Messenger of Allah ﷺ came to visit me during my ailment which had been aggravated during Hajjat-al- Wadaʿ. I said to him, "You see how sick I am. I have much property but have no heir except my only daughter May I give two thirds of my property in charity?"! He said, "No." I said, "Half of it?" He said, "No." I said "One third?" He said, "One third is too much, for to leave your heirs rich is better than to leave them poor, begging of others. Nothing you spend seeking Allah's pleasure but you shall get a reward for it, even for what you put in the mouth of your wife."  

البخاري:٥٦٦٨حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي سَلَمَةَ أَخْبَرَنَا الزُّهْرِيُّ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

جَاءَنَا رَسُولُ اللَّهِ ﷺ يَعُودُنِي مِنْ وَجَعٍ اشْتَدَّ بِي زَمَنَ حَجَّةِ الْوَدَاعِ فَقُلْتُ بَلَغَ بِي مَا تَرَى وَأَنَا ذُو مَالٍ وَلاَ يَرِثُنِي إِلاَّ ابْنَةٌ لِي أَفَأَتَصَدَّقُ بِثُلُثَىْ مَالِي قَالَ لاَ قُلْتُ بِالشَّطْرِ قَالَ لاَ قُلْتُ الثُّلُثُ قَالَ الثُّلُثُ كَثِيرٌ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَذَرَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ وَلَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِهَا وَجْهَ اللَّهِ إِلاَّ أُجِرْتَ عَلَيْهَا حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ

That his father said, "In the year of the last Hajj of the Prophet ﷺ I became seriously ill and the Prophet ﷺ used to visit me inquiring about my health. I told him, 'I am reduced to this state because of illness and I am wealthy and have no inheritors except a daughter. Should I give two-thirds of my property in charity?' He said, 'No.' I asked, 'Half?' He said, 'No.' then he added, 'One-third, and even one-third is much. You'd better leave your inheritors wealthy rather than leaving them poor, begging others. You will get a reward for whatever you spend for Allah's sake, even for what you put in your wife's mouth.'

I said, 'O Messenger of Allah ﷺ! Will I be left alone after my companions have gone?' He said, 'If you are left behind, whatever good deeds you will do will upgrade you and raise you high. And perhaps you will have a long life so that some people will be benefited by you while others will be harmed by you. O Allah! Complete the emigration of my companions and do not cause them to turn on their heels.' Saʿd b. Khaulah ˹another companion˺ was unfortunate and the Messenger of Allah ﷺ lamented his death as he died in Makkah." ˹but Saʿd b. Abū Waqqas lived long after the Prophet ﷺ.˺  

البخاري:١٢٩٥حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ عَنْ أَبِيهِ ؓ قَالَ

كَانَ رَسُولُ اللَّهِ ﷺ يَعُودُنِي عَامَ حَجَّةِ الْوَدَاعِ مِنْ وَجَعٍ اشْتَدَّ بِي فَقُلْتُ: إِنِّي قَدْ بَلَغَ بِي مِنَ الْوَجَعِ وَأَنَا ذُو مَالٍ وَلاَ يَرِثُنِي إِلاَّ ابْنَةٌ، أَفَأَتَصَدَّقُ بِثُلُثَىْ مَالِي؟ قَالَ: «لاَ۔» فَقُلْتُ: بِالشَّطْرِ؟ فَقَالَ: «لاَ۔» ثُمَّ قَالَ: «الثُّلُثُ، وَالثُّلْثُ كَبِيرٌ۔» أَوْ «كَثِيرٌ۔ إِنَّكَ أَنْ تَذَرَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَذَرَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ، وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِهَا وَجْهَ اللَّهِ إِلاَّ أُجِرْتَ بِهَا حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ۔»

