The verdict of Messenger of Allah ﷺ was sought about an unmarried slave girl guilty of illegal intercourse. He replied, "If she commits illegal sexual intercourse, then flog her (fifty stripes), and if she commits illegal sexual intercourse (after that for the second time), then flog her (fifty stripes), and if she commits illegal sexual intercourse (for the third time), then flog her (fifty stripes) and sell her for even a hair rope." Ibn Shihab said, "I am not sure whether the Prophet ﷺ ordered that she be sold after the third or fourth time of committing illegal intercourse."

أَنَّ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنِ الأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ قَالَ إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لاَ أَدْرِي بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ

Messenger of Allah ﷺ was asked about the slave-girl, if she was a virgin and committed illegal sexual intercourse. The Prophet ﷺ said, "If she committed illegal sexual intercourse, lash her, and if she did it a second time, then lash her again, and if she repeated the third time, then sell her even for a hair rope." Ibn Shihab said, "I don't know whether to sell her after the third or fourth offense."

Malik related to me from Ibn Shihab from Ubaydullah ibn Abdullah ibn Utba ibn Masud from Abu Hurayra and Zayd ibn Khalid al-Juhani that the Messenger of Allah ﷺ was asked about a slave-girl who committed fornication and was not muhsana. He said, "If she commits fornication, then flog her. If she commits fornication again, then flog her, and if she commits fornication again, then sell her, if only for a rope." Ibn Shihab added, "I don't know whether it was three or four times."

[Machine] He informed him that the Prophet ﷺ said regarding the slave girl: If she commits adultery, then flog her. If she commits adultery again, then flog her. If she commits adultery again, then flog her. If she commits adultery again, then sell her, even if it is for a rope.

أَخْبَرَهُ أَنَّ النَّبِيَّ ﷺ قَالَلِلْوَلِيدَةِ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ وَالضَّفِيرُ الْحَبْلُ

“If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.” (Using translation from Ibn Mājah 2566)

[Machine] "The Prophet ﷺ was asked about a slave woman who commits adultery but is not married. He said, 'If she commits adultery, then flog her, and if she commits adultery again, then flog her.' He said, 'I do not know about the third or fourth time, sell her, even if it is for a lock of hair.'"

[Machine] Al-Qa'nabi narrated from Malik, and Abu Yazid al-Qaratissi narrated from Abdullah bin Abdul-Hakam, and Bakr bin Sahl narrated from Abdullah bin Yusuf, they all said: "I am Malik, from Ibn Shihab, from Ubaidullah bin Abdullah bin Utba bin Mas'ud, from Abu Hurairah and from Zaid bin Khalid al-Juhani, that the Messenger of Allah ﷺ was asked about slaves who commit illegal sexual intercourse but do not get married. He said, "If they commit illegal sexual intercourse, lash them.' 'Then if they commit illegal sexual intercourse (after that), lash them.' 'Then if they commit illegal sexual intercourse (after that), lash them.' 'Then if they commit illegal sexual intercourse (after that), sell them even for a rope of hair.' Ibn Shihab said, 'I do not know whether that was before or after the verse of Al-Qisas (i.e. the law of equality in punishment)." 'Adad' is the rope.

ثنا الْقَعْنَبِيُّ عَنْ مَالِكٍ ح وَحَدَّثَنَا أَبُو يَزِيدَ الْقَرَاطِيسِيُّ ثنا عَبْدُ اللهِ بْنُ عَبْدِ الْحَكَمِ ح وَحَدَّثَنَا بَكْرُ بْنُ سَهْلٍ ثنا عَبْدُ اللهِ بْنُ يُوسُفَ قَالَا أَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ عَنْ أَبِي هُرَيْرَةَ وَعَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ؟ فَقَالَ «إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» قَالَ ابْنُ شِهَابٍ «وَلَا أَدْرِي بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ وَالضَّفِيرُ هُوَ الْحَبْلُ»

[Machine] The Prophet ﷺ said, "If a slave woman commits fornication, flog her. If she commits fornication again, flog her. If she commits fornication a third time, flog her. Then sell her, even if it is with a strand of hair." Abu 'Abd al-Rahman said that Abu Uwais is weak, and his son Isma'il is even weaker than him.

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَبُو أُوَيْسٍ ضَعِيفٌ وَإِسْمَاعِيلُ ابْنُهُ أَضْعَفُ مِنْهُ

[Machine] Abu Hurairah and Zaid bin Khalid reported that they heard the Messenger of Allah ﷺ being asked about what should be done with a slave woman if she commits adultery and does not repent. He replied, "Lash her, and if she commits adultery again, lash her. And if she commits adultery again, lash her. Then sell her, even if it is with a rope."

أَنَّ أَبَا هُرَيْرَةَ وَزِيدَ بْنَ خَالِدٍ حَدَّثَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ وَهُوَ يُسْأَلُ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ؟ قَالَ «اجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ وَالضَّفِيرُ الْحَبْلُ»

that Messenger of Allah ﷺ was asked about an unmarried slave-girl who committed illegal sexual intercourse. They heard him saying, "Flog her, and if she commits illegal sexual intercourse after that, flog her again, and on the third (or the fourth) offense, sell her." (Using translation from Bukhārī 2232)

أَخْبَرَهُ أَنَّ أَبَا هُرَيْرَةَ وَزَيْدَ بْنَ خَالِدٍ أَخْبَرَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ وَهُوَ يُسْأَلُ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصِنْ قَالَ «اجْلِدُوهَا إِنْ زَنَتْ ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ»

[Machine] He told him that the Messenger of Allah ﷺ said: "If the slave-girl commits illegal sexual intercourse, then flog her one hundred times, and do not let compassion move you to not flog her. Then if she commits illegal sexual intercourse again after that, flog her another hundred times and do not let compassion move you to not flog her. And yet if she commits illegal sexual intercourse for the third time, then flog her another hundred times and sell her even if only for a rope." And the "rope" is a "frayed one" in the third or fourth (lashing). And Zaid bin Khalid narrated to him (the same) from the Messenger of Allah ﷺ something similar to that.

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ وَأَخْبَرَهُ زَيْدُ بْنُ خَالِدٍ عَنْ رَسُولِ اللهِ ﷺ مِثْلَ ذَلِكَ

[Machine] He informed him that the Messenger of Allah ﷺ said, "If the slavegirl commits adultery, then flog her, and if she commits adultery again, then flog her again, and if she commits adultery again, then sell her, even if it is for a rope." And the rope is in the third or fourth offense.

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ
