53. Fighting Rebellion (5/6)
[Machine] If you said anything else, I would contradict you.
[Machine] Ali did not curse on the Day of Jamali, nor on the Day of Nahrwan.
[Machine] Ali on the day of the Camel (referring to the Battle of the Camel), we will testify for him that there is no god but Allah and we will inherit the fathers from their sons.
[Machine] "Our brothers rebelled against us, so we fought them. They were defeated and we accepted them."
[Machine] I witnessed the battle of Siffin, and they wouldn't harm the wounded, nor kill a captive, nor loot a slain person.
[Machine] Ali said to a captive from Muawiya's companions, "I will not kill you willingly, for I fear Allah, the Lord of the worlds." Al-Shafi'i and Al-Harbi fought fiercely on the Day of Siffin, with Muawiya fighting aggressively throughout his reign, either maintaining his position or overpowering his opponents. Ali said to the captive from Muawiya's companions, "I will not kill you willingly, for I fear Allah, the Lord of the worlds." The esteemed scholar, may Allah have mercy on him, commented on the statement of Al-Shafi'i and Muawiya fighting fiercely throughout his reign, either maintaining his position or overpowering his opponents. This means that at times they were equals in battle, and at other times one would overpower the other. The captive was a member of Muawiya's faction, yet Ali did not kill him, nor did he seek permission to do so. It is said that Ali considered himself in a state of balance regarding this matter, as he claimed to seek revenge for the blood of Uthman. And he considered himself in a position of authority in the eyes of others, as they knew that Ali was innocent of Uthman's blood. The first opinion is more authentic, although there is a weak hadith narrated on this subject.
[Machine] The Messenger of Allah ﷺ said to Abdullah bin Mas'ood, "O Ibn Mas'ood, do you know the ruling of Allah regarding those who rebel from this Ummah?" Ibn Mas'ood said, "Allah and His Messenger know best." The Prophet ﷺ said, "Indeed, the ruling of Allah regarding them is that their backs should not be followed, their captives should not be killed, their wounded should not be tortured, as mentioned in the Hadith of Al-Kharrāz and in the narration of Al-Khuwārizmī. Their property should not be divided among the Muslims." This was narrated specifically by Kawthar bin Hakeem, who is weak in his narrations.
[Machine] The Messenger of Allah ﷺ said in his Farewell Pilgrimage: "It is not lawful for a Muslim to take the wealth of his brother except what he gives willingly. This is the narration of At-Taymi, and in the narration of Ar-Raqashi, it is not lawful for anyone, meaning a Muslim, to take anyone's wealth except with their consent."
[Machine] When Ali killed the people of Nahar, he went into their camp. Whoever knew anything, he took it until nothing remained. Then I saw it, so I took it afterwards. Sufyan narrated it from Ash-Shaybani from 'Arfajah from his father that Ali was given the inheritance of the people of Nahar, so he recognized it. Whoever recognized something, took it until nothing was left. We narrated from a man from the Banu Tamim, he said: I asked Ibn Umar about the wealth of the Khawarij, so he said: I do not see any spoils in their wealth.
[Machine] That he finished them off and killed them without cutting off their heads or exposing their private parts.
53.31 [Machine] The man kills one of the Muslims by interpretation, or a group of non-Muslims kill one and they deserve retaliation.
[Machine] In Ibn Muljam, after he was struck, feed him and give him water. Treat his left side well. If I live, I will forgive my blood if I want to, and if I want to avenge it. If I die, you kill him, but do not mutilate.
53.32 [Machine] Whoever says about apostates that they should be killed in battle while they are non-combatants, and then they repent, they are not to be followed by bloodshed. Imam Shafi'i, may Allah have mercy on him, said: Tulayhah bin Khuwaylid and Thabit bin Akram were killed and then they embraced Islam, so they wouldn't be given assurance of safety or strength of mind.
[Machine] When Allah appointed Abu Bakr as his caliph, some of the Arabs apostatized from Islam. The story was mentioned in the context of the mission and battle of Khalid bin Al-Walid. It is said that Tulayha was extremely skilled in battle, and that day he killed 'Ukkasha bin Mihjan and Ibn Aqram. When the truth prevailed, Tulayha dismounted and embraced Islam. He then headed towards 'Umrah with a sense of security among the people, passing by Abu Bakr in Medina, and then he went to Makkah to perform his 'Umrah. It is also reported that 'Ata bin Abi Rabah mentioned that the retaliation was pardoned for him.