فَقُلْتُ: يَا رَسُولَ اللَّهِ، أُخَلَّفُ بَعْدَ أَصْحَابِي؟ قَالَ: «إِنَّكَ لَنْ تُخَلَّفَ، فَتَعْمَلَ عَمَلاً صَالِحًا إِلاَّ ازْدَدْتَ بِهِ دَرَجَةً وَرِفْعَةً ثُمَّ لَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ، اللَّهُمَّ أَمْضِ لأَصْحَابِي هِجْرَتَهُمْ وَلاَ تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ۔» لَكِنِ الْبَائِسُ سَعْدُ ابْنُ خَوْلَةَ يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أَنْ مَاتَ بِمَكَّةَ

The Prophet ﷺ came visiting me while I was (sick) in Mecca, ('Amir the sub-narrator said, and he disliked to die in the land, whence he had already migrated). He (i.e. the Prophet) said, "May Allah bestow His Mercy on Ibn Afra (Saʿd bin Khaula)." I said, "O Messenger of Allah ﷺ! May I will all my property (in charity)?" He said, "No." I said, "Then may I will half of it?" He said, "No". I said, "One third?" He said: "Yes, one third, yet even one third is too much. It is better for you to leave your inheritors wealthy than to leave them poor begging others, and whatever you spend for Allah's sake will be considered as a charitable deed even the handful of food you put in your wife's mouth. Allah may lengthen your age so that some people may benefit by you, and some others be harmed by you." At that time Saʿd had only one daughter.  

البخاري:٢٧٤٢حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا سُفْيَانُ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ ؓ قَالَ

جَاءَ النَّبِيُّ ﷺ يَعُودُنِي وَأَنَا بِمَكَّةَ وَهْوَ يَكْرَهُ أَنْ يَمُوتَ بِالأَرْضِ الَّتِي هَاجَرَ مِنْهَا قَالَ يَرْحَمُ اللَّهُ ابْنَ عَفْرَاءَ قُلْتُ يَا رَسُولَ اللَّهِ أُوصِي بِمَالِي كُلِّهِ قَالَ لاَ قُلْتُ فَالشَّطْرُ قَالَ لاَ قُلْتُ الثُّلُثُ قَالَ فَالثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ وَإِنَّكَ مَهْمَا أَنْفَقْتَ مِنْ نَفَقَةٍ فَإِنَّهَا صَدَقَةٌ حَتَّى اللُّقْمَةُ الَّتِي تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ وَعَسَى اللَّهُ أَنْ يَرْفَعَكَ فَيَنْتَفِعَ بِكَ نَاسٌ وَيُضَرَّ بِكَ آخَرُونَ وَلَمْ يَكُنْ لَهُ يَوْمَئِذٍ إِلاَّ ابْنَةٌ  

malik:37-4Mālik > Ibn Shihāb > ʿĀmir b. Saʿd b. Abū Waqqāṣ from his father

Malik related to me from Ibn Shihab from Amir ibn Sad ibn Abi Waqqas that his father said, "The Messenger of Allah ﷺ came to me to treat me for a pain which became hard to bear in the year of the farewell hajj. I said, 'Messenger of Allah, you can see how far the pain has reached me. I have property and only my daughter inherits from me. Shall I give two thirds of my property as sadaqa?' The Messenger of Allah ﷺ said, 'No.' I said, 'Half?' He said, 'No.' Then the Messenger of Allah ﷺ said, 'A third, and a third is a lot. Leaving your heirs rich is better than leaving them poor to beg from people. You never spend anything on maintenance desiring the Face of Allah by it, but that you are rewarded for it, even what you appoint for your wife.' Sad said, 'Messenger of Allah, will I be left here in Makka after my companions have departed for Madina?' The Messenger of Allah ﷺ said, 'If you are left behind, and do sound deeds you will increase your degree and elevation by them. Perhaps you will be left behind so that some people may benefit by you and others may be harmed by you. O Allah! complete their hijra for my companions, and do not turn them back on their heels. The unfortunate one is Said ibn Khawla.' The Messenger of Allah ﷺ was distressed on his account for he had died at Makka." Yahya said that he heard Malik speak about a man who willed a third of his property to a man and said as well, "My slave will serve so-and-so (another man) for as long as he lives, then he is free," then that was looked into, and the slave was found to be a third of the property of the deceased. Malik said, "The service of the slave is evaluated. Then the two of them divide it between them. The one who was willed a third takes his third, as a share, and the one who was willed the service of the slave takes what was evaluated for him of the slave's service. Each of them takes, from the service of the slave or from his wage if he has a wage, according to his share. If the one who was given the service of the slave for as long as he lived dies, then the slave is freed." Yahya said that he heard Malik speak about someone who willed his third and said "So-and-so has such- and-such, and so-and-so has such-and-such," naming some of his property, and his heirs protested that it was more than a third." Malik said, "The heirs then have an option between giving the beneficiaries their full bequests and taking the rest of the property of the deceased, or between dividing among the beneficiaries the third of the property of the deceased and surrendering to them their third. If they wish, their rights in it reach as far as they reach."  

مالك:٣٧-٤حَدَّثَنِي مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ عَنْ أَبِيهِ

أنَّهُ قالَ: جاءَنِي رَسُولُ اللَّهِ ﷺ يَعُودُنِي عامَ حَجَّةِ الوَداعِ. مِن وجَعٍ اشْتَدَّ بِي. فَقُلْتُ: يا رَسُولَ اللَّهِ قَدْ بَلَغَ بِي مِنَ الوَجَعِ ما تَرى. وأنا ذُو مالٍ. ولا يَرِثُنِي إلّا ابْنَةٌ لِي. أفَأتَصَدَّقُ بِثُلُثَيْ مالِي؟ قالَ رَسُولُ اللَّهِ ﷺ: «لا»، فَقُلْتُ: فالشَّطْرُ؟ قالَ: «لا»، ثُمَّ قالَ رَسُولُ اللَّهِ ﷺ: «الثُّلُثُ، والثُّلُثُ كَثِيرٌ، إنَّكَ أنْ تَذَرَ ورَثَتَكَ أغْنِياءَ، خَيْرٌ مِن أنْ تَذَرَهُمْ عالَةً يَتَكَفَّفُونَ النّاسَ. وإنَّكَ لَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِها وجْهَ اللَّهِ، إلّا أُجِرْتَ. حَتّى ما تَجْعَلُ فِي فِي امْرَأتِكَ» قالَ، فَقُلْتُ: يا رَسُولَ اللَّهِ أأُخَلَّفُ بَعْدَ أصْحابِي؟ فَقالَ رَسُولُ اللَّهِ ﷺ: «إنَّكَ لَنْ تُخَلَّفَ، فَتَعْمَلَ عَمَلًا صالِحًا، إلّا ازْدَدْتَ بِهِ دَرَجَةً ورِفْعَةً، ولَعَلَّكَ أنْ تُخَلَّفَ حَتّى يَنْتَفِعَ بِكَ أقْوامٌ ويُضَرَّ بِكَ آخَرُونَ، اللَّهُمَّ أمْضِ لِأصْحابِي هِجْرَتَهُمْ، ولا تَرُدَّهُمْ عَلى أعْقابِهِمْ. لَكِنِ البائِسُ سَعْدُ بْنُ خَوْلَةَ. يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أنْ ماتَ بِمَكَّةَ» قالَ يَحْيى: سَمِعْتُ مالِكًا يَقُولُ: فِي الرَّجُلِ يُوصِي بِثُلُثِ مالِهِ لِرَجُلٍ. ويَقُولُ غُلامِي يَخْدُمُ فُلانًا ما عاشَ. ثُمَّ هُوَ حُرٌّ. فَيُنْظَرُ فِي ذَلِكَ، فَيُوجَدُ العَبْدُ ثُلُثَ مالِ المَيِّتِ. قالَ: «فَإنَّ خِدْمَةَ العَبْدِ تُقَوَّمُ، ثُمَّ يَتَحاصّانِ. يُحاصُّ الَّذِي أُوصِيَ لَهُ بِالثُّلُثِ بِثُلُثِهِ. ويُحاصُّ الَّذِي أُوصِيَ لَهُ بِخِدْمَةِ العَبْدِ. بِما قُوِّمَ لَهُ مِن خِدْمَةِ العَبْدِ، فَيَأْخُذُ كُلُّ واحِدٍ مِنهُما مِن خِدْمَةِ العَبْدِ، أوْ مِن إجارَتِهِ، إنْ كانَتْ لَهُ إجارَةٌ، بِقَدْرِ حِصَّتِهِ. فَإذا ماتَ الَّذِي جُعِلَتْ لَهُ خِدْمَةُ العَبْدِ ما عاشَ، عَتَقَ العَبْدُ» قالَ: وسَمِعْتُ مالِكًا يَقُولُ، فِي الَّذِي يُوصِي فِي ثُلُثِهِ فَيَقُولُ لِفُلانٍ كَذا وكَذا ولِفُلانٍ كَذا وكَذا يُسَمِّي مالًا مِن مالِهِ فَيَقُولُ ورَثَتُهُ قَدْ زادَ عَلى ثُلُثِهِ: «فَإنَّ الوَرَثَةَ يُخَيَّرُونَ بَيْنَ أنْ يُعْطُوا أهْلَ الوَصايا وصاياهُمْ ويَأْخُذُوا جَمِيعَ مالِ المَيِّتِ وبَيْنَ أنْ يَقْسِمُوا لِأهْلِ الوَصايا ثُلُثَ مالِ المَيِّتِ فَيُسَلِّمُوا إلَيْهِمْ ثُلُثَهُ فَتَكُونُ حُقُوقُهُمْ فِيهِ إنْ أرادُوا بالِغًا ما بَلَغَ»

[Machine] "I complained to the Prophet ﷺ during the Farewell Pilgrimage, until at one point he came to visit me. I said, 'O Messenger of Allah, I only see myself suffering and I possess a lot of wealth, and my daughter will inherit from me. Should I give all my wealth in charity?' He said, 'No.' I said, 'Then half of it?' He replied, 'No.' I asked, 'Then a third?' He said, 'A third and even a third is a lot. Indeed, if you leave your inheritors wealthy, it is better than leaving them destitute, begging people with their hands. And every expenditure you make, Allah will reward you for it, even the morsel you put in your wife's mouth.'"  

الدارمي:٣٢٣٩أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ الزُّهْرِيِّ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

اشْتَكَيْتُ مَعَ النَّبِيِّ ﷺ فِي حَجَّةِ الْوَدَاعِ حَتَّى إِذَا أُدْنِفْتُ فَدَخَلَ عَلَيَّ رَسُولُ اللَّهِ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللَّهِ مَا أُرَانِي إِلَّا أُلِمَّ بِي وَأَنَا ذُو مَالٍ كَثِيرٍ وَإِنَّمَا يَرِثُنِي ابْنَةٌ لِي أَفَأَتَصَدَّقُ بِمَالِي كُلِّهِ؟ قَالَ «لَا» قُلْتُ فَنِصْفِهِ قَالَ «لَا» قُلْتُ فَالثُّلُثِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَتْرُكْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَتْرُكَهُمْ فُقَرَاءَ يَتَكَفَّفُونَ النَّاسَ بِأَيْدِيهِمْ وَإِنَّكَ لَا تُنْفِقُ نَفَقَةً إِلَّا آجَرَكَ اللَّهُ فِيهَا حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ»  

ibnhibban:6026ʿUmar b. Saʿīd b. Sinān > Aḥmad b. Abū Bakr > Mālik > Ibn Shihāb > ʿĀmir b. Saʿd b. Abū Waqqāṣ from his father

