15. Book of Breast Feeding
١٥۔ كِتَابُ الرَّضَاعِ
[Machine] A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have a dinar, what should I do with it?" He ﷺ said, "Spend it on yourself." He said, "I have another one, what should I do with it?" He ﷺ said, "Spend it on your family." He said, "I have another one." He ﷺ said, "Spend it on your children." He said, "I have another one." He ﷺ said, "Spend it on your servant." He said, "I have another one, what should I do with it?" He ﷺ said, "You know best."
جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ عِنْدِي دِينَارٌ فَمَا أَصْنَعُ بِهِ؟ قَالَ «أَنْفِقْهُ عَلَى نَفْسِكَ» قَالَ عِنْدِي آخَرُ فَمَا أَصْنَعُ بِهِ؟ قَالَ «أَنْفِقْهُ عَلَى أَهْلِكَ» قَالَ عِنْدِي آخَرُ قَالَ «أَنْفِقْهُ عَلَى وَلَدِكَ» قَالَ عِنْدِي آخَرُ فَمَا أَصْنَعُ بِهِ؟ قَالَ «أَنْفِقْهُ عَلَى خَادِمِكَ» قَالَ عِنْدِي آخَرُ فَمَا أَصْنَعُ بِهِ؟ قَالَ «أَنْتَ أَعْلَمُ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ نَفَقَةَ الْمَرْءِ عَلَى نَفْسِهِ وَعِيَالِهِ، عِنْدَ عَدَمِ الْيَسَارِ أَفْضَلُ مِنْ صَدَقَةِ التَّطَوُّعِ
[Machine] A man from the companions of the Messenger of Allah ﷺ freed a slave of his after him, even though he had no other wealth. So, the Messenger of Allah ﷺ ordered him to sell him and said, "You are most entitled to his price, and Allah is wealthy regarding him."
أَنَّ رَجُلًا مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ أَعْتَقَ عَبْدًا لَهُ مِنْ بَعْدَهُ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَأَمَرَ رَسُولُ اللَّهِ ﷺ فَبَاعَهُ وَقَالَ «أَنْتَ أَحَقُّ بِثَمَنِهِ وَاللَّهُ عَنْهُ غَنِيٌّ»
ذِكْرُ الْبَيَانِ بِأَنَّ نَفَقَةَ الْمَرْءِ عَلَى نَفْسِهِ وَعِيَالِهِ تَكُونُ لَهُ صَدَقَةً
"The Messenger of Allah said: 'Give charity.' A man said: 'O Messenger of Allah, I have a Dinar.' He said: 'Spend it on yourself.' He said: 'I have another.' He said: 'Spend it on your wife.' He said: 'I have another.' He said: 'Spend it on your son.' He said: 'I have another.' He said: 'Spend it on your servant.' He said: 'I have another.' He said: 'You know best (what to do with it)."' أَنَّ رَسُولَ اللَّهِ ﷺ حَثَّ ذَاتَ يَوْمٍ عَلَى الصَّدَقَةِ فَقَالَ رَجُلٌ يَا رَسُولَ اللَّهِ عِنْدِي دِينَارٌ فَقَالَ « تَصَدَّقْ بِهِ عَلَى نَفْسِكِ» قَالَ عِنْدِي آخَرُ قَالَ «تَصَدَّقْ بِهِ عَلَى وَلَدِكَ» قَالَ عِنْدِي آخَرُ قَالَ «تَصَدَّقْ بِهِ عَلَى زَوْجَتِكَ» قَالَ عِنْدِي آخَرُ قَالَ «تَصَدَّقْ بِهِ عَلَى خَادِمِكَ» قَالَ عِنْدِي آخَرُ قَالَ «أَنْتَ أَبْصَرُ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا الصَّدَقَةَ لِلْمُنْفِقِ عَلَى نَفْسِهِ وَأَهْلِهِ وَغَيْرِهِمْ إِذَا كَانَ مَالُهُ مِنْ حَلَالٍ
[Machine] On the authority of the Messenger of Allah ﷺ , he said, "Whichever man earns wealth through permissible means and then feeds himself or clothes himself, then whoever is dependent on him from among the creation of Allah, then indeed, he has given them their due zakat."
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «أَيُّمَا رَجُلٍ كَسْبَ مَالًا مِنْ حَلَالٍ فَأَطْعَمَ نَفْسَهُ أَوْ كَسَاهَا فَمَنْ دُونَهُ مِنْ خَلْقِ اللَّهِ فَإِنَّ لَهُ بِهَا زَكَاةً»
ذِكْرُ الْبَيَانِ بِأَنَّ كُلَّ مَا يَصْطَنِعُ الْمَرْءُ إِلَى أَهْلِهِ مِنَ الْكِسْوَةِ وَغَيْرِهَا يَكُونُ لَهُ صَدَقَةً
[Machine] Is everything you do for your family considered charity? Amr said, "I heard the Messenger of Allah ﷺ saying that, so what Amr said to the Messenger of Allah ﷺ was mentioned, and he ﷺ said, 'Amr spoke the truth. Everything you do for your family is considered charity for them.'"
