12. Book of Divorce
١٢۔ كِتَابُ الطَّلَاقِ
she wanted to buy Barirah and set her free, but they stipulated that her loyally as a freed slave (wala') should be to them. She mentioned that to the Messenger of Allah and he said: "Buy her and set her fee, and loyally is due to the one who frees the slave." She was given the choice when she was freed. Some meat was brought to the Messenger of Allah and it was said: "This is something that is given in charity to Barirah." He said: "It is charity for her and gift for us." And her husband was a free man. (Using translation from Nasāʾī 2614)
أَنْ يَشْتَرِطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «اشْتَرِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» فَاشْتَرَتْهَا فَأَعْتَقَتْهَا وَخَيَّرَهَا مِنْ زَوْجِهَا وَكَانَ حُرًّا وَأَنَّ النَّبِيَّ ﷺ أُتِيَ بِلَحْمٍ فَقَالَ مِنْ أَيْنَ هَذَا؟ قِيلَ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
[Machine] The Prophet ﷺ entered upon me, so I brought him some food that did not contain meat. He said, "Did I not see a raised portion for you?" I said, "O Messenger of Allah, this is meat given as a charity to our slave girl who then gifted it to us." He said, "It is charity for her and a gift for us." She had a husband, so when she was freed, she was given the choice.
دَخَلَ النَّبِيُّ ﷺ عَلَيَّ فَقَرَّبْتُ إِلَيْهِ طَعَامًا لَيْسَ فِيهِ لَحْمٌ فَقَالَ «أَلَمْ أَرَ لَكُمْ قِدْرًا مَنْصُوبَةً» قُلْتُ يَا رَسُولَ اللَّهِ هَذَا لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْ لَنَا قَالَ «هُوَ عَلَيْهَا صَدَقَةٌ ولَنَا هَدِيَّةٌ» وَكَانَ لَهَا زَوْجٌ فَلَمَّا عُتِقَتْ خُيِّرَتْ
[Machine] "When Aisha freed Barira, her husband was still a slave. So the Messenger of Allah ﷺ encouraged her to stay with him. She said to the Messenger of Allah ﷺ, 'Shouldn't I separate from him?' He replied, 'Yes.' So she indeed separated from him."
أَنَّ بَرِيرَةَ حِينَ أَعْتَقَتْهَا عَائِشَةُ كَانَ زَوْجُهَا عَبْدًا فَجَعَلَ رَسُولُ اللَّهِ ﷺ يَحُضُّهَا عَلَيْهِ فَجَعَلَتْ تَقُولُ لِرَسُولِ اللَّهِ ﷺ أَلَيْسَ لِي أَنْ أُفَارِقَهُ؟ قَالَ «بَلَى» قَالَتْ فَقَدْ فَارَقْتُهُ
The husband of Barirah was a slave called Mughith. It is as if I can see him walking behind her weeping, with the tears running down onto his beard. The Prophet [SAW] said to Al-'Abbas: "O 'Abbas, are you not amazed by the love of Mughith for Barirah and the hatred of Barirah for Mughith?" The Messenger of Allah [SAW] said to her: "Why don't you take him back, for he is the father of your child?" She said: "O Messenger of Allah, are you commanding me (to do so)?" He said: "I am just interceding." She said: "I have no need of him." (Using translation from Nasāʾī 5417)
يُقَالُ لَهُ مُغِيثٌ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ يَا عَبَّاسُ «أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا» فَقَالَ لَهَا «لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ» فَقَالَتْ يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي؟ قَالَ «إِنَّمَا أَنَا شَافِعٌ» قَالَتْ لَا حَاجَةَ لِي فِيهِ
