ مِنْكِ عَرَضَتْ نَفْسَهَا عَلَى النَّبِيِّ ﷺ»

Hafsah bint 'Umar became the widow of Khunais or Hudhaifah bin Hudhafah - 'Abdur-Razzaq was not certain. He was one of the Companions of the Prophet ﷺ who were present at Badr, and he died in Madinah, I met 'Uthman bin ʿAffan and offered I Hafsah to him in marriage, I said: If you wish, I will marry Hafsah to you. He said: I will think about it. A few days passed, then he met me and said: I do not want to get married at present. 'Umar said: Then I met Abu Bakr and I said: If you wish, I will marry Hafsah the daughter of ‘Umar to you. He did not give any response to me, and I was more upset with him than with 'Uthman. A few days passed, then the Messenger of Allah ﷺ proposed marriage to her and he gave her in marriage to him. Abu Bakr met me and said: Perhaps you felt upset with me when you offered Hafsah to me in marriage and I did not give you any response? I said: Yes. He said: Nothing prevented me from giving you an answer when you offered her to me in marriage except that I heard the Messenger of Allah ﷺ mention her and I did not want to disclose the private matters of the Messenger of Allah ﷺ. If he had not married her, I would have married her. (Using translation from Aḥmad 74)  

الكبرى للنسائي:٥٣٤٣أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ رَاهَوَيْهِ قَالَ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ حَدَّثَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ قَالَ

تَأَيَّمَتْ حَفْصَةُ بِنْتُ عُمَرَ مِنْ خُنَيْسٍ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ مِمَّنْ شَهِدَ بَدْرًا فَتُوُفِّيَ بِالْمَدِينَةِ فَلَقِيتُ عُثْمَانَ فَعَرَضْتُ عَلَيْهِ حَفْصَةَ فَقُلْتُ إِنْ شِئْتَ أَنْكَحْتُكَ حَفْصَةَ فَقَالَ سَأَنْظُرُ فِي ذَلِكَ فَلَبِثْتُ لَيَالِيَ فَلَقِيتُهُ فَقَالَ مَا أُرِيدُ أَنْ أَتَزَوَّجَ يَوْمِي هَذَا قَالَ عُمَرُ فَلَقِيتُ أَبَا بَكْرٍ فَقُلْتُ إِنْ شِئْتَ أَنْكَحْتُكَ حَفْصَةَ فَلَمْ يَرْجِعْ إِلَيَّ شَيْئًا فَكُنْتُ عَلَيْهِ أَوْجَدَ مِنِّي عَلَى عُثْمَانَ فَلَبِثْتُ لَيَالِيَ فَخَطَبَهَا إِلَيَّ رَسُولُ اللهِ ﷺ فَأَنْكَحْتُهَا إِيَّاهُ فَلَقِيَنِي أَبُو بَكْرٍ فَقَالَ لَعَلَّكَ وَجَدْتَ عَلَيَّ حِينَ عَرَضْتَ عَلَيَّ حَفْصَةَ فَلَمْ أَرْجِعْ إِلَيْكَ شَيْئًا قُلْتُ نَعَمْ قَالَ فَإِنَّهُ لَمْ يَمْنَعْنِي حِينَ عَرَضْتَ عَلَيَّ أَنْ أَرْجِعَ إِلَيْكَ شَيْئًا إِلَّا أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَذْكُرُهَا وَلَمْ أَكُنْ لِأُفْشِيَ سِرَّ رَسُولِ اللهِ ﷺ وَلَوْ تَرَكَهَا نَكَحْتُهَا

