bukhari:2742Abū Nuʿaym > Sufyān > Saʿd b. Ibrāhīm > ʿĀmir b. Saʿd > Saʿd b. Abū Waqqāṣ

The Prophet ﷺ came visiting me while I was (sick) in Mecca, ('Amir the sub-narrator said, and he disliked to die in the land, whence he had already migrated). He (i.e. the Prophet) said, "May Allah bestow His Mercy on Ibn Afra (Saʿd bin Khaula)." I said, "O Messenger of Allah ﷺ! May I will all my property (in charity)?" He said, "No." I said, "Then may I will half of it?" He said, "No". I said, "One third?" He said: "Yes, one third, yet even one third is too much. It is better for you to leave your inheritors wealthy than to leave them poor begging others, and whatever you spend for Allah's sake will be considered as a charitable deed even the handful of food you put in your wife's mouth. Allah may lengthen your age so that some people may benefit by you, and some others be harmed by you." At that time Saʿd had only one daughter.  

البخاري:٢٧٤٢حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا سُفْيَانُ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ ؓ قَالَ

جَاءَ النَّبِيُّ ﷺ يَعُودُنِي وَأَنَا بِمَكَّةَ وَهْوَ يَكْرَهُ أَنْ يَمُوتَ بِالأَرْضِ الَّتِي هَاجَرَ مِنْهَا قَالَ يَرْحَمُ اللَّهُ ابْنَ عَفْرَاءَ قُلْتُ يَا رَسُولَ اللَّهِ أُوصِي بِمَالِي كُلِّهِ قَالَ لاَ قُلْتُ فَالشَّطْرُ قَالَ لاَ قُلْتُ الثُّلُثُ قَالَ فَالثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ وَإِنَّكَ مَهْمَا أَنْفَقْتَ مِنْ نَفَقَةٍ فَإِنَّهَا صَدَقَةٌ حَتَّى اللُّقْمَةُ الَّتِي تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ وَعَسَى اللَّهُ أَنْ يَرْفَعَكَ فَيَنْتَفِعَ بِكَ نَاسٌ وَيُضَرَّ بِكَ آخَرُونَ وَلَمْ يَكُنْ لَهُ يَوْمَئِذٍ إِلاَّ ابْنَةٌ

The Prophet ﷺ visited me at Mecca while I was ill. I said (to him), "I have property; May I bequeath all my property in Allah's Cause?" He said, "No." I said, "Half of it?" He said, "No." I said, "One third of it?" He said, "One-third (is alright), yet it is still too much, for you'd better leave your inheritors wealthy than leave them poor, begging of others. Whatever you spend will be considered a Sadaqa for you, even the mouthful of food you put in the mouth of your wife. Anyhow Allah may let you recover, so that some people may benefit by you and others be harmed by you."

Messenger of Allah ﷺ came to visit me during my ailment which had been aggravated during Hajjat-al- Wadaʿ. I said to him, "You see how sick I am. I have much property but have no heir except my only daughter May I give two thirds of my property in charity?"! He said, "No." I said, "Half of it?" He said, "No." I said "One third?" He said, "One third is too much, for to leave your heirs rich is better than to leave them poor, begging of others. Nothing you spend seeking Allah's pleasure but you shall get a reward for it, even for what you put in the mouth of your wife."  

البخاري:٥٦٦٨حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي سَلَمَةَ أَخْبَرَنَا الزُّهْرِيُّ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

"The Prophet used to visit him when he was in Makkah, and he did not want to die in the land from which he had emigrated. The Prophet said: 'May Allah have mercy on Sa'd bin 'Afra.' He had only one daughter, and he said: 'O Messenger of Allah, shall I bequeath all my wealth?' He said: 'No.' I said: 'Half?' He said: 'No.' I said: 'One-third?' He said: 'One-third, and one-third is a lot. For you to leave your heirs independent of means is better than if you were to leave them poor, holding out their hands to people.'"  

