20. Vows and Oaths
٢٠۔ كتاب النذور والأيمان
That the Messenger of Allah ﷺ said: "There is no vowing for disobedience, and its atonement is the atonement of an oath."
قَالَ رَسُولُ اللَّهِ ﷺ لاَ نَذْرَ فِي مَعْصِيَةٍ وَكَفَّارَتُهُ كَفَّارَةُ يَمِينٍ قَالَ وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ وَجَابِرٍ وَعِمْرَانَ بْنِ حُصَيْنٍ
That the Prophet ﷺ said: "There is no vowing in disobedience to Allah, and its atonement is the atonement of an oath."
عَنِ النَّبِيِّ ﷺ قَالَ لاَ نَذْرَ فِي مَعْصِيَةِ اللَّهِ وَكَفَّارَتُهُ كَفَّارَةُ يَمِينٍ
20.2 Whoever Vows To Obey Allah, Then He Should Obey Him
٢٠۔٢ باب مَنْ نَذَرَ أَنْ يُطِيعَ اللَّهَ فَلْيُطِعْهُ
That the Prophet ﷺ said: "Whoever vowed to obey Allah, then he should obey Him. And whoever vowed to disobey Allah, then he should not disobey Him."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ نَذَرَ أَنْ يُطِيعَ اللَّهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللَّهَ فَلاَ يَعْصِهِ
عَنِ النَّبِيِّ ﷺ نَحْوَهُ
20.3 What Has Been Related About There Is No Vowing In That Over Which The Son Of Adam Has No Control
٢٠۔٣ باب مَا جَاءَ لاَ نَذْرَ فِيمَا لاَ يَمْلِكُ ابْنُ آدَمَ
That the Prophet ﷺ said: "It is not for a person to vow about that over which he has no control."
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ عَلَى الْعَبْدِ نَذْرٌ فِيمَا لاَ يَمْلِكُ قَالَ وَفِي الْبَابِ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو وَعِمْرَانَ بْنِ حُصَيْنٍ
20.4 What Has Been Related About Atonement For A Vow When It Was Not Specified
٢٠۔٤ باب مَا جَاءَ فِي كَفَّارَةِ النَّذْرِ إِذَا لَمْ يُسَمَّ
That the Messenger of Allah ﷺ said: "The atonement of a vow when it is not specified is the atonement of an oath."
قَالَ رَسُولُ اللَّهِ ﷺ كَفَّارَةُ النَّذْرِ إِذَا لَمْ يُسَمَّ كَفَّارَةُ يَمِينٍ
20.5 What Has Been Related About Whoever Takes An Oath And Then Sees That Something Else Is Better Than It
٢٠۔٥ باب مَا جَاءَ فِيمَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا
That the Messenger of Allah ﷺ said: "O 'Abdur-Rahman! Do not ask for a position of leadership, for if you receive it due to asking, you will be left alone with it, and if you receive it without asking, then you will be aided in it. And if you take an oath and you see that something else is better than it, then do what is better, and make an atonement for your oath."
قَالَ رَسُولُ اللَّهِ ﷺ يَا عَبْدَ الرَّحْمَنِ لاَ تَسْأَلِ الإِمَارَةَ فَإِنَّكَ إِنْ أَتَتْكَ عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا وَإِنْ أَتَتْكَ عَنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا وَإِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَائْتِ الَّذِي هُوَ خَيْرٌ وَلْتُكَفِّرْ عَنْ يَمِينِكَ وَفِي الْبَابِ عَنْ عَلِيٍّ وَجَابِرٍ وَعَدِيِّ بْنِ حَاتِمٍ وَأَبِي الدَّرْدَاءِ وَأَنَسٍ وَعَائِشَةَ وَعَبْدِ اللَّهِ بْنِ عَمْرٍو وَأَبِي هُرَيْرَةَ وَأُمِّ سَلَمَةَ وَأَبِي مُوسَى
20.6 What Has Been Related About The Atonement Before The Violation
٢٠۔٦ باب مَا جَاءَ فِي الْكَفَّارَةِ قَبْلَ الْحِنْثِ
That the Prophet ﷺ said: "Whoever takes an oath, and then he sees that something else is better than it, then he should make atonement for his oath and then do it."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلْ قَالَ وَفِي الْبَابِ عَنْ أُمِّ سَلَمَةَ
20.7 What Has Been Related About Making Exceptions In Oath
٢٠۔٧ باب مَا جَاءَ فِي الاِسْتِثْنَاءِ فِي الْيَمِينِ
That the Messenger of Allah ﷺ said: "Whoever swears about an oath and says: 'If Allah wills (Insha Allah), then there is no breaking of the oath against him."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَقَالَ إِنْ شَاءَ اللَّهُ فَقَدِ اسْتَثْنَى فَلاَ حِنْثَ عَلَيْهِ قَالَ وَفِي الْبَابِ عَنْ أَبِي هُرَيْرَةَ
That the Messenger of Allah ﷺ said: "Whoever swears [about an oath] and says: 'If Allah wills (Insha Allah), then he will not have broken it."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَقَالَ إِنْ شَاءَ اللَّهُ لَمْ يَحْنَثْ
20.8 What Has Been Related About It being Disliked To Swear By Other Than Allah
٢٠۔٨ باب مَا جَاءَ فِي كَرَاهِيَةِ الْحَلِفِ بِغَيْرِ اللَّهِ
From his father (Ibn 'Umar) that the Prophet ﷺ heard 'Umar saying: "By my father, By my father!" So he said: "Verily Allah prohibits you from swearing by your father." So 'Umar said: "By Allah I did not swear by him after that, neither intentionally nor in narrating."