ʿUmar bin Al-Khattab said, "When (my daughter) Hafsa bint ʿUmar lost her husband Khunais bin Hudhaifa As-Sahrni who was one of the companions of Messenger of Allah ﷺ and had fought in the battle of Badr and had died in Medina, I met ʿUthman bin ʿAffan and suggested that he should marry Hafsa saying, "If you wish, I will marry Hafsa bint ʿUmar to you,' on that, he said, 'I will think it over.' I waited for a few days and then he said to me. 'I am of the opinion that I shall not marry at present.' Then I met Abu Bakr and said, 'if you wish, I will marry you, Hafsa bint ʿUmar.' He kept quiet and did not give me any reply and I became more angry with him than I was with ʿUthman . Some days later, Messenger of Allah ﷺ demanded her hand in marriage and I married her to him. Later on Abu Bakr met me and said, "Perhaps you were angry with me when you offered me Hafsa for marriage and I gave no reply to you?' I said, 'Yes.' Abu Bakr said, 'Nothing prevented me from accepting your offer except that I learnt that Messenger of Allah ﷺ had referred to the issue of Hafsa and I did not want to disclose the secret of Messenger of Allah ﷺ , but had he (i.e. the Prophet) given her up I would surely have accepted her." الكبرى للنسائي:٥٣٤٤أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ الْمُبَارَكِ قَالَ حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ بْنِ سَعْدٍ قَالَ حَدَّثَنَا أَبِي عَنْ صَالِحٍ عَنِ ابْنِ شِهَابٍ قَالَ أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللهِ أَنَّهُ سَمِعَ عَبْدَ اللهِ بْنَ عُمَرَ يُحَدِّثُ

أَنَّ عُمَرَ بْنَ الْخَطَّابِ حِينَ تَأَيَّمَتْ حَفْصَةُ بِنْتُ عُمَرَ مِنْ خُنَيْسِ بْنِ حُذَافَةَ السَّهْمِيِّ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَتُوُفِّيَ بِالْمَدِينَةِ فَقَالَ عُمَرُ فَأَتَيْتُ عُثْمَانَ بْنَ عَفَّانَ فَعَرَضْتُ عَلَيْهِ حَفْصَةَ بِنْتَ عُمَرَ قَالَ قُلْتُ إِنْ شِئْتَ أَنْكَحْتُكَ حَفْصَةَ قَالَ سَأَنْظُرُ فِي أَمْرِي فَلَبِثْتُ لَيَالِي ثُمَّ لَقِيَنِي فَقَالَ قَدْ بَدَا لِي أَنْ لَا أَتَزَوَّجَ يَوْمِي هَذَا قَالَ عُمَرُ فَلَقِيتُ أَبَا بَكْرٍ الصِّدِّيقَ فَقُلْتُ لَهُ إِنْ شِئْتَ زَوَّجْتُكَ حَفْصَةَ بِنْتَ عُمَرَ فَصَمَتَ أَبُو بَكْرٍ فَلَمْ يَرْجِعْ إِلَيَّ شَيْئًا فَكُنْتُ عَلَيْهِ أَوْجَدَ مِنِّي عَلَى عُثْمَانَ فَلَبِثْتُ لَيَالِيَ ثُمَّ خَطَبَهَا رَسُولُ اللهِ ﷺ فَأَنْكَحْتُهَا إِيَّاهُ فَلَقِيَنِي أَبُو بَكْرٍ فَقَالَ لَعَلَّكَ وَجَدْتَ عَلَيَّ حِينَ عَرَضْتَ عَلَيَّ حَفْصَةَ فَلَمْ أَرْجِعْ إِلَيْكَ شَيْئًا قَالَ عُمَرُ قُلْتُ نَعَمْ قَالَ فَإِنَّهُ لَمْ يَمْنَعْنِي أَنْ أَرْجِعَ إِلَيْكَ فِيمَا عَرَضْتَ عَلَيَّ إِلَّا أَنِّي قَدْ كُنْتُ عَلِمْتُ أَنَّ رَسُولَ اللهِ ﷺ «قَدْ ذَكَرَهَا فَلَمْ أَكُنْ لِأُفْشِيَ سِرَّ رَسُولِ اللهِ ﷺ وَلَوْ تَرَكَهَا رَسُولُ اللهِ ﷺ قَبِلْتُهَا»

[Machine] The Prophet ﷺ married her when she was six years old, and consummated the marriage when she was nine years old. Abu Abdul Rahman Abu Bakr ibn Ayyash said to us that there is a disagreement about his name, it was said that his name is Shu'bah, and it was said that his name is Muhammad, and it was said that his name is his nickname.  

الكبرى للنسائي:٥٣٤٥أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ رَاهَوَيْهِ قَالَ أَخْبَرَنَا يَحْيَى بْنُ آدَمَ قَالَ حَدَّثَنَا أَبُو بَكْرٍ وَهُوَ ابْنُ عَيَّاشٍ عَنِ الْأَجْلَحِ عَنِ ابْنِ أَبِي مُلَيْكَةَ عَنْ عَائِشَةَ

أَنَّ النَّبِيَّ ﷺ تَزَوَّجَهَا «وَهِيَ بِنْتُ سِتِّ سِنِينَ وَدَخَلَ بِهَا وَهِيَ بِنْتُ تِسْعِ سِنِينَ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ أَبُو بَكْرِ بْنُ عَيَّاشٍ اخْتُلِفَ فِي اسْمِهِ فَقِيلَ اسْمُهُ شُعْبَةُ وَقِيلَ مُحَمَّدٌ وَقِيلَ اسْمُهُ كُنْيَتُهُ

It was narrated from 'Aishah that the Messenger of Allah married her when she was six years old, and consummated the marriage with her when she was nine. (Using translation from Nasāʾī 3255)  

الكبرى للنسائي:٥٣٤٦أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا أَبُو مُعَاوِيَةَ يَعْنِي مُحَمَّدَ بْنَ خَازِمٍ الضَّرِيرَ قَالَ حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ

أَنَّ رَسُولَ اللهِ ﷺ «تَزَوَّجَهَا وَهِيَ بِنْتُ سِتِّ سِنِينَ وَبَنَى بِهَا وَهِيَ بِنْتُ تِسْعٍ»

"The Messenger of Allah married me when I was seven years old, and he consummated the marriage with me when I was nine." (Using translation from Nasāʾī 3256)  

الكبرى للنسائي:٥٣٤٧أَخْبَرَنَا مُحَمَّدُ بْنُ النَّضْرِ بْنِ مُسَاوِرٍ الْمَرْوَزِيُّ قَالَ حَدَّثَنَا جَعْفَرُ بْنُ سُلَيْمَانَ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ قَالَتْ

«تَزَوَّجَنِي رَسُولُ اللهِ ﷺ لِسَبْعِ سِنِينَ وَدَخَلَ عَلَيَّ لِتِسْعِ سِنِينَ»

It was narrated from 'Aishah that the Messenger of Allah married her when she was nine and he died when she was eighteen years old. (Using translation from Nasāʾī 3258)

عَنْ عَائِشَةَ «تَزَوَّجَهَا رَسُولُ اللهِ ﷺ وَهِيَ بِنْتُ تِسْعٍ وَمَاتَ عَنْهَا وَهِيَ بِنْتُ ثَمَانِيَ عَشْرَةَ»

[Machine] Aisha said: "The Prophet of Allah ﷺ married me when I was nine years old, and I lived with him for nine years." Israel contradicted him in his chain of transmission and text.  

الكبرى للنسائي:٥٣٤٩أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا عَبْثَرُ عَنْ مُطَرِّفٍ وَهُوَ ابْنُ طَرِيفٍ الْكُوفِيُّ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي عُبَيْدَةَ قَالَ قَالَتْ

عَائِشَةُ «تَزَوَّجَنِي رَسُولُ اللهِ ﷺ لِتِسْعِ سِنِينَ وَصَحِبْتُهُ تِسْعًا» خَالَفَهُ إِسْرَائِيلُ فِي إِسْنَادِهِ وَمَتْنِهِ

[Machine] "The Messenger of Allah ﷺ married Aisha when she was six years old, and consummated the marriage when she was nine years old."

Abu Abdullah al-Rahman ibn Tarif al-Kufi said to us: "I am more certain of this narration than the Israelites, and his hadith is closer to being correct. And Allah knows best."  

الكبرى للنسائي:٥٣٥٠أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ رَاهَوَيْهِ قَالَ أَخْبَرَنَا يَحْيَى بْنُ آدَمَ قَالَ حَدَّثَنَا إِسْرَائِيلُ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي عُبَيْدَةَ عَنْ أَبِيهِ قَالَ

«تَزَوَّجَ رَسُولُ اللهِ ﷺ عَائِشَةَ وَهِيَ بِنْتُ سِتِّ سِنِينَ وَبَنَى بِهَا وَهِيَ بِنْتُ تِسْعٍ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ مُطَرِّفُ بْنُ طَرِيفٍ الْكُوفِيُّ أَثْبَتُ مِنْ إِسْرَائِيلَ وَحَدِيثُهُ أَشْبَهُ بِالصَّوَابِ وَاللهُ أَعْلَمُ

A woman without a husband has more right to her person than her guardian, and a virgin's consent must be asked from her, and her silence implies her consent. (Using translation from Muslim 1421a)  

الكبرى للنسائي:٥٣٥١أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا مَالِكٌ عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»

[Machine] The Prophet ﷺ said, "The widow has more right to her own self than her guardian, and the orphaned girl should be consulted and her consent sought for her marriage."

