٦٣۔ كِتَابُ الْأَيْمَانِ ص ١
I came to Allah's Apostle ﷺ along with a group of Ash'arites requesting to give us a mount. He (the Holy Prophet) said: By Allah, I cannot provide you with a mount, and there is nothing with me which I should give you as a ride. He (the narrator) said: We stayed there as long as Allah willed. Then there were brought to him (to the Holy Prophet) camels. He (the Holy Prophet) then ordered to give us three white humped camels, We started and said (or some of us said to the others): Allah will not bless us. We came to Messenger of Allah ﷺ begging him to provide us with riding camels. He swore that he could not provide us with a mount, but later on he provided us with that. They (some of the Prophet's Companions) came and informed him about this (rankling of theirs), whereupon he said: It was not I who provided you with a mount, but Allah has provided you with that. So far as I am concerned, by Allah, if He so wills, I would not swear, but if, later on, I would see better than it, I (would break the vow) and expiate it and do that which is better. أَتَيْتُ رَسُولَ اللهِ ﷺ فِي رَهْطٍ مِنَ الْأَشْعَرِيِّينَ نَسْتَحْمِلُهُ قَالَ وَاللهِ مَا أَحْمِلُكُمْ وَمَا عِنْدِي مَا أَحْمِلُكُمْ عَلَيْهِ قَالَ فَلَبِثْنَا مَا شَاءَ اللهُ ثُمَّ أُتِيَ بِإِبِلٍ فَأَمَرَ لَنَا بِثَلَاثِ ذَوْدٍ غُرِّ الذُّرَى فَلَمَّا انْطَلَقْنَا قُلْنَا أَوْ قَالَ بَعْضُنَا لِبَعْضٍ لَا يُبَارَكُ اللهُ لَنَا أَتَيْنَا رَسُولَ اللهِ ﷺ نَسْتَحْمِلُهُ فَحَلَفَ أَنْ لَا يَحْمِلَنَا ثُمَّ حَمَلَنَا فَأَتَوْهُ فَأَخْبَرُوهُ فَقَالَ مَا أَنَا حَمَلْتُكُمْ وَلَكِنَّ اللهَ ﷻ حَمَلَكُمْ إِنِّي وَاللهِ إِنْ شَاءَ اللهُ لَا أَحْلِفُ عَلَى يَمِينٍ ثُمَّ أَرَى خَيْرًا مِنْهَا إِلَّا كَفَّرْتُ يَمِينِي وَأَتَيْتُ الَّذِي هُوَ خَيْرٌ لَفْظُ حَدِيثِ خَلَفِ بْنِ هِشَامٍ وَحَدِيثُ الطَّيَالِسِيُّ بِمَعْنَاهُ
[Machine] The sun eclipsed during the time of the Prophet Muhammad's ﷺ speech until it said, "So he said, 'By Allah, if you knew what I knew, you would laugh a little and weep a lot.'"
خَسَفَتِ الشَّمْسُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ الْحَدِيثَ إِلَى أَنْ قَالَتْ فَقَالَ وَاللهِ لَوْ تَعْلَمُونَ مَا أَعْلَمُ لَضَحِكْتُمْ قَلِيلًا وَلَبَكَيْتُمْ كَثِيرًا
[Machine] And the Messenger of Allah ﷺ said, "By the One in whose hand is my soul, if you knew what I know, you would have wept much and laughed little."
وَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ تَعْلمُونَ مَا أَعْلَمُ لَبَكَيْتُمْ كَثِيرًا وَلَضَحِكْتُمْ قَلِيلًا
[Machine] The Messenger of Allah ﷺ said, "By the One in whose hand is the soul of Muhammad, if I had even one gold piece, I would prefer that it not stay with me for three nights, and I have a dinar with me which I cannot find anyone to accept it from me except if I give it as charity to someone who has a debt with me."
وَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ لَوْ أَنَّ عِنْدِي أُحُدًا ذَهَبًا لَأَحْبَبْتُ أَنْ لَا يَأْتِيَ عَلَيَّ ثَلَاثُ لَيَالٍ وَعِنْدِي مِنْهُ دِينَارٌ أَجِدُ مَنْ يَتَقَبَّلُهُ إِلَّا شَيئًا أَرْصُدُهُ لِدَيْنٍ عَلَيَّ
When the Messenger of Allah ﷺ swore an oath strongly, he said: No, by Him in Whose hand is the soul of AbulQasim. (Using translation from Abū Dāʾūd 3264)
كَانَ رَسُولُ اللهِ ﷺ إِذَا اجْتَهَدَ فِي الْيَمِينِ قَالَ لَا وَالَّذِي نَفْسُ أَبِي الْقَاسِمِ بِيَدِهِ
[Machine] I came to the Prophet ﷺ while he was sitting in the shade of the Kaaba. When he saw me, he said, "They are the ones who will lose." By the Lord of the Kaaba, I approached until I sat down, feeling hesitant to stand up. So I said, "May my parents be sacrificed for you, O Messenger of Allah, who are they?" He said, "They are those who have the most wealth, except for those who say, 'This and that and that' from what is in front of them, behind them, to their right, and to their left, and they are few."
انْتَهَيْتُ إِلَى النَّبِيِّ ﷺ وَهُوَ جَالِسٌ فِي ظِلِّ الْكَعْبَةِ فَلَمَّا رَآنِي قَالَ هُمُ الْأَخْسَرُونَ وَرَبِّ الْكَعْبَةِ قَالَ فَجِئْتُ حَتَّى جَلَسْتُ فَلَمْ أَتَقَارَّ أَنْ قُمْتُ فَقُلْتُ فِدَاكَ أَبِي وَأُمِّي يَا رَسُولَ اللهِ مَنْ هُمْ؟ قَالَ هُمُ الْأَكْثَرُونَ أَمْوَالًا إِلَّا مَنْ قَالَ بِالْمَالِ هَكَذَا وَهَكَذَا وَهَكَذَا مِنْ بَيْنَ يَدَيْهِ وَمِنْ خَلْفِهِ وَعَنْ يَمِينِهِ وَعَنْ شِمَالِهِ وَقَلِيلٌ مَا هُمْ
[Machine] I arrived at him while he was saying in the shade of the Kaaba, "They are the ones who will incur a loss." By the Lord of the Kaaba, I said, "What is my concern? Does he see something in me?" So I sat down while he was saying, "I couldn't remain silent, and my mind was overwhelmed by what Allah willed. So I said, "Who are they, O Messenger of Allah, by my father and mother?" He said, "The majority of them are those who possess wealth, except those who say this and this and this." Abu Abdullah Al-Hafiz informed us, Abu Ja'far Muhammad ibn Salih ibn Hane' told us, Al-Sari ibn Khuza'ima told us, Umar ibn Hafs told us, my father told us, Al-Amash mentioned it.