سَمِعَ النَّبِيُّ ﷺ عُمَرَ وَهُوَ يَقُولُ وَأَبِي وَأَبِي فَقَالَ أَلاَ إِنَّ اللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ فَقَالَ عُمَرُ فَوَاللَّهِ مَا حَلَفْتُ بِهِ بَعْدَ ذَلِكَ ذَاكِرًا وَلاَ آثِرًا قَالَ وَفِي الْبَابِ عَنْ ثَابِتِ بْنِ الضَّحَّاكِ وَابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ وَقُتَيْلَةَ وَعَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ
That the Messenger of Allah ﷺ came across 'Umar while he was on his mount, and he was swearing by his father. So the Messenger of Allah ﷺ said: "Verily Allah prohibits you from swearing by your fathers. So let the one who swears, swear by Allah, or be silent."
أَنَّ رَسُولَ اللَّهِ ﷺ أَدْرَكَ عُمَرَ وَهُوَ فِي رَكْبٍ وَهُوَ يَحْلِفُ بِأَبِيهِ فَقَالَ رَسُولُ اللَّهِ ﷺ إِنَّ اللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ لِيَحْلِفْ حَالِفٌ بِاللَّهِ أَوْ لِيَسْكُتْ
That Ibn 'Umar heard a man saying: "No by the Ka'bah" so Ibn 'Umar said: "Nothing is sworn by other than Allah, for I heard the Messenger of Allah ﷺ say: 'Whoever swears by other than Allah, he has committed disbelief or shirk.'"
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ مَنْ حَلَفَ بِغَيْرِ اللَّهِ فَقَدْ كَفَرَ أَوْ أَشْرَكَ
20.9 What Has been Related About One Who Takes An Oath To Walk And He Is Not Able To
٢٠۔٩ باب مَا جَاءَ فِيمَنْ يَحْلِفُ بِالْمَشْىِ وَلاَ يَسْتَطِيعُ
"A Woman vowed to walk to the House of Allah, so the Prophet ﷺ asked about that, and he said: 'Verily Allah is in no need of her walking, order her to ride.'"
أَنْ تَمْشِيَ إِلَى بَيْتِ اللَّهِ فَسُئِلَ نَبِيُّ اللَّهِ ﷺ عَنْ ذَلِكَ فَقَالَ إِنَّ اللَّهَ لَغَنِيٌّ عَنْ مَشْيِهَا مُرُوهَا فَلْتَرْكَبْ قَالَ وَفِي الْبَابِ عَنْ أَبِي هُرَيْرَةَ وَعُقْبَةَ بْنِ عَامِرٍ وَابْنِ عَبَّاسٍ
"The Prophet ﷺ passed by old man walking (while supported) between his two sons, so he said: 'What is the matter with this one?' They said: "O Messenger of Allah! He vowed to walk.' He said: 'Verily Allah [the Mighty and Sublime] is in no need of this person punishing himself.'" He said: "So he ordered him to ride."
مَرَّ النَّبِيُّ ﷺ بِشَيْخٍ كَبِيرٍ يَتَهَادَى بَيْنَ ابْنَيْهِ فَقَالَ مَا بَالُ هَذَا قَالُوا يَا رَسُولَ اللَّهِ نَذَرَ أَنْ يَمْشِيَ قَالَ إِنَّ اللَّهَ ﷻ لَغَنِيٌّ عَنْ تَعْذِيبِ هَذَا نَفْسَهُ قَالَ فَأَمَرَهُ أَنْ يَرْكَبَ
Another Chain from Anas that the Messenger of Allah ﷺ saw a man, and he mentioned similarly.
