[Machine] "And Thabit used to do it."
«وَكَانَ ثَابِتٌ يَفْعَلُهُ»
[Machine] He used to treat his aunt as a mother when she wasn't a mother, and his uncle as a father when he wasn't a father.
«كَانَ مَسْرُوقٌ يُنَزِّلُ الْعَمَّةَ بِمَنْزِلَةِ الْأَبِ إِذَا لَمْ يَكُنْ أَبٌ وَالْخَالَةَ بِمَنْزِلَةِ الْأُمِّ إِذَا لَمْ تَكُنْ أُمٌّ»
[Machine] About a woman or man who died and left behind a paternal aunt and paternal aunt, they said he has no heir or relative other than them, so they said, "Abdullah ibn Mas'ud used to treat the paternal aunt like his own mother and treat the paternal aunt like his own sister."
عَنِ امْرَأَةٍ أَوْ رَجُلٍ تُوُفِّيَ وَتَرَكَ خَالَةً وَعَمَّةً قال لَيْسَ لَهُ وَارِثٌ وَلَا رَحِمٌ غَيْرُهُمَا فَقَالَ «كَانَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ يُنَزِّلُ الْخَالَةَ بِمَنْزِلَةِ أُمِّهِ وَيُنَزِّلُ الْعَمَّةَ بِمَنْزِلَةِ أَخِيهَا»
[Machine] About al-Hasan, regarding a man who admitted to owing a thousand dirhams to one person and another person provided evidence of a thousand dirhams, and the deceased left behind a thousand dirhams. He said, "The money should be divided equally between the two, unless the deceased was bankrupt, then his claim cannot be accepted."
عَنْ الْحَسَنِ فِي رَجُلٍ اعْتَرَفَ عِنْدَ مَوْتِهِ بِأَلْفِ دِرْهَمٍ لِرَجُلٍ وَأَقَامَ آخَرُ بَيِّنَةً بِأَلْفِ دِرْهَمٍ وَتَرَكَ الْمَيِّتُ أَلْفَ دِرْهَمٍ فَقَالَ «الْمَالُ بَيْنَهُمَا نِصْفَيْنِ إِلَّا أَنْ يَكُونَ مُفْلِسًا فَلَا يَجُوزُ إِقْرَارُهُ»
[Machine] Concerning Ibrahim and his brothers, some of them claim brotherhood while others deny it. He said, "He will enter with them in the position of a slave who has a share among brothers, so one of them will free his portion." He said, and 'Amir, the judge, and their companions say, "He will not enter except in the share that he acknowledged."
عَنْ إِبْرَاهِيمَ فِي الْإِخْوَةِ يَدَّعِي بَعْضُهُمُ الْأَخَ وَيُنْكِرُ الْآخَرُونَ قَالَ «يَدْخُلُ مَعَهُمْ بِمَنْزِلَةِ عَبْدٍ يَكُونُ بَيْنَ الْإِخْوَةِ فَيَعْتِقَ أَحَدُهُمْ نَصِيبَهُ» قَالَ وَكَانَ عَامِرٌ وَالْحَكَمُ وَأَصْحَابُهُمَا يَقُولُونَ «لَا يَدْخُلُ إِلَّا فِي نَصِيبِ الَّذِي اعْتَرَفَ بِهِ»
[Machine] If they are brothers, does one of them claim brotherhood while the other denies it? Ibn Abi Layla said: "It is divided into six parts: three for the one who does not claim, two for the claimant, and one for the one being claimed."