انْتَهَيْتُ إِلَيْهِ وَهُوَ يَقُولُ فِي ظِلِّ الْكَعْبَةِ هُمُ الْأَخْسَرُونَ وَرَبِّ الْكَعْبَةِ قُلْتُ مَا شَأْنِي؟ أَيَرَى فِيَّ شَيْئًا فَجَلَسْتُ وَهُوَ يَقُولُ فَمَا اسْتَطَعْتُ أَنْ أَسْكُتَ وَتَغَشَّانِي مَا شَاءَ اللهُ فَقُلْتُ مَنْ هُمْ بِأَبِي أَنْتَ وَأُمِّي يَا رَسُولَ اللهِ؟ قَالَ الْأَكْثَرُونَ أَمْوَالًا إِلَّا مَنْ قَالَ هَكَذَا وَهَكَذَا وَهَكَذَا أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ صَالِحِ بْنِ هَانِئٍ ثنا السَّرِيُّ بْنُ خُزَيْمَةَ ثنا عُمَرُ بْنُ حَفْصٍ ثنا أَبِي ثنا الْأَعْمَشُ فَذَكَرَهُ
[Machine] To the Messenger of Allah, ﷺ , I said, "O Messenger of Allah, indeed I know when you are pleased with me and when you are angry with me." He said, "How do you know that, O Messenger of Allah?" He said, "When you are pleased with me, I say 'No, by the Lord of Muhammad,' and when you are angry with me, I say 'No, by the Lord of Ibrahim.'
لِي رَسُولُ اللهِ ﷺ إِنِّي لَأَعْلَمُ إِذَا كُنْتِ عَنِّي رَاضِيَةً وَإِذَا كُنْتِ عَلَيَّ غَضْبَى قَالَتْ قُلْتُ مِنْ أَيْنَ تَعْلَمُ ذَاكَ يَا رَسُولَ اللهِ؟ قَالَ إِذَا كُنْتِ عَنِّي رَاضِيَةً قُلْتِ لَا وَرَبِّ مُحَمَّدٍ وَإِذَا كُنْتِ عَلَيَّ غَضْبَى قُلْتِ لَا وَرَبِّ إِبْرَاهِيمَ
[Machine] The Prophet ﷺ had a right hand that he would swear by, saying "By the Lord who turns the hearts."
كَانَ لِلنَّبِيِّ ﷺ يَمِينٌ يَحْلِفُ بِهَا لَا وَمُقَلِّبِ الْقُلُوبِ
63.2 [Machine] The Names of Allah ﷻ and His Praises
٦٣۔٢ بَابُ أَسْمَاءِ اللهِ ﷻ ثَنَاؤُهُ
[Machine] The Prophet of Allah, ﷺ , said: "Indeed, Allah has ninety-nine names, one hundred minus one. Whoever counts them will enter Paradise. Verily, Allah is odd and He loves odd numbers."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ لِلَّهِ تِسْعَةً وَتِسْعِينَ اسْمًا مِائَةً إِلَّا وَاحِدًا مَنْ أَحْصَاهَا دَخَلَ الْجَنَّةَ إِنَّهُ وِتْرٌ يُحِبُّ الْوِتْرَ
“Indeed, Allah has ninety-nine Names, one hundred less one, whoever counts them shall enter Paradise. He is Allah, the one whom there is none worthy of worship except for Him (Allāhu Lā Ilāha Illā Huwa), the Most Merciful (to the creation) (Ar-Raḥmān), the Most Beneficent (to the believers) (Ar-Raḥīm), the King (Al-Malik), the Free of Deficiencies (Al-Quddūs), the Granter of Safety (As-Salām), the Granter of Security (Al-Mu’min), the Watcher (Al-Muhaimin), the Mighty (Al-ʿAzīz), the Compeller (Al-Jabbār), the Supreme (Al-Mutakabbir), the Creator (Al-Khāliq), the Originator (Al-Bāri’), the Fashioner (Al-Muṣawwir), the Pardoner (Al-Ghaffār), the Overwhelming (Al-Qahhār), the Giving (Al-Wahhāb), the Provider (Ar-Razzāq), the Opener (Al-Fattāḥ), the Knowing (Al-ʿAlīm), the Taker (Al-Qābiḍ), the Giver (Al-Bāsiṭ), the Abaser (Al-Khāfiḍ), the Exalter (Ar-Rāfiʿ), the One who grants honor (Al-Muʿizz), the One who humiliates (Al-Mudhil), the Hearing (As-Samīʿ), the Seeing (Al-Baṣīr), the Judge (Al-Ḥakam), the Just (Al-ʿAdl), the Kind (Al-Laṭīf), the Aware (Al-Khabīr), the Forbearing (Al-Ḥalīm), the Magnificent (Al-ʿAẓīm), the Oft-Forgiving (Al-Ghafūr), the Grateful (Ash-Shakūr), the Most High (Al-ʿAliyy), the Great (Al-Kabīr), the Guardian (Al-Ḥafīẓ), the Powerful (Al-Muqīt), the Reckoner (Al-Ḥasīb), the Glorious (Al-Jalīl), the Generous (Al-Karīm), the Watcher (Ar-Raqīb), the Responder (Al-Mujīb), the Liberal Giver (Al-Wāsiʿ), the Wise (Al-Ḥakīm), the Loving (Al-Wadūd), the Majestic (Al-Majīd), the Reviver (Al-Bāʿith), the Witness (Ash-Shahīd), the Truth (Al-Ḥaqq), the Guarantor (Al-Wakīl), the Strong (Al-Qawiyy), the Firm (Al-Matīn), the One Who Aids (Al-Waliyy), the Praiseworthy (Al-Ḥamīd), the Encompasser (Al-Muḥṣi), the One Who Begins things (Al-Mubdi’), the One Who brings things back (Al-Muʿīd), the One Who gives life (Al-Muḥyi), the One Who causes death (Al-Mumīt), the Living (Al-Ḥayyu), the Self-Sufficient (Al-Qayyūm), the One Who brings into existence (Al-Wājid), the Illustrious (Al-Mājid), the One (Al-Wāḥid), the Master (Aṣ-Ṣamad), the Able (Al-Qādir), the Powerful (Al-Muqtadir), the One who hastens (Al-Muqaddim), the One who delays (Al-Mu’akhkhir), the First (Al-Awwal), the Last (Al-Ākhir), the Apparent (Aẓ-Ẓāhir), the Inner (Al-Bāṭin), the Owner (Al-Wāli), the Exalted (Al-Mutaʿāli), the Doer of Good (Al-Barr), the Acceptor of repentance (At-Tawwāb), the Avenger (Al-Muntaqim), the Pardoning (Al-ʿAfuww), the Kind (Ar-Ra’ūf), the Owner of Dominion (Mālikul-Mulk), the Possessor of Glory and Generosity (Dhul Jalāli wal Ikrām), the One who does justice (Al-Muqsiṭ), the Gatherer (Al-Jāmiʿ), the Rich (Al-Ghaniyy), the Enricher (Al-Mughni), the Preventer (Al-Māniʿ), the Harmer (Aḍ-Ḍār), the One who benefits (An-Nāfiʿ), the Light (An-Nūr), the Guide (Al-Hādi), the Originator (Al-Badīʿ), the Lasting (Al-Bāqi), the Inheritor (Al-Wārith), the Guide (Ar-Rashīd), the Tolerant (Aṣ-Ṣabūr).” (Using translation from Tirmidhī 3507)
قَالَ رَسُولُ اللهِ ﷺ إِنَّ لِلَّهِ تِسْعَةً وَتِسْعِينَ اسْمًا مِائَةً غَيْرَ وَاحِدَةٍ مَنْ أَحْصَاهَا دَخَلَ الْجَنَّةَ وَهُوَ وِتْرٌ يُحِبُّ الْوِتْرَ هُوَ اللهُ الَّذِي لَا إِلَهَ إِلَّا هُوَ الرَّحْمَنُ الرَّحِيمُ الْمَلِكُ الْقُدُّوسُ السَّلَامُ الْمُؤْمِنُ الْمُهَيْمِنُ الْعَزِيزُ الْجَبَّارُ الْمُتَكَبِّرُ الْخَالِقُ الْبَارِئُ الْمُصَوِّرُ الْغَفَّارُ الْقَهَّارُ الْوَهَّابُ الرَّزَّاقُ الْفَتَّاحُ الْعَلِيمُ الْقَابِضُ الْبَاسِطُ الْخَافِضُ الرَّافِعُ الْمُعِزُّ الْمُذِلُّ السَّمِيعُ الْبَصِيرُ الْحَكَمُ الْعَدْلُ اللَّطِيفُ الْخَبِيرُ الْحَلِيمُ الْعَظِيمُ الْغَفُورُ الشَّكُورُ الْعَلِيُّ الْكَبِيرُ الْحَفِيظُ الْمُقِيتُ الْحَسِيبُ الْجَلِيلُ الْكَرِيمُ الرَّقِيبُ الْمُجِيبُ الْوَاسِعُ الْحَكِيمُ الْوَدُودُ الْمَجِيدُ الْبَاعِثُ الشَّهِيدُ الْحَقُّ الْوَكِيلُ الْقَوِيُّ الْمَتِينُ الْوَلِيُّ الْحَمِيدُ الْمُحْصِي الْمُبْتَدِئُ الْمُعِيدُ الْمُحْيِي الْمُمِيتُ الْحِيُّ الْقَيُّومُ الْوَاجِدُ الْمَاجِدُ الْوَاحِدُ الصَّمَدُ الْقَادِرُ الْمُقْتَدِرُ الْمُقَدَّمُ الْمُؤَخِّرُ الْأَوَّلُ الْآخَرُ الظَّاهِرُ الْبَاطِنُ الْوَالِي الْمُتَعَالِي الْبَرُّ التَّوَّابُ الْمُنْتَقِمُ الْعَفُوُّ الرَّؤْوفُ مَالِكُ الْمُلْكِ ذُو الْجَلَالِ وَالْإِكْرَامِ الْمُقْسِطُ الْجَامِعُ الْغَنِيُّ الْمُغْنِي الْمَانِعُ الضَّارُّ النَّافِعُ النُّورُ الْهَادِي الْبَدِيعُ الْبَاقِي الْوَارِثُ الرَّشِيدُ الصَّبُورُ
[Machine] Imam Shafi'i, may Allah have mercy on him, said: "Whoever swears by Allah or by one of the names of Allah and then breaks his oath, then he must make expiation."
قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ مَنْ حَلَفَ بِاللهِ أَوْ بِاسْمٍ مِنْ أَسْمَاءِ اللهِ فَحَنِثَ فَعَلَيْهِ الْكَفَّارَةُ
[Machine] I heard Ash-Shafi'i say, "Whoever takes an oath by one of the names of Allah and breaks it, then he must make expiation, because the name of Allah is uncreated. And whoever takes an oath by the Kaaba or by Safa and Marwa, then there is no expiation upon him, because they are created, unlike the name of Allah."
سَمِعْتُ الشَّافِعِيَّ يَقُولُ مَنْ حَلَفَ بِاسْمٍ مِنْ أَسْمَاءِ اللهِ فَحَنِثَ فَعَلَيْهِ الْكَفَّارَةُ لِأَنَّ اسْمَ اللهِ غَيْرُ مَخْلُوقٍ وَمَنْ حَلَفَ بِالْكَعْبَةِ أَوْ بِالصَّفَا وَالْمَرْوَةِ فَلَيْسَ عَلَيْهِ الْكَفَّارَةُ لِأَنَّهُ مَخْلُوقٌ وَذَاكَ غَيْرُ مَخْلُوقٍ
63.3 [Machine] Dislike of taking an oath with other than Allah.
٦٣۔٣ بَابُ كَرَاهِيَةِ الْحَلِفِ بِغَيْرِ اللهِ ﷻ
The Messenger of Allah ﷺ heard me swearing an oath by my father and said: “Allah forbids you to swear by your fathers.” ‘Umar said: By Allah, I never swore by my father after that, whether saying it myself or narrating what someone else had said. (Using translation from Aḥmad 241)
أَنَّ رَسُولَ اللهِ ﷺ سَمِعَ عُمَرَ ؓ وَهُوَ يَقُولُ وَأَبِي وَأَبِي فَقَالَ إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ قَالَ عُمَرُ فَوَاللهِ مَا حَلَفْتُ بِهِ ذَاكِرًا وَلَا آثِرًا
[Machine] The Prophet ﷺ heard Umar swearing an oath by his father, and he said, "Verily, Allah forbids you from swearing by your fathers." Umar said, "By Allah, I will never swear by it again, either remembering or forgetting."