النسائي:٣٦٢٨أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

abudawud:2864ʿUthmān b. Abū Shaybah And Ibn Abū Khalaf > Sufyān > al-Zuhrī > ʿĀmir b. Saʿd from his father > Mariḍ Maraḍ

On the authority of his father (Sa'd b. Abi Waqqas): When he (Sa'd) fell ill at Mecca (according to the version of Ibn Abi Kkalaf) - then the agreed version has: which brought him near to death - the Messenger of Allah ﷺ went to visit him. He said: Messenger of Allah, I have a large amount of property, and my daughter is my only heir. May I give two-thirds (of my property) as a sadaqah (charity)? He said: No. He asked: Then a half ? He replied: No. He asked: Then one-third ? He replied: (You may will away) a third and third is a lot. To leave your heirs rich is better than to leave them poor begging from people. You will not spend anything, seeking thereby to please Allah, without being rewarded for it, even the mouthful you give your wife. I said: Messenger of Allah, shall I be left behind form immigration (to Medina)? He said: If you remain behind after me and do good works seeking the pleasure of Allah, your rank will be raised and degree increased. Perhaps you will not remain behind, and some people will benefit from you and others will be harmed by you. He then said: O Allah, complete the immigration of my Companions and do not turn them back. But miserable was Sa'd b. Khawlah. The Messenger of Allah ﷺ lamented on him as he died at Mecca.  

أبو داود:٢٨٦٤حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ وَابْنُ أَبِي خَلَفٍ قَالاَ حَدَّثَنَا سُفْيَانُ عَنِ الزُّهْرِيِّ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ مَرِضَ مَرَضًا قَالَ

ابْنُ أَبِي خَلَفٍ بِمَكَّةَ ثُمَّ اتَّفَقَا أَشْفَى فِيهِ فَعَادَهُ رَسُولُ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ لِي مَالاً كَثِيرًا وَلَيْسَ يَرِثُنِي إِلاَّ ابْنَتِي أَفَأَتَصَدَّقُ بِالثُّلُثَيْنِ قَالَ لاَ قَالَ فَبِالشَّطْرِ قَالَ لاَ قَالَ فَبِالثُّلُثِ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَتْرُكَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً إِلاَّ أُجِرْتَ بِهَا حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ قُلْتُ يَا رَسُولَ اللَّهِ أَتَخَلَّفُ عَنْ هِجْرَتِي قَالَ إِنَّكَ إِنْ تُخَلَّفْ بَعْدِي فَتَعْمَلْ عَمَلاً صَالِحًا تُرِيدُ بِهِ وَجْهَ اللَّهِ لاَ تَزْدَادُ بِهِ إِلاَّ رِفْعَةً وَدَرَجَةً لَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ ثُمَّ قَالَ اللَّهُمَّ أَمْضِ لأَصْحَابِي هِجْرَتَهُمْ وَلاَ تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنِ الْبَائِسُ سَعْدُ ابْنُ خَوْلَةَ يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أَنْ مَاتَ بِمَكَّةَ  

tirmidhi:2116Ibn Abū ʿUmar > Sufyān b. ʿUyaynah > al-Zuhrī > ʿĀmir b. Saʿd b. Abū Waqqāṣ from his father

"I was ill during the year of the Conquest (of Makkah) with an illness bringing me to the brink of death. So The Messenger of Allah ﷺ came to visit me, and I said: 'O Messenger of Allah ﷺ! Indeed I have a great deal of wealth and I do not have any heirs except my daughter, so should I will all of my wealth?' He said: 'No.' I said: 'Then two-thirds of my wealth?' He said: 'No.' I said: 'Then half?' He said: 'No.' I said: 'Then a third' He said: 'No.' A third and a third is too much. If you leave your heirs without need it is better than to leave them in poverty begging from the people. Indeed you do not do any spending (on your family) except that you are rewarded for it, even the morsel of food you raise to your wife's mouth.'" He said: "I said: 'Will I be left behind from my emigration?' He said: 'You will not be left behind after me,and do righteous deeds intending Allah's Face, except that it will add to your elevation in rank. Perhaps you will remain until some people benefit from you and others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them on their heels. But the case of Sa'd bin Khawlah is sad.'" the Messenger of Allah ﷺ felt sorry for him dying in Makkah.  

