The Prophet ﷺ said: “If a maid-servant commits adultery and it is proven, then let him (the master) flog her and not reproach her. Then if she commits adultery again, let him flog her and not reproach her. Then if she commits adultery a third time, let him sell her, even if only for a rope made of hair.”

قَالَ النَّبِيُّ ﷺ: «إِذَا زَنَتِ الأَمَةُ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ».

Messenger of Allah ﷺ was asked about the slave-girl, if she was a virgin and committed illegal sexual intercourse. The Prophet ﷺ said, "If she committed illegal sexual intercourse, lash her, and if she did it a second time, then lash her again, and if she repeated the third time, then sell her even for a hair rope." Ibn Shihab said, "I don't know whether to sell her after the third or fourth offense."

أَنَّ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنِ الأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ قَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لاَ أَدْرِي بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ

that Messenger of Allah ﷺ was asked about an unmarried slave-girl who committed illegal sexual intercourse. They heard him saying, "Flog her, and if she commits illegal sexual intercourse after that, flog her again, and on the third (or the fourth) offense, sell her."

أَخْبَرَهُ أَنَّ زَيْدَ بْنَ خَالِدٍ وَأَبَا هُرَيْرَةَ ؓ أَخْبَرَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللَّهِ ﷺ يُسْأَلُ عَنِ الأَمَةِ تَزْنِي وَلَمْ تُحْصَنْ قَالَ اجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ

I heard the Prophet ﷺ saying, "If a slave-girl of yours commits illegal sexual intercourse and her illegal sexual intercourse is proved, she should be lashed, and after that nobody should blame her, and if she commits illegal sexual intercourse the second time, she should be lashed and nobody should blame her after that, and if she does the offense for the third time and her illegal sexual intercourse is proved, she should be sold even for a hair rope."

سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلاَ يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلاَ يُثَرِّبْ ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ

The Prophet ﷺ said, "If a slave-girl (Ama) commits illegal sexual intercourse, scourge her; if she does it again, scourge her again; if she repeats it, scourge her again." The narrator added that on the third or the fourth offense, the Prophet ﷺ said, "Sell her even for a hair rope."

عَنِ النَّبِيِّ ﷺ قَالَ إِذَا زَنَتِ الأَمَةُ فَاجْلِدُوهَا ثُمَّ إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِذَا زَنَتْ فَاجْلِدُوهَا فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ بِيعُوهَا وَلَوْ بِضَفِيرٍ

The verdict of Messenger of Allah ﷺ was sought about an unmarried slave girl guilty of illegal intercourse. He replied, "If she commits illegal sexual intercourse, then flog her (fifty stripes), and if she commits illegal sexual intercourse (after that for the second time), then flog her (fifty stripes), and if she commits illegal sexual intercourse (for the third time), then flog her (fifty stripes) and sell her for even a hair rope." Ibn Shihab said, "I am not sure whether the Prophet ﷺ ordered that she be sold after the third or fourth time of committing illegal intercourse."

أَنَّ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنِ الأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ قَالَ إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لاَ أَدْرِي بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ

The Prophet ﷺ said: "If a slave woman commits unlawful sexual intercourse and her act is established, let him flog her and not reproach her. Then if she commits it again, let him flog her and not reproach her. Then if she commits it a third time, let him sell her, even for a rope made of hair."

قَالَ النَّبِيُّ ﷺ: «إِذَا زَنَتِ الأَمَةُ فَتَبَيَّنَ زِنَاهَا، فَلْيَجْلِدْهَا وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ».

When the slave-woman of any of you commits adultery and this (offence of hers) becomes clear, she should be flogged (as the prescribed) punishment, but hurl no reproach at her. If she commits adultery again, she should (again be punished) by flogging, but hurl no reproach upon her. If she commits fornication for the third time and it becomes clear, then he should sell her, even if only for a rope of hair.