أَوَكُلُّ مَا صَنَعْتَ إِلَى أَهْلِكِ صَدَقَةٌ؟ قَالَ عَمْرٌو سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ ذَلِكَ فَذُكِرَ مَا قَالَ عَمْرٌو لِرَسُولِ اللَّهِ ﷺ فَقَالَ ﷺ «صَدَقَ عَمْرٌو كُلُّ مَا صَنَعْتَ إِلَى أَهْلِكَ فَهُوَ صَدَقَةٌ عَلَيْهِمْ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا لِلْمُسْلِمِ الصَّدَقَةَ بِمَا أَنْفَقَ عَلَى أَهْلِهِ
[Machine] On the authority of the Prophet ﷺ, he said: "Indeed, when a Muslim spends on his family, it is considered charity for him."
عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ الْمُسْلِمَ إِذَا أَنْفَقَ عَلَى أَهْلِهِ كَانَتْ لَهُ صَدَقَةً»
ذِكْرُ الْبَيَانِ بِأَنَّ الصَّدَقَةَ إِنَّمَا تَكُونُ لِلْمُنْفِقِ عَلَى أَهْلِهِ إِذَا احْتَسَبَ فِي ذَلِكَ
"When a man spends on his family, seeking reward for that, that is an act of charity on his part." (Using translation from Nasāʾī 2545)
عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا أَنْفَقَ الرَّجُلُ عَلَى أَهْلِهِ وَهُوَ يَحْتَسِبُهَا كَانَتْ لَهُ صَدَقَةً»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُضَيِّعَ الْمَرْءُ مَنْ تُلْزَمُهُ نَفَقَتُهُ مِنْ عِيَالِهِ
It is sufficient sin for a man that he neglects him whom he maintains. (Using translation from Abū Dāʾūd 1692)
قَالَ رَسُولُ اللَّهِ ﷺ «كَفَى بِالْمَرْءِ إِثْمًا أَنْ يُضَيِّعَ مَنْ يَقُوتُ»
ذِكْرُ وَصَفِ قَوْلِهِ ﷺ «أَنْ يُضَيِّعَ مَنْ يَقُوتُ»
While we were sitting in the company of 'Abdullah b. 'Umar there came in his steward. He (Ibn 'Umar) said: Have you supplied the provision to the slaves? He said: No. Upon this he said: Go and give (the provision) to them, for the Messenger of Allah ﷺ has said: This sin is enough for a man that he withholds the subsistence from one whose master he is. قَالَ رَسُولُ اللَّهِ ﷺ «كَفَى بِالْمَرْءِ إِثْمًا أَنْ يَحْبِسَ عَمَّا يَمْلِكُ قُوتَهُمْ»
ذِكْرُ الْبَيَانِ بِأَنَّ نَفَقَةَ الْمَرْءِ عَلَى عِيَالِهِ أَفْضَلُ مِنَ النَّفَقَةِ فِي سَبِيلِ اللَّهِ
"The most virtuous of the Dinar is the Dinar spent by a man on his dependants, and the Dinar spent by a man on his beast in the Cause of Allah, and the Dinar spent by a man on his companions in the Cause of Allah." Abu Qilabah (one of the narrators) said: " He began with the dependants." Then he said: "And which man is greater in reward than a man who spends upon his depandants, having little ones by which Allah causes him to abstain (from the unlawful) and by which Allah enriches him." أَنَّ النَّبِيَّ ﷺ قَالَ «أَفْضَلُ دِينَارٍ دِينَارٌ يُنْفِقُهُ الرَّجُلُ عَلَى عِيَالِهِ وَدِينَارٌ يُنْفِقُهُ الرَّجُلُ عَلَى دَابَّتِهِ فِي سَبِيلِ اللَّهِ وَدِينَارٌ يُنْفِقُهُ الرَّجُلُ عَلَى أَصْحَابِهِ فِي سَبِيلِ اللَّهِ» قَالَ أَبُو قِلَابَةَ بَدَأَ بِالْعِيَالِ ثُمَّ قَالَ «وَأَيُّ رَجُلٍ أَعْظَمُ أَجْرًا مِنْ رَجُلٍ يُنْفِقُ عَلَى عِيَالٍ لَهُ صِغَارٍ يُعِفُّهُمُ اللَّهُ بِهِ وَيُغْنِيهِمُ اللَّهُ بِهِ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ نَفَقَةَ الْمَرْءِ عَلَى عِيَالِهِ أَفْضَلُ مِنْ نَفَقَتِهِ عَلَى أَقْرِبَائِهِ
"The best of charity is that which is given when you are self-sufficient, and the upper hand is better than the lower hand, and start with those for whom you are responsible." (Using translation from Nasāʾī 2534)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «خَيْرُ الصَّدَقَةِ مَا كَانَ عَنْ ظَهْرِ غِنًى وَالْيَدُ الْعُلْيَا خَيْرٌ مِنَ الْيَدِ السُّفْلَى وَابْدَأْ بِمَنْ تَعُولُ»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى وَالِي الْيَتِيمِ التَّسْوِيَةَ بَيْنَ مَنْ فِي حِجْرِهِ مِنَ الْأَيْتَامِ، وَبَيْنَ وَلَدِهِ فِي النَّفَقَةِ عَلَيْهِمْ
[Machine] "A man said, O Messenger of Allah, from what I strike of them, my orphans. He said, From what you strike of them and your children, you must not take any share of their wealth nor leave any inheritance behind from their wealth."