الترمذي:٢١١٦حَدَّثَنَا ابْنُ أَبِي عُمَرَ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنِ الزُّهْرِيِّ عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ عَنْ أَبِيهِ قَالَ

مَرِضْتُ عَامَ الْفَتْحِ مَرَضًا أَشْفَيْتُ مِنْهُ عَلَى الْمَوْتِ فَأَتَانِي رَسُولُ اللَّهِ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّ لِي مَالاً كَثِيرًا وَلَيْسَ يَرِثُنِي إِلاَّ ابْنَتِي أَفَأُوصِي بِمَالِي كُلِّهِ قَالَ لاَ قُلْتُ فَثُلُثَىْ مَالِي قَالَ لاَ قُلْتُ فَالشَّطْرُ قَالَ لاَ قُلْتُ فَالثُّلُثُ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً إِلاَّ أُجِرْتَ فِيهَا حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ أُخَلَّفُ عَنْ هِجْرَتِي قَالَ إِنَّكَ لَنْ تُخَلَّفَ بَعْدِي فَتَعْمَلَ عَمَلاً تُرِيدُ بِهِ وَجْهَ اللَّهِ إِلاَّ ازْدَدْتَ بِهِ رِفْعَةً وَدَرَجَةً وَلَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ اللَّهُمَّ أَمْضِ لأَصْحَابِي هِجْرَتَهُمْ وَلاَ تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنِ الْبَائِسُ سَعْدُ ابْنُ خَوْلَةَ يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أَنْ مَاتَ بِمَكَّةَ  

قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنِ ابْنِ عَبَّاسٍ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ هَذَا الْحَدِيثُ مِنْ غَيْرِ وَجْهٍ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ أَنَّهُ لَيْسَ لِلرَّجُلِ أَنْ يُوصِيَ بِأَكْثَرَ مِنَ الثُّلُثِ وَقَدِ اسْتَحَبَّ بَعْضُ أَهْلِ الْعِلْمِ أَنْ يَنْقُصَ مِنَ الثُّلُثِ لِقَوْلِ رَسُولِ اللَّهِ ﷺ وَالثُّلُثُ كَثِيرٌ
malik:37-4Mālik > Ibn Shihāb > ʿĀmir b. Saʿd b. Abū Waqqāṣ from his father

Malik related to me from Ibn Shihab from Amir ibn Sad ibn Abi Waqqas that his father said, "The Messenger of Allah ﷺ came to me to treat me for a pain which became hard to bear in the year of the farewell hajj. I said, 'Messenger of Allah, you can see how far the pain has reached me. I have property and only my daughter inherits from me. Shall I give two thirds of my property as sadaqa?' The Messenger of Allah ﷺ said, 'No.' I said, 'Half?' He said, 'No.' Then the Messenger of Allah ﷺ said, 'A third, and a third is a lot. Leaving your heirs rich is better than leaving them poor to beg from people. You never spend anything on maintenance desiring the Face of Allah by it, but that you are rewarded for it, even what you appoint for your wife.' Sad said, 'Messenger of Allah, will I be left here in Makka after my companions have departed for Madina?' The Messenger of Allah ﷺ said, 'If you are left behind, and do sound deeds you will increase your degree and elevation by them. Perhaps you will be left behind so that some people may benefit by you and others may be harmed by you. O Allah! complete their hijra for my companions, and do not turn them back on their heels. The unfortunate one is Said ibn Khawla.' The Messenger of Allah ﷺ was distressed on his account for he had died at Makka." Yahya said that he heard Malik speak about a man who willed a third of his property to a man and said as well, "My slave will serve so-and-so (another man) for as long as he lives, then he is free," then that was looked into, and the slave was found to be a third of the property of the deceased. Malik said, "The service of the slave is evaluated. Then the two of them divide it between them. The one who was willed a third takes his third, as a share, and the one who was willed the service of the slave takes what was evaluated for him of the slave's service. Each of them takes, from the service of the slave or from his wage if he has a wage, according to his share. If the one who was given the service of the slave for as long as he lived dies, then the slave is freed." Yahya said that he heard Malik speak about someone who willed his third and said "So-and-so has such- and-such, and so-and-so has such-and-such," naming some of his property, and his heirs protested that it was more than a third." Malik said, "The heirs then have an option between giving the beneficiaries their full bequests and taking the rest of the property of the deceased, or between dividing among the beneficiaries the third of the property of the deceased and surrendering to them their third. If they wish, their rights in it reach as far as they reach."