إِذَا كَانَا أَخَوَيْنِ فَادَّعَى أَحَدُهُمَا أَخًا وَأَنْكَرَهُ الْآخَرُ؟ قَالَ كَانَ ابْنُ أَبِي لَيْلَى يَقُولُ هِيَ مِنْ سِتَّةٍ لِلَّذِي لَمْ يَدَّعِ ثَلَاثَةٌ وَلِلْمُدَّعِي سَهْمَانِ وَلِلْمُدَّعَى سَهْمٌ
[Machine] About Hammad concerning a man who has three sons. Hammad said: "two-thirds of the property should go to the youngest son." The middle son said: "I agree." And the eldest son said: "I do not agree." Hammad said: "She comes from nine (shares), so he (the youngest son) gets his share and the share of the one who agreed." And Hammad said: "The arrow is returned to all of them." And 'Amir said: "The one who returned it only returned it to himself."
عَنْ حَمَّادٍ فِي الرَّجُلِ يَكُونُ لَهُ ثَلَاثَةُ بَنِينَ فَقَالَ ثُلُثِي لِأَصْغَرِ بَنِيَّ فَقَالَ الْأَوْسَطُ أَنَا أُجِيزُ وَقَالَ الْأَكْبَرُ أَنَا لَا أُجِيزُ قَالَ «هِيَ مِنْ تِسْعَةٍ يُخْرِجُ ثُلُثَهُ فَلَهُ سَهْمُهُ وَسَهْمُ الَّذِي أَجَازَ» وَقَالَ حَمَّادٌ «يَرُدُّ السَّهْمَ عَلَيْهِمْ جَمِيعًا» وَقَالَ عَامِرٌ «الَّذِي رَدَّ إِنَّمَا رَدَّ عَلَى نَفْسِهِ»
[Machine] About Al-Harith al-Ukli, regarding a man who confessed upon his death to having a thousand dirhams as investment and a thousand dirhams as debt, and he did not leave behind anything except a thousand dirhams. He said, "Begin with the debt, for if there is any remaining, it will be an increase for the owner of the investment."
عَنْ الْحَارِثِ الْعُكْلِيِّ فِي رَجُلٍ أَقَرَّ عِنْدَ مَوْتِهِ بِأَلْفِ دِرْهَمٍ مُضَارَبَةً وَأَلْفٍ دَيْنًا وَلَمْ يَدَعْ إِلَّا أَلْفَ دِرْهَمٍ قَالَ «يُبْدَأُ بِالدَّيْنِ فَإِنْ فَضَلَ فَضْلٌ كَانَ لِصَاحِبِ الْمُضَارَبَةِ»
[Machine] About Al-Shaabi (a famous poet) regarding a man who died leaving behind three hundred dirhams and three sons, a man came claiming one hundred dirhams from the deceased. One of the sons confirmed his claim and said the amount should be paid to him from their portion. Then Al-Shaabi said, "I do not see that an inheritance can be distributed until the debt is settled."
عَنْ الشَّعْبِيِّ فِي رَجُلٍ مَاتَ وَتَرَكَ ثَلَاثَ مِائَةِ دِرْهَمٍ وَثَلَاثَةَ بَنِينَ فَجَاءَ رَجُلٌ يَدَّعِي مِائَةَ دِرْهَمٍ عَلَى الْمَيِّتِ فَأَقَرَّ لَهُ أَحَدُهُمْ قَالَ يَدْخُلُ عَلَيْهِمْ بِالْحِصَّةِ ثُمَّ قَالَ الشَّعْبِيُّ «مَا أُرَى أَنْ يَكُونَ مِيرَاثًا حَتَّى يُقْضَى الدَّيْنُ»
[Machine] About Al-Hasan, there was a man who died leaving behind two sons and two thousand dirhams. The two sons divided the two thousand dirhams equally between themselves. Then, one of the sons disappeared. A man came and claimed a thousand dirhams from the deceased. He said to take all that is in the witness's hand and he was told to follow his absent brother and take half of what is in his hand.