53.33 [Machine] Who said: "They are followed by blood"?
[Machine] A delegation from the tribe of Buzakha, including Asad and Ghatafan, came to Abu Bakr and asked him for reconciliation. He presented them with the choice between a clear war or a humiliating peace.
[Machine] After the death of the Prophet Muhammad ﷺ, Ali refused to pledge allegiance to peace. Abu Bakr said, "We will not accept anything from you except humiliating peace or local war." Ali asked, "Is humiliating peace an actual thing?" Abu Bakr replied, "You testify that those whom we kill are in Paradise, and that your killed ones are in Hell. You record our deaths, but we do not record yours. So choose humiliating peace." It has been narrated in this story that Umar bin Khattab saw that our slain ones should not be counted, and he said, "Our killed ones were killed by the command of Allah, so they do not have blood money. And this is mentioned in the chapter of fighting the apostates, if Allah wills."
53.34 [Machine] The people express the view of the Khawarij that their fighting is not permissible. Al-Shafi'i, may Allah have mercy on him, said: We were informed that Ali, while he was delivering a sermon, heard a ruling from one side of the mosque: "There is no judgment except for Allah." So Ali ibn Abi Talib said: "There is no judgment except for Allah." It is a true word that is intended to be false. We have three things for you: We do not prevent you from mentioning the name of Allah in His mosques, we do not prevent you from taking spoils when your hands are with ours, and we do not initiate fighting against you.
[Machine] While I was on the pulpit on Friday, Ali Ibn Abi Talib stood up and said, "There is no judgment except for Allah." Then another man stood up and said the same. Then they stood up from different sides of the mosque and Ali gestured to them to sit down, saying, "Yes, there is no judgment except for Allah, a phrase sought after for a false purpose. The judgment of Allah shall be dealt with later. Look at you, the three qualities you have with me: we will not prevent you from entering the mosques of Allah to remember His name, we will not prevent you from receiving whatever you need with us, and we will not fight you until you fight us." Then he continued his speech, and a different version of some of its meanings was narrated from Ubaidullah Ibn Abu Rafe' about Ali.
[Machine] Ali heard a group of people saying, "There is no authority except for Allah." He said, "Yes, there is no authority except for Allah, but people must have a righteous or corrupt leader who the believers work under and the disbelievers enjoy living under, and Allah will ultimately judge them in it."
[Machine] And he said, "Why do you not speak?" So I remained silent. Then he returned with something similar, so I said, "Shall I kill you, O Amir al-Mu'minin?" He said, "No, but he insulted the caliphs." So I said, "Then I think he should be punished for violating the sanctity of the caliphs."
[Machine] "That I would reconsider it and write to him, 'Umar ibn Abd al-Aziz sent greetings to you. As for what follows, by the One in whose hand is my soul, if you had killed him, I would have killed you with him, and if you had cut him, I would have cut you with him, and if you had beaten him, I would have beaten him more severely than you. So when this letter of mine reaches you, take it to the common people and curse the one who cursed me or forgive him, for that is dearer to me. For it is not permissible to kill a Muslim because of the curse of someone else, except in the case of someone who curses the Messenger of Allah ﷺ , for whoever curses the Messenger of Allah ﷺ , his blood is permissible (to be shed)."
53.35 [Machine] The Khawarij abandon the group of people, they kill their governor from the side of the just Imam before they appoint an Imam, and they believe and show a judgment contrary to his judgment, in which case retribution is imposed on them.
