13. Book of Penalties
١٣۔ كِتَابُ الْحُدُودِ
ʿThe Pen has been lifted from three; from the sleeper until he wakes up, from the crazy - or insane- one until he comes back to his senses, and from the minor until he grows up.” (Using translation from Aḥmad 956)
عَنِ النَّبِيِّ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّغِيرِ حَتَّى يَحْتَلِمَ وَعَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ وَقَدْ قَالَ حَمَّادٌ أَيْضًا وَعَنِ الْمَعْتُوهِ حَتَّى يَعْقِلَ
13.2 [Machine] What is permissible to do with the blood of a Muslim?
١٣۔٢ بَابُ مَا يَحِلُّ بِهِ دَمُ الْمُسْلِمِ
Why would they kill me? I heard the Messenger of Allah ﷺ say: ʿIt is not permissible (to shed) the blood of a Muslim except in three cases: If a man disbelieves after becoming Muslim, or commits zina after being married or kills someone and is executed in retaliation.ʿ (Using translation from Aḥmad 509)
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلَّا بِإِحْدَى ثَلَاثٍ بِكُفْرٍ بَعْدَ إِيمَانٍ أَوْ بِزِنًى بَعْدَ إِحْصَانٍ أَوْ يَقْتُلُ نَفْسًا بِغَيْرِ نَفْسٍ فَيُقْتَلُ
The blood of a Muslim man who testifies that there is no god but Allah and that I am the Messenger of Allah should not be lawfully shed but only for one of three reasons: married fornicator, soul for soul, and one who deserts his religion separating himself from the community. قَالَ رَسُولُ اللَّهِ ﷺ لَا يَحِلُّ دَمُ رَجُلٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنِّي رَسُولُ اللَّهِ إِلَّا أَحَدَ ثَلَاثَةِ نَفَرٍ النَّفْسُ بِالنَّفْسِ وَالثَّيِّبُ الزَّانِي وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ
13.3 [Machine] The thief donates the stolen item after stealing it.
١٣۔٣ بَابُ السَّارِقِ تُوهَبُ مِنْهُ السَّرِقَةُ بَعْدَ مَا سَرَقَ
Safwan bin Umayyah was sleeping in the mosque, then a man came to him while he was also sleeping. He took his cloak from under his head and woke him up. Safwan caught up with him and took it back, then he went to the Prophet Muhammad ﷺ and said, "O Messenger of Allah, I was sleeping in the mosque and this man came to me and took my cloak from under my head. I caught up with him and took it back. He ordered for it to be cut, so Safwan said to him, "O Messenger of Allah, my cloak has not reached the point where it should be cut." He said, "Why didn't you accept it before bringing it to me?"
كَانَ صَفْوَانُ بْنُ أُمَيَّةَ نَائِمًا فِي الْمَسْجِدِ فَأَتَاهُ رَجُلٌ وَهُوَ نَائِمٌ فَاسْتَلَّ رِدَاءَهُ مِنْ تَحْتِ رَأْسِهِ فَتَنَبَّهَ بِهِ فَلَحِقَهُ فَأَخَذَهُ فَانْطَلَقَ بِهِ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ كُنْتُ نَائِمًا فِي الْمَسْجِدِ فَأَتَانِي هَذَا فَاسْتَلَّ رِدَائِي مِنْ تَحْتِ رَأْسِي فَلَحِقْتُهُ فَأَخَذْتُهُ فَأَمَرَ بِقَطْعِهِ فَقَالَ لَهُ صَفْوَانُ يَا رَسُولَ اللَّهِ إِنَّ رِدَائِي لَمْ يَبْلُغْ أَنْ يُقْطَعَ فِيهِ هَذَا قَالَ «فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ؟»
13.4 [Machine] What is not cut off by the hand?