عَنْ الْحَسَنِ فِي رَجُلٍ هَلَكَ وَتَرَكَ ابْنَيْنِ وَتَرَكَ أَلْفَيْ دِرْهَمٍ فَاقْتَسَمَا الْأَلْفَيْ دِرْهَمٍ وَغَابَ أَحَدُ الِابْنَيْنِ فَجَاءَ رَجُلٌ فَاسْتَحَقَّ عَلَى الْمَيِّتِ أَلْفَ دِرْهَمٍ قَالَ يَأْخُذُ جَمِيعَ مَا فِي يَدِ الشَّاهِدِ وَيُقَالُ لَهُ اتَّبِعْ أَخَاكَ الْغَائِبَ فَخُذْ نِصْفَ مَا فِي يَدِهِ
[Machine] Ali decided in favor of the apostate's family in their inheritance from the Muslims.
«أَنَّ عَلِيًّا قَضَى فِي مِيرَاثِ الْمُرْتَدِّ لِأَهْلِهِ مِنَ الْمُسْلِمِينَ»
[Machine] About Qatadah, regarding a man who accused his wife of adultery and brought witnesses, hence she was stoned to death. Qatadah said, "He inherits her."
عَنْ قَتَادَةَ فِي رَجُلٍ قَذَفَ امْرَأَتَهُ وَجَاءَ بِشُهُودٍ فَرُجِمَتْ؟ قَالَ «يَرِثُهَا»
[Machine] "He inherits from the side that is eligible, and doesn't inherit from the side that is not eligible."
«يَرِثُ مِنَ الْجَانِبِ الَّذِي يَصْلُحُ وَلَا يَرِثُ مِنَ الْجَانِبِ الَّذِي لَا يَصْلُحُ»
[Machine] "It inherits him and he inherits her."
«أَنَّهَا تَرِثُهُ وَيَرِثُهَا»
[Machine] Regarding the statement of Damrah, Al-Fudayl bin Fadalah, Ibn Abi Awf, Rashed, and Atiyah, they said, "Mules cannot inherit."
عَنْ ضَمْرَةَ وَالْفُضَيْلِ بْنِ فَضَالَةَ وَابْنِ أَبِي عَوْفٍ وَرَاشِدٍ وَعَطِيَّةَ قَالُوا «لَا يُوَرَّثُ الْحُمَلَاءُ»
[Machine] "They inherit from their mothers, and if she gives birth to twins and dies, the sixth inherits."
«يَتَوَارَثُونَ مِنْ قِبَلِ الْأُمَّهَاتِ وَإِنْ وَلَدَتْ تَوْأَمًا فَمَاتَ وَرِثَ السُّدُسَ»
[Machine] About Al-Hasan in regard to a man who divorces a woman and then marries her, he said, "There is no harm except if she is pregnant, as the child will not follow him."
عَنْ الْحَسَنِ فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا قَالَ «لَا بَأْسَ إِلَّا أَنْ تَكُونَ حُبْلَى فَإِنَّ الْوَلَدَ لَا يَلْحَقُهُ»
[Machine] The translation of the phrase "عُمَرُ «الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا أَوْ لِوَقْتِهِمَا»" from Arabic to English is: "The age/an entire lifetime of 'sadaqah' (charity) and 'sā'ibah' (letting loose animals for grazing) is for their day or their time."
عُمَرُ «الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا أَوْ لِوَقْتِهِمَا»
[Machine] About stolen property in a man who died and had no inheritor, he said, "His wealth is where he directed it. If he did not direct it, then it is in the treasury."
عَنْ مَسْرُوقٍ فِي رَجُلٍ مَاتَ وَلَمْ يَكُنْ لَهُ مَوْلَى عَتَاقَةٍ قَالَ «مَالُهُ حَيْثُ أَوْصَى بِهِ فَإِنْ لَمْ يَكُنْ أَوْصَى فَهُوَ فِي بَيْتِ الْمَالِ»
[Machine] Regarding the commoner's situation when a man marries a woman and then divorces her, and they have a child together? He said, "If she is a free woman, the financial responsibility is upon her mother. And if she is a slave, meaning a young child, then it is upon his guardians."
عَنْ الشَّعْبِيِّ فِي الْعَبْدِ يَتَزَوَّجُ الْمَرْأَةَ ثُمَّ يُطَلِّقُهَا وَلَهُ مِنْهَا وَلَدٌ؟ قَالَ إِنْ كَانَتْ حُرَّةً فَالنَّفَقَةُ عَلَى أُمِّهِ وَإِنْ كَانَ عَبْدًا يَعْنِي الصَّبِيَّ فَعَلَى مَوَالِيهِ
[Machine] "From Abu Qilabah"
عَنْ أَبِي قِلَابَةَ
[Machine] "From Abu Qilabah regarding a woman who died and left behind her children, so they inherited her wealth and belongings. Then her children died. He said, 'The rights return to the family of the woman.'"
عَنْ أَبِي قِلَابَةَ فِي امْرَأَةٍ مَاتَتْ وَتَرَكَتْ بَنِيهَا فَوَرِثُوهَا مَالًا وَمَوَالِيَ ثُمَّ مَاتَ بَنُوهَا قَالَ «يَرْجِعُ الْوَلَاءُ إِلَى عَصَبَةِ الْمَرْأَةِ»
[Machine] "From Al-Hasan and Sa'id ibn Al-Musayyib, they despised selling loyalty."
عَنْ الْحَسَنِ وَسَعِيدِ بْنِ الْمُسَيِّبِ «أَنَّهُمَا كَرِهَا بَيْعَ الْوَلَاءِ»
[Machine] "This makes me a guilty person while I consider him an immoral person. He reveals complaints and conceals all other matters. So the man said to him, 'What do you say about two daughters, parents, and a husband?' He replied, 'The husband is entitled to one-fourth of all the wealth, and the parents are entitled to one-sixth each, and what remains is for the two daughters.' So what have you deprived me of?' The man said, 'I have not deprived you, it is Allah who has deprived you. He has deprived you of two-thirds for the daughters, one-sixth for the parents, and one-fourth for the husband. So it is a duty from seven and a half, and your family's duty.'"
هَذَا يَخَالُنِي امْرَءاً جَائِرًا وَأَنَا أخَالُهُ امْرَءاً فَاجِرًا يُظْهِرُ الشَّكْوَى وَيَكْتُمُ قَضَاءً سَائِرًا فَقَالَ لَهُ الرَّجُلُ مَا تَقُولُ فِي بِنْتَيْنِ وَأَبَوَيْنِ وَزَوْجٍ؟ فَقَالَ «لِلزَّوْجِ الرُّبُعُ مِنْ جَمِيعِ الْمَالِ وَلِلْأَبَوَيْنِ السُّدُسَانِ وَمَا بَقِيَ فَلِلِابْنَتَيْنِ» فَلِأَيِّ شَيْءٍ نَقَصْتَنِي؟ قَالَ «لَيْسَ أَنَا نَقَصْتُكَ اللَّهُ نَقَصَكَ لِلِابْنَتَيْنِ الثُّلُثَانِ وَلِلْأَبَوَيْنِ السُّدُسَانِ وَلِلزَّوْجِ الرُّبُعُ فَهِيَ مِنْ سَبْعَةٍ وَنِصْفٍ فَرِيضَةً فَرِيضَتُكَ عَائِلَةٌ»
[Machine] About Ibrahim, in offices, he died, and he completed half of his work, and he has a son from a free woman. He said, "I can only see his child's obligations dragging him."
عَنْ إِبْرَاهِيمَ فِي مُكَاتَبٍ مَاتَ وَقَدْ أَدَّى نِصْفَ مُكَاتَبَتِهِ وَلَهُ وَلَدٌ مِنَ امْرَأَةٍ حُرَّةٍ قَالَ «مَا أُرَاهُ إِلَّا قَدْ جَرَّ وَلَاءَ وَلَدِهِ»
[Machine] During the Mamluk era, a free person (usually a slave) would be under the authority of their master. "If a child is freed, they are considered to be free because their mother is freed. When the father is freed, the child follows their status."
