[Machine] "I will spend in it a year of medical treatment if it is permissible for him." If she made it permissible for him, he would receive one hundred lashes. And if she did not make it permissible for him, she would be stoned. Her husband was asked, and he said, "Indeed, I have made it permissible for him." So he struck him one hundred times. Yahya said, "He is elevated."  

الدارمي:٢٣٧٤ – أَخْبَرَنَا يَحْيَى بْنُ حَمَّادٍ حَدَّثَنَا أَبَانُ بْنُ يَزِيدَ عَنْ قَتَادَةَ قَالَ كَتَبَ إِلَيَّ خَالِدُ بْنُ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ أَنَّ غُلَامًا كَانَ يُنْبَزُ فُرْفُورًا فَوَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ فَرُفِعَ ذلك إِلَى النُّعْمَانِ بْنِ بَشِيرٍ فَقَالَ

لَأَقْضِيَنَّ فِيهِ بِقَضَاءٍ شَافٍ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ كَانَتْ لَمْ تُحِلَّهَا لَهُ رَجَمْتُهُ فَقِيلَ لَهَا زَوْجُكِ فَقَالَتْ إِنِّي قَدْ أَحْلَلْتُهَا لَهُ فَضَرَبَهُ مِائَةً قَالَ يَحْيَى هُوَ مَرْفُوعٌ

"A man was brought to An-Nu'man bin Bashir who had relations with the slave girl of his wife. He said: 'I give you judgement about her case according to the judgement of the Messenger of Allah ﷺ: If she made her lawful for him, then I will lash him one hundred times, and if she did not make her lawful, then I will stone him."

Habib ibn Salim said: A man called AbdurRahman ibn Hunayn had intercourse with his wife's slave-girl. The matter was brought to an-Nu'man ibn Bashir who was the Governor of Kufah. He said: I shall decide between you in accordance with the decision of the Messenger of Allah ﷺ. If she made her lawful for you, I shall flog you one hundred lashes. If she did not make her lawful for you, I shall stone you to death. So they found that she had made her lawful for him. He, therefore, flogged him one hundred lashes. Qatadah said: I wrote to Habib b. Salim; so he wrote this (tradition) to me. (Using translation from Abū Dāʾūd 4458)   

أحمد:١٨٤٢٦ – حَدَّثَنَا عَفَّانُ حَدَّثَنَا أَبَانُ الْعَطَّارُ حَدَّثَنَا قَتَادَةُ عَنْ خَالِدِ بْنِ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ وَقَالَ أَبَانُ أَخْبَرَنَا قَتَادَةُ أَنَّهُ كَتَبَ إِلَى حَبِيبِ بْنِ سَالِمٍ فِيهِ فَكَتَبَ إِلَيْهِ أَنَّ رَجُلًا يُقَالُ لَهُ عَبْدُ الرَّحْمَنِ بْنُ حُنَيْنٍ كَانَ يُنْبَزُ قُرْقُورًا رُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ فَقَالَ

لَأَقْضِيَنَّ فِيكَ بِقَضَاءِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ رَجَمْتُكَ فَوَجَدَهَا قَدْ أَحَلَّتْهَا لَهُفَجَلَدَهُ مِائَةً

[Machine] It was reported to him that a man had accused his wife of adultery, so he said, "I will decide the case according to the law of the Messenger of Allah, ﷺ . If she has committed adultery, I will flog you one hundred lashes, and if she has not committed adultery, I will stone you to death." He later found out that his wife had indeed committed adultery, so he flogged her one hundred times.  

أحمد:١٨٤٤٥ – حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ وَعَبْدُ اللهِ بْنُ بَكْرٍ قَالَا حَدَّثَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ قَالَ ابْنُ بَكْرٍ مَوْلَى النُّعْمَانِ بْنِ بَشِيرٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ
