12. Book of Divorce
١٢۔ كِتَابُ الطَّلَاقِ
"I divorced my wife when she was menstruating. 'Umar mentioned that to the Messenger of Allah and he said: 'Tell him to take her back until she becomes pure (i.e., her period ends), then she has her period (again), then she becomes pure (again), then if he wishes he may divorce her before having sexual relations with her, and if he wishes he may keep her. This is the waiting period that Allah has enjoined.'" (Using translation from Ibn Mājah 2019)
أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ «مُرْهُ أَنْ يُرَاجِعَهَا وَيُمْسِكَهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ»
[Machine] "When the Prophet ﷺ divorced the wife of Ibn Umar, he said, 'Let him take her back and then divorce her while she is in a state of purity.' Abu Muhammad said, 'This was narrated by Ibn Al-Mubarak, Wakie, or Hamil.'"
لِلنَّبِيِّ ﷺ حِينَ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ فَقَالَ «مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرَةٌ» قَالَ أَبُو مُحَمَّد «رَوَاهُ ابْنُ الْمُبَارَكِ وَوَكِيعٌ أَوْ حَامِلٌ»

١٢۔٢ بَابٌ فِي الرَّجْعَةِ
The Prophet ﷺ divorced Hafsah, but he took her back in marriage. (Using translation from Abū Dāʾūd 2283)
«طَلَّقَ رَسُولُ اللَّهِ ﷺ حَفْصَةَ ثُمَّ رَاجَعَهَا»
[Machine] "The Prophet ﷺ divorced Hafsah and then took her back," Abu Muhammad said, "It seems that Ali ibn al-Madinah disapproved of this hadith and said, 'We do not have this hadith in Basra from Humaid.'"
أَنَّ النَّبِيَّ ﷺ «طَلَّقَ حَفْصَةَ ثُمَّ رَاجَعَهَا» قَالَ أَبُو مُحَمَّد كَأَنَّ عَلِيَّ بْنَ الْمَدِينِيِّ أَنْكَرَ هَذَا الْحَدِيثَ وَقَالَ لَيْسَ عِنْدَنَا هَذَا الْحَدِيثُ بِالْبَصْرَةِ عَنْ حُمَيْدٍ
12.3 [Machine] No divorce before marriage
١٢۔٣ بَابُ لَا طَلَاقَ قَبْلَ نِكَاحٍ
[Machine] The Messenger of Allah ﷺ wrote to the people of Yemen, "The Quran should not be touched except by one who is pure, and divorce cannot be pronounced before ownership is established, and the freeing of a slave cannot be done until it is bought." Abu Muhammad was asked about Sulaiman, and he said, "I think he is a writer among the writers of Umar ibn Abdul Aziz."
أَنَّ رَسُولَ اللَّهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ «أَنْ لَا يَمَسَّ الْقُرْآنَ إِلَّا طَاهِرٌ وَلَا طَلَاقَ قَبْلَ إِمْلَاكٍ وَلَا عَتَاقَ حَتَّى يَبْتَاعَ» سُئِلَ أَبُو مُحَمَّدٍ عَنْ سُلَيْمَانُ قَالَ أَحْسَبُ كَاتِبًا مِنْ كُتَّابِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ
12.4 [Machine] What is permissible for a woman to do for her husband who divorced her, so that her divorce is final?
١٢۔٤ بَابُ مَا يُحِلُّ الْمَرْأَةَ لِزَوْجِهَا الَّذِي طَلَّقَهَا فَبَتَّ طَلَاقَهَا
[Machine] The woman of Rifaa'a al-Qurazi came to the Messenger of Allah ﷺ , and with him were Abu Bakr and Khalid ibn Sa'id ibn al-'As, waiting at the door to be permitted to enter to see the Messenger of Allah ﷺ . The woman said, "O Messenger of Allah, I was with Rifaa'a and he divorced me, and now my 'Iddah (waiting period) is complete." He said, "Do you want to go back to Rifaa'a? No, not until he has sexual intercourse with you and you have tasted his semen, and he has tasted yours." Khalid ibn Sa'id called out to Abu Bakr, "Don't you see what she is saying loudly? This is in front of the Messenger of Allah ﷺ !"
جَاءَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ إِلَى رَسُولِ اللَّهِ ﷺ وَعِنْدَهُ أَبُو بَكْرٍ وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ عَلَى الْبَابِ يَنْتَظِرُ أَنْ يُؤْذَنَ لَهُ عَلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ فَطَلَّقَنِي فَبَتَّ طَلَاقِي قَالَ «أَتُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا حَتَّى يَذُوقَ عُسَيْلَتَكِ وَتَذُوقِي عُسَيْلَتَهُ» فَنَادَى خَالِدُ بْنُ سَعِيدٍ أَبَا بَكْرٍ أَلَا تَرَى مَا تَجْهَرُ بِهِ؟ هَذِهِ عِنْدَ رَسُولِ اللَّهِ ﷺ؟
"The wife of Rifa'ah Al-Qurazi came to the Messenger of Allah and said: 'O Messenger of Allah! I got married to 'Abdur-Rahman bin Az-Zabir, and what he has is like this fringe.' The Messenger of Allah said: 'Perhaps you want to go back to Rifa'ah? No, not until he ('Abdur-Rahman) tastes your sweetness and you taste his sweetness.'" (Using translation from Nasāʾī 3408)
طَلَّقَ رِفَاعَةُ رَجُلٌ مِنْ بَنِي قُرَيْظَةَ امْرَأَتَهُ فَتَزَوَّجَهَا عَبْدُ الرَّحْمَنِ بْنُ الزُّبَيْرِ فَدَخَلَتْ عَلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ وَاللَّهِ إِنْ مَعَهُ إِلَّا مِثْلُ هُدْبَتِي هَذِهِ فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ لَعَلَّكِ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى يَذُوقَ عُسَيْلَتَكِ أَوْ قَالَ تَذُوقِي عُسَيْلَتَهُ

١٢۔٥ بَابٌ فِي الْخِيَارِ
"The Messenger of Allah gave his wives the choice; was that a divorce?" (Using translation from Nasāʾī 3444)
قَدْ «خَيَّرَنَا رَسُولُ اللَّهِ ﷺ أَفَكَانَ طَلَاقًا»
12.6 [Machine] The prohibition of a woman asking her husband for a divorce.
١٢۔٦ بَابُ النَّهْيِ عَنْ أَنْ تَسْأَلَ الْمَرْأَةُ زَوْجَهَا طَلَاقَهَا
'Any woman who asks her husband for a divorce when it is not absolutely necessary, the fragrance of Paradise will be forbidden to her.'" (Using translation from Ibn Mājah 2055)
قَالَ رَسُولُ اللَّهِ ﷺ «أَيُّمَا امْرَأَةٍ سَأَلَتْ زَوْجَهَا الطَّلَاقَ مِنْ غَيْرِ بَأْسٍ فَحَرَامٌ عَلَيْهَا رَائِحَةُ الْجَنَّةِ»

١٢۔٧ بَابٌ فِي الْخُلْعِ
[Machine] The Prophet ﷺ desired to marry her, and she was his neighbor. Thabit struck her, so she came to the door of the Prophet ﷺ with a bandage on her head. The Prophet ﷺ came out and saw a man, and asked, "Who is this?" She said, "I am Habiba bint Sahl." He asked, "What happened to you?" She replied, "Neither I nor Thabit have any problem." Thabit then came to the Prophet ﷺ , and the Prophet ﷺ said to him, "Take from her and leave her alone." She said, "O Messenger of Allah, I have everything he gave me." So he took from her and she went back to her family.
أَنَّ رَسُولَ اللَّهِ ﷺ كَانَ هَمَّ أَنْ يَتَزَوَّجَهَا وَكَانَتْ جَارَةً لَهُ وَأَنَّ ثَابِتًا ضَرَبَهَا فَأَصْبَحَتْ عَلَى بَابِ رَسُولِ اللَّهِ ﷺ فِي الْغَلَسِ وَأَنَّ رَسُولَ اللَّهِ ﷺ خَرَجَ فَرَأَى إِنْسَانًا فَقَالَ «مَنْ هَذَا؟» قَالَتْ أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ فَقَالَ «مَا شَأْنُكِ؟» قَالَتْ لَا أَنَا وَلَا ثَابِتٌ فَأَتَى ثَابِتٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ لَهُ رَسُولُ اللَّهِ «خُذْ مِنْهَا وَخَلِّ سَبِيلَهَا» فَقَالَتْ يَا رَسُولَ اللَّهِ عِنْدِي كُلُّ شَيْءٍ أَعْطَانِيهِ فَأَخَذَ مِنْهَا وَقَعَدَتْ عِنْدَ أَهْلِهَا
12.8 [Machine] In the divorce of al-batta
١٢۔٨ بَابٌ فِي طَلَاقِ الْبَتَّةِ
[Machine] "He divorced his wife, Al-Batta, and then went to the Prophet ﷺ and informed him about it. The Prophet ﷺ asked him, 'What did you intend?' He replied, 'One divorce.' The Prophet ﷺ said, 'Did you intend by the name of Allah?' He replied, 'Yes, by the name of Allah.' The Prophet ﷺ said, 'Then that is what you have intended.'"
أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ «مَا أَرَدْتَ؟» فَقَالَ وَاحِدَةً قَالَ «آللَّهِ؟» قَالَ آللَّهِ قَالَ هُوَ مَا نَوَيْتَ
12.9 [Machine] In the daytime
١٢۔٩ بَابٌ فِي الظِّهَارِ
I was a man who was more given than others to sexual intercourse with women. When the month of Ramadan came, I feared lest I should have intercourse with my wife, and this evil should remain with me till the morning. So I made my wife like my mother's back to me till the end of Ramadan. But one night when she was waiting upon me, something of her was revealed. Suddenly I jumped upon her. When the morning came I went to my people and informed them about this matter. I said: Go along with me to the Messenger of Allah ﷺ. They said: No, by Allah. So I went to the Prophet (peace be upon him and informed him of the matter. He said: Have you really committed it, Salamah? I said: I committed it twice, Messenger of Allah. I am content with the Commandment of Allah, the Exalted; so take a decision about me according to what Allah has shown you. He said: Free a slave. I said: By Him Who sent you with truth, I do not possess a neck other than this: and I struck the surface of my neck. He said: Then fast two consecutive months. I said: Whatever I suffered is due to fasting. He said: Feed sixty poor people with a wasq of dates. I said: By Him Who sent you with truth, we passed the night hungry; there was no food in our house. He said: Then go to the collector of sadaqah of Banu Zurayq; he must give it to you. Then feed sixty poor people with a wasq of dates; and you and your family eat the remaining dates. Then I came back to my people, and said (to them): I found with you poverty and bad opinion; and I found with the Prophet ﷺ prosperity and good opinion. He has commanded me to give alms to you. Ibn al-Ala' added: Ibn Idris said: Bayadah is a sub-clan of Banu Zurayq. (Using translation from Abū Dāʾūd 2213)
كُنْتُ امْرَأً أُصِيبُ مِنَ النِّسَاءِ مَا لَا يُصِيبُ غَيْرِي فَلَمَّا دَخَلَ شَهْرُ رَمَضَانَ خِفْتُ أَنْ أُصِيبَ فِي لَيْلِي شَيْئًا فَيَتَتَابَعَ بِي ذَلِكَ إِلَى أَنْ أُصْبِحَ قَالَ فَتَظَاهَرْتُ إِلَى أَنْ يَنْسَلِخَ فَبَيْنَا هِيَ لَيْلَةً تَخْدُمُنِي إِذْ تَكَشَّفَ لِي مِنْهَا شَيْءٌ فَمَا لَبِثْتُ أَنْ نَزَوْتُ عَلَيْهَا فَلَمَّا أَصْبَحْتُ خَرَجْتُ إِلَى قَوْمِي فَأَخْبَرْتُهُمْ وَقُلْتُ امْشُوا مَعِي إِلَى رَسُولِ اللَّهِ ﷺ فَقَالُوا لَا وَاللَّهِ لَا نَمْشِي مَعَكَ مَا نَأْمَنُ أَنْ يَنْزِلَ فِيكَ الْقُرْآنُ أَوْ أَنْ يَكُونَ فِيكَ مِنْ رَسُولِ اللَّهِ ﷺ مَقَالَةٌ يَلْزَمُنَا عَارُهَا وَلَنُسْلِمَنَّكَ بِجَرِيرَتِكَ فَانْطَلَقْتُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَصَصْتُ عَلَيْهِ قصتي فَقَالَ يَا سَلَمَةُ «أَنْتَ بِذَاكَ» قُلْتُ أَنَا بِذَاكَ قَالَ يَا سَلَمَةُ «أَنْتَ بِذَاكَ» قُلْتُ أَنَا بِذَاكَ قَالَ يَا سَلَمَةُ «أَنْتَ بِذَاكَ» قُلْتُ أَنَا بِذَاكَ وَهَا أَنَا صَابِرٌ نَفْسِي فَاحْكُمْ فِيَّ مَا أَرَاكَ اللَّهُ قَالَ «فَأَعْتِقْ رَقَبَةً» قَالَ «فَضَرَبْتُ صَفْحَةَ رَقَبَتِي» فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ رَقَبَةً غَيْرَهَا قَالَ «فَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ» قُلْتُ وَهَلْ أَصَابَنِي الَّذِي أَصَابَنِي إِلَّا فِي الصِّيَامِ؟ قَالَ «فَأَطْعِمْ وَسْقًا مِنْ تَمْرٍ سِتِّينَ مِسْكِينًا» فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَقَدْ بِتْنَا لَيْلَتَنَا وَحْشَى مَا لَنَا مِنَ الطَّعَامِ قَالَ فَانْطَلِقْ إِلَى صَاحِبِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْهَا إِلَيْكَ وَأَطْعِمْ سِتِّينَ مِسْكِينًا وَسْقًا مِنْ تَمْرٍ وَكُلْ بَقِيَّتَهُ أَنْتَ وَعِيَالُكَ قَالَ فَأَتَيْتُ قَوْمِي فَقُلْتُ وَجَدْتُ عِنْدَكُمُ الضِّيقَ وَسُوءَ الرَّأْيِ وَوَجَدْتُ عِنْدَ رَسُولِ اللَّهِ ﷺ السَّعَةَ وَحُسْنَ الرَّأْيِ وَقَدْ أَمَرني بِصَدَقَتِكُمْ
12.10 [Machine] Three things to consider in divorced women: Housing, financial support
١٢۔١٠ بَابٌ فِي الْمُطَلَّقَةِ ثَلَاثًا أَلَهَا السُّكْنَى، وَالنَّفَقَةُ أَمْ لَا
[Machine] "Her husband divorced her three times, so the Prophet ﷺ did not provide her with maintenance or accommodation. Salama said that he mentioned this to Ibrahim, who said, 'Umar ibn al-Khattab said: We do not abandon the book of our Lord and the Sunnah of His Prophet based on the words of a woman, so he provided her with accommodation and maintenance.'"
أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا «فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ ﷺ نَفَقَةً وَلَا سُكْنَى» قَالَ سَلَمَةُ فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ فَقَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ فَجَعَلَ لَهَا السُّكْنَى وَالنَّفَقَةَ
[Machine] "That her husband divorced her three times, so the Prophet ﷺ ordered her to observe 'iddah (waiting period) at the house of her cousin, the son of her maternal aunt, Ibn Umm Maktum."
«أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَأَمَرَهَا النَّبِيُّ ﷺ أَنْ تَعْتَدَّ عِنْدَ ابْنِ عَمِّهَا ابْنِ أُمِّ مَكْتُومٍ»
[Machine] "We do not invalidate our scriptures and the practices of our Prophet by the statement of a divorced woman, who is granted housing and financial support."
«لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ الْمُطَلَّقَةُ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ»
The above mentioned tradition has also been transmitted by Ma’mar through a different chain of narrators to the same effect. (Using translation from Abū Dāʾūd 895)
عَنْ عُمَرَ نَحْوَهُ
[Machine] Umar said, "We do not allow a divorced woman to have the right to housing and financial support in the religion of Allah, three times for her. Abu Muhammad said, "I do not see housing and financial support for the divorced woman."
عُمَرُ «لَا نُجِيزُ قَوْلَ امْرَأَةٍ فِي دِينِ اللَّهِ الْمُطَلَّقَةُ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ» قَالَ أَبُو مُحَمَّد «لَا أَرَى السُّكْنَى وَالنَّفَقَةَ لِلْمُطَلَّقَةِ»

١٢۔١١ بَابٌ فِي عِدَّةِ الْحَامِلِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا وَالْمُطَلَّقَةِ
[Machine] He informed him that he and Ibn Abbas met with Abu Hurairah and they mentioned a man whose wife dies and he remarries after a few nights. Ibn Abbas said that her waiting period is the end of the two terms (the waiting period for pregnancy and for being widowed). Abu Salama said that when she gives birth, her waiting period ends. They disagreed about it, so Abu Hurairah said, "I am with my nephew's son, meaning Abu Salama." So they sent Kureib, the slave of Ibn Abbas, to Umm Salamah and he asked her. Umm Salamah mentioned that Subay'ah bint al-Harith al-Aslamiyah died and her husband passed away and after him she got her period after a few nights, and a man from Bani Abd Ad-Dar proposed to her and informed her that she had her period. She wanted to marry someone else, so Abu As-Sanabil said to her, "Indeed, you have not completed your waiting period." Subay'ah mentioned this to the Messenger of Allah ﷺ and he ordered her to get married.
أَخْبَرَهُ أَنَّهُ اجْتَمَعَ هُوَ وَابْنُ عَبَّاسٍ عِنْدَ أَبِي هُرَيْرَةَ فَذَكَرُوا الرَّجُلَ يُتَوَفَّى عَنِ الْمَرْأَةِ فَتَلِدُ بَعْدَهُ بِلَيَالٍ قَلَائِلَ فَقَالَ ابْنُ عَبَّاسٍ حِلُّهَا آخِرُ الْأَجَلَيْنِ وَقَالَ أَبُو سَلَمَةَ إِذَا وَضَعَتْ فَقَدْ حَلَّتْ فَتَرَاجَعَا فِي ذَلِكَ بَيْنَهُمَا فَقَالَ أَبُو هُرَيْرَةَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ فَسَأَلَهَا فَذَكَرَتْ أُمُّ سَلَمَةَ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ الْأَسْلَمِيَّةَ مَاتَ عَنْهَا زَوْجُهَا فَنَفِسَتْ بَعْدَهُ بِلَيَالٍ وَأَنَّ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ يُكَنَّى أَبَا السَّنَابِلِ خَطَبَهَا وَأَخْبَرَهَا أَنَّهَا قَدْ حَلَّتْ فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ فَقَالَ لَهَا أَبُو السَّنَابِلِ فَإِنَّكِ لَمْ تَحِلِّينَ فَذَكَرَتْ سُبَيْعَةُ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ «فَأَمَرَهَا أَنْ تَتَزَوَّجَ»
"Subai'ah gave birth a few days after her husband died, and the Messenger of Allah told her to get married." (Using translation from Nasāʾī 3513)
تُوُفِّيَ زَوْجُ سُبَيْعَةَ بِنْتِ الْحَارِثِ فَوَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَيَّامٍ «فَأَمَرَهَا رَسُولُ اللَّهِ ﷺ أَنْ تَتَزَوَّجَ»
"Subai'ah Aslamiyyah bint Harith gave birth twenty-odd days after her husband died. When her postnatal bleeding ended, she adorned herself, and was criticized for doing that. Her case was mentioned to the Prophet ﷺ and he said: 'If she does that, then her waiting period is over."' (Using translation from Ibn Mājah 2027)
وَضَعَتْ سُبَيْعَةُ بِنْتُ الْحَارِثِ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا بِبِضْعٍ وَعِشْرِينَ لَيْلَةً فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَشَوَّفَتْ فَعِيبَ ذَلِكَ عَلَيْهَا فَذُكِرَ أَمْرُهَا لِرَسُولِ اللَّهِ ﷺ فَقَالَ «إِنْ تَفْعَلْ فَقَدِ انْقَضَى أَجَلُهَا»
[Machine] "Sab'iyah had passed away a few days after her husband's death, so Abu Al-Sanabil noticed her and asked her if she had mentioned her situation to the Messenger of Allah ﷺ . He instructed her to get married."