أَنَّ النَّبِيَّ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ وَإِذْنُهَا صُمَاتُهَا»

The Prophet ﷺ said: A guardian has no concern with a woman previously married and has no husband, and an orphan girl (i.e. virgin) must be consulted, her silence being her acceptance. (Using translation from Abū Dāʾūd 2100)

The Prophet ﷺ said, "A matron should not be given in marriage except after consulting her; and a virgin should not be given in marriage except after her permission." "A previously married woman should not be married until her permission has been sought, and a virgin should not be married until her consent is sought." [Machine] A man married off his daughter while she was unwilling. So she went to the Prophet ﷺ and said, "Indeed, my father has married me off to a man while I am unwilling, and my cousin has proposed to me." He said, "There is no marriage for him, marry whomever you wish."

أَنَّ رَجُلًا زَوَّجَ ابْنَةً لَهُ وَهِيَ كَارِهَةٌ فَأَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنَّ وَذَكَرَ كَلِمَةً مَعْنَاهَا أَبِي زَوَّجَنِي رَجُلًا وَأَنَا كَارِهَةٌ وَقَدْ خَطَبَنِي ابْنُ عَمٍّ لِي فَقَالَ «لَا نِكَاحَ لَهُ انْكِحِي مَنْ شِئْتِ»

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)

[Machine] My father married me off, but I disliked it and I am still a virgin. So, I complained to the Prophet ﷺ, and he said, "Do not marry her if she dislikes it." Malik ibn Anas disagreed with him in his narration and in his wording.  

الكبرى للنسائي:٥٣٦١أَخْبَرَنَا مُحَمَّدُ بْنُ حَاتِمِ بْنِ نُعَيْمِ بْنِ عَبْدِ الْكَرِيمِ الْمَرْوَزِيُّ قَالَ أَخْبَرَنَا حَبَّانُ يَعْنِي ابْنَ مُوسَى قَالَ أَخْبَرَنَا عَبْدُ اللهِ يَعْنِي ابْنَ الْمُبَارَكِ عَنْ سُفْيَانَ يَعْنِي ابْنَ سَعِيدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ عَنْ خَنْسَاءَ بِنْتِ خِذَامٍ قَالَتْ

أَنْكَحَنِي أَبِي وَأَنَا كَارِهَةٌ وَأَنَا بِكْرٌ فَشَكَوْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «لَا تُنْكِحْهَا وَهِيَ كَارِهَةٌ» خَالَفَهُ مَالِكُ بْنُ أَنَسٍ فِي إِسْنَادِهِ وَفِي لَفْظِهِ

that her father gave her in marriage when she was a matron and she disliked that marriage. So she went to Messenger of Allah ﷺ and he declared that marriage invalid. (Using translation from Bukhārī 5138)  

الكبرى للنسائي:٥٣٦٢أَخْبَرَنَا هَارُونُ بْنُ عَبْدِ اللهِ الْحَمَّالُ قَالَ حَدَّثَنَا مَعْنٌ قَالَ حَدَّثَنَا مَالِكٌ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ أَبِيهِ عَنْ عَبْدِ الرَّحْمَنِ وَمُجَمِّعٍ ابْنَيْ يَزِيدَ بْنِ جَارِيَةَ الْأَنْصَارِيِّ عَنْ خَنْسَاءَ بِنْتِ خِذَامٍ

أَنَّ أَبَاهَا زَوَّجَهَا وَهِيَ ثَيِّبٌ فَكَرِهَتْ ذَلِكَ فَأَتَتْ رَسُولَ اللهِ ﷺ فَرَدَّ نِكَاحَهُ

[Machine] A man married off his daughter while she was a virgin without consulting her. So she went to the Prophet ﷺ and he separated them. Abu Hafs, meaning 'Umar ibn Abi Salamah, an-Niyssi narrated to us, saying, I heard al-Awza'e say, Ibrahim ibn Murrah narrated to me from 'Ata' ibn Abi Rabah, who said, a man married off his daughter while she was a virgin, and this is the continuation of the hadith.