١٣۔٤ بَابُ مَا تُقْطَعُ فِيهِ الْيَدُ
"The Messenger of Allah used to cut off the (thief's) hand for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4932)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «تُقْطَعُ الْيَدُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
“The Prophet ﷺ cut off (the hand of a thief) for a shield worth three Dirham.” (Using translation from Ibn Mājah 2584)
«قَطَعَ رَسُولُ اللَّهِ ﷺ فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ»
13.5 [Machine] Intercession in boundaries without authority.
١٣۔٥ بَابُ الشَّفَاعَةِ فِي الْحُدُودِ دُونَ السُّلْطَانِ
The Quraish were anxious about the Makhzumi woman who had committed theft, They said : Who will speak to the Messenger of Allah ﷺ about her ? Then they said: Who will be bold enough for it but Uasmah bin Zaid, the prophet’s ﷺ friend! So Usamah spoke to him, and the Messenger of Allah ﷺ said : Are you interceding regarding one of the punishments prescribed by Allah ? He then got up and gave an address, saying : What destroyed your predecessors was just that when a person of rank among them committed a theft, They left him alone , and when a weak one of them committed a theft, they inflicted the prescribed punishment on him . I swear by Allah that if Fatimah daughter of Muhammad should steal, I would have her hand cut off. (Using translation from Abū Dāʾūd 4373)
شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ ﷺ قَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ ﷺ فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ثُمَّ قَامَ فَاخْتَطَبَ» فَقَالَ «إِنَّمَا هَلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا»
13.6 [Machine] Recognizing Theft
١٣۔٦ بَابُ الْمُعْتَرِفِ بِالسَّرِقَةِ
a thief who confused to a crime but with whom no stolen goods has been found, was brought to the Messenger of Allah. The Messenger of Allah said to him: "I do not think that you stole anything."He He said: "Yes I did." He said: "Take him and cut off his hands, then bring him here, "So they cut off his hand then they brought him to him. He said to him; "Say: I seek the forgiveness of Allah and I repent to Him." He said: "I seek the forgiveness of Allah and I repent to Him." He said:: "O Allah, accept his repentance."(Daif) (Using translation from Nasāʾī 4877)
أَنَّ رَسُولَ اللَّهِ ﷺ أُتِيَ بِسَارِقٍ اعْتَرَفَ اعْتِرَافًا لَمْ يُوجَدْ مَعَهُ مَتَاعٌ فَقَالَ «مَا إِخَالُكَ سَرَقْتَ؟» قَالَ بَلَى قَالَ «مَا إِخَالُكَ سَرَقْتَ؟» قَالَ بَلَى قَالَ «فَاذْهَبُوا فَاقْطَعُوا يَدَهُ ثُمَّ جِيئُوا بِهِ فَقَطَعُوا يَدَهُ ثُمَّ جَاءُوا بِهِ» فَقَالَ اسْتَغْفِرِ اللَّهَ وَتُبْ إِلَيْهِ فَقَالَ أَسْتَغْفِرُ اللَّهَ وَأَتُوبُ إِلَيْهِ فَقَالَ «اللَّهُمَّ تُبْ عَلَيْهِ اللَّهُمَّ تُبْ عَلَيْهِ»
13.7 [Machine] What cannot be cut from the fruits
١٣۔٧ بَابُ مَا لَا يُقْطَعُ فِيهِ مِنَ الثِّمَارِ
"I heard the Messenger of Allah say: 'The hand is not to be cut off for (stealing) produce or the spadix of palm trees."' (Using translation from Nasāʾī 4960)
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ»
"I heard the Messenger of Allah say: 'The hand is not to be cut off for (stealing) produce or the spadix of palm trees."' (Using translation from Nasāʾī 4964)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ»
“The hand is not to be cut off for (stealing) produce or the spadix of palm trees.” (Using translation from Ibn Mājah 2593)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ»
This tradition has also been narrated on the authority of ‘A’ishah through a different chain. (Using translation from Abū Dāʾūd 99)
عَنِ النَّبِيِّ ﷺ نَحْوَهُ
[Machine] I heard the Prophet ﷺ saying, "There should be no cutting in the fruit nor excess." He said this while referring to the fat of the date palm, and excess refers to the fibers in it.