[Machine] "I killed him and Ali was informed. He sent to them, 'Bind us with Abdullah bin Khabbab.' They said, 'How can we bind you with him when we all killed him?' He said, 'Did all of you kill him?' They said, 'Yes.' He said, 'Allah is the greatest.' Then he ordered them to be arrested and said, 'By Allah, no group of ten among you will be killed and no group of ten among you will escape.' They killed them. [Machine] I was in Sham (Damascus) when Al-Muhallab sent sixty heads of the Khawarij and they were stationed at the steps of Damascus. I was on the back of my house when Abu Umamah passed by, so I got down and followed him. When he stood in front of them, tears welled up in his eyes and he said, "Glory be to Allah! How does Satan influence the sons of Adam three times? The dogs of Hell, the dogs of Hell, the worst of killers under the shade of the sky, three times! The best of those who kill are those who kill them, and blessed are those who kill them or are killed by them." Then he turned to me and said, "O Abu Galib, may Allah protect you from them." I said, "I saw you cried when you saw them." He said, "I cried out of mercy when I saw them. They used to be Muslims. Do you recite Surah Al-Imran?" I said, "Yes." Then he recited, "It is He who has sent down to you, [O Muhammad], the Book; in it are verses [that are] precise - they are the foundation of the Book - and others unspecific. As for those in whose hearts is deviation [from truth], they will follow that of it which is unspecific, seeking discord and seeking an interpretation [suitable to them]. And no one knows its [true] interpretation except Allah. But those firm in knowledge say, "We believe in it. All [of it] is from our Lord." And no one will be reminded except those of understanding." (Al-Imran 7) until it reaches, "And do not be like the ones who became divided and differed" (Al-Imran 105) until it reaches, "But as for those who were destined to be prosperous, they will be in Paradise, abiding therein as long as the heavens and the earth endure" (Al-Imran 107). I said, "Are they the ones you were referring to, O Abu Umamah?" He said, "Yes." I said, "Before you, did you ever say anything or hear anything from the Messenger of Allah ﷺ ?" He said, "Then I would be wrong (to say so), but I heard him say this, not once or twice, until he counted seven. Then he said, 'The Children of Israel divided into seventy-one sects, and this nation will divide into seventy-two, all of which are in the Fire except one, which is the Jama'ah (main body).' I said, 'O Abu Umamah, don't you see what they are doing?' He said, 'Upon them is what they bear, and upon you is what you bear.'"

If you do not cut it off, I will inform you of what Allah has ordained on the tongue of His Prophet ﷺ about those who killed them. Ubaydah said, "So I said to Ali, 'Did you hear this from the Prophet ﷺ ?' He said, 'Yes, by the Lord of the Ka'bah, yes, by the Lord of the Ka'bah, three times.'" Ash-Shafi'i (may Allah have mercy on him) said: There have been a group of people who rejected fighting against the rebellious faction and said that the rebellious faction are disbelievers and not Muslims. They claimed that it is not permissible to fight against Muslims, because the Messenger of Allah ﷺ said: "The blood of a Muslim may not be shed except in three cases: a person who reverts to disbelief after becoming Muslim, a married person who commits adultery, and a person who kills someone, so he is to be killed in return." They said: The Messenger of Allah ﷺ prohibited shedding blood except in these cases, so it is not permissible to shed blood except in these cases. They considered fighting against Muslims as killing them, because fighting leads to killing. Ash-Shafi'i said: It is said to them that Allah commanded fighting against the rebellious group and the Messenger of Allah ﷺ also commanded that. Fighting is not killing by its nature, because sometimes it is permissible to fight against a Muslim but killing him is not permissible. Similarly, it is permissible to injure him or strike him, but it is not permissible to kill him. Then he mentioned that the companions of the Messenger of Allah ﷺ did not object to Ali's fighting against the Khawarij, but they objected to his fighting against the people of Basra and the people of Sham. They disliked it and did not dislike his treatment of the Khawarij. The Shaykh (may Allah have mercy on him) said: This is how...

The people used to ask Messenger of Allah ﷺ about good, but I used to ask him about evil for fear that it might overtake me. Once I said, "O Messenger of Allah ﷺ! We were in ignorance and in evil and Allah has bestowed upon us the present good; will there by any evil after this good?" He said, "Yes." I asked, "Will there be good after that evil?" He said, "Yes, but it would be tained with Dakhan (i.e. Little evil)." I asked, "What will its Dakhan be?" He said, "There will be some people who will lead (people) according to principles other than my tradition. You will see their actions and disapprove of them." I said, "Will there by any evil after that good?" He said, "Yes, there will be some people who will invite others to the doors of Hell, and whoever accepts their invitation to it will be thrown in it (by them)." I said, "O Messenger of Allah ﷺ! Describe those people to us." He said, "They will belong to us and speak our language" I asked, "What do you order me to do if such a thing should take place in my life?" He said, "Adhere to the group of Muslims and their Chief." I asked, "If there is neither a group (of Muslims) nor a chief (what shall I do)?" He said, "Keep away from all those different sects, even if you had to bite (i.e. eat) the root of a tree, till you meet Allah while you are still in that state."