That his father said, "In the year of the last Hajj of the Prophet ﷺ I became seriously ill and the Prophet ﷺ used to visit me inquiring about my health. I told him, 'I am reduced to this state because of illness and I am wealthy and have no inheritors except a daughter, (In this narration the name of 'Amir bin Saʿd is mentioned and in fact it is a mistake; the narrator is ʿAisha bint Saʿd bin Abi Waqqas). Should I give two-thirds of my property in charity?' He said, 'No.' I asked, 'Half?' He said, 'No.' then he added, 'Onethird, and even one-third is much. You'd better leave your inheritors wealthy rather than leaving them poor, begging others. You will get a reward for whatever you spend for Allah's sake, even for what you put in your wife's mouth.' I said, 'O Messenger of Allah ﷺ! Will I be left alone after my companions have gone?' He said, 'If you are left behind, whatever good deeds you will do will upgrade you and raise you high. And perhaps you will have a long life so that some people will be benefited by you while others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them renegades.' But Messenger of Allah ﷺ felt sorry for poor Saʿd bin Khaula as he died in Mecca." ابن حبّان:٦٠٢٦أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ قَالَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ عَنْ أَبِيهِ

[Machine] The Messenger of Allah ﷺ said, "If you leave your heirs wealthy, it is better than leaving them dependent on others. And you will not spend a sum seeking Allah's countenance except that you will be rewarded for it, even (the reward) for the morsel of food you put in your wife's mouth."  

الطبراني:٧١٧١حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْحَاقَ التُّسْتَرِيُّ ثنا سُوَيْدُ بْنُ سَعِيدٍ ثنا الْوَلِيدُ بْنُ مُحَمَّدٍ الْمُوَقَّرِيُّ عَنِ الزُّهْرِيِّ عَنْ مَحْمُودِ بْنِ لَبِيدٍ عَنْ شَدَّادِ بْنِ أَوْسٍ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ وَلَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِهَا وَجْهَ اللهِ إِلَّا أُجِرْتَ بِهَا حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ»

"I became ill with a sickness from which I later recovered. The Messenger of Allah came to visit me, and I said: 'O Messenger of Allah, I have a great deal of wealth and I have no heir except my daughter. Shall I give two-thirds of my wealth in charity?' He said: 'No.' I said: 'Half?' He said: 'No.' I said: 'One-third?' He said: '(Give) one-third, and one-third is a lot. It is better to leave your heirs independent of means, than to leave them poor and holding out their hands to people.'" (Using translation from Nasāʾī 3626)

مَرِضْتُ مَرَضًا أَشْفَيْتُ مِنْهُ فَأَتَانِي رَسُولُ اللهِ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ لِي مَالًا كَثِيرًا وَلَيْسَ يَرِثُنِي إِلَّا ابْنَتِي أَفَأَتَصَدَّقُ بِثُلُثَيْ مَالِي؟ قَالَ «لَا» قُلْتُ فَالشَّطْرُ قَالَ «لَا» قُلْتُ فَالثُّلُثُ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ لَهُمْ مِنْ أَنْ تَتْرُكَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ»

"الثُّلثُ والثلثُ كَثيرٌ إِنَّكَ إِنْ تذرْ وَرَثَتَكَ أغْنياءَ خيرٌ مِنْ أنْ تَدرَهُمْ عَالةً يتَكَفَّفُونَ النَّاسَ، وَإنَّكَ لَنْ تُنْفِقَةً تَبْتَغِى بِهَا وَجْهَ اللهِ إِلَّا أُجِرت بِهَا حَتَّى مَا تجعلُ فِي امرأتك".

اللَّهُمَّ أَمْض لأصْحابى هجْرَتَهُمْ وَلا تَرُدّهُمْ عَلَى أعْقَابهمْ، لكن البَائِسَ سَعدَ بْنُ خَوْلَةَ يَرْثى له رَسُولُ اللهِ ﷺ أن ماتَ بمَكَّة"