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ» قَالَ وَهُوَ شَحْمُ النَّخْلِ وَالْكَثَرُ الْجُمَّارُ
[Machine] I heard the Prophet ﷺ saying, "There is no cutting in abundance." Abu Muhammad said that Abu Usamah did not say that.
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «لَا قَطْعَ فِي كَثَرٍ» قَالَ أَبُو مُحَمَّد الْقَوْلُ مَا قَالَ أَبُو أُسَامَةَ
13.8 [Machine] What can't be severed from the thieves
١٣۔٨ بَابُ مَا لَا يُقْطَعُ مِنَ السُّرَّاقِ
“The hand of the one who betrays a trust, the robber and the pilferer is not to be cut off”. (Using translation from Ibn Mājah 2591)
قَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ عَلَى الْمُنْتَهِبِ وَلَا عَلَى الْمُخْتَلِسِ وَلَا عَلَى الْخَائِنِ قَطْعٌ»
13.9 [Machine] At the limit of alcohol
١٣۔٩ بَابٌ فِي حَدِّ الْخَمْرِ
That a man who had drunk wine was brought to the Prophet ﷺ, so he beat him about forty times with two stalks of a palm tree. So Abu Bakr did similarly, and by the time 'Umar became Khalifah he sought council from the people. And 'Abdur-Rahman bin 'Awf said: 'I see that the lightest penalty is eighty lashes,' so 'Umar ordered that. (Using translation from Tirmidhī 1443)
أَنَّ النَّبِيَّ ﷺ «أُتِيَ بِرَجُلٍ قَدْ شَرِبَ خَمْرًا فَضَرَبَهُ بِجَرِيدَتَيْنِ» ثُمَّ فَعَلَ أَبُو بَكْرٍ مِثْلَ ذَلِكَ فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَخَفُّ الْحُدُودِ ثَمَانِينَ قَالَ «فَفَعَلَ»
“When Walid bin ʿUqbah was brought to ʿUthman, they had testified against him. He said to 'Ali: 'You are close to your uncle's son, so carry out the legal punishment on him.' So 'Ali whipped him. He said: 'The Messenger of Allah ﷺ gave forty lashes, and Abu Bakr gave forty lashes, and 'Umar gave eighty all are Sunnah.'” (Using translation from Ibn Mājah 2571)
عَلِيٌّ «جَلَدَ النَّبِيُّ ﷺ أَرْبَعِينَ وَجَلَدَ أَبُو بَكْرٍ أَرْبَعِينَ وَعُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ»
13.10 [Machine] In the Shop of Wine, When the Fourth One is Brought
١٣۔١٠ بَابٌ فِي شَارِبِ الْخَمْرِ إِذَا أُتِيَ بِهِ الرَّابِعَةَ
[Machine] I heard the Messenger of Allah ﷺ saying, "If one of you drinks, then strike him. If he repeats it, then strike him. If he repeats it again, then strike him. If he repeats it for the fourth time, then kill him."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِذَا شَرِبَ أَحَدُكُمْ فَاضْرِبُوهُ ثُمَّ إِنْ عَادَ فَاضْرِبُوهُ ثُمَّ إِنْ عَادَ فَاضْرِبُوهُ ثُمَّ إِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ»
13.11 [Machine] Punishment in sins
١٣۔١١ بَابُ التَّعْزِيرِ فِي الذُّنُوبِ
[Machine] I heard the Messenger of Allah ﷺ saying, "It is not permissible for anyone to strike another person with more than ten lashes except within the limits prescribed by Allah."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يَحِلُّ لِأَحَدٍ أَنْ يَضْرِبَ أَحَدًا فَوْقَ عَشَرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ»
13.12 [Machine] Recognition of Adultery
١٣۔١٢ بَابُ الِاعْتِرَافِ بِالزِّنَا
[Machine] A man who had embraced Islam came to the Prophet ﷺ and confessed that he had committed adultery. He testified against himself that he had committed adultery four times. So, the Prophet ordered that he be stoned to death, although he was married.
أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى النَّبِيَّ ﷺ فَحَدَّثَهُ أَنَّهُ زَنَى فَشَهِدَ عَلَى نَفْسِهِ أَنَّهُ زَنَى أَرْبَعًا «فَأَمَرَ بِرَجْمِهِ وَكَانَ قَدْ أُحْصِنَ»
[Machine] He heard Jabir bin Samurah saying, "The Prophet ﷺ was presented with a short man wearing an izār (a lower garment) without a rida (a upper garment). The Messenger of Allah ﷺ was reclining on a cushion on his left side. He spoke to him, but I do not know what he said to him as I was far away from them and the people were between me and him. He said, "Take him away and stone him." Then he said, "Bring him back." He spoke to him again and I listened, although the people were still between me and him. Then he said, "Take him away and stone him." Then the Prophet ﷺ stood up and delivered a sermon, and I listened to it. Then he said, "Whenever we go out in the cause of Allah, one of them would be given a she-camel to ride and the rest would share its milk. By Allah, I cannot convey the like of one of them without facing hardship."
أَنَّهُ سَمِعَ جَابِرَ بْنَ سَمُرَةَ يَقُولُ أُتِيَ النَّبِيُّ ﷺ بِمَاعِزِ بْنِ مَالِكٍ رَجُلٍ قَصِيرٍ فِي إِزَارٍ مَا عَلَيْهِ رِدَاءٌ وَرَسُولُ اللَّهِ ﷺ مُتَّكِئٌ عَلَى وِسَادَةٍ عَلَى يَسَارِهِ فَكَلَّمَهُ فَمَا أَدْرِي مَا يُكَلِّمُهُ بِهِ وَأَنَا بَعِيدٌ مِنْهُ بَيْنِي وَبَيْنَهُ الْقَوْمُ فَقَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» ثُمَّ قَالَ «رُدُّوهُ» فَكَلَّمَهُ أَيْضًا وَأَنَا أَسْمَعُ غَيْرَ أَنَّ بَيْنِي وَبَيْنَهُ الْقَوْمَ ثُمَّ قَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» ثُمَّ قَامَ النَّبِيُّ ﷺ فَخَطَبَ وَأَنَا أَسْمَعُهُ ثُمَّ قَالَ «كُلَّمَا نَفَرْنَا فِي سَبِيلِ اللَّهِ خَلَفَ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ مِنَ اللَّبَنِ؟ وَاللَّهِ لَا أَقْدِرُ عَلَى أَحَدٍ مِنْهُمْ إِلَّا نَكَّلْتُ بِهِ»
A man came to the Prophet ﷺ and said, "I beseech you to judge us according to Allah's Laws." Then his opponent who was wiser than he, got up and said, "He has spoken the truth. So judge us according to Allah's Laws and please allow me (to speak), O Messenger of Allah ﷺ." The Prophet ﷺ said, "Speak." He said, "My son was a laborer for the family of this man and he committed illegal sexual intercourse with his wife, and I gave one-hundred sheep and a slave as a ransom (for my son), but I asked the religious learned people (regarding this case), and they informed me that my son should be flogged onehundred stripes, and be exiled for one year, and the wife of this man should be stoned (to death)."The Prophet ﷺ said, "By Him in Whose Hand my soul is, I will Judge you (in this case) according to Allah's Laws. The one-hundred (sheep) and the slave shall be returned to you and your son shall be flogged one-hundred stripes and be exiled for one year. And O Unais! Go in the morning to the wife of this man and ask her, and if she confesses, stone her to death." She confessed and he stoned her to death. (Using translation from Bukhārī 6859)
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْن خَالِدٍ وَشِبْلٍ قالُوا جاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ أَنْشُدُكَ اللَّهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ فَقَالَ خصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ صَدَقَ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَأْذَنْ لِي يَا رَسُولَ اللَّهِ أَنْ أَتَكَلَّمَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَليْهِ وَسَلَّمَ «قُلْ» فَقَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى أَهْلِ هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ وَإِنِّي سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَيَا أُنَيْسُ اغْدُ عَلَى امْرَأَةِ هَذَا فَسَلْهَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَاعْتَرَفَتْ فَرَجَمَهَا
13.13 [Machine] The confessor retracts his confession.