سَمِعَ النَّبِيُّ ﷺ عُمَرَ يَحْلِفُ بِأَبِيهِ فَقَالَ أَلَا إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ قَالَ عُمَرُ ؓ وَاللهِ مَا حَلَفْتُ بِهَا بَعْدُ ذَاكِرًا وَلَا آثِرًا
[Machine] "The Prophet ﷺ heard me while I was swearing by my father. He said, 'Verily, Allah forbids you from swearing by your fathers.' Umar said, 'I have never sworn by it, mentioning it or neglecting it.'"
سَمِعَنِي النَّبِيُّ ﷺ وَأَنَا أَحْلِفُ أَقُولُ وَأَبِي فَقَالَ إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ قَالَ عُمَرُ فَمَا حَلَفْتُ بِهَا ذَاكِرًا وَلَا آثِرًا
that he found ʿUmar bin Al-Khattab in a group of people and he was swearing by his father. So Messenger of Allah ﷺ called them, saying, "Verily! Allah forbids you to swear by your fathers. If one has to take an oath, he should swear by Allah or otherwise keep quiet." (Using translation from Bukhārī 6108)
رَسُولَ اللهِ ﷺ أَدْرَكَ عُمَرَ بْنَ الْخَطَّابِ وَهُوَ يَسِيرُ فِي رَكْبٍ وَهُوَ يَحْلِفُ بِأَبِيهِ فَقَالَ رَسُولُ اللهِ ﷺ أَلَا إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ مَنْ كَانَ حَالِفًا فَلْيَحْلِفْ بِاللهِ أَوْ لِيَصْمُتْ
[Machine] The Messenger of Allah ﷺ met Umar during one of his journeys, and he was saying: "And my father, and my father." So he said: "Verily, Allah forbids you from swearing by your fathers. So whoever swears, let him swear by Allah, or be silent."
أَدْرَكَ رَسُولُ اللهِ ﷺ عُمَرَ وَهُوَ فِي بَعْضِ أَسْفَارِهِ وَهُوَ يَقُولُ وَأَبِي وَأَبِي فَقَالَ إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ فَمَنْ كَانَ حَالِفًا فَلْيَحْلِفْ بِاللهِ أَوْ لِيَصْمُتْ
[Machine] The Messenger of Allah ﷺ caught up with Umar while he was on a journey, taking an oath by his father. When the Messenger of Allah ﷺ heard this, he said, "Hold on, for Allah has prohibited you from swearing by your fathers. Whoever swears, let him swear by Allah or remain silent."
رَسُولَ اللهِ ﷺ أَدْرَكَ عُمَرَ ؓ وَهُوَ فِي رَكْبٍ وَهُوَ يَحْلِفُ بِأَبِيهِ فَلَمَّا سَمِعَهُ رَسُولُ اللهِ ﷺ قَالَ مَهْلًا فَإِنَّ اللهَ قَدْ نَهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ مَنْ حَلَفَ فَلْيَحْلِفْ بِاللهِ أَوْ لِيَسْكُتْ
The Messenger of Allah ﷺ found 'Umar al-Khattab in a caravan while he was swearing by his father. So he said: Allah forbids you to swear by forefathers. If anyone swears, he must swear by Allah or keep silence. (Using translation from Abū Dāʾūd 3249)
أَنَّ رَسُولَ اللهِ ﷺ أَدْرَكَهُ وَهُوَ فِي رَكْبٍ وَهُوَ يَحْلِفُ بِأَبِيهِ فَقَالَ إِنَّ اللهَ يَنْهَاكُمْ أَنَ تَحْلِفُوا بِآبَائِكُمْ فَلْيَحْلِفْ حَالَفٌ بِاللهِ أَوْ لِيَسْكُتْ
[Machine] The Messenger of Allah ﷺ said, "Do not swear by your fathers nor by the false deities."
قَالَ رَسُولُ اللهِ ﷺ لَا تَحْلِفُوا بِآبَائِكُمْ وَلَا بِالطَّوَاغِيتِ
[Machine] "From the Prophet ﷺ , he said: Do not swear by your fathers or your mothers. Increased falsehood does not make it any better. And do not swear by any other deities. Swear only by Allah and swear only when you are truthful."
عَنِ النَّبِيِّ ﷺ قَالَ لَا تَحْلِفُوا بِآبَائِكُمْ وَلَا بِأُمَّهَاتِكُمْ زَادَ تَمْتَامٌ وَلَا بِالْأَنْدَادِ وَلَا تَحْلِفُوا إِلَّا بِاللهِ وَلَا تَحْلِفُوا إِلَّا وَأَنْتُمْ صَادِقُونَ
[Machine] The Messenger of Allah ﷺ said: "Whoever swears by other than Allah has indeed disbelieved or associated partners with Him." And this is something that Saad bin Ubaydah did not hear from Ibn Umar.
رَسُولَ اللهِ ﷺ يَقُولُ مَنْ حَلَفَ بِغَيْرِ اللهِ فَقَدْ كَفَرَ أَوْ أَشْرَكَ وَهَذَا مِمَّا لَمْ يَسْمَعْهُ سَعْدُ بْنُ عُبَيْدَةَ مِنِ ابْنِ عُمَرَ
[Machine] No, but I swear by the Lord of the Kaaba. Verily, Umar used to swear by his father, so the Messenger of Allah ﷺ said: "Do not swear by your father, for whoever swears by other than Allah has associated partners with Him."
لَا وَلَكِنِ أَحْلِفُ بِرَبِّ الْكَعْبَةِ فَإِنَّ عُمَرَ كَانَ يَحْلِفُ بِأَبِيهِ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَحْلِفْ بِأَبِيكَ فَإِنَّهُ مَنْ حَلَفَ بِغَيْرِ اللهِ فَقَدْ أَشْرَكَ
[Machine] "That the Prophet, ﷺ , said: 'He succeeded, and his father succeeded, if he is truthful. It is possible that this statement came from him before the prohibition, and it is possible that it happened from him according to the usual way of speaking on tongues. It does not mean by it the swearing, such as idle talk. And it is possible that the prohibition only occurred from him when it was in respect and honor of him, and to glorify his right, unlike what was contrary to it. And that was not from him in the way of glorifying, rather it was in the way of affirmation. And it is possible that he, ﷺ , alluded to the name of Allah the Exalted in it, as if he said: 'No, by the Lord of his father and others,' he, ﷺ , does not imply concealment, rather he goes with the way of glorification for his father.'"