عُمَرُ فِي الْمَمْلُوكِ يَكُونُ تَحْتَهُ الْحُرَّةُ «يُعْتَقُ الْوَلَدُ بِعِتْقِ أُمِّهِ فَإِذَا عُتِقَ الْأَبُ جَرَّ الْوَلَاءَ»
[Machine] "As for what she gave birth to while he was a slave, their allegiance is to her family members who were the recipients of her grace. And as for what she gave birth to while he was a free man, their allegiance is to his family members who were the recipients of his grace."
«أَمَّا مَا وَلَدَتْ مِنْهُ وَهُوَ عَبْدٌ فَوَلَاؤُهُمْ لِأَهْلِ نِعْمَتِهَا وَمَا وَلَدَتْ مِنْهُ وَهُوَ حُرٌّ فَوَلَاؤُهُمْ لِأَهْلِ نِعْمَتِهِ»
[Machine] "If a free woman serves under a slave and bears a child for him, then the child is to be freed along with its mother, and their loyalty and guardianship belongs to the mother's freedmen. But if the father is freed, the loyalty is transferred to the freedmen of his father."
عُمَرُ «إِذَا كَانَتِ الْحُرَّةُ تَحْتَ الْمَمْلُوكِ فَوَلَدَتْ لَهُ غُلَامًا فَإِنَّهُ يُعْتَقُ بِعِتْقِ أُمِّهِ وَوَلَاؤُهُ لِمَوَالِي أُمِّهِ فَإِذَا أُعْتِقَ الْأَبُ جَرَّ الْوَلَاءَ إِلَى مَوَالِي أَبِيهِ»
[Machine] "They divided his inheritance among those who used to share with them in giving."
"So his inheritance was divided among those who used to take part in charitable donations with him in his lifetime."
«أَنْ قسِمُوا مِيرَاثَهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمُ الْعَطَاءَ» فَقُسِمَ مِيرَاثُهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمُ الْعَطَاءَ فِي عِرَافَتِهِ
[Machine] "The believer does not eat until his stomach is completely full, and his conscience remains under his control."
«الْمُؤْمِنُ لَا يَأْكُلُ فِي كُلِّ بطنه وَلَا تَزَالُ وَصِيَّتُهُ تَحْتَ جَنْبِهِ»
“I said to Abdullah bin Abu Awfa: 'Did the Messenger of Allah ﷺ make a will concerning anything?' He said: 'No.' I said: 'How come he told the Muslims to make wills?' He said: 'He enjoined (them to adhere to) the book of Allah (SWT).” Malik said: “Talhah bin Musarrif said: 'Huzail bin Shurahbil said: “Abu Bakr was granted leadership according to the will of Messenger of Allah ﷺ?” (Rather) Abu Bakr wished that the found a covenant (in that regard) from Messenger of Allah ﷺ, so he could fetter his nose with a (camel's) nose ring.” (Using translation from Ibn Mājah 2696)
سَأَلْتُ عَبْدَ اللَّهِ بْنَ أَبِي أَوْفَى أَوْصَى رَسُولُ اللَّهِ ﷺ؟ قَالَ لَا قُلْتُ فَكَيْفَ كُتِبَ عَلَى النَّاسِ الْوَصِيَّةُ أو أُمِرُوا بِالْوَصِيَّةِ؟ فَقَالَ «أَوْصَى بِكِتَابِ اللَّهِ ﷻ» وقَالَ هُزَيْلُ بْنُ شُرَحْبِيلَ «أَبُو بَكْرٍ كَانَ يَتَأَمَّرُ عَلَى وَصِيِّ رَسُولِ اللَّهِ ﷺ؟ وَدَّ أَبُو بَكْرٍ أَنَّهُ وَجَدَ مِنْ رَسُولِ اللَّهِ ﷺ عَهْدًا فَخَزَمَ أَنْفَهُ بِخِزَامَةٍ ذَلِكَ»
[Machine] "If you do not leave wealth, leave it for your children."
«لَا لَمْ تَدَعْ مَالًا فَدَعْ مَالَكَ لِوَلَدِكَ»
[Machine] About Ibrahim, there was a man who made a will, and the heirs were witnesses, so he said, "It is not permissible." Abu Muhammad said, meaning if they deny afterwards.
عَنْ إِبْرَاهِيمَ فِي رَجُلٍ أَوْصَى وَالْوَرَثَةُ شُهُودٌ مُقِرُّونَ فَقَالَ «لَا يَجُوزُ» قَالَ أَبُو مُحَمَّد يَعْنِي إِذَا أَنْكَرُوا بَعْدُ
[Machine] "Concerning a shurayh (a stipulation) in a man's will that recommends more than two-thirds of his wealth, he said: If the heirs approve it, we will grant it. And if the heirs reject it, we still have the choice when they remove their hands from the grave."
عَنْ شُرَيْحٍ فِي الرَّجُلِ يُوصِي بِأَكْثَرَ مِنْ ثُلُثِهِ قَالَ إِنْ أَجَازَتْهُ الْوَرَثَةُ أَجَزْنَاهُ وَإِنْ قَالَتِ الْوَرَثَةُ أَجَزْنَاهُ فَهُمْ بِالْخِيَارِ إِذَا نَفَضُوا أَيْدِيَهُمْ مِنَ الْقَبْرِ
[Machine] Concerning the man the will is advised to allocate more than one-third, will the heirs be satisfied? He said, "It is permissible." Abu Muhammad said, "We permitted it during his lifetime."
عَنْ الْحَسَنِ فِي الرَّجُلِ يُوصِي بِأَكْثَرَ مِنَ الثُّلُثِ فَرَضِيَ الْوَرَثَةُ؟ قَالَ «هُوَ جَائِزٌ» قَالَ أَبُو مُحَمَّد أَجَزْنَاهُ يَعْنِي فِي الْحَيَاةِ
[Machine] "They used to impose taxes at a rate of one-fifth and one-fourth, and the one-third was the highest tax. Abu Muhammad said that by 'al-jamih' [the highest tax], it means a spirited horse."
«إِنَّمَا كَانُوا يُوصُونَ بِالْخُمُسِ وَالرُّبُعِ وَكَانَ الثُّلُثُ مُنْتَهَى الْجَامِحِ» قَالَ أَبُو مُحَمَّد يَعْنِي بِالْجَامِحِ الْفَرَسَ الْجَمُوحَ
[Machine] Regarding Ibrahim, "In the wealth of the orphan, the guardian works when entrusted to a man."
عَنْ إِبْرَاهِيمَ «فِي مَالِ الْيَتِيمِ يَعْمَلُ بِهِ الْوَصِيُّ إِذَا أَوْصَى إِلَى الرَّجُلِ»
[Machine] Umar used to share with his brother and two siblings, and when they increased, he gave him one-third, and he gave him one-sixth with the child.
«كَانَ عُمَرُ يُقَاسِمُ بِالْجَدِّ مَعَ الْأَخِ وَالْأَخَوَيْنِ فَإِذَا زَادُوا أَعْطَاهُ الثُّلُثَ وَكَانَ يُعْطِيهِ مَعَ الْوَلَدِ السُّدُسَ»
[Machine] It seems that Al-Sha'bi means Ali, may Allah be pleased with him, narrated it from Ali, may Allah be pleased with him.