١٣۔١٣ بَابُ الْمُعْتَرِفِ يَرْجِعُ عَنِ اعْتِرَافِهِ
[Machine] "So we reminded the Messenger of Allah ﷺ and he said, 'So why didn't you abandon it?'"
فَذَكَرْنَا ذَلِكَ لِرَسُولِ اللَّهِ ﷺ قَالَ «فَهَلَّا تَرَكْتُمُوهُ»
13.14 [Machine] The digging for whom stoning is intended
١٣۔١٤ بَابُ الْحَفْرِ لِمَنْ يُرَادُ رَجْمُهُ
[Machine] The Messenger of Allah ﷺ said, "Go with Ma'iz ibn Malik and stone him." So we went with him to Baqee' al-Gharqad. By Allah, we did not tie him up or dig a hole for him. Rather, he stood and we stoned him with bones, pottery, and gravel.
قَالَ رَسُولُ اللَّهِ ﷺ «انْطَلِقُوا بِمَاعِزِ بْنِ مَالِكٍ فَارْجُمُوهُ» فَانْطَلَقْنَا بِهِ إِلَى بَقِيعِ الْغَرْقَدِ فَوَاللَّهِ مَا أَوْثَقْنَاهُ وَلَا حَفَرْنَا لَهُ وَلَكِنْ قَامَ فَرَمَيْنَاهُ بِالْعِظَامِ وَالْخَزَفِ وَالْجَنْدَلِ
[Machine] I was sitting with the Prophet ﷺ when a man named Ma'iz ibn Malik came to him and confessed to committing adultery. The Prophet ﷺ asked him three times if he was sure, and each time the man confirmed his confession. Then, he came for the fourth time and confessed again. The Prophet ﷺ ordered a pit to be dug for him and he was placed in it up to his chest. The Prophet ﷺ then commanded the people to stone him.
كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَهُ رَجُلٌ يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَرَدَّهُ ثَلَاثَ مَرَّاتٍ ثُمَّ جَاءَ الرَّابِعَةَ فَاعْتَرَفَ «فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَحُفِرَ لَهُ حُفْرَةٌ فَجُعِلَ فِيهَا إِلَى صَدْرِهِ وَأَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ»
13.15 [Machine] In the judgment between the people of the Book when they seek arbitration from Muslim judges.
١٣۔١٥ بَابٌ فِي الْحُكْمِ بَيْنَ أَهْلِ الْكِتَابِ إِذَا تَحَاكَمُوا إِلَى حُكَّامِ الْمُسْلِمِينَ
[Machine] "Indeed, the Jews came to the Messenger of Allah ﷺ with a man and a woman from among them who had committed adultery. The Messenger said, 'What should be done with those who have committed adultery among you?' They replied, 'We do not find anything mentioned about it in our scripture.' Abdullah bin Salam said, 'You have lied regarding stoning in the Torah. Bring the Torah and recite it if you are truthful.' So they brought the Torah, and he placed his hand on the verse of stoning and asked, 'What is this?' When they saw that, they said, 'It is the verse of stoning.' So the Messenger of Allah ﷺ ordered that they be stoned near the site where funeral processions are placed near the mosque.' Abdullah said, 'I saw the man shielding the woman with his body from the stones.'"
