He who took an oath and then found another thing better than (this) should expiate for the oath (broken) by him and do (the better thing).

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلْ

[AI] The Messenger of Allah ﷺ said: "Whoever swears an oath and then sees that something else is better than it, let him do that which is better and expiate for his oath."

When anyone amongst you takes an oath, but he finds (something) better than that he should expiate (the breaking of the oath), and do that which is better.

قَالَ رَسُولُ اللَّهِ ﷺ إِذَا حَلَفَ أَحَدُكُمْ عَلَى الْيَمِينِ فَرَأَى خَيْرًا مِنْهَا فَلْيُكَفِّرْهَا وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ

You asked me for one hundred dirhams and I am the son of Hatim; by Allah, I will not give you. But then he said: (I would have done that) if I had not heard Messenger of Allah ﷺ say: He who takes an oath, but then finds something better than that, should do that which is better.

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ مَنْ حَلَفَ عَلَى يَمِينٍ ثُمَّ رَأَى خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ

The Messenger of Allah ﷺ said: An oath or a vow about something over which a human being has no control, and to disobey Allah, and to break ties of relationship is not binding. If anyone takes an oath and then considers something else better than it, he should give it up, and do what is better, for leaving it is its atonement. Abu Dawud said: All sound traditions from the Prophet ﷺ say: "He should make atonement for his oath," except those versions which are not reliable. Abu Dawud said: I said to Ahmad: Yahya b. Sa'id (al-Qattan) has transmitted this tradition from Yahya b. 'Ubaid Allah. He (Ahmad b. Hanbal) said: But he gave it up after that, and he was competent for doing it. Ahmad said: His (Yahya b. 'Ubaid Allah's) tradition are munkar (rejected) and his father is not known.

قَالَ رَسُولُ اللَّهِ ﷺ لاَ نَذْرَ وَلاَ يَمِينَ فِيمَا لاَ يَمْلِكُ ابْنُ آدَمَ وَلاَ فِي مَعْصِيَةِ اللَّهِ وَلاَ فِي قَطِيعَةِ رَحِمٍ وَمَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَدَعْهَا وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ فَإِنَّ تَرْكَهَا كَفَّارَتُهَا

On the authority of his father that the Prophet ﷺ said: I swear by Allah that if Allah wills I shall swear on an oath and then consider something else to be better than it without making atonement for my oath and doing the thing that is better. Or he said (according to another version): But doing the thing that is better and making atonement for my oath.

أَنَّ النَّبِيَّ ﷺ قَالَ إِنِّي وَاللَّهِ إِنْ شَاءَ اللَّهُ لاَ أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلاَّ كَفَّرْتُ عَنْ يَمِينِي وَأَتَيْتُ الَّذِي هُوَ خَيْرٌ أَوْ قَالَ إِلاَّ أَتَيْتُ الَّذِي هُوَ خَيْرٌ وَكَفَّرْتُ يَمِينِي

The Prophet ﷺ said to me: 'Abd al-Rahman b. Samurah, when you swear an oath and consider something else to be better than it, do the thing that is beter and make atonement for your oath. Abu Dawud said: I heard Ahmad (b. Hanbal) permitting to make atonement before breaking the oath.

لِيَ النَّبِيُّ ﷺ يَا عَبْدَ الرَّحْمَنِ بْنَ سَمُرَةَ إِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَأْتِ الَّذِي هُوَ خَيْرٌ وَكَفِّرْ يَمِينَكَ

That the Prophet ﷺ said: "Whoever takes an oath, and then he sees that something else is better than it, then he should make atonement for his oath and then do it."

عَنِ النَّبِيِّ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلْ قَالَ وَفِي الْبَابِ عَنْ أُمِّ سَلَمَةَ

"There is nothing on Earth that I swear an oath upon, and I see that something else is better, but I do that which is better."