أَنَّ رَسُولَ اللَّهِ ﷺ رَأَى رَجُلاً فَذَكَرَ نَحْوَهُ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ
20.10 About Vows Being Disliked
٢٠۔١٠ باب فِي كَرَاهِيَةِ النَّذْرِ
That the Messenger of Allah ﷺ said: "Do not vow, for the vows does not prevent what is decreed at all, and it only causes the miser to spend (of his wealth)."
قَالَ رَسُولُ اللَّهِ ﷺ لاَ تَنْذِرُوا فَإِنَّ النَّذْرَ لاَ يُغْنِي مِنَ الْقَدَرِ شَيْئًا وَإِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الْبَخِيلِ قَالَ وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ
20.11 What Has Been Related About Fulfilling Vows
٢٠۔١١ باب مَا جَاءَ فِي وَفَاءِ النَّذْرِ
"I said:'O Messenger of Allah! I had vowed to perform I'tikaf in Al-Masjid Al-Haram for a night during the era of Jahiliyyah.' He said: 'Fulfill your vow.''"
قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي كُنْتُ نَذَرْتُ أَنْ أَعْتَكِفَ لَيْلَةً فِي الْمَسْجِدِ الْحَرَامِ فِي الْجَاهِلِيَّةِ قَالَ أَوْفِ بِنَذْرِكَ قَالَ وَفِي الْبَابِ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو وَابْنِ عَبَّاسٍ
20.12 What Has Been Related About How The Prophet ﷺ Would Swear
٢٠۔١٢ باب مَا جَاءَ كَيْفَ كَانَ يَمِينُ النَّبِيِّ ﷺ
From this father (Ibn Umar) who said: "The Messenger of Allah ﷺ often would swear with this oath: 'No! By the Changer of the Hearts.'"
كَثِيرًا مَا كَانَ رَسُولُ اللَّهِ ﷺ يَحْلِفُ بِهَذِهِ الْيَمِينِ لاَ وَمُقَلِّبِ الْقُلُوبِ
20.13 What Has Been Related About The Reward For Freeing A Slave
٢٠۔١٣ باب مَا جَاءَ فِي ثَوَابِ مَنْ أَعْتَقَ رَقَبَةً
"I heard the Messenger of Allah ﷺ saying: 'Whoever frees a believing slave, then Allah frees a limb from the Fire for each of his limbs, such that he frees his private parts in lieu of his private parts.'"
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ مَنْ أَعْتَقَ رَقَبَةً مُؤْمِنَةً أَعْتَقَ اللَّهُ مِنْهُ بِكُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنَ النَّارِ حَتَّى يُعْتِقَ فَرْجَهُ بِفَرْجِهِ قَالَ وَفِي الْبَابِ عَنْ عَائِشَةَ وَعَمْرِو بْنِ عَبَسَةَ وَابْنِ عَبَّاسٍ وَوَاثِلَةَ بْنِ الأَسْقَعِ وَأَبِي أُمَامَةَ وَعُقْبَةَ بْنِ عَامِرٍ وَكَعْبِ بْنِ مُرَّةَ
20.14 What Has Been Related About A Man Who Slaps His Servant
٢٠۔١٤ باب مَا جَاءَ فِي الرَّجُلِ يَلْطِمُ خَادِمَهُ
"We were seven brothers without a servant except one, and one of us slapped her, so the Prophet ﷺ ordered us to free her."
لَقَدْ رَأَيْتُنَا سَبْعَةَ إِخْوَةٍ مَا لَنَا خَادِمٌ إِلاَّ وَاحِدَةٌ فَلَطَمَهَا أَحَدُنَا فَأَمَرَنَا النَّبِيُّ ﷺ أَنْ نُعْتِقَهَا قَالَ وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ
20.15 What Has Been Related About It Being Disliked To Swear By A Religion Other Than Islam
٢٠۔١٥ باب مَا جَاءَ فِي كَرَاهِيَةِ الْحَلِفِ بِغَيْرِ مِلَّةِ الإِسْلاَمِ
That the Messenger of Allah ﷺ said: "Whoever swears by a religion other than Islam while lying, then he is as he said."
