13. Book of Penalties
١٣۔ كِتَابُ الْحُدُودِ
[Machine] A man who had embraced Islam came to the Prophet ﷺ and confessed that he had committed adultery. He testified against himself that he had committed adultery four times. So, the Prophet ordered that he be stoned to death, although he was married.
أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى النَّبِيَّ ﷺ فَحَدَّثَهُ أَنَّهُ زَنَى فَشَهِدَ عَلَى نَفْسِهِ أَنَّهُ زَنَى أَرْبَعًا «فَأَمَرَ بِرَجْمِهِ وَكَانَ قَدْ أُحْصِنَ»
[Machine] He heard Jabir bin Samurah saying, "The Prophet ﷺ was presented with a short man wearing an izār (a lower garment) without a rida (a upper garment). The Messenger of Allah ﷺ was reclining on a cushion on his left side. He spoke to him, but I do not know what he said to him as I was far away from them and the people were between me and him. He said, "Take him away and stone him." Then he said, "Bring him back." He spoke to him again and I listened, although the people were still between me and him. Then he said, "Take him away and stone him." Then the Prophet ﷺ stood up and delivered a sermon, and I listened to it. Then he said, "Whenever we go out in the cause of Allah, one of them would be given a she-camel to ride and the rest would share its milk. By Allah, I cannot convey the like of one of them without facing hardship."
أَنَّهُ سَمِعَ جَابِرَ بْنَ سَمُرَةَ يَقُولُ أُتِيَ النَّبِيُّ ﷺ بِمَاعِزِ بْنِ مَالِكٍ رَجُلٍ قَصِيرٍ فِي إِزَارٍ مَا عَلَيْهِ رِدَاءٌ وَرَسُولُ اللَّهِ ﷺ مُتَّكِئٌ عَلَى وِسَادَةٍ عَلَى يَسَارِهِ فَكَلَّمَهُ فَمَا أَدْرِي مَا يُكَلِّمُهُ بِهِ وَأَنَا بَعِيدٌ مِنْهُ بَيْنِي وَبَيْنَهُ الْقَوْمُ فَقَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» ثُمَّ قَالَ «رُدُّوهُ» فَكَلَّمَهُ أَيْضًا وَأَنَا أَسْمَعُ غَيْرَ أَنَّ بَيْنِي وَبَيْنَهُ الْقَوْمَ ثُمَّ قَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» ثُمَّ قَامَ النَّبِيُّ ﷺ فَخَطَبَ وَأَنَا أَسْمَعُهُ ثُمَّ قَالَ «كُلَّمَا نَفَرْنَا فِي سَبِيلِ اللَّهِ خَلَفَ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ مِنَ اللَّبَنِ؟ وَاللَّهِ لَا أَقْدِرُ عَلَى أَحَدٍ مِنْهُمْ إِلَّا نَكَّلْتُ بِهِ»
A man came to the Prophet ﷺ and said, "I beseech you to judge us according to Allah's Laws." Then his opponent who was wiser than he, got up and said, "He has spoken the truth. So judge us according to Allah's Laws and please allow me (to speak), O Messenger of Allah ﷺ." The Prophet ﷺ said, "Speak." He said, "My son was a laborer for the family of this man and he committed illegal sexual intercourse with his wife, and I gave one-hundred sheep and a slave as a ransom (for my son), but I asked the religious learned people (regarding this case), and they informed me that my son should be flogged onehundred stripes, and be exiled for one year, and the wife of this man should be stoned (to death)."The Prophet ﷺ said, "By Him in Whose Hand my soul is, I will Judge you (in this case) according to Allah's Laws. The one-hundred (sheep) and the slave shall be returned to you and your son shall be flogged one-hundred stripes and be exiled for one year. And O Unais! Go in the morning to the wife of this man and ask her, and if she confesses, stone her to death." She confessed and he stoned her to death. (Using translation from Bukhārī 6859)
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْن خَالِدٍ وَشِبْلٍ قالُوا جاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ أَنْشُدُكَ اللَّهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ فَقَالَ خصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ صَدَقَ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَأْذَنْ لِي يَا رَسُولَ اللَّهِ أَنْ أَتَكَلَّمَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَليْهِ وَسَلَّمَ «قُلْ» فَقَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى أَهْلِ هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ وَإِنِّي سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَيَا أُنَيْسُ اغْدُ عَلَى امْرَأَةِ هَذَا فَسَلْهَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَاعْتَرَفَتْ فَرَجَمَهَا