عَنِ النَّبِيِّ ﷺ قَالَ مَا عَلَى الأَرْضِ يَمِينٌ أَحْلِفُ عَلَيْهَا فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلاَّ أَتَيْتُهُ

"Whoever swears an oath, then sees something better than it, let him do that which is better."

Yahya said that he heard Malik say, "Anyone who says that he has a vow but does not mention the name of Allah, is still obliged to make the kaffara for an oath (if he breaks it)". Malik said, "Emphasis is when a man swears one thing several times, repeating the oath in his speech time after time. For instance, the statement, 'By Allah, I will not decrease it from such-and-such,' sworn three times or more. The kaffara of that is like the kaffara of one oath. If a man swears, 'I will not eat this food or wear these clothes or enter this house,' that is all in one oath, and he is only obliged to do one kaffara. It is the same for a man who says to his wife, 'You are divorced if I clothe you in this garment or let you go to the mosque,' and it is one entire statement in the normal pattern of speech. If he breaks any of that oath, divorce is necessary, and there is no breaking of oath after that in whatever he does. There is only one oath to be broken in that." Malik said, "What we do about a woman who makes a vow without her husband's permission is that she is allowed to do so and she must fulfill it, if it only concerns her own person and will not harm her husband. If, however, it will harm her husband, he may forbid her to fulfill it, but it remains an obligation against her until she has the opportunity to complete it."

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ حَلَفَ بِيَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلِ الَّذِي هُوَ خَيْرٌ۔ قَالَ يَحْيَى : سَمِعْتُ مَالِكًا يَقُولُ: مَنْ قَالَ: عَلَيَّ نَذْرٌ، وَلَمْ يُسَمِّ شَيْئًا، إِنَّ عَلَيْهِ كَفَّارَةَ يَمِينٍ. قَالَ مَالِكٌ : فَأَمَّا التَّوْكِيدُ، فَهُوَ حَلِفُ الْإِنْسَانِ فِي الشَّيْءِ الْوَاحِدِ، يُرَدِّدُ فِيهِ الْأَيْمَانَ، يَمِينًا بَعْدَ يَمِينٍ، كَقَوْلِهِ: وَاللهِ، لَا أَنْقُصُهُ مِنْ كَذَا، أَوْ كَذَا، يَحْلِفُ بِذلِكَ مِرَارًا. ثَلَاثًا، أَوْ أَكْثَرَ مِنْ ذلِكَ. قَالَ: فَكَفَّارَةُ ذلِكَ وَاحِدَةٌ، مِثْلُ كَفَّارَةِ الْيَمِينِ. قَالَ مَالِكٌ : فَإِنْ حَلَفَ رَجُلٌ، فَقَالَ: وَاللهِ لَا آكُلُ هذَا الطَّعَامَ، وَلَا أَلْبَسُ هذَا الثَّوْبَ، وَلَا أَدْخُلُ هذَا الْبَيْتَ. فَكَانَ هذَا فِي يَمِينٍ وَاحِدَةٍ. فَإِنَّمَا عَلَيْهِ كَفَّارَةٌ وَاحِدَةٌ. وَإِنَّمَا ذلِكَ كَقَوْلِ الرَّجُلِ لِامْرَأَتِهِ: أَنْتِ الطَّلَاقُ، إِنْ كَسَوْتُكِ هذَا الثَّوْبَ، وَلَا أَذِنْتُ لَكِ إِلَى الْمَسْجِدِ، يَكُونُ ذلِكَ نَسَقًا مُتَتَابِعًا، فِي كَلَامٍ وَاحِدٍ. فَإِنْ حَنِثَ فِي شَيْءٍ مِنْ ذلِكَ وَاحِدٌ، فَقَدْ وَجَبَ عَلَيْهِ الطَّلَاقُ، وَلَيْسَ عَلَيْهِ فِيمَا فَعَلَ، بَعْدَ ذلِكَ، حِنْثٌ. إِنَّمَا الْحِنْثُ فِي ذلِكَ حِنْثٌ وَاحِدٌ. قَالَ مَالِكٌ : الْأَمْرُ عِنْدَنَا فِي نَذْرِ الْمَرْأَةِ، أَنَّهُ جَائِزٌ عَلَيْهَا بِغَيْرِ إِذْنِ زَوْجِهَا، يَجِبُ عَلَيْهَا ذلِكَ، وَيَثْبُتُ إِذَا كَانَ ذلِكَ فِي جَسَدِهَا، وَكَانَ ذلِكَ لَا يَضُرُّ بِزَوْجِهَا. وَإِنْ كَانَ ذلِكَ يَضُرُّ بِزَوْجِهَا كَانَ ذلِكَ عَلَيْهَا حَتَّى تَقْضِيَهُ.

Yahya said, Malik related to us from Hisham ibn Hisham ibn Utba ibn Abi Waqqas from Abdullah ibn Nistas from Jabir ibn Abdullah al- Ansari that the Messenger of Allah ﷺ said, 'If someone swears a false oath near this mimbar of mine, he will take his seat in the fire.' "

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ حَلَفَ عَلَى مِنْبَرِي آثِمًا تَبَوَّأَ مَقْعَدَهُ مِنَ النَّارِ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلِ الَّذِي هُوَ خَيْرٌ»

the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينً فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»

[AI] The Prophet ﷺ, when he used to swear by an oath, he would not break it until the expiation for the oath was revealed. Then he ﷺ would say, "I do not swear by an oath and then see something better than it except that I fulfill the better one and compensate for my oath."

كَانَ رَسُولُ اللَّهِ ﷺ إِذَا حَلَفَ عَلَى يَمِينٍ لَمْ يَحْنَثْ حَتَّى نَزَلَتْ كَفَّارَةُ الْيَمِينِ فَقَالَ ﷺ «لَا أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا أَتَيْتُ الَّذِي هُوَ خَيْرٌ وَكَفَّرْتُ عَنْ يَمِينِي»

the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)

قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»

[AI] On the authority of the Prophet, ﷺ , he said, "Whoever swears an oath on his right hand, and then sees something better than it, should fulfill it, as it serves as its expiation, except in the case of divorce or freeing a slave."

عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِهَا فَإِنَّهَا كَفَّارَتُهَا إِلَّا طَلَاقٍ أَوْ عَتَاقٍ»

[AI] I heard the Messenger of Allah ﷺ saying, "Whoever takes an oath and then sees something better than it, let him do that which is better and atone for his oath."

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَرْكَبْ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»

[AI] I heard the Messenger of Allah ﷺ say: "Whoever takes an oath and sees something better than it, he should do what is better and break his oath."

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ مَا أَعْطَيْتُكَ»

[AI] The Messenger of Allah ﷺ said, "Whoever swears an oath and then sees something better than it, should leave it and do what is better."

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَتْرُكْهَا وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ»

When anyone amongst you takes an oath, but he finds (something) better than that he should expiate (the breaking of the oath), and do that which is better. (Using translation from Muslim 1651c)

قَالَ رَسُولُ اللهِ ﷺ «إِذَا حَلَفَ أَحَدُكُمْ عَلَى شَيْءٍ فَرَأَى خَيْرًا مِنْهَا فَلْيُكَفِّرْهَا وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ»

[AI] The Messenger of Allah ﷺ said, "Whoever swears an oath and then sees something better than it, let him break his oath and do what is better, and he will be expiated for his oath."

قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَدَعْ يَمِينَهُ وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»

"There is nothing on Earth that I swear an oath upon, and I see that something else is better, but I do that which is better." (Using translation from Nasāʾī 3779)

عَنِ النَّبِيِّ ﷺ قَالَ «مَا عَلَى الْأَرْضِ يَمِينٌ أَحْلِفُ عَلَيْهَا فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا أَتَيْتُهُ»