[Machine] "A man came to the Prophet ﷺ with his daughter and said, 'This is my daughter, she refuses to get married.' The Prophet ﷺ said, 'Obey your father.' She kept repeating her statement, so he said to her, 'By the One who sent you with the truth, I will not get married until you inform me of the rights of the husband over his wife.' The Prophet ﷺ said, 'The husband's right over his wife is that if he has a wound, she licks it until she fulfills his right.' She then said, 'By the One who sent you with the truth, I will never get married.' The Prophet ﷺ said, 'Do not marry them without their consent.' Abu Abdur-Rahman (i.e., Prophet's companion) said, 'Abu Haroon Al-Abdi, whose hadith is abandoned, and his name is Umara bin Jowain, and Abu Haroon Al-Ghanawi, whose hadith is acceptable, and his name is Ibrahim bin Al-Ala,' and both of them are from the people of Basra."  

الكبرى للنسائي:٥٣٦٥أَخْبَرَنَا أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ الْكُوفِيُّ قَالَ حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ قَالَ حَدَّثَنِي رَبِيعَةُ بْنُ عُثْمَانَ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ عَنْ نَهَارٍ الْعَبْدِيِّ وَهُوَ مَدَنِيٌّ لَا بَأْسَ بِهِ عَنْ أَبِي سَعِيدٍ قَالَ

جَاءَ رَجُلٌ بِابْنَةٍ لَهُ إِلَى النَّبِيِّ ﷺ فَقَالَ هَذِهِ ابْنَتِي أَبَتْ أَنْ تَزَوَّجَ فَقَالَ «أَطِيعِي أَبَاكِ» كُلُّ ذَلِكَ تُرَدِّدُ عَلَيْهِ مَقَالَتَهَا فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ حَتَّى تُخْبِرَنِي مَا حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ فَقَالَ «حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ لَوْ كَانَتْ بِهِ قُرْحَةٌ فَلَحَسَتْهَا مَا أَدَّتْ حَقَّهُ» فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ أَبَدًا فَقَالَ «لَا تُنْكِحُوهُنَّ إِلَّا بِإِذْنِهِنَّ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَبُو هَارُونَ الْعَبْدِيُّ مَتْرُوكُ الْحَدِيثِ وَاسْمُهُ عُمَارَةُ بْنُ جُوَيْنٍ وَأَبُو هَارُونَ الْغَنَوِيُّ لَا بَأْسَ بِهِ وَاسْمُهُ إِبْرَاهِيمُ بْنُ الْعَلَاءِ وَكِلَاهُمَا مِنْ أَهْلِ الْبَصْرَةِ

[Machine] A young virgin girl came to the Prophet Muhammad and said, "My father has married me off while I dislike it." So the Prophet Muhammad annulled her marriage.

أَنَّ جَارِيَةً بِكْرًا أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنَّ أَبِي زَوَّجَنِي وَهِيَ كَارِهَةٌ «فَرَدَّ النَّبِيُّ ﷺ نِكَاحَهَا»

[Machine] "A man from the Banu Mudhar married off his daughter while she was unwilling, so she went to the Prophet ﷺ. He annulled the marriage for her."  

الكبرى للنسائي:٥٣٦٧أَخْبَرَنِي أَيُّوبُ بْنُ مُحَمَّدٍ الرَّقِّيُّ قَالَ حَدَّثَنَا مَعْمَرٌ وَهُوَ ابْنُ سُلَيْمَانَ الرَّقِّيُّ قَالَ حَدَّثَنَا زَيْدُ بْنُ حَبَّانَ عَنْ أَيُّوبَ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ عَنْ أَبِي سَلَمَةَ قَالَ

«أَنْكَحَ رَجُلٌ مِنْ بَنِي الْمُنْذِرِ ابْنَتَهُ وَهِيَ كَارِهَةٌ فَأَتَى النَّبِيُّ ﷺ» فَرَدَّ نِكَاحَهَا 5368 أَخْبَرَنِي أَيُّوبُ بْنُ مُحَمَّدٍ قَالَ حَدَّثَنَا مَعْمَرٌ قَالَ حَدَّثَنَا زَيْدٌ عَنْ أَيُّوبَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ ﷺ مِثْلَهُ