أَنَّ الْيَهُودَ جَاءُوا إِلَى رَسُولِ اللَّهِ ﷺ بِرَجُلٍ مِنْهُمْ وَامْرَأَةٍ قَدْ زَنَيَا فَقَالَ «كَيْفَ تَفْعَلُونَ بِمَنْ زَنَى مِنْكُمْ؟» قَالُوا لَا نَجِدُ فِيهَا شَيْئًا فَقَالَ لَهُمْ عَبْدُ اللَّهِ بْنُ سَلَامٍ كَذَبْتُمْ فِي التَّوْرَاةِ الرَّجْمُ فَأْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ فَوَضَعَ مِدْرَاسُهَا الَّذِي يَدْرُسُهَا مِنْهُمْ كَفَّهُ عَلَى آيَةِ الرَّجْمِ فَقَالَ «مَا هَذِهِ؟» فَلَمَّا رَأَوْا ذَلِكَ قَالُوا هِيَ آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللَّهِ ﷺ فَرُجِمَا قَرِيبًا مِنْ حَيْثُ تُوضَعُ الْجَنَائِزُ عِنْدَ الْمَسْجِدِ قَالَ عَبْدُ اللَّهِ فَرَأَيْتُ صَاحِبَهَا يَجْنَأُ عَلَيْهَا يَقِيهَا الْحِجَارَةَ
13.16 [Machine] In the case of those protected by marital confinement who commit adultery
١٣۔١٦ بَابٌ فِي حَدِّ الْمُحْصَنِينَ بِالزِّنَا
ʿUmar said: Allah, may He be exalted, sent Muhammad ﷺ and sent down the Book to him. Among that which was revealed to him was the verse of stoning. We recited it and understood it. But I fear that with the passage of time, some people will say: We do not find the verse of stoning in the Book of Allah, and as a result an obligation that Allah revealed will be forsaken. Stoning is the due punishment in the Book of Allah for those who commit zina, both men and women, if they have been married and if proof is established, or there is a pregnancy or a confession. عُمَرُ إِنَّ اللَّهَ تَعَالَى بَعَثَ مُحَمَّدًا ﷺ بِالْحَقِّ وَأَنْزَلَ عَلَيْهِ الْكِتَابَ وَكَانَ فِيمَا أَنْزَلَ آيَةُ الرَّجْمِ فَقَرَأْنَاهَا وَوَعَيْنَاهَا وَعَقَلْنَاهَا وَرَجَمَ رَسُولُ اللَّهِ ﷺ وَرَجَمْنَا بَعْدَهُ فَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ الْقَائِلُ لَا نَجِدُ حَدَّ آيَةِ الرَّجْمِ فِي كِتَابِ اللَّهِ وَالرَّجْمُ فِي كِتَابِ اللَّهِ حَقٌّ عَلَى مَنْ زَنَى مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا أُحْصِنَ إِذَا قَامَتْ عَلَيْهِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ
13.17 [Machine] When a pregnant woman confesses to adultery
١٣۔١٧ بَابُ الْحَامِلِ إِذَا اعْتَرَفَتْ بِالزِّنَا
[Machine] I was sitting with the Prophet ﷺ when a woman from the tribe of Banu Ghamed came to him and said, "O Prophet of Allah, I have committed adultery and I want you to purify me." He told her to go back. The next day she came to him again and confessed her sin. She said, "O Prophet of Allah, purify me, and perhaps you will treat me as you treated Ma'iz ibn Malik." She pleaded with him, saying, "By Allah, I am pregnant." The Prophet ﷺ told her to go back until she gave birth. When she gave birth, she came to him carrying the baby in a cloth and said, "O Prophet of Allah, I have given birth." He said, "Go and breastfeed him, then wean him." When she weaned the baby, she came to him holding a piece of bread in his hand and said, "O Prophet of Allah, I have weaned him." The Prophet ﷺ ordered the baby to be given to a Muslim man and ordered a hole to be dug for her. She was placed in the hole up to her chest and the people were ordered to stone her. Khalid ibn al-Walid came forward with a stone and struck her head, causing blood to splatter onto Khalid's cheek. He cursed her, and the Prophet ﷺ heard his curse. He said, "Stop, O Khalid, do not curse her. By the One in whose hand is my soul, she has repented in a way that if a sinful person were to repent the same way, Allah would have forgiven him." He ordered for her to be prayed upon and buried.
كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَتْهُ امْرَأَةٌ مِنْ بَنِي غَامِدٍ فَقَالَتْ يَا نَبِيَّ اللَّهِ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهَا «ارْجِعِي فَلَمَّا كَانَ مِنَ الْغَدِ أَتَتْهُ أَيْضًا فَاعْتَرَفَتْ عِنْدَهُ بِالزِّنَا» فَقَالَتْ يَا نَبِيَّ اللَّهِ طَهِّرْنِي فَلَعَلَّكَ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ فَوَاللَّهِ إِنِّي لَحُبْلَى فَقَالَ لَهَا النَّبِيُّ ﷺ «ارْجِعِي حَتَّى تَلِدِي» فَلَمَّا وَلَدَتْ جَاءَتْ بِالصَّبِيِّ تَحْمِلُهُ فِي خِرْقَةٍ فَقَالَتْ يَا نَبِيَّ اللَّهِ هَذَا قَدْ وَلَدْتُ فَقَالَ فَاذْهَبِي فَأَرْضِعِيهِ ثُمَّ افْطِمِيهِ فَلَمَّا فَطَمَتْهُ جَاءَتْ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ يَا نَبِيَّ اللَّهِ قَدْ فَطَمْتُهُ فَأَمَرَ النَّبِيُّ ﷺ بِالصَّبِيِّ فَدُفِعَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ وَأَمَرَ بِهَا فَحُفِرَ لَهَا حُفْرَةٌ فَجُعِلَتْ فِيهَا إِلَى صَدْرِهَا ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهَا فَأَقْبَلَ خَالِدُ بْنُ الْوَلِيدِ بِحَجَرٍ فَرَمَى رَأْسَهَا فَتَلَطَّخَ الدَّمُ عَلَى وَجْنَةِ خَالِدِ بْنِ الْوَلِيدِ فَسَبَّهَا فَسَمِعَ النَّبِيُّ ﷺ سَبَّهُ إِيَّاهَا فَقَالَ «مَهْ يَا خَالِدُ لَا تَسُبَّهَا فَوَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَغُفِرَ لَهُ» فَأَمَرَ بِهَا فَصُلِّيَ عَلَيْهَا وَدُفِنَتْ
A woman belonging to the tribe of Juhaynah (according to the version of Aban) came to the Prophet ﷺ and said that she had committed fornication and that she was pregnant. The Messenger of Allah ﷺ called her guardian. Then the Messenger of Allah ﷺ said to him: Be good to her, and when she bears a child, bring her (to me). When she gave birth to the child, he brought her (to him). The Prophet ﷺ gave orders regarding her, and her clothes were tied to her. He then commanded regarding her and she was stoned to death. He commanded the people (to pray) and they prayed over her. Thereupon Umar said: Are you praying over her, Messenger of Allah, when she has committed fornication? He said: By Him in Whose hand my soul is, she has repented to such an extent that if it were divided among the seventy people of Medina, it would have been enough for them all. And what do you find better than the fact that she gave her life. Aban did not say in his version: Then her clothes were tied to her. (Using translation from Abū Dāʾūd 4440)
أَنَّ امْرَأَةً مِنْ جُهَيْنَةَ أَتَتِ النَّبِيَّ ﷺ وَهِيَ حُبْلَى مِنَ الزِّنَا فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَدَعَا رَسُولُ اللَّهِ ﷺ وَلِيَّهَا فَقَالَ «اذْهَبْ فَأَحْسِنْ إِلَيْهَا فَإِذَا وَضَعَتْ حَمْلَهَا فَأْتِنِي بِهَا» فَفَعَلَ فَأَمَرَ بِهَا رَسُولُ اللَّهِ ﷺ فَشُكَّتْ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا فَقَالَ عُمَرُ يَا رَسُولَ اللَّهِ أَتُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ فَقَالَ «لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا لِلَّهِ ﷻ؟»
13.18 [Machine] In the Mamluks, if they commit adultery, their rulers impose the punishment on them, not the sultan.