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلاَ يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلاَ يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ

If she commits adultery, then flog her and if she commits adultery again, then flog her and then sell her even for a rope. Ibn Shihab said: I do not know whether he said this (his statement pertaining to the sale of slave-woman) at the third or the fourth time. Ibn Shihab said that the word dafir (used in the text) means rope.

The Messenger of Allah ﷺ was asked about a slave-woman who commits fornication, and she is not married: If she commits fornication, flog her: if she commits fornication again flog her; if only for a rope of hair (dafir). Ibn Shihab: I do not know whether he (the Prophet) said it is a third or a fourth time.

When the slave-woman of any of you commits fornication, he should inflict the prescribed punishment on her, but not hurl reproaches at her. This is to be done up to three times. If she a fourth time, he should flog her, and sell her even if only for a rope of hair.

عَنِ النَّبِيِّ ﷺ قَالَ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَحُدَّهَا وَلاَ يُعَيِّرْهَا ثَلاَثَ مِرَارٍ فَإِنْ عَادَتْ فِي الرَّابِعَةِ فَلْيَجْلِدْهَا وَلْيَبِعْهَا بِضَفِيرٍ أَوْ بِحَبْلٍ مِنْ شَعْرٍ

“We were with the Prophet ﷺ and a man asked him about a slave woman who commits fornication (again), whip her, even if that is for a rope of hair.' ”

عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَسَأَلَهُ رَجُلٌ عَنِ الأَمَةِ تَزْنِي قَبْلَ أَنْ تُحْصَنَ فَقَالَ اجْلِدْهَا فَإِنْ زَنَتْ فَاجْلِدْهَا فَإِنْ زَنَتْ فَاجْلِدْهَا ثُمَّ قَالَ فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ فَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ

“If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.”

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ إِذَا زَنَتِ الأَمَةُ فَاجْلِدُوهَا فَإِنْ زَنَتْ فَاجْلِدُوهَا فَإِنْ زَنَتْ فَاجْلِدُوهَا فَإِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ وَالضَّفِيرُ الْحَبْلُ

[AI] "The Prophet ﷺ was asked about a slave woman who commits adultery but is not married. He said, 'If she commits adultery, then flog her, and if she commits adultery again, then flog her.' He said, 'I do not know about the third or fourth time, sell her, even if it is for a lock of hair.'"

أَنَّ النَّبِيَّ ﷺ سُئِلَ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصَنْ فَقَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا قَالَ فَمَا أَدْرِي فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ «فَبِيعُوهَا وَلَوْ بِضَفِيرٍ»

[AI] "Regarding the Prophet ﷺ , if the slave woman of one of you commits fornication, and her fornication is proven, then she should be flogged with the punishment. However, he should not accuse her or shame her in the third or fourth pregnancy, but rather he should sell her even if it is for a strand of hair."

عَنِ النَّبِيِّ ﷺ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ قَالَ سُفْيَانُ لَا يُثَرِّبْ عَلَيْهَا لَا يُعَيِّرْهَا عَلَيْهَا فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ فَلْيَبِعْهَا وَلَوْ بِضَفِيرٍ

[AI] "The Messenger of Allah ﷺ said, 'If any of your female slaves commit adultery, then whip them but do not disgrace them. If they do it again, whip them but do not disgrace them. If they repeat it for the third time, then sell them, even if it is with a rope made of hair or a braid made of hair.'"

أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا وَلَا يُعَيِّرْهَا فَإِنْ عَادَتْ فَلْيَجْلِدْهَا وَلَا يُعَيِّرْهَا فَإِنْ عَادَتْ فَلْيَجْلِدْهَا وَلَا يُعَيِّرْهَا فَإِنْ عَادَتْ فِي الرَّابِعَةِ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ أَوْ ضَفِيرٍ مِنْ شَعَرٍ

[AI] He informed him that the Prophet ﷺ said regarding the slave girl: If she commits adultery, then flog her. If she commits adultery again, then flog her. If she commits adultery again, then flog her. If she commits adultery again, then sell her, even if it is for a rope.