أَنَّ سُبَيْعَةَ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَيَّامٍ فَتَشَوَّفَتْ فَعَابَ أَبُو السَّنَابِلِ فَسَأَلَتْ أَوْ ذَكَرَتْ أَمْرَهَا لِرَسُولِ اللَّهِ ﷺ؟ «فَأَمَرَهَا أَنْ تَتَزَوَّجَ»
12.12 [Machine] During a woman's mourning for her husband
١٢۔١٢ بَابٌ فِي إِحْدَادِ الْمَرْأَةِ عَلَى الزَّوْجِ
"It is not permissible for a woman who believes in Allah and the Last Day to mourn for more than three days, except for her husband." (Using translation from Nasāʾī 3526)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَوْ تُؤْمِنُ بِاللَّهِ أَنْ تَحِدَّ عَلَى أَحَدٍ فَوْقَ ثَلَاثَةِ أَيَّامٍ إِلَّا عَلَى زَوْجِهَا»
[Machine] "A brother or a close relative of hers passed away, so she rushed to make her hands disheveled and said, 'I am doing this because the Prophet ﷺ said, 'It is not permissible for a woman who believes in Allah and the Last Day to mourn for more than three days, except for her husband. In that case, she mourns for four months and ten days.'"
أَنَّ أَخًا لَهَا مَاتَ أَوْ حَمِيمًا لَهَا فَعَمَدَتْ إِلَى صُفْرَةٍ فَجَعَلَتْ تَمْسَحُ يَدَيْهَا وَقَالَتْ إِنَّمَا أَفْعَلُ هَذَا لِأَنَّ النَّبِيَّ ﷺ قَالَ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحِدَّ فَوْقَ ثَلَاثٍ إِلَّا عَلَى زَوْجِهَا فَإِنَّهَا تَحِدُّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا»
[Machine] About her mother or a woman from the Prophet's wives, similar to her.
عَنْ أُمِّهَا أَوِ امْرَأَةٍ مِنْ أَزْوَاجِ النَّبِيِّ ﷺ نَحْوَهُ
12.13 [Machine] Prohibition for a woman from adorning herself during the waiting period
١٢۔١٣ بَابُ النَّهْيِ لِلْمَرْأَةِ عَنِ الزِّينَةِ فِي الْعِدَّةِ
‘Umm Athiyah reported the Prophet ﷺ as saying “A woman must not observe mourning for more than three (days) except for four months and ten days in the case of a husband and she must not wear a dyed garment except one of the types made of dyed yarn or apply collyrium or touch perfume except for a little costus or azfar when she has been purified after her menstrual courses. The narrator Ya’qub mentioned the words “except washed clothes” instead of the words “one of the types made of dyed yarn”. Ya’qub also added “She must not apply Henna” (Using translation from Abū Dāʾūd 2302)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا تَحِدُّ الْمَرْأَةُ فَوْقَ ثَلَاثَةِ أَيَّامٍ إِلَّا عَلَى زَوْجٍ فَإِنَّهَا تَحِدُّ عَلَيْهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا لَا تَلْبَسُ ثَوْبًا مَصْبُوغًا إِلَّا ثَوْبَ عَصْبٍ وَلَا تَكْتَحِلُ وَلَا تَمَسُّ طِيبًا إِلَّا فِي أَدْنَى طُهْرِهَا إِذَا اغْتَسَلَتْ مِنْ مَحِيضِهَا نُبْذَةً مِنْ كُسْتٍ وَأَظْفَارٍ»
12.14 [Machine] The departure of her deceased husband from her.
١٢۔١٤ بَابُ خُرُوجِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا
[Machine] She asked the Messenger of Allah ﷺ for permission to return to her family. Her husband had gone out in search of a sustenance, so they decided to wait for him. They caught up with him when he was about to arrive and they killed him. The Messenger of Allah ﷺ said to her, "Stay in your house until the time appointed in the Quran." I said, "He did not leave for me a house that I own nor any provision." He said, "Stay until the time appointed in the Quran." So she observed 'Iddah (waiting period) for four months and ten days. When 'Uthman sent for me, he asked about this. I informed him of the situation, so he followed the same ruling and decreed accordingly.