أَنَّ النَّبِيَّ ﷺ قَالَ أَفْلَحَ وَأَبِيهِ إِنْ صَدَقَ فَيُحْتَمَلُ أَنْ يَكُونَ هَذَا الْقَوْلُ مِنْهُ قَبْلَ النَّهْيِ وَيُحْتَمَلُ أَنْ يَكُونَ جَرَى ذَلِكَ مِنْهُ عَلَى عَادَةِ الْكَلَامِ الْجَارِي عَلَى الْأَلْسُنِ وَهُوَ لَا يَقْصِدُ بِهِ الْقَسَمَ كَلَغْوِ الْيَمِينِ الْمَعْفُوِّ عَنْهُ وَيُحْتَمَلُ أَنْ يَكُونَ النَّهْيُ إِنَّمَا وَقَعَ عَنْهُ إِذَا كَانَ مِنْهُ عَلَى وَجْهِ التَّوْقِيرِ لَهُ وَالتَّعْظِيمِ لِحَقِّهِ دُونَ مَا كَانَ بِخِلَافِهِ وَلَمْ يَكُنْ ذَلِكَ مِنْهُ عَلَى وَجْهِ التَّعْظِيمِ بَلْ كَانَ عَلَى وَجْهِ التَّوْكِيدِ وَيُحْتَمَلُ أَنَّهُ كَانَ ﷺ أَضْمَرَ فِيهِ اسْمَ اللهِ تَعَالَى كَأَنَّهُ قَالَ لَا وَرَبِّ أَبِيهِ وَغَيْرُهُ لَا يُضْمِرُ بَلْ يَذْهَبُ فِيهِ مَذْهَبَ التَّعْظِيمِ لِأَبِيهِ
63.4 [Machine] Who swears by other than Allah, then breaks his oath, or swears by innocence of Islam, or by a religion other than Islam, or by trustworthiness...
٦٣۔٤ بَابُ مَنْ حَلَفَ بِغَيْرِ اللهِ , ثُمَّ حَنِثَ، أَوْ حَلَفَ بِالْبَرَاءَةِ مِنَ الْإِسْلَامِ، أَوْ بِمِلَّةٍ غَيْرِ الْإِسْلَامِ، أَوْ بِالْأَمَانَةِ
[Machine] The Messenger of Allah ﷺ said, "Whoever swears an oath, let him swear only by Allah. The Quraysh used to swear by their fathers, so he ﷺ said, 'Do not swear by your fathers.'"
قَالَ رَسُولُ اللهِ ﷺ مَنْ كَانَ حَالِفًا فَلَا يَحْلِفْ إِلَّا بِاللهِ وَكَانَتْ قُرَيْشٌ تَحْلِفُ بِآبَائِهَا فَقَالَ لَا تَحْلِفُوا بِآبَائِكُمْ
Messenger of Allah ﷺ said: "Whoever amongst you swears, (saying by error) in his oath 'By Al-Lat and Al- Uzza', then he should say, 'None has the right to be worshipped but Allah.' And whoever says to his companions, 'Come let me gamble' with you, then he must give something in charity (as an expiation for such a sin)." (See Hadith No. 645) (Using translation from Bukhārī 6107)
قَالَ رَسُولُ اللهِ ﷺ مَنْ حَلَفَ مِنْكُمْ فَقَالَ فِي حَلِفِهِ بِاللَّاتِ وَالْعُزَّى فَلْيَقُلْ لَا إِلَهَ إِلَّا اللهُ وَمَنْ قَالَ لِصَاحِبِهِ تَعَالَ أُقَامِرْكَ فَلْيَتَصَدَّقْ
[Machine] The Prophet ﷺ said, "A believer is not obligated to fulfill a vow if he cannot fulfill it, and cursing a believer is like killing him. Whoever kills themselves with something will be punished with it on the Day of Judgment. And whoever swears by a religion other than Islam falsely, he is as he said."
أَنَّ النَّبِيَّ ﷺ قَالَ لَيْسَ عَلَى الْمُؤْمِنِ نَذْرٌ فِيمَا لَا يَمْلِكُ وَلَعْنُ الْمُؤْمِنِ كَقَتْلِهِ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ عُذِّبَ بِهِ يَوْمَ الْقِيَامَةِ وَمَنْ حَلَفَ بِمِلَّةٍ غَيْرِ الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَ
The Prophet ﷺ said: If anyone takes an oath and says: I am free from Islam; now if he is a liar (in his oath), he will not return to Islam with soundness. (Using translation from Abū Dāʾūd 3258)
قَالَ رَسُولُ اللهِ ﷺ مَنْ حَلَفَ أَنَّهُ بَرِيءٌ مِنَ الْإِسْلَامِ فَإِنْ كَانَ صَادِقًا لَمْ يَرْجِعْ إِلَى الْإِسْلَامِ سَالِمًا وَإِنْ كَانَ كَاذِبًا فَهُوَ كَمَا قَالَ
[Machine] The Messenger of Allah ﷺ said, "Whoever breaks their oath of trust is not one of us, and whoever slanderizes the wife of a man or his slave, is not one of us."
قَالَ رَسُولُ اللهِ ﷺ مَنْ حَلَفَ بِالْأَمَانَةِ فَلَيْسَ مِنَّا وَمَنْ خَبَّبَ زَوْجَةَ امْرِئٍ أَوْ مَمْلُوكِهِ فَلَيْسَ مِنَّا
[Machine] Said Sa'id, Qatada and Al-Hasan said, "There is no expiation for one who swears by Judaism or Christianity and then breaks his oath."
قَالَ سَعِيدٌ كَانَ قَتَادَةُ وَالْحَسَنُ يَقُولَانِ لَيْسَ عَلَيْهِ كَفَّارَةٌ يَعْنِي مَنْ حَلَفَ بِالْيَهُودِيَّةِ أَوِ النَّصْرَانِيَّةِ ثُمَّ حَنِثَ
[Machine] The Messenger of Allah ﷺ was asked about a man who claims to be a Jew, Christian, or someone who is not a Muslim, but he swears by Allah when making an oath and then breaks it. He replied that the expiation for breaking an oath is required. This narration has no basis in the Hadith of Az-Zuhri or others. Sulaiman ibn Abi Dawud al-Harrani attributed it to himself, but it is a fabricated hadith that has been weakened by scholars who have abandoned it.