١٣۔١٨ بَابٌ فِي الْمَمَالِيكِ إِذَا زَنَوْا يُقِيمُ سَادَتُهُمْ عَلَيْهِمُ الْحَدَّ دُونَ السُّلْطَانِ
[Machine] "The Prophet ﷺ was asked about a slave woman who commits adultery but is not married. He said, 'If she commits adultery, then flog her, and if she commits adultery again, then flog her.' He said, 'I do not know about the third or fourth time, sell her, even if it is for a lock of hair.'"
أَنَّ النَّبِيَّ ﷺ سُئِلَ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصَنْ فَقَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا قَالَ فَمَا أَدْرِي فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ «فَبِيعُوهَا وَلَوْ بِضَفِيرٍ»
13.19 [Machine] In the interpretation of Allah's saying "or Allah will make a way for them
١٣۔١٩ بَابٌ فِي تَفْسِيرِ قَوْلِ اللَّهِ تَعَالَى أَوْ يَجْعَلَ اللَّهُ لَهُنَّ سَبِيلًا
Messenger of Allah ﷺ as saying: Receive (teaching) from me, receive (teaching) from me. Allah has ordained a way for those (women). When an unmarried male commits adultery with an unmarried female (they should receive) one hundred lashes and banishment for one year. And in case of married male committing adultery with a married female, they shall receive one hundred lashes and be stoned to death. (Using translation from Muslim 1690a)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ خُذُوا عَنِّي خُذُوا عَنِّي قَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلًا الْبِكْرُ بِالْبِكْرِ وَالثَّيِّبُ بِالثَّيِّبِ الْبِكْرُ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ وَالثَّيِّبُ جَلْدُ مِائَةٍ وَالرَّجْمُ
The above-mentioned tradition has also been transmitted by Abu Hurairah through a different chain of narrators to the same effect. (Using translation from Abū Dāʾūd 865)
عَنِ النَّبِيِّ ﷺ بِنَحْوِهِ
13.20 [Machine] Who falls on his wife's maid?
١٣۔٢٠ بَابٌ فِيمَنْ يَقَعُ عَلَى جَارِيَةِ امْرَأَتِهِ
[Machine] "I will spend in it a year of medical treatment if it is permissible for him." If she made it permissible for him, he would receive one hundred lashes. And if she did not make it permissible for him, she would be stoned. Her husband was asked, and he said, "Indeed, I have made it permissible for him." So he struck him one hundred times. Yahya said, "He is elevated."
لَأَقْضِيَنَّ فِيهِ بِقَضَاءٍ شَافٍ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ كَانَتْ لَمْ تُحِلَّهَا لَهُ رَجَمْتُهُ فَقِيلَ لَهَا زَوْجُكِ فَقَالَتْ إِنِّي قَدْ أَحْلَلْتُهَا لَهُ فَضَرَبَهُ مِائَةً قَالَ يَحْيَى هُوَ مَرْفُوعٌ
This tradition has also been narrated on the authority of ‘A’ishah through a different chain. (Using translation from Abū Dāʾūd 99)
عَنِ النَّبِيِّ ﷺ نَحْوَهُ
13.21 [Machine] The penalty of Kaffarah for one who breaks fast.
١٣۔٢١ بَابُ الْحَدُّ كَفَّارَةٌ لِمَنْ أُقِيمَ عَلَيْهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever is punished for a sin, that sin will be forgiven for him."
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ أُقِيمَ عَلَيْهِ حَدٌّ غُفِرَ لَهُ ذَلِكَ الذَّنْبُ»