أَنَّهَا سَأَلَتْ رَسُولَ اللَّهِ ﷺ أَنْ يَأْذَنَ لَهَا أَنْ تَرْجِعَ إِلَى أَهْلِهَا؟ فَإِنَّ زَوْجَهَا قَدْ خَرَجَ فِي طَلَبِ أَعْبُدٍ لَهُ أَبَقُوا فَأَدْرَكَهُمْ حَتَّى إِذَا كَانَ بِطَرَفِ الْقَدُومِ قَتَلُوهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «امْكُثِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» فَقُلْتُ إِنَّهُ لَمْ يَدَعْنِي فِي بَيْتٍ أَمْلِكُهُ وَلَا نَفَقَةٍ فَقَالَ «امْكُثِي حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» فَاعْتَدَّتْ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَتْ فَلَمَّا كَانَ عُثْمَانُ أَرْسَلَ إِلَيَّ فَسَأَلَنِي عَنْ ذَلِكَ؟ فَأَخْبَرْتُهُ فَاتَّبَعَ ذَلِكَ وَقَضَى بِهِ
[Machine] "So I went to the Prophet ﷺ and mentioned that to him. He said, 'Go out and suck the milk from your date palm tree, perhaps you may give charity or do a good deed.'"
فَأَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «اخْرُجِي فَجُدِّي نَخْلَكِ فَلَعَلَّكِ أَنْ تَصَدَّقِي أَوْ تَصْنَعِي مَعْرُوفًا»
12.15 [Machine] In the choice of the nation, it is under the slave, so it is freed.
١٢۔١٥ بَابٌ فِي تَخْيِيرِ الْأَمَةِ تَكُونُ تَحْتَ الْعَبْدِ فَتُعْتَقُ
she wanted to buy Barirah and set her free, but they stipulated that her loyally as a freed slave (wala') should be to them. She mentioned that to the Messenger of Allah and he said: "Buy her and set her fee, and loyally is due to the one who frees the slave." She was given the choice when she was freed. Some meat was brought to the Messenger of Allah and it was said: "This is something that is given in charity to Barirah." He said: "It is charity for her and gift for us." And her husband was a free man. (Using translation from Nasāʾī 2614)
أَنْ يَشْتَرِطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «اشْتَرِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» فَاشْتَرَتْهَا فَأَعْتَقَتْهَا وَخَيَّرَهَا مِنْ زَوْجِهَا وَكَانَ حُرًّا وَأَنَّ النَّبِيَّ ﷺ أُتِيَ بِلَحْمٍ فَقَالَ مِنْ أَيْنَ هَذَا؟ قِيلَ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
[Machine] The Prophet ﷺ entered upon me, so I brought him some food that did not contain meat. He said, "Did I not see a raised portion for you?" I said, "O Messenger of Allah, this is meat given as a charity to our slave girl who then gifted it to us." He said, "It is charity for her and a gift for us." She had a husband, so when she was freed, she was given the choice.
دَخَلَ النَّبِيُّ ﷺ عَلَيَّ فَقَرَّبْتُ إِلَيْهِ طَعَامًا لَيْسَ فِيهِ لَحْمٌ فَقَالَ «أَلَمْ أَرَ لَكُمْ قِدْرًا مَنْصُوبَةً» قُلْتُ يَا رَسُولَ اللَّهِ هَذَا لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْ لَنَا قَالَ «هُوَ عَلَيْهَا صَدَقَةٌ ولَنَا هَدِيَّةٌ» وَكَانَ لَهَا زَوْجٌ فَلَمَّا عُتِقَتْ خُيِّرَتْ
[Machine] "When Aisha freed Barira, her husband was still a slave. So the Messenger of Allah ﷺ encouraged her to stay with him. She said to the Messenger of Allah ﷺ, 'Shouldn't I separate from him?' He replied, 'Yes.' So she indeed separated from him."