رَجُلٌ يَا رَسُولَ اللَّهِ مِمَّا أَضْرِبُ مِنْهُ يَتِيمِي قَالَ «مِمَّا كُنْتَ ضَارِبًا مِنْهُ وَلَدَكَ غَيْرَ وَاقٍ مَالَكَ بِمَالِهِ وَلَا مُتَأَثِّلٍ مِنْ مَالِهِ مَالًا»
ذِكْرُ إِعْطَاءِ اللَّهِ جَلَّ وَعَلَا السَّاعِيَ عَلَى الْأَرَامِلِ وَالْمَسَاكِينَ مَا يُعْطِي الْمُجَاهِدَ فِي سَبِيلِهِ
[Machine] Narrated Abu Huraira:
The Messenger of Allah ﷺ said, "The one who cares for the widow and the poor is like a fighter in the cause of Allah." And I consider him to have said, "Like the one who fasts and does not break his fast, and like the one who stands in prayer and does not sleep."
حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنْ ثَوْرِ بْنِ زَيْدٍ عَنْ أَبِي الْغَيْثِ عَنْ أَبِي هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «السَّاعِي عَلَى الْأَرْمَلَةِ وَالْمِسْكِينِ كَالْمُجَاهِدِ فِي سَبِيلِ اللَّهِ» وَأَحْسِبُهُ قَالَ «كَالصَّائِمِ لَا يُفْطِرُ وَكَالْقَائِمِ لَا يَنَامُ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا الْأَجْرَ لِلْمُنْفِقَةِ عَلَى أَوْلَادِ زَوْجِهَا مِنْ مَالِهَا
[Machine] I said to the Messenger of Allah ﷺ, "Do I have any reward in spending on the family of Abu Salamah? For I spend on them while they are only my in-laws and not my own family. Should I continue doing this or not?" The Messenger of Allah ﷺ said, "Yes, you will have a reward for what you spend on them."
قُلْتُ لِرَسُولِ اللَّهِ ﷺ هَلْ لِي مِنْ أَجْرٍ فِي بَنِي أَبِي سَلَمَةَ؟ فَإِنِّي أُنْفِقُ عَلَيْهِمْ وَإِنَّمَا هُمْ بَنِيَّ فَلَسْتُ بِتَارِكَتِهِمْ هَكَذَا وَهَكَذَا تَقُولُ كَانَ لِي أَجْرٌ أَوْ لَمْ يَكُنْ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «نَعَمْ لَكِ فِيهِمْ أَجْرٌ مَا أَنْفَقْتِ عَلَيْهِمْ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا الْأَجْرَ الْجَزِيلَ لِلْمَرْأَةِ إِذَا أَنْفَقَتْ عَلَى زَوْجِهَا وَعِيَالِهَا مِنْ مَالِهَا
[Machine] "What I do not like is if you do not have any reward in return for doing it, so she asked the Messenger of Allah, may peace be upon him, whether or not she has any reward in supporting them financially, as she is a woman and has a craft from which she sells, but neither her husband nor her children have anything to support themselves and they keep her occupied, so she cannot give charity. Is there any reward for me in spending on them? He (the Messenger) replied, "You will have a reward for whatever you spend on them, so spend on them."