أَخْبَرَهُ أَنَّ النَّبِيَّ ﷺ قَالَلِلْوَلِيدَةِ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ وَالضَّفِيرُ الْحَبْلُ

“If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.” (Using translation from Ibn Mājah 2566)

Malik related to me from Ibn Shihab from Ubaydullah ibn Abdullah ibn Utba ibn Masud from Abu Hurayra and Zayd ibn Khalid al-Juhani that the Messenger of Allah ﷺ was asked about a slave-girl who committed fornication and was not muhsana. He said, "If she commits fornication, then flog her. If she commits fornication again, then flog her, and if she commits fornication again, then sell her, if only for a rope." Ibn Shihab added, "I don't know whether it was three or four times."

قَالَ قَالَ رَسُول اللهِ ﷺ إذا زنت أمة أحدكم فليجلدها ثُمَّ إن زنت فليبيعها ولو بضفير وهذا الحديث يرويه الثقات عَن الزُّهْرِيّ عن عُبَيد الله عَن أبي هُرَيرة وزيد بن خالد

عَن النَّبِيّ ﷺ قال إذا زنت أمة أحدكم فليجلدها ثُمَّ إن زنت فليجلدها ثُمَّ إن زنت فليبعها ولو بضفير

قَالَ قَالَ رَسُول اللهِ ﷺ إذا زنت أمة أحدكم فليجلدها وإذا زنت فليجلدها ثلاثًا ثُمَّ بيعوها ولو بحبل

عَن النَّبِيّ ﷺ قال إذا زنت أمة أحدكم فليجلدها ثُمَّ إن زنت فليبعها ولو بضفير عبد الرحمن بن وردان عن الْمَقْبُرِيّ عَن أبي هُرَيرة

قَالَ قَالَ رَسُول اللهِ ﷺ إذا زنت أمة أحدكم فليجلدها ثُمَّ إن زنت فليجلدها ثُمَّ إن زنت فليبعها ولو بضفير وَهَذَا الْحَدِيثُ لا نَعْلَمُ رَوَاهُ عَنْ سُفيان عَن حبيب عَن أبي صالح عَن أبي هُرَيرة إلاَّ معاوية بن هشام

عَنِ النَّبِيِّ ﷺ قال إذا زنت أمة أحدكم فليجلدها ثم إن زنت فليجلدها ثم إن زنت في الثالثة أو الرابعة فليبعها ولو بضفير وهذا الحديثُ لاَ نَعْلَمُ رَوَاهُ عن مُجاهد عن أبي هريرة ؓ إلا أبو يحيى القتات ولا عن أبي يحيى إلا كامل وقد روي عن أبي هريرة ؓ من وجوه

[AI] Abu Huraira and Zaid ibn Khalid Al-Juhani said: The Messenger of Allah ﷺ was asked about the slave woman who is not chaste. He said, "If she commits adultery, then flog her. But if she repeats it for the third or fourth time, Al-Zuhri doubts her, so sell her, even if it is for a strand of hair."

عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ قَالَا سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الْأَمَةِ الَّتِي لَمْ تُحْصَنْ فَقَالَ «إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِذَا زَنَتْ فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ شَكَّ الزُّهْرِيُّ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ»

[AI] The Messenger of Allah ﷺ said, "If one of your female slaves commits adultery, let them be lashed. If they commit adultery again, let them be lashed. If they commit adultery a third time, let them be lashed. If they commit adultery a fourth time, sell them, even if it is for a strand of hair."

قَالَ رَسُولُ اللهِ ﷺ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا فَإِنْ عَادَتْ فَلْيَجْلِدْهَا فَإِنْ عَادَتْ فَلْيَجْلِدْهَا فَإِنْ عَادَتِ الرَّابِعَةَ فَلْيَبِعْهَا وَلَوْ بِضَفِيرِ شَعَرٍ»

[AI] "He informed him that Abu Hurairah and Zaid ibn Khalid al-Juhani informed him that they heard the Messenger of Allah, ﷺ , asking about a slave woman who commits adultery while unmarried. He said, 'Give her lashes if she commits adultery, then if she commits adultery again, give her lashes, then sell her even if it is with a lock of hair' on the third or fourth offense."