أنَّهُ قالَ: جاءَنِي رَسُولُ اللَّهِ ﷺ يَعُودُنِي عامَ حَجَّةِ الوَداعِ. مِن وجَعٍ اشْتَدَّ بِي. فَقُلْتُ: يا رَسُولَ اللَّهِ قَدْ بَلَغَ بِي مِنَ الوَجَعِ ما تَرى. وأنا ذُو مالٍ. ولا يَرِثُنِي إلّا ابْنَةٌ لِي. أفَأتَصَدَّقُ بِثُلُثَيْ مالِي؟ قالَ رَسُولُ اللَّهِ ﷺ: «لا»، فَقُلْتُ: فالشَّطْرُ؟ قالَ: «لا»، ثُمَّ قالَ رَسُولُ اللَّهِ ﷺ: «الثُّلُثُ، والثُّلُثُ كَثِيرٌ، إنَّكَ أنْ تَذَرَ ورَثَتَكَ أغْنِياءَ، خَيْرٌ مِن أنْ تَذَرَهُمْ عالَةً يَتَكَفَّفُونَ النّاسَ. وإنَّكَ لَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِها وجْهَ اللَّهِ، إلّا أُجِرْتَ. حَتّى ما تَجْعَلُ فِي فِي امْرَأتِكَ» قالَ، فَقُلْتُ: يا رَسُولَ اللَّهِ أأُخَلَّفُ بَعْدَ أصْحابِي؟ فَقالَ رَسُولُ اللَّهِ ﷺ: «إنَّكَ لَنْ تُخَلَّفَ، فَتَعْمَلَ عَمَلًا صالِحًا، إلّا ازْدَدْتَ بِهِ دَرَجَةً ورِفْعَةً، ولَعَلَّكَ أنْ تُخَلَّفَ حَتّى يَنْتَفِعَ بِكَ أقْوامٌ ويُضَرَّ بِكَ آخَرُونَ، اللَّهُمَّ أمْضِ لِأصْحابِي هِجْرَتَهُمْ، ولا تَرُدَّهُمْ عَلى أعْقابِهِمْ. لَكِنِ البائِسُ سَعْدُ بْنُ خَوْلَةَ. يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أنْ ماتَ بِمَكَّةَ» قالَ يَحْيى: سَمِعْتُ مالِكًا يَقُولُ: فِي الرَّجُلِ يُوصِي بِثُلُثِ مالِهِ لِرَجُلٍ. ويَقُولُ غُلامِي يَخْدُمُ فُلانًا ما عاشَ. ثُمَّ هُوَ حُرٌّ. فَيُنْظَرُ فِي ذَلِكَ، فَيُوجَدُ العَبْدُ ثُلُثَ مالِ المَيِّتِ. قالَ: «فَإنَّ خِدْمَةَ العَبْدِ تُقَوَّمُ، ثُمَّ يَتَحاصّانِ. يُحاصُّ الَّذِي أُوصِيَ لَهُ بِالثُّلُثِ بِثُلُثِهِ. ويُحاصُّ الَّذِي أُوصِيَ لَهُ بِخِدْمَةِ العَبْدِ. بِما قُوِّمَ لَهُ مِن خِدْمَةِ العَبْدِ، فَيَأْخُذُ كُلُّ واحِدٍ مِنهُما مِن خِدْمَةِ العَبْدِ، أوْ مِن إجارَتِهِ، إنْ كانَتْ لَهُ إجارَةٌ، بِقَدْرِ حِصَّتِهِ. فَإذا ماتَ الَّذِي جُعِلَتْ لَهُ خِدْمَةُ العَبْدِ ما عاشَ، عَتَقَ العَبْدُ» قالَ: وسَمِعْتُ مالِكًا يَقُولُ، فِي الَّذِي يُوصِي فِي ثُلُثِهِ فَيَقُولُ لِفُلانٍ كَذا وكَذا ولِفُلانٍ كَذا وكَذا يُسَمِّي مالًا مِن مالِهِ فَيَقُولُ ورَثَتُهُ قَدْ زادَ عَلى ثُلُثِهِ: «فَإنَّ الوَرَثَةَ يُخَيَّرُونَ بَيْنَ أنْ يُعْطُوا أهْلَ الوَصايا وصاياهُمْ ويَأْخُذُوا جَمِيعَ مالِ المَيِّتِ وبَيْنَ أنْ يَقْسِمُوا لِأهْلِ الوَصايا ثُلُثَ مالِ المَيِّتِ فَيُسَلِّمُوا إلَيْهِمْ ثُلُثَهُ فَتَكُونُ حُقُوقُهُمْ فِيهِ إنْ أرادُوا بالِغًا ما بَلَغَ»