مَا أُحِبُّ إِنْ لَمْ يَكُنْ لَكِ فِي ذَلِكَ أَجْرٌ أَنْ تَفْعَلِي فَسَأَلَ رَسُولَ اللَّهِ ﷺ هُوَ وَهِيَ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي امْرَأَةٌ وَلِيَ صَنْعَةٌ فَأَبِيعُ مِنْهَا وَلَيْسَ لِي وَلَا لِزَوْجِي وَلَا لِوَلَدِي شَيْءٌ وَشَغَلُونِي فَلَا أَتَصَدَّقُ فَهَلْ لِي فِي النَّفَقَةِ عَلَيْهِمْ مِنْ أَجْرٍ؟ فَقَالَ «لَكِ فِي ذَلِكَ أَجْرٌ مَا أَنْفَقْتِ عَلَيْهِمْ فَأَنْفِقِي عَلَيْهِمْ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْأَةَ يَكُونُ لَهَا بِمَا أَنْفَقَتْ عَلَى زَوْجِهَا وَعِيَالِهَا أَجْرَانِ، أَجْرُ الصَّدَقَةِ، وَأَجْرُ الْقَرَابَةِ
[Machine] The Messenger of Allah ﷺ addressed us women saying, "O assembly of women, be charitable, even if it is from your adornments, for you are the majority of the inhabitants of Hell on the Day of Resurrection." There was a man named Abdullah who had a slight hand deformity. She said, "Ask the Messenger of Allah ﷺ whether I can give charity, from my spending, to my husband and orphans in my care." She said, "The Messenger of Allah ﷺ was respected, so he said, 'No, rather ask him.'" She said, "So I went out, and when I reached the door, I saw a woman from the Ansar whose need was the same as mine. Her name was Zainab." She said, "So Bilal came out to us, and I said to him, 'Ask the Messenger of Allah ﷺ whether we can give charity from our spending to our husbands and orphans in our care.' She said, "So Bilal entered and said, 'O Messenger of Allah, at the door is Zainab.' The Messenger of Allah ﷺ said, 'Which Zainab?' Zainab, the wife of Abdullah, and Zainab, the woman from the Ansar, are asking about giving charity from their spending to their husbands and orphans in their care. Can they do that as charity?' The Messenger of Allah ﷺ said, 'Yes, for both of them there are two rewards: the reward of kinship and the reward of charity.'"
خَطَبَنَا رَسُولُ اللَّهِ ﷺ فَقَالَ «يَا مَعْشَرَ النِّسَاءِ تَصَدَّقْنَ وَلَوْ مِنْ حُلِيِّكُنَّ فَإِنَّكُنَّ أَكْثَرُ أَهْلِ جَهَنَّمَ يَوْمَ الْقِيَامَةِ» قَالَتْ وَكَانَ عَبْدُ اللَّهِ رَجُلًا خَفِيفَ ذَاتِ الْيَدِ فَقَالَتْ سَلْ لِي رَسُولَ اللَّهِ ﷺ أَتُجْزِئُ عَنِّي مِنَ الصَّدَقَةِ النَّفَقَةُ عَلَى زَوْجِي وَأَيْتَامٍ فِي حِجْرِي؟ قَالَتْ وَكَانَ رَسُولُ اللَّهِ ﷺ قَدْ أُلْقِيَتْ عَلَيْهِ الْمَهَابَةُ فَقَالَ لَا بَلْ سَلِيهِ أَنْتِ قَالَتْ فَانْطَلَقْتُ فَإِذَا عَلَى الْبَابِ امْرَأَةٌ مِنَ الْأَنْصَارِ حَاجَتُهَا حَاجَتِي اسْمُهَا زَيْنَبُ قَالَتْ فَخَرَجَ عَلَيْنَا بِلَالٌ فَقُلْتُ لَهُ سَلْ لَنَا رَسُولَ اللَّهِ ﷺ أَتُجْزِئُ عَنَّا مِنَ الصَّدَقَةِ النَّفَقَةُ عَلَى أَزْوَاجِنَا وَأَيْتَامٍ فِي حُجُورِنَا قَالَتْ فَدَخَلَ بِلَالٌ فَقَالَ يَا رَسُولَ اللَّهِ عَلَى الْبَابِ زَيْنَبُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَيُّ الزَّيَانِبِ؟ » قَالَ زَيْنَبُ امْرَأَةُ عَبْدِ اللَّهِ وَزَيْنَبُ امْرَأَةٌ مِنَ الْأَنْصَارِ تَسْأَلَانِ عَنِ النَّفَقَةِ عَلَى أَزْوَاجِهِمَا وَأَيْتَامٍ فِي حُجُورِهِمَا أَيُجْزِئُ ذَلِكَ عَنْهُمَا مِنَ الصَّدَقَةِ فَقَالَ رَسُولُ اللَّهِ ﷺ «نَعَمْ لَهُمَا أَجْرَانِ أَجْرُ الْقَرَابَةِ وَأَجْرُ الصَّدَقَةِ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا الْأَجْرَ بِكُلِّ مَا يُنْفِقُ الْمَرْءُ عَلَى عِيَالِهِ حَتَّى رَفَعِهِ اللُّقْمَةَ إِلَى فِي أَهْلِهِ