أَخْبَرَهُ أَنَّ أَبَا هُرَيْرَةَ وَزَيْدَ بْنَ خَالِدٍ الْجُهَنِيَّ أَخْبَرَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ وَهُوَ يَسْأَلُ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصَنْ؟ قَالَ «اجْلِدُوهَا إِنْ زَنَتْ ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ

[AI] The Messenger of Allah ﷺ said, "If a slave woman of any of you commits adultery, then he should flog her, and if she commits adultery again, then he should flog her, and if she commits adultery again, then he should flog her, and if she commits adultery again, then he should sell her even for a rope."

قَالَ رَسُولُ اللهِ ﷺ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا ثُمَّ إِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِضَفِيرٍ»

[AI] The Prophet ﷺ said, "If a slave woman commits fornication, flog her. If she commits fornication again, flog her. If she commits fornication a third time, flog her. Then sell her, even if it is with a strand of hair." Abu 'Abd al-Rahman said that Abu Uwais is weak, and his son Isma'il is even weaker than him.

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَبُو أُوَيْسٍ ضَعِيفٌ وَإِسْمَاعِيلُ ابْنُهُ أَضْعَفُ مِنْهُ

[AI] The Prophet ﷺ said, "If any of your female slaves commit adultery, flog them. If they commit adultery again, flog them. If they commit adultery a third time, flog them. And if they commit adultery again, then sell them, even if it is with a rope made of hair."

أَنَّ النَّبِيَّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»

I heard the Prophet ﷺ saying, "If a slave-girl of yours commits illegal sexual intercourse and her illegal sexual intercourse is proved, she should be lashed, and after that nobody should blame her, and if she commits illegal sexual intercourse the second time, she should be lashed and nobody should blame her after that, and if she does the offense for the third time and her illegal sexual intercourse is proved, she should be sold even for a hair rope." قَالَ رَسُولُ اللهِ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا وَإِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»

[AI] From the Prophet, ﷺ , he said, "If one of you's slave woman commits adultery, then he should punish her (by lashing), and not harm her. If she commits adultery again, then he should punish her (by lashing) again. And if she commits adultery again, then he should sell her, even if it is with a rope made of hair or braids made of hair."

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا وَلَا يُعَنِّفْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ أَوْ بِضَفِيرٍ مِنْ شَعْرٍ»

[AI] That the Prophet ﷺ said, "If the slave girl of one of you commits adultery, then he should flog her. If she commits adultery again, then he should flog her. And do not revile her, for if she commits adultery again, then he should sell her, even if it is for a strand of hair."

أَنَّ النَّبِيَّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ عَلَيْهَا فَإِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِضَفِيرٍ»

When the slave-woman of any of you commits adultery and this (offence of hers) becomes clear, she should be flogged (as the prescribed) punishment, but hurl no reproach at her. If she commits adultery again, she should (again be punished) by flogging, but hurl no reproach upon her. If she commits fornication for the third time and it becomes clear, then he should sell her, even if only for a rope of hair. (Using translation from Muslim 1703a)

قَالَ رَسُولُ اللهِ ﷺ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ عَلَيْهَا فَإِنْ عَادَتْ فَزَنَتْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ عَلَيْهَا فَإِنْ عَادَتْ فَزَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»

[AI] Abu Hurairah and Zaid bin Khalid reported that they heard the Messenger of Allah ﷺ being asked about what should be done with a slave woman if she commits adultery and does not repent. He replied, "Lash her, and if she commits adultery again, lash her. And if she commits adultery again, lash her. Then sell her, even if it is with a rope."