[Machine] The Prophet ﷺ visited him while he was sick in Makkah, so I said, "O Messenger of Allah, shall I bequeath all my wealth?" He said, "No." I said, "Shall I bequeath half of it?" He said, "No." I said, "Shall I bequeath one-third of it?" He said, "One-third and even one-third is a lot. It is better for you to leave your heirs wealthy than to leave them poor, forcing people to provide for them. And no matter how much you spend on your family, you will be rewarded for it, even for a morsel of food that you raise to your wife's mouth." He said, "At that time, he had only one daughter." Saad mentioned hijrah (migration) and said, "May Allah have mercy on Ibn 'Afrah. Perhaps Allah will raise your rank until a group benefits from you while others are harmed."  

أحمد:١٤٨٢حَدَّثَنَا وَكِيعٌ حَدَّثَنَا مِسْعَرٌ وَسُفْيَانُ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ قَالَ سُفْيَانُ عَنْ عَامِرِ بْنِ سَعْدٍ وَقَالَ مِسْعَرٌ عَنْ بَعْضِ آلِ سَعْدٍعَنْ سَعْدٍ

أَنَّ النَّبِيَّ ﷺ دَخَلَ عَلَيْهِ يَعُودُهُ وَهُوَ مَرِيضٌ بِمَكَّةَ فَقُلْتُ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ لَا قُلْتُ فَبِالشَّطْرِ؟ قَالَ لَا قُلْتُ فَبِالثُّلُثِ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَبِيرٌ أَوْ كَثِيرٌ إِنَّكَ أَنْ تَدَعَ وَارِثَكَ غَنِيًّا خَيْرٌ مِنْ أَنْ تَدَعَهُ فَقِيرًا يَتَكَفَّفُ النَّاسَ وَإِنَّكَ مَهْمَا أَنْفَقْتَ عَلَى أَهْلِكَ مِنْ نَفَقَةٍ فَإِنَّكَ تُؤْجَرُ فِيهَا حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ قَالَ وَلَمْ يَكُنْ لَهُ يَوْمَئِذٍ إِلا ابْنَةٌ فَذَكَرَ سَعْدٌ الْهِجْرَةَ فَقَالَ يَرْحَمُ اللهُ ابْنَ عَفْرَاءَ وَلَعَلَّ اللهَ يَرْفَعُكَ حَتَّى يَنْتَفِعَ بِكَ قَوْمٌ وَيُضَرَّ بِكَ آخَرُونَ

"The Prophet used to visit him when he was in Makkah, and he did not want to die in the land from which he had emigrated. The Prophet said: 'May Allah have mercy on Sa'd bin 'Afra.' He had only one daughter, and he said: 'O Messenger of Allah, shall I bequeath all my wealth?' He said: 'No.' I said: 'Half?' He said: 'No.' I said: 'One-third?' He said: 'One-third, and one-third is a lot. For you to leave your heirs independent of means is better than if you were to leave them poor, holding out their hands to people.'" أحمد:١٤٨٨حَدَّثَنَا عَبْدُ الرَّحْمَنِ عَنْ سُفْيَانَ عَنْ سَعْدٍ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