On the authority of his father (Sa'd b. Abi Waqqas): When he (Sa'd) fell ill at Mecca (according to the version of Ibn Abi Kkalaf) - then the agreed version has: which brought him near to death - the Messenger of Allah ﷺ went to visit him. He said: Messenger of Allah, I have a large amount of property, and my daughter is my only heir. May I give two-thirds (of my property) as a sadaqah (charity)? He said: No. He asked: Then a half ? He replied: No. He asked: Then one-third ? He replied: (You may will away) a third and third is a lot. To leave your heirs rich is better than to leave them poor begging from people. You will not spend anything, seeking thereby to please Allah, without being rewarded for it, even the mouthful you give your wife. I said: Messenger of Allah, shall I be left behind form immigration (to Medina)? He said: If you remain behind after me and do good works seeking the pleasure of Allah, your rank will be raised and degree increased. Perhaps you will not remain behind, and some people will benefit from you and others will be harmed by you. He then said: O Allah, complete the immigration of my Companions and do not turn them back. But miserable was Sa'd b. Khawlah. The Messenger of Allah ﷺ lamented on him as he died at Mecca. (Using translation from Abū Dāʾūd 2864)
مَرِضْتُ بِمَكَّةَ عَامَ الْفَتْحِ مَرَضًا أَشْفَيْتُ مِنْهُ عَلَى الْمَوْتِ فَعَادَنِي رَسُولُ اللَّهِ ﷺ فَقُلْتُ لَهُ أَيْ رَسُولَ اللَّهِ إِنَّ لِي مَالًا كَثِيرًا وَلَيْسَ يَرِثُنِي إِلَّا ابْنَتِي أَفَأُوصِي بِثُلُثَيْ مَالِي؟ قَالَ «لَا» قُلْتُ الشَّطْرُ؟ قَالَ «لَا» قُلْتُ الثُّلُثُ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَتْرُكَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَتْرُكَهُمْ عَالَةَ يَتَكَفَّفُونَ النَّاسَ إِنَّكَ لَنْ تُنْفِقَ نَفَقَةً تُرِيدُ بِهَا وَجْهَ اللَّهِ إِلَّا أُجِرْتَ عَلَيْهَا حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ» قُلْتُ يَا رَسُولَ اللَّهِ أُخَلَّفُ عَنْ هِجْرَتِي قَالَ «إِنَّكَ لَنْ تُخَلَّفَ بَعْدِي فَتَعْمَلَ عَمَلًا تُرِيدُ بِهِ وَجْهَ اللَّهِ إِلَّا ازْدَدْتَ بِهِ رِفْعَةً وَدَرَجَةً وَلَعَلَّكَ أَنْ تُخَلَّفَ بَعْدِي حَتَّى يَنْتَفِعَ أَقْوَامٌ بِكَ وَيُضَرَّ بِكَ آخَرُونَ اللَّهُمَّ امْضِ لِأَصْحَابِي هِجْرَتَهُمْ وَلَا تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنِ الْبَائِسُ سَعْدُ بْنُ خَوْلَةَ يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أَنْ مَاتَ بِمَكَّةَ»
ذِكْرُ عَدَمِ إِيجَابِ السُّكْنَى، وَالنَّفَقَةِ لِلْمُطَلَّقَةِ ثَلَاثًا عَلَى زَوْجِهَا
[Machine] "That her husband divorced her three times, and the Prophet ﷺ did not provide for her neither sustenance nor accommodation." I mentioned this to Ibrahim Al-Nakha'i and he said, Umar ibn Al-Khattab said, "We do not leave the Book of our Lord and the Sunnah of our Prophet ﷺ for the words of a woman concerning sustenance and accommodation."
«أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ ﷺ نَفَقَةً وَلَا سُكْنَى» قَالَ فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ النَّخَعِيَّ فَقَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ «لَا نَدَعُ كِتَابَ رَبِّنَا وَلَا سُنةَ نَبِيِّنَا لِقَوْلِ امْرَأَةٍ لَهَا النَّفَقَةُ وَالسُّكْنَى»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
Fatimah bint Qais said: “My husband divorced me at the time of the Messenger of Allah ﷺ three times. The Messenger of Allah ﷺ said: 'You have no right to accommodation or to maintenance.'” (Using translation from Ibn Mājah 2036)
فَاطِمَةُ بِنْتُ قَيْسٍ طَلَّقَنِي زَوْجِي عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَا سُكْنَى لَكِ وَلَا نَفَقَةَ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ: مَنْ أَوْجَبَ سُكْنَى لِلْمُطَلَّقَةِ ثَلَاثًا عَلَى زَوْجِهَا، وَنَفْيَ إِيجَابِ النَّفَقَةِ لَهَا عَلَيْهِ
"I came to Fatimah bint Qais and asked her about the ruling of the Messenger of Allah concerning her. She said that her husband divorced her irrevocably, and she referred her dispute with him, concerning accommodation and maintenance, to the Messenger of Allah. She said: 'He did not give me (the right to) accommodation and maintenance, and he told me to observe my 'Iddah in the house of Ibn Umm Maktum,'" (Using translation from Nasāʾī 3548)
دَخَلْتُ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ فَسَأَلْتُهَا عَنْ قَضَاءِ رَسُولِ اللَّهِ ﷺ فَقَالَتْ طَلَّقَهَا زَوْجُهَا أَلْبَتَّةَ قَالَتْ «فَخَاصَمْتُ إِلَى رَسُولِ اللَّهِ ﷺ فِي السُّكْنَى وَالنَّفَقَةِ فَلَمْ يَجْعَلْ لِي سُكْنَى وَلَا نَفَقَةَ وَأَمَرَنِي أَنْ أَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا أَمَرَ ﷺ فَاطِمَةَ بِنْتَ قَيْسٍ أَنْ تَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ
[Machine] Abu Amr ibn Hafs divorced her three times and ordered her to receive maintenance and let her go. The Messenger of Allah ﷺ sent him towards Yemen, and Khalid ibn Al-Walid set out with a group from the tribe of Makhzum to meet the Prophet ﷺ while he was at the house of Maymunah. He said, "O Messenger of Allah, Abu Amr ibn Hafs divorced Fatimah three times. Does she have any maintenance?" The Messenger of Allah ﷺ said, "She does not have maintenance or a dwelling." So the Messenger of Allah ﷺ sent to her that she should move to her Aunt Sharikah, then he sent to her that the Muhajirun would come to her first, so move to the house of Ibn Umm Maktum. If you remove your veil, he will not see you. And he sent to her, "Do not precede me with yourself." So the Messenger of Allah ﷺ married her to Usamah ibn Zaid.
أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا ثَلَاثًا وَأَمَرَ لَهَا بِنَفَقَةٍ وَاسْتَقَلَّتْهَا وَكَانَ رَسُولُ اللَّهِ ﷺ بَعَثَهُ نَحْوَ الْيَمَنِ فَانْطَلَقَ خَالِدُ بْنُ الْوَلِيدِ فِي نَفَرٍ مِنْ بَنِي مَخْزُومٍ إِلَى رَسُولِ اللَّهِ ﷺ وَهُوَ فِي بَيْتِ مَيْمُونَةَ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَ فَاطِمَةَ ثَلَاثًا فَهَلْ لَهَا نَفَقَةٌ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ لَهَا نَفَقَةٌ وَلَا سُكْنَى» فَأَرْسَلَ إِلَيْهَا رَسُولُ اللَّهِ ﷺ أَنْ تَنْتَقِلَ إِلَى أُمِّ شَرِيكٍ ثُمَّ أَرْسَلَ إِلَيْهَا أَنَّ أُمَّ شَرِيكٍ يَأْتِيهَا الْمُهَاجِرُونَ الْأَوَّلُونَ فَانْتَقِلِي إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّكِ إِنْ وَضَعْتِ خِمَارَكِ لَمْ يَرَكِ وَأَرْسَلَ إِلَيْهَا لَا تَسْبِقِينِي بِنَفْسِكِ فَزَوَّجَهَا رَسُولُ اللَّهِ ﷺ مِنْ أُسَامَةَ بْنِ زَيْدٍ