"A girl came to her and said: 'My father married me to his brother's son so that he might raise his own status thereby, and I was unwilling.' She said: 'Sit here until the Prophet comes.' Then the Messenger of Allah came, and I told him (what she had said). He sent word to her father, calling him, and he left the matter up to her. She said: 'O Messenger of Allah, I accept what my father did, but I wanted to know whether women have any say in the matter.'" (Using translation from Nasāʾī 3269)

اجْلِسِي حَتَّى يَأْتِيَ النَّبِيُّ ﷺ فَجَاءَ رَسُولُ اللهِ ﷺ فَأَخْبَرْتُهُ فَأَرْسَلَ إِلَى أَبِيهَا «فَدَعَاهُ فَجَعَلَ الْأَمْرَ إِلَيْهَا» فَقَالَتْ يَا رَسُولَ اللهِ قَدْ أَجَزْتُ مَا صَنَعَ أَبِي وَلَكِنِّي أَرَدْتُ أَنْ أَعْلَمَ أَلِلنِّسَاءِ مِنَ الْأَمْرِ شَيْءٌ؟ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الْحَدِيثُ يُرْسِلُونَهُ

[Machine] "The Prophet ﷺ said, 'The guardian does not have authority over a woman who is of sound mind, and the silence of an orphan girl is considered as her consent.'" Muhammad ibn Ishaq mediated between Salih ibn Kaysan and Nafi' ibn Jubayr, the son of Abdullah ibn Al-Fadl.

[Machine] "That the Prophet ﷺ married Maimuna when it was prohibited, and she handed her matter over to Abbas and he married her to him." Abu Abdur-Rahman told us that this chain of narration is good, and the statement "she handed her matter over to Abbas and he married her to him" is a rejected saying. It is possible that this word is from some of those who narrated this hadith and was included in the narration."

أَنَّ النَّبِيَّ ﷺ «نَكَحَ مَيْمُونَةَ وَهُوَ حَرَامٌ جَعَلَتْ أَمْرَهَا إِلَى الْعَبَّاسِ فَأَنْكَحَهَا إِيَّاهُ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ هَذَا إِسْنَادٌ جَيِّدٌ وَقَوْلُهُ جَعَلَتْ أَمْرَهَا إِلَى الْعَبَّاسِ فَأَنْكَحَهَا إِيَّاهُ كَلَامٌ مُنْكَرٌ وَيُشْبِهُ أَنْ يَكُونَ هَذَا الْحَرْفُ مِنْ بَعْضِ مَنْ رَوَى هَذَا الْحَدِيثَ فَأُدْرِجَ فِي الْحَدِيثِ

قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ أَمْرِ مَوْلَاهَا فَإِنَّمَا نِكَاحُهَا بَاطِلٌ وَإِنَّمَا الَّذِي أَعْطَاهَا بِمَا اسْتَحَلَّ مِنْهَا فَإِنِ اشْتَجَرُوا فَذَلِكَ إِلَى السُّلْطَانِ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»

She said, "Then do not accompany me if you worship a piece of wood that grew from the earth, carved by an Abyssinian belonging to the Banu Fulan. If you have embraced Islam, I don't want anything else from you." He said, "Wait until I think about it." He then left and returned, saying, "I bear witness that there is no god but Allah, and Muhammad is the Messenger of Allah." She said, "O Anas, marry Abu Talhah."

يَا أَبَا طَلْحَةَ أَلَيْسَ إِلَهُكُمُ الَّذِي تَعْبُدُ خَشَبَةً نَبَتَتْ مِنَ الْأَرْضِ نَجَرَهَا حَبَشِيُّ بَنِي فُلَانٍ؟ قَالَ بَلَى قَالَتْ فَلَا تَصْحَبْنِي إِنْ تَعْبُدْ خَشَبَةً نَبَتَتْ فِي الْأَرْضِ نَجَرَهَا حَبَشِيُّ بَنِي فُلَانٍ إِنْ أَنْتَ أَسْلَمْتَ لَمْ أُرِدْ مِنْكَ شَيْئًا غَيْرَهُ قَالَ حَتَّى أَنْظُرَ فِي أَمْرِي قَالَ فَذَهَبَ ثُمَّ رَجَعَ فَقَالَ «أَشْهَدُ أَنَّ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ» قَالَتْ يَا أَنَسُ زَوِّجْ أَبَا طَلْحَةَ