جَاءَهُ النَّبِيُّ ﷺ يَعُودُهُ وَهُوَ بِمَكَّةَ وَهُوَ يَكْرَهُ أَنْ يَمُوتَ بِالْأَرْضِ الَّتِي هَاجَرَ مِنْهَا فَقَالَ النَّبِيُّ ﷺ يَرْحَمُ اللهُ سَعْدَ ابْنَ عَفْرَاءَ يَرْحَمُ اللهُ سَعْدَ ابْنَ عَفْرَاءَ وَلَمْ يَكُنْ لَهُ إِلا ابْنَةٌ وَاحِدَةٌ فَقَالَ يَا رَسُولَ اللهِ ﷺ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ لَا قَالَ فَالنِّصْفُ؟ قَالَ لَا قَالَ فَالثُّلُثُ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ وَإِنَّكَ مَهْمَا أَنْفَقْتَ مِنْ نَفَقَةٍ فَإِنَّهَا صَدَقَةٌ حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ وَلَعَلَّ اللهَ أَنْ يَرْفَعَكَ فَيَنْتَفِعَ بِكَ نَاسٌ وَيُضَرَّ بِكَ آخَرُونَ

[Machine] "I complained to the Prophet ﷺ during the Farewell Pilgrimage, until at one point he came to visit me. I said, 'O Messenger of Allah, I only see myself suffering and I possess a lot of wealth, and my daughter will inherit from me. Should I give all my wealth in charity?' He said, 'No.' I said, 'Then half of it?' He replied, 'No.' I asked, 'Then a third?' He said, 'A third and even a third is a lot. Indeed, if you leave your inheritors wealthy, it is better than leaving them destitute, begging people with their hands. And every expenditure you make, Allah will reward you for it, even the morsel you put in your wife's mouth.'"  

الدارمي:٣٢٣٩أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ الزُّهْرِيِّ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

اشْتَكَيْتُ مَعَ النَّبِيِّ ﷺ فِي حَجَّةِ الْوَدَاعِ حَتَّى إِذَا أُدْنِفْتُ فَدَخَلَ عَلَيَّ رَسُولُ اللَّهِ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللَّهِ مَا أُرَانِي إِلَّا أُلِمَّ بِي وَأَنَا ذُو مَالٍ كَثِيرٍ وَإِنَّمَا يَرِثُنِي ابْنَةٌ لِي أَفَأَتَصَدَّقُ بِمَالِي كُلِّهِ؟ قَالَ «لَا» قُلْتُ فَنِصْفِهِ قَالَ «لَا» قُلْتُ فَالثُّلُثِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَتْرُكْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَتْرُكَهُمْ فُقَرَاءَ يَتَكَفَّفُونَ النَّاسَ بِأَيْدِيهِمْ وَإِنَّكَ لَا تُنْفِقُ نَفَقَةً إِلَّا آجَرَكَ اللَّهُ فِيهَا حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ»  

ibnhibban:6026ʿUmar b. Saʿīd b. Sinān > Aḥmad b. Abū Bakr > Mālik > Ibn Shihāb > ʿĀmir b. Saʿd b. Abū Waqqāṣ from his father

That his father said, "In the year of the last Hajj of the Prophet ﷺ I became seriously ill and the Prophet ﷺ used to visit me inquiring about my health. I told him, 'I am reduced to this state because of illness and I am wealthy and have no inheritors except a daughter, (In this narration the name of 'Amir bin Saʿd is mentioned and in fact it is a mistake; the narrator is ʿAisha bint Saʿd bin Abi Waqqas). Should I give two-thirds of my property in charity?' He said, 'No.' I asked, 'Half?' He said, 'No.' then he added, 'Onethird, and even one-third is much. You'd better leave your inheritors wealthy rather than leaving them poor, begging others. You will get a reward for whatever you spend for Allah's sake, even for what you put in your wife's mouth.' I said, 'O Messenger of Allah ﷺ! Will I be left alone after my companions have gone?' He said, 'If you are left behind, whatever good deeds you will do will upgrade you and raise you high. And perhaps you will have a long life so that some people will be benefited by you while others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them renegades.' But Messenger of Allah ﷺ felt sorry for poor Saʿd bin Khaula as he died in Mecca." (but Saʿd bin Abi Waqqas lived long after the Prophet ﷺ.) (Using translation from Bukhārī 1295)  

ابن حبّان:٦٠٢٦أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ قَالَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ عَنْ أَبِيهِ