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الرَّجُلِ يَقُولُ هُوَ يَهُودِيٌّ أَوْ نَصْرَانِيٌّ أَوْ بَرِيءٌ مِنَ الْإِسْلَامِ فِي الْيَمِينِ يَحْلِفُ عَلَيْهِ فَيَحْنَثُ؟ قَالَ كَفَّارَةُ يَمِينٍ فَهَذَا لَا أَصْلَ لَهُ مِنْ حَدِيثِ الزُّهْرِيِّ وَلَا غَيْرِهِ تَفَرَّدَ بِهِ سُلَيْمَانُ بْنُ أَبِي دَاوُدَ الْحَرَّانِيُّ وَهُوَ مُنْكَرُ الْحَدِيثِ ضَعَّفَهُ الْأَئِمَّةُ وَتَرَكُوْهُ
63.5 [Machine] No one hates to swear by Allah except in what is due to Allah's obedience.
٦٣۔٥ بَابُ مِنْ كَرِهَ الْأَيْمَانَ بِاللهِ إِلَّا فِيمَا كَانَ لِلَّهِ طَاعَةٌ
[Machine] The Prophet of Allah ﷺ said, "An oath is either fulfilled or repented."
قَالَ رَسُولُ اللهِ ﷺ الْحَلِفُ حَنْثٌ أَوْ نَدَمٌ كَذَا
[Machine] Al-Bukhari and the Hadith of Umar are more important.
الْبُخَارِيُّ وحَدِيثُ عُمَرَ أَوْلَى
63.6 [Machine] Whoever takes an oath and then sees something better than it, should do that which is better and make amends for his oath.
٦٣۔٦ بَابُ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ، وَلْيُكَفِّرْ عَنْ يَمِينِهِ
Messenger of Allah ﷺ said, "(O ʿAbdur-Rahman!) Do not seek to be a ruler, for, if you are given the authority of ruling without your asking for it, then Allah will help you; but if you are given it by your asking, then you will be held responsible for it (i.e. Allah will not help you ) . And if you take an oath to do something and later on find another thing, better than that, then do what is better and make expiation for (the dissolution of) your oath." (Using translation from Bukhārī 6722)
قَالَ رَسُولُ اللهِ ﷺ يَا عَبْدَ الرَّحْمَنِ لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا وَإِنْ أُعْطِيتَهَا عَنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا وَإِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَأْتِ الَّذِي هُوَ خَيْرٌ وَكَفَرْ عَنْ يَمِينِكَ
[Machine] I entered upon Abu Musa while he was eating chicken meat. He said, "Come and eat." I said, "I have sworn not to eat it." He said, "Come and eat, and I will tell you about your right hand." I approached and ate. He said, "We accompanied the Messenger of Allah ﷺ when some of the Ash'aris came and asked to be carried. He said, 'No, by Allah, I will not carry you, and I don't have what I can carry you on.' He said, 'We did not stay long until the Ghurru Al-Dhura pillars came to him, and he instructed us to carry them. We did not go far until we said, 'What have we done? We have forgotten the right of the Messenger of Allah ﷺ .' By Allah, we will not succeed.' So we returned to him and said, 'What is your response to us?' He said, 'I did not forget it, but whoever swears on his right hand and then sees something better than it, let him come to what is better and make atonement for his right hand.' 19843 and Abu 'Abdullah Al-Hafiz informed us, narrating from Yahya bin Mansur Al-Qadi, who narrated from Muhammad bin 'Umar bin Al-'Ala, who narrated from Shayban bin Farrukh, who narrated from Al-Sa'q bin Hazan, who mentioned it.
دَخَلْتُ عَلَى أَبِي مُوسَى ؓ وَهُوَ يَأْكُلُ لَحْمَ دَجَاجٍ فَقَالَ ادْنُ فَكُلْ فَقُلْتُ إِنِّي حَلَفْتُ لَا آكُلُهُ قَالَ ادْنُ فَكُلْ وَسَأُخْبِرُكَ عَنْ يَمِينِكَ هَذِهِ قَالَ فَدَنَوْتُ فَأَكَلْتُ قَالَ أَتَيْنَا رَسُولَ اللهِ ﷺ فِي نَاسٍ مِنَ الْأَشْعَرِيِّينَ نَسْتَحْمِلُهُ فَقَالَ لَا وَاللهِ لَا أَحْمِلُكُمْ وَمَا عِنْدِي مَا أَحْمِلُكُمْ عَلَيْهِ قَالَ فَمَا بَرِحْنَا حَتَّى أَتَتْهُ فَرَائِضُ غُرُّ الذُّرَى فَأَمَرَ لَنَا مِنْهَا بِحِمْلَانِ فَمَا بَرِحْنَا إِلَّا يَسِيرًا حَتَّى قُلْنَا مَا صَنَعْنَا نَسَّيْنَا رَسُولَ اللهِ ﷺ يَمِينَهُ وَاللهِ لَا نُفْلِحُ قَالَ فَرَجَعْنَا إِلَيْهِ قَالَ مَا رَدَّكُمْ؟ قَالُوا إِنَّكَ حَلَفْتَ أَلَّا تَحْمِلَنَا فَخَشِينَا أَنْ لَا يُبَارَكَ لَنَا وَخَشِينَا أَنْ نَكُونَ نَسَّيْنَاكَ يَمِينَكَ قَالَ أَنِّي وَاللهِ مَا نُسِّيتُهَا وَلَكِنْ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ 19843 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي ثنا مُحَمَّدُ بْنُ عُمَرَ بْنِ الْعَلَاءِ ثنا شَيْبَانُ بْنُ فَرُّوخَ ثنا الصَّعْقُ بْنُ حَزَنٍ فَذَكَرَهُ
[Machine] We carried the Messenger of Allah ﷺ on our shoulders, and he said, "I swear by Allah, I am not carrying you. I do not have what I can carry you on." So when we returned, the Messenger of Allah ﷺ sent to us three camels, and I said, "O Messenger of Allah, you have sworn not to carry us, but you carried us." He said, "I did not carry you, but Allah carried you. By Allah, I do not swear by any right hand to show that there is something better than it unless I fulfill it."
أَتَيْنَا رَسُولَ اللهِ ﷺ نَسْتَحْمِلُهُ فَقَالَ وَاللهِ لَا أَحْمِلُكُمْ وَمَا عِنْدِي مَا أَحْمِلُكُمْ عَلَيْهِ قَالَ فَلَمَّا رَجَعْنَا أَرْسَلَ إِلَيْنَا رَسُولُ اللهِ ﷺ بِثَلَاثٍ ذَوْدٍ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّكَ حَلَفْتَ أَنْ لَا تَحْمِلَنَا فَحَمَلْتَنَا قَالَ أَنِّي لَمْ أَحْمِلُكُمْ وَلَكِنَّ اللهَ حَمَلَكُمْ وَاللهِ لَا أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا أَتَيْتُهُ
[Machine] From the Prophet ﷺ in this hadith, he said: "By Allah, if Allah wills, I will not swear an oath on my right hand and then see something better than it, unless I do what is better and release it." Abu Abdullah Al-Hafiz informed us, Abu Abdullah Muhammad ibn Ya'qub narrated to us, Yahya ibn Muhammad ibn Yahya narrated to us, Abu Al-Rabi Al-Zahranini narrated to us, Hammad ibn Zaid narrated from Ayyub, from Abu Qilabah, from Zahdam Al-Garmi. Ayyub said: "And Al-Qasim Al-Kalbi informed me about it."