"Tell the Messenger of Allah that I am a jealous woman and that I have sons, and none of my guardians are present." He went to the Messenger of Allah and told him that. He said: "Go back to her and tell her: As for your saying that you are a jealous woman, I will pray to Allah for you to take away your jealousy. As for your saying that you have sons, your sons will be taken care of. And as for your saying that none of your guardians are present, none of your guardians, present or absent, would object to that." She said to her son: "O 'Umar, get up and perform the marriage to the Messenger of Allah," so he performed the marriage. (Using translation from Nasāʾī 3254)

عَنْ أُمِّ سَلَمَةَ لَمَّا انْقَضَتْ عِدَّتُهَا بَعَثَ إِلَيْهَا أَبُو بَكْرٍ يَخْطُبُهَا عَلَيْهِ فَلَمْ تَزَوِّجْهُ ثُمَّ بَعَثَ إِلَيْهَا عُمَرُ يَخْطُبُهَا فَلَمْ تَزَوِّجْهُ فَبَعَثَ رَسُولُ اللهِ ﷺ إِلَيْهَا عُمَرَ بْنَ الْخَطَّابِ يَخْطُبُهَا عَلَيْهِ فَقَالَتْ أَخْبِرْ رَسُولَ اللهِ ﷺ أَنِّي امْرَأَةٌ غَيْرَى وَأَنِّي امْرَأَةٌ مُصْبِيَةٌ وَلَيْسَ أَحَدٌ مِنْ أَوْلِيَائِي شَاهِدٌ فَأَتَى رَسُولَ اللهِ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ «ارْجِعْ إِلَيْهَا فَقُلْ لَهَا أَمَّا قَوْلُكِ أَنِّي امْرَأَةٌ غَيْرَى فَسَأَدْعُو اللهَ فَيُذْهِبُ غَيْرَتَكِ وَأَمَّا قَوْلُكِ إِنِّي امْرَأَةٌ مُصِيبَةٌ فَسَتُكْفَيْنَ صِبْيَانَكِ وَأَمَّا قَوْلُكِ إِنَّهُ لَيْسَ أَحَدٌ مِنْ أَوْلِيَائِي شَاهِدٌ فَلَيْسَ أَحَدٌ مِنْ أَوْلِيَائِكِ شَاهِدٌ وَلَا غَائِبٌ يَكْرَهُ ذَلِكَ» فَقَالَتْ لِابْنِهَا يَا عُمَرُ قُمْ فَزَوِّجْ رَسُولَ اللهِ ﷺ فَزَوَّجَهُ مُخْتَصَرٌ

The Prophet ﷺ said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them. قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا وَأَيُّمَا رَجُلٍ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ»

"When the 'Iddah of Zainab was over, the Messenger of Allah said to Zaid: 'Propose marriage to her on my behalf.' Zaid went and said: 'O Zainab, rejoice, for the Messenger of Allah has sent me to you to propose marriage on his behalf.' She said: 'I will not do anything until I consult my Lord.' She went to her prayer place and Qur'an was revealed, then the Messenger of Allah came and entered upon her without any formalities." (Using translation from Nasāʾī 3251)

قَالَ رَسُولُ اللهِ ﷺ لِزَيْدٍ «اذْكُرْهَا عَلَيَّ» قَالَ زَيْدٌ فَانْطَلَقْتُ فَقُلْتُ يَا زَيْنَبُ أَبْشِرِي أَرْسَلَنِي إِلَيْكِ رَسُولُ اللهِ ﷺ يَذْكُرُكِ فَقَالَتْ مَا أَنَا بِصَانِعَةٍ شَيْئًا حَتَّى أَسْتَأْمِرَ رَبِّي فَقَامَتْ إِلَى مَسْجِدِهَا وَنَزَلَ الْقُرْآنُ «وَجَاءَ رَسُولُ اللهِ ﷺ حَتَّى دَخَلَ عَلَيْهَا فَدَخَلَ بِغَيْرِ أَمْرٍ»

[Machine] I heard Anas saying, "Zaynab used to boast among the wives of the Prophet ﷺ that Allah married me from the heavens and in it, the verse of Hijab was revealed."