أَنَّ بَرِيرَةَ حِينَ أَعْتَقَتْهَا عَائِشَةُ كَانَ زَوْجُهَا عَبْدًا فَجَعَلَ رَسُولُ اللَّهِ ﷺ يَحُضُّهَا عَلَيْهِ فَجَعَلَتْ تَقُولُ لِرَسُولِ اللَّهِ ﷺ أَلَيْسَ لِي أَنْ أُفَارِقَهُ؟ قَالَ «بَلَى» قَالَتْ فَقَدْ فَارَقْتُهُ
The husband of Barirah was a slave called Mughith. It is as if I can see him walking behind her weeping, with the tears running down onto his beard. The Prophet [SAW] said to Al-'Abbas: "O 'Abbas, are you not amazed by the love of Mughith for Barirah and the hatred of Barirah for Mughith?" The Messenger of Allah [SAW] said to her: "Why don't you take him back, for he is the father of your child?" She said: "O Messenger of Allah, are you commanding me (to do so)?" He said: "I am just interceding." She said: "I have no need of him." (Using translation from Nasāʾī 5417)
يُقَالُ لَهُ مُغِيثٌ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ يَا عَبَّاسُ «أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا» فَقَالَ لَهَا «لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ» فَقَالَتْ يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي؟ قَالَ «إِنَّمَا أَنَا شَافِعٌ» قَالَتْ لَا حَاجَةَ لِي فِيهِ
12.16 [Machine] In the child's dilemma between his parents
١٢۔١٦ بَابٌ فِي تَخْيِيرِ الصَّبِيِّ بَيْنَ أَبَوَيْهِ
[Machine] Narrated by Abu Maymuna Sulaiman, the servant of the people of Madinah, who said: I was with Abu Huraira when a woman came to him and said, "Indeed, my husband wants to take away my child." Abu Huraira said, "I was with the Messenger of Allah ﷺ when a woman came to him and said, 'Indeed, my husband wants to take away my child or my son, and he has benefited me and provided me with water from the well of Abu 'Inaba.' The Messenger of Allah ﷺ said, 'Bring your husband here.' So her husband came and said, 'Who will contend with me regarding my child or my son?' The Messenger of Allah ﷺ said, 'O young boy, this is your father and this is your mother, so take the hand of whoever you wish.' Abu Asim said, 'Follow whichever of them you wish.' So he took the hand of his mother and they left together."
عَنْ أَبِي مَيْمُونَةَ سُلَيْمَانَ مَوْلًى لِأَهْلِ الْمَدِينَةِ قَالَ كُنْتُ عِنْدَ أَبِي هُرَيْرَةَ فَجَاءَتْهُ امْرَأَةٌ فَقَالَتْ إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِوَلَدِي فَقَالَ أَبُو هُرَيْرَةَ كُنْتُ عِنْدَ رَسُولِ اللَّهِ ﷺ إِذْ جَاءَتْهُ امْرَأَةٌ فَقَالَتْ إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِوَلَدِي أَوْ بِابْنِي وَقَدْ نَفَعَنِي وَسَقَانِي مِنْ بِئْرِ أَبِي عِنَبَةَ فَقَالَ رَسُولُ اللَّهِ ﷺ اسْتَهِمَا أَوْ قَالَ تَسَاهَمَا أَبُو عَاصِمٍ الشَّاكُّ فَجَاءَ زَوْجُهَا فَقَالَ مَنْ يُخَاصِمُنِي فِي وَلَدِي أَوْ فِي ابْنِي؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «يَا غُلَامُ هَذَا أَبُوكَ وَهَذِهِ أُمُّكَ فَخُذْ بِيَدِ أَيِّهِمَا شِئْتَ» وَقَدْ قَالَ أَبُو عَاصِمٍ فَاتْبَعْ أَيَّهُمَا شِئْتَ فَأَخَذَ بِيَدِ أُمِّهِ فَانْطَلَقَتْ بِهِ
12.17 [Machine] In the divorce of the mother
١٢۔١٧ بَابٌ فِي طَلَاقِ الْأَمَةِ
[Machine] About the Prophet ﷺ, he said, "For women, there are two types of divorce and their recurrences during the period of menstruation." Abu Asim said, "I heard this from Muzahir."
عَنِ النَّبِيِّ ﷺ قَالَ «لِلْأَمَةِ تَطْلِيقَتَانِ وَقُرُوؤُهَا حَيْضَتَانِ» قَالَ أَبُو عَاصِمٍ سَمِعْتُهُ مِنْ مُظَاهِرٍ
12.18 [Machine] In the exception of the nation
١٢۔١٨ بَابٌ فِي اسْتِبْرَاءِ الْأَمَةِ
Abu Sa’id Al Khudri traced to Prophet ﷺ the following statement regarding the captives taken at Atwas. There must be no intercourse with pregnant woman till she gives birth to her child or with the one who is not pregnant till she has had one menstrual period. (Using translation from Abū Dāʾūd 2157)
أَنَّهُ قَالَ فِي سَبَايَا أَوْطَاسٍ «لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ حَمْلَهَا وَلَا غَيْرُ ذَاتِ حَمْلٍ حَتَّى تَحِيضَ حَيْضَةً»