ذِكْرُ وَصْفِ مَا بَعَثَ بِهِ أَبُو عَمْرِو بْنُ حَفْصٍ إِلَى فَاطِمَةَ بِنْتِ قَيْسٍ لِنَفَقَتِهَا، وَإِنْ لَمْ تَكُنْ تَجِبُ عَلَيْهِ
My husband Abu 'Amr b. Hafs b. al-Mughira sent 'Ayyish b. Abu Rabi'a to me with a divorce, and he also sent through him five si's of dates and five si's of barley. I said: Is there no maintenance allowance for me but only this, and I cannot even spend my 'Idda period in your house? He said: No. She said: I dressed myself and came to Messenger of Allah ﷺ. He said: How many pronouncements of divorce have been made for you? I said: Three. He said what he ('Ayyish b. Abu Rabi'a) had stated was true. There is no maintenance allowance for you. Spend 'Idda period in the house of your cousin, Ibn Umm Maktum. He is blind and you can put off your garment in his presence. And when you have spent your Idda period, you inform me. She said: Mu'awiya and Abu'l-Jahm (Allah be pleased with them) were among those who had given me the proposal of marriage. Thereupon Allah's Apostle ﷺ said: Mu'awiya is destitute and in poor condition and Abu'l-Jahm is very harsh with women (or he beats women, or like that), you should take Usama b. Zaid (as your husband). (Using translation from Muslim 1480q)
فَشَدَدْتُ عَلَيَّ ثِيَابِي ثُمَّ أَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «كَمْ طَلَّقَكِ؟ » قُلْتُ ثَلَاثَةً قَالَ «صَدَقَ لَيْسَ لَكِ نَفَقَةٌ وَاعْتَدِّي فِي بَيْتِ ابْنِ عَمِّكِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ ضَرِيرُ الْبَصَرِ تَلْقِينَ ثَوْبَكِ عِنْدَهُ فَإِذَا انْقَضَتْ عِدَّتُكِ فَآذِنِينِي» قَالَتْ فَخَطَبَنِي خُطَّابٌ مِنْهُمْ مُعَاوِيَةُ وَأَبُو جَهْمٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ مُعَاوِيَةَ خَفِيفُ الْحَاذِ وَأَبُو جَهْمٍ فِيهِ شِدَّةٌ عَلَى النِّسَاءِ أَوْ يَضْرِبُ النِّسَاءَ أَوْ نَحْوَ هَذَا وَلَكِنْ عَلَيْكِ بِأُسَامَةَ بْنِ زَيْدٍ»
ذِكْرُ الْأَمْرِ لِلْمَرْأَةِ أَنْ تَأْخُذَ مِنْ مَالِ زَوْجِهَا بِالْمَعْرُوفِ لِتُنْفِقَ عَلَى عِيَالِهِ، إِذَا قَصَّرَ الزَّوْجُ فِي النَّفَقَةِ عَلَيْهِمْ
[Machine] Hind said to the Prophet Muhammad (PBUH), "Indeed, Abu Sufyan is a stingy man and I only have what he provides for me." He (the Prophet) said, "Take what is sufficient for you and your child with what is good."
قَالَتْ هِنْدٌ لِلنَّبِيِّ ﷺ إِنَّ أَبَا سُفْيَانَ رَجُلٌ شَحِيحٌ وَلَيْسَ لِي إِلَّا مَا يُدْخِلُ عَلَيَّ قَالَ «خُذِي مَا يَكْفِيكِ وَوَلَدَكِ بِالْمَعْرُوفِ»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْأَةِ أَنْ تَأْخُذَ مِنْ مَالِ زَوْجِهَا لِعِيَالِهِ بِالْمَعْرُوفِ مِنْ غَيْرِ عِلْمِهِ
[Machine] Hind came to the Messenger of Allah ﷺ and said, "Verily, Abu Sufyan is restraining me and my children. Can I take some of his wealth without him knowing?" He replied, "Take from his wealth what is reasonable, and he will not know."
جَاءَتْ هِنْدٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ إِنَّ أَبَا سُفْيَانَ مُضَيِّقٌ عَلَيَّ وَعَلَى وَلَدِي أَفَآخُذُ مِنْ مَالِهِ وَهُوَ لَا يَشْعُرُ؟ قَالَ «خُذِي مِنْ مَالِهِ بِالْمَعْرُوفِ وَهُوَ لَا يَشْعُرُ»
ذِكْرُ الْإِخْبَارِ عَنْ جَوَازِ أَخْذِ الْمَرْأَةِ مِنْ مَالِ زَوْجِهَا بِغَيْرِ عِلْمِهِ، تُرِيدُ بِهِ النَّفَقَةَ عَلَى أَوْلَادِهِ وَعِيَالِهِ