كَأَنَّهُ يَعْنِي عَلِيًّا رِضْوَانُ اللَّهِ عَلَيْهِ الشَّعْبِيُّ يَرْوِيهِ عَنْ عَلِيٍّ رِضْوَانُ اللَّهِ عَلَيْهِ
[Machine] Do I have any sisters? I said no. He said that the husband's share is a half and the mother's share is a third. He said, "So I tried my best to answer me and he did not answer me except by that." Ibrahim and 'Amir and 'Abdul-Rahman ibn 'Abdullah said, "No one has ever come with a obligation more confusing than the obligation you came with." He said, "So I came to 'Ubaidah As-Salmani and it was said that no one in Kufa knows more about a obligation than 'Ubaidah and Al-Harith Al-A'war. 'Ubaidah used to sit in the mosque, and when Shurayh came with an obligation that had a difficulty, he would refer it to 'Ubaidah, and he would give a ruling. So I asked him and he said, "If you want, I can tell you about the obligation of Abdullah ibn Mas'ood in this matter. He said, "For the husband, there are three shares, half for the wife, a third for the mother, and a sixth of the remaining capital for the father-in-law." Abu Ishaq said, "The father-in-law is the grandfather."
لِي هَلْ مِنْ أُخْتٍ؟ قُلْتُ لَا قَالَ لِلْبَعْلِ الشَّطْرُ وَلِلْأُمِّ الثُّلُثُ قَالَ فَجَهِدْتُ عَلَى أَنْ يُجِيبَنِي فَلَمْ يُجِبْنِي إِلَّا بِذَلِكَ فَقَالَ إِبْرَاهِيمُ وَعَامِرٌ وَعَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ مَا جَاءَ أَحَدٌ بِفَرِيضَةٍ أَعْضَلَ مِنْ فَرِيضَةٍ جِئْتَ بِهَا قَالَ فَأَتَيْتُ عَبِيدَةَ السَّلْمَانِيَّ وَكَانَ يُقَالُ لَيْسَ بِالْكُوفَةِ أَحَدٌ أَعْلَمَ بِفَرِيضَةٍ مِنْ عَبِيدَةَ وَالْحَارِثِ الْأَعْوَرِ وَكَانَ عَبِيدَةُ يَجْلِسُ فِي الْمَسْجِدِ فَإِذَا وَرَدَتْ عَلَى شُرَيْحٍ فَرِيضَةٌ فِيهَا جَدٌّ رَفَعَهُمْ إِلَى عَبِيدَةَ فَفَرَضَ فَسَأَلْتُهُ فَقَالَ إِنْ شِئْتُمْ نَبَّأْتُكُمْ بِفَرِيضَةِ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ فِي هَذَا «جَعَلَ لِلزَّوْجِ ثَلَاثَةَ أَسْهُمٍ النِّصْفَ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ السُّدُسُ مِنْ رَأْسِ الْمَالِ وَلِلْأَخِ سَهْمٌ وَلِلْجَدِّ سَهْمٌ» قَالَ أَبُو إِسْحَاقَ «الْجَدُّ أَبُو الْأَبِ»
[Machine] "Amir said, 'Take from the matter of the ancestors what the people have agreed upon.'" Abu Muhammad said, meaning the statement of Zaid.
عَامِرٌ «خُذْ مِنْ أَمْرِ الْجَدِّ مَا اجْتَمَعَ النَّاسُ عَلَيْهِ» قَالَ أَبُو مُحَمَّدٍ يَعْنِي قَوْلَ زَيْدٍ
[Machine] "The grandmother and her son are alive."
«تَرِثُ الْجَدَّةُ وَابْنُهَا حَيٌّ»
[Machine] Abu Bakr's grandmother, the mother of his father or the mother of his mother, came to him and said, "My son's son or my daughter's son has passed away and I was informed that I have a share. What is it for me?" Abu Bakr replied, "I did not hear the Messenger of Allah ﷺ saying anything about this, but I will ask the people." After performing the Dhuhr prayer, Abu Bakr asked, "Which one of you heard the Messenger of Allah ﷺ saying something about the grandmother?" Al-Mughirah bin Shu'bah replied, "I heard him saying, 'He gave her one-sixth.'" Abu Bakr asked, "Does anyone else know this except you?" Muhammad bin Muslimah said, "Yes, he is truthful." So Abu Bakr gave her one-sixth. Then another woman with a similar case came to Umar and said, "I do not know what I have heard from the Messenger of Allah ﷺ about this, but I will ask the people." They informed her with the narration of Al-Mughirah bin Shu'bah and Muhammad bin Muslimah. Umar said, "If any one of you had a share by herself, she should have one-sixth, but if both of you share together, then it is between you."