سَمِعْتُ أَنَسًا يَقُولُ «كَانَتْ زَيْنَبُ تَفْتَخِرُ عَلَى نِسَاءِ النَّبِيِّ ﷺ أَنَّ اللهَ أَنْكَحَنِي مِنَ السَّمَاءِ وَفِيهَا نَزَلَتْ آيَةُ الْحِجَابِ»

Zainab bint Jahsh used to boast to the other wives of the Prophet and say: "Allah married me to him from above the Heavens." And the Verse of Hijab was revealed concerning her. (Using translation from Nasāʾī 3252)

سَمِعْتُ أَنَسًا يَقُولُ كَانَتْ زَيْنَبُ بِنْتُ جَحْشٍ تَفْتَخِرُ عَلَى نِسَاءِ النَّبِيِّ ﷺ تَقُولُ إِنَّ «اللهَ أَنْكَحَنِي مِنَ السَّمَاءِ وَفِيهَا نَزَلَتْ آيَةُ الْحِجَابِ»

"The Messenger of Allah married Maimunah while he was Halal, and he stayed with her while he was Halal, and I was the messenger between the two of them." (Using translation from Tirmidhī 841)

أَنَّ رَسُولَ اللهِ ﷺ «تَزَوَّجَ مَيْمُونَةَ وَهُوَ حَلَالٌ وَبَنَى بِهَا وَهُوَ حَلَالٌ وَكُنْتُ أَنَا الرَّسُولُ فِيمَا بَيْنَهُمَا» أَرْسَلَهُ مَالِكُ بْنُ أَنَسٍ

[Machine] The Messenger of Allah, ﷺ , married Maimuna and he consummated the marriage with her in Sarif, and the grave of Maimuna is in Sarif.

«تَزَوَّجَ رَسُولُ اللهِ ﷺ مَيْمُونَةَ وَهُوَ حَلَالٌ وَبَنَى بِهَا بِسَرِفَ وَكَانَ قَبْرُ مَيْمُونَةَ بِسَرِفَ»

الكبرى للنسائي:٥٣٨٣أَخْبَرَنَا أَحْمَدُ بْنُ حَفْصِ بْنِ عَبْدِ اللهِ النَّيْسَابُورِيُّ قَالَ حَدَّثَنِي أَبِي قَالَ حَدَّثَنِي إِبْرَاهِيمُ وَهُوَ ابْنُ طَهْمَانَ عَنِ الْحَجَّاجِ وَهُوَ ابْنُ الْحَجَّاجِ عَنِ الْوَلِيدِ وَهُوَ ابْنُ زَوْرَانَ عَنْ مَيْمُونِ بْنِ مِهْرَانَ عَنْ يَزِيدَ بْنِ الْأَصَمِّ عَنْ خَالَتِهِ مَيْمُونَةَ أَنَّهَا حَدَّثَتْهُ

أَنَّ رَسُولَ اللهِ ﷺ «تَزَوَّجَهَا حَلَالًا وَبَنَى بِهَا حَلَالًا وَتَزَوَّجَهَا بِسَرِفَ وَبَنَى بِهَا تَحْتَ التَّنْضُبَةَ»

«مَا تَزَوَّجَ رَسُولُ اللهِ ﷺ مَيْمُونَةَ وَهُوَ مُحْرِمٌ وَهِيَ خَالَةُ يَزِيدَ»

«تَزَوَّجَ رَسُولُ اللهِ ﷺ بَعْضَ نِسَائِهِ وَهُوَ مُحْرِمٌ»

[Machine] "From Abu Asim, who is noble, from Uthman ibn Aswad, from Ibn Abi Mulayka, from Aisha, that the Messenger of Allah ﷺ married while he was in a state of ihram (i.e., during the pilgrimage). I said to Abu Asim, 'You have added this to us from your own fabrication, as Aisha is not mentioned in it.' He said, 'Leave Aisha aside, let me verify it.'"

عَنْ أَبِي عَاصِمٍ هُوَ النَّبِيلُ عَنْ عُثْمَانَ بْنِ الْأَسْوَدِ عَنِ ابْنِ أَبِي مُلَيْكَةَ عَنْ عَائِشَةَ أَنَّ رَسُولَ اللهِ ﷺ «تَزَوَّجَ وَهُوَ مُحْرِمٌ» قُلْتُ لِأَبِي عَاصِمٍ أَنْتَ أَمْلَيْتَ عَلَيْنَا هَذَا مِنَ الرُّقْعَةِ لَيْسَ فِيهِ عَائِشَةُ فَقَالَ دَعْ عَائِشَةَ حَتَّى أَنْظُرَ فِيهِ