عَنِ النَّبِيِّ ﷺ فِي هَذَا الْحَدِيثِ قَالَ إِنِّي وَاللهِ إِنْ شَاءَ اللهُ لَا أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا أَتَيْتُ الَّذِي هُوَ خَيْرٌ وَتَحَلَّلْتُهَا أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا يَحْيَى بْنُ مُحَمَّدِ بْنِ يَحْيَى ثنا أَبُو الرَّبِيعِ الزَّهْرَانِيُّ ثنا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ أَبِي قِلَابَةَ عَنْ زَهْدَمٍ الْجَرْمِيِّ قَالَ أَيُّوبُ وَحَدَّثَنِيهِ الْقَاسِمُ الْكَلْبِيُّ عَنْ زَهْدَمٍ فَذَكَرَهُ
[Machine] About the Prophet ﷺ in this Hadith: "I swear by Allah, I do not swear an oath on any other right-hand oath, and then see anything better than it, except that I nullify my oath and fulfill what is better." Abu Al-Hassan Al-Muqri' informed us, and he informed us Abu Al-Hassan bin Muhammad bin Ishaq, and he informed us Yusuf bin Ya'qub, and he informed us Muhammad bin Abi Bakr, and he informed us Hammad, and he informed us Ghaylan bin Jarir, from Abu Burdah, from his father, who mentioned it. They included it in Sahih, as mentioned before.
عَنِ النَّبِيِّ ﷺ فِي هَذَا الْحَدِيثِ إِنِّي وَاللهِ لَا أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا كَفَّرْتُ يَمِينِي وَأَتَيْتُ الَّذِي هُوَ خَيْرٌ أَخْبَرَنَاهُ أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا حَمَّادٌ ثنا غَيْلَانُ بْنُ جَرِيرٍ عَنْ أَبِي بُرْدَةَ عَنْ أَبِيهِ فَذَكَرَهُ أَخْرَجَاهُ فِي الصَّحِيحِ كَمَا مَضَى
A person sat late in the night with Allah's Apostle ﷺ, and then came to his family and found that his children had gone to sleep. His wife brought food for him. but he took an oath that he would not eat because of his children (having gone to sleep without food) He then gave precedence (of breaking the vow and then expiating it) and ate the food He then came to Allah s Messenger ﷺ and made mention of that to him, whereupon Messenger of Allah (may peace he upon him) said: He who took an oath and (later on) found something better than that should do that, and expiate for (breaking) his vow. (Using translation from Muslim 1650a)
اعْتَمَّ رَجُلٌ عِنْدَ النَّبِيِّ ﷺ ثُمَّ رَجَعَ إِلَى أَهْلِهِ فَوَجَدَ الصِّبْيَةَ قَدْ نَامُوا فَأَتَاهُ أَهْلُهُ بِطَعَامٍ فَحَلَفَ أَنْ لَا يَأْكُلَ مِنْ أَجْلِ صِبْيَتِهِ ثُمَّ بَدَا لَهُ فَأَكَلَ فَأَتَيَا رَسُولَ اللهِ ﷺ فَذَكَرَا ذَلِكَ لَهُ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِهَا وَلْيُكَفِّرْ عَنْ يَمِينِهِ
[Machine] He has nothing of mine except for my shield and forgiveness, so I will write to you to give it to my family." He said, "He did not agree." He said, "So Adi became angry and swore not to give him anything." He said, "The man was satisfied." He said, "He said, 'Had I not heard the Messenger of Allah ﷺ saying, 'Whoever swears an oath and sees its consequences, let him fulfill it with piety.'"
لَهُ عَدِيُّ مَا عِنْدِي إِلَّا دِرْعِي وَمِغْفَرِي فَأَنَا أَكْتُبُ لَكَ إِلَى أَهْلِي تُعْطَهَا قَالَ فَلَمْ يَرْضَ قَالَ فَغَضِبَ عَدِيُّ فَحَلَفَ لَا يُعْطِيهِ شَيْئًا قَالَ فَرَضِيَ الرَّجُلُ قَالَ فَقَالَ لَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى تُقَاءَهَا فَلْيَأْتِ التَّقْوَى مَا حَنَثَتْ
[Machine] "That the Prophet ﷺ said: Whoever swears an oath and then sees something better than it, should act upon what is better and break the oath."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيَتْرُكْ
[Machine] The Messenger of Allah ﷺ said, "If any one of you takes an oath and later finds something better, then let him make expiation for his oath and do what is better." Narrated Abu Abdullah Al-Hafiz, who narrated from Ahmad ibn Sahl Al-Bukhari, who narrated from Salih ibn Muhammad Al-Hafiz, who narrated from Muhammad ibn Abdullah ibn Numair, who narrated from Muhammad ibn Fudail ibn Ghazwan, from Al-A'mash, who mentioned it.
قَالَ رَسُولُ اللهِ ﷺ إِذَا حَلَفَ أَحَدُكُمْ عَلَى يَمِينٍ فَرَأَى خَيْرًا مِنْهَا فَلْيُكَفِّرْهَا وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ 19850 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَحْمَدُ بْنُ سَهْلٍ الْبُخَارِي أنبأ صَالِحُ بْنُ مُحَمَّدٍ الْحَافِظُ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ نُمَيْرٍ ثنا مُحَمَّدُ بْنُ فُضَيْلِ بْنِ غَزْوَانَ عَنِ الْأَعْمَشِ فَذَكَرَهُ
the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ يَمِينَهُ
[Machine] The Messenger of Allah ﷺ said, "By Allah, it is more sinful for one of you to enter upon his family with his right hand than to give his required expiation that Allah has obliged."