جَاءَتْ إِلَى أَبِي بَكْرٍ جَدَّةٌ أُمُّ أَبٍ أَوْ أُمُّ أُمٍّ فَقَالَتْ إِنَّ ابْنَ ابْنِي أَوِ ابْنَ ابْنَتِي تُوُفِّيَ وَبَلَغَنِي أَنَّ لِي نَصِيبًا فَمَا لِي؟ فَقَالَ أَبُو بَكْرٍ مَا سَمِعْتُ رَسُولَ اللَّهِ ﷺ قَالَ فِيهَا شَيْئًا وَسَأَسْأَلُ النَّاسَ فَلَمَّا صَلَّى الظُّهْرَ فقَالَ أَيُّكُمْ سَمِعَ رَسُولَ اللَّهِ ﷺ قَالَ فِي الْجَدَّةِ شَيْئًا؟ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ أَنَا قَالَ مَاذَا؟ قَالَ «أَعْطَاهَا رَسُولُ اللَّهِ ﷺ سُدُسًا» قَالَ أَيَعْلَمُ ذَاكَ أَحَدٌ غَيْرُكَ؟ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ صَدَقَ فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ فَجَاءَتْ إِلَى عُمَرَ مِثْلُهَا فَقَالَ مَا أَدْرِي مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ فِيهَا شَيْئًا وَسَأَسْأَلُ النَّاسَ فَحَدَّثُوهُ بِحَدِيثِ الْمُغِيرَةِ بْنِ شُعْبَةَ وَمُحَمَّدِ بْنِ مَسْلَمَةَ فَقَالَ عُمَرُ «أَيُّكُمَا خَلَتْ بِهِ فَلَهَا السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فَهُوَ بَيْنَكُمَا»
[Machine] Four grandmothers arrived, competing for the position of stolen. He canceled either the mother or the father of the mother, and inherited three: his paternal grandmother, his maternal grandmother, and his paternal grandfather's mother.
جِئْنَ أَرْبَعُ جَدَّاتٍ يَتَسَاوَقْنَ إِلَى مَسْرُوقٍ فَأَلْغَى أَمَّ أَبِي الْأُمِّ وَوَرَّثَ ثَلَاثًا جَدَّتَيْ أَبِيهِ أُمَّ أُمِّهِ وَأُمَّ أَبِيهِ وَجَدَّةَ أُمِّهِ
[Machine] "The money is for the nephew."
«الْمَالُ لِابْنِ الْأَخِ»
[Machine] "The money belongs to the niece."
«الْمَالُ لِابْنَةِ الْأَخِ»
[Machine] "Give the money to the daughter of the brother."
«أَعْطِي الْمَالَ لِابْنَةِ الْأَخِ»
[Machine] "One third belongs to his mother and the rest is for his mother's family."
«الثُّلُثُ لِأُمِّهِ وَمَا بَقِيَ فَلِعَصَبَةِ أُمِّهِ»
[Machine] About Ali and Abdullah regarding the son of Al-Mula'anah, they said, "His lineage traces back to his mother."
عَنْ عَلِيٍّ وَعَبْدِ اللَّهِ فِي ابْنِ الْمُلَاعَنَةِ قَالَا «عَصَبَتُهُ عَصَبَةُ أُمِّهِ»
[Machine] "The cursed son inherits his mother's share from him, and all of that is in the treasury."
«وَلَدُ الْمُلَاعَنَةِ لِأُمِّهِ تَرِثُ فَرِيضَتَهَا مِنْهُ وَسَائِرُ ذَلِكَ فِي بَيْتِ الْمَالِ»