أَنَّ أَبَا هُرَيْرَةَ وَزِيدَ بْنَ خَالِدٍ حَدَّثَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ وَهُوَ يُسْأَلُ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ؟ قَالَ «اجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ وَالضَّفِيرُ الْحَبْلُ»

that Messenger of Allah ﷺ was asked about an unmarried slave-girl who committed illegal sexual intercourse. They heard him saying, "Flog her, and if she commits illegal sexual intercourse after that, flog her again, and on the third (or the fourth) offense, sell her." (Using translation from Bukhārī 2232)

The Messenger of Allah ﷺ was asked about a slave-woman who commits fornication, and she is not married: If she commits fornication, flog her: if she commits fornication again flog her; if only for a rope of hair (dafir). Ibn Shihab: I do not know whether he (the Prophet) said it is a third or a fourth time. (Using translation from Abū Dāʾūd 4469)

أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ؟ قَالَ «إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ» وَالضَّفِيرُ الْحَبْلُ

[AI] "The Prophet ﷺ was asked about a slave girl who commits adultery before she is married. He said, 'Flog her, and if she commits adultery again, flog her.' He also said regarding the fourth or third time, 'Sell her, even if it is for her hair.' Abu Abdul Rahman said, 'The correct narration is from Malik, and the mistake in this narration is from Shibil.'"

أَنَّ النَّبِيَّ ﷺ سُئِلَ عَنِ الْأَمَةِ تَزْنِي قَبْلَ أَنْ تُحْصِنَ قَالَ اجْلِدُوهَا فَإِنْ زَنَتْ فَاجْلِدُوهَا وَقَالَ فِي الرَّابِعَةِ أَوِ الثَّالِثَةِ بِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَالصَّوَابُ حَدِيثُ مَالِكٍ وَشِبْلٌ فِي هَذَا الْحَدِيثِ خَطَأٌ

[AI] He told him that the Messenger of Allah ﷺ said: "If the slave-girl commits illegal sexual intercourse, then flog her one hundred times, and do not let compassion move you to not flog her. Then if she commits illegal sexual intercourse again after that, flog her another hundred times and do not let compassion move you to not flog her. And yet if she commits illegal sexual intercourse for the third time, then flog her another hundred times and sell her even if only for a rope." And the "rope" is a "frayed one" in the third or fourth (lashing). And Zaid bin Khalid narrated to him (the same) from the Messenger of Allah ﷺ something similar to that.

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ وَأَخْبَرَهُ زَيْدُ بْنُ خَالِدٍ عَنْ رَسُولِ اللهِ ﷺ مِثْلَ ذَلِكَ

[AI] He informed him that the Messenger of Allah ﷺ said, "If the slavegirl commits adultery, then flog her, and if she commits adultery again, then flog her again, and if she commits adultery again, then sell her, even if it is for a rope." And the rope is in the third or fourth offense.

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ

“If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.” (Using translation from Ibn Mājah 2566)

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ

“If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.” (Using translation from Ibn Mājah 2566)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ

[AI] I heard the Messenger of Allah ﷺ say: "If the slave woman of any of you commits adultery, then let him ascertain her adultery, then let him lash her with one hundred lashes and let there be no compassion for her. If she commits adultery again, then let him lash her with one hundred lashes and there be no compassion for her. If she commits adultery for the third time, then let him ascertain her adultery, then let him sell her, even for a rope of hair."

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ

The Prophet ﷺ said, "If a slave-girl commits illegal sexual intercourse and it is proved beyond doubt, then her owner should lash her and should not blame her after the legal punishment. And then if she repeats the illegal sexual intercourse he should lash her again and should not blame her after the legal punishment, and if she commits it a third time, then he should sell her even for a hair rope." "إِذَا زَنَتْ أمةُ أحدكم، فتَبَّين زناها فليجلدْها الحدَّ، ولا يُثرِّب عليها، ثم إن زنت فليَجْلِدْهَا الحدِّ ولا يُثَرِّب عليها، ثم إن زَنَتْ الثالثَة فَليَبِعْهَا ولو بِحَبْلٍ من شَعْرٍ".