وَقَالَ رَسُولُ اللهِ ﷺ وَاللهِ لَأَنْ يَلِجَ أَحَدُكُمْ بِيَمِينِهِ فِي أَهْلِهِ آثَمُ لَهُ عِنْدَ اللهِ مِنْ أَنْ يُعْطِيَ كَفَّارَتَهُ الَّتِي فَرَضَ اللهُ
[Machine] The Messenger of Allah ﷺ said: "When a man feels estrangement towards his family, it is the greatest sin, and expiation does not suffice."
قَالَ رَسُولُ اللهِ ﷺ إِذَا اسْتَلَجَّ الرَّجُلُ فِي أَهْلِهِ فَهُوَ أَعْظَمُ إِثْمًا لَيْسَ تُغْنِي الْكَفَّارَةُ
[Machine] In His saying, "And do not make Allah an obstacle to your oaths" [Al-Baqarah 224], He is saying, "Do not make me an obstacle to your vow not to do good. Instead, fulfill your vow and do good."
فِي قَوْلِهِ ﷻ {وَلَا تَجْعَلُوا اللهَ عُرْضَةً لِأَيْمَانِكُمْ} [البقرة 224] يَقُولُ لَا تَجْعَلْنِي عُرْضَةً لِيَمَيْنِكَ أَنْ لَا تَصْنَعَ الْخَيْرَ وَلَكِنْ كَفَرْ عَنْ يَمِينِكَ وَاصْنَعِ الْخَيْرَ
[Machine] On the authority of Al-Hasan, regarding his statement {And do not make Allah an obstacle to your oaths} [Al-Baqarah 224], he said: "Do not belittle Allah. None of you should say, 'I have vowed to not maintain ties of kinship, or strive for righteousness, or give charity from my wealth.' Disbelieving in your right hand, turn to Allah whom you have sworn by." This is the statement of Qatadah.
عَنِ الْحَسَنِ فِي قَوْلِهِ {وَلَا تَجْعَلُوا اللهَ عُرْضَةً لِأَيْمَانِكُمْ} [البقرة 224] قَالَ لَا تَعْتَلُّوا بِاللهِ لَا يَقُولُ أَحَدُكُمْ إِنِّي آلَيْتُ أَنْ لَا أَصْلَ رَحِمًا وَلَا أَسْعَى فِي صَلَاحٍ وَلَا أَتَصَدَّقَ مِنْ مَالِي كَفِّرْ عَنْ يَمِينِكَ وَائْتِ اللهَ الَّذِي حَلَفْتَ عَلَيْهِ وَهُوَ قَوْلُ قَتَادَةَ
63.7 [Machine] Doubt of those who claimed that there is no expiation for breaking an oath if it is done in obedience.
٦٣۔٧ بَابُ شُبْهةِ مِنْ زَعَمَ أَنْ لَا كَفَّارَةَ فِي الْيَمِينِ إِذَا كَانَ حِنْثُهَا طَاعَةً
[Machine] Two brothers from the ansar had an inheritance between them, so one of them asked his companion for a distribution. The companion replied, "No, if you ask me for a distribution again, I will never speak to you. All the money I have is in the Riyat al-Kaaba." Umar ibn al-Khattab said, "Indeed, the Kaaba is rich enough without your wealth. So, make expiation for your oath and speak to your brother. Verily, I heard the Messenger of Allah ﷺ say: There is no oath or vow in that which angers the Lord, nor in cutting off ties of kinship, nor in that which one does not possess. Umar ibn al-Khattab's fatwa on expiation is proof that the intended meaning of the statement is not an oath, but rather it is a directive to take action and strive to maintain righteousness when one is in a state of disobedience. It is not that expiation is not necessary for a false oath; rather, this is also what is meant by the statement.
أَنَّ أَخَوَيْنِ مِنَ الْأَنْصَارِ كَانَ بَيْنَهُمَا مِيرَاثٌ فَسَأَلَ أَحَدُهُمَا صَاحِبَهُ الْقِسْمَةَ فَقَالَ لَا لَئِنْ عُدْتَ تَسْأَلُنِي الْقِسْمَةَ لَمْ أُكَلِّمْكَ أَبَدًا وَكُلُّ مَالٍ لِي فِي رِتَاجِ الْكَعْبَةِ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ إِنَّ الْكَعْبَةَ لَغَنِيَّةٌ عَنْ مَالِكَ فَكَفِّرْ عَنْ يَمِينِكَ وَكَلِّمْ أَخَاكَ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَمِينَ وَلَا نَذْرَ فِيمَا يُسْخِطُ الرَّبَّ وَلَا فِي قَطِيعَةِ الرَّحِمِ وَلَا فِيمَا لَا يُمْلَكُ فَتْوَى عُمَرَ بْنِ الْخَطَّابِ ؓ بِالْكَفَّارَةِ دَلِيلٌ عَلَى أَنَّ الْمُرَادَ بِالْخَبَرِ لَا يَمِينَ يُؤْمَرُ بِالْمُقَامِ عَلَيْهَا وَالْمُحَافَظَةِ عَلَى الْبِرِّ فِيهَا إِذَا كَانَتْ فِي مَعْصِيَةٍ لَا أَنَّ الْكَفَّارَةَ لَا تَجِبُ بِالْحِنْثِ فِيهَا وَهَذَا هُوَ الْمُرَادُ أَيْضًا بِمَا
[Machine] The Messenger of Allah, may peace and blessings be upon him, said: "Whoever divorces something he does not possess, then there is no divorce for him. And whoever frees something he does not possess, then there is no freedom for him. And whoever makes a vow concerning something he does not possess, then there is no vow for him. And whoever swears an oath to commit a sinful act, then there is no oath for him. And whoever swears an oath to sever family ties, then there is no oath for him. And it has been narrated in this hadith an addition that contradicts the authentic narrations from the Prophet, may peace and blessings be upon him."
رَسُولَ اللهِ ﷺ قَالَ مَنْ طَلَّقَ مَا لَا يَمْلِكُ فَلَا طَلَاقَ لَهُ وَمَنْ أَعْتَقَ مَا لَا يَمْلِكُ فَلَا عَتَاقَةَ لَهُ وَمَنْ نَذَرَ فِيمَا لَا يَمْلِكُ فَلَا نَذْرَ لَهُ وَمَنْ حَلَفَ عَلَى مَعْصِيَةِ اللهِ فَلَا يَمِينَ لَهُ وَمَنْ حَلَفَ عَلَى قَطِيعَةِ رَحِمٍ فَلَا يَمِينَ لَهُ وَقَدْ رُوِيَ فِي هَذَا الْحَدِيثِ زِيَادَةٌ تُخَالِفُ الرِّوَايَاتِ الصَّحِيحَةِ عَنِ النَّبِيِّ ﷺ
