ذِكْرُ عَدَمِ إِيجَابِ السُّكْنَى، وَالنَّفَقَةِ لِلْمُطَلَّقَةِ ثَلَاثًا عَلَى زَوْجِهَا

ibnhibban:4250 – Abū Khalīfah > Muḥammad b. Kathīr al-ʿAbdī > Sufyān al-Thawrī > Salamah b. Kuhayl > al-Shaʿbī > Fāṭimah b. Qays

[Machine] "That her husband divorced her three times, and the Prophet ﷺ did not provide for her neither sustenance nor accommodation." I mentioned this to Ibrahim Al-Nakha'i and he said, Umar ibn Al-Khattab said, "We do not leave the Book of our Lord and the Sunnah of our Prophet ﷺ for the words of a woman concerning sustenance and accommodation."

ابن حبّان:٤٢٥٠ – أَخْبَرَنَا أَبُو خَلِيفَةَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ الْعَبْدِيُّ قَالَ أَخْبَرَنَا سُفْيَانُ الثَّوْرِيُّ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنِ الشَّعْبِيِّ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ

«أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ ﷺ نَفَقَةً وَلَا سُكْنَى» قَالَ فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ النَّخَعِيَّ فَقَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ «لَا نَدَعُ كِتَابَ رَبِّنَا وَلَا سُنةَ نَبِيِّنَا لِقَوْلِ امْرَأَةٍ لَهَا النَّفَقَةُ وَالسُّكْنَى»

[Machine] "Her husband divorced her three times, so the Prophet ﷺ did not provide her with maintenance or accommodation. Salama said that he mentioned this to Ibrahim, who said, 'Umar ibn al-Khattab said: We do not abandon the book of our Lord and the Sunnah of His Prophet based on the words of a woman, so he provided her with accommodation and maintenance.'"

الدارمي:٢٣٢٠ – أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنْ الشَّعْبِيِّ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ

So, I mentioned this to Ibrahim, and Ibrahim said, "Umar ibn Al-Khattab said, 'We do not forsake the book of our Lord and the Sunnah of our Prophet ﷺ based on the words of a woman concerning housing and financial support, which was narrated by Ash-Sha'bi."

السيوطي:٦٧٥-٥b –

"عَنِ الثَّوْرِيِّ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنِ الشَّعْبِيِّ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ: طَلَّقَنِي زَوْجِي ثَلَاثًا، فَجِئْتُ إِلَى النَّبِيِّ ﷺ فَسَأَلْتُهُ فَقَالَ: لَا نَفَقَةَ لَكِ وَلَا سُكْنَى قَالَ: فَذَكَرْتُ ذَلِكَ لإِبْرَاهِيمَ فَقَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ: لَا نَدُعُ كِتَاب رَبِّنَا وَلَا سُنَّةَ نَبِيِّنَا ﷺ لَهَا النَّفَقَةُ وَالسُّكْنَى".