أَنَّهُ قَالَ جَاءَنِي رَسُولُ اللَّهِ ﷺ يَعُودُنِي عَامَ حَجَّةِ الْوَدَاعِ مِنْ وَجَعٍ اشْتَدَّ بِي فَقُلْتُ يَا رَسُولَ اللَّهِ بَلَغَ بِي مِنَ الْوَجَعِ مَا تَرَيْ وَأَنَا ذُو مَالٍ وَلَا يَرِثُنِي إِلَّا ابْنَةٌ لِي أَفَأَتَصَدَّقُ بِثُلُثَيْ مَالِي؟ قَالَ «لَا» قُلْتُ فَبِشَطْرِهِ؟ قَالَ «لَا» ثُمَّ قَالَ «الثُّلُثُ وَالثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ إِنَّكَ إِنْ تَذَرْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ يَكُونُوا عَالَةً يَتَكَفَّفُونَ النَّاسَ وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِهَا وَجْهَ اللَّهِ إِلَّا أُجِرْتَ بِهِ حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ» فَقُلْتُ يَا رَسُولَ اللَّهِ أُخَلَّفُ بَعْدَ أَصْحَابِي؟ قَالَ «إِنَّكَ لَنْ تُخَلَّفَ فَتَعْمَلَ عَمَلًا صَالِحًا تَبْتَغِي بِهِ وَجْهَ اللَّهِ إِلَّا ازْدَدْتَ بِهِ دَرَجَةً وَرِفْعَةً وَلَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ اللَّهُمَّ أَمْضِ لِأَصْحَابِي هِجْرَتَهُمْ وَلَا تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنَّ الْبَائِسَ سَعْدَ بْنَ خَوْلَةَ» يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أَنْ مَاتَ بِمَكَّةَ

[Machine] The Prophet ﷺ came to me and visited me. He disliked the idea of dying in the land he had migrated from so I asked him, "O Messenger of Allah, should I bequeath all my wealth?" He replied, "No." I asked, "Then should I bequeath half of it?" He again replied, "No." I asked, "Should I bequeath one third of it?" He replied, "Yes, and one third is still a lot. Verily, if you leave your heirs rich, it is better for them than leaving them in need, begging people with their hands. And no matter what you spend, it is considered as charity, even if it is just a morsel that you raise to your wife. Perhaps Allah will elevate you and benefit others through you, while harming other people." And Abu Abdullah Al-Hafiz informed us, narrating from Abu Amr Uthman ibn Ahmad ibn As-Sammak, narrating from Hanbal ibn Ishaq ibn Hanbal, narrating from Abu Nuaim, narrating from Sufyan ibn Saeed. He mentioned it with his chain of narrators, except that he said, "He visited me while I was ill in Mecca and he disliked the idea of dying in the land he had migrated from." Then he said, "May Allah have mercy on Ibn Afra." And he mentioned it.  

البيهقي:١٧٧٨٠أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ دُحَيْمٍ ثنا أَحْمَدُ بْنُ حَازِمٍ ثنا ابْنُ أَبِي غَرَزَةَ ثنا عَبْدُ اللهِ هُوَ أَبُو نُعَيْمٍ عَنْ سُفْيَانَ الثَّوْرِيِّ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ سَعْدِ بْنِ مَالِكٍ ؓ قَالَ

جَاءَنِي النَّبِيُّ ﷺ يَعُودُنِي وَكَانَ يَكْرَهُ أَنْ يَمُوتَ بِالْأَرْضِ الَّتِي هَاجَرَ مِنْهَا فَقُلْتُ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ لَا قُلْتُ فَالشَّطْرِ؟ قَالَ لَا قُلْتُ فَالثُّلُثِ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ لَهُمْ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ بِأَيْدِيهِمْ وَإِنَّكَ مَهْمَا أَنْفَقْتَ مِنْ نَفَقَةٍ فَإِنَّهَا صَدَقَةٌ حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ وَلَعَلَّ اللهَ أَنْ يَرْفَعَكَ فَيَنْتَفِعَ بِكَ أُنَاسٌ وَيُضَرَّ بِكَ آخَرُونَ 17781 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو عَمْرٍو عُثْمَانُ بْنُ أَحْمَدَ بْنِ السَّمَّاكِ ثنا حَنْبَلُ بْنُ إِسْحَاقَ بْنِ حَنْبَلٍ ثنا أَبُو نُعَيْمٍ ثنا سُفْيَانُ بْنُ سَعِيدٍ فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ إِلَّا أَنَّهُ قَالَ يَعُودُنِي وَأَنَا مَرِيضٌ بِمَكَّةَ وَهُوَ يَكْرَهُ أَنْ يَمُوتَ بِالْأَرْضِ الَّتِي هَاجَرَ مِنْهَا فَقَالَ يَرْحَمُكَ اللهُ ابْنَ عَفْرَاءَ ثُمَّ ذَكَرَهُ