Messenger of Allah, by Allah, there was no other household upon the surface of the earth than your household about which I cherished Allah bringing disgrace upon it, (and now) there is no other household upon the surface of the earth than your household about which I cherish Allah granting it honour. Allah's Apostle ﷺ said: It is so, by Him in Whose Hand is my life She said: Messenger of Allah, Abu Sufyan is a niggardly person. Is there any harm for me if I spend upon his children out of his wealth without his permission? Thereupon Allah's Apostle ﷺ said: There is no harm for you if you spend upon them what is reasonable. جَاءَتْ هِنْدُ بِنْتُ عُتْبَةَ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ وَاللَّهِ مَا كَانَ عَلَى ظَهْرِ الْأَرْضِ أَهْلُ خِبَاءٍ أَحَبَّ إِلَيَّ مِنْ أَنْ يُذِلَّهُمُ اللَّهُ مِنْ أَهْلِ خِبَائِكَ وَمَا عَلَى ظَهْرِ الْأَرْضِ أَهْلُ خِبَاءٍ أَحَبَّ إِلَيَّ الْيَوْمَ أَنْ يُعِزَّهُمُ اللَّهُ مِنْ أَهْلِ خِبَائِكَ ثُمَّ قَالَتْ يَا رَسُولَ اللَّهِ إِنَّ أَبَا سُفْيَانَ رَجُلٌ مُمْسِكٌ فَهَلْ عَلَيَّ مِنْ حَرَجٍ أَنْ أُنْفِقَ عَلَى عِيَالِهِ مِنْ مَالِهِ بِغَيْرِ إِذْنِهِ فَقَالَ النَّبِيُّ ﷺ «لَا حَرَجَ عَلَيْكِ أَنْ تُنْفِقِي بِالْمَعْرُوفِ عَلَيْهِمْ»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْأَةِ أَنْ تَأْخُذَ مِنْ مَالِ زَوْجِهَا بِغَيْرِ عِلْمِهِ مِقْدَارَ مَا تُنْفِقُهُ عَلَيْهَا، وَعَلَى وَلَدِهَا، مِنْ غَيْرِ حَرَجٌ يَلْزَمُهَا فِي ذَلِكَ
[Machine] Hind, the wife of Abu Sufyan, came to the Prophet ﷺ and said, "Abu Sufyan is a stingy man. Is it permissible for me to take from his wealth and spend it on myself and my children?" The Prophet ﷺ said to her, "There is no harm in you taking from Abu Sufyan's wealth and spending it on yourself and your children in a reasonable manner."
جَاءَتْ هِنْدُ امْرَأَةُ أَبِي سُفْيَانَ إِلَى النَّبِيِّ ﷺ فَقَالَتْ إِنَّ أَبَا سُفْيَانَ رَجُلٌ شَحِيحٌ فَهَلْ عَلَيَّ جُنَاحٌ أَنْ أُصِيبَ مِنْ مَالِهِ فَأُنْفِقَ عَلَيَّ وَعَلَى وَلَدِي؟ فَقَالَ لَهَا نَبِيُّ اللَّهِ ﷺ «لَا حَرَجَ عَلَيْكِ أَنْ تَأْخُذِي مِنْ مَالِ أَبِي سُفْيَانَ فَتُنْفِقِيهِ عَلَيْكِ وَعَلَى وَلَدِكِ بِالْمَعْرُوفِ»
ذِكْرُ الْإِخْبَارِ عَنْ إِبَاحَةِ أَخْذِ الْمَرْءِ مِنْ مَالِ وَلَدِهِ حَسْبَ الْحَاجَةِ إِلَيْهِ مِنْ غَيْرِ أَمْرِهِ
'The best (most pure) food a man consumes is that which he has earned himself, and his child (and his child's wealth) is part of his earnings." (Using translation from Ibn Mājah 2137)
قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ أَطْيَبَ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَإِنَّ وَلَدَ الرَّجُلِ مِنْ كَسْبِهِ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ إِسْنَادَ هَذَا الْخَبَرِ مُنْقَطِعٌ لَيْسَ بِمُتَّصِلٍ
[Machine] Narrated by the Prophet ﷺ , he said, "The best food a person can eat is from his own earning, and indeed, his children also benefit from his earning."
عَنِ النَّبِيِّ ﷺ قَالَ «أَطْيَبُ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَإِنَّ وَلَدَهُ مِنْ كَسْبِهِ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ ذِكْرَ الْأَسْوَدِ فِي هَذَا الْخَبَرِ، وَهِمَ فِيهِ شَرِيكٌ
'The best (most pure) food a man consumes is that which he has earned himself, and his child (and his child's wealth) is part of his earnings." (Using translation from Ibn Mājah 2137)
قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ أَطْيَبَ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَوَلَدُهُ مِنْ كَسْبِهِ»
ذِكْرُ خَبَرِ أَوْهَمَ مَنْ لَمْ يُحْكِمْ صِنَاعَةَ الْعِلْمِ أَنَّ مَالَ الِابْنِ يَكُونُ لِلْأَبِ
[Machine] A man came to the Messenger of Allah ﷺ to argue with his father about a debt he owed, so the Messenger of Allah ﷺ said, "You and your money belong to your father."
أَنَّ رَجُلًا أَتَى رَسُولَ اللَّهِ ﷺ يُخَاصِمُ أَبَاهُ فِي دَيْنٍ لَهُ عَلَيْهِ فَقَالَ نَبِيُّ اللَّهِ ﷺ «أَنْتَ وَمَالُكَ لِأَبِيكَ»