قَالَ رَسُولُ اللَّهِ ﷺ مَنْ حَلَفَ بِمِلَّةٍ غَيْرِ الإِسْلاَمِ كَاذِبًا فَهُوَ كَمَا قَالَ
20.16 What Has Been Related About One Who Vows To Perform Hajj By Walking
٢٠۔١٦ باب
"I said: 'O Messenger of Allah! My sister vowed that she would walk to the House barefoot and without Khimar (covering).' The Prophet ﷺ said: 'Verily Allah will not do anything with the misery of your sister. She should ride, and cover, and fast three days.'"
قُلْتُ يَا رَسُولَ اللَّهِ إِنَّ أُخْتِي نَذَرَتْ أَنْ تَمْشِيَ إِلَى الْبَيْتِ حَافِيَةً غَيْرَ مُخْتَمِرَةٍ فَقَالَ النَّبِيُّ ﷺ إِنَّ اللَّهَ لاَ يَصْنَعُ بِشَقَاءِ أُخْتِكَ شَيْئًا فَلْتَرْكَبْ وَلْتَخْتَمِرْ وَلْتَصُمْ ثَلاَثَةَ أَيَّامٍ قَالَ وَفِي الْبَابِ عَنِ ابْنِ عَبَّاسٍ
20.17 The Mention Of What Eliminates Swearing By Al-Lat and Al-'Uza
٢٠۔١٧ باب
That the Messenger of Allah ﷺ said: "Whoever among you swears, saying in his oath: 'By Al-Lat! By Al-'Uzza!' Then let him say 'La ilaha illa Allah' And whoever says: 'Come let me gamble with you!' Then let him give in charity."
قَالَ رَسُولُ اللَّهِ ﷺ مَنْ حَلَفَ مِنْكُمْ فَقَالَ فِي حَلِفِهِ وَاللاَّتِ وَالْعُزَّى فَلْيَقُلْ لاَ إِلَهَ إِلاَّ اللَّهُ وَمَنْ قَالَ تَعَالَ أُقَامِرْكَ فَلْيَتَصَدَّقْ
20.18 What Has Been Related About Fulfilling The Vow Of The Deceased
٢٠۔١٨ باب مَا جَاءَ فِي قَضَاءِ النَّذْرِ عَنِ الْمَيِّتِ
That Sa'd bin 'Ubadah asked the Messenger of Allah ﷺ about a vow that was due from his mother, who died before fulfilling it. The Prophet ﷺ said: "Fulfill it for her."
أَنَّ سَعْدَ بْنَ عُبَادَةَ اسْتَفْتَى رَسُولَ اللَّهِ ﷺ فِي نَذْرٍ كَانَ عَلَى أُمِّهِ تُوُفِّيَتْ قَبْلَ أَنْ تَقْضِيَهُ فَقَالَ النَّبِيُّ ﷺ اقْضِهِ عَنْهَا
20.19 What Has Been Related About The Virtue Of Freeing Slaves
٢٠۔١٩ باب مَا جَاءَ فِي فَضْلِ مَنْ أَعْتَقَ
"Any Muslim man who frees a Muslim man, then it is his salvation from the Fire - each of his limbs suffices for a limb of himself. And any Muslim man that frees two Muslim women, then are his salvation from the Fire - each of their limbs suffices for a limb of himself. And any Muslim woman that frees a Muslim woman, then she is her salvation from the Fire - each of her limb suffices for a limb of herself."
عَنْ أَبِي أُمَامَةَ وَغَيْرِهِ مِنْ أَصْحَابِ النَّبِيِّ ﷺ عَنْ النَّبِيِّ ﷺ قَالَ أَيُّمَا امْرِئٍ مُسْلِمٍ أَعْتَقَ امْرَأً مُسْلِمًا كَانَ فَكَاكَهُ مِنْ النَّارِ يُجْزِي كُلُّ عُضْوٍ مِنْهُ عُضْوًا مِنْهُ وَأَيُّمَا امْرِئٍ مُسْلِمٍ أَعْتَقَ امْرَأَتَيْنِ مُسْلِمَتَيْنِ كَانَتَا فَكَاكَهُ مِنْ النَّارِ يُجْزِي كُلُّ عُضْوٍ مِنْهُمَا عُضْوًا مِنْهُ وَأَيُّمَا امْرَأَةٍ مُسْلِمَةٍ أَعْتَقَتْ امْرَأَةً مُسْلِمَةً كَانَتْ فَكَاكَهَا مِنْ النَّارِ يُجْزِي كُلُّ عُضْوٍ مِنْهَا عُضْوًا مِنْهَا