The Prophet ﷺ came visiting me while I was (sick) in Mecca, ('Amir the sub-narrator said, and he disliked to die in the land, whence he had already migrated). He (i.e. the Prophet) said, "May Allah bestow His Mercy on Ibn Afra (Saʿd bin Khaula)." I said, "O Messenger of Allah ﷺ! May I will all my property (in charity)?" He said, "No." I said, "Then may I will half of it?" He said, "No". I said, "One third?" He said: "Yes, one third, yet even one third is too much. It is better for you to leave your inheritors wealthy than to leave them poor begging others, and whatever you spend for Allah's sake will be considered as a charitable deed even the handful of food you put in your wife's mouth. Allah may lengthen your age so that some people may benefit by you, and some others be harmed by you." At that time Saʿd had only one daughter. (Using translation from Bukhārī 2742)   

البيهقي:١٥٦٩٦أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَبُو الْقَاسِمِ سُلَيْمَانُ بْنُ أَحْمَدَ اللَّخْمِيُّ ثنا ابْنُ أَبِي مَرْيَمَ ثنا الْفِرْيَابِيُّ ح قَالَ وَأنبأ سُلَيْمَانُ ثنا مُعَاذُ بْنُ الْمُثَنَّى نا ابْنُ كَثِيرٍ ح قَالَ وَأَخْبَرَنَا سُلَيْمَانُ نا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ نا أَبُو نُعَيْمٍ قَالُوا نا سُفْيَانُ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ ؓ قَالَ

جَاءَ النَّبِيُّ ﷺ يَعُودُنِي وَأَنَا بِمَكَّةَ وَهُوَ يَكْرَهُ أَنْ يَمُوتَ أَحَدُنَا بِالْأَرْضِ الَّتِي هَاجَرَ مِنْهَا فَقَالَ يَرْحَمُ اللهُ ﷻ ابْنَ عَفْرَاءَ قُلْتُ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ قَالَ لَا قُلْتُ فَبِالشَّطْرِ قَالَ لَا قُلْتُ فَبِالثُّلُثِ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ وَإِنَّكَ مَهْمَا أَنْفَقْتَ عَلَى أَهْلِكَ مِنْ نَفَقَةٍ فَإِنَّهَا صَدَقَةٌ حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ وَعَسَى الله ﷻ أَنْ يَنْفَعَ بِكَ قَوْمًا وَيَضُرَّ بِكَ آخَرِينَ وَلَمْ يَكُنْ لَهُ يَوْمَئِذٍ إِلَّا ابْنَةٌ

"عَنْ عُمَرَ بنِ سَعْدٍ عَنْ سَعْدٍ: أَنَّ النَّبِىَّ ﷺ جَاءَهُ يَعُودُه وَهُوَ يَكْرَهُ أَنْ يَمُوتَ بالأَرْضِ الَّتى هَاجَرَ مِنْهَا، قَالَ: يَا رَسُولَ اللهِ! أُوصِى بِمَالِى كُلِّهِ؟ قَالَ: لَا، قَالَ فَالشَّطْرُ؟ قَالَ: لَا: ، قَالَ: فَالثُّلُثُ، والثُّلُثُ كَثِيرٌ. إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ بِخَيْرٍ خَيْرٌ لَكَ مِنْ أنْ تَدعَهُم عَالَةً يَتَكَفَّفُونَ النَّاسَ مَا فِى أَيْدِيهِمْ، مَهْمَا أنْفَقْتَ مِنْ نَفَقَةٍ فَإِنَّهَا صَدَقَةٌ، حَتَّى اللُّقْمَة تَرْفَعُهَا إِلَى فِى امْرَأَتِكَ".
